I'd
like
to
remind
folks
that
that
this
particular
hearing
is
being
recorded

it's
recorded

also
is

City
Council
TV
is
now

24

a
day
and
seven
days
a

but
those
who
may
want
to
catch
up

further

the

this

we'd

presenters

are

context
is
probably
a
good
idea.

the
Boston
City
Council,
based
on
state
regulations,
needs
to
approve
non
opposition
to
a
dispensary,
a
medical
marijuana
dispensary
in
the
city
of
los,
and
that's
it
that's
the
crux
of
it.
So
what
we
do
is
we
listen
to
how
folks
will
operate
and
where
it's
located
impacts
on
the
community
security
and
the
like,
and
then
after
we
hear
this,
we
give
opportunity
for
the
public
and
others
to
testify.

would,
if
we
bring
the
matter
forward
out
of
committee,
it
would
then
be
a
vote
to
not
oppose
or
oppose
this
particular
exciting
and
location
of
a
medical
marijuana
dispensary.
So
I
we're
going

compassionate
organics

purpose
here
is
the
chairman
mentioned,
is
to
present
materials
and
answer
questions
of
the
committee
regarding
a
proposed
medical
marijuana
dispensary
to
be
located
at
331.
Newbury
Street
in
the
Back
Bay
I'm

former
member
of
the
Boston
Police
Department
and
he
also
works
with
Dan
Lenski,
the
former
superintendent
in
chief
of
the
Boston
Police
Department

Kroll
security,
which
is
a
recognized
international
security.

working

compassionate
organics

handle
all
security
measures.

even
looked
at
possibly
having
them
fly
in

and
just
couldn't

be

and
instead-

we
really
appreciate
Frank's
presence
today,
I
just
wanted
to
quickly.
If
I
may
go
over
our
proposal,
we
kind
of
at
the
top
level
and
then
open
up
to
questions
after
we
go
over
a
little
bit
of
that.

We
have
a
leave
behind
a
deck
that,
hopefully
all
the
members
have,
that
will
be
loosely
based
or
more
detailed,
and
my
comments
will
be
loosely
based
on
what
you
have
in
front
of
you.
Compassion,
organics
has
been
searching
for
the
perfect
location
that
meets
the
strict
state
and
local
standards
to
operate
a
registered
medical
marijuana
dispensary
in
Boston,
since
just
after
the
2012
ballot
initiative,
this
organization
was
formed
by
a
local
entrepreneur,
Jeff
and
his
board,
who
are
all
or
almost
all
members
of
our
community
of
many
who
live
in
Boston.

So
Jeff
also
grew
up
on
Marlborough
Street
in
the
Back
Bay
as
lived
there.
His
whole
life
and
it
in
many
ways
brought
him
to
this
location
at
3,
3
or
1
Newberry
the
locations
on
the
last
block
of
Newbury
Street.
It
sits
in
a
community
that
overwhelmingly
approved
the
ballot
initiative
back
in
2012
by
77%
of
its
residents.
The
location
meets
all
buffer
requirements.
It
fits
within
the
existing
zoning,
complies
with
the
amendment
passed
by
this
council
and
advanced
into
the
zoning
code.

Sensory
will
serve
those
qualifying
patients
who
require
its
treatment,
patients
with
cancer,
coma,
hiv/aids,
Crohn's
disease
and
other
ailments.
Our
proposal
is
to
be
open.
7
days
a
week
from
10
a.m.
to
8
p.m.
our
plan
is
to
have
daily
deliveries
of
dispensary
so
that
no
more
than
one
day
supply
is
on-site
at
any
one
time.
Our
cultivation
site
is
in
Fitchburg
Massachusetts
and
the
security
plan
advanced
by
Dan
linski
and
his
team
will
call
for
randomized
deliveries
made
safely
and
security
and
securely
by
members
of
our
security
team.

