the
april
7
joint
planning,
commission
and
city
council
workshop
where
we
discussed
the
proposed
changes
that
we
have
before
you
today
and
and
for
those
of
y'all
who
were
not
there
I'll
just
go
ahead
and
give
a
quick,
quick
synopsis
of
of
why
we're
bringing
these
proposed
changes
to
you
back
in
2016
there
was
a
supreme
court
decision
called
reid
versus
the
town
of
gilbert
arizona
and
the
case
in
question
involved
a
a
lawsuit
by
a
local
church
in
the
town
of
arizona,
and
this
church
in
question
did
not
have
a
location.

They
didn't
have
a
sanctuary
themselves.
They
would,
they
would
move
their
their
worship
service
to
different
schools,
different
locations
in
the
community.
So
in
order
to
advertise
for
that,
they
would
put
out
temporary
signs
sometimes
referred
to
as
bandit
signs,
but
we've
seen
them
whether
they're
advertising
a
service
or
real
estate
or
campaign
signs.

We
see
a
lot
of
those
they're
they're
called
temporary
signs,
so
this
church
would
put
out
those
temporary
signs
and
the
issue
for
the
town
of
gilbert
is:
it
ran
afoul
of
their
sign
ordinance
and
what
their
sign
ordinance
said,
which
is
what
a
lot
of
sign
ordinances
in
america
say.
Is
it
outlines
what
signs
are
allowed
but
then
typically,
there's
a
section
of
the
sign
ordinance
that
exempts
a
lot
of
signs,
because
the
city
does
not
a
city
does
not
really
want
to
permit.

Every
for-sale
sign
in
a
city
does
not
want
to
permit
every
campaign
sign
in
a
city
so
there's
usually
in
in
most
zoning
ordinances.
There
is
a
section
of
the
ordinance
that
exempts
signs
and
it
goes
through
and
outlines
those
types
of
signs
and
the
way
it
is
typically
done
is
by
identifying
those
signs
by
what's
in
the
sign,
so
you'll
you'll
see,
campaign
signs
are
exempt,
temporary
events
are
exempt,
etc,
etc.

We
were
also
waiting
on
a
case
coming
out
of
the
city
of
austin,
where
a
billboard
company
had
sued
the
city
saying
that
they
were
violating
the
reed
decision,
and
I
believe
that
the
the
city
did
not
prevail
in
that
case,
so
they
lost.
So
that
takes
us
to
our
proposed
ordinance.
Today
and
again,
I
have
I've.
I've
handed
out
a
two-page
sheet
which
basically
shows
the
types
of
temporary
signs.

What's
in
the
current
ordinance
and
what's
in
the
proposed
ordinance,
and
maybe
before
I
go
through
those
real
quickly,
let
me
just
say
that
our
ordinance,
like
many,
is
broken
into
three
parts.
The
first
part
is
kind
of
a
prescriptive
part.
So
if
you're
a
new
business
coming
into
town-
and
you
say
I
want
to
locate
a
restaurant
in
town,
what
kind
of
sign
package
can
I
have?
You
can
have
a
free
standing
sign
of
such
and
such
size
or
such
and
such
height?

There
is
some
language
throughout
you
may
notice
in
those
sections
that
refer
to
content,
so,
for
example,
in
that
section
there
are
there's
a
provision
for
electronic
reader
board.
You
may
recall
several
years
ago
we
used
to
not
allow
those
electronic
reader
boards,
like
you,
see
at
pharmacies,
but
we
did.

We
have
proposed
to
make
those
changes
so
again
we're
looking
at
what
the
court
says
we
can
do,
which
is
we
can
control
the
location,
the
number
the
size,
the
height
and
the
manner
in
which
they're
displayed,
which
is
not
the
content
so
you'll
see
throughout
you
know,
we've
made
some
minor
changes
to
that.
So
that's
the
first
part
of
the
sign
ordinance
and
again
this
is
typical
across
the
country.
The
second
part
of
the
sign
ordinance
is
for
billboards
and
you'll
see.

We've
made
some
changes
to
the
definition
in
that,
because
the
way
we
typically
define
billboards
is
whether
or
not
they're
advertising
for
the
business
or
the
use
on
the
property
versus
an
outside
use.
So
what
you
typically
see
on
a
billboard
may
not
be
related
to
what's
on
that
property,
we
have
copied
the
state
definition,
so
the
state
changed
their
definition
after
read,
and
so
we
have
gone
back
and
copied
it
verbatim
so
that
we
can.

