Description
The City of Beacon Council Meeting from September 11, 2023
A
All
right,
hi
everyone,
it's
seven
o'clock.
This
is
a
formal
meeting,
so
let's
begin
it,
let's
start
with
a
pledge.
A
And,
let's
see
we're
all
call
Molly
are
you
here,
Justin
I'm.
B
A
George,
mostly
Lee's
here
also.
B
B
C
A
Everyone
I
see
Chris
White
here
is
a
representative
from
our
City
attorney
online.
A
Okay,
so
we
got
a
full
house
and
and
done
our
roll
call.
We
do
have
a
community
segment
and
it's
a
spirit
of
Beacon
update,
so
Katie
you
gonna
do
that
come
on
yep
and
make
sure
you
introduce
yourselves
into
the
mic.
So
people
will
know
who
you
are.
G
Discuss
the
spirit
of
Beacon
Day
this
year
begins
highly
anticipated
event.
The
spirit
of
Beacon
day
takes
place
on
Sunday
September
24th
at
11
A.M
to
4
P.M.
This
event
was
established
in
1977
in
response
to
racial
tensions
between
Beacon's
Youth
and
the
community.
As
a
result,
various
Community
leaders
from
our
local
churches,
Library
police
city,
council
and
others
came
together
to
figure
out
what
to
do.
Solution
was
proposed
that
we
have
the
Community
Day
said
one
of
the
original
backbones
of
the
spirit
of
Pekin
day
Nan
wittinum
about
the
origin
of
the
origin.
G
In
the
newspaper
called
the
Pekin
evening
news
in
1986..
She
said
everyone
was
in
agreement
that
we,
the
community,
should
get
to
know
one
another
better.
It
was
agreed
that
we
should
learn
to
know
each
other's
likes
and
dislikes
regarding
conversation,
feelings,
entertainment,
education
and
food
so
come
to
enjoy
a
variety
of
foods
for
professionals,
churches,
organizations
as
well
as
get
to
know
the
services
available
at
vendor
tables.
G
Music
performances
are
at
two
stages,
will
be
going
on
all
day
at
the
Main
Street
stage
at
veterans
place
and
the
secondary
stage
across
street,
which
will
be
the
probably
last
year
for
the
cross
street
location
because
of
the
new
building
going
up.
It's
a
really
come
out,
so
you
can
enjoy
that
performance.
G
Big
parade,
kicks
off
at
1pm
and
goes
down
Main

our

will
be
down
at

right
before
the

starts,
so
we're
excited
and
K104
is
going
to
come
out
again
this
year
to
help
us
vocalize
that
the
day
starts
at
11
when
Main
Street
is
blocked
off
from
South
Broad
Street
at
Key

to
teller

at
the
Yankee

Both
businesses
are
one
of
our
sponsors
this
year
and
we
thank
them
so
much.
It
is
with
sponsor
support.
G
At
this
day
it
can
even
get
produced

this
year
include

being
provided
and

The

wanted

on

last

Our
restaurants
did
very
well
because
people
went
inside
and
ordered,
but
the
people
also
wanted
street
food,
and
so
this
year
please
come
hungry
because
you're
going

Even
if
you
march
every

please
go
to
the

because
we
need
to
get
you
in
there.
So
we
can

Lots
of

is
coming
to
you
and
we
have
saved
tables,
especially
for
the
after-school

at
the
Beacon
City

We
have
saved
a
spot
for
you
to
come
out
of
the
school
and
onto
the
street.
Everyone
can
meet
you
and
see
the
effort
you
bring
to
the
students
in
the
district.
G
You
guys
still
have
time
to
sign
up,
because
we've
literally
saved
a
couple
tables
just
for
you.
The
students
for
gender

have
signed
up
and
we
hope
more
do
as
well.
In

at

It
will
include
activities
from

and
come
on

First
of
all,
tell
all
of
your
friends
to
come
to
this

to
begin
day,
but
there
is
parking
for
them
thanks
to
the

Please
tell

We
need
very
specific
things
so
make
sure
you
sign
up
our
volunteer

G
We
need
like
a

for
two
big
wooden
boards
to
go
at
either
end
of
town
people
to
pass
out

that
pass

able
to

H
A
Yep,
so
this
is
the
first
opportunity
for
public
comment.
No
one
has
signed
up,
but
if
anyone
in
the
physical
audience
would
like
to
make
the
comment
now
would
be
the
opportunity
to
do
so
on
three
minutes
on
any
topic
of
your
choice.