Unlike
some
dispensary
all
of
the
product
for
this
dispensary
is
prepackaged
in
childproof
containers,
and
so
that
in
no
case
is
there
even
any
loose
leaf
products.
Everything
is
is
packaged.
Boston
has
solid
experience,
as
you
know,
mr.
chairman,
in
permitting
dispensaries,
there
are
ten
existing
dispensaries
in
operation
in
Massachusetts.
Currently
today,
as
I
understand,
with
many
more
scheduled
to
open
and
here
in
Boston
by
my
count,
I
believe
just
one
is
open
and
at
least
three
more
in
the
process
of
opening.

We
know
a
lot
more
today
than
when
we
first
the
dispensaries
were
first
opened.
We
know
that
the
average
patient
is
just
over
40
years
old,
that
the
costs
per
transaction
well
exceed
that
of
the
black
market
and
that
anecdotally,
the
security
that
dispensaries
bring
to
their
immediate
host
communities
do
so
by
making
that
community
safer.
We've
also
already
begun
the
community
process.
With
regard
to
this
location,
we
are
meeting
with
our
abutters.

We
have
been
in
discussions
with
the
Neighborhood
Association
of
the
Back
Bay
and
have
a
hearing
scheduled
with
their
licensing
subcommittee
in
early
July.
Their
chair,
incidentally,
is
here
Eliot
laugher,
with
his
colleague
Martin
Reiter,
both
of
the
neighbors
association
in
the
Back
Bay
he's
they're.
Here
today
we
have
been
in
other
discussions
with
the
other
organizations
of
the
community,
the
Back
Bay
Association
and
the
Newberry
Street
League
and
others.

We've
been
buoyed
by
some
of
the
public
comments
that
had
been
spontaneously
made
by
some
of
our
immediate
neighbors
in
a
Boston
Herald
article
that
was
recently
written.
The
manager
of
the
Trident
bookstore
in
cafe
said
that
quote:
we
attract
an
eclectic
clientele,
some
of
them
probably
would
enjoy
a
dispensary
and
the
general
manager
of
Santee
restaurant
said
quote.
It
would
bring
a
lot
of
business.

The
area
this
block
has
a
lot
of
young
people
that
are
looking
for
that
at
this
point,
I'd
like
to
introduce
our
CEO
Jeff
Rylander
Jeff's
own
story
and
reasons
for
becoming
involved
in
this
industry
are
quite
compelling.
As
a
person
who
has
suffered
from
the
condition
of
multiple
sclerosis,
he
has
been
helped
and
aided
by
medical
marijuana
since
beginning
his
treatment.
He
has
yet
to
have
a
relapse
or
a
flair
for
almost
18
years.

Indeed,
the
National
Multiple
Sclerosis
Society
now
supports
the
rights
of
patients
to
gain
access
to
medical
marijuana
treatment,
as
I
mentioned.
Jeff
is
also
a
lifelong
resident
of
the
Back
Bay,
and
that
makes
this
a
truly
locally
run
business
which,
for
this
particular
industry,
is
quite
a
statement.

Larry,

so
the
reason
we
appreciate
this
location
is
it's
close
to
public
transportation.
It's
fully
ADA
accessible
and
it's
privately
owned
and
large
enough
to
accommodate
our
use,
which
is
pretty
specific.
In
addition,
as
Mike
mentioned,
77
percent
of
residents
in
this
area
voted
for
this
use
in
2012
on
a
ballot
question.

also
engaged
a
law
practice
of
principal
Bell
and
attorney
Mike
Ross.
Next
to

addition,
we've
re-established
the
commitment
with
our
board
of
directors
who
continue
to
offer
guidance
and
assistance
to
the
organization

again,
as
we
mentioned,
Joel
Pierce
is
sitting
in
the
back

proud

the
team

we've
assembled
of
local
talent,
local
board
local
capital.

councillor
co-moh

not
meeting
the
standards.
He
and
all
of
you

applicants
like
me

diligence
and
concern
for
his
community

application

better
for
the
experience
and
the
opportunity
that
bring
me
here
to
present

background

that
I
was
a
probation
officer
in
South
Boston
Court,
we've
gone
from
that
to
security
with
water
and
sewer,
and
then
chief
of
the
municipal
police
and
landed
in
City
Hall
as
chief
of
security
here
and
retired
two
years
ago.
Since
then,
I've
been
on
contract
with
coral
organization
of
actually
with
Danny
Lansky.

