This
is
an
administrative
hearing
before
the
mayor's
office
of
consumer
affairs
and
licensing
today
is
thursday
march
10
2022.
This
hearing
is
being
conducted
pursuant
to
certain
temporary
amendments
to
the
open
meeting
law.
That
is
what
allows
us
to
meet.
Virtually
this
hearing
is
being
recorded
and
will
be
posted
to
the
city
of
boston's
website.
We
are

the
executive
director
of
the
mayor's
office
of
consumer
affairs
and
licensing

Good
morning,
I'm
going
to
read
from
a
police
report
which
I
wrote
on
a
sunday
february,
6
2022
sergeant
detective
william
gallagher
and
detective
eddie
hernandez,
signed
of
the
bpd
license
premise
unit
conducted
a
licensed
promise.
Inspection
of
el
diamante,
located
at
73
meridian
street
in
east
boston
detectives
were
there
regarding
a
noise
complaint
that
had
been
made
for
the
city's
311
complaint
line.
As
detectives
approached
the
establishment,
they
could
easily
hear
loud
amplified,
music
emanating
from
inside
the
premise
going
to
the
streets
in
a
budding
neighborhood.

While
standing
in
front
of
the
establishment
side,
detective
gallagher
utilized
a
sound
meter
and
recorded
an
average
decibel
reading
of
69.20
detectives
made
note
of
the
time
is
approximately
11,
35
p.m.
Boston,
noise
ordnance
state
said
the
noise
decibels
may
not
exceed
50
decibels
after
11
pm.

So

understand
you
want
to
do
what
you
can
to
make
sure
everyone
can
live
together
peacefully.
But
what
does
that
mean?
You've
had
I'm
looking
at
your
file,
and
this
isn't
the
first
time
that
you've
we've
had
a
lot
of
complaints
about
noise
and
it
doesn't.
You
haven't
demonstrated
to
me
that
has
changed.

Yeah,
so
what
we're
doing
right
now?
We
hire
a
company
and
we're
trying
to
change
our
system,
our
sound
system,
but
our
order
is
back
quarter
since
kovi
and
all
these
things
going
on.
We
still
wait
in
an
hour
order.
So
for
now,
what
we're
trying
to
do
and
what
we've
been
doing
is
trying
to
keep
the
volume
as
the
lowest
we
can.
So
we
don't
get
any
more
complaints
and,
as
you
can
see,
we've
been
doing
good
because
there's
no
complaints.

wanted

ask
the
detective
or
the
sergeant:
do
you
know
of
any
sound
monitoring
devices
that
can
be
downloaded
easily
to
someone's
phone
or
computer?
Perhaps
the
self-monitor.

like,
like
we
said
after
11
o'clock,
the
security
and
most
of
the
employees
have
this
program
on
their
phones,
and
this
is
what
we
do.
The
problem
that
we
have
is
that
sometimes
the
music
goes
up,
and
this
is
when
we
get
the
complaint
but,
as
I
say
for
us
like,
whenever
we
get
complaints
or
whenever
we
get
like
notice
that
the
music
it's
it's
going,
a
little
bad
right
away,
we
go
and
we
put
it
down
because
you
know
we
don't
want
to
make
it.

what
happened
is
that
from
what
I
understand
she's
that
she's,
not
our
neighbors,
don't
hear
the
music,
it's
just
the
building
by
with
the
music.
So
this
is
the
problem
that
we
have

not
so
much
about

we

loud.

that
the
buildings
are
too
close
to
each
other.

state
for
the
record
that
there
is
a
history
at
el
diamante
complaints
from
the
neighbor,
but
also
actual
violations
with
loud
music.
We
have
held
hearings.
There
was
one
that
was
warning
in
october
of
last
year
we
did
have
an
lpv
issued
for
music
75
to
78
decibels,
elevating
to
90
decibels
at
11
pm.

That
is
the
only
issue
before
the
division.
Today,
the
executive
director
will
take
this
matter
under
advisement
and
will
issue
a
written
decision.
