Description
The Licensing Board for the City of Boston holds licensed premise inspection hearings on Tuesdays, transactional hearings on Wednesdays and voting hearings on Thursdays weekly pursuant to Governor Charles Baker’s executive order (the “Order”) issued March 22, 2020, temporarily modifying certain requirements of the Open Meeting Law (M.G.L. ch. 30A s. 20) due to the ongoing public health crisis due to Covid-19 (coronavirus).
A
A
A
As
a
reminder,
today's
hearing
is
being
conducted
pursuant
to
temporary
amendments
to
the
open
meeting
law.
That
is
what
allows
us
to
meet
virtually
today's
hearing
is
being
recorded
and
will
be
posted
to
the
city
of
boston's
website.
The
items
on
the
agenda
will
be
called
in
the
order
in
which
they
are
posted.
C
Good
evening,
good
afternoon,
madam
chair
board,
members
andrew
upton
for
the
applicant
holly
crab
is
an
existing
restaurant
in
alston.
It
has
a
cv
and
a
liquor
license.
It
has
been
closed
for
several
months.
The
owner
wants
to
sell
it
to
his
cousin.
Mr
kenneth
kang,
mr
kang,
has
actually
been
running
the
restaurant
as
the
operations
manager
for
a
couple
of
years.
His
goal
is
to
reopen
it
as
soon
as
possible,
with
cv
only
no
liquor
and
it
will
be
exactly
the
same
same
floor
plan
same
hour,
same
concept,
same
food.
C
Every
aspect
will
be
the
same,
including
the
guy
who
actually
runs
the
day
to
day.
Mr
kang,
it
is
our
intention
when
some
tax
issues
with
a
liquor
license
are
cleared
up
to
come
back
to
the
board
and
ask
for
your
approval
to
transfer
the
liquor
license,
but
because
of
the
tax
considerations
right
now,
we
are
not
doing
that.
We
would
just
like
to
reopen
with
food.

E
Members
of
the
board-
it's
actually
my
name
is
attorney
michael
brangwin,
I'm
sorry.
I
have
the
wrong
name
on
the
zoom,
I'm
using
my
colleague's
computer,
but
I'm
here
on
behalf
of
the
applicant
cafe
victoria
I'm
here
with
gerald
riccio
who's,
the
manager
and
owner
of
the
cafe,
and
we
are
applying
to
transfer
stop
from
david
riccio
jerry's
brother,
a
49
stock
interest.
E
This
is
a
pretty
simple
corporate
stock
transfer.
Cafe
vitoria
is
an
italian
style
cafe
on
hanover
street,
offering
drinks
and
traditional
italian
fare
and
we're
seeking
approval
of
the
transfer
of
the
stock
from
david
to
jerry
and
jerry
has
at
all
times
been
responsible
for
the
operations
of
the
business.
E
David
has
not
really
been
involved
in
the
operations
for
over
a
decade
now,
and
this
is
just
formalizing
the
trend,
the
transfer
of
this
stock
interest
to
jerry,
but
in
terms
of
the
operations
at
the
at
the
cafe,
everything's,
going
to
continue
as
it
has
for
years
and
there'll,
be
no
change
in
the
day-to-day
operations
or
anything
like
that.
This
is
strictly
just
a
transfer
of
ownership
interest,
but
we're
happy
to
answer
any
questions.

