previous
Council
committee
meeting
I,
have
prepared
two
separate
ordinances
for
council's
consideration
on
this
tonight.
The
original
ordinance,
which
did
not
change
any
of
the
substantive
provisions
merely
assigned
criminal
penalties
to
all
violations
which
is
previously
and
currently
the
case
in
our
ordinance.

At
the
request
of
council
member
only
also
prepared
a
separate,
optional
resolution,
slash
ordinance,
which
would
create
a
civil
penalty
just
for
violations
of
the
ordinance
which
deal
with
bikes,
carts,
strollers
or
other
means
of
personal
Transportation.
So
the
ordinance
would
still
read
in
either
case
that
those
items
are
allowed
to
be
stored
on
public
property
for
up
to
seven
days
before
a
violation
occurs.
The
difference
being
that
currently,
the
violation
for
any
storage
of
personal
property
is
a
criminal
penalty.

it
can

get
some
clarity
around
item

because
it
reads
as
though,
even
though
we
have
to
purchase
ballistic
vests,
specifically
for
individual
staff,
that
we
have
some
that
are
not
going

excess

came

noticed

briefing
meeting

the
mayor
brought
up
the
potential
of
recognizing
harm
done.
The
African
African-American
community,

urban
renewal
and
I,
would
just
invite
you
to
look
at
some
other
policies.
You
know
that
were
here
in
the
in
the
day
and
recognize
those
that
need
to
be
swept
away
as
well.
So

be
careful
about
the
language
that
we
use
and
I
find
it
disturbing
that
we
put
gender
equality
with
reparations.
The
two
do
not
belong
together
unless
I've
missed
some
history
and
white,
women
were
enslaved

children

Reparations
and
gender
equality
are
too
completely
separate
items.
They
should
not
be
combined
under
any
circumstance,
so
I
would
hope
that
you
guys
would

that
as
soon

possible,

gender
language

included
when
the
chair

vice
chair
of
the
committee
came
forward,
they
placed
special
emphasis
on
dealing
with
harms
specific
to
black
women,
so
I
believe,
that's
probably
why
the
gender
language
is
included.

think
we
have
to
consider
that
you
can
be
black
and
women
at
the
same
time.

clarify,

happens
with
any
of
these
Clauses,
like
both
of
them
bought
forward.
If
you
look
back
at
history,
that
type
of
language
have
sometimes
superseded
the
actual
event

you're

history,
especially
in
the
black
community.

therefore,

think
it
is
something
we
need

the

motion

to
the
offender
to

fifty
dollars
for
each

all

removed

amount

concerns

enforcement,

top
priority
right
now

that

someone
is
retrieving
their
personal
Transportation
equipment
like
a
bike
parked
in
a
bike
rack
that
they

criminal
misdemeanor
when
they
retrieve
it.
So
I
move
to
accept
item

the
alternative

the
exception

adding
the
provision
allowing

we

employee
recognitions,

two
topics
that
I'm
going
to
cover
of
this
evening.

first
presentation
is
going

recognize
some
pretty
special
employees
for
some
pretty
extraordinary
community
support
and
the
other
for
personal
accomplishment.

second
presentation
will
be
from
Ken
Putnam
who's,
going
to
update
us
on
the
I-26
project.

So
all
of
our
city
of
Asheville
employees
are
heroes
and
are
celebrated
daily
for
the
exemplary
work
and
service
they
provide
to
our
community.
Recently
I've
we've
kind
of
been
on
a
roll
of
having
the
opportunity,
the
privilege
and
the
honor
as
part
of
my
manager's
report,
to
recognize
and
acknowledge
the
work
of
some
pretty
extraordinary
employees.

So
tonight,
I
want
to
lift
up
and
celebrate
the
five
members
of
the
Asheville
Fire
Department
for
volunteering
to
help
the
residents
of
Vermont
during
a
flood
that
occurred
in
that
state
and
Lauren
brune
for
a
personal
accomplishment
of
achieving
the
North
Carolina
government
budget
officer
certification.

