A
A
Thank
you,
man.
We
do
have
a
quorum.
The
minutes
of
the
last
meeting
was
sent
to
you
folks
and
if
you
do
not
have
any
corrections
or
suggestions,
I
would
entertain
the
motion
to
approve
a
motion
to
approve
the
minutes.
Second,
we
have
a
motion
to
approve
the
March
20th
minutes
and
we
have
a
second
any
discussion,
all
in
favor,
say
aye
aye
and
in
opposition
the
eyes
have
it.
Thank
you
with
that.
We're
going
to
jump
in
there.
In
the
first
case,
pz202350.
C
Phillips
is
requesting
to
abandon
a
portion
of
Carpenter
Road.
Approval
of
this
request
will
allow
Mr
Phillips
to
care
for
the
right-of-way,
as
vegetation
has
taken
over
the
pavement
due
to
constant
flooding,
the
city
does
have
a
water
line,
and
street
lights
and
nearby
sewer
line
planning
staff
recommends
approval
of
the
request
with
the
following
conditions:
number
one
shall
retain
the
existing
right-of-way
as
an
easement
number.
C
Number
three,
no
permanent
structures
or
pertinences
shall
be
placed
within
the
easement
property.
The
city
will
not
be
responsible
for
any
surface
restoration
when
water
and
or
sanitary
sewer
repairs
are
necessary
within
the
City
of
Beaumont
water
line
or
Cemetery
sewer,
one
easement
four.
If
a
fence
is
to
be
installed
a
minimum
six
foot
wide
gate
shall
be
provided
for
City
Crews
to
access
the
easement
I
do
need
to
add
a
fifth
condition
if
approved
applicant.
C
We
do
have
the
applicant
present
today,
I
believe,
if
you
have
any
questions.
A
Any
questions
or
things
Mr
Phillips
good
afternoon,
sir.
How
are
you
good
to
have
you
great
if
I
had
that
my
way,
I'll
give
you
all
the
abandonment
sites
in
the
city,
so
you
can
clean
them
up
yeah.
Do
you
have
any
other
information
you'd
like
to
give
us
I'm?
Sorry,
we
need
your
name
and
address
for
the
record.
D
I've
lived
there
for
24
years,
I'm
gonna
land
on
both
sides
of
the
right
away,
a
question:
I
guess:
oh,
it
goes
right
through
a
big
portion
of
a
pond
and
it's
just
overgrown
with
vegetation
and
they
removed
the
power
lines
all,
except
for
one
pole
to
their
a
little.
While
back
and
request
of
the
abandonment
and
airing
today
correct.
E
A
A
A
Great
okay,
so
now,
ladies
and
gentlemen,
we're
going
to
start
the
the
meeting
with
the
joint
meeting
with
the
city
council
and
The
Honorable
mayor
would
get
us
started.
Thank.
B
H
Thank
you.
This
is
a
joint
meeting
with
quorums
of
both
the
Beaumont
City
Council
and
the
Planning
Commission.
The
only
opportunity
to
speak
on
the
items
is
today.
The
Planning
Commission
will
make
recommendations
to
the
city
council.
The
items
heard
today
will
come
back
before
City
Council
in
one
to
two
weeks.
Therefore,
there
will
not
be
a
public
hearing
on
any
of
the
items
at
the
city
council
meeting
again.
The
public
hearing
today
will
be
your
only
opportunity
to
make
any
comments.
Thank
you
for
coming.
You
may
begin.

C
C
The
planning
division
received
complaints
regarding
parking
issues
due
to
the
swim
lessons
he
has
been
providing
Services
since
July
of
2019
and
has
served
over
500
children
and
150
adults
to
learn
to
swim.
The
program
begins,
mid-may
and
ends
mid-september.
Lessons
for
children
are
Monday
Tuesday
and
Thursday
from
5
30
to
8

