hearing
is
to
assess
the
qualification
of
verizon
to
provide
cable
television
service
in
the
city
of
Boston.
If
they
are
determined
to
be
qualified,
the
city
may
enter
into
a
license
agreement
pursuant
to
the
applicable
state
and
federal
regulation,
and
we'll
talk
a
little
bit
about
what
those
are
shortly.

day
in
office,
mayor
Walsh
is
committed
to
increasing
competition
in
cable
and
broadband
service.
Here
in
Boston
today,
limited
competition
means
that
most
households
have
only
one
company
to
choose
from
when
it
comes
to
cable
service.
We
are
pleased
to
be
close
to
an
agreement
with
verizon
to
provide
an
additional
choice
for
boston
residents.
We
believe
that
market
competition
is
good
for
consumers.
This
license
and
this
hearing,
while
focus
solely
young,
is
focused
solely
on
cable
television,
service,
federal
and
state
law.
A
Do
not
grant
the
city
regulatory
authority
over
broadband
internet
service
and
any
license
that
the
city
may
grant
will
only
address
television
related
topics.
However,
it
is
important
to
note
that
the
applicant
intends
to
provide
broadband
internet
over
the
same
fiber
optic
connection
used
for
television
service,
so
a
verizon
cable
license
should
also
lead
to
increased
competition
for
broadband
internet
service.

This
hearing
in
the
process
to
date
has
been
done
in
accordance
with
Massachusetts
cable
law
and
the
regulations
published
by
the
Department
of
Telecommunications
and
cable.
It
began
with
a
joint
announcement
on
April
12
of
this
year
that
Verizon
intends
to
build
a
fiber-optic
network
in
Boston
and
to
use
that
network
to
offer
fios
internet
and
television
service.
The
same
day,
the
city
initiated
the
cable
television
licensing
process,
inviting
companies
to
submit
proposals
to
obtain
a
license
and
offer
service.
Verizon
was
the
sole
applicant
in
this
process.
A
Following
the
various
steps
set
forth
by
the
Massachusetts
Department
of
Telecommunications
in
cable,
the
city,
the
city
and
Verizon
proceeded
towards
licensing.
Although
state
regulations
require
only
one
hearing,
the
city
has
chosen
to
hold
to
the
first
hearing
was
held
on
August
second,
at
the
bowling,
Municipal
Building
and
Dudley
square.
The
city
was
beginning
license
negotiations
at
that
time,
and
our
goal
was
to
hear
from
the
public
early
to
inform
our
perspective
as
we
worked
with
verizon
to
draft
a
license.
A
All
comments
made
at
the
first
hearing
and
solicited
online
will
be
incorporated
into
the
record
of
this
hearing,
so
on
Monday
November
28th,
this
past
Monday,
the
city
published
a
draft
license
online.
This
is
the
result
of
the
negotiations
that
have
taken
place
over
the
past
four
months.
The
formal
purpose
of
this
hearing
is
to
review
the
qualification
qualifications
of
the
applicant
for
a
cable
license.
However,
we
welcome
any
comments
that
the
public
may
wish
to
make
on
the
draft
license
as
well.
A
I'd
like
to
point
out
that
the
structure
and
many
of
the
provisions
in
the
draft
license
were
based
on
the
existing
licenses
that
the
city
has
already
granted
to
other
licensees.
This
establishes
a
fair
basis
on
which
companies
can
compete
with
each
other.
It
also
fulfills
a
legal
obligation
in
our
existing
licenses
than
any
new
licensees,
be
granted
a
license
and
terms
that
are
substantially
the
same
as
those
given
to
existing
licensees.

Both
parties
went
into
negotiation
with
a
desire
to
reach
agreement,
but
with
the
city
committed
to
fighting
hard
for
a
license
that
served.
The
people
of
Boston
well
I
want
to
express
my
appreciation
for
the
people
at
Verizon
and
their
legal
counsel,
most
of
whom
are
in
the
room
for
their
spirited
but
professional
approach
to
this
negotiation.

