a
report

sergeant
schroeder
on
august
15
2021
at
1
am
sergeant.
Schroeder
observed
an
unknown
female
being
loaded
into
an
ambulance
in
front
of
96.
Brookline
out
of
fenway
johnny's
bar
sergeant
pulled
over
observed
being
speaks
that
the
victim
to
be
extremely
intoxicated
and
semi-conscious.

She
was
the
victim
was
with
three
other
females
who
were
crying
and
telling
emts
that
she
was
19
years
old
and
had
been
drinking
the
fenway
johnnies.
At
that
time,
the
sergeant
walked
across
the
street
and
observed
a
large
crowd
outside
many
appeared
to
be
intoxicated
and
attempting
to
get
inside.
The
premises
sergeant
approached
the
manager,
hugo
trindal
and
informed
him
that
the
bar
was
closed
due
to
the
fact
they
have
underage
drinking
and
over-serving
issues
that
time
the
lights
were
turned
on,
the
music
was
turned
off.

officers
responded
and
assisted
clearing
out
the
bars
patrons
were
leaving.
Many
were
observed
to
be
intoxicated
and
were
attempting
to
leave.
The
bar
with
drinks
about
premises
was
issued.
A
code
35
for
over
serving
and
patrons
and
underage
patrons
copy
was
given
to
the
manager
in
hand.
Sergeant
was
formed
that
the
establishment
needs
to
have
a
better
system
for
checking
ids
and
that
they
were
when
the
bar
was
in
the
process
of
buying
those
dutch
application.

occurred
at

On
august
15
2021,
when
sergeant
schroeder
arrived
at
the
bar,
and
she
observed
an
unknown
female
being
loaded
into
an
ambulance
at
that
point
in
time
I
do
not
have
the
manager
of
the
bar
here
with
us.
He
had
a
family
matter
and
is
out
of
town.
I
have
interviewed
him
prior
to
this
hearing
and
hoped
to
have
had
his
testimony,
and
that
is
igor
trindadi.

commissioner
since

that
mr
trindadi
told
me
that
at
approximately
11
o'clock
a
young
woman
had
left
the
bar
and
she
was
outside,
and
I
asked
him
why.
Why
did
he
recognize
her
at
11
o'clock
and
he
said
she
had
distinctive
clothe
clothing
on
she
had
a
leopard
patterned
skirt.

She
left
the
bar
at
approximately
11
o'clock
and
was
not
readmitted
to
the
bar.
She
was
refused
re-entry
to
the
bar
at
approximately
one
o'clock
in
the
morning.
The
incident
occurred
where
this
I'm
representing
to
the
commissioners.
This
same
female
was
loaded
into
an
ambulance
and
she,
her
friends,
apparently
represented
that
they
had
been
drinking
in
fenway
johnny's.

exited

bar
at
approximately

p.m.

hours
earlier
now
I
do

just
texted
my
client
to
see

present
on
the
night
as
well.
He
is
the
licensee
and
the
owner,

lining

alcohol

their
possession
and

taken
additional
security
measures

search
patrons
before
they
come
in.

saturday
september
4,
2021
officers,
cody

burke,
and
the
fox
201
alpha
responded
to
a
radio
call
for
a
fight
at
332,
west
broadway
street
south
south
boston,
following
units
also
responded
to
assist
fox
923
sergeant
harrison
fox
k-1,
fulham
and
burke,
and
the
fox
421
obstacle
upon
arrival
officer,
pointed
in
the
direction
of
the
suspect,
william
callahan
by
multiple
staff.
Members
and
witnesses
on
scene
at
the
above
address
officer
spoke
with
callahan,
who
was
extremely
uncooperative
and
intoxicated.

Callahan
stated
multiple
times
that
he
was
not
in
a
fight
and
he
wanted
to
go
home.
Office
observed
callahan
to
have
a
laceration
on
his
left
index
finger
as
well
as
bruising
and
swelling
around
the
left
side
of
his
face.
Callahan
denied
ems
multiple
times
officers
then
spoke
to
the
victim,
christiana
coleman,
who
stated
she
was
outside
the
box,
smoking
a
cigarette
and
was
attacked
for
no
reason
by
callahan
coleman
stated
that
calhoun
grabbed
her
by
the
hair
dragged
her
to
the
ground
and
punched
her
in
the
head.

