support

amended
resolution
that
Commissioner

is
offering
I
think
and
thank
you
for

overwhelming
response

listening

community.
It's
a
good
compromise.
There
was
a
lot
of
concerns
that
the
original
language
actually
circumvented,
the
separation
of
powers
and
the
importance
of
the
judiciary
in
deciding
constitutionality
on
various
on
different
lana's
I
think
this
is
a
good
solution
for
Bay
County.

With
my
past
experience,
I'm
here
to
support
Commissioner
Lutz's,
common-sense
resolution
to
the
request
by
the
gun
from
some
of
the
Second
Amendment
supporters
to
declare
Bay
County
to
be
a
gun
sanctuary
community,
you
know
effort
in
my
whole
lifetime,
I,
remember
people
saying
they're
coming
to
take
our
guns
and
I'm
wondering
who
they
is.
You
know
in
our
lifetime
we
have
made
Michigan
an
open,
carry
state
very
few
restrictions
about
where
a
person
can
openly
carry
a
gun
and
who
doesn't
have
a
concealed
weapons
permit.

We
have
abandoned
the
gun
boards,
which
were
a
discretionary
way
for
community
people
elected
you,
our
prosecutor,
our
County
Clerk,
and
our
share
to
use
their
discretion.
Knowing
somebody's
reputation
to
say
they
shouldn't
have
a
gun,
those
have
been
abolished
and
now
we're
basically
a
must
carry,
must
issue
state.
So
where
is
this
fear
tactic?
Coming
from
that
somebody's
coming
to
take
our
guns,
you
know
I
think
everybody
here
supports
the
Second
Amendment.
It's
an
inalienable
right
that
we
have,
along
with
the
First
Amendment.

We
have
First
Amendment
rights
to
free
speech,
but
it
doesn't
mean
you
can
stand
up
in
a
crowded,
theater
ins
claim
fire
and
put
other
people
at
risk.
We
have
my
First
Amendment
right
to
freedom
of
assembly,
but
you
can't
have
a
rattly
in
the
middle
of
the
Vaseline
of
I-75.
These
are
for
public
safety
issues
that
some
laws
are
enacted,
and
that
includes
common-sense
restrictions
that
sometimes
deal
with
the
Second
Amendment
right
to
bear
arms
now
I'm
going
to
pose
to
that
Second
Amendment
at
all.

I
do
believe
that
when
corporation
council
looked
at
the
resolution
that
some
of
the
Second
Amendment
supporters
have
proposed,
an
accurate
legal
argument
was
made
for
the
fact
that
we
have
three
branches
of
government
and
the
legislature
passes
laws
and
the
judges
decide
on
whether
or
not
these
laws
are
constitutional.
We
don't
give
to
private
citizens
and
bus
to
our
law
enforcement
officers.

right
to
determine
on
the
street
that
I'm
not
going
to
enforce
this
law
because
some
people
don't
like
it
or
don't,
think
it's
constitutional,
that's
not
how
our
system
of
government
works,
and
it's
just
one
quick
reminder.
You
know
the
assault
weapons
ban
was
passed
by
Congress
in
the
1980s
and
it
was
left
allowed
to
expire
20
years
later,
that
was
in
2004,
and
you
know
what
that's
15
and
a
half
years
ago
and
George
Bush
was
our
president
at
that
time
and
nobody.

the
assault
weapons
and
if
they
did
they
were
they
were
shut
down.
There's
been
no
appetite
among
Congress
to
reinstate
a
ban
on
assault
weapons
and
so
I'm,
not
sure
where
the
fear
comes
from
where
people
are
saying,
they're
coming
to
take
our
guns,
and
so
you
have
to
make
a
preliminary
judgment
that
people
don't
have
to
enforce
laws
that
haven't
been
even
enacted.

resolution

forth

simple

was
stated
that,
where
are
these
fears
coming
from

can
tell

right

they're

from

have
to
watch
TV
Virginia
people

dying

stated
that
red
flag
laws

they
are
not

resolution

asking

why
we're
asking

sign
it
this

because
counties
have

on
board
we're
gonna
get
more
because

already

hearing
prelims

other
county
boards
that
they're
all

going
along
with
our
resolution.

we
do
need

More

13
states
have
already
passed
red
flag
or
other
unconstitutional
gun

state
government

signs

they

begin

aggressive
action

restrict
the
right
to
bear
arms
to
law-abiding
citizen.
This
is
our
reality.
The
change
will
start
slowly
and
creep
into
legislature
as
red,
flag

common
sense
gun
laws
and
quickly
expand
to
include
weapons
that
are
scary
to
those
without
firearms,
education
or
exposure.
This
is
simply
not
what
we
want
to
see
in
Bay,
County
or
Michigan
for
that
matter,
I'm,
not
popular.

truly
need
your
support
in
your
voice
and
legislation
to
keep
this
evil
at
bay.
The
government,
at
all
levels
will
make
a
bigger
impact,
supporting
the
improvement
of
mental
health
and
addiction
programs
to
improve
the
safety
of
the
people.

bad
guy
with
a
gun
isn't
going
to
follow
the
laws
in
many
cases
due
to
the
rural
logistics
of
our
county.
Most
people
only
have
the
protection
of
a
good
guy
with
a
gun.

it's
my
understanding
that,
rather
than
voting
on
the
resolution
as
presented
tonight,
a
statement
affirming
the
board's
support
of
constitutional
rights
in
general
has
been
drafted,
because
the
resolution
submitted
supposedly
exceeds
big
homies
authority
by
directing
the
excuse
of
the
sheriff
or
prosecutor.
This
interpretation
is
simply
not
correct.
The
original
resolution
specifically
states
that
the
board
affirms
its
support
to
bay,
County
Sheriff
and
prosecuting
attorney
to
exercise
their
sound
discretion
to
not
enforce
against
citizens
of
unconstitutional
firearms
law.