Now
the
third
part
of
the
sign
ordinance
is
is
kind
of
the
gist
of
what
we've
been
talking
about
and
that's
the
exempt
section
and
again
these
are
all
the
signs
that
should
that
are
exempt
from
permitting
just
because
there
are
so
many.
We
understand
they're
necessary
for
life
in
the
city,
but
we
don't
want
to
permit
them,
but
we
kind
of
have
to
define
them
so
that
we
don't
have
to
permit
them,
but
again
because
of
read,
we
have
to
read
it
to,
or
we
have
had
to
read
it
in
order
to
enforce
it.

So
what
we've
proposed
is
outlined
and
again
these
are
for
temporary
signs.
What
we've
proposed
here
is
outline
in
the
sheet
in
front
of
you,
and
so
in
the
first
column.
You'll
see
temporary
sign
type,
for
example,
real
estate,
construction,
flags
yard
lettering
and
campaign,
and
what
I've
got
here
is
line
per
line
is
the
number
the
size,
the
height
and
the
duration,
in
other
words,
the
time
at
which
you
can
have
a
sign
again
without
having
to
get
a
permit
so,
for
example,
real
estate.

The
current
ordinance
allows
one
per
street
a
maximum
of
eight
square
feet.
In
height
there
is
no
height
defined,
but
again
you
don't
have
to
have
a
permit
for
a
real
estate,
temporary
sign
during
sailor
lease
of
the
property.
What
we're
proposing
is
no
change
to
the
number,
no
change
to
the
size.
We
are
putting
a
six
foot
high
maximum
on
it
and
then
again
during
the
sailor,
lease
of
the
property
that's
for
residential.

Again
right
now,
it's
limited
to
eight
square
feet.
We
are
proposing
50
square
feet
again.
In
commercial
height,
there
is
no
defined
height,
but
we
are
proposing
a
15
feet
height
and
then
again
during
a
sale
or
lease
of
a
property
going
down
next
to
construction
again,
the
currently
you're
only
you're
limited
to
one
construction,
temporary
sign
per
street,
we're
proposing
no
limit
and
again
a
lot
of
these.

That
first
row
is
yard
lettering,
so
we've
talked
about
that
you've
seen
them
around
town
they're,
typically
in
the
neighborhoods,
where
you
see
a
happy
birthday
or
congratulations
or
happy
anniversary.
These
are
relatively
new.
I
think
phenomenon
currently
they're
not
allowed
by
the
current
ordinance.
So
what
we're
saying
is
we
do
want
to
allow
them.

We
just
and
you'll
see
the
size
of
60
feet,
which
sounds
pretty
big,
but
if
you
go
and
you
look
at
them
and
measure
them
they're
actually
pretty
large,
so
the
60
feet
would
not
be
per
letter.
It's
the
whole
sign
five
feet
in
height
and
then
again
just
limit
it
to
seven
days,
and
that
would
be
the
proposal
is
for
that
scheme
to
be
for
both
residential
and
commercial
and
then,
finally,
last
but
not
least,
would
be
campaign
or
election
signs.

So
in
residential
zones,
the
current
ordinance
says:
there's
no
limit
the
current
ordinance
limits,
you
in
residential
districts
to
eight
square
feet
in
size,
six
feet
in
height
and
the
time
duration
is
for
60
days.
Maximum
must
be
removed.
10
days
after
the
election,
that's
residential,
we're
proposing
no
limit
to
the
number.
We're
proposing
a
maximum
of
16
square
feet,
which
is
twice
you
know
it's
twice
as
big
six
feet
in
height
maximum
and
then
we're
clarifying
the
definition
a
little
bit,
but
essentially
the
same.

Currently,
there's
really
no
limit,
but
I
put
on
here
the
timing
is
vague,
because
if
you
read
the
in
the
ordinance
currently
it's
it's,
it
could
be
interpreted
a
couple
different
ways,
but
typically
the
way
we
have
been
enforcing
it
is
60
days
and
then
finally,
the
commercial
proposed
for
election
or
campaign
signs
number
would
be
no
limit
maximum
square
feet
of
40
feet
and
eight
eight
square
feet
or
yeah
eight
feet
in
height.