PM.
Lessons
for
adults
are
offered
Friday,
Saturday
and
Sunday
at
various
times
during
the
daylight
hours.
Staffing
includes
himself
and
two
to
three
employees.
C
Staff
recommends
approval
with
the
following
condition:
per
engineering.
The
driveway
can
accommodate
six
cars
and
and
nine
cars
can
be
parked
on
the
street.
At
no
point
shall
cars
park,
block
drop,
show
cars
to
block
driveways
or
restrict
Life
Safety
vehicles
to
navigate
the
neighborhood.
The
owner
of
the
business
shall
be
responsible
for
enforcing
such
parking
restrictions.
C
Notices
were
sent
out
to
19
Property
Owners.
We
received
one
in
favor
and
one
informal
opposition,
informal
opposition
States.
They
are
opposed
in
that
the
neighborhood
is
quiet.
The
families
who
have
lived
in
the
subdivision
are
accustomed
to
the
quaint
and
quietness
and
would
like
for
it
to
remain
as
such,
the
previous
Summers
we
have
had
to
deal
with
the
noise
of
Music
dancing
in
the
front
yard
side
of
individuals
uncovered
in
their
swimwear
in
the
front
yard.
C
Several
cars
parked
along
the
street,
making
it
difficult
to
drive
home
or
back
out
of
our
driveways.
They
expressed
concerns
of
liability,
appropriate
areas
to
conduct
swim
lessons
and
safety
of
Neighbors