I
want

recognize
the
tremendous
work
of
a
kind
of
an
intergovernmental
team.
Our
partners
were
Buncombe
County,
fire
department,
Charlotte
task
force,
the
Greensboro
task
force,
the
National
Weather
Service
and
FEMA,
who
responded
to
as
I
noted
earlier,
a
flood
that
was
happening
in
the
state.
So
this
was
not
just
go
to
one
city.
It
was
kind
of
a
Statewide
event
that
our
team
and
a
governmental
team
support
it
and
responded
to.
So
if,
if
the
firefighters
would
please
come
up
to
the
front,
that
would
be
very
much
appreciated.

yes,
we
definitely
work
with
some
outstanding
tremendous
Partners,
but
tonight
we
are
recognizing
our
own
Team
for
the
extraordinary
work
that
they
did
and
we
regret
that
all
of
them
couldn't
be
here
tonight.

vacation,
but
we
wanted
to
acknowledge
them
and
express
our
gratitude
for
their
willingness
to
volunteer
to
help
another
community
in
their
time
of
need.

conditions

which
our
firefighters
had
to
to
go
into,
and
you
can
see.

suffice
it
to
say
they
were
deployed
on
Sunday
July.
The
9th
and
released
for
Duty
on
July
17th
I
won't
go
into
as
I
said,
the
details
about
every
effort,
but
let's
just
say
that
our
team
wasn't
there
just
in
case
they
were
needed.
They
were
actively
engaged
in
numerous
Swift
water
rescue
efforts,
ranging
from
participating
in
a
recovery
after
a
damn
break,
evacuating
people
from
hotels,
apartments
and
several
single-family
homes
to
assisting
and
in
the
rescue
of
a
missing
person.

again
this
was
happening
in
several
parts
of
the
state.

the
Vermont
commissioner
and
I'm
I'm,
assuming
you
guys
are
telling
the
truth
about
this:
a
public
safety
and
Fire

Life
Safety
that
they
were
one
of
the
best
teams
in

city
of
Asheville
couldn't
agree
more.

particular
recognition
in
this
certification,

to
do
a
lot.
You
got
a
lot

testing
local
government
budgeting,
Capital,
financing,
performance
measurement
and
management,
but
this
is
so
special
because
Lauren
is
the
first
city
of
Asheville
employee
to
have
this
distinction
and
exemplifies
the
professionalism
we
are
striving
for
in
public
works
and
our
organization
in
general.

Update
on
the
I-26
project,
which
has
been
many
years
in
the
making
the
design
build
selection
process
for
the
sections
BND
is
ongoing.
With
a
planned
contract
award
in
February
of
2024.,
the
Burton
Street
Community
is
the
only
neighborhood
in
Asheville
to
have
received
an
environmental
justice
population
designation
from
ncdot
for
the
project.

Burton
Street
would
no
longer
be
eligible
for
this
designation
and
Associated
improvements
based
on
current
demographics
in
February
of
2023
city
council,
adopted
a
resolution
supporting
the
Aesthetics
committee's
recommendation
to
invest
5.9
million
dollars
in
Aesthetics
enhancements
for
the
1926
connector
project,
which
requires
local
funding,
because
these
enhancements
exceed
ncdot's
standard
level
of
treatment.
As
part
of
that
action,
city
council
also
approved
a
motion
in
support
of
neighborhood
improvements
for
Burton,
Street,
Hillcrest
and
Montford,
and
the
ncdot
was
notified
about
both
approvals.

Section
B
begins
just
south
of
the
Haywood
Road
Bridge
and
ends
at
U.S
1923,
which
is
future
I-26
near
Broadway.
Street,
section
D
is
Riverside
Drive
and
it
begins
south
of
Hill
Street
and
ends
at
Broadway
Street.
Both
sections
will
be
delivered
using
the
design,
build
method
and
the
selection
process
is
ongoing
and
three
teams
have
been
shortlisted
to
compete.