Llc
attorney
joseph

F
F
F
There
was
a
obviously
a
secession
of
the
construction
for
a
number
of
months.
Due
to
the
pandemic.
They
started
back
up
again
this
summer.
They
anticipate
opening,
sometime
in
january,
they're
buying
a
license
from
bella,
luna,
restaurant
and
lanes.
They,
the
owner
operator,
is
retiring.
The
lease
was
not
being
renewed.
F
It's
190,
2
000
square
foot,
approximately
hotel,
there's
some
commercial
space,
there's
also
some
residential
space
in
the
entire
project.
In
the
building
itself,
that's
not
obviously
being
licensed.
They
are
going
to
be
a
dual
branded
hotel
in
the
business
class.
So
I
was
here
in
january
for
another
hotel,
not
too
far
from
this
location,
which
is
in
the
same
business
class
concept.
F
So
it's
filling
a
public
need
for
the
business
traveler
who's
going
to
the
convention
center,
but
it's
it's
a
lesser
price
point
than
what's
being
offered
there
now
in
the
area
or
or
in
the
downtown
area.
It
has
not
quite
as
many
amenities
either
there
is
meal
service,
but
it's
not
full
meal
service.
There
is
a
restaurant
space
here
that
I've
included
in
the
application,
but
there
is
nothing
there
right
now.
F
They
anticipate
putting
a
third
party
in
there
leslie
in
there
who
then
might
take
over
the
operations
for
the
food
and
beverage
at
least,
but
that's
probably
a
year
from
now
we
would
have
to
come
back
with
you
with
a
floor
plan,
etc.
F
F
It's
an
open
lobby,
so
you
know
to
the
left,
will
be
the
open
entryway
to
the
restaurant.
Then
a
little
bit
more
of
the
you
know
towards
12
o'clock
is,
is
one
of
the
open
hotel
desk
front
desk
and
then
on.
The
other
side
is
the
other
hotel's
front
desk,
but
really
when
you
walk
in
there,
it's
gonna
other
than
they
have
two
front
desks.
It's
hard
to
tell
that
it's
dual
branded.
F
The
with
me
is
charles
york,
who
is
one
of
the
executives
and
the
sort
of
man
area
manager
for
the
hilton.
This
is,
is
going
to
be
run.
The
two
locations
or
the
two
hotels
are
going
to
be
run
by
the
hilton
management
companies
responsible
for
those
brands.
These
two,
hampton
inn
and
homewood
suites,
are
hilton
concepts
and
also
decay.
A
christmas
is
the
proposed
manager
record
he's
a
mass
resident
he's.
F
A
u.s
citizen
he's
also
had
15
years,
at
least
of
progressive
responsibility
in
the
hotel
business,
culminating
with
being
the
general
manager
here.
He's
also
worked
in
boston,
so
he's
familiar
with
the
rules
and
regulations
of
the
city
of
boston,
the
commonwealth
of
massachusetts.
He's
worked
for
the
four
seasons
in
boston
and
also
the
fairmount
battery
wharf
hotels.
F
He's
also
worked
for
colwin,
which
has
operations
here
in
massachusetts,
and
hilton
hotels
obviously
has
operations
here
in
massachusetts,
we've
spoken
to
the
mayor's
office
and
neighborhood
services.
There
really
isn't
any
residents
in
that
area
to
to
speak.
To
I
mean
the
building
that
is
being
built
will
have
residents
in
it.
That's
sort
of
the
creep
that
that's
happening
there
towards
the
black
falcon
terminal
well
spoke
to
the
city
council's
office
and
hope
to
have
their
support
today
as
well,
and
we're
here
to
answer
any
questions
you
might
have.
B
F
Under
charles
york,
I
think,
muted
take
you
might
be
muted
right
now.
H
I
A
F
Yes,
the
palms,
the
the
chain
concept
went
into
bankruptcy.
It
was
purchased
out
of
bankruptcy
by
the
landry's
restaurant
group
out
of
texas.
They
are
the
owners
of
morton's
chart,
house,
ocean
air
mass
rose
and
a
couple
of
other
locations
that
operate
in
massachusetts.
F
The
the
managers
remaining
the
same.
The
operations
are
remaining
the
same.
The
premises
is
remaining
the
same:
they've
just
bought
it
out
of
bankruptcy.
The
officers
have
changed,
obviously,
but
they're
the
approved
officers
for
the
landry's
corporate
structure,
which
which
we
were
here
maybe
six
months
ago,
getting
up.
Maybe
maybe
now
it's
about
eight
to
nine
months
ago,
getting
all
of
those
approved
for
their
locations
in
massachusetts.
F
They
had
some
corporate
restructuring
there.
Ultimately,
though,
the
owner
of
the
there's
one
owner
it's
easy
to
trade.
This
is
not
a
confusing
one
with
the
beneficial
interest
disclosure
waiver
requests
or
anything
like
that.
It
goes
to
one
guy
tillman,
j
fertitta,
who
is
also
the
owner
of
houston
rockets.
You
might
have
heard
that
name
before,
but
he's
owned
all
of
those
restaurant
concepts
for
at
least
the
last
six
or
seven
years
in
massachusetts.
G
B
I
Sorry
leslie,
I
am,
I
do
want
to
speak
on
this
one.
Sorry,
I'm

would
like
to
go

will
take
this
better
under
advisement.

Okay,
I
don't

Commissioners,
do
you.
A
G
Good
afternoon,
members
of
the
board,
madam
chairwoman,
we
were
before
you
recently
just
a
couple
months
ago
regarding
the
change
of
stock
ownership
and
change
of
directors.
During
that
hearing,
we
had
not
submitted
a
change
of
manager.
By
way
of
background.
Mr
henry
wong
acquired
the
business
in
2014
in
2017.
G
New
partners
came
in
and
recently
this
year
they
exited
and
on
october
19th.
Your
office
had
notified
us
that
the
abcc
approved
the
change
of
officers
and
change
of
stockholders.
So
this
is
strictly
a
well
from
our
end,
a
formality
to
change
the
name
of
the
manager
on
the
liquor
license.
That's
the
sole
issue
before
the
board.
Today,
the
business
is
not
in
operation.
There
will
be
no
operational
change.
B
Okay,
thank
you
attorney
lou,
mr
wong.
I
think.
G
Henry,
if
you
can
hear
us,
oh
there
you
go
there.
B
We
go
mr
wong,
I'm
going
to
ask
you
the
four
questions
that
we
ask
anyone
who's
becoming
who's,
applying
to
become
manager
of
record.
Are
you
a.
B
I
do
see
that
he's
here
if
he's
having
problems
with
his
sound
attorney,
lou
leslie.
If
this
is
part
of
the
presentation,
could
the
attorney
present
schools,
four
facts
for
us?
Yes,
attorney.
A
If
you
have
the
knowledge
the
the
chair
can
ask
you
the
questions
and
you
can
respond
on
behalf
of
your
clients.
G
Thank
you.
I
will
let
the
board
know
if
I'm
unable
to
answer,
but
I
will
yeah.

is
indebted
to
jds

which
is
a

That
indebtedness
arises
from
the
assignment
of
certain
loan
obligations
of
my
client
to
middlesex

bank,
which
were
assigned
to

K
Those
are
evidenced
by

is
further
evidenced
in
the

dated

this
is
a

a

we
are