The
Massachusetts
cable
law
suggests
that
a
city
would
first
issue
a
provisional
license,
followed
within
a
year
by
a
substantially
similar
final
license,
because
neither
the
City
of
Boston
nor
verizon
saw
any
benefit
to
a
two-part
licensing
process.
We
jointly
requested
and
received
a
waiver
of
the
provisional
license
requirement
from
the
Massachusetts
DTC
a
if,
after
this
hearing,
the
city
decides
to
grant
a
license,
we
would
move
forward
to
issue
a
final
license
as
soon
as
is
practical.

previously
mentioned,
the
city's
negotiating
goals
were
based
on
the
public
comments
received
in
August
and
the
administration's
priority
for
K
priorities
for
cable
competition.
Our
highest
priorities
were
to
establish
a
level
competitive
playing
field
with
other
television
providers
to
secure
new
and
ongoing
support
for
public
access,
also
known
as
peg
to
secure
a
new
commitment
to
public
education
by
connecting
schools
in
the
service
area
to
the
city's
fiber-optic
network
for
broadband
internet
purposes,
to
ensure
a
fair
non-discriminatory
service
area
and
to
prevent
cherry-picking
of
customers
to
ensure
service
availability
to
residents
of
public
housing.

asked
the
applicant
in
advance
of
this
hearing
to
address
a
number
of
topics,
specifically
compliance
with
Massachusetts,
cable,
television
statutes
and
dtc
regulations,
and
state
laws,
including
Mass
General
law,
166,
a
sections
3
through
5,
the
service
area
that
is
proposed
in
the
draft
license
currently
proposed,
as
approximately
thirty
percent
of
the
city
and
their
future
plans
for
expansion
of
that
service
area.

of

circumstances
in
which
a
household
may
not
be
able
to
get
cable
television
service.

announced
the
partnership
on
April
twelfth
to
bake
Boston
one
of
the
most
technologically
advanced
cities
in
the
country.
Verizon
is
well
underway
in
investing
three
hundred
million
dollars
over
the
next
five
to
six
years
to
bring
its
next-generation
fiber
network
to
residents
and
businesses
across
Boston.

The
new
network
will
offer
tremendous
bandwidth
and
speeds.
It
will
bring
increased
competition
and
choice
for
broadband
and
TV
services,
spur
innovation
and
economic
opportunity
in
the
neighborhoods
across
the
city.
It
will
power
many
verizon
services,
including
fios
wireless
technology,
enhanced
Ethernet
solutions
and
Smart
City
applications.

have
worked
closely
with
city
officials
to
come
to
terms
of
a
video
franchise
agreement
if
a
license
is
granted.
Fios
TV
in
addition
to
data
and
voice,
will
soon
be
available
to
consumers
in
the
first
service
area.
In
the
neighborhoods
of
Dorchester
Dudley
Square
innovation,
district
and
rossendale
and
West
Roxbury
verizon
technicians
have
been
out
already
placing
large
capacity
fiber-optic
cables,
both
above
and
under
ground,
to
connect
fiber
directly
to
homes
and
businesses.

on
verizon's
qualifications

offer
consumers

other
choice

video
services.
Verizon
is
one
of
the
world's
leading
providers,
a
broadband
and
entertainment
services.
We
have
a
diverse
workforce
of
over
160
2,000
employees,
132
billion
in
revenue
with
a
long
history
of
providing
quality
wireline
in
wireless
service
to
consumers.
In
2015,
verizon
invested
more
than
17
billion
dollars
in
wireless
wireline
and
enterprise
infrastructure.

We're
financially
sound
with
invested
hundreds
of
millions
of
dollars
in
supporting
our
fios
business
to
guarantee
its
success.
Verizon's
largest,
all
fiber
network
supports
more
than
5.6
million
FiOS
data
customers
and
4.7
million
files.
Tv
customers,
our
advanced
fiber
network,
offers
video
data
and
voice
connections
directly
to
the
customers.
Premise:
it's
the
most
sophisticated
network
in
the
nation.

new
fiber
network
is
being
built
and
supported
locally,

union

with
the
ability

Lowell
business

fios
service

issues
will
be
handled
out
of
our
by
employees.
Out
of
our
50
solution
center
down
in
providence,
rhode,
island
verizon
has
been
a
long-standing
philanthropic
partner
in
the
city,
with
a
primary
focus
on
STEM
education
programs
that
benefit
Boston
Public
Schools
school
students.

