question
is
because

does
this
city
council
have
a
lawful
right
to
their
seat
and
the
reason
I'm
asking
that
is
because
the
last
time
I
was
here,
I
made
a
statement
and
it
was
a
reaction
of
one
of
the
city.
Councilmen
that
made
me
wonder,
am
I
right?
Do
you
have
a
lawful
right
to
sit
on
those
seats
under
North
Carolina
constitutional
law?
Bothwell
was
the
one
that
first
found
out
about
it
because
when
he
first
ran
for
City
Council,
it
was
assumed
that
he
was
an
atheist.

the
statement
was
he
could
not
run
for
City
Council,
because
North
Carolina
constitutional
law
stated
you
must
be
a
Christian,
not
a
Muslim,
not
a
Hindu,
but
a
Christian.
They
was
specific
base
under
the
apostles
creed
or
the
nia
seen
creed.
Now
it
never
got
resolved
because
Bothwell
immediately
claimed
that
he
was
some
other
unitarian
belief.
And
if
I
remember
right,
the
unitarian
belief
does
not
fall
into
the
Christian
belief.

according
to
the
NIA
seeing
Creed,
they
did
not
accept
Jesus
Christ
as
the
Son
of
God
born
of
the
Virgin
Mary.

can
read

legislative
update
and
we

hear

Paul
Featherston
making
his
second

mayor
members
of
council,
just
briefly
to
update
you
on
where
the
legislative
session
is.
As
you
know,
the
short
session
started
on
May
the
14th.
Originally
we
heard
that
it
might
be
one
of
the
fastest
sessions
in
history
that
I
might
end
by
this
month.
What
we,
then
we
heard
it
was
going
to
be
July
4th,
and
today
we
heard
it
was
going
to
be
ja.
July
eleventh,
there's
also
been
some
recent
statements
by
the
chairman
of
the
Rules
Committee
that
he
may
adjourn
it.

May
the
legislature
may
adjourn
without
a
budget,
so
it's
certainly
something
to
watch
so
checking
in
with
our
lobbyists
today.
He
advised
us
that
Thursday
is
the
last
day
of
regularly
scheduled
committee
meetings
in
the
Senate,
and
it's
going
to
be
a
busy
frenetic
week.
There's
a
lot
of
action
happening
on
others,
they're,
conferring
on
the
budget
and
also
doing
a
lot
of
work
on
some
bills,
so
just
to
update
you
on
a
high
level,
so
the
coal
ash
bill
it's
on
the
Senate
floor
this
afternoon.
It's
expected
to
pass.

The
third
reading
would
be
tomorrow
and
then
refer
to
the
house,
and
there
was
no
amendments
from
the
bill
late
last
week,
zoning
design
and
aesthetic
controls.
What
we
know
about
this
is
that
the
future
is
uncertain.
It's
currently
in
the
Senate
rules,
but
the
Senate
rules
committee
can
meet
at
any
time
at
the
call
of
the
chair,
and
so
jack
told
us
to
be
prepared
that
this
will
feature.
This
will
remain
uncertain
until
adjournment.

public
safety,
omnibus
justice
amendments-
this
includes
the
penalty
for
graffiti
vandalism.
It
increases
the
penalty,
it's
a
felony
if
the
cost
to
repair
is
in
excess
of
a
thousand
dollars
and
the
person
has
two
or
more
prior
convictions
for
the
violation.
It
has
passed.
The
Senate
it's
in
the
house.
Appropriations
was
added
to
the
Senate
bill
and
would
have
to
go
back
to
Senate
and
it's
expected
to
be
finished
by
the
middle
of
next
week.

lobbyists
indicated
that
it
may
be
too

this
session
and
it
may
end
up

the
next

because
there's
so
much
information
in
it,
it's
not
only

graffiti
bills.

changes
in
that
act.

exemptions.
This
passed
the
senate
government
local
government
committee
earlier
this
afternoon,
the
asheville
regional
airport.
This
would
provide
elected
public
official
representation
for
on
the
asheville
regional
airport
authority,
and
this
also
passed
earlier
today.

then
economic
development
and
I'm
going
to
merge
two
into
one,
so
there's
two
issues
that
we
watched
on
this
one.
This
is
the
one
I
was
on
the
film
credit.
This
Senate
turned
the
incentive
program
into
a
pared-down
grant.
The
house
then
rejected
the
amendments
to
the
budget,
which
would
renew
the
credits
and
it's
in
budget
negotiations
right
now.
So
the
film
credit
issue
is
in
budget
negotiations
on,
because
the
house
and
the
Senate
couldn't
agree
on
how
to
approach
it.
Same
is
kind
of
true
for
the
historic
rehabilitation
credits.