Now
I'll
read
my
script
here
you
people,
the
crawl
security
plan
is
a
combination
of
next-generation
technologies,
talented
security
professionals
and
a
company-wide
commitment
to
safety
leading
ad
team
security.
Efforts
for
the
project
is
director
of
security,
Daniel,
P,
Lansky,
compassionate
organics
has
engaged
crawl
and
our
services
develop
and
address
the
safe
safety
and
security
protocols.
We
believe
necessary
to
exceed
the
strict
standard
set
by
the
Commonwealth
of
Massachusetts
and
the
City
of
Boston.
Kroll
has
also
been
involved
intimately
with
the
compliance
procedures,
but
proposed
registered
medical
marijuana.

The
building
is
well
suited
for
the
state
of
odd
camera
and
lighting
system
that
will
be
fully
integrated
with
the
city's
existing
camera
operations
to
allow
BPD
or
Boston
Police
Department
to
access
more
areas
of
the
city,
crawl,
employee,
a
to
alarm
security
system
to
allow
for
backup
and
redundancy
in
the
facility.
We
intend
to
utilize
innovative
analytical
video
processing
technology
that
features

CCTV
system
tied
to
a
central
morning
up
that
is
staffed
24
hours,
seven
days
a
week.

The
Massachusetts
law
department
of
public
health
regulations
regarding
marijuana
for
the
medical
use
program
guidelines,
as
our
affiliates
have
done
in
other
jurisdictions.
Compassion
organic
intends
to
hire
a
professional
security
personnel,
but
preference
performer
law
enforcement
and
military
service.

the
approval

this
moves
forward,
both
at
this
stage

potential
vote

the

and

residents

area

may
have
concerns

little

timeline
is

the
approval
process?

you
go
to

guess
third
to
last
page
in
the
packet
there's
a
fairly
handy
timeline,
which
shows
that
we're
actually
pretty
very
near
to
the
beginning,
listed
under
June
2017.
The
second
bullet
point
and
you'll
see
that
there's
six
bullet
points
to
the
right
with
additional
bullets
under
each.
That
represents
substantial
number
of
steps
that
we
need
to
comply
with.
I
guess
the
broad
brush
strokes
for
us
are
immediately.

Our
next
step
is
going
to
be
a
meeting
with
the
Neighborhood
Association
in
the
Back
Bay
before
their
licensing
committee,
we're
meeting
in
the
second
week
of
July
it's
possible.
We
might
do
another
meeting
with
them.
You
know
that
will
be
up
to
the
discretion
of
that
committee.
We've
already
done
some
initial
outreach
with
the
community,
but
the
next
I'd
say
good
month,
plus
a
couple
months
we're
doing
the
community
outreach
and
process
that
is
all
leading
up
to
what
is
essentially
a
zoning
case.

As
you,
as
you
likely
know,
medical
marijuana
is
a
conditional
use
in
this
location,
and
so
we
would
have
to
go
before
the
Zoning
Board
of
Appeal
for
a
conditional
use.
Permit
and
we've
made
no
such
application
at
this
time
for
an
appeal,
but
that's
sketched
out
sometime
in
between
September
November.
We
anticipate
that
we
will
be
before
them
then,
provided
that
everything
goes
well
once
we
get
if
we
are
approved
at
that
point,
we
then
have
to
go
back
to
the
Department
of
Public
Health,
to
submit
and
to
to
get
our
approval.

I
actually
skipped
a
step
upon
just
prior
to
the
zoning
process.
The
Department
of
Public
Health
would
provisionally
approve
us
for
this
site
and
its
provisional
on
our
ability
to
actually
go
forward
with
the
local
zoning
process.
So
if
we
are
successful
that
we
go
back
to
DPH
for
a
little
bit
more
process
through
that,
and
then
we
also
have
to
go
to
the
Boston
Public
Health
Commission,
and
we
also
have
to
go
to
the
public
to
the
Back
Bay
architectural
Commission.