However,
the
recommended
aesthetic
improvements
for
the
Haywood
Road
Bridge
will
definitely
benefit
the
Burton
Street
neighborhood,
as
well
as
West
Asheville

mitigation
strategies
were
identified
in
the
plan
that
included
commitments
for
both
ncdot
and
the
City
or
the
rest
of
the
slides.
I'll
talk
about
some
of
the
key
commitments
that
they're
identified
and
a
majority
of
these
strategies
will
be
implemented
during
the
overall
construction
phase
of
sections.

of
the
key
strategies
is
to
improve
all
the
existing
sidewalks
to
meet
Ada
design
standards.
These
improvements
have
been
identified
and
cost
estimates
have
been
prepared
and
the
work
will
be
accomplished
with
a
separate
contract
in
order
to
provide
opportunities
for
smaller
companies
to
participate.

A
multi-use
path
along
the
south
side
of
Patton
Avenue
is
included
in
the
preliminary
project
design
for
Section
B,
so
that
will
be
part
of
the
design
build
process
that
contract
incorporate
a
Burton,
Street
history
mural
on
proposed
I-26
connector
sound
law.
If
one
is
constructed
once
a
final
determination
is
made
as
part
of
the
design
process
that
Burton
Street
would
benefit
from
a
sound
wall,
it
will
only
be
constructed,
followed
a
vote
from
the
impacted
residents.

pedestrian
bridge
adjacent
to
the
entrance
of
to
Hillcrest
neighborhood
will
provide
access
to
Hill,
Street
and
aesthetic
and
treat
aesthetic
treatments
and
lighting
will
be
included
on
that
new
pedestrian
bridge
for
Montford.
The
Aesthetics
committee
and
ncdot
agreed
upon
the
following
items:
impact
in
Montford,
which
will
be
incorporated
into
the
final
design
of
the
project.

that's
a
good
question
because
what
they
have
to
do
on
a
design
build
process
they'll
have
to
complete
the
design,
so
they'll
get
a
partial
design.
They'll
have
to
complete
it.
Then
they'll
have
to
purchase
the
right-of-way.

they'll
have
to
move
all
of
the
utilities
that
have
to
be
moved,
and
then
construction
can
begin.
So
more
than
likely
it
will
be
at
least
18
months
to
two
years
before
you
would
see
construction
actually
begin.

depending

what
team
is
picked,
they'll
probably
have
different
ways
that
they'll
go
through
through
the
project.
I
think
that
it's
safe
to
say
that
the
teams,
all
the
teams,
are
going
to
look
at
every
possible
angle.

construction
time
frame,
but
I
was
trying
to
be
realistic
that
it's
probably
we're
probably
looking
at
that
six
to
seven
years,
the

and

the

thing

hasn't
been
clear

me
over
the
years

the
Aesthetics
committee
engagement
that
I've
participated

the
engagement
with

Hillcrest
neighborhood
and
residence

looked

there's,
always
a
question
that
is
going
to
happen
through
the
Housing
Authority.
Have
we
used
our
tools
with
the
gear
Outreach
the
impact
on
buildings?
Is
that
really
clear
to
the
residence
Council
Visa
a
postcard?
Are
we
just
leaving
it
to
other
organizations
or
are
we
engaging
as
a
city
the.

was
not
the
other
side
of
the
project,
so
I
think
it
would
be
helpful
if,
if
it
does
come
to
that
that
we
do
some
really
intentional
engagement,
I
think
would
be
important,
but
for
the
Burton
Street
part
of
it
I
know.
The
2010
plan
is
mentioned
in
the
2018
plan
and
the
2018
plant
was
effectively
an
update.
So
since
the
2010
plan
is
mentioned
in
the
update,
does
that
mean
both
the
original
neighborhood
plan
and
its
updates
are
considered
or
just
the
2018
plan?

an
updated
schedule
from
planning
staff
today
and
they're
doing
some
steps
to
try
to
build
consensus
among
South,
Side
Community,
and
they
their
schedule
is
to
have
it
here
in
October
and
I
assure
you
they
want

have
it

front
of
you
as
much
as
you
want
to
have
it
in
front
of
you.
So
that
is
the
most
recent
schedule
and
I
really
hope
we
don't
have
to
move
it
again.

