For the appeals meeting, um it's all accustomed that we begin our meeting by reciting the pledge of allegiance. If I can ask you guys to stand and play supply.

Thank you. First of all, let me uh introduce one of our newest members to this board. um Mr um evan bromley welcome to the zoning boards of appeal. Thank you glad to be here. Thank you and I'd like to take this time to thank uh one of our other members, mr chet williams, um for his time and his tenure here at beaufort, county's only mode of appeal.

uh I could like to say that I have gleaned and learned a lot from mr williams and I'm quite sure, a lot of my other colleagues that have been on this board for a while can probably echo the same.

In second, all in favor of the january 27th and the february 24th meeting, I get someone. Okay, all right item number six, mr martin smoothie uh vinair, snotty yeah, we've been here last week, uh just give us an update on yeah what happened since the last time. We.

Saw you so not not too much. I had a two contractors flake on me and I looked for a smaller sized carport, one that was 10 foot wide and they're all uh not good, they're, flimsy and kind of uh just not up to par of what I had originally planned. So um at this point, I'm not sure what to do.

If you know if it means asking for another continuance, if that's possible or uh just going ahead and trying to vote on the original application.

If you were to access board for another continuous, what are you looking to accomplish within that time frame.

Well, meet with a contractor that could give me something: that's a not as wide 10 foot wide as opposed to 12 foot wide, um get him to draw out some plans, and then I can bring those plans in and and be able to demonstrate a little bit better.

What I'm trying to do.

Yeah because, as of now it's you know, it's.

You know finding people to come over and look at things is just impossible. Okay, um so that that's kind of where I'm at at this moment.

I'm almost tempted to just.

To go and tonight and get a vote on on the original plan, but I'm still a little ambivalent about it. So you know I came here not with a real, concrete idea of what what was gonna. What was gonna happen, but here I am and just trying to take it one step at a time really.

I'm not and- and I'm quite sure, because I I just noticed that you have a carport on both side- and you said you know your carport drawn to scale. Is that the one that you're in that's the one? That's a question, that's drawing the scale right and let me just ask a question: you're separate taking drain field, do your drain feel that's. Does it come all the way over to the edge of your property.

Line pretty close yeah, it's it's I'd, say it's about five foot away. When I had somebody out there to inspect it, it kind of bleeds over into that area.

Well, if it's the pleasure to board, I mean you can't access to. If you want to access for continuance or you can, we can move on this tonight. If you want to okay.

So if we, if we moved on this tonight, the consequence of getting voted down would be I'd have to wait a year before reapplying, correct, correct, okay,.

You know what I think, just the nature of contractors this day and age, and not being able to get people over people not showing up when they're saying they're going to show up, I'm afraid that in between my work schedule, I'm afraid that uh you know if I ask for a continuance and I go, and I try to get people to show up to the house and they don't show up, I'm gonna be coming back.

It's gonna be a similar thing, um so I think I will try to go ahead and move on this this evening and um just and take it from there. Yep.

Okay, mr chairman, I'd like to just say something: you are aware of the county record. This is recommended to disapprove this variance. Yes, sir okay, so you know.

So, mr martin, let me ask you another question. Yes, I mean I'd like to help you as much as I can, because I notice that you have some areas in the rear of your property near the pool area. But I guess you, you think that the irrigation would or your drain feel. You said it's only five feet away. Yeah.

And you know the reason.

The reason why I say irrigation is an issue is uh I actually had somebody drive on that already and it busted ahead and it busted some of that pvc and it was a pain.

It's just a pain to deal with. I do like that feature of the house, but um I guess there's since I I've never had that system before, but it has busted on me already well.

uh Mr chairman, I'm moved that we disapprove the variance and follow the county's recommendation because it exceeds the five foot setback.

Good evening my name is david carlitt, I'm a carillon engineer, I'm here tonight on behalf of mr allen, patterson, who has requested a special use, permit to dig a four and a half acre pond on a 303 acre parcel on saint helen island.

The following will follow the beaufort county requirements for mines, five acres and less people.

I'm glad to answer any questions you all have.

I have a question.

Is the depth 20 feet or is it 12 feet 12 feet the property slopes, the highest top of bank is elevation 20., the lowest top of bank is elevation 15. We took 12 feet from elevation 20., so it'll be 12 feet deep on the deepest end and a little shallower on the other side, a d-hack allows you to dig it 20 feet, but county only allowed 12 and that's why we stopped at 12.