That
should
be
eight
feet
in
height,
the
second
line
and
then
again
sixty
days
prior
to
election
and
10
days.
After
so
again,
most
of
the
changes
we've
talked
about
have
been
in
this
category
of
exempt
signs.
So
these
are
signs
that
the
city
does
not
permit
for
just
because
there
are
so
many
and
we
feel
like
it
it
it
does.

I
think
it
goes
a
long
way
in
preserving
what
the
current
scheme
is
in
terms
of
limiting
the
number
and
size
and
location,
but
instead
of
us
having
to
run
a
foul
of
read
by
having
to
read
the
sign
to
enforce
it.
It's
simply,
they
you're
allowed
a
certain
number
based
on
condition
and
whether
that's
under
construction
for
sale.

saying
is
that

city
cannot
enact
an
ordinance
that
prohibits
a
political
sign
from
being
placed
not
and
doesn't
talk
about
in
terms
of
time,
either

political
sign
from
being
placed
and
it
begs
the
question
obviously
is
well
under
greed
versus
city
of
gilbert
you're,
going
to
have
to
look
at
that
sign
to
make
a
determination

whether

not
it's
a
political
sign.

it
so
this
this
law.

statute,
might
have
problems
in
and
of
itself.

get
that,
but
it
is
the
law
as
it
currently
exists
the
legislature's
in
session
right
now.

don't
know

they're
going
to
address
it

attorney
general's

to
address
it
or
not,
but
I
do
know
this.
This
makes
it
real
easy
for
me.

logic
that
you're
using
recognizing
that
the
election
code
is
presumptively
invalid.
As
the
courts
have
said,
it
stands
at
the
at
the
same
on
the
same
footing
as

city's
ordinance.
The
city's
ordinance

invalid
until

the
council
changes
it.
That
does
not
make
the
state
law
any
better
than
what
city's
council's
ordinance
is,
and
the
city's
ordinance
stands
as
the
law
until
and
unless
the
council
changes
it.

belief
that
when
you
are
a
private
property
owner,
you
should
be
able
to
do
a
lot
of
things
on
your
property
that,
as
long
as
it
doesn't
cause
problems
with
your
neighbors,
and
you
know
a
sign
on

property
if
it's
not
obscene
or
yeah
objectionable
in
some
way,
and
that
again
is
another
discussion,
I
can't
read
it.
It
can't.

councilman
goetz:
did
he
have
something
that
he
would
change
on
this
as
to
amend
it
because,
first
off,
I
don't
know
of
anybody
if
somebody
says
yay,
westbrook
or
yay
beaumont
united,

member
of
the
drill
team
or
I
don't
know
anybody.
That's
ever
called
tina
correct
me.
If
I'm
wrong
and
said
you
know,
they've
had
this
sign
up
here
for
three
months.

solution

particular
issue
would
be
you

not
have
a
limit

it

out

we
could
talk

reason
I've
come
before
you
today
is
I,
when
I
purchased
the
facility,
the
ymca
on
sarah
street,
I
purchased
for
the
purpose
of
the
community
having
a
place
to
go
when
they
had
no
other
place
to
go
to,
but
also
to
turn
into
a
health
care
facility.

decided
to
have
an
event.
While
we
were
working
on
the
facility
on
saturday-
and
I
called
one
of
the
council
members
to
ask
if
I
needed
to
have
any
type
of
permit-
and
she
called
me
back
and
said
no,
I
did
not
need
any
type
of
permit.

So
today
I
was
met
with
pushback
by
planning,
because
planning
is
saying
that
I
cannot
hold
a
event
without
having
a
permit,
and
so
I
don't
know
what
type
of
permit
they
didn't
give
me
the
type
of
permit
that's
needed,
but
the
other
thing
what
they
did
give
me
is
amusement
and
recreation
services,
saying
that
if
my
established
establishment
is
primarily
engaged
in
providing
entertainment,
I
would
have
to
have
some
type
of
special
license.
That's
not
what
I
do
and
I
don't.

understand
why
I
can't
have
an
event
for
the
community
as
often
as
I
want.

want
those
that
that
space
for
little
children
that
want

play
baseball
football
they
should
be
able

at

bureaucratic
burdens,
the
city's
new
mayor
and
council
should
do
as
much
as
they
can
to
make
the
city's
bus
system
as
effective
and
economical
as
possible.
The
buses
do
meet
an
important
need
for
some
low-income
residents
and
helping
them
get
to
jobs
or
doctor's
appointments
should
be
a
concern
of
every
council
member.