staff
did
not
receive
signatures
to
indicate
these
comments
represent
the
neighborhood
or
one
individual
in
favor
states.
This
has
been.
This
has
not
been
a
problem
for
me.
I
think
it's
a
great
it's
great
that
he
is
helping
teaching
people
to
swim
on
the
screen.
The.
C
H
H
J
Forget
it
is
there
I,
looked
at
the
numbers
and
it
said
500
over
so
many
years.
What
is
the
main
average
of.
A
Be
able
to
oh
that's
good
question
before
good
afternoon,
sir.
If
you
would
maybe-
or
you
can
just
be
comfortable
over
there
state
your
name
and
address
for
the
record
and
we're
going
to.
H
A
K
K
He
is
also
a
lifeguard
for
the
last
four
years
at
Magnolia
and
Alaska
pools
right
here
in
the
City
of
Beaumont
during
a
conversation
with
a
family
member
this
past
weekend,
who
was
wanting
to
sign
her
two
grandsons
up
for
swimming
lessons
with
me.
She
jokingly
reminded
me
that
I
was
that
I
was
that
child
that
was
running
around
the
pool
screaming
and
crying
I,
don't
remember
the
instructor's
name
or
the
exact
address,
but
it
was
that
at
home
in
someone's
backyard
on
Chinquapin,
which
is
also
in
ward
3.
K
when
it
was
all
said
and
done.
My
mom
said
I
was
one
of
the
better
swimmers
to
come
out
of
that
class.
So
here
it
is
today.
I
stand
before
you
all
asking
for
permission
to.
Allow
me
to
continue
passing
my
knowledge
on
to
others.
Back
in
the
summer
of
2019,
a
family
friend
approached
me
about
teaching
their
child
to
swim,
because
I
had
made
sure
all
of
mine
could,
after
some
thought,
I
pushed
I.
K
K
K
A
Thank
you,
sir,
and
questions
for
the
gentleman
yes
go
ahead.
I.
J
Commend
you
for
what
you're
doing
and
the
work
that
you're
doing
I
think
just
looking
at
it.
I
don't
see
a
big
issue
but
I'm
just
looking
at
I
guess
the
complaint
is
how,
when
you
have
the
pool
full
the
parking,
is
there
anything
that
you
can
do
to
help
eliminate
the
issues
that
your
neighbors
have.
K
Spoken
to
up
yes,
I've
only
spoken
to
one
neighbor,
he
mentioned
a
concern.
I
don't
even
know
if
that's
the
same
neighbor
that
wrote
that
or
would-
and
it
was
I
told
him.
If
that's
you
know,
I
have
I
have
orange
Combs
so
that
way,
I'm
kind
of
putting
everybody
around
my
property,
so
they're
not
just
way
down
the
street.
Most
people
are
not
going
to
Parkway
down
the
street
they're
gonna
try
to
park
as
close
to
where
they
got
to
go
as
possible.
K
So
and
I
was
actually
in
the
process
of
told
my
wife
that
I'm
going
to
type
out
a
letter
to
all
the
people
on
the
Block
so
and
with
my
name
and
number
for
those
that
I
hadn't
met
I
know
most
of
because
I've
been
there
about
nine
years.
That
way.
If
they
had
any
concerns,
they
can
always
call
me
text
me
or
whatever
you
know
so
that
we
can
address
any
concerns.
K
Also
in
saying
that,
on
the
first
day
of
lessons,
I
always
tell
the
parents
watch,
you
speak
coming
in
and
out
the
neighborhood,
no
Loud
Music
Park
on
the.
If
you're
parking
on
the
opposite
side
of
the
street
and
she
park
at
the
floor,
tracker
don't
park
on
the
right
side
of
your
car
is
facing
the
wrong
direction.
So
you
know
there's
several
things
that
I
go
over
to
try
to
eliminate
out
of
there.
I
Yeah
I
too,
would
like
to
commit
you.
But
what
do
you
do
about
the
the
noise
other
than
warning
the
individuals
about
the
noise
and
do
you
also
have
CPR
as
a
part
of
your
training.
K
Okay,
as
far
as
the
noise
I
have
no
idea
what
they're
talking
about,
because
all
the
parents
are
seen
in
the
backyard
watching
the
kids
most
parents
are
not
gonna
be
gone
somewhere
and
the
child
is
in
the
water.
You
know
it's
just
a
it's
just
a
safety
ass,
but
they
want
to
be
present
while
their
child
is
in
the
water
line
in
the
swim.
So
there's
generally,
nobody
sitting
in
the
vehicle
I
have
at
times
just
go
out
to
make
sure
that
nobody's
out
there,
like
I,
said
because
I
have
three
other.
K
My
son
and
two
other
people
in
the
pool
room
as
well.
So
I
maintain
all
that
and
CPR
I
used
to
be
a
firefighter
we're
going
back
to
that.
I
worked
12
years
of
Prisons
I
was
CPR
certified
then
I
went
into
the
industrial
firefighting
before
getting
position,
so
I've
been
certified
all
my
life
and
done
the
updates
and
stuff
like
that.
As
long
as
like
I
said,
I
also
had
two
certified
light
bars
that
work
for
the
city
and
they're
certified.
K
K
A
All
right,
Mr
Ford,
are
you
saying:
live
music
in
your
backyard?
Okay,
do
you
a
lot
of
that
