the
items
and
with
that
I

our
Council
agenda.
First,
under
proclamations,
we
have
September
12
2023
is
Mana
Food
Bank
day
moving
into
the
consent
agenda
and
I'm
just
going
to
cover
two
items
today
on
the
consent,
actually
I'm
going
to
do
one
and
ask
Brad
to
do
the
other,
but
if
there
are
other
items
you
want
to
discuss,
please
let

First
I
wanted
to
identify
consent.

Item

this
is
a
long-standing
agreement
that
actually
dates
back
to
2013.
and
I.
Think
it's
a
very
positive
thing.
This
is
an
automatic
Aid
agreement
between
the
city
of
Asheville
and
the
Reems
Creek
Fire
Department,
and
what
this
does.
It
strengthens
the
standard
of
response
and
coverage
for
our
fire
service
in
the
Beaver
Dam
Valley
area.

that

members
to
become
familiar
with,
because
you're
going
to
begin
seeing
this
on
a
monthly
basis
going
forward
on
your
agendas.
This
is
something
that
has
historically
been
handled
entirely
by
Buncombe
County.
We
have
a
long-standing
agreement
where
the
county
handles
all
of
the
tax
collection
for
the
city
and
as
part
of
that
process,
they
have
also,
on
a
monthly
basis,
approved
any
requests
for
refunds
or
releases.

However,
a
recent
interpretation
of
the
statute,
which
requires
the
governing
board
of
a
taxing
authority
to
approve
these
things,
has
led
us
to
believe
that
it
is
a
good
practice
for
the
city
going
forward
to
do
exactly
what
the
county
is
already
doing,
which
is
for
ourselves
and
our
own
tax
collection
purposes,
approved
on
a
monthly
basis
per
statute.
All
of
the
requested
releases
and
refunds.
This
process
will
still
be
managed
by
the
county
going
forward.

what
you're
doing
is
taking
a
procedural
step
to
comply
with
the
statute,
which
does
require
the
governing
board
to
take
this
action
on
a
monthly
basis.
All
of
the
actual
work
will
be
done
by
the
county,
which
we
will
continue
to
coordinate
on,
so
they
will
be
providing
us
the
information
they
will
be
approving
this
as
well
on
their
end
and
asking
you
to
provide
that
cursory
approval
on
a
monthly
basis.
So
you'll
see
this
at
once
a
month
meetings
going
forward.

department,

that

then
contact
the
appropriate
on-call
staff
to
address
that
issue,

it
basically
gives
us

spot

from
the
Emma
Community
chicken
Hill,

Arts
District

New
Belgium
side
and
the
west
gate
exit

a
sidewalk
there
right
now,
but
in
the
absence
of
a
sidewalk
that
corner
is
used
is
pretty
significant
landing
spot.

can
tell
from
all
the
grasses
pressed
down
by
feet
and
other
devices,
so
I'm
curious
when
we
have
multimodal
projects
close
by
it's
a
access
to
the
closest
grocery
store
for
the
river
Arts
District,
though
it's
a
little
tricky
that
way
also
Transit
stops
and
to
and
from
our
River
Arts
District
Greenway
system.
What
is
the
future
plan
for
sidewalks
instead
of,
what's
being
used?
Essentially
in
the
right-of-way
there.

under
that
first
item
is,

the
pack
Square
visiting
concept
plan
and
I'll
just
want
to
take
a
second
or
a
few
minutes
here
to
walk
through
that,
and
one
thing
to
note
about
this
particular
process
is
on
on
your
next
meeting.
Your
September
12th
meeting
you'll
have
a
presentation
on
this
planning
effort,
but
we're
not
asking
the
council
to
take
any
kind
of
action
at
that
meeting.
So
this
is
simply
just
a
presentation
and
Mitchell
silver
who's.

lead
consultant
will
will
be
providing
that
presentation
at
your
next
meeting
and
then
we're
going
to
bring
it
back
to
the
September
26th
meeting
to
have
the
public
Hearing
in
any
kind
of
action
from
Council.
So
just
want
to
clarify
those
two
points
in
the
process.
For
this
particular
item,
the
packs
are
visiting
concept
planning
process
began
with
the
work
of
The
Joint
City
County
Advance
Monument
task
force
and
in
March
2021
city
council
adopted
a
resolution
to
remove
the
advanced
monuments.