Essentially,
the
existing
signage
at
the
hospital
was
approved
under
what
was
called
a
sign
package
that
we
no
longer
I
guess
do
as
part
of
the
sign
regulations.
So,
therefore,
this
request
is
coming
forward
as
a
conditional
zoning
amendment
to
amend
the
allotted
signage
for
the
hospital,
the
existing
future
land
use
is
employment
and
anchor
institution.
No
change
in
that
designation
would
be
required,
and
essentially
this
is
the
proposed
sign
plan.
Just
the
map
overview,
you
can
see
all
the
existing
and
proposed
signs
the
proposed
signs
being
outlined
with
the
other
red
boxes.

This
was
reviewed
and
approved
unanimously
at
the
June
7th
planning
zoning
commission
hearing.
There
are
a
few
conditions
associated
with
this
proposal,
including
that
the
maximum
number
of
signs
would
be
41.
Total
signage
area
would
not
exceed
1500
square
feet
and
that
the
signage
sign,
design
and
location
would
substantially
conform
to
this
proposed
Master
signage
plan,
which
is
incorporated
into
this
conditional
zoning
Amendment.

the
other
existing
regulations
of
the
conditional
use
permit
from
2011
would
remain
in
place
regarding
the
the
building's
expansion
and
all
that
other
stuff
staff
concurs
with
Planning
and
Zoning
commission
recommends
approval
a
proposed
amendment
to
the
conditional
zoning
and
I'm
glad
to
answer
any
questions.
I
believe
we
also
have
a
member
our
person
from
the
applicant
team
available
to
answer
more
specific
design
or
sign
questions
as
well.

any
of
the
signs
that
we're
looking
at
are
in
areas
for
future
expansion
of
multimodal
Transportation
options,
for
example,
there's
some
you
know,
entrance
number
nine,

example,
is
pretty
close
to
what
I
imagine
would

like

future
sidewalk

be
so
have
we
have
staff
identified
any
like
pinch
points
or
areas
of
concern,
because
this
is
really
broad

just

finding
the
right
balance
between
specificity
and

generality
in
this
plan
will
allow
for
a
little
bit
of
tweaking
around
the
margins
as
either
sidewalks
get
built
or
Transit
stops,

moved

I
think
it
allows
for
if
they
wanted
to
move
a
sign,
10
feet
this
way
or
that
way
wouldn't
have
to
come
back
to
you
all
for
approval.

motion
to
approve
the
amendment
to
the
conditional
zoning
request
for
the
property
located
at
509
Biltmore
Avenue
in
zoned
industrial
conditional
zone
for
the
allowance
of
additional
signage
beyond
the
previous
approved
amount
and
find
that
the
request
is
reasonable
is
in
the
public.
Interest
is
consistent
with
the
city's
comprehensive
plan
and
meets
the
development
needs
of
the
community.
In
that
the
request
one
improves
wayfinding
signage
for
pedestrians
and
bicyclists,
and
two
connects
businesses
and
the
workforce
by
working
with
local
hospitals
to
deliver
contextually,
sensitive
design
and
development
decisions.

consider

amendment

the
land
use
impact
table
into
one

unified
table.