Any
changes
any
signage,
any
anything
on
the
outside
will
require
the
back
by
architectural
commission.
So
those
are
all
fairly
substantial
steps.
Once
all
of
those
things
have
happened,
we
can
then
begin
building
the
the
property
out
and
then
we
would
eventually
go
for
our
final
certificate
of
registration
from
the
depart,
a
public
health
and
we
and
we
we
believe
that
that
would
take
us
all
the
way
out
to
basically
a
year
from
today
and
then
we
don't
think
we'll
even
be
ready
to
sell
until
August
of
2018
while
that's
happening.

Jeff
and
his
colleagues
are
also
going
to
be
building
out
the
cultivation
site
in
Fitchburg
Massachusetts.
So
that's
where
they're
growing
the
marijuana
and
nowhere
else,
but
Fitchburg
will
they
be
doing
so
so
that
entire
site
has
to
get
up
and
running.
It
has
to
that
there's
a
substantial
timeline
for
that
as
well,
and
so,
if
everything
goes
perfect,
we'll
be
we'll
be
good
by
August
2018.
But
there's
a
lot
that
so.

quite
a
few
regulatory
steps.
Us
are
beyond
this.
So
as
far
as
the
use
here,
I
guess,
there's
two
two
aspects
of
my
question.
My
next
question
is,
you
know
the
state
is
continuously
revising
I
believe
they're
in
session
today,
I
think
to
talk
about
their
changes
to
both
medical
and
recreational
marijuana.
Potentially,
do
you
anticipate
much
of
this
process
changing?
Have
you
been
monitoring
that,
with
the
understanding
that
maybe
no
one
knows
what
they're
actually
doing
right
now,
but
do
you
anticipate
any
significant
changes
in
this
approval
process,
not.

is,
that
is
obviously
something
that's
I
think
important
for
people,
considering
whether
this
is
an
appropriate
location.
Obviously
I
think
the
impacts
and
the
siting
of
a
medical
dispensary
are
far
different
than
a
recreational
dispensary
or
store
some
know
what
your
intentions
are,
what
the
potential
would
be
I
know
when
we
were
talking
about
other
locations
that
have
been
approved
in
the
city.
There
have
been
commitments
from
the
proponent
that
it
was
a
medical
dispensary
location
only
regardless
of
changes
in
state
law.

councillor,
if
I,
could
in
response
to
the
question
one
of
the
things,
because
that
question
is
asked
a
lot
and,
as
you
said,
it's
evolving
continuously.
We
don't
know
where
this
is
going
and
that's
okay
for
a
new
program.
I
mean
it
should
be
evolving
as
we're
going
down
the
road,
but
one
of
the
things
that
I
say
to
people
is
I'm.
Doing
this
from
medical
I
will
forever
sell
medical
marijuana
at
3:31.
Newbury
Street
I
will
forever
be
bound
by
the
incredible
type
requirements
and
restrictions
of
medical
marijuana
at
3:31,
Newbury
Street.

Now,
as
Mike
said,
there
may
be
reasons
that
the
community
wants
me.
The
state
wants
me:
I
might
also
choose
to
do.
Recreational
possibly,
but
I
will
still
be
bound
by
those
parameters
and
usually
when
people
say
oh,
no,
recreational,
they
don't
want
lines
and
drum
circles
outside
I
can't
have
that
as
medical
I
can't
have
all
these
things
that
people
fear.
So
that's
one
of
things
that
we
can
absolutely
commit
to
right
now,
not
knowing
how
things
are
taking
shape
in
the
future,
so
that
should
hopefully
give
people
peace
of
mind.

