offender
has
been
arrested

charged
with
this
offence
and
has
been
to
court
for

initial

matter

still
ongoing.

a
number
of
people
inside
the
premises
who
may
be
called
potential
as
witnesses,

it
also
clearly
identifies
the
injured
party,
the
offender
and
all
the
persons
present
in
that
book.

the
application
has
been
submitted
and
the
application
is
based
on
a
one,
significant,
serious
assault
that
took
place
inside
the
premises
which
has
been
crimed
as
a
section
18
assault
that
certificate
has
been
completed.

This
review
hearing
isn't
brought
about
because
of
covered
breaches,
and
it's
not
a
specific
covid
bridge
that
has
brought
us
here.
However,
we
can't
discuss
what's
going
on
without
putting
some
context
in
around
the
regulations
required
due
to
the
covered
pandemic,
so
just
as
scene
setting
I'm
going
to
go
through
the
initial
part
of
the
submission.
That's
been
provided
and
look
at
what
measures
should
be
in
place
for
any
premises,
that's
using
any
licensed
premises
having
indoor
outpost
sales.

So,
as
per
the
submission
that's
been
placed
in
there's,
a
a
lot
of
guidance
has
been
put
out
for
licensed
premises
and
there's.
Numerous
links
that
have
been
put
out
with
organic
documents
are
updated
on
a
regular
basis,
because
the
amount
of
changes
to
lockdowns
local
tiers,
different
measures
that
have
been
in
place
and
guidance
from
the
government.
So
we
accept
that
this
has
been
very
difficult
for
licensed
premises
and
it's
been
a
time
of
financial
hardship
for
them.

The
guidance
has
been
designed
to
show
premises
how
to
open
and
how
to
minimize
potential
risk
of
spreading
the
disease
it
covered
matters
such
as
risk
assessments,
cue
control,
social
distance
and
etc,
and
gave
specific
numbers
around
people
who
can
be
inside
the
premises,
tables,
etc.

The
police
approach
has
been
around
the
four
e's
principle,
which
has
been
engaged,
explain,
encourage
and,
as
a
last
resort.
Finally,
is
enforcement
and
it's
imperative
that
hospitality
trade
comply
with
the
rules
are
set
down
to
curb
the
growth
of
disease
in
terms
of
local
measures
and
since
the
17th
of
may
2021
step,
3
measures
have
been
in
place.
This
means
that
indoor
hospitality
could
operate
subject
to
having
a
covey,
secure
risk
assessment
and
numerous
control
measures
in
place.

Specifically,
around
social
distancing
table
service
is
required
and
those
tables
are
limited
to
six
people
or
two
households
and
customers
should
order,
be
served
and
then
eat
and
drink
and
consume
their
alcohol,
whilst
seated
that
sets
the
scene
for
what
measures
should
have
been
in
place
at
that
time.
So
then,
if
we
look
specifically
at
this
premises,
casey
jones
katy
jones
have
been
engaged
by
licensing
officers
back
in
november
of
2020,
where
there
was
a
intelligence
around
a
breach
of
covert
regulations
on
the
1st
of
november.

This
led
to
licensing
officer
chris
jones
speaking
with
the
license
holder
and
dps,
which
is
caroline
dowling.
This
was
followed
up
with
an
email
on
13th
of
november,
advising
caroline
of
enforcement
options
moving
forward
and
also
advice
on
measures
that
should
be
in
place
on
sunday,
the
27th
of
june,
just
sunday
just
gone
officers,
were
called
to
attend
the
premises
following
a
report
of
an
injured
male
being
treated
by
an
ambulance
crew.
This
male
had
been
punched
to
the
head
was
unconscious
and
bleeding
from
his
ears.
That
was
the
initial
report
that
we
got.

think
at
this
time
councillors-
it's
probably
the
best
time
for
me
to
show
the
cctv,
so
you
can
understand
what
I'm
now
going
to
discuss
so,
as
already
agreed,
I
was
asked
for
this
to
be
in
private
session
now.

cctv
has
been
has
been
shown
in
private
session
and
just

in
terms
of
commentary
around
that
it
shows
the
offender
calmly
walk
over
to
the
dance
floor.
He
places
his
drinks
down
on
the
table
and
then,
as
you've,
seen
viciously
assaults.