famous

who

started
a
whole
new
genre
and
he
was
assigned
in
1865
New
York
City
created
a
common
fire
department
between
the
city
of
Brooklyn
in
the
city
of
New
York,
and
it
took
33
years
before
the
cities
merged,
but
they
actually
had
been
functioning
as
the
common
Fire
Department
for
33
years
prior
and
my
grandfather
being
a
brooklynite
I
joined
the
Department
in
the
first
year
of
the
combined
cities
and
had
the
Good
Fortune
of
being
assigned
to
engine
65
in
Midtown
Manhattan
when
it
was
a
rural
area
and
while
the
cathedral
was
still
being
built
in
Rockefeller
Center
heading
Columbia
was
there
Department
lost
his
life.
I
J
Good
evening
Teresa
Kraft,
we
need
to
bring
attention
to
the
blatant
demolition
of
the
Main
Street
neighborhoods
near
historic
buildings
following
the
urban
fairy
tale,
propaganda
of
the
luxury,
City,
infinite
growth
and
the
disregard
of
the
natural
limits
of
density.
The
city
does
not
need
to
infill
every
parcel
and
Beacon
with
housing,
accessory
dwellings
and
airbnbs.
J
J
We
can
must
protect
and
save
endangered
historic
sites
across
the
city
through
these
artistic
interventions,
I
fear
the
additions
of
floors
on
the
brown
block
buildings
on
the
East
End
of
Main
Street
are
next
an
overbuild
on
tyrande
Avenue,
surrounded
by
hdlo
building
and
properties
only
needed
a
building
permit.
Will
it
become
a
hotel?
J
Now
we're
listening
to
you,
Pat
yourselves
on
the
back,
what
a
great
idea
but
you're
not
working
for
the
residence
we're
already
hearing
about
the
we're
watching
the
future
Route
52
neighborhoods
being
threatened
with
needless
and
large-scale
over
development
will
be
another
blow
to
our
community
one
workshop
and
a
short
notice.
Public
hearing
can
forever
change
and
lose
our
quality
of
life
to
fill
the
agenda.
J
The
proposed
Route
52
high
density,
build
out
is
out
of
balance
with
nature
in
response
to
the
gentrification
and
Rapid
Mass
development
of
urban
areas,
where
the
importance
of
light
industrial
Zone
districts
are
necessary.
History
of
that
area
has
has
proved
it,
and
the
natural
environment
it
meant,
is
all
too
ignored.
J
Did
you
not
hear
residents
concerned
with
building
out
the
corner
of
Main
Street
and
52
encroaching
single-family
residents
with
the
project
currently
in
front
of
the
planning
board?
The
one
where
the
developers
lawyer
said
to
a
resident
across
the
street
they'll
build
a
high
tall
green
wall
to
block
out
the
blinding
lights?
Come
on,
stop
the
madness.
Enough
is
enough.
Last
week,
at
a
workshop,
we
listened
to
the
city's
own
plan.
A
Robert
stamp
new
zone
changes
recently
made
in
other
sections
of
the
beacon
City
into
the
Route
52
Corridor.
J
On
these
four
Parcels
that
Haley
Brothers
is
unloading.
We
need
more
light
Industrial
to
keep
the
city
thriving
Beacon
suffered
years
ago.
In
the
last
of
the
industrial
factories,
closed
up
shop
and
the
city
became
boarded
up,
and
now
you
want
to
repeat
history
and
get
rid
of
the
last
few
light.
Industrial
partials.
J
Those
big
ugly
boxes,
I'll
fight
this
thinly,
disguide
veiled
reuse
with
my
final
breath
as
a
resident
living
behind
the
project
on
the
opposite
side
of
the
creek
I,
refused
to
change
my
quality
of
life
and
that
of
my
