the
city
of
boston
for
all
south
boston
and
seaport
licensees
holding
an
alcoholic
beverages
license.
Today's
hearing
is
in
partnership
with
the
mayor's
office
of
health
and
human
services,
boston,
boston,
public
instructional
services
department.
Again
as
a

licensees
violations
of

operational
requirements

we're
not
looking

infor

looking

bring
you

for
enforcement
hearings
unless
there's
an
egregious
violation.
We
understand
these
requirements
are
confusing
and
they
are
changing
the
board
and
all
of
our
other
agencies
on
this
call
and
in
the
city
are
here
as
a
resource
to
you.

people
are
permitted
to
sit
together,
not
eight,
not
ten
tables
need
to
be
placed
six
feet
apart
even
outside
one
of
the
concerns
we're
hearing
from
our
licensees
is
that
you're
struggling
to
ensure
your
patrons
are
wearing
their
masks,
social
distancing
in
line
and
remaining
seated.
We
understand
that
this
is
challenging,
but
at
the
end
of
the
end
of
the
day,
it's
your
responsibility
to
ensure
patrons
are
adhering
to
these
guidelines.

sure
everyone
has
been
following
the
news
closely,
maybe
not
as
closely
as
we
in
public
health
are,
but
you
have
probably
heard
that
across
the
country
cases
of
covet
are
increasing
and
increasing
at
a
dramatic
rate,
and,
unfortunately,
boston
is
not
immune
to
this
trend.

We
are
very
concerned
about
what
the
data
are
showing
us
and
I'm
sure
anyone
who
has
kids
in
the
boston
public
schools
have.
You
know,
learned
that
boston,
public
school
students
are
going
to
be
remote,
so
that
sort
of
shows
you
the
gravity
of
the
situation
that
we're
in
when
we're
looking
at
the
total
number
of
cases
in
boston,
we
look,
we
can
drill
down
and
look
at
the
data
and
slice
it
in
a
lot
of
different
ways,
and
I
don't
want
to
get
too
into
the
weeds.

But
just
for
your
information,
I
thought
it
would
be
helpful
to
think
about
the
age
groups
that
are
most
impacted
at
this
time.
So
the
of
the
total
number
of
new
cases
I've
covered
in
boston,
the
group,
the
age
band
that
has
the
most
number
of
cases
it's
20
to
29
year
olds
and
that's
followed
by
30
to
39
year
olds
and.

The
number
of
positive
cases,
total
positive
cases
divided
by
the
total
number
of
conductive
cases,
so
the
numerator
denominator
could
bring
you
back
to
some
math
classes,
so
boston's,
seven
day,
average
covid19
positive
test
rate
was
5.7
percent
most
recently,
and
this
was
an
increase
from
last
week's
rate
of
4.5
and
again
based
on
the
decision
to
go
remote
for
the
boston
public
schools.
You
can,
I
think
we
can
all
infer
that
these
rates
are
troubling
and
we're
headed.

we
have
neighborhood
specific
data
and
we
have
some
rates
that
are
at
high
11.4
percent
positivity,
followed
by
9.4
9.2.
If
the
folks
are
interested
in
data,
you
can
find
all
this
on

we
again
we
drill
down
to
racial
and
ethnic
rates
of
cova
19.,
and
we
just
ask,
as
you
think
about
this,
and
if
you
hear
the
numbers
that
you
really
start
to
think
about
the
people
who
are
impacted
by
kova,
it's
the
guest
who
you're
having
at
your
restaurant.

also
your
employees,
it's
your
employees,
families,
it's
the
employees,
loved
ones
and
friends,
so
that
these
are
people
who
are
impacted
by
it,
and
there
are
people
who
are
getting
very
sick
and
we
also
have
the
flu
coming
around
so
not
to
be
doom
and
gloom
and
also
think
about
the
and
I'm
sure
people
follow
this.
But
you
know
the
racial
disparities
that
are
connected
to
covet
infection
rates,
and
you
know
how
is
that
impacting
your
employees
and
how
is
it
going
to
impact
folks
moving
forward
along
with
the
flow?

recognize
counselor

counselor

wanted

the
same

we
understand
the
difficulties
that
the
industry
is
facing
and
the
detectives
assigned
to
the
licensed
premise
unit
are
not
seeking
to
compound
any
problems
or
give
anyone
any
issues.
Rather,
it's
our
intent
to
to
identify
and
clarify
the
issues
but
and
the
change
in
the
changing
environment
and
identify
any
unacceptable
behavior
and
with
the
cooperation,
the
continued
cooperation
of
the
establishments
to
correct
these
issues.

some
some
of
the
questions
that
we've
received
and
then
open
it
up
to
questions
from
from
all
of
you.
We
did
want
to
flag
some
of
the
complaints
that
we've
been
receiving
to
date,
while
the
vast
majority
of
our
licensees
have
been
very
clearly
committed
to
adhering
to
all
of
the
requirements
and
the
guidance
issued
as
it's
been
changing.
We've
recently
received
a
significant
increase
in
complaints
specific
to
south
boston
and
the
seaport.