Then,
a
late
coming,
one
s,
493
regulatory
reform
acts.
So
this
addresses
two
items:
one
is
it
eliminates.
Zoning
petitions
and
the
other
item
introduces
new
ethics
requirements
for
City
Council's,
with
a
population
greater
than
7
7500.
This
require
governing
boards
of
City
and
counties
to
file
a
statement
of
economic
interest
by
April
fifteenth
of
each
year.

elected
officials
cannot
mention
the
mem,
their
public
position
and
non-governmental
ads
that
advances,
members
or
other
private
interests.
Elected
members
can't
use
public
funds
for
adds
up
other
than
an
emergency,
and
they
can't
disclose
nonpublic
information
gained
in
the
course
of
official
responsibilities.
That
would
affect
personal
financial
interests
of
them
or
other
people.
And
again
it
only
applies
to
cities
of
a
population
of
75,000
or
more,
but.

think
that
there
was
a
pretty
interesting
quote
on
the
House
floor
who
of
the
bill
the
carrying
this
bill
in
the
House
floor,
he
said
a
saint,
my

I'm
just
walking
it
because
the
bill
sponsor
wasn't

it
last
I
heard
it
went
back
to
committee.
But
maybe
it's
been
resurrected.

landscaping

we've
stated,
this
is
a
conditional
zoning
request
for
a
single
parcel.
This
site,
as
you
can
see
on
the
exhibit

map,
consists
of
one
parcel
just
under
an
acre
in
size
at
573,
fairview,
road
fairview
road
just
2
is
here
to
the
north,
and
the
property
also
has
significant
frontage
along
Shannon
drive.
This
is
in
the
Oakley
neighborhood,
the
site
is
zoned
neighborhood
business
and,
as
you
can
see,
parcels
across
fairview
road
are
also
neighborhood
business,
as
well
as
immediately
adjacent.

The
remainder
of
the
boundaries
are
all
zoned
rs8.
The
site
is
currently
owned
by
helps
internationals
ministries
and
it's
used
for
offices
and
the
new
the
proposals
to
retain
the
existing
building,
a
general
site
layout
that
you
can
see
here
on
the
aerial
for
the
new
owner,
which
is
roots
and
wings
School
of
Art
and
Design.
They
are
proposing
several
uses
offices
preschool
studio,
space
and
instructional
services.
Currently,
only
office
uses
are
allowed
in
neighborhood
business.
The
rest
of
those
uses
that
they're
proposing
aren't
permitted
in
neighborhood
business.

They
are
in
community
business,
which
is
a
similar
low
intensity,
neighborhood-based
zoning
district,
which
is
why
staff
and
the
applicant
selected
that,
as
their
proposed
conditional
zoning
as
I
mentioned,
the
site
will
remain
primarily.
The
same
here
is
a
site
plan.
You
can
see.
Here's
the
building,
fairview,
road
or
shannon
drive
the
owner
will
be.
The
new
owner
would
be
reusing.
The
existing
building
and
a
couple
of
small
changes,
one
is
which
is
sort
of
reorienting
the
flow
of
traffic.

Currently
cars
can
enter
and
exit
from
both
driveways,
but
the
applicant
is
proposing
for
all
traffic
to
enter
from
Shannon
and
exit
onto
fairview
road
and
that
reorientation
will
minimize
some
traffic
impact
to
the
neighbors
that
are
across
the
street
on
Shannon
drive.
That's
a
that's
a
positive
change,
also
they're.
The
only
other
real
site
change
will
be
landscaping,
that's
required,
and
that
is
the
basis
of
the
modifications
that
you've
seen
in
the
report.
I
spoke
too
soon,
there's
one
other
very
notable
change,
and
that
is
the
addition
of
sidewalk
there's.

Currently,
no
sidewalk
along
Shannon
drive
the
applicants
proposing
to
put
a
five-foot
sidewalk
along
that
full
stretch,
their
sidewalk
on
fairview
road,
but
the
sidewalk,
that's
just
in
front
of
the
buildings
actually
flush
with
the
street
and
they're
going
to
upgrade
that
with
curb,
so
that
it's
a
safer
situation
for
pedestrians
right
there.
So
that
is
a
notable
change.
I
didn't
want
to
leave
that
one
out,
but
back
to
the
landscaping
because
of
the
adjacent
parcels
being
zoned
RS
we've
got
a
landscape
property
line
buffer,
that's
required
the
three
modifications
one
it
would
be.

There
would
be
that
30
foot
buffer
required
right
here,
there's
just
not
room
because
of
the
existing
location
of
the
building
along
the
sides.
Here,
the
back
of
the
property
in
lieu
of
the
30
foot
buffer,
the
applicants
proposing
to
reduce
it
by
fifty
percent,
and
that
is
supported
by
staff,
because
this
entire
area
here
is
going
to
remain
as
an
open
space.
It's
a
grass
field
and
there'll
be
a
playground.
So
it's
really
not
a
high
intensity
area,
as
a
staff
felt
that
producing
that
buffer
was
was
appropriate.

The
third
area
of
non-compliance
is
a
long
Shannon
drive.
They
would
be
required
again
that
30
foot
buffer
and
lieu
of
that
that
applicant
is
proposing
to
put
in
a
grass
strip
and
then
that
Sidewalk
separating
the
sidewalks
on
the
street
and
then
behind
the
sidewalk
would
be
a
planting
strip
with
street
trees,
evergreen
shrubs
and
the
street
buffer.
That
would
be
required
down
here
next
to
the
parking
lot.
So
staff
is
supportive
of
all
of
those
modification
requests.