neighbors
for
your
profit.
We
do
not
want
to
look
at
Future
parking
lots
on
the
rear
of
these
buildings,
abutting
the
precious
Fishkill
Creek,
a
protected
Waterway
enlisted
New
York
State
flood
zone.
You.
K
A
K
If
you're
on
zoom
and
you'd
like
to
make
a
public
comment,
you
need
to
reuse
the
raised
hand
option
if
you're
joining
us
by
a
phone
you'll
need
to
press
star
nine.
If
you're
joining
us
by
YouTube,
you
will
need
to
join
the
zoom
by
visiting
beaconny.gov
and
as
of
now,
we
have
no
hands
raised
on
soon.
A
Okay,
thank
you
Ben,
so
there'll
be
a
second
opportunity
for
public
comment
at
the
end.
So,
let's
move
on,
we
have
a
public
hearing
that
we're
going
to
adjourn.
A
So
there
was
to
be
a
public
hearing
on
the
hip
loss.
The
concept
plan,
which
was
requested
to
be
adjourned,
do
I
need
to
do
anything
about
that
Nick
or
do
I
just
announce
the
adjournment.
A
All
right,
so
we
don't
need
to
add
anything
now
when
when
the
applicant
is
ready,
we
can
do
that
all
right.
So
let's
do
reports.
You
want
to
start
again
and
we'll
go
this
way.
L
Oh
I
just
want
to
start
off
by
thanking
everyone.
Who's
been
sending
emails
and
reaching
out
about
our
discussion
on
the
Fishkill
zoning
rezone,
Fishkill,
Avenue,
resuming
sorry
and
and
I
just
want
to
say
that
I
really
appreciate
all
of
the
great
ideas
that
I've
been
hearing
from
people.
L
One
of
the
things
that
I
I
have
been
hearing
is
to
maybe
look
at
the
project
more
holistically
than
just
the
zoning
and
to
maybe
do
some
drawings
of
what
Fishkill
Avenue
could
look
like
the
street
itself
as
walking
over
there
on
Saturday
there's,
certainly
room
for
a
bike
lane
there.
The
sidewalks
are
a
mess,
as
someone
has
pointed
out,
there's
no
garbage
cans,
not
many
trees.
So
there's
more
that
we
can
do
than
just
zoning
and
I
hope
we'll
take
a
look
at
the
whole.
L
The
whole
package
in
early
August
I
inquired
with
the
city
attorney
about
a
possible
requirement
for
a
viewing
platform
on
the
waterfall
on
the
west
side
of
the
waterfall
and
I
just
wanted
to
reiterate
that
I'm
interested
in
knowing
What
what
came
of
the
requirement
for
that
for
the
viewing
platform
and
then
lastly,
I,
want
to
thank
George
for
Dogwood.
L
Dogwood
has
been
very
Central
to
our
Civic
and
community
life
in
Beacon
very
much
the
way
that
public
houses
have
been
for
several
centuries
and
it
was
a.
It
has
been
a
real
Cornerstone
of
Beacon
life
and
nightlife
and,
and
it's
hopefully,
there'll
be
many
more
years
for
Dogwood,
but
it
wouldn't
have
it
without
George.
I
want
to
say
thanks.
L
B
B
I
am
also
happy
to
be
home
after
traveling
for
the
last
month
and
also
happy
to
be
back
to
bring
my
new
learnings
and
perspectives
back
to
the
council
and
back
to
Beacon.
My
travels
included
a
conference
in
St
Louis
on
local
governance
and
I
also
had
the
honor
of
visiting
the
current
reservation
of
the
Stockbridge
Muncie
band
of
Mohegan
Indians,
which
was
located
in
Wisconsin.
B
Their
ancestral
homelands
lie
primarily
north
of
the
city
of
Beacon,
but
they
did
give
our
Hudson
a
more
scientifically
accurate
name,
which
is
mahi
kanitak
the
river
that
flows
both
ways.
I
think
it
is
important
to
continue
to
use
the
language
as
much
as
possible
of
the
people