Attacker
shenanigans
staff
members
were
able
to
break
up
the
fight
prior
to
officer's
arrival
coleman,
also
denied
any
need
for
further
medical
attention.
Officers
were
able
to
speak
with
a
witness
on
scene,
ellen
mcgrew
bingham,
who
stated
that
she
saw
the
entire
thing.
Mcgregor
ban
stated
that
coleman
was
minding
her
own
business
and
out
of
nowhere,
callahan
attacked.
Her
officers
also
spoke
with
the
manager
of
shenanigans,
justin
valkport,
who
stated
the
exact
same
story.
Officers
advised
both
victim
and
suspect.
Reportedly
written
documented,
the
incident
and
all
parties
were
released
from
the
scene
code.

the

was

the

The
staff
of
the
establishment
cooperated
with
the
inspection.
However,
the
boston
police
were
not
notified
of
the
assault
by
the
staff
of
the
establishment
prior
to
the
licensed
premise
inspection.

incident

this
type.

no
dispute
that,
unfortunately,
there
was
a
stabbing
that
occurred
in
the
bathroom,
but
this
was
the
first
time
anything
like
this
had
ever
happened
at
makuma
latina.

Mr
lopes
and
mr
mr
fernandez
have
been
operating
makuma
latina
for
over
15
around
over
15
years
and
they've
actually
been
in
the
bar
restaurant
business
since
1999..
This
is
the
first
such
intent
of
this
type
that
they've
ever
ever
ever
ever
experienced.

it
doesn't
mean
that
mokume
doesn't
take
precautions
to
make
sure
that
they
provide
their
their
patience
with
it
with
a
safe
environment.

they
do
at
that
night
in
question.
They
had
in
fact

security.
There
they

one
security
outside

bathroom,

I
indicated,

where
the

stabbing
unfortunately
took
place,
and
there
are
two
other
security
nearby

bathrooms,
the,
as
I
had
indicated,

that

fernandez

lopes
were
present
that
night.

what
do
they
do
in
terms
of
having
patrons
enter
makumba
latina?

There
are
two
security,
a
female
and
a
male,
and
they
are
in
terms
of
males
they
are
patted
down,
and
that
goes
right
to
their
very
shoes
and
boots
that
they
are
wearing
the
gentleman
who
does
that
torrance
has
been
with
makuma
latina
for
ten
years
and
he's
well
experienced
in
this
in
in
doing
the
searches
that
are
necessary
and,
unfortunately,
over
the
years
they
have
found
knives
and
what
they
do,
then
is
they
confiscate
the
knife
or
if
the
patron
is
unwilling
to
give
up
their
neck,
they
will
ask
them
to
leave
and
they
and
they
escort
them
out
the
door.

there
have
been,

have
been

Have
not,

I
said,
been
any
knife
stabbings
at
macomb
latina
over
that
period
of
15
years.
Why?
Because
they
take
these
precautions,
since
this
incident
they've
taken

added

additional
precautions,
which

fernandez
can
testify

they
were

was
located
in
the
office
above
the
floor.

the
second
floor
and
at
the
time
of
this
incident,
mr
lopes
was
located
on
the
floor
near
the
bar.

bathroom

located

towards
the
rear
of
the
building.

night

this
accident

This
happened
on
sunday
monday
morning
tomorrow
morning
about

patrons
that
night
it

starting.

upstairs
using
the

restroom
and
when
you
upstairs,
you
got
a
different
door.
Come
to
our
side.
When
I
came
down,
I
saw
I
was
for
my
security.

they
said
that

pulled
up

phone,
but
I
didn't.

them

police,

said
no,

told

that

hand
was
in
the

walked
to
the
front.

was
walking
toward
the
front

see
what

going
on.

have
my
phone
in

sergeant,
mcdougall,
detective,
sione
and
officer.
Bryant
also
responded
to
the
scene.

Upon
arrival,
officers
observed
macumba
security
guards
tending
to
a
male
victim
later
identified
as
luis
edgar
edgardo,
a
bayou
ruiz
who
was
semi-conscious
laying
down
in
the
middle
of
river
street,
the
victim
was
bleeding
from
a
four
inch
laceration
to
the
forehead
officer.
Montero
rendered
aid
to
the
victim
by
applying
pressure
to
an
open
wound
to
the
victim's
forehead.

While
officer
mahoney
gathered
information
on
the
incident
and
suspect
a
witness
known
to
the
commonwealth
informed
officers
that
an
unknown
suspect
struck
the
victim
in
the
head
with
a
baseball
bat
and
then
got
into
mass
reg
two.

a
2021
toyota
venza
red
in
color,
the
suspect,
got
into
the
driver's
seat
of
the
vehicle
and
the
vehicle
fled
down
river
street
towards
adams.

suspect
was
also
with
another,
unidentified

stated
that
he
had
been
at
macomb
earlier
in
the
night
with
three
friends,
antonio
velazquez
miguel,
herrera
and
raphael.
Mr
baez
stated
that
he
had
left
his
friends
at
a
table
and
gone
to
the
bathroom
alone,
where
he
was
assaulted
by
four
hispanic
males.

to
assault
the
victim

of

fact

patrons

the

one
person
at

was
in
a
cruiser
outside
the
store.

they

acknowledge
this
is
outside
of

bounds

did
respond

immediately

correct

patron
and

that

back
onto

premises
at
this

running
apparel
brand
and
boston
marathon.
Weekend
is
always
a
very
special
weekend
for
the
city,
but
also
for
us.
Our
store
on
newbury
street
is
a
hub
for
runners
that
weekend
and
also
their
families
and
friends.
This
year
we
were
having
a
private
party
on
our
premises.