far
as
you
know,
you
have
a
good
great
graphic

of
the
surrounding
area,
and
you
know
where
they

It
is
the
where
youth
regularly
gather.
You

neighbors
have
asked
about
a
program
at
the
Boston
Architectural
College,
which
is
within
the
radius
of
your
location.
Have
you
examine
that?
Do
you
know
what
the
state's
feeling
is
on
whatever
type
of
I
think
the
summer
enrichment
program
that
they
run?

that?

the
extent
of
the
program,
the
regular
leanness
of
the
program,
a
consistency
of
the
program,
the
advertising,
the
program,
all
those
things
contribute,
and
now
that
we've
this
has
been
out
for
a
few
years,
there's

little
bit
of
case
law
on
this
a
little
bit.
So
we
have
a
better
understanding
of
what
that
means.
It
was
relatively
vague
language.
We
made
the
decision
to
move
from
Mass
Ave
to
this
other
site.
Knowing
what's
around
us,
including
the
program
you
reference.

the
state
and
the
city
through
the
Boston
Public
Health
Commission,
the
DPH,
determined
that
so
in
the
event
that
we
were
proved
wrong,
we
would
we
would
just
propose,
and
the
regulations
allow
for
amending
our
license
so

not
to
open
during
the
period
that
those
the
brief
period
that
that
particular
program
is
imply
right.

neighborhood
groups,

oppose
it
and
that's
what
happened
in
East
Boston
and
they
opposed
the
one
and
a
gallon
highway
and
pass
a
mas
arm.
I
hope
that
the
state
does
the
right
thing
in
regards
to,

they
told
us
this
we
went
to
Colorado
is
the
medical
and
recreational
at
the
same
site.
So
you
don't
have
all
these
different
types
in
one
day
it
was
so
that
disabled
will
do
that,
but
I
also
saw
that
I'm
concerned
about
your
one
day
supply.

small
light
impact
in
terms

automobile
and
access,
so
the
impact
is
very
small
number
one

we
have
an
existing
parking
space
in
the
back

our
building
and
we
don't
want
to
get
too
far

bring
that
in,
but
we're
happy
to
do
so

executive

environment,

a

plan
in

particular

injection

the

there

opened

principles
of
the
company
and
it
seems
to
be
working.
But
the
thing
that
I
hear
over
and
over
and
over
is
that
everyone
walks
by
it
yeah.

report

very
positive

they

singled
out

dispensary
saying
that
they've
had
absolutely
no
issues
whatsoever
at
that
location
and
I
was
very
pleased
that
he
someone
who
would
oppose
this
proposal
and
went
out

way
to
walk
across
the
room
and
tell
me
that
I
also
know
I
was
during
the
last
few
weeks
months,
I
received
a
phone
call
from
one
of
your
colleagues.
I
honestly
could
not
remember,
which
colleague
asking
to
they
happen
to
be
there
with
one
or
two
of
their
colleagues.

it
possible
to
get
in-
and
this
is
one
of
the
benefits
of
having
a
local
applicant

the
door
immediately

industry

serious
people

funds

long

credibility
of
the
community
in

they're
seeking
to

we

long
time
working

this
particular
team

ID

outpatient

inpatient

also
prescription
drugs.
Now,
regrettably,
I
come
at
this
moment
to
oppose
this
application,
because
the
evidence
available
to
me
today,
prior
to
any
new
information
and
I
suspect
to
many
others
who
haven't
heard
this
before,
is
simply
not
sufficient
at
this
point
support
your
application.
In
fact,
it's
quite
the
opposite.
Now,
first
I'd
like
to
make
a
couple
of
disclosures,
I
have
lived
in
one
of
the
four
Prudential
Center
apartment
buildings,
where
both
applicant
principals
also
live,
but
I
do
not
know
them.