who
stewarded
this
land
for
thousands
of
years.
B
I
know
the
mayor
is
going
to
share
a
proclamation
for
today
as
part
of
patriots
day,
it
is
September
11th.
In
addition
to
expressing
my
grand
attitude
to
the
many
brave
people
who
gave
their
lives
this
day
22
years
ago,
and
in
recognition
of
the
grief
and
Trauma
many
of
us
still
Bears,
New
Yorkers
in
particular,
I
also
want
to
share
the
story
of
one
of
America's
first
veterans.
His
name
was
Daniel
ninham.
B
M
D
M
I
just
have
a
kind
of
a
quick
Public,
Service
Announcement
regarding
trees.
Recently
during
some
of
the
severe
weather
we've
experienced,
that
trees
have
been
coming
down
in
people's
yards
and
they
don't
often
come
down
cleanly
in
in
your
own
yard.
It
often
involves
neighbors
and
so
the
law
states-
and
this
is
something
that
people
should
be
aware
of-
that
you,
if
you
see
prior
to
things,
coming
down
a
dead
limb
of
your
neighbors
hanging
over
your
property.
M
Please
alert
the
property
owners
whose
base
that
tree
is
in
to
rectify
that,
because
once
it
comes
down
and
without
that
prior
notice,
if
it
comes
out
in
your
yard,
you
are
100
responsible.
M
So
it's
really
good
to,
and
it's
it's
good
for
everyone
to
know
if
there's
dead
limbs
or
trees,
so
please
be
free,
proactive
in
bringing
that
to
the
attention
of
the
homeowner,
because
ultimately
it
just
becomes
a
difficult
situation
for
all
neighbors
and
it's
stressful
and
it's
a
lot
of
unexpected
monies.
So
just
take
that
into
consideration
in
the
future.
Thanks.
That's
all
I
have.
N
I'm
going
to
keep
it
brief
as
well:
I
want
to
welcome
everybody,
that's
starting
school
again
and
just
remind
everybody
to
Drive
slowly,
especially
with
students
walking
to
and
from
school
and
I,
don't
have
formal
office
hours.
But
if
you
go
to
the
city
of
Beacon
website
under
the
city
council
page,
you
can
schedule
a
meeting
with
me
most
days
of
the
week.
H
Thanks
Justice
I
want
to
thank
the
Elks
Lodge
for
their
ceremony
that
they
did
in
honor
of
9
11.
On
this
past
Saturday
they've
been
offering
this
ceremony
to
the
community
for
several
years
and
it's
just
great
to
see
that
they
continue
to
honor
the
people
who
are
directly
impacted
in
our
community
and
to
offer
as
a
way
for
anyone
who
wants
to
to
come
out
and
be
part
of
the
ceremony
and
recognize
what
happened.
D
H
Years
ago,
I
also
wanted
to
let
people
know
that
there
is
currently
a
work
being
done
to
consider
closing
some
streets
around
East
and
West
Willow
in
my
ward
for
Halloween.
This
will
be
on
Halloween
night
from
6
to
9
pm,
and
so
the
people
who
are
interested
in
this
are
currently
going
door
to
door
to
try
to
get
signatures,
which
is
part
of
the
process.
Whenever
you
have
a
street
closer,
so
I
wanted
to
bring
it
up
here.
H
J
H
If
you
want
to
be
able
to
have
access-
and
this
would
be
so-
that
non-residents
along
those
streets-
the
the
goal
is
that
they
won't
be
driving
during
six
to
nine
PM
that
night
and
lastly,
I'll
have
office
hours.
This
coming
Sunday
as
well,
September
17th,
but
in
the
afternoon,
from
4
to
6
p.m,
at
pool
Hill,
Park
or
if
the
weather
has
other
ideas.
I'll
move
over
into
bank
square
and
I
will
pass
it
to
Ren.
Who
is
online.
C
Thank
you
Molly
good
evening.
