Friday
judge
Michael
Lee,
granted
a
stay
for
90
days
of
the
liberty
and
prosperity
lawsuit
he
had
previously
granted
a
stay
of
the
case.
The
county
was
involved
in
in
the
liberty
and
prosperity
case.
As
you
know,
he
declared
the
2021
amendments
to
the
casino
property
tax
stabilization
act
as
being
unconstitutional
of
the
state
asked
for
a
state.
The
state
has
previously
filed
a
notice
of
appeal
with
the
Appellate
Division
of
Superior
Court.
In
our
case,
they
are
likely
to
do
the
same.
I
With
regard
to
the
liberty
and
prosperity
case,
it's
likely
that
the
two
cases
will
be
Consolidated
now
the
judge
granted
his
stay
in
liberty
and
prosperity
for
a
period
of
90
days,
and
that
was
done
with
the
idea
of
hoping
that
the
Appellate
Court
will
expedite
the
appeal
and
we'll
move
it
forward,
and
perhaps
maybe
even
the
state
supreme
court
would
take
the
case
on
Direct
certification,
as
I
explained
once
before.
I
The
first
level
of
appeal
in
a
case
is
the
Appellate
Division
of
superior
court.
That
says
of
a
matter
of
right,
you
get
to
the
Supreme
Court
one
of
two
ways:
if
the
matter
goes
through
the
Appellate
Division
and
there
is
a
a
dissenting
vote,
the
party
that
has
lost
has
an
automatic
right
of
appeal
to
the
state
supreme
court.
I
If
that
does
not
happen,
if
the
opinion
is
unanimous,
then
the
losing
party
has
to
file
what's
called
a
petition
for
certification,
with
the
New
Jersey
Supreme
Court
and
then
by
a
majority
vote
of
the
seven
justices
at
four
of
the
justices
agree
to
take
the
case,
then
they'll
Grant,
what
they
call
certification
and
the
case
gets
put
on
their
docket
now.
What
do
we
mean
by
an
expedited
appeal
that
doesn't
mean
that
next
month,
the
Court's
going
to
take
going
to
take
the
case?
I
Well,
where
there
are
matters
of
extreme
public
importance
and
I.
Think
this
case
would
qualify
as
one
sometimes
the
Supreme
Court,
where
there's
an
appeal
by
both
of
the
parties
may
take
the
case
and
bypass
the
Appellate
Court,
because,
let's
face
it
in
both
of
these
cases,
no
matter
what
happens,
the
losing
party
is
likely
to
petition
the
court
anyway
to
get
the
case
there.

The
the
state
is
the
appealing
party
in
these
cases,
first
to
the
Appellate
Court.
They
have
to
order
the
transcripts.
There
have
been
numerous
hearings
in
both
of
these
cases.
They
would
have
to
order
the
transcripts
those
transcripts
have
to
be
typed
up
at
all
and
sent
and
forwarded
to
the
Appellate
Court,
whether
it's
the
Appellate
Division
or
the
state
supreme
court.
The
court
then
will
issue
a
briefing
schedule
where,
where
both
sides
would
brief
the
case,
the
state
has
the
appealing
party
with
they're
the
appellant.
I
They
would
file
their
brief
first
and
normally
the
court
allows
once
they
put
out
a
briefing
schedule.
It's
usually
45
days
that
the
party
has
to
file
their
their
brief.
We,
the
county
at
liberty
and
prosperity,
would
be
the
respondents.
The
respondents
normally
have
30
days
after
the
state
files,
its
brief
to
respond,
and
then
normally
the
the
state,
as
the
appealing
party
would
then
have
I.
Think
it's
15
days
after
that,
the
file
a
what's
called
a
responsive
brief
to
the
arguments
we
made.
I
So
there's
three
three
levels
of
briefs
there
that
get
filed
that
goes
up.
The
judges
have
to
read
and
digest
all
that
chances
are
in
a
case
of
this
Magnet
or
cases
of
this
magnitude.
They
would
ask
for
oral
argument
that
would
have
to
be
scheduled,
and
then
the
parties
would
appear
either
before
the
active
or
the
state
supreme
court
for
oral
argument.
And
then,
after
you
have
that
the
court
then
takes
whatever
time
it
needs
to
take
to
formulate
his
decision
and
will
issue
a
decision
which
first
gets
sent
out.

So
that's
that's
the
process
and
Mr
riccio
and
I
have
looked
at
it
and
believe
that
you
know
we're
probably
under
a
best
case
scenario,
looking
at
nine
to
12
months
before
this
case
would
be,
and
that
that's,
if
it

it
goes
on
an
expedited
basis,
if
the
Court
decides
not
to
do
that,
and
if
the
Appellate
Court
takes
it
first,
you
could
be
nine
to
12
months
in
the
Appellate
Division
get
the
decision
from
there
and
then
have
to
get
certification
by
the
Supreme
Court
you're
talking
an
even
longer
period
of
time.

My
best
guess
is
a
year
at
a
minimum.
Before
we
get
a
decision
in
this
case
or
both
both
cases,
thank

and
you
could
get
a
split
decision
on
this
case,
I
mean
there's
I
should
be
very
clear
on
that
we,
the
county,
did
not
directly
challenge
the
constitutionality
of
those
2021
amendments.
Our
argument
was:
is
that
those
amendments
violated
the
consent
order
of
settlement
which
we
maintain
as
a
contract
contract.

That's
been
sanctioned
by
the
court
in
the
form
of
a
court
order,
and
while
the
legislature
does
have
significant
a
wide
berth
in
what
it
could
do
in
legislating,
we
maintain
that
they
can't
violate
a
contract
that
they
themselves
State.
The
executive
branch
of
government
made
so
there's
going
to
be
a
contract
arguments
paid
there's
going
to
be
separation
of
powers.
Arguments
that
we
would
make
I
frankly,
think
our
case
is
the
stronger
the
two
it's
possible
that
the
court
could
have
a
split
decision.