We
think,
given
the
improvements
to
the
site
this
this
will
these
landscaping
improvements
will
provide
some
buffering,
but
it
also
allows
the
site
to
integrate
into
the
neighborhood,
not
just
be
walled
off
with
landscaping
so
good,
like
that,
the
project
was
approved
with
conditions
by
the
TRC
on
May
nineteenth,
the
Planning
and
Zoning
Commission
reviewed
the
proposal
on
june
fourth
and
recommended
unanimous
support.
The
applicant
held
a
community
meeting
back
in
May.
No
opposition
has
been
received.

We
have
received
multiple
letters
and
emails
of
support
that
were
forwarded
along
to
you,
so
staff
does
recommend
approval
of
the
conditional
zoning
request
from
neighborhood
business
to
see
be
one
for
the
uses
that
were
described
and
included
in
your
staff
report,
as
well
as
in
the
exhibit
list.

the
ordinance.
This
includes
support
of
the
landscape,
modifications.
One
note
about
the
list
of
the
conditions:
that's
in
your
packet.
We
staff
noted
in
that
list
that
we
classified
it

art-based

classify

a

and
those

right

ashland
avenue,
both
requests

straight
rezoning
from
regional
business

central

Because
of
these
multiple
requests,
staff
and
the
downtown
commission
have
started
to
undertake
a
zoning
study
for
a
corridor
wide
rezoning,
multi,
first
parcel
rezoning-
and
that's
what's
shown
here
on
this
map.
This
is
the
ashland
avenue,
CBD
expansion
study.

It's
not
just
because
of
the
requests
that
have
been
received,
also
in
the
downtown
master
plan.
The
maps
of
several
maps
that
were
included
in
that
plan
that
was
adopted
back
in
2009
showed
expanding
the
CBD
in
this
area
along
ashland
avenue.
So
it's
been
contemplated
by
the
consultants
it's
been
by
the
staff
and
now
by
multiple
property
owners
and
again
here's
the
two
locations
that
were
approved
back
in
2013
and
then
the
the
subject
property
for
tonight's
consideration
is
just
right
there.
In
this
consideration,
that's
been
going
on.

The
staff
and
members
of
the
downtown
commission
met
with
property
owners
along
the
corridor
back
in
January
of
this
year,
and
that
was
a
kickoff
to
aging
interest
in
the
multi
parcel
rezoning.
We
had
pretty
significant
interest
from
the
property
owners.
No,
no
opposition.
The
next
step,
then
from
the
staffs
perspective,
is
to
reach
out
to
the
neighbors
that
are
in
this
neighborhood
to
talk
to
them
about
the
proposed
rezoning,
and
we
just
haven't
gotten
to
that
step
yet
because
of
other
workloads.
But
in
the
meantime
this
this
application
came
in.

was
a
lot
of
background
on
just
what's
going
on
in
the
area
right
now.
The
request
for
rezoning
also
includes
the
request
to
amend
the
height
zone
map.
This
is
that
height
zone

you're
all
familiar
with
the
areas

areas
in
green
are
the
intermediate
height
zone.
The
downtown
Commission
suggested
and
staff
also
recommends
rezoning
when
we
resume.

they'll
pass
to
rezoning

additionally

change

the

are

things

ordinance

street
cut
utility
fund.

that's
the

had
the
impact
actually
on
the
total
budget
was

sixty
seven
thousand
dollar
addition
of
two
full-time
positions:
the

Attorney's

trying
to
provide
is
flexibility
to
the
city
attorney
to
reallocate
funds
as
necessary
in
her
reorganization
of
the
department
to

most
effective

capital
improvement

we
reallocated

hundred
thousand
dollars,
fifty
thousand
dollars
from
charlotte
street
and
fifty
from
town
branch
Greenway
to
do
the
first
hundred
thousand
dollars
funding
of
the
neighborhood
sidewalk

project

the

current

estimated

million
dollars
plus
the
city
budget

provisions

payment

city
council
is
requiring
pack
place
to
make.

that

correct,

to
assume
that
obligation
in
addition
to
the
two
million
capital
expense.
Finally,
that

are
other
expenses,
mainly
building
code,
compliance

could
cost
upwards
to
three
million
dollars.
That's

total
forecast
of
roughly
six
million
dollars
without
considering
the
cost
of
operations,
and
it
is
not
minimal
operations.

be

benchmark

each
crop
you
know
we're
consuming

residential
and
commercial
basis

some
great
nonprofits
in
the
area
that
would

potentially
able

help
in
that
regard.

is
something
I've
mentioned
before
and
that's
to
bring

a
new
staff
member
within
the
Office

Sustainability
to
analyze
the
impact
of
new
development

wanting

kind

new
company
in
town.
They
have
a
product
called
the
smart
wall
and
the
smart
wall
is
a
green
building
material
that
has
an
r-value
of
over
50
and
when
you
take
the
material
costs
in
the
labor
costs
against
traditional
construction,
material
cost
and
labor
costs
it's
about
a
wash.

two

I

years
alleged

on

have
contacted

times

said

institution

doubt
if
that
will
happen,
but
government
bureaucracy

tell

on

daily
basis,

placards
