vacation
of
unimproved
street
right
away
south
of
1100
Main
Street,
which
is
generally
near
the
intersection
of
Main
Street
and
South
Avenue.

right
away
was
dedicated
in
1960,
but
has
remained
unimproved
since
being
dedicated
with
the
South
Gate
subdivision.
The
applicant's
Claude
and
Wanda
Thompson
owned
the
property
at
1100,
Main
Street
and
their
private
driveway
is
located
in
the
right-of-way.
They
are
requesting
to
vacate
the
north
half
of
the
right-of-way
to
allow
the
driveway
to
be
on
their
property
staff
does
not
believe
there
is
any
need
for
this
right-of-way,
especially
since
it
is
no
longer
needed
to
provide
East-West
access
due
to
the
plotting
of
the
Emerson
Park
Subdivision
to
the
southeast
in
2006..

are
currently
utilities
within
the
right-of-way
that
will
need
to
be
reserved
as
part
of
the
vacation.

separate
dedication
to
accomplish
that
will
be
approved,
we'll
need
to
be
approved
concurrently
with
the
approval
of
the
vacation
by
city
council
there's
also
right-of-way
along
Main
Street.
That
would
need
to
be
dedicated
as
well
and
approved
concurrently
with
the
approval
of
the
vacation
by
the
city
council.

South
half
of
this
right-of-way
will
remain
as
right
away
for
the
time
being
until
at
such
point
that
any
of
the
adjacent
Property
Owners
do
to
decide
a
petition
for
that
vacation
process.
Staff
does
recommend,
approve
approval

vacation
subject
to
the
three
conditions
in
the
staff
report.

stuff

own

forward
and

recommendations
are
number
one

statement

this
is
based

a
survey
done

Huffman
land
surveyors
on

18

is
that

easement
be
dedicated
concurrently
with
the
approval
of
the
vacation
by
the
city
council
and
three,
the
right-of-way
along
Main
Street
would
be
dedicated

item
that
we

is
another
public
hearing
and
we
will
call
it
to
order-
and
this
is
for
the
consideration
of
certain
text-
amendments
to
the
United
development
code,
UDC
related
to
the
comprehensive
adult
use,
marijuana
facilities,
director
yep.

Thank
you
chair
before
this
evening
are
the
UDC
tax
amendments
to
accommodate
a
comprehensive
adult
use
marijuana
to
comply
with
amendment
3,
which
was
approved
by
Missouri
voters
on
November
8
2022
amendment
3
did
add
section
2
to
amendment
14
of
the
Missouri
Constitution,
which
has
been
included
at
the
back
of
the
packet
for
reference
with
that
there
are
four
sections
that
are
being
proposed
to
be
amended
in
the
UDC.
The
first
section
is
section
1-5,
which
is
the
general
definition
section.

The
second
section
is
section
40-415,
which
is
the
uses
subject
to
conditions.
This
is
currently
where
the
commercial
medical
marijuana
conditions
are
in
the
code.
We
are
proposing
to
retitle
that
to
medical
marijuana
and
marijuana
facilities
and
then
add
the
additional
facilities
that
these
conditions
would
apply
to.
There
is
some
additional
clarification
that
came
out
with
this
amendment
related
specifically
to
the
separation
distance
requirements.

There
was
a
lot
of
confusion
with
how
that
was
supposed
to
be
measured
with
medical
marijuana
facilities,
so
that
has
been
cleaned
up
and
this
would
apply
to
both
medical
marijuana
and
comprehensive
marijuana
facilities,
so
that
would
be
the
separation
distance
between
churches,
schools
and
daycares
from
any
of
these
facilities,
and
that
language
does
mirror
what
is
in
the
amendment
so
would
follow
state
constitution.

Other
items
that
are
changing
here
are
just
general
cleanup
and
the
addition
of
either
comprehensive
marijuana
or
medical
marijuana,
where
it
wasn't
clear
just
to
make
it
clear
that
all
of
these
conditions
apply
to
any
marijuana
facility
regardless.
If
it's
for
medical
or
adult
use
purposes,
and
then
we
did
strike
one
item
where
it
talks
about
facilities,
any
operations
being
within
an
entirely
enclosed
building,
because
that
was
already
redundant
and
included
to
appear
at
the
top.

The
next
section,
that's
being
amended,
is
40-1h,
which
is
the
land
use
table
that
applies
to
Citywide,
except
for
overlay
districts.
With
this
we
are
adding
comprehensive
marijuana,
dispensary
and
the
micro
business
dispensary
facilities,
both
with
those
conditions
in
the
C2
zoning.
That
would
be
the
same.
Zoning
District,
where
the
medical
marijuana
dispensaries
are
currently
permitted
and
then
for
the
industrial
use
categories
again,
adding
the
comprehensive
marijuana
facilities
and
they
would
be
allowed
in
the
M1
and
M2
industrial
zoning
districts,
which
would
be
the
same
zoning
districts
as
the
comparable
medical
marijuana,
industrial
facilities.

last
section
that
is
proposed
is
18-8,
which
covers
the
permitted
uses
in
the
north
Scott
Corridor
overlay
in
2019.
When
the
medical
marijuana
amendments
were
made,
there
were
no
changes
that
were
made
to
the
overlay.
However,
there
was
a
map
that
was
included
that
showed
the
commercial
and
Industrials
within
the
overlay
as
areas
of
potential
facilities.

public
hearings,

once
again,
we
will
ask
if
there's
anyone

in
opposition
to
these
code
changes.