Following
now,
the
city
council
and
Buncombe
County
Commissioners
contributed
funding
for
a
planning
process
to
develop
a
vision
for
this
site
for
this
portion
of
the
city
of
the
county
on
June
2022
city
council
authorized
a
contract
with
McAdams
company
to
lead
the
engagement
process
and
begin
to
develop
this
planning
effort
for
that
portion
of
pack
Square
Park
the
project
kicked
off
in
late
summer,
2022
included
significant
public
engagement
was
led
by
our
planning
and
Urban
Design
department
and
is
now
complete
and
is
coming
to
this
Council
for
consideration
just
to
take
us
a
few
minutes
to
talk
about
the
plan
itself.

Overall,
the
vision
in
the
plan
states
that
the
Pax
Square
Plaza
in
the
future
should
do
a
couple
things.
One
of
that
area
should
be
more
usable
and
accessible,
provide
new
experiences
and
amenities
be
a
place
for
sharing
stories
and
addressing
past
harms
and
better
connect
pack
Square
to
the
block.

It
considers
a
number
of
public-private
Partnerships
in
the
future
around
that
space,
then,
as
I've
mentioned,
really
how
to
connect
the
Block
in
pack
Square
Plaza
and
make
those
more
cohesive
and
connected
in
general
and
then.
Finally,
the
plan
does
anticipate
some
of
the
potential
costs
and
phasing
of
these
types
of
improvements
in
the
pack
Square
Plaza
area.

The
general
framework
of
the
plan
you'll,
see
this
and
and
staff
and
Mitchell
silver
will
obviously
go
into
more
detail
on
this,
but
it
really
it
really
creates
the
community
input
and
kind
of
frames
that
into
10
themes.
So
there's
10
themes
of
the
engagement
and
then
as
a
response.
It
establishes
10
design-based
ideas
to
kind
of
help
God
in
a
future
Improvement
projects
that
are
associated
with
the
engagement
process
planning
and
economic
Economic
Development
Council
committee.
Has
those
members
have
seen
this
a
couple
times.

They've
discussed
this
and
at
their
eight
or
August
14th
meeting,
they
voted
unanimous
leader
recommend
to
city
council
and
that's
where
we
really
develop
the
schedule
of
having
the
presentation
of
the
plan
on
September
12th
and
then
consideration
of
adoption
on
September
26th.
Downtown
commission
has
also
heard
updates
on
this
planned
and
they
voted
unanimously
to
recommend
adoption
of
the
plan,
the
council
and
finally,
this
will
go
to
our
Planning
and
Zoning
Commission
on
September
14th.

don't
have
that
action
from
the
Planning
and
Zoning
commission
yet,
but
we'll
have
that
in
place
prior
to
any
Council
consideration
for
adoption.

next
item

is
the
manager's
report,
and
this
is
really
kind

an
update

some
organizational
initiatives.

hotel
with
between

and
300
guest
rooms
and.

of
this
project

the

between

residential

little
bit
out
of
the
ordinary
in
that
you
are
not
seeing
the
proposed
rezoning
request
at
the
same
time
or
even
after
you
have
seen
any
requests
for
subsidies
or
other
similar
requests
from
the
developer
themselves.

So
it
is
very
important
just
to
give
you
a
quick
reminder
that
your
decision
on
this
particular
item
on
the
agenda
will
be
purely
the
zoning
question,
which
means
you
must
limit
your
decision-making
process
to
two
things
number
one,
whether
or
not
the
rezoning
request
is
consistent
with
the
approved
area
plans
and
number
two
is
the
request
reasonable
and
there
are
various
factors
which
we
can
talk
about
more
in
detail.