Everyone
I
am
on
day
six
of
my
covet
quarantine,
so
I
will
be
very
brief
as
to
not
dissolve
into
a
coughing
bit,
which
seems
to
be
coming
with
this
round,
so
express
my
gratitude
to
the
spirit
of
Beacon
day
volunteers.
C
That
is
a
very
exciting
announcement
that
you
made
earlier
with
a
lot
of
participation
in
our
city
and
I'm,
very,
very
excited
about
the
spirit
of
Bika
Day
this
year,
thanks
to
everyone,
who's
Taken
part
in
it
and
if
anyone's
signing
on
to
the
meeting
right
now,
please
go
to
the
city's
website
and
you
can
see
more
information
on
how
to
volunteer.
C
A
Thank
you
all
I'll
also
be
brief.
I
I
guess
there's
a
typo
on
our
letterhead.
It
has
Church
Mansfield,
It's,
At
Large.
Clearly
he's
the
councilman
from
Dogwood
I'll.
Add
one
thing
on
Limbs
and
I'm.
Glad
George
mentioned
that
if
the
limb
from
your
neighbor
extends
into
your
lot,
you
can
take
it
down
and
that's
within
your
rights.
So
that's
the
other
way
to
kind
of
get
at
it.
Is
you
know
if
you're
worried
about
limbs?
That's
one
way
to
go
for
it.
I.
A
Damage
from
tree
limbs,
you
know
I,
guess
the
long
term
is
you,
you
pre-prune
them
all,
but
that's
just
really
really
hard
to
do
anyway.
A
A
I
will
say
before
I
read
the
proclamation
that
over
the
years
I
think
many
of
you
know
that
I
started
on
the
council
30
years
ago,
and
one
of
the
hard
things
was
understanding
in
the
community,
whether
our
future
lied
with
factories
or
industry
zoning
or
whether
it
lights
somewhere
else,
and
it
took
quite
a
long
time
and
in
fact
I
think
many
of
you
know
that
the
DSi
was
zoned
industrial
and
was
marketed
industrial
and
almost
became
industrial.
Once
again
before
Dia
came
along
at
the
11th
hour
and
I
I.
A
Think
diach,
you
know,
was
probably
the
single
most
important
Catalyst
in
Transforming
Our
Community,
not
industrial
zoning
I
personally
have
slowly
but
surely
worked
at
removing
most
industrial
zoning.
We
still
have
some
light
industry
and
some
heavy
industry
on
the
Route
52,
Corridor
and
I
do
believe
that
any
kind
of
zoning
that
I'm
interested
in
will
maintain
the
option
for
that
type
of
zoning
as
well
as
additional
uses.
A
Having
said
that,
I
would
like
to
read
a
proclamation
as
the
last
thing
I
do
so.
This
one
is
a
proclamation
in
honor
and
a
remembrance
of
Patriot
Day
September
11
2023.,
whereas
today
we
join
communities
across
this
country,
remembering
the
nearly
3
000
innocent
victims
lost
in
the
attacks
on
September,
11
2001
and
also
honor
the
heroes
who
serve
their
Community
22
years
ago.
A
Now,
therefore
be
a
resolved.
I
merely
kiryaku
do
hereby
proclaims.
September
11
2023
is
Patriot
Day
and
National
Day
of
Service
and
Remembrance,
and
encourage
the
city
of
Beacon
residents
to
pause
in
remembrance
of
the
individuals
who
perished
as
a
result
of
the
terrorist
attacks
and
in
honor
of
those
who
bravely
responded
to
these
attacks
to
save
others.
O
You
I
have
two
traffic
updates,
we'll
be
closing
South
Avenue
part
of
the
day
tomorrow
and
all
day
Wednesday
to
cut
in
the
new
electric
service
for
the
fire
department.
The
city
school
district
has
been
notified
about
that,
but
please
try
to
avoid
that
area
if
you
can.
Secondly,
we
have
a
traffic
light
that
is
malfunctioned