music
I'm,
really
pleased
that
you're
being
very
proactive
and
visiting
with
the
neighbors
and
and
sending
them
the
Flyers
anybody
with
an
inappropriate
clothing
on
the
front
yard.
You
know
so
I
mean
because.
K
It's
the
I'll,
be
adults,
we
have
a
restroom,
they
get
they
change
in
there.
They
do
the
swimming
lessons
they
put
back
on
their
clothes
or
whatever,
and
they
head
to
their
car.
If
they
don't,
if
they're
kind
of
wet
someone
may
wrap
up
in
their
tiles,
but
they're
dosing
on
parking
in
the
driveway,
because
there's
no
more
than
four
adults
at
a
time,
because
adults
have
been
two
to
four
at
a
time
so
they'll
barking
the
drivers.
K
They
want
to
be
anybody
on
the
street
when
they're
on
Friday
and
Saturdays
the
kids,
my
first
class
here,
maybe
six
kids
at
one
time.
So
you
may
have
a
few
cars
on
the
street
and
then
my
older
groups,
it's
6,
30
and
7
30.
It
may
be
nine
kids,
so
at
the
most
there's
nine
cars.
If
somebody
some
of
those
families
are
multiple
kids,
so
we
don't
even
have
that
many
vehicles
out
there.
L
A
That
might
not
do
that.
Okay,
any
other
questions
for.
K
Your
waiting
list,
I
hadn't,
even
publicized
it
for
this
year,
but
everybody
knows
and
I'm
already,
because
everybody
know
the
waiting
on
this
approval,
but
it's
already
full
for
the
month
of
May,
I
kind
of
would
like
to
start
May
1st
and
from
May
1st.
All
the
main
and
most
of
June
is
already
full
and
I
only
do
it
to
right
after
school
starts,
which
really
only
allows
me
six
weeks
of
two
week
sessions
six
sessions,
so
it
books
are
pretty
fast.
The
kids
do,
adults
are
always
apprehensive.
K
K
But
I've
been
telling
my
wife
that
that
we
do
want
a
person,
but
not
at
this
time.
We
don't
thank.
N
A
Now
in
these
hurts
overclose
the
public
hearing,
we've
heard
from
the
staff
and
we've
heard
from
Mr
Ford,
the
applicant
he
has
been
very
proactive
visiting
with
the
neighbors
and
I,
would.
M
C
A
A
C
Thank
you.
In
order
for
the
board
of
adjustment
to
Grant
a
variance
the
applicant
has
the
burden
of
proof
or
the
burden
to
prove
all
of
the
following:
a
that.
The
granting
of
the
variants
will
not
be
contrary
to
the
public
interest
and
B
that
literal
enforcement
of
the
chapter
will
result
in
unnecessary
hardship
because
of
exceptional
narrowness,
shallowness,
shape,
topography
or
other
extraordinary
or
exceptional
physical
situation
or
physical
condition.
C
However,
as
is
the
case
in
most
cities,
states
economic
hardship
is
not
a
basis
to
Grant
of
variants.
However,
Texas
House
Bill
1475
amended
the
local
government
code
to
require
that
Texas
cities
allow
economic
hardship
as
one
of
the
justifications
for
granting
a
variance
in
some
limited
circumstances,
provided.
G
C
For
ovarians
are
to
be
granted
or
adhered
to.
Specifically,
the
board
may
also
consider
the
following
economic
impacts:
number
one.
The
financial
cost
of
compliance
is
greater
than
50
percent
of
the
appraised
value
of
the
structure,
as
shown
on
the
most
recent
appraisal
rule
certified
to
the
assessor
for
the
municipality
under
Section
26.01
tax
code
number.
Two
compliance
would
result
in
a
loss
to
the
lot
on
which
the
structure
is
located
at
least
25
percent
of
the
area
on
which
development
May
physically
occur.
C
In
addition,
the
following
factors
may
also
be
considered
number
three:
compliance
with
would
result
in
the
structure
not
being
in
compliance
with
the
requirement
of
a
municipal,
ordinance
building
code
or
other
requirement
number
four
compliance
would
result
in
the
unreasonable
encroachment
on
an
adjacent
property
or
easement
or
number
five.
The
municipality
considers
the
structure
to
be
not
a
non-conforming
structure.
C
However,
it
is
again
important
to
mention
that,
while
these
additional
justifications
are
now
eligible
for
consideration
for
a
variance
to
be
approved,
all
requirements
outlined
in
the
ordinance
must
be
proven
by
the
applicant
in
order
to
comply
with
State
statutes.
The
planning
staff
is
recommending
amendments
recommending
approvals
up
to
the
amendment
to
section
28.02.0053b.
C
Looking
at
the
screen
right
now
are
our
language
that
is
in
violation
is
at
the
very
bottom
where
I've
struck
Financial
considerations,
and
this
is
where
we
are
actually
going
to
add.
The
items
in
red
one
through
five,
which
is
exactly
from
the
State
statues
just
being
put
placed
into
our
zoning,
coordinates.