But,
generally
speaking,
the
most
important
aspect-
I
want
you
to
remember-
is
we're
not
taking
into
consideration
any
future
requests
for
entitlement
or
the
financing
portion
of
this
particular
development.
Only
the
development
land
entitlement
itself
and
whether
or
not
that
is
consistent
and
whether
or
not
it
is
reasonable
for
this
particular
location.
So
please,
let
me
know
if
we
need
to
go
over
any
more
details
about
that
in
advance,
but
given
the
complexity
of
potential
future
asks,
I
wanted
to
remind
Council
of
that
dynamic.

they're

like

follow-up
memo

something

I
was
trying
to
remember
when
we
did
the
first
micro
unit
over
by
I
guess
on
Hilliard
it
was
the
first
time
we
saw
the
Luigi
ask
and
a
conditional
zoning
ask
at
the
same
time
and
the
conversation
was
a
little
messy,
because
what
I
understood
was
we
always
had
to
have
a
Luigi
ask
before
the
CZ
ask
and
I
think
we
changed
that
rule
and
I
thought
we
brought
it
to
concurrent,
but
because
someone
verify
that
I
really
couldn't
find
the
documents
to
confirm
and
I'm
just
not
sure,
because
I
understand
there
will
be
a
Luigi
and
I
understand
what
you're
saying
this
is
just
the
entitlement,
but
don't
we
have
a
process
that
makes
the
Luigi
happen
simultaneously
if
you
could
just
confirm
and
and
then
I
think
well,
one
is
I'd
love
to
hear.

last
delay
was
due

wanting
to
have
input
from
the
East
End
community
directly.

saw

entitling

be
layered

housing

affordable
portions

provide

units

something
that
affordable

that's

wondering
if
there
is
a
time
to
add
some
other
conditions
that
I
had
in
discussions
with
them,
which
of
course
would
need
to
be
verified
and
check
with
them
ahead
of
our
hearing.
So
those
would
be,
one

them
is
around
the
gating.

time
we
had
a
project
this
large.
It
was
that
Cox
in
Ashland
with
you,
know,
550
units
or
something
and
100
000
square
feet
of
retail,
and
they
were
they
went
through
design
and
ended
up
like
fencing
off
half
of
it
and
it
wasn't
all
Ada
accessible
and
when
I
was
talking
with
the
development
team
about
this
and
they're
more
than
more
than
amenable.

other
thing
that
I
had
talked
to
them
about
and
I'm,
not
sure
where
this
landed
was
the
idea
that,
since
their
first
phase
has
a
hotel
request,
I
was
a
little
concerned
that
they
weren't
going
through
the
typical
hotel
process,
because
I
think
you
know,
after
115
rooms
it
has
to
come
to
council
but
up
to
115
rooms.
We
have
these
like
basic
things.
This
community
benefits
table
these
activation
of
retail.

that
we
made
and
in
my
impression
when
you
go
bigger
than
those
you
still
have
to
meet
those
basic
rules,
so
I'm
not
sure
if
they
have
submitted
anything
around
a
community
benefits
table.
If
they
have,
could
we

all
those
things
that
we
normally
look
at
and
then
lastly,
one
of
the
other
conditions

association

a
week
ago.

meeting
I
attended
the
meeting
lasted
two
and
a
half
close
to
three
hours.
My
understanding
is
that,
since
that
meeting,
a
committee
was
picked
by
the
Association
to
continue
conversations
with
the
developer.
My
understanding
is
those
conversations
have
continued
and
I
suspect.
A
representative
from
the
Easton
Valley
neighborhood
association
will
be
in
attendance
at
our
meeting.

know
that
one
of
their
asks
was
that
they
be
included
in
the
process,
should
it
be
approved
Tuesday
throughout
the
design
process
and
various
other
asks
from
the
neighborhood.