of
the
sheriff
or
prosecutor.
So
today
we
are
asking
that
at
least
two
of
you
motion
and
support
the
sudden
motion
to
vote
on
the
Second
Amendment
sanctuary
resolution,

originally

to
know
that
you
have
our

we

backs
when
it
comes
time
to
protect
our
Second
Amendment
rights
in
the
political
arena,
as

becomes
more
aggressive,

their

to
a
lawyer.

doing
business
with

talking

to
deal
with
the
sanctuary,

said
well.
What's
that
all
about?

guns
and

and
they
said
yes,
they
want
sanctuary
city

that
anybody
that
comes

has
a
right
to
do
whatever
they
want.
Unless
the

prosecutor,

Sheriff
Department
at
their
discretion,
decides
to
do
something
about
it.

don't
live
in
Virginia

in
Bay
County
and
as
far
as

concerned.

feeling
is,
you

Virginia
wants
to
pass
that
law.
Other
states.
Other
communities
won't
pass

law.

anybody
takes

oath
for
an
office,
they
support
every
amendment

constitutional

the
second
amendment

backed
up

old
office

change
it
around,
and
this
is
another
thing

learned

long
time
ago,
when
somebody
pushes
this
hard
there's
a
reason
behind
it
and
I've
been
trying
to
figure
out
that
reason
and
I've
asked
this
is
wrong.

has
to
come
up

can't
get
an
answer.

the
general
office

this
group

is
gone
from
state

state

money

backing
them

decision

than
Anthony
Scalia

was
the
additional

gun
rights

and

can
be

haven't
been
able
to
carry
automatic
weapons

other
kinds
of
weapons
that
are
banned
in
this
country,
I'm
not
here
to
advocate
for
banning
war
or
leaving
them
on
the
streets.

just
want

commend

of
you
for
recognizing
your
responsibilities

local
office

for
recognizing
that
the
sheriff
and
the
prosecutor
in
this
county
have
taken
a
similar
role
and
that
they
are
voluntary,
enforce
all

walls
that
come
down,
not
just
the
ones
that,
or
even
a
majority
of
people
disagree.

encourage
you
to
vote
for
the
resolution
you
have
on
your
agenda
and

approval
for
his

amend
the
noise

to
County
properties,
which
are
really
the
two
options
that
the
board
has
in
front
of

the
consensus
isn't,
even

board

decided

preference
is
to
simply
rescind
the
ordinance,
because
I
think
such
difficulties,
if
you
start
testing,
annoying
support
notices
with
regards
to
County
owned
properties,
because
those
county
owned
properties.

other
municipalities,

if

municipality,
it's
a
conflicting
noise,
ordinance,
there's
a
question
as
to
what
should
apply.
Noise
doesn't
stuff
at
the
at
the
boundary
of
any
personal
real
property,
and
the
other
difficulty
that
you
have
is
that
many
of
our
venues
are
venues
such
as
the
fairgrounds,
and
we
have
our
two
very
derbies.

have
the
fair
of
those
generate,
a
fair
amount
of
activity
and

Don't

County
wants
to
start
to
the
business
of
enforcing
its
own
noise
ordinance
against
itself
or
its
tenants.

it
would
be
my
preference
to
simply
just
eliminate
the
noise
ordinance
in
its
entirety.

provided

a
copy
of
an
attorney
general
opinion
which
buttressed
my
research
regarding
whether
or
not
tell
me
why
noise
ordinance
was
enforceable,
as
the
board
is
aware
it
just
as
with
the
Second
Amendment
sanctuary
city
resolution.
This
board
is
the
statutorily
created
body
and
you
have
to
work
within
the
confines
of
what
what
powers
the
statutes
give
you
and
we
can
pass
a
dog
licensing
ordinance,
because
there
is
a
dog
law
and
state
level.

Unfortunately,
there's
no
noise
law
at
the
state
level
that
allows
counties
to
pass
those
ordinances.
So
the
suggestion
has
been
I've
been
in
discussion
with
the
prosecutor
about
this,
as
well
as
several
constituents
that
have
called
for
some
preparation,
because
they're
stating
well
within
those
arguments,
but
it's
not
being
enforced
by
the
prosecutor
and
my
response
was
we
holder
that
the
ordinance
itself
is
unenforceable
at
this
point?
But
the
best
resolution
is
for
the
different
townships,
villages
and
cities
to
pass
the
on
noise
ordinances.

would
be
a
city
ordinance,
so
the
county
prosecutor
only
prosecute
those
county
ordinances
and
state

agree

prosecute

ordinance

really
what
the
county
prosecutor
does
is
based
on
what
law
is

a
County

And
if
it's
a
lucky
municipal
law,
absent
a
written
agreement

municipality
and
the
county,
then
it
would
be
the
means
of
penalties

that
prosecuted

would

encourage
us
commissioners
to
go
back
to
our

townships
that
we
represent
and
talk
with
the
supervisors
to
encourage
them
to
maybe
make
contact
with
you

share
possible
resolutions

out
there

other
townships
that
they
could
put
something
together
so
that
this
summer,
individuals
that
are
having
issues
can
do
something
about
it.

dogs

8:00

then
the
following
Saturday
on

22nd,
we're
going
to
be
at

city
market
they're
going
there's
going
to
be
a
chef
there.

than