Over
the
past
five
years,
verizon's
contributed
over
3.4
million
dollars
to
nonprofits
across
the
city.
Verizon
has
committed
a
hundred
thousand
dollars
to
the
Boston
Public
Library
in
support
of
a
new
Wi-Fi
hotspot
lending
program.
The
two-year
pilot
focuses
on
making
100
hot
spots
available
to
library,
patrons
increasing
access
to
the
internet
and
other
online
services.

cable
license
is
granted,
verizon
will
provide
an
outstanding
alternative
for
video
service
to
residents
here
in
the
city,
just
as
we've
already
done
for
the
past
11
years
in
113,
other
Massachusetts
communities
file
services,
most
awarded
service

the
industry,
rated
highest
and
consumer
satisfaction
in
the
East
reason
region
by
JD,
Power
again.

city

their
desire

provide
video
choice
to

residents.

action
on
approving

and
license
will
ensure
that
residents

the
first
neighborhoods
benefit

like

believe
these
documents
alone
provide
sufficient
evidence
to
the
city
that
verizon
has
the
necessary
legal,
technical
and
financial
qualifications
to
operate
a
cable
system
in
the
city
of
Boston.

highlight
some
of
the
material
terms
of
the
proposed
license
under
consideration
at
this
hearing,
as
well
as
how
the
provisions
of
the
proposed
license
meet
the
applicable
provisions
of
state
laws
and
regulations
consistent
with
chapter
1
66,
a
of
the
Massachusetts
General
Laws,
the
proposed
10-year
license
defines
a
service
area
to
include
the
neighborhoods
of
Dorchester
West
Roxbury
and
the
Dudley
square
innovation
district
in
Roxbury,
collectively
comprising
roughly
thirty
percent
of
the
city.
The
specific
boundaries
of
the
service
area
illustrated
on
exhibit
one
of
the
proposed
license.

The
license
also
expressly
cares
for
the
future
expansion
of
the
service
area
to
incorporate
additional
portions
of
the
city
by
amending
exhibit
one
of
the
license.
Any
such
amendment
would,
of
course,
be
subject
to
the
approval
of
the
issuing
authority
and
must
be
effectuated
consistent
with
the
provisions
of
207
CMR
3.7.

But
the
critical
point
to
note
is
that
the
license
was
crafted
in
a
manner
intended
to
facilitate
the
seamless
expansion
of
the
service
area
in
future
years.
If
the
city
and
Verizon
reached
an
agreement
to
do
so,
section
3.1,
clearly
obligates
Verizon,
to
make
cable
service
available
to
all
residential
households
in
the
service
area
on
a
non-discriminatory
basis
within
the
timeline
set
forth
in
the
license
and
under
state
law
recognizing
the
reality
that,
in
certain
circumstances,
factors
beyond
verizon's
control
may
prohibit
verizon's
ability
to
access
certain
households
to
install
service.

The
license
does
include
certain
exceptions
to
the
service
availability
obligation,
those
installation
exceptions,
variations
of
which
are
standard
in
all
cable
licenses
throughout
the
country,
irrespective
of
provider
include
cases
where
Verizon
cannot
gain
access
to
a
private
right
of
way,
where
a
landlord
of
a
multiple
dwelling
unit
either
denies
access
or
is
restricted
by
an
exclusive
marketing
agreement
with
another
provider
where
Verizon
does
not
have
existing
telecommunications
facilities,
we're
significant
technical
impediments
exist
and
we're
extraordinarily
high
installation
costs
render
installation
impracticable
in
limits.
Limited
circumstances
where
these
exceptions
are
exercised.

Service
may
not
be
immediately
available
to
the
affected
household,
however,
as
a
new
entrant
to
a
competitive
market,
verizon,
obviously
as
a
compelling
interest
in
gaining
access
to
as
many
households
in
the
service
area.
As
is
possible,
moreover,
in
the
interest
of
transparency
and
oversight
by
the
city,
the
license
includes
extensive
record-keeping
and
reporting
requirements
with
respect
to
the
status
of
exceptions,
including
the
right
of
the
do
IT
to
participate
in
a
series
of
verification
sessions,
during
which
the
do
IT
will
be
able
to
review
verizon's
internal
databases
to
ascertain
the
status
of
deployment.