Councilman
Turner
real
quickly
holds
a
lot
of
hands
raised.
I
do
want
to
address
one
question
directly
that
you
ask
that
I
think
is
important.
I
should
have
covered
this
in
terms
of
affordable
housing.
They
do
have
a
condition
that
relates
to
that
and
what
it
says
is
that-
and
this
is
for
each
phase,
a
minimum
of
20
of
the
residential
units
provided
will
be
designated
affordable
to
those
earning
at
or
below
80
percent
of
the
AFI
for
20
years.

though,
so
what
I
understood
about
processing
Brad
curriculum?
Is
these
conditional
zoning
requests
for
everybody's
sake?
We
can't
like
negotiate
at
the
dice.
We
need
to
agree
on
terms
ahead
of
time,

both
parties

to
be
in
agreement
with
those
terms,
that's
kind
of
how
I've
understood
it
legally
and
so
I
did
meet
with
them,
and
these
did
come
up
and
my
understanding
is
they
do
want
them
as
conditions.

think
you
had
your
hand
up
after
Council
on
Saturday.

So
I
did
speak
with
the
developer
this
morning,
heard
good
things
from
the
neighborhood
engagement,
following
up
from
our
last
agenda
briefing
the
questions
about
public
right-of-way
and
the
roads,
maintaining
public
status,
which
would
provide
potentially
more
flexibility
in
the
future.
I
heard
that
the
the
project
developer
was
amenable
to
that
conversation,
so
I'd
love
to
know
if
staff
has
also
had
that
conversation
I
also
hear
concerns
about
it
being
separated
from
downtown
instead
of
integrated
into
downtown
and
being
part
of
downtown
and
people
being
able
to
move
through
it.
I
That
is
not
my
understanding
that
the
intention
is
to
put
a
gate
up,
but
I
think
that
if
we
had
some
clarity
around,
if
the
roads
are
going
to
be
publicly
owned
and
maintained,
that
would
help
for
the
conversation
on
Tuesday.
Another
thing
that
I
had
heard
from
the
neighborhood,
which
I
thought
was
a
really
interesting
idea.
I
If
there
was
a
future
potential
to
transfer
ownership
of
space,
whether
it's
commercial
or
residential,
whether
it's
land,
trust
or
parking
spaces
or
parking
lot
ownership.
That
could
happen
between
the
city
and
the
county,
but
have
we
ever
had
a
situation
where
we've
done
something
like
that
with
a
commercial
going
to
like
a
neighborhood
or
a
non-profit.
I
This
I
guess
it's
kind
of
like
a
menu
of
ideas.
Normally,
when
I,
when
I
hear
a
lot
of
feedback
around
a
conditional
zoning
people
are
concerned
about,
will
there
be
a
place
for
people
to
live
and
work
in
those
spaces,
and
it
comes
around
affordability
if
this
project,
what
I
seem
to
be
hearing
the
most
about,
is?
Is
it
possible
for
the
community
to
have
ownership
in
the
space,
so
you've
got
like
the
YW?
I
Non-Profit,
you've
got
the
churches,
there
are
you
the
YMCA,
nonprofit,
sorry,
and
then
what
would
it
look
like
if
there
was
either
commercial
space
or
residential
units
or
the
parking
decks?
If
there's
going
to
be
a
transfer
of
ownership
as
part
of
a
conditional
use,
could
it
be
the
neighborhood
or
a
non-profit,
and
not
just
the
city?
For
example,
if
there
was
going
to
be
a
transfer
of
the
parking
lot
to
the
city
of
the
county
for
future
maintenance
or
partnership,
could
it
instead
be
owned
by
a
neighborhood
or
nonprofit
group?

of
the
very
discussion
that
the
parties
were
having
last
week
and
continue
to
have
happen
now,
I
understand
there
had
been
discussion
and
I,
don't
know
where
this
will
lead
with
discussion
about
transferring
parts
to
the
Community
Land
Trust,
also
including
part
of
the
commercial
space,
and
whether
the
neighborhoods
would
be
able
to
set
up
a
separate
non-profit
entity
that
would
focus
extensively
on
the
commercial
spaces.
So
that's
part
of
the
discussion,
I,
don't
know
where
they
landed
or
I'd.