it's

to
it.
Additionally,
one
is
afraid
it
may
diminish
their
property
value
as
the
neighborhood
is
turning
more
commercial
than
residential
on
the
PowerPoint.
C
And
this
is
the
subject
property,
so
there
was
a
glare
that
day,
but
you
can
see
the
house
that's
going
to
be
demolished
and
then
that
area
is
going
to
be
turned
into
a
parking
lot.
A
Mr
Wilson
good
afternoon
good
afternoon:
how
are
you,
sir
I'm
doing
well,
if
you
would
state
your
name
and
yeah,
you
need
to
come
in
here,
so
we
can
get
a
good
look
at
you
in
the
camera.
If
you
would
state
your
name
and
address
for
the
record,
please
and
tell
us
what
you're
about
to
do.
O
John
Wilson
and
4190
Gladys,
so
part
of.
O
Half
of
it's
used,
as
you
know,
this
is
an
amendment,
so
we've
already
kind
of
using
half
of
it
as
a
parking
lot,
but
our
neighbors
over
at
Waltham
deshong
are
growing
and
they're.
You
know
we
use
them.
We
have
a
good
relationship,
but
they're
they're
definitely
concerned
now
that
you
know,
since
they're
growing
that
they're
running
out
of
spots.
O
For
lunch
and
so
I'm
trying
to
you
know,
since
we
have
that
property,
you.
O
And,
and
also
to
to
whoever
was
worried
about
the
the
turnarounds,
this
will
actually
give
us
an
in
and
out
which
we
really
don't
have
at
the
moment,
it's
really
in
and
out,
and
it
will
provide
a
better
flow
for
for
what
we're
doing
currently
so.
O
O
Haven't
heard
anything
I
haven't
heard
anything
I,
don't
know
what
I
don't
know
what
where
they
would
turn
around.
You
know
I
mean
unless
they
just
missed
it
or
what
not
I'm,
not
sure
if
they're
here,
we'll
probably
hear
from
them.
J
Any
questions
yes,
question
was
looking
at
the
lot
and
I've
noticed
that
how
the
resonance
is
next
to
when
you've
demolished
the
house
doesn't
look
like
there's
a
lot
of
space
between
where
the
fence
is
going
to
be.
The
parking
lot
begins
in
their
house.
If
they
had
any
questions
about
that,
have
you
had
any
kind
of
discussion,
discussion.
J
The
the
size
of
it
and
I
know
a
lot
of
this
is
for
a
car
side,
but
but
trucks
are
usually
somewhere
about
24
25
feet,
and
then
we
start
adding
that
in
and
turning
around
is
it
adequate
for
them.
O
Yeah,
this
is
all
code
really
I
mean
this
is
all
code
parking
code
and
it
compliance
with
parking
code
with
the
with
the
18
foot,
the
24
18.
You
know
so.
J
That's,
oh!
That's
just
what
the
Engineers
put.
G
A
The
engineering
department,
okay,
I'm,
trying
to
figure
out
why
they're
making
him
move
that
driveway
15
feet,
because
when
he
moves,
South
15
feet,
he's
going
to
be
right
in
line
with
the
fire
trucks
and
I'm,
not
sure.
If
that's
the
real
kosher
thing
to
do
right,
opposite
yeah,.
O
Oh,
that's
trust
me,
I
mean
also
I'm.
Looking
at
there's
energy
line,
I
don't
know,
I
mean,
like
I
said
it's
I
haven't
put
a
lot
of
effort
into
it
until
I've
got
everything,
I
mean
yes,
I
would
like
to
move
it
yeah
there
are
people
that
could
move
and
I
would
be
interested.
J
G
A
O
Don't
think
I
think
I,
don't
think
the
I
don't
think
it
messes
with
the
fire
trucks,
though
quite
yet
I
mean
Jay.
Wilson's
is
in
line
with
them,
and
then
it
goes
across
okay
to
the
other
commercial
building.
Any.
C
To
add
to
that,
he
would
have
to
apply
for
a
parking
lot
permit.
So
engineering
would
review
again.
A
A
O
I,
like
the
all
right:
let's
switch
it
up.
A
Thank
you,
sir.
Is
there
anybody
in
the
audience
that
would
like
to
speak
for
or
against
this
case.

