Good
afternoon,
this
is
a
hearing
before
the
licensing
board
for
the
city
of
Boston.
Today
is
Thursday
July
20th
2023..
Today's
hearing
is
being
held
pursuant
to
Temporary
amendments
to
the
open
meeting
law.
That
is
what
allows
us
to
meet.
Virtually
today's
hearing
is
being
recorded
and
will
be
posted
to
the
city
of
Boston's
website.

The
item
on
this
afternoon's
agenda
is
Monica's
Trattoria
on
Prince
Inc,
doing
business
as
Monica's
Trattoria
located
at
67
Prince
Street.
This
is
an
informational
hearing
to
review
the
character
and
fitness
of
the
licensee
and
manager
of
record
pursuant
to
match
general
laws.
Chapter
138,
section
12
and
section
26.,
who
is
present
on
behalf
of
the
licensee.

As
you
know,
this
is
a
heavily
regulated
industry
and
as
Regulators
we
have
scheduled
this
hearing
to
gather
information
as
to
whether
Mr
Patrick
Mendoza
has
a
requisite
character
and
fitness
to
own
any
interest
in
a
liquor
license,
as
required
by
Master
of
Law
chapter
138,
section
12,
and
whether
he
has
a
requisite
qualifications
to
be
the
manager
record,
as
required
by
Master
Allah
chapter
138,
section
26..

We
have
shared
with
you
four
police
reports
that
the
dates
of
the
that
have
formed
the
basis
of
today's
hearing.
The
dates
and
those
police
reports
are
July,
12th,
July,
13th,
June,
22nd
and
June
29th.
Did
you
receive
all
those
police
reports.

received
those
at

27
this
afternoon
and
I
will
waive
the
reading
of
those
reports.
I
presume
that
the
commission
has
them
will
make
a
part
of
the
record
for
those
around
themselves.

The
qualifications
for
manager
of
record
before
this
board
are
citizenship
residency
in
Massachusetts
experience
in
the
food
and
beverage
industry,
in
familiarity
with
the
rules
and
regulations
on
board
the
abcc
and
the
laws
of
the
Commonwealth
relative
to
the
sale
and
service
of
alcohol.
While
these
are
the
Baseline
requirements,
section
26
also
requires
that
a
manager
of
record
be
with
respect
to
his
character
satisfactory
to
the
licensing
authorities
based
on
the
events
that
have
occurred
over
the
past
week
and
which
are
public
knowledge.

and
I
also
want
to
point
out
that
our
rules
and
regulations,
Section
1.15
state
that
a
cause
for
revocation
suspension
and
modification
of
a
license.
One
of
those
elements
is
a
failure
to
to
appear
before
the
board
failure
of
the
licensee
or
the
manager
to
appear
and
testify
under
oath
to
any
inquiry
or
hearing
held
by
the
board,
with
respect
to
any
application
or
matter
before
the
board
pertain
to
the
conduct
or
bearing
upon
the
character
and
fitness
of
such
person
to
hold
to
continue
to
hold
a
license.

So
I
just
wanted
to
set
the
stage
as
to
why
we
are
here.
The
information
we're
going
to
gather
I'm,
going
to
give
you
an
opportunity
to
make
some
opening
statements
and
then
we'll
the
members
of
the
board
will
ask
some
questions.

background
for
this
restaurant
is
that
it's
been
operated
by
the
Mendoza
family
for
more
than
20
years.
You
will
not
find
any
disciplinary
actions
in
your
files.
With
regard
to
the
operations,
restaurant
had
been
a
family
business
that
Mr
Patrick
Mendoza,
took
over
individually
within
the
last
few
years
of
his
absence.

I
believe
you
know
across
the
police
department
knows
he
has
not
been
present
at
the
restaurant.
For
eight
days,
however,
his
brothers
spoke
with
whom
our
licensed
managers
by
this
board,
approved
by
this
board,
his
wife
and.

Mr
Queen
has
been
the
operations
manager
at
the
restaurant
for
the
last
six
years
and
amongst
that
group
of
family
members
and
Miss
McQueen,
the
restaurant
has
operated
during
the
past
week
without
any
incidence
of
problems,
and
we
Faithfully
represent
to
you
that
that
will
continue
at
this
point
in
time
and
that
we
would
like
the
opportunity
to
be
able
to
file
a
request
to
have
Miss
McQueen
a
point
that,
as
a
manager
of
reckon
for
this
premises,
which
we
are
in
the
process
of
gathering
that
information.

think
my
40
plus
years
experience
before
this
board
having
an
absent
manager
is
not
something
that
hasn't
happened
before
people
take
vacations
people
get
sick,
people
are
incapacitated
and
the
sport
has
allowed
replacement
managers
once
that's
been
brought
to
their
attention,
and
that
is
our
request
today.

comfortable

the
restaurant
remaining

we

still

determined

transferring

interest

pause?

evading
the
law,
he's
not
cooperating
with
police
he's
unavailable

board

he's
putting
at
risk
the
operations
of
his
business,
upon
which
his
family
and
these
25
employees
rely
on.

I
urge
you
to
get
us
that
information
as
quickly
as
possible.

We
we
do
have
precedence
on
transfers
of
management
records
and
improving
such
but
it's
unprecedented
that,
when
called
upon
a
manager
of
record
is
unavailable
for
a
week,
anticipating
the
law
and
is
accused
of
some
serious
crime.
So
I
don't
see
a
parallel
to
any
other
transfer
application
that
we've
had
before
us.
In
the
four
years,
almost
four
years
I've
been
chair
of
the
board,
so
I
don't
see
a
lot
of
similarities.

Needless
to
say,
I
would
to
say
allegations
of
the
allegations
and
deal
with
the
allegations
as
you
see
fit,
and
we
will
try
to
proceed
to
the
board
by
providing
information
that
we
can.
But
once
again,
what
has
been
a
successful
family.

should
not
be
penalized
at
this
point
in
time
by
putting
people
out
of
work
by
having
the
family
go
without
income
and
not
allow
us
at
least
to
keep
the
restaurant
open
on
the
reliable
group
of
family
members.
As
I
say.
Two
other
brothers
are
approved
by
the
sport
as
managers
and
willing
to
assist
in
the
business.
We
have
a
person
who
has
six
years
of
experience,
managing
they
can
assist
with
the
business
that
has
little
to
do
with
the
allegations
that
attending
regarding
Mr
Mendoza.