I'm,
bringing
to
you
a
an
amendment
that
is
easy
to
explain
but
has
complicated
impacts,
as
you
can
tell
by
the
length
of
the
ordinance.
This
is
about
our
table
of
uses
in
Udo.
I
apologize
is
the
unified
development
ordinance.
It
is
our
single
ordinance
that
regulates
the
development
of
land
and
is
our
access
point
for
Citizens
developers
and
anybody
seeking
to
do
work
in
the
city
of
Asheville.

However,
we
developed
a
set
of
criteria
that
we
think
certain
amendments
should
be
brought
forward
to
the
council
for
consideration,
and
these
are
the
criteria
that
we
use,
despite
the
fact
that
this
update
is
planned
in
the
future,
that
one
substantive
changes
deserve
and
require
significant
engagement
with
the
public
and
staff.
So
structural
and
maintenance
updates
are
also
equally
important
and
changes
should
and
can
be
undertaken.

While
we
wait
for
that
comprehensive
update,
if
it
improves
our
customer
service
and
our
operations,
this
table
of
use
unification
qualifies
in
a
very
interesting
way,
because
there
it's
not
a
substantive
change
to
the
ordinance
at
all.
It's
it's
basically
a
very
comprehensive
formatting
change.
When,
when
I
first
learned
the
Udo,
it
was
an
embarrassing
process
to
find
out
how
it
all
worked
together.
There
are
four
Separate
Tables
that
list
uses
by
the
district
or
Zone
that
they're
located
in.

There
are
three
additional
lists
that
have
those
uses
and
uses
listed
and-
and
it
became
clear
to
me
and
when
I
proposed
this
to
other
staff
that
we
could
unify
this
without
changing
the
substance
of
the
Udo,
so
that
we
would
have
one
table
that
have
all
of
the
the
uses
listed
in
it.
We
and
and
when
we
go
deeper
into
that
staff
reported
back
to
us
that
that
citizens
were
frustrated
in
the
complexity
of
the
ordinance
and
so
that
triggered
this
update
process.

We
feel
that
it
improves
consistency
across
all
zones
and
we
were
able
to
complete
this
project
internally
without
seeking
outside
help.
What
it
does
is.
It
takes
these
separate
lists
of
uses
and
tables
and
brings
them
all
into
one
which
reduces
confusion
for
customers
and
landowners.
Many
citizens
come
to
the
city
for
the
first
time,
dealing
with
a
question
about
a
use
and
they
have
to
comprehend
our
incredibly
lengthy
and
important
development
ordinance,
but
having
multiple
tables
creates
some
kind
of
frustration.

It
has
also
created
a
challenge
because
updates
have
taken
place
in
Separate
Tables
and
have
not
been
coordinated.
So
there's
some
confusion
over
the
use
of
language
and
terms,
and
we
feel
that
by
bringing
this
all
together,
everything
is
consistent
and
we
don't
have
to
rely
on
an
incredible
amount
of
support
to
get
people
to
understand
how
this
works.

What
this
essentially
does
we
have
a
primary
table
of
permitted

to

of

applications
for

the
Luigi
policy

recommending
that
city
council
delay
consideration

this
application
until
the
policy
has
been
revised
on

20th

they

recommend

wanted

adjusted

account
for

smaller
unit

tend
to
be
between

400
square

whereas

might

up
or
even
efficiencies

recommendation

ahac
did

housing
authority
and
the
VA
that
those
vouchers
would

the

would
qualify
for
the
voucher

occupancy,
so
they
would

categorized

efficiency

has
to
do
with

the
rent
standard
that
HUD
would

After
her
death
and

copy
of
the
document,
my
father
and
I
were
forced
to
sign
after
a
day
of
negotiations
with
the
justice
department
on
September
13
2001
for
your
review.
I
left
that
with
your
legal
department
for
each
of
you
to
review
on
another
note,
what
is
the
city's
greatest
challenge?
This
question
was
posed
to
me
in
another
region.
Thinking
positively.

first
thought
was
too
many
free,
affordable,
interesting,
informative
fun
activities
scheduled
at
the
same
time,
but
not
having
been
born
and
raised.
There
I
conducted
extensive
research,
asking
lots
of
businesses,
civil
servants
and
community
members.
The
natives
elders
and
civil
servants
offered
great
Insight
factoring
in
all
citizens.
An
invaluable
learning
experience
some
common
answers,
not
enough
living
wage
jobs
and
affordable
housing,
drug
problems,
labor
shortage
infrastructure
needs
dry
county,
not
enough
water
to
support
current
and
future
development.