It says that uh for number four page two offer the uh reclamation plan v8500.

I think you guys put in there that uh uh describe the method to prevent the eliminate conditions that could be hazardous to animals and fish. The mining site will complete completely be fenced to keep wildlife out of the fencing.

To keep wildlife out and the fencing will be removed once the site has been reclaimed. um Is that your guys plan to fix that.

The property is currently fenced, the entire thing they're going to leave the fence in there, as is.

Events will not be removed. You know it's there to keep people out, not necessarily wildlife. Okay,.

The reason why I lacked that, because I know that I think in the previous pond that we uh permitted, I think we kind of uh omitted, that from being one of the conditions being, that it was fully vegetated and you have ditches around there, but um that pretty much surround that that that pawn as well as field. So that's why I was wondering if you guys were going to be fencing that pawn in within that what five four four point, something they could five point something nickers there.

So they're gonna use the perimeter currently out there.

We want them in the house, I have any questions for.

County recommended approval. We looked at this as a staff review team and we have. We have 12 um conditions that has to be met.

So one the mine can be no more than 12 feet. Deep, fencing, 100 foot perimeter buffer reclamation bond.

We are not going to use the dhec bond um hours of operation, 7 30 to 6 30 monday through friday and then eight to five on saturdays, nothing on sunday and um they're, going to be using the existing whole road and they're going to sweep the curb to ensure that seaside road is kept free from debris.

The deordering information to storm water at final review and the monitoring well the test for salt level and.

Then they're also supposed to.

Submit quarterly reports to ensure that the pond is no more than 12 feet deep.

When you received it yeah and I'm just trying to make heads up like what's what okay, what I'm looking at, and so I don't mean.

um Item number mr michael deluca who's requesting a variance to construct a single-family home residence within the 50-60 feet.

Of the setback, thank you for having me and thanking me for coming here for the variance I just got flat fire outside. So I'm like. Oh man, it's raining now, I'm looking for a 5.8.

um This critical line on our lot drags all different ways and the 5.8 critical line of 4.8 shows on the survey that we had done.

H

We're not encroaching uh we're not going over the critical line, the critical line I've been there for years and we went to the first arv and they approved taking the house and moving it forward. So we get away from the critical line. So the critical line stands at 5.48.

You said you, you moved the house forward, yeah.

H

So the front is 19 19, it's usually 25., so fripp. Let us move the house forward. Take it but get away from the critical one.

And that's the house currently on the planet, correct that is correct. Okay, so nothing changed. Nothing changed right now,.

It's a very it's a very uh unusual lot and uh it's a lovely lot. I'm the owner of a lot.

The staff review team recommended me to try to be 15 feet away and uh I went to david gasco, the survey in town yesterday and we've we reversed the house and one corner. We have 16 feet another corner, we have 10 another corner, we have 12., but since the critical line is curved, you can't have a straight line. It can't be all one one.

And why are you tied to the design of this particular design of the house? Why can it not be redesigned.

H

Well, that means the whole house would be redesigned, and that would be tremendous pressure on me to do that. I'm not a designer I have to. I spend a lot of money to have a design. The.

Reason why I went forward.

I didn't know there was a critical line. I bought the lot five years.

Ago I was in the same situation.

With the same plans, the same house- and I was five feet from the critical line it was approved unanimously. I bought that paperwork here now.

So it's the same home uh six blocks six blocks away and I'm still looking to keep that the way it is now without designing and ripping down the whole thing and throwing the plants in the garbage and it's very difficult to build a home. It's only 40 feet deep, that's all I have here.

So if you look at the plan, all the bedrooms are in the front and we kind of narrow it into the back.

So this this portion here in the in the on the river side, that you said, that's a bedroom there.

For the front, those are bedrooms in the back, that's unfortunate, so that's important! That is, of course, so if we flipped it, we can get a little further away from the critical line.

If you'd like to see that I have it here. Yes, you'd like to see.

So the house, to your left and to your right, how close are those houses to the critical life I mean I'm looking at right, you know: are these the back corners of the house.

Yeah they are well. This is sure I give everyone one of these.

So what you're looking at now is the house flip flip the whole entire home, and you see it that it holds a 16 foot line. It goes to 10 12 in the back there. So.