Secondly,
I
have
no
affiliation
with
any
other
registered
marijuana
dispensary.
Meanwhile
counselors,
you
are
very
well
acquainted
with
compasseth
compassion,
the
organics.
Just
ten
months
ago,
you
unanimously
rejected
its
application
for
an
RM
d
in
Allston.
At
that
time
you
had
ample
evidence
to
do
so.
Neither
of
the
principles
had
any
experience
in
the
MRD
industry.

the
Austin
application
process.
Nearly
two
dozen
documents
were
posted
on
the
DPH
website,
ranging
from
the
original
application
of
in
ten
in
June
2015
to
the
last
one
in
June
of
last
year.
Since
then,

single
additional
document
dated
June
1st
this
year
was
posted.
It
was
a
third
application
of
intent
and
the
only
2017
changes
were
an
increase
in
the
capital
and
a
change
of
Bank.

you
all
know
that
there
are
three
critical
elements
for
licensing
a
specific
RMD
at
a
specific
site.

is

qualifications
of
the
operator
last

have

terminal

suffer

daily
debilitating

pain

frequent
Boston
a
lot
and

I'm
helping

City
Council
build
this
medical
marijuana
program

boundaries
of
Boston

realized

I

able
to
conduct
business
and
pop
into
21
milk
Street
and
pick
up
some
medicines
for
the
week,
which
was
under
$25
and
at
that
moment
I
realized.
Wow
I
can
do
all
these
things.

work
visit
somebody's
office
and
then
not
spend
a
lot
of
my
time
going
out
to
look
for
medical
marijuana
and
all
the
city's
neighborhoods
are
very
different
and
wonderful
and
they
all
bring
different
visitors
and
different
workers
to
their
locality
and
Newbury
Street
in
Back.
Bay
is
no
different
and
I
love.
Newbury,
Street
and
I
know
a
lot
of
people
that
love
to
go
visit
and
shop
and
work
and
go
to
school,
and
this
is
just
going
to
be
one
of
those
boutique
facilities
that
you're
able
to
pop
in
to
provide
that
is.

organization
continues
to
live
up
to
those
standards
that
we
expect
and
the
Massachusetts
patient
advocacy
alliance
is
no
different.

want
to
see
high
standards
of
security,
clinical
environment,
customer
service
and
dignity
and
respect
when
dealing
with
these
conditions,
because
you
know
when
we're
talking
about
adult
use,
we're
not
talking
about
the
same
kind
of
consumer,
we're
talking
about
someone
who
is
exasperated
exhausted,
they
need
attention
and
they
want
a
little
bit
more
guidance
than
someone
who

using
it
for

get
high
on
a
Friday
night.

to

pride
ourselves

whenever

new
industry
comes

city,

solar
energy,

it's
the
pharmaceutical
company
casino
gambling,
whatever
it
happens

be
it
comes
to
our
area.

it

make
sure
that
we
can
secure

jobs

our
membership,

building

know
a
store,
whether
it
whatever
they
happen

reached

coming

city

parts

the
area
in
they
were

receptive

facilities

actually
works
and
helps
a
lot

other
patients
getting
through
the
system.
Finding
appropriate
dispensary
and
a
lot
of
people
are
looking
for
safe
access
in
their
neighborhoods.

do
ask
you

support
the
non
granting
an
opposition
letter
to
compassionate
organics
I
do
find
that
most
patients
are
easier
to
be
able
to
find
dispensaries
that
are
closer
to
public
transportation
and
I
wanted.
To
just
add
a
couple
of
things
that
I
wanted
to
add
is
that
it's
actually

dispensaries
open.
At
the
current
moment,
the
11
that
opened
was
in
Georgetown
in
May
and
about
the
price
of
marijuana
going
down
in
around
2014
when
the
first
dispensaries
opened.

average
price
was
about
three
hundred
eighty-five
dollars
to
$350
an
ounce,
and
now,
in
this
year
multiple
dispensaries
have
brought
their
prices
down.
It
could
be
brought
down
to
325

292
to
70
250,
all
sorts
of
different
things
that
are
going
on
nowadays.
Bringing
the
prices
down,
as
the
young
lady
here
mentioned,
that
we
as
more
dispensaries
come
open.
There
would
be
more,
you
know,
competition
in
the
price
continues
to
go
down,
so
I
asked
us
guys
to
support
the
non
opposition
letter,
and
thank