proposed
license
also
includes
a
firm
commitment
from
verizon
to
provide
cable
service
to
all
public
housing
communities,
including
public
housing
authorities,
owned
or
managed
by
the
Boston
Housing
Authority
and
by
third
parties
on
behalf
of
the
Boston
Housing
Authority,
pursuant
to
the
terms
of
section
3.1
h
of
the
proposed
license.
In
addition
to
these
important
deployment
and
service
availability
issues,
verizon
has
agreed
to
a
range
of
substantial
financial
and
operational
commitments
to
support
the
city's
cable,
related
needs
and
interests.

for
a
network
fund
to
permit
the
city
to
purchase
equipment
and
services
for
the
video
return
locations,
which
would
be
used
to
provide
cable,
related
services
to
boston,
public
schools,
libraries
and
other
public
buildings.
Through
the
cable
system,
verizon
has
agreed
to
construct
a
fiber-optic
public
information
network
or
pin
connecting
43
schools
in
the
service
area
over
the
first
36
months
of
the
license,
along
with
the
ten
thousand
dollar
grant
to
offset
certain
related
costs,
the
pen
may
be
expanded
to
up
to
a
total
of
127
locations.

Verizon
shall
pay
five
percent
of
its
quarterly
gross
revenue
for
cable
service
generated
in
the
service
area
and,
finally,
Verizon
shall
establish
a
full-service
customer
service
center
in
the
city,
as
well
as
two
bill
payment
locations
in
the
service
area
and
two
additional
in
close
proximity
to
the
service
area.
In
conclusion,
we
are
again
grateful

the
opportunity

for
the
city's
consideration

the
proposed
license
through
this

Verizon
expressed
their
intent

build
fios
service

eventually

city

intent
of
Verizon
and

you

expect
to
see
in
the
years
ahead,
as
it
relates
to
service
area
expansion,
short.

upgrading

existing
network

fiber

underway.

agreement
is
sort
of
an
extension
of
that
process,
but
whereby
we
gain
approval
to
provide
video
service
in

service
area

agreement.

you
know,
the
agreement
contemplates
the
additional
future
service
areas
as
we
go
forward.
That
would
obviously
be
subject
to
negotiation
between
verizon
and
the
issuing
authority,
and
we
would
negotiate
such
amendments
consistent
with
the
terms
in
the
franchise
and
the
terms
of
state
law.

internet
service

Roxbury
innovation
center
is
dedicated
to
assisting
and
encouraging
entrepreneurship
and
innovation
for
residents
of
Roxbury,
Dorchester
and
mattapan.
We
provide
programming
to
support
small
business
owners,
entrepreneurs
and
innovators.

summer
we
had
over
280
students
per
week
using
laptops,
smartphones
and
Microsoft
surfaces
simultaneously,
as
they
learned
coding,
mobile
app
development
website,
design,
digital
fabrication
and
computer-aided
design.
Without
fast
speed,
verizon
internet
running
over
running
our
summer
programming
would
have
been
difficult
to
near
impossible
in
eight
months
since
I
first
spoke
about
verizon's
fios
I
have
smoked
spoken
to
small
business
owners,
students
and
community
members.

many
of
them
struggle
with
internet
and
cable
accessibility,

believe
bringing

offering
verizon
brings

these

arts,
culture,
information
and
viewpoints
of
interest
to
their
communities
throughout
the
city
and
beyond.

the
testimony
of
young
people
about
the
value
of
our
hands-on
training
programs,
including
an
international
student
intern,
a
high
school
student,
a
former
youth
program
participant
who
described
how
this
was
an
important
step
leading
to
her
media
career,
but
they
are
representative
our
support
in
every
community
in
the
city

bnn
since
1986
when
I
began
as
a
member,
we

a
very
busy
community
media
center.
Last
year,
our
members
produced
in
1990
new
local
shows
in
Boston.
That's
38
new
shows
each
week,
13
of
them
live
and
bnn
staff
produced.
Another
485
shows
including
a
nightly
news
program,
coverage
of
high
school
sports
parades
and
community
events
in
the
process.

Bnn
and
our
members
served
over
800
nonprofits,
educational
and
religious
institutions,
city
agencies
and
community
groups,
in
addition
to
providing
access
to
TV
studios,
a
media
lab
and
other
production
facilities
were
also
a
training
center.
Last
year
we
offered
10
multiple
session
workshops,
5
youth
programs
to
senior
programs
and
20
other
classes,
orientations
and
hands-on
tours
with
youth
groups.

