C
C
We
don't
have
a
gallery
tonight,
so
I
won't
remind
them
of
the
behavior,
but
councilors
are
well
and
truly
aware
of
that.
In
accordance
with
the
Local
Government
Act
of
2020,
a
councilor
must
declare
any
conflict
of
interest
pursuant
to
section
130
of
the
act
in
any
items
of
this
agenda.
Does
anyone
have
a
conflict
of
interest
in
any
item?
C
Thank
you.
Yes,
counselor
Hearn.
E
D
C
I
understand
why
you're
doing
that,
because
we
have
a
few
apologies
tonight
so
we'll
attend
to
that
at
the
next
council
meeting.
Thank.
F
F
How
are
you
Mr
chair
presenter,
the
finance
and
planning
committee,
the
monthly
building
and
planning
report
for
October
2022?
There
were
nine
planning
applications,
one
planning,
Amendment
decided
under
officer
delegation.
There
were
two
planning
applications
decided
by
Council
and
one
application
withdrawn.
F
There
were
24
building
permits
issued
within
the
municipality
totaling,
approximately
4.11
million
dollars
council's
building
department
issued
14
of
these
permits
and
you'll
note
that
there
were
eight
new
dwellings
within
this
24
permits
issued.
The
recommendation
is
on
page
8
12
for
the
committee's
consideration.
C
A
I
want
to
for
their
saying,
but
also
I,
made
a
comment
last
month
that
we
didn't
have.
G
That
many
times
that
time
and
all
of
a
sudden
you've
got
a
lot
of
the
way
it
goes.
I've
also
have
been
told
that
my
new.
A
D
H
Yeah
sorry
I
just
assumed
that
was
only
yes.
Apologies.
Do
you
want
me
to
go
through
that
again,
I'm
gonna
start
again,
yeah
all
right
so
well,
there
is
one
application
under
this
month's
Community
sponsorship,
but
grant
that
is
the
benella
theater
company
is
seeking
500
for
the
hire
of
the
town
hall
for
their
annual
night
of
entertainment.
It's
an
event
that
they
have
been
doing
for
a
number
of
years.
The
event
was
actually
held
last
weekend
with
over
a
hundred
attending,
so
it
is
quite
a
popular
event.
H
They
do
it
not
only
for
their
own
benefit,
but
also
for
members
of
the
community
to
come
in,
and
they
contribute
towards
fundraising
to
make
improvements
at
the
Town
Hall.
So
I
would
draw
your
attention
to
you.
The
recommendation
on
page
14
that
500
to
be
allocated
to
the
banana
theater
company
and
happy
to
take
any.
C
Questions
you
are
there
any
questions,
if
not
I'd,
just
like
to
mention
a
very
sad
issue
that
Mr
John
Ellis,
who
is
a
stalwart
at
the
benalla
theater
company,
passed
away
during
the
week,
probably
doing
something
that
he
really
not
that
he
wants
to
pass
away,
but
he
was
at
a
theater
at
a
live
theater
in
Melbourne
I.
Think
it's
one
of
the
live
shows
down
there
Hamilton
and
it
must
be
very
exciting
because
he
had
a
heart
attack
and
died.
C
C
D
I
C
Okay
item
number:
three:
the
annual
grants
program
guidelines,
so
that's
been
the
third
hands
so
now
we're
on
to
four
Economic
Development
and
sustainability.
Department
activity
report
for
the
quarter
ended
the
30th
of
September,
welcome,
Courtney,
Norton
I.
Think
it's
your
first
nice
here
so
welcome
in
Council.
E
So
the
highlights
of
this
activity
report
are
council's
annual
report
was
completed.
The
outdoor
activation
fund
is
on
track
and
delivering
10
key
projects
such
as
the
outdoor
seating
and
the
lights
around.
The
lake
planning
is
well
underway
for
the
banana
Festival
in
this
quarter
and
the
Art
Gallery
showcase
the
artistic
talents
of
the
local,
secondary
and
students.
E
The
visitation
guide
was
released
and
well
received,
and
the
first
stage
of
the
roadside,
Pest
and
weed
program
was
completed.
So
there's
a
recommendation
on
page
26.