zero

That
is
the
subject:
property.
P
P
M
P
More
than
five
or
seven
years
doing
it,
but
we
recently
bought
this
property
thinking
that
it
was
going
to
be
easy
to
open
it,
but
the
guy
who
sold
the
property
was
working
on
the
round
and
when
we
were
trying
to
reconnect
the
electricity,
it
was
when
everything
happened.
Okay,.
P
A
G
P
A
L
A
Okay
and
you,
you
have
some
spot
in
the
back
too
right
and
there's
a
part
that
is
a
handicap
space
already.
Yes,
okay,
all
right!
When
you
get
ready
to
do
this
and
go
to
the
building
department,
you
might
have
to
rethink
this
parking
because
you're,
essentially
in
the
street
yeah,
there's
only
21
feet.
So
any
anytime,
you,
you
back
out
you're,
going
to
be
in
the
street,
and
you
have
to
be
really
careful
how
you
do
that
other
than
that
I!
Don't
have
any
comments!
Any
questions
from
anybody
in
this.
J
On
the
committee,
a
question
I
saw
that
on
one
of
the
pictures,
your
trailer
on
the
subject,
property
was
parked
next
to
the
building
and
a
Truck.
Would
it
be
easier
to
just
go
inside
the
building
and
design
your
parking
where
it
doesn't
have
any
any
experience
in
the
street
because
I'm,
assuming
that,
if
you're
doing
carpentry
work
a
lot
of
people
end
up
coming
with
trucks?
There's
at
least
24
foot
long,
yeah.
P
P
We
need
to
do
a
lot
of
stuff
and
if
we
were
going
to
also
work
on
the
parking
lotion
or
10
15
000
dollars,
which
we
don't
have
and
that's
why
they
grant
us
the
special
permission
and
us
as
long
as
it's
just
the
carpentry,
and
we
are
aware
that
if
the
business
grows
we
are,
we
will
have
to
do
the
parking
lot.
We
agree
on
that.
One.
P
N
P
P
A
Any
other
questions
for
the
gentleman
no,
thank
you,
sir,
is
anybody
in
the
audience
that
would
like
to
speak
for
or
against
this
case.
A
A
N
C
C
Although
larger
game
rooms
with
multiple
gaming
machines
may
take
on
the
scale
of
a
small
Casino
as
such,
careful
consideration
should
include
compatibility
with
other
land
uses,
noise
traffic
proximity
to
Parks
residential
uses
and
schools.
When
reviewing
these
Gaming
facilities,
this

in
close

to

to

to
the

A
gaming

draw
in
a

that
will
exhibit
nuisance

that
will
likely
lead
to
an

at
the
detriment
of
the
158

we
own

C
C
This
is
a
bird's

so
the

You
can
see.
Apartments

to
the

commercial

Sorry,
yes
to
the

is
commercial
kitchens
and
further
east?
Is
the
Calvary

and
to
the
West?
Are
the
Travel

a
motel
and
I?
Forget
that
I
think
it's
a
Travel

lodge.
A
A
S
would
you
tell
us
what
you're
about
to
do,
sir,.
A
A
And
let's
see
what
you
have
50
machines
30.
A
and
what
what
happens
in
there.
People
come
and
put
it
in
put
money
in
these
machines.
And
then
what
like.
L
G
J
L
A
E
Are
against
it
because,
like
we
said
we're
not
in
favor
of
the
special
use
permit,
as
we
feel
like
it
will
draw
in
the
wrong
clientele,
as
that
area
is
already
a
rough
area.
I
know
they
don't
live
in
Beaumont.
They
live
in
Port
Arthur,
but
if
you
live
in
North
Beaumont
or
if
you
ever
have
lived
in
North
Beaumont,
you
know
that
area.
So
we
are
totally
against
it.
G
A
Q
Q
Sir
and
I
would
love
to
hear
from
you
we're
in
the
close
to
this
game
room
because
I
managed
security
at
one
of
the
hotels.
Yes,
sir,
and
last
summer
alone,
I
got
a
couple
on
three
different
times.
Q
A
A
Sorry,
you
you've
heard
some
negative
comments
about
your
your
project,
so
you
have
a
chance
to
remodel
if
you
liked
it
all
right.
Thank
you
with
that
said,
any
other
discussion
on
our

Operational

Monday
through

the

will
also
be
the
security
guard
and
will
have

they

The
machines
should
be
noted
that
Gaming
facilities
that
have
five
or
fewer
machines
tend
to
be
considered
accessory
in
nature
and
when
part
of
a
primary
use
and
as
such,
tend
to
result
in
fewer
negative
impacts
on
the
surrounding
land
uses.
C
This
property
is
in
close
proximity
with
two
existing

and
a
bus,
residential
single-family,
Zone
properties.
Additionally.
The
shared
parking
lot
has
36
existing
spaces
for
the
shopping
plaza,
and
the
proposed
gaming
facility
would
require
33
of
those
spaces.
Therefore,
92
percent
of
the
parking
lot
may
be
occupied
for
by
customers
for
the
gaming
facility,
which
may
lead
to
conflict
amongst
tenants
per
engineering.

Usually
people
want
to
spend
their
free
time,
maybe
in
the
weekends
or
in
the

when
they
get

they

Yes,
yeah,
looking

so
you're
just
trying
to
add
more
business
to
it.
Yes,.
R
Actually
I'm,
like
I've,
seen
the
growth
around
the

there,
because
there
are
a

of

around