Our
members
are
not
our
only
constituents.
We
know
that
cable
viewers
appreciate
bnn
TV
as
well.
Last
year
we
commissioned
a
citywide
community
media
survey
to
measure
Boston,
cable
subscribers
awareness
and
support
of
the
community
based
services.
Bnn
provides.
Eighty
percent
of
respondents
feel
that
bnn
community
channels
featuring
local
content
are
important.

Seventy-Five
percent
agree
that
bnn
programs
are
of
interest.
Ninety
percent
agree
that
public
access
to
training,
production
facilities
and
channels
is
a
good
community
service,
and
support
for
DNN
is
strong
among
all
groups,
especially
among
those
under
40
and
those
whose
first
language
is
not
English.

hear
that
verizon
is
making
plans
to
bring
vios
to
the

hopes
and
encourages

city

franchise
agreement

verizon
so
that
we
can
experience
greater
choice

competition
in

Verizon
plans
to
invest
approximately
300
million

city
for
this

investment
is

State-Of-The-Art,
fiber
network
illustrates

continuing
importance

the
company's
wireline

facilities,
schools,
manufacturers
and
other
public
and
private
sector
entities
better
faster
internet
service
and
connectivity,

addition
to
other
option
for
TV

six

commitment
represents
good-paying
jobs
for

and

will

support

Jamaica
Plain
is
sort

further
down

urge
you
to
support
this

a
number

reasons.
There's
already
been
mentioned.
The
increased
competition
will
be
good
for
consumers,
good
of
residents

the
City
of
Boston,
as
well
as
residents
across
the
Commonwealth.
A
Boston
will
now
join
with
a
hundred
and
fourteen
plus
other
communities
across
the
Commonwealth,
with
access
to
these
services.
Fiber
optics
I've
spoken
to
our
members
throughout
the
state
who
have
been
very
pleased
with
the
nature,
delivery
of
services
and
three

citizen
Townsville
Commonwealth.

We
hope
that
will
ultimately
be
a
wired
with
broadband
and
with
files,
so
competition
is
good.
It's
supporting
small
businesses,
which
of
the
key
job
creators
in
mass
chusetts,
will
be
instrumental
and
economic
development
activities
will
be
important
that
will
be
brought
about
by
the
implementation
of
fios
in
the
city
of
Boston.
I
want
to
also
commend
verizon
and
mr.

We
hope
that
the
license
will
incorporate
mayor
washes
are
more
recent
statements
about
the
Boston
residence
jobs
program.
He
announced
this
week,
which
will
incorporate
and
increase
the
number
of
Boston
residents
at
the
51%
minorities,
and
people
call
our
forty
percent
of
women,
the
twelve
percent
in
the
construction
aspects,
and
also
hope
that
would
be
consistent
and
be
included
in
relation
to
the
permanent
jobs
that
are
created
as
result
of
this
investment.
If
Boston
residents
don't
benefit
in
the
construction,
jobs
and
permanent
jobs,
this
will
be
a
sort
of
an
unfortunate
aspect
of
the
project.

know
the
Boston
residence
will
benefit
from
the
services
that
verizon
will
deliver,
but
it's
going
to
be
more
than
just
service
delivery.
It's
going
to
be
Economic,
Opportunity
benefits
of
residents.
So,
on
the
basis
of
that,
we
urge
you
to
support
the
license
application
both
from
the
mattress
workers,
Board,
Association
and
I
urge
you
on
my
behalf
as
a
resident
of
the
city
of
Boston.

issue

certain
areas

Massachusetts

we
have
to
get
members
in
other
areas
that,
quite
frankly,
don't
have
enough
work
at
this
time
to
do
it.

there
is
a
commitment.

an
associate
professor
of
Boston
College
Law
School,
where
I
read
and
I
write
and
I
teach
about
telecommunications
law,
including
cable
Verizon's,
asked
me
to
provide
some
comments
tonight.
Based
on
my
experience
studying
the
industry,
I
would
encourage
the
city
to
approve
the
agreement.
My
I
think
both
the
city
and
its
residents
are
likely
to
benefit
from
the
increased
competition
that
we're
going
to
see
when
Verizon
interest
the
market.