I
was
inside
when
the
officers
arrived
and
was
asked
to
come
to
the
door
once
I
realized
why
the
officers
were
there,
I
did
look
outside
and
there
were
a
number
of
guests
on
our
front
steps
and
on
our
garden
level,
patios
enjoying
the
beer
which
are
on
private
property,
and
there
was
one
individual
in
the
street
with
a
beer
in
his
hand,
and
this
stood
out
to
me
because
I
actually
knew
the
patron
he's
one
of
boston's,
prominent
cancer
doctors,
and
he
was
actually
speaking
to
a
boston
police
officer
who
had
parked
his
car
outside
our
store
on
newbury
street,
which
was
closed
to
traffic
on
on
boston
marathon
monday.

They
were
sharing
a
laugh
at
the
moment,
so
I
assumed
that
they
knew
each
other,
but
it
was
also
clear
that
that
officer
was
was
not
there
with
the
other
two
who
were
at
the
door
who
I
was
engaged
with
other
than
that
individual.
I
didn't
see
anyone
at
that
time
with
alcohol
who
were
off
our
premises.
We
did
have
someone
stationed
at
the
door
checking
people
in
and
also
reminding
them
that
they
cannot
leave
the
premises
with
alcohol.
If
you
recall
boston
marathon
weekend,
it
was
beautiful
weather.

We
were
also
still
in
the
midst
of
of
the
pandemic
and,
as
I
mentioned,
our
space
is
a
common
meeting
place
for
runners
and
their
friends
and
family
after
the
race,
because
it's
hard
to
meet
at
the
finish
line.
So
it
is
certainly
possible
that,
as
the
officers
were
approaching
the
store,
a
runner,
you
know
holding
a
beer,
perhaps
a
family
member.

these

becoming
more
frequent.
There
are
quests
for
apparel
places
and
such
along
newbury
street
applying
for
one
days
and
it's
a
great
concern
to
the
board
as

number

requests

especially
on
big
weekends.
Again,
these
are
weekends
that
put
a
strain
on
resources
for
boston
police.
We
really
really
need
the
applicants
to
abide
by
the
rules
and
regulations
of
this
board.

is
there's
no
exception
to
that.

is
a
real

Alcohol
leaving
the
area
that

supposed
to
be
consumed

not

familiar
with
the
rules
and
regulations
of
the
board,
letting
someone
slip
by
regardless
if
it's
a
prominent
doctor
having
a
casual
conversation
with
a
cop
on
the
street.

these
requests

other
places

take

close
look

did
they

well-respected
store,

they've

permits

existence
in
2017.,
they've
never
had
any
issue.
Prior
to
this,
there
wasn't
any
issue
of
any
unruly
or
out
of
control
party
in
the
neighborhood,
with
this
one
day
license
situation
that
has
otherwise
caused
an
issue
in
the
surrounding
neighborhood
there's
no
report
of
public
intoxication
noise
disturbance,
or
particularly
egregious
behavior.

were
under
capacity.
Unfortunately,
this
was
an
instance
which
they
did
admit
to
of
a
patron
walking
to
talk
to
somebody
on
the
curb,
with
a
drink
in
their
hand,
which
was
immediately
addressed
for
any
future
marathon
events,
which
they
would
respectfully
request
the
board
take
before
going
into
the
consideration
and
and
that
they
have
been
up
until
this
point
in
exemplary
licensee
one
day.

Licensee
with
that
being
said,
they
still
hope
to
hold
these
events,
which
are
intermittent
of
the
year
and
will
absolutely
increase
staff
at
the
door
and
on
private
property.
If
they're
allowed
to
do
so
outside
on
the
private
property
as
well
as
place,
conspicuous
signage,
that
no
alcohol
is
allowed
beyond
a
particular
point,
obviously
in
the
public
way
they
they
acknowledge
and
admit
that
that
was
a
misstep
with
this
particular
type
of
license.

that

come

purview
and
we
look
at
these
very
carefully.
We
have
sometimes
we
have
to
pick
and
choose
which
special
events
move
forward
in
the
city.
Obviously
they
get
police
approval.
This
particular
one-day
license

approved,

tolerance
policy
for
this
due
to
the
fact
that
we're
asking
more
and
more
of
our
police
department,
as
these
events
come
back
online.