C
E
E
You
know
hardwood
supplying
or
whether
they're
manufacturing
or
anything
like
that,
they're
funding.
You
know
what
could
be
done
outside
of
that,
so
yeah
probably
take
they
pass
this
one
on
to
dong.
B
Thanks
Mr
chair
as
Courtney's
alluded
to
we're
very
fortunate
to
be
included
as
one
of
the
11
Council
areas
in
in
Victoria
to
receive
about
five
hundred
thousand
dollars
to
develop,
essentially
an
economic
diversification
plan
for
our
community.
It's
a
significant
project
has
commenced
probably
about
two
months
ago,
and
it
will
go
for
about
two
months,
two
years
actually
So
Courtney
in
her
new
role,
oversee
that
particular
program.
B
Work
really
closely
with
several
government
departments,
but
it's
a
great
opportunity
for
our
community
to
think
outside
the
box,
talk
to
the
Future
and
also
assess
what
our
current
strengths
are
and
look
at
what
future
opportunities
like
for
our
community.
But
it's
a
huge
project
and
I
know
it's
one
that
Courtney
and
Matt
Curry
who's.
B
Our
project
officer
has
been
very
passionate
about
driving,
obviously
in
Courtney's
first
five
weeks,
but
Matt's
been
with
us
for
about
six
months
in
another
role,
but
stepping
over
into
the
forest
fund
roles
that
it's
we're
very,
very
fortunate
to
be
included
in
that
particular
project.
D
C
Right
just
one
other
thing:
I
noticed
in
here
Courtney
you've
mentioned
the
piece
of
street
art
by
Julian
clavio
and
you've
named
it
baby
Joy,
but
I'm
pretty
sure
that
Julian
called
it
the
rainbow
baby.
So
maybe
we'll
I'll
just
get
a
clarification
on
that,
so
that
we
had
upset
the
artists
like
calling
it
yeah.
C
C
G
Would
think
you,
through
the
chair
with
regards
to
a
couple
of
those
things
the
Courtney
spoke
to,
and
so
did
the
CEO.
That
is
a
fantastic
project.
That's
an
initiative
on
state
government,
basically
to
replace
jobs
that
will
be
lost
through
the
Banning
of
the
of
the
hardwood
forest,
and
so
that's
a
great
initiative.
G
But
it's
also
it's
it's
great
to
see
the
outdoor
activation
monies
I
think
everybody
in
the
community
would
be
very
aware
of,
what's
going
on
with
within
the
CBD
and
outside
in
the
rural
townships
as
well,
and
some
of
these
things
that
you
know
they're
not
great
big
projects,
but
they
they're
really
having
an
effect
the
tables
and
shares
down
the
main
street
of
benalla,
look
fantastic
and
and
they're
being
used.
That's
the
main
thing
so
little
by
little
bit
it's
it's
changing
the
face.
G
C
A
A
C
J
Mr
chair
the
report
discusses
they
proposed
blenner
landfill
resource
recovery,
center
transfer
station
charges
on
the
5th
of
October.
This
year,
the
Planning
and
Development
Committee,
acting
under
its
delegate
authority
of
council,
resolved
two
that
the
proposed
banana
landfill
and
resource
recovery
center
transfer
station
charges
below
be
endorsed
for
public
exhibition
for
at
least
28
days.
Follow
me
the
submission
closure
on
Thursday,
the
3rd
of
December
2022.
No
submissions
were
received.
J
A
copy
or
detail
of
the
waste
charges
are
on
the
bottom
of
page
27,
including
the
current
charges
and
the
proposed
new
charges
and
on
the
top
of
page
28,
we've
got
the
products
which
will
not
incur
any
charges
following
the
public
exhibition.
No
changes
are
proposed
for
the
for
the
new
transfer
station
charges.
It's
important
to
note
that
the
new
volume
based
charges
will
be
calculated
per
meter
cubed,
regardless
of
the
type
of
General
waste.
The
organic
green
rice
has
its
own
charges.
Revenue
from
the
domestic
customer.
J
D
G
With
regards
to
it's
really
not
supposed
to
be
trying
to
make
more
money
out
of
We're
just
trying
to
change
the
way
that
we
calculate
is
that
the
main
thing.