We
understand
that
it
can
be
difficult
to
ensure
that
all
of
your
patrons
are
adhering
to
all
of
these
rules
and
regulations,
especially
as
they
change
on
a
fairly
regular
basis.
We're
committed
to
working
with
you
to
identify
best
practices
to
ensure
all
of
your
patrons
are
adhering
to
these
rules
and
regulations,
but
at
the
end
of
the
day,
we
want
to
make
sure
that
you
are
doing
everything
you
can
both
to
protect
the
public
health
and
public
safety
of
your
patrons
your
employees
in
the
community,
as
well
as
protecting
your
annual
liquor
license.

the
chairwoman
said,
the
board
has
been
viewing
any
violations
as
a
conversation
starter,
as
opposed
to
something
that
requires
punitive
action.
So
if
you
have
any
questions,
we're
here
as
a
resource,
as
are
all
the
other
departments

are
on
this
call
with
that,
I
want
to
turn
it
back
over
to
chairwoman
joyce,
who
has
is
going
to
address
one
of
the
most
common
questions
we've
received
about
recent
changes
to
the
use
of
seating
at
the
bar.

have
received,
you
know
very
received
emails
and
phone
calls
from
neighbors
in
your
community
that
are
even
upset
that
we're
even
having
this
hearing,
but
this
really
is
to
educate
each
other
and
to
start
out
the
governor's
guidelines
and
our
advisories
are
probably
written
for
the
industry,
they're
not
written
for
the
public.

So
there
is
probably
a
communication
breakdown
when
the
public
goes
into
your
restaurant
as
far
as
what
is
expected
of
them-
and
all
we
can
ask
is
that
you
continue
to
remind
your
patrons
that
these
these
rules
are
in
place
for
their
own
safety
and
for
the
safety
of
the
restaurants
and
for
the
community.
So
I'd
like
to
jump
into
seating
at
a
bar.
What
has
changed
as
far
as
seating
as
a
bar-
and
many
of
you
know
this,
and
there
has
been
some
confusion
on
the
enforcement
side.

Seating
at
the
bar
is
permitted
as
long
as
there
is
a
delineated
space
for
the
service
bar,
so
in
some
restaurants,
where
they
have
a
20-foot
bar,
the
service
bar
is
on
one
end,
and
people
are
not
seated
near
that.
Then
you
can
have
seats
along
the
bar
in
groups
of
six,
should
you
wish,
or
in
groups
of
four
or
in
groups
of
two
and
as
long
as
they're
socially
distant
by
party,
either
by
six
feet
away
from
each
other
or
by
plexiglas
partitions
that
is
okay.

Prior
to
this
change,
service
had
to
be
on
the
restaurant
side
at
the
bar.
Now
you
can
serve
your
customers,
as
many
of
you
know,
from
the
bar
side.
As
long
as
there
is
six
feet
between
the
patron
and
where
the
service
area
is,
should
you
wish
people
to
sit
closer
together
than
the
parties
of
than
six
feet?
You
can?
You
can
use
plexiglas
as
partitions.

I
want

make
sure
I'm
clear
that
plexiglas
is
not
a
requirement
at
any
of
these
bars,
but
should
you
choose
to
use
the
bar
as
additional
seating?
You
have
to
make
sure
that
they're
six
feet
between
the
customer
and
the
service
bar
area,
or
there
is
a
plexiglas
partition,
protecting
the
customer
in
the
bartender
from
each
other,
and
there
can
be
a
space
in
which
to
serve
the
food
underneath
the
plexiglas.

There
was
some
confusion
as
far
as
whether
plugged
glass
was
a
requirement
at
every
bar
and
what
it
meant
to
have
a
service
bar
and
or
service
at
a
bar.
So
you
can
have
service
at
a
bar
and
it
doesn't
have
to
be
from
the
restaurant
side.
But
you
do
need
to
delineate
a
service
area
of
the
bar
and
make
sure
that
the
patrons
are
socially
distant
or
have
plexiglass
to
separate
their
seating
areas
at
the
bar,
so
that
that
is
probably
more
confusing
than
it
needs
to
be.