at
verplank
and
Matawan.
It's
gone
just
to
a
flashing
light,
we're
aware
of
it
and
we're
waiting
for
a
part
for
the
controller
for
that
in
the
bless.
O
In
the
meantime,
we've
posted
police
there
they'll
be
there
in
the
morning
and
afternoon
to
help
kids
cross
at
that
intersection
and
we're
trying
to
get
that
back
online
as
quickly
as
possible.
I
also
just
want
to
highlight
our
sidewalk
project
on
South
Avenue
is
completed
and
it
came
out
very
well.
It's
the
section
between
Davies
Avenue
and
Walcott
Avenue,
and
we
got
a
little
bit
of
just
clean
up
work
and
I
think
the
crosswalks
haven't
been
painted,
but
everything
else
is
done.
N
Can
I
just
get
some
clarification
on
the
closure
for
South
Avenue?
Is
that
just
the
stretch
from
Main
Street
to
Beacon
Street,
to
the
end
of
where
the
fire
station
or.
L
N
O
That
hasn't
been
set
up,
but
it
will
be
yeah.
Thank
you.
Thanks
for
the
clarification
it
was
just
in
the
area
right
across
from
the
firehouse.
A
O
O
N
A
A
Nothing
nothing!
Thank
you.
Okay,
let's
do
local
laws
and
resolutions.
The
first
one
is
a
resolution.
Appointing
Andrew
Bell
to
the
tree
advisory
committee
and
I
get
a
motion
in
a.
A
That
was
Justice
in
Paloma.
Any
discussion
I
just
want
to
thank
Andrew
Bell
for
all
his
service
over
the
years
on
various
committees.
D
A
Opposed
all
right,
thank
you,
red
yeah,
make
sure
I
can
hear
it.
Thank
you.
Second
one
is
also
a
tree
advisory
committee.
Appointment,
it's
Ethan
scooches.
If
I'm
saying
it
correctly,
can
I
get
a
motion
in
a
second
motion.
H
N
Can
I
just
get
some
clarification,
did
terms
for
the
tree
advisory
committee
expire?
Are
we
feeling
empty
seats
or
expired
seats
or
where
they're
just
open
seats.
O
N
A
H
E
Thank
you
mayor,
so
the
city
prepared
bid
specifications
for
the
fiberglass
and
Rehabilitation
project
for
the
beacon
pool
it
was
noticed
in
accordance
with
state
law
bids
were
received
and
there
was
a
lowest
responsible
bidder.
E
So
after
we
reviewed
the
matter
spoke
with
Mark
about
the
project
and
the
timing,
it's
our
legal
opinion
that
the
bids
therefore
should
be
rejected,
as
the
city
is
permitted
to
do
so
under
New
York,
state
general
Municipal
law.
So
today,
you're
just
adopting
a
resolution
rejecting
those
bids
we're
going
to
work
with
Mark
to
revise
the
contract
and
the
invitation
to
bidders,
and
this
will
likely
come
back
to
the
council
in
the
spring
for
an
award
of
the
contract.
At
that
time.
H
H
Is
as
it
sounds
like,
I
won't
go
out
in
this
spring.
I
think
the
initial
intention
was
to
try
to
do
the
work.
This
fall
is
that
what
I.
D
O
B
Great
definitely
I
recall
also
from
listening
to
last
week
that
there's
concern
about
somebody
retiring
and
making
sure
that
this
would
still
be
available
to
somebody
that
might
want
to
bid
yeah.
O
That
person
may
retire,
I
think
I.
Think
it's
in
the
city's
interest
to
rebid
it
with
update
some
updated
specifications.
We
we
had,
they
weren't
quite
bidding
on
the
same
thing.
O
And-
and
we
may
have
a
product-
that's
better:
we
want
to
make
sure
everybody's
bidding
fairly
on
the
same
set
of
same
scope
of
work
with
the
same
product,
yeah.
O
A
Okay
I
note
that
I'm
sure
that
the
administration
will
reach
out
and
let
bidders
know