Brad
spoke
about
process
like
entitlement
versus
future
potential
partnership
deals
because
it's
my
understanding
that
there
is
a
going
to
be
a
request
for
partnership
on
the
parking
structures,
plural
and
how
that
gets
financed
and
stuff,
and
whether
it's
feasible
is
pretty
relative
to
what
this
project
gets
built
or
not,
but
we're
not
really
able
to
speak
to
that.
Yet
it
can't
really
until
it
comes
to
us,
because
this
is
just
like,
can
we
build
it,
I
mean
really
we're
asking
what
what
conditions
can
even
exist.
Can
we
put
a
condition
like
that?

intrigued.
I
might
need
a
little
more
specificity
about
what
the
exact
plan.
What
I'm
hearing
is
I
think
potentially,
as
councilmember
Turner
has
said,
a
a
permissible
thing
to
do.
The
question
becomes:
what
are
you
as
a
council
able
to
include
in
your
thought,
process
and
conditions
process?
The
one
limitation
I
would
just
remind
everybody
about.

Is
there
is
a
very
clear
in
North
Carolina
prohibition
against
zoning
around
ownership,
so
I
know
that
sounds
very
broad,
but
just
as
a
quick
example,
you
are
to
treat
a
rental
apartment
the
same
as
a
condo,
so
you
could
not
say
we
would
have
an
allowance
for
someone
to
have
a
condo,
but
we
don't
want
someone
renting
an
apartment
in
this
situation
from
a
land
perspective,
the
land
perspective.
It
is
a
residential
unit.

is
the
same
either
way
so
when
you're
beginning
to
delve
into
the
waters
about
who
is
going
to
be
the
specific
user,
what
the
specific
activity
is
or
who
the
quote-unquote
owner
would
be.
You
run
into
much
more
risky
ground
in
terms
of
crossing
over
potentially
where
your
allowances
as
a
legislative
body,
but
with
a
little
more
specificity,
I'll,
be
happy
to
render
a
more
particular
opinion
on
that.

would
we
be
able
to
have
a
condition,
be
that
the
developer,
create
a
community
benefit
agreement
and
go
through
a
community
benefit
agreement
negotiation
process,
because
my
guess
is:
there's
just
a
lot
of
technical
stuff.

little
bit
different
than
some
other
states
where
even

South
Carolina,
there
is
a
very
clear
allowance
for
these.
What
we
call
generally
Community
benefits
agreements
in
North
Carolina.
It
is
specifically
disallowed,
which
means
we
have
a
very,
very
high
level
of
restriction
on
a
local
government's
ability
to
impose
Community
benefit
agreements.
Now
what
we
do
have
currently
with
hotels
is
we
have
separate
from
the
approval
process.

have
an
incentive-based
program
that
allows
for
a
streamlined
review
process,
not
an
approval
process,
a
review
process
if
you're
willing
to
meet
certain
Community
benefits
the
reason
that
we
structured
it.
This
way
is
because,
generally
speaking,
those
benefits
would
not
be
something
that
we
would
have
the
legal
authority
to
include
as
a
condition
of
a
rezoning.
But
we
have
said
if,
if
you
are
willing
to
voluntarily
offer
some
of
these
things,
then
we
will
in
turn,
allow
you
a
streamline
on
review
process.

particular
entity
has
gone
all
the
way
through
the
full
review
process,
which
means

be
limited,
probably
completely
from
enforcing
any
kind
of
the
items

on

be

conditions

request
stemming
from
the
homeless
initiative,
advisory
committee's

group,

group
has
worked

strategy
to
add
interim
Housing
Shelter
beds
in
alignment
with
the
National
Alliance
and
homelessness
recommendation
to
increase
the
inventory
of
interim
housing
beds.