The part that just juts out the smallest part, that's is correct. Why couldn't you put that porch on on either side and then you would have.

On either side of the home yeah, it's it can't be done, but it wouldn't be the views of the mosh.

You still see the marsh from there.

So if you're saying, if you put that porch on the side of the home, it would prohibit you from your view of the march.

That is correct. You know you can't put it on the side, but you just you just you know the view is not there compared to what what you're looking at now.

But the the setback from the critical line is really important to protect the quality of the water.

Now I understand that, but I have really um unusual circumstances because of the light and critical line where it goes.

But I know you have unusual circumstances, but it seems like that you could work to redesign the back of the house, like the staff is recommending to not to be.

Further away from I reversed the house, I reversed it so now, when we're 16 feet, 10 feet and 12 feet. If I can't get five I'd like to have something well,.

We're trying to work with you, I mean that's. Why we're you know suggesting if you were to put it to the side, your porch? Yes, then, you would be further away from the critical line, correct.

You purchased this property december 2021.

That was a different variance board and we don't set precedence. Oh I understand.

But you would have aware that it existed. I mean due diligence, you would have looked to see where the critical line.

I did, and I put it where I put it now, because I thought it was approved five years, but you just told me something different and um I just want to be able to get the house in there.

And you know you can put the house in there. Okay, you know. Just you know you would have to you know I I can't speak for the board, but I think that porch area, if you were to redesign that porch area, I think it'll be more.

um You know the board will find more favoring and then, if you were to redesign that porch area, then.

You mean putting it to the side of the home right, okay, I'll agree with that. I would like to do that that helps the situation a little bit and.

Well, it'll help minimize anyhow yeah, so how many fields that we're talking about eight more feet.

Is that a covered porch screened in covered porch has a roof over it, so it is.

Well, you know our one of our greatest resources in the county and we do know that there are some lots that do need a variance. He came to the srt and the house was too big, so we and he he was too close- we can go. We are not allowed to go less than 20 feet from the critical line. So looking.

There's a whole lot of space on the sides that the house can be redesigned and get as far away from the critical line as he possibly can. I mean he should be trying to get the least amount of well the most. What is it, the least variance so that we can have a buffer.

We can have a.

Planted buffer- and you know something that the runoff can in infiltrate, and so it's not going all the way into the into the marsh. So that's why we recommended that he redesign the water side of the house and and get that roof line as far away from the critical line as he possibly can and there's space on the. So it's not like he's taking up the entire there's space on the side of the rear.

That he can do.

Something with and be away from the critical line, so we recommend this approval. um Well, we recommended approval if he redesigned the house and get it as far away as he possibly can. If not, then staff recommends his approval.

Ms austin, wouldn't you recommend that if he should just come back with the redesign instead of us granting a variance for an unknown if.

He's willing to go back and bring something back for next month. I'm fine with that. You can look at it.

So, are you the county still looking for that minimum 15 feet.

As a short-term rental, also on the air community plan, have you been operating under that short term prior to receiving a notification? We.

Started in october and ended in november, because we have found out that we needed a zoning permit, because before when I went, they just told us, we needed a business license.

Went in to see the business license also is, when I found out that we needed a zoning permit, so we shut them down as soon as we found out so.

It's um it was like 520 or something, but what I, the reason why I took the pictures of the other stuff is because this stuff is deteriorating. My building doesn't look anything like that. Was put on there july 4th and I guess a complaint went on in november 16th and my neighbors don't seem to have a problem except one. Whoever complained.

No, there are proper, there's two properties there. It's both families front and back my sister lives behind me and she doesn't care that that building's there either. Neither do the people next to me or a lot of the people, because I had letters, people wrote letters.

Yeah we had, I think, a couple in support and probably five or six that were opposed to it. Oh really,.

So but I don't understand that, why would they pick on something like this, but then they don't take care of something that's been sitting on buchanan for 20 years. That looks like this. We.

Yeah, I I understand you're concerned, but that's not you know before us today, um but you said your sister lives behind you. Yes, my sister and I'm not you know not recommending I'm not trying to tell you what to do, but do you think she would be opposed to having this on her property versus where it could well. I can't even say that, because I don't know the size of her home.

Well, I mean it's just too big for one you mean you meet the setbacks.