what's
up
and
encourage
them
to
bid
when
it's
ready
anything
else.
Okay,
all
in
favor
of
rejecting
the
bids
received
from
the
beacon
pool,
fiberglass,
Rehabilitation
projects,
say
I
I,.
O
A
H
E
Certainly
so,
this
resolution
pertains
to
the
property
of
a
four-story
multi-family
building
approved
by
the
planning
board
at
16,
West
Main
Street
in
connection
with
the
construction.
There
are
certain
infrastructure
that
needs
to
be
constructed
at
the
Builder's
cost,
Property
Owners
cost
and
then
because
it
will
be
public
infrastructure
in
the
health
department
requires
to
be
organized
to
run
and
maintained
and
operated
by
the
city.
It
is
being
installed
at
the
developers
cost
and
then
the
maintenance
bond
is
provided.
E
The
city's
engineer
will
inspect
it
during
construction
and
also
during
the
first
year
of
its
operation,
and
it
is
being
offered
for
dedication
to
the
to
the
city,
and
so
this
will
be
in
water
utility
and
sight
line.
Easement
on
the
sideline.
E
H
I
have
a
very
question
for
you,
Nick,
so
I
notice,
as
we
happen,
to
have
another
Eastman
Eastman
for
a
totally
separate
piece
of
property
on
the
agenda
that,
with
the
combined
real
estate
transfer
tax,
return,
the
section
that
talks
about
condition
of
conveyance,
which
is
the
bottom
of
page
27.
In
our
taxes.
In
this
form
they
checked
other
and
wrote
easement
agreement,
but
in
the
other
one
they
said,
conveyance
of
an
easement
and
I
just
wanted
to
check
that.
H
E
N
O
E
Just
saw
that
thank
you
for
pointing
out
yep
those
are
prepared
by
the
applicant.
We
should
notice
that,
but
those
are
the
applicant
stockings,
so
we'll
ask
them
to
correct
it.
It's
not
material
in
terms
of
it
doesn't
affect
the
property
the
city
will
describe,
but
it
should
be
correct,
so
we'll
get
it
corrected
before
we
ask
Chris
to
sign
it.
Okay,
and
thank
you
for
that
review.
A
A
H
A
B
I
think
Jennifer
clarified
this
in
a
workshop,
but
I
wanted
to
be
sure
that
we're
accepting
this
tiny
corner
of
sidewalk
but,
as
is
true,
the
rat
Beacon,
the
property
owner,
is
still
responsible
for
shoveling
the
sidewalks.
Yes,.
A
A
D
A
A
E
You
so
44
Kent
Street
was
a
free
live
subdivision
before
the
planning
board
that
was
approved
in
May
of
2023.
During
the
review
of
the
subdivision,
it
was
noted
that
there
is
a
public
infrastructure,
a
subsurface
storm
drain
drain,
there's
Colbert
that
is
located
on
the
applicant's
property.
There
was
no
evidence
of
a
recorded
easement,
permitting
the
city
to
have
that
pipe
on
its
property
so
similar
to
what
we
just
discussed
about
the
sidewalk.
E
The
applicant
is
agreeing
to
give
the
city
the
an
easement
to
allow
its
drainage
infrastructure
to
be
located
on
the
private
property,
as
it
has
been
for
who
knows
how
long
so,
by
this
resolution,
you're
accepting
the
grant
of
an
easement
to
allow
the
city
infrastructure
to
remain
at
44.
Kent
Street
provide
approximate
five
foot,
subsurface
storm
drainage,
culvert.
E
No
I
think
this
city
knew
about
it.
The
question
was
when
it
was
installed,
was
there
and
easement
granted
may
have
been,
it
may
not
have
been
recorded
or
it
could
have
been
done.
30,
40,
50
60
70
years
ago,
and
no
one
obtained
an
easement,
because
the
property
owner
said
okay