G
J
C
C
C
J
You
Mr
chair.
The
report
seeks
the
council's
approval
for
the
chief
executive
officer
to
commence
their
statutory
procedures
to
consider
discontinuing
the
government
roads
abutting,
three
Nelson
Road
went
North
and
publicly
advertise
and
invite
public
submissions
on
the
proposal
back
in
2019,
Life,

Australia
proprietary,
limited
being
the
applicant
requested
that
Council
consider
proposal
to
discontinue
and
sell
the
roads
to
the
applicant
to
facilitate
the
construction
of
a
solar
farm
on
the
land
on
the
basis
at
the
roads
are
government.
J
The
applicant
subsequently
had
Direct
discussions
with
the
Department
of
environment,
land,
water
and
planning.
Following
these
discussions,
the
applicant
notified
Council
in
June
2022
that
it
had
reached
an
in-principle
agreement
with
Delp
for
the
release
of
the
roads
to
the
applicant
subject
to
council
first
making
a
decision
to
discontinue
the
roads.
Accordingly,
the
applicant
has
revised
its
original
proposal
to
request
their
Council
discontinue
the
roads
in
order
to
facilitate
the
lease
of
the
discontinued
Rose
to
its
form.
J
The
roads
are
crownland
known
to
the
total,
as
Government
roads
and
as
part
of
the
roads
contained
in
Crown
folio
stated
on
page
36,
which
is
administered
by
Council
as
Crown
Land
administrator
and
reserved
as
a
government
Road
vacant
and
covered
in
grass
and
partially
encroached
over
by
trees
and
other
vegetations,
and
not
constructed
as
a
physical
Road.
As
the
roads
are
known
to
the
total
as
roads.
They
are
therefore
roads
for
the
purposes
of
Local
Government
Act
1989
Council
has
the
power
to
consider
discontinuing
the
roads.
J
J
Excuse
me
adjoining
properties:
the
roads
are
about
the
following
properties:
a
crown
allotment
2020,
Parish
of
Whitton
being
the
whole
of
the
land
contained
in
the
crown
folio
statement
stated
on
page
36,
which
is
administered
by
the
secretary
to
Delp
and
lots
one
and
three
on
title
plan,
tp903174t
being
part
of
the
land
containing
certificate
of
total
volume,
as
stated
on
page
36,
which
is
owned
by
Mr
Leo
Edward
Hernan
who's,
the
adjoining
owner
accordingly,
Council
required
the
applicant
to
obtain
the
written
consent
of
the
adjoining
owner
to
The
Proposal
on
the
18th
of
August
2022.
J
J
J
In
conclusion,
Council
May
resolve
to
either
commence
or
not
commence
the
statutory
procedures
to
consider
carrying
out
the
proposal.
It
is
recommended
that
the
council
proceed
with
the
proposal
by
giving
public
notice
of
the
intention
to
discontinue
the
road
to
facilitate
police
of
the
roads
from
Crown
to
the
applicant.
Any
submissions
received
in
response
to
the
proposal
will
be
heard
at
a
finance
and
planning
committee
meeting
to
be
held
on
Wednesday,
the
1st
of
February
2023..
The
recommendation
is
on
page
38.
C
Thank
you
there
any
questions
of
Adrian
Council
again
right
now,.
J
If
I
made
through
the
chair,
so
first
of
all,
cancel
is
currently
managing
that
road
Reserve,
it's
not
Council
land,
it
is
vested
in
Crown.
So
we
need
to
determine
to
discontinue
the
road
as
required
for
General
Public
Access,
which,
in
the
reverts
back
to
Crown
it'll,
be
up
to
the
applicant
to
enter
into
an
agreement
with
crown
for
the
sale
of
that
road,
foreign.
J
If
I
may,
through
the
chair
by
going
through
the
public
exhibition
process,
that's
a
statutory
requirement,
so
we
need
to
do
that.
On
top
of
that,
we
we
can
here
we
can
give
targeted
notice
as
as
you've
highlighted.
However,
I
am
led
to
believe
that
the
applicant
has
already
undertaken
that
process
already
in
particularly
that
land
that
we
mentioned
those
two
lots
of
one
and
three
on
that
TP.