The
FCC's
long
noted
that
more
cable
competition
can
lead
to
lower
prices
and
better
quality,
not
just
for
cable,
but
also
for
other
telecommunications
services
as
well
such
as
broadband
I've
reviewed
the
proposed
agreement
and
I
think
the
terms
look
comparable
to
other
similar
cable
franchise
agreements,
including
Boston's
earlier
agreement
with
comcast
and
I.
Think
the
phased
construction
model
that
Verizon
has
proposed
is
one
that
has
been
tried
elsewhere
with
success
and
I.
F
Now,
that's
led
a
lot
of
other
cable
companies
to
halt
new
cable
construction
and
to
focus
on
their
businesses
elsewhere.
Just
last
month,
google
fiber,
which
many
of
us
thought,
was
going
to
be
the
revolutionary
spark
in
this
industry
to
bring
one
gigabit
broadband
and
competitive
cable
to
other
markets.
They
announced
that
they
were
putting
their
future
expansion
plans
on
hold
and
they
began
laying
off
workers,
including
the
head
of
the
Google
Fiber
division.

So,
given
those
market
dynamics,
I
applaud,
Verizon
and
the
city
for
negotiating
an
agreement
that
seems
flexible
enough
to
allow
verizon
to
continue
its
build-out
and
I.
Think
it's
worth
noting
that
the
build-out
is
part
of
a
much
larger
project
by
Verizon
to
provide
to
upgrade
Boston's
telecommunications
infrastructure,
bringing
more
fiber
and
other
advanced
network
architecture
to
meet
the
needs
of
a
21st
century
city.

think
this
upgrade
will
do
very
good
things
for
Boston
as
an
innovation
hub
and
I.
Think
the
city
can
help
make
sure
that
happens
by
allowing
verizon
to
provide
cable
service
alongside
telephone
and
Internet
service
on
that
network.

also

add
that
I'm,
an
existing
files
customer
and
because
of
my
nature,
I'm,
a
particularly
troublesome
one
and
I,
can
attest
that
verizon
fios
is
customer
service
is
really
really
good.

overall

think
this

like

win-win

city
and
its
residents
out

the
council

approve

files

coming

boston

a
lot

choices,

right
now
for

residents

city

Boston,

even
consumers
who
don't
choose
files
will
benefit
from
its
presence
in

marketplace

competing

our
business
will
make
all
cable
providers
sharper
as
they'll
need
to
pay
more
attention
to
customer
service,
offer
the
best
programming
available
and
keep
their
prices
down.
Fios
is
a
great
alternative
as
its
offered
over
the
new
fiber
optic
network.
Verizon
is
building
in
boston.
This
is
a
great
development
for
the
city.
It's
tremendous!

three
kids

go
through
30
gig
in
less
than
a
month
and
we're
always
fighting
over
you'll
get
off
the
netflix.
You
know
so,
there's

not
enough
bandwidth.

comcast

rcn
and
just
more
choices
for
everybody
in
the
city
is,
is
a
win-win.
Verizon
is
an
excellent
corporate
citizen
and
any
issues
that
come
up
our
needs
will
be
there
right
away

reach
out
to
anybody
for
any
help
that
that
is
needed
and
customer
service
is
number

summer
jobs,

part
of

city
administration

mid-80s
when
we
first
allowed
cable
television
into
town
and
we
had
tremendous
leverage
and
frankly
regulated
the
price.
Those
days
are
long
gone.
Yet
the
competition
that
was
supposed
to
surface
in
lieu
of
the
agreements
has
really
not
materialized.
So
I
commend
mayor
Walsh
for
making
an
aggressive
move
to
bring
for
rise
and
bios
into
the
competitive
environment,
and
I
would
also
point
out,
particularly
with
you
here,
Joshua,
that
this
is
not
just
about
price.
It's
about
technological
innovation.

really
don't
know
what
the
various
streams
will
carry
10
years
from
now,
and
competition
and
innovation
to
me
is
just
as
important
as
competition
in
price,
though,
when
I
opened
my
bills,
I,
don't
necessarily
see
that
as
clearly

I

so.

urge
the
mayor
in
the
city
to
move
expeditiously
to
bring
pariahs,
bring
files
into
the
competitive
stream.