or
they
just
assumed
it
was
city,
property.
E
No
I
came
to
mind
led
to
bully
from
conversation.
It's
not.
It's
certainly
not
recent.
It's
in
the
part
of
the
existing
infrastructure.
A
D
A
Streets
off
Main
and
comes
across
teller,
just
behind
Madame
brat,
so
there's
a
few
of
them
I
assume
that
during
after
the
city
was
incorporated
and
they
started
laying
out,
you
know
plots
for
development
or
for
homes
that
they
put
several
of
them
underground.
I.
D
A
Also,
between
90
and
Dutchess
Terrace
on
several
streets,
and
some
of
it
is
above
ground,
and
some
of
it
is
under
there's.
A
Really
you
know
that
recently
yeah,
so,
okay,
any
other
questions.
B
This
is
just
me
trying
to
understand,
so
this
is
a
functioning
storm
drain
in
terms
of
the
fact
that
it's
a
pipe
that
also
diverts
rain
water
off
of
the
street
that
we're
speculating
that
it
also
may
have
been
an
enclosure
of
an
existing
Creek
many
years
ago
when
it
was
built
and
we're
not.
Those
are
two
different
things,
but
it's
the
same:
enclosed
Waterway.
E
What
I
understand
from
this
conversation?
Yes,
it's
an
existing
pipe.
Its
function
is
what
was
being
discussed
tonight,
whether
it
was
a
capsulation
of
the
creek
or
if
it's
for
controlling
stormwater
or
both
I,
don't
know,
but
it
is
existing
infrastructure
of
the
city
has
I,
understand,
maintained
and
relies
upon.
A
So
that's
Justice
and
George.
Any
discussion
I
think
Nick.
This
is
the
small
two-story
Second
Empire
on
Commerce
behind
the
first
few
buildings,
just
off
South
Ave.
That.
E
Is
correct:
this
is
rezoning
the
information
that
the
agenda
packet
goes
through.
The
planning
boards
comment
memorandum,
as
well
as
the
applicants
letter
in
the
city
planner's
memorandum
to
resume
one
parcel.
B
Sorry
I
had
a
as
I
think
I
said
when
we
first
discussed
this
a
couple
of
months
ago.
I
think
that
you
know
pending
public
input.
The
the
long-term
use
does
make
sense
as
commercial.
B
O
Building
inspector
went
and
spoke
to
the
people
who,
who
I
think
lived
there
and
also
ascertained
that
the
the
signs
indicating
a
commercial
business
were
not
there
when
he
visited,
and
he
didn't
see
any
sign
that
they
were
violating
our
code
at
this
time.
So
again
that
I
don't
know
what
they
did
in
the
past.
But
when
he
went
based
on
a
complaint
he
could
not
confirm
that
there
was
any
kind
of
enforcement
action
necessary.
D
A
Any
other
comments
questions
all
right.
So
all
in
favor
of
setting
a
public
Hearing
in
two
weeks
on
the
proposers
owning
a
six
Commerce
Street,
say
aye.
A
You
Ren,
okay,
the
hordes
are
coming
in
now
because
we're
about
to
get
a
motion
to
approve
the
minutes
of
August
21st
can
I
get
a
motion
and
a
second
motion.
So
that's
Molly
and
Dan,
and
we're
looking
for
readers
of
the
minutes
and
either
Easter
eggs
or
Corrections
or
deletions.
H
I,
don't
have
anything
for
these
minutes.
I
did
want
to
say
publicly
that
we
had
discussion
about
the
minutes
of
August
7th,
which
I'm
sure
we
all
remember
so
well.
We
discussed
it
at
our
last
voting
meeting
on
August
21st
and
there
was
an
issue
of
we
didn't
properly
say
we
went
into
executive
sessions,
so
I
actually
Ben
took
a
look
and
we
did
not
have
an
executive
session
the
evening
of
August
7th.