But
that
is
how
we
understand
it,
and
we've
had
several
calls
this
week
into
departmental
calls
to
make
sure
we're
all
on
the
same
page
and
that
has
changed
in
the
last
week.
So
we're
making
sure
that
everyone
gets
the
same
message
from
the
city.

just
to
clarify,
when
the
chairwoman
talks
about
a
service
bar,
that
is
the
active
area
where
your
bartender
or
your
staff
are
making
mixed
drinks
or
cutting
fruit
or
where
they're
standing
when
they're
not
serving
the
patrons.
So
the
six
feet
does
not
include
if
the
bartender
is
walking
up
to
a
patron,
who
must
be
seated
to
take
their
order
and
then
walking
back
to
the
service
area
to
fulfill
that
order.

active
service
area
is
where
the
bartender
or
the
staff
would
be
for
extended
periods
of
time
and
again,
we
know
that's
very
confusing,
and
the
chairwoman
and
our
team
have
spent
a
lot
of
time
talking
with
our
inner
departmental
team,
as
well
as
the
state
to
make
sure
that
we
understand
what
is
allowed,
but
this
effectively
creates
additional
table
service
at
the
bar.
However,
it's
also
important
to
note
that
there
could
be
no
standing
at
the
bar.
No
one
can
walk
up
to
the
bar
for
bar
service;
it
has
to
be
used.

distance
from
a
gaming
area
to

dining
area.

limited
to

and

be

fees
in
2021

certain

have
that
data
off

our

the

premise
unit-

conduct
an
investigation
whenever

receive
a
complaint
and
the
vast
majority
of
licensees
have
been
complying
and
anyone
who
did
have
issues
has
been
extremely
cooperative
in
working
with
us
from
an
educational
perspective
to
rectify
any
concerns.

seeing,

you
guys

possibly

the
food
requirements,
we've
had
a
lot

pushback
on
it
and

different
people
doing
different
things.
So
I
just
kind
of
wanted
to
get
a
better
understanding
from
the
licensing
point
of
view.
What
exactly
is
going
on.

Sure
food
is
required
in
order
to
sit
at
a
table
and
have
drinks.
There
was
a
little
clarity
a
couple
of
weeks
ago,
maybe
last
month,
that
you
don't
necessarily
need
to
have
that
appetizer
brought
over.
At
the
same
time.
You
have
your
drink
brought
over.
The
sequence
of
service
doesn't
have
to
be
food
and
then
drink,
but
you
do
have
to
order
food
with
drinks
and
it
has
to
be
an
amount
of
food.

That's
sufficient
to
serve
that
table
and
there's
no,
that
we
don't
have
any
more
specific
guidelines
about
what
is
specific
for
a
person
who's
sitting
at
the
table
again
we're
trying
to
encourage
people
to
eat
and
drink
together
at
a
restaurant.
It's
not.
These
guidelines
are
not
intended
to
encourage
people
to
stay
for
four
or
five
hours
and
have
rounds
of
drinks
without
food
and
then
have
their
judgment
impaired
and
refuse
to
wear
their
masks
and
and
hassle
the
staff.

So
it's
up
to
you
as
an
operator
and
as
a
licensee,
to
figure
out
what
works
best
for
your
licensed
premise.
But
that's
where
these
public
health
guidelines
are
coming
from
they're
intended
to
allow
restaurants
to
open
and
operate,
not
necessarily
for
the
public
to
spend
four
or
five
hours
at
the
same
restaurant.

of
the
one
of
the
questions
that
we've
received
fairly
frequently
that
I
think
we've
just
gotten
a
little
more
clarity
on
from
the
state
are
restaurant
buyouts
for
special
events.
So
there
was
recently
a
change
in
the
requirement
that,
if
you're
closing
your
restaurant
for
a
special
event,
it
used
to
be
that
the
maximum
capacity
indoors
was
25,
including
staff.
It
is
now
25
for
the
patrons.

patrons
can
sit
or
stand,
but
they
can
only
sit
or
stand
in
groups
of
up
to
six
socially
distanced
by
six
feet.
So,
if
you're
closing
for
a
private
event,
it
does
change
what
you
can
and
can't
do.
But
one
of
the
most
important
things
to
remember
there
is
the
maximum
is
25
guests,
no
longer
25
guests,
including
staff.

just
a
question

regards
to
that

that
depend
on
the
size
of
the
the
restaurant,
or
is
that
just
the
case
all
around.

hours,

their
chances
of
exposure
to
droplets
and
aerosols
is

greater.

it's
still

out
in

restaurant,

private
dining
room
that

accommodate
those

people
and
still
have
the
rest
of
my
dining

space,
that
enclosed
space
for
those

people
that
could
socially
distance.
They
can
stand
up
with
a
cocktail.