The
injured
male
from
behind
the
injured
male
had
no
idea
that
the
puncher
is
coming
and
he
drops
to
the
floor
unconscious
as
a
result
of
the
punch
he
had
a
broken
jaw,
fractured
skull
and
a
bleed
on
the
brain.

This
has
been
crimed
as
a
section
18
assault
and
the
offender
has
been
charged
with
this
offence.
Current
indications
are
that
the
ip's
condition
is
now
not
life-threatening.
It
was
at
one
point
believed
to
be
life-threatening.
We
have
been
informed
that
the
injured
person
will
have
permanent,
scarring
and
deformity
in
relation
to
their
jaw.

is
various
other
parts
of
cctv
that
we're
looking
to
go
through
just
to
look
at.
What's
happened
in
the
lead
up
to
this
assault
and
and
find
out
exactly
what
was
happening
inside
the
premises,
because
this.

Expedited
review
and
with
the
limits
on
disclosing
a
large
amount
of
data
via
the
team's
meeting,
we've
only
shown
you
a
very
small
clip
today
which
which
covers
the
actual
assault.
Further
evidence
and
cctv
will
be
provided
at
the
full
hearing.
There
appears
to
be
some
sort
of
interaction
between
the
offender
and
the
injured
party
and
the
offender's
friend.

Though
they
appear
to
be
unknown
to
each
other,
but
because
of
the
lack
of
control
measures
in
place
of
the
premises,
groups
appear
to
be
intermingled,
which
has
led
to
this
male
engaging
with
and
some
sort
of
interaction
with
the
offender's
friend.

There
shouldn't
be
interaction
between
groups
of
people
just
mingling
and
wandering
around,
and
the
customers
appear
to
be
behaving
as
if
social,
distance
and
measures
aren't
in
operation
in
this
premises,
and
they
don't
appear
to
be
challenged
by
staff
that
are
working
at
that
location
and
there's
a
number
of
people
that
have
just
gathered
at
the
bar
area.
Customers
are
dancing,
people
are
moving
around
without
masks
on
they're,
standing
up
drinking
and
wandering
around
with
their
drinks.

All
of
these
things
would
have
been
apparent
to
the
staff
that
were
working
behind
the
bar
and
we
believe
that
staff
haven't
taken
any
of
these
measures
seriously
and
if
they
had
have
had
better
control
of
the
premises.
If
people
had
been
sitting
down,
if
we
hadn't
have
had
those
groups
mingling
together,
walking
around
with
pine
glasses,
etc,
then
this
assault
may
not
have
happened.

Have
had
that
initial
interaction
between
the
offender
and
the
injured
person,
which
has
then
escalated
to
this
assault,
an
orderly
premises
should
not
have
allowed
that
to
happen.
Therefore,
we
believe
that
they've
failed
to
promote
the
licensing
objectives
by
failing
to
provide
a
a
safe
environment
where,
whereby
the
crime
and
disorder
objective
and
public
safety
objectives
have
been
promoted.

also
need
to
look
further
into
the
levels
of
intoxication
within
the
premises
and
that
will
probably
be
borne
out
by
the
other
cctv
that
we
have
that
we
that
we
need
to
go
through
in
more
detail.
However,
the
people
seem
to
be
that
certainly
the
the
man
who's
assaulted
appears
to
be
unsteady
on
his
feet,
as
he's
walking
around
the
premises
at
some
point
earlier
on,
and
it's
off
concern
to
us
how
much
alcohol
that
man
may
have
consumed
and
whether
that's
influenced
his
behavior
westminster.

we
have
bought

cases

nuisance,

spread
of
the
disease.
The
the
certificate
is
signed
up
on
the
basis
of
a
section,
18
assault
being
crimed
and
a
male
being
charged
with
that.

customers
safe
are
not
in
place
and
if

assault,

has

left

young
man
with
potentially
life-changing
injuries
in
terms

his
jaw.

the
license
holder,
who
is
also
the
dps
at
that
premises.