So,
yes,
we
can,
if
that's
a
cancer
decision.
J
If
I
can
through
the
chair,
yes,
they
are
used
as
roads
and
generally
used
by
the
adjoining
landowners,
but
they
are
currently
open
or
available
for
General
Public
Access.
J
G
Yes,
well
for
the
councils,
my
time
with
on
the
committee
of
with
a
Wetlands,
for
example,
I
was
aware
of
the
of
the
use
of
that
upcoming
times,
and
quite
often
it
was
for
a
negative
reason.
People
were
using
it
at
the
wrong
times
and
for
the
wrong
reasons,
so
it
may
not
really
impact
on
the
general
public
that
much.
However,
a
targeted
question
may
not
be
a
bad
thing.
C
Adrian
and
it
it's
basically
an
unused
Road.
Is
there
any
negative
issues
that
may
prop
up
because
of
discontentment
as
a
road.
J
This
will
be
up
to
adult
or
the
Secretary
of
dealt
to
to
decide
on
whether
or
not
the
the
land
is
sold
once
the
land
is
sold,
it's
going
to
be
very
unlikely.
Anything
can
be
reverted
back,
however,
if
Delp
decide
not
to
and
just
offer
a
lease.
Well,
yes,
that
can
be
reverted
back
to
a
road
reserve
and
open
up
for
General
Public
Access.
C
I
C
I
You
very
much
Mr
chair
tonight's
report,
requests
that
Council
laws
make
a
decision
on
a
couple
of
members
who
are
retiring
from
the
your
due
for
their
terms
to
cease
at
the
end
of
the
this
year,
31
December
Mr,
John
Stapleton,
and
this
Rita
Runners,
who
are
both
finished
at
31
December
having
discussions
with
Mr,
Stapleton
and
reader
trying
to
ascertain
what
their
plans
are
for
next
year,
whether
or
not
they're
interested
in
rejoining
the
committee,
Mr
Stapleton
has
indicated
that
no,
he
does
not
want
to
apply
for
reappointment
he's
served
his
time.
I
He
said
he's
quite
happy
to
farewell.
The
committee
reader,
on
the
other
hand,
has
expressed
an
interest
in
being
re-apported
again.
If
counselors
were
of
that
mind,
so
we
have
if
it
went
through
tonight,
we
could
reappoint
radar
to
the
committee
as
detailed
in
the
recommendation.
Cameron
Gray's
first
term
as
chair
also
expires
31
December
and
as
a
recommendation
of
Cameron.
The
reappointed
chair
for
another
12
months
so
with
John
Stabler
are
not
seeking
reappointment.
I
The
maximum
independent
members
on
the
committee
is
full,
so
it
is
proposed
that
we
actually
early
in
the
New
Year,
go
out
to
expression
of
interest
to
see
if
there's
people
out
there
who
will
be
interested
in
joining
the
committee
for
a
three-year
term.
So
it's
the
real
end
of
the
day.
The
decision
is
which
I
think
is
a
good
result
in
that
we
get
to
retain
some
knowledge
in
regard
to
reader,
but
we
also
have
a
chance
for
some
new
blood
on
the
community
too.
I
So
it's
a
combination
of
two
so
the
recommendations
that
really
gets
reappointed
for
three
years
term,
until
31
December
25,
the
Cameron
gray,
get
appointed
chair
until
31
December
2023,
the
expression
of
Interest
he
called
for
for
the
independent
member
vacant
position
and
that
the
mayor
writes
to
John
stapler
and
thanking
him
for
his
service.
C
D
K
I
would
like
to
support
to
reappoint
Rita,
as
Mr
Baba
said,
to
retain
the
knowledge
that
we
had
in
the
committee
and
I
would
like
to
thank
Mr
John
Stapleton
for
his
service
for
the
committee
over
the
child
and
would
like
to
see
new
blood
coming
into
the
committee
as
well.
Thank
you.
G
Just
to
reiterate
what
everybody
else
has
said,
but
personally
I'd
like
to
thank
John
Stapleton
for
his
time
on
the
committee,
but
because
I'm
also
aware
that
he
he
volunteers
much
of
his
time
on
other
volunteering
capacities
on
different
committees
and