Smaller
buses
could
be
cheaper
and
more
effective
overall,
even
if
their
lifespan
isn't
as
long
finally,
city
councils
in
beaumont
and
many
other
towns
should
prod
the
state
and
federal
governments
to
support
voluntary
experiments
with
some
form
of
ride
sharing
such
as
uber
or
lyft
on
paper.
It
makes
a
lot
of
sense
to
match
up
a
rider
and
a
ride
more
specifically,
perhaps
with
vouchers
from
the
city
for
at
least
some
residents,
it
could
be
much
more
efficient
than
a
large
bus
running
a
fixed
route
with
little
ridership.

and
with
that
said

will
be
the
last
full
council
meeting
that
councilwoman

will
be
seated
in
ward,

the
idea
is
that
people

this
you're

doing

for
the

month

the

the
mayor
makes
you

it

care

the
city
and
in
stacy
and
joe's
case
you
care
about
the
students.
I
care
about
the
the
future
of
our
community,
we're
fortunate
to
have
in
beaumont
some
great
people,
people
that
you
don't
hear
a
lot
about.

don't

people
like
kyle
tyrone,
chris
bart
molly,
who
we
congratulated
last
week
mike
I
could
go
on
and
on
about
all
the
different
chief
singletary
honest-to-goodness
is
one
of
the
greatest
police
chiefs
in
the
country
and
does
an
exceptional
job
and
earl
white.
What
can
you
say
our
fire
chief?
We
have
so
many
great
people
that
make
this
city
run
and
our
wonderful
people
upstairs
angie
and
charlene
and
halle.

almost

big
as
the
lottery
tomorrow
night,
but
these
people
are
dedicated
but
they're,
not
usually
the
people
you
hear
about.

you
don't
hear

the

want

everybody

making
the
14
years.

had
here

enjoyable

things
have
changed
when
I

got
elected,

hair

city
keeps
moving
forward.

lot

confidence
in
our
community.

restaurant

not
going

promote

though
this
is
my
next
last
meeting

mother's
day

coming

support
your
local
restaurants,
whichever
one
you
have
to
achieve,
we
got

lot
of
them.
Trust
me.
I
spent
a
whole
lot
more
money
in
other
restaurants
than
in
mine,
but
we
do
have
a
lot
of
great
things
going
on
in
beaumont.

stated,
there
is
a
runoff
roy
and
robin
are
in
the
runoff.
It
counts
for
you
to
take
time
and
vote
and
to
understand
where
everybody
stands
on
the
issue,
because
you
know
we
complain
about
the
turnout
being
low
and
but
that's
that's
us,
I
mean
we
can't
turn
around
blaming
on
somebody
else
for
not
turning
out
voting.

say
that
for
those
of
us
that
do
this
on
occasion,
you'll
hear
mike
talk
about
allison

randy
talk
about,
and
we
all
talk
about.
Our
spouses
and
becky
talks
about
rodney
and
rightfully
so.
It's

tough
job
to
do
without
support,
and
if
you
don't
have
it
it's
really
difficult,
and
for
those
of
us
that
have
been
fortunate
enough
to
have
partners,
they
were
always
there.

wasn't
the
best
thing
and
the
citizens,
as
we
suggested,
did
vote
to
change
that,
and
so
there
were
three

us
that
was
evelyn.
Lord
was
the
mayor
then,
and
I
was
at
large
and
then
andrew
coconuts.
We
had
a
one-year
term.
So
that's
the
reason
for
that.

But
I
just
want
to
thank
you
for
your
service
and
for
everything
that
y'all
done
and
it's
not
always
easy,
as
you
said,
but
we
appreciate
it
and
I
think
the
citizens
should
too
and
it's
it's
all
sometimes
thankless,
and
I
recognize
that
so
we
appreciate
you
very
much
and
I
do
for
sure
enjoyed
working
with
both
of
you
all

I
believe
that

weekend

mother's

mothers

echoed

lot

grandkids