It's
a
universal
question
of
all
cities
and
towns,
survive
or
thrive.
Tourism
is
vital.
Visitors
bring
new
residents
and
businesses
increasing
tax
base
to
improve
the
community
and
the
services.
I.
Commend
you
on
your
efforts
to
serve
your
constituents.
How
could
we
measure
success
in
any
community?

what
I
came
up
with
one
when
civil
service
can
afford
to
live
and
work
in
the
same
place.
Each
neighborhood
has
a
proactive,
neighborhood
watch.
This
will
increase
Mutual
Security
at
the
community
level,
so
yeah
when
every
child
is
afforded
quality,
preschool,
K-12
and
postgraduate
education
chooses
and
can't
afford
to
live
and
serve
in
the
community.
They
were
born
three.

every
senior
can
afford
and
chooses
to
live
in
the
community,
they
were
born
comfortably
peacefully
fearlessly,
a
respected
living
historian
with
purpose
and
dignity
for
an
economy
where
Mom
and
Pop
stores
survive,
complementing
other
larger
businesses.

this
to
you
as
a
member
of
Phil's

processions

name

white
supremacy.

vote
for
the
amendment
to
disenfranchise
Black
citizens
here
in
North
Carolina,
via
the
literacy
tests
and
grandfather
clause,
was
coming
up
on
August,
2nd,
so
it'd
be
like
next
week.
So
lots
of
you
know
writings
in
the
paper
about
white
supremacy,
there's
so
much
of
it.
I
couldn't
really
put
it
all
in
here.
In
the
bottom
of
this
announcement,
you'll
see
it
says
all
white
men
are
invited
to
take
a
part.
In
this
event,
preparations
for
the
big
procession,
handing
out
torches
at
the
courthouse.

about
a
woman
who
was
imploring
the
men
to
vote
for
white
supremacy
and
here's
what
she
said
she
said
shall
we
oblige
be
obliged
to
submit
to
the
indignities
that
pale,
the
faces
of
strong
men
from

class

negroes

our
insult
come,
which
is
most
to
be
dreaded,
the
weak
and
unwise
negro
vaulted
up
by
misplaced
power
or
the
humble
black
men
under
wise
control.
Answer
the
question

and
let

vote
represent

answer

you
honor
your
mother.

wife

cast

a
touching
appeal

men

North
Carolina

Womanhood

the
state.

response
to
the
call
next
Thursday
will
Gladden

hearts

mothers,
wives

Daughters
of
the
old
North
State.
So
maybe,
as
the
reparations
process
goes
on,
we
apparently
study
gender
disparities.

look
at
how
the
women
back
in
the
day
were
really
the
most
hard
and,
as
I
told
you
a
few
weeks
ago,
the
the
Hal
Reed
Act,
where
it
was
the
women's
Buncombe
League
that
were
working
the
hardest
to
disenfranchise
the
black
vote
in
1931
when
we
reformed
our
form
of
government.
We
disenfranchised
black
voters
ten
weeks
before
the
formation
of
this
very
agency
and
I
would
really
like
the
history
of
this
agency
to
be
looked
at.

maybe
the
reparations
committee
would
be
interested
in
hearing
about
it.

murder

this
city
and
those
who
want

fill

black

especially
our
younger
people.

it's

guns

those

haven't
lived

enough
disappointing
moments

decisions

a

anger
or
fear
would

to

done

history

neighborhood

choice

entrepreneurs

our