recommendation
from

National,
Alliance

homelessness
was
to
increase
that
number
by
95
beds,
through
a
request
for
Partnerships
process,
Hayak
vetted
proposals
from
different
agencies
and
is
recommending
the
addition

43

beds

45
existing
shelter
beds
as
an
important
step
to
achieve
the
recommendations
from
the
National
Alliance
and
homelessness.
The
cost
of
the
45
preserve
Beds,

preserved

funding
ends

September,
and
the
additional

new
beds
is
a
combined
1.75

we
did

we
drafted
an
RFP
that
matched

what
the

and

25
beds
that
were
kind

a
higher
for
folks
that
were
going
to
need
higher
level
services,

needed
the

additional
shelter

took
all
that

drafted
the
RFP,
we
pushed

whole
rooms
of
beds
that

weren't
able

utilize
due
to
funding
issues
and
stopping
issues

consider
is
the
idea

this

these
additional
beds

are
going

add

the

stock

beds

Care
Consolidated
funding
applications
to
HUD.
This
is
the
funding
we
receive
every
year.

funding

homeless
management
information
system
Grant,
as
well
as
other
Grant
programming.
Funding
that
supports
the
Continuum
of
Care
Emily
is
also
as
a
part
of
the
hcd
meeting
going
to
provide
an
update

code
purple.

mayor
mentioned,
code
purple
will
continue
and
be
augmented,
potentially
by
the
short-term
shelter,
Funding
Solution
identity
certified
by
the
shelter
work
group
and
the
city
and
county
annually
support
code
purple
at
a
level
of
fifty
thousand
dollars
per
year
from
each
agency.

hcd

19th

an
amendment
to
the
HUD
Consolidated
plan.

intent

this
action
is

allow

helpmate
to

HUD
funds
outside

limits

dollars

limits,
as
they
are
trying
to
find
housing
for
victims

more
their
concern
that
there's

lot

on
in
downtown
and

lot
of
downtown
and
that
the
timing
of
this
bike
lane
just
doesn't
seem
as
important.

feedback,
I'm
hearing
isn't
just
you
know,
should
it
be
a
space
there

this
space
here
it's
really
like.

this
really

we're
worried
about
right

businesses
right

talking
with
the
business

more
every
single
day
and
kind

conjuring
up
like
what

it

saying
that

downtown
has
all
these
needs.

Sage,

I've
spoken
to
a
lot
of
business
people
that
were
basically
it
felt
that
their
business

few
restaurant
owners
who
said
their
business
has
been
like

35
on
less
say,

they're
losing
and.

at
taking
on
all
these
other,
you
know
dealing
with
issues
and
then
taking
on
all
this
particular
issue
which
basically,
the
the
businesses
are
saying,
will
impact
their
business
or
their
businesses
have
not
recovered
from
the
pandemic
and
they're
still
struggling
and
one
particular
business
owner.
Who
owns
a
couple
of
restaurants
and
said
that
he
actually
expects
that
we're
going
to
see
more
possible
business
to
closing
downtown
so
I
think
in
light
of
all
those
different
issues
that
we're
dealing
with
like
like
Sage
said
it's
not
that
we're
so
opposed.

it's
also
important
not
to
conflate
our
economic
and
safety
concerns
with
bike
lanes,
because
we
run
20
different
departments
and
just
because
we
have
a
great
need
in
downtown
doesn't
mean
we
stop
our
garbage
collection
service.

transportation
service
in
a
multimodal
program.
We've
been
doing
planning
for
over
a
decade
for
these
outcomes.
I
am
sensitive
to
how
hard
it
is
for
downtown
businesses
right
now,
but
we
run
a
complex
organization
with
lots
of
different
functions
and.

just
want

see
if
someone
could
sort
of
lay
out
to
me
the
actual
benefits
to
moving
forward
on
the
bike
lane.

this
particular
time
then
maybe
I
could
be
more
minimal,
because
I
can't
really
see

benefits
outweighing

needs

the
community,
