few

comments

light

the
vast
amount
of
testimony
we
received
at
the
hearing
in
november
and
the
follow-up
in
writing.
Since
then.
I
want
to
outline
where
I
am
coming
from
on
this.
When
this
board
is
approving
the
granting
or
transfer
of
a
liquor
license,
it's
we
are
charged
charged
with
determining
the
public
need
of
a
particular
license
at
a
particular
location.

The
appeals
court
held
in
ballerin
that
the
need,
in
the
literal
sense
of
the
requirement,
is
not
what
the
statute
is
about.
Rather,
the
test
includes
an
assessment
of
public
want
and
the
appropriateness
of
a
license
at
a
particular
location.
It's
our
duty
as
a
licensing
board,
to
look
at
these
ballerin
factors
in
making
our
decision.

The
opinions
of
the
neighborhood,
the
traffic
impacts
of
this
additional
license,
the
overall
reputation
of
the
applicant
in
more
broadly
public
convenience
and
public
good,
the
number
of
existing
section
15
licenses
in
this
one
mile
area.
There
are
a
number
of
section
15
licenses
in
this
one
mile
area,
but
I
would
add,
the
very
business
model
of
total
wine
is
distinct
and
completely
different.

Existing
licensees
are
smaller
and
have
a
different
selection.
In
most
cases,
only
about
half
of
them
offer
on-site
parking.
None
to
my
knowledge
offer
space
for
community
events,
some
offer
tastings
some
offer
online
ordering
and
delivery.
Some
are
destinations
for
groceries
and
scratch
tickets.
Some
are
cash.
Only
south
bay
centre
is
in
the
middle
of
being
revitalized
and
redeveloped
with
residential
office
medical
office
in
retail
space.
I
believe
this
redevelopment
is
another
reason.
An
additional
section,
15
license
can
be
supported
here.

Total
wine
has
no
plans
to
offer
groceries
and
no
plans
to
offer
scratch
tickets.
The
opinions
of
the
neighborhood
are
very
important.
We
have
support
and
we
have
opposition.
We
have
thousands
of
signatures
in
opposition.
We
have
thousands
of
signatures
and
support.
I
do
not
discount
any
of
those
signatures,
but
I
have
to
ask
how
these
signatures
were
obtained.

On
the
other
side,
signatures
were
collected
in
south
bay
center
at
home
depot
from
people
who
are
already
patronizing
south
bay.
For
other
reasons,
I
share
this
as
a
fact
it's
something
I
experienced
there
was
support
from
the
andrew
squared
civic
association.
They
voted
to
support
total
wine's
proposal
and
I'd
like
to
note
their
comments.

They
pointed
out
that
they
don't
generally
support
liquor
stores
and
the
two
liquor
stores
in
their
neighborhood
are
in
deplorable
condition
and
target
the
homeless
population
by
selling
nips
and
selling
small
bottles,
and
both
stores
have
refused
to
stop
selling
them
further.
They
went
on
to
say
that
south
bay
center
has
better
security.

I
would
like
to
point
out
in
their
opposition
letter
two
things
they
specifically
point
out
are
competition
with
existing
licensees
in
the
area
in
a
purported
verbal
agreement
that
was
made
years
ago,
but
the
landlord
would
never
allow
a
liquor
store
in
south
bay
center.
To
the
first
point,
it
is
an
established
fact
that
competition
cannot
be
a
factor
that
this
board
can
look
into
in
establishing
public
need
as
to
the
verbal
agreement.
That
is
something
that
came
up
a
lot
by
the
opposition.

The
applicant
has
done
considerable
outreach
to
the
community
and
elected
officials
from
city
councillors
to
state
reps
to
neighborhood
groups,
including
the
dudley
street
neighborhood
initiative.
It's
clear,
they've
listened
and
they've
learned,
and
they
have
showed
a
commitment
to
addressing
the
important
concerns,
especially
the
various
societal
issues
impacting
our
community
and,
in
particular,
the
area
surrounding
south
bay
traffic
impacts
of
this
additional
license.
I
see
none
the
overall
reputation
of
the
applicant
first,
the
llc
that
owns
and
operates.

Another
thing
that
makes
this
applicant
different
from
other
stores
in
the
area
is
their
focus
on
knowledge,
their
focused
on
knowledge
and
education
about
wine
and
liquor.
The
applicant
has
committed
to
hiring
on-site
experts
and
they
have
a
classroom
space
where
they
intend
to
hold
classes
to
educate
customers
on
wine,
beer
and
liquor.

I
would
broadly
describe
those
concerns
as
falling
into
the
bucket
of
safety
and
security
and
having
to
do
with
the
issues
of
mass
and
casts.
While
these
are
legitimate
concerns.
I
do
not
believe
the
addition
of
total
wine
will
exacerbate
the
issues
at
south
bay.
The
safety
and
security
plan
provided
by
total
lines
and
a
letter
from
edens
describing
how
totalwine's
additional
security
will
be.
A
bonus
in
the
area
may
actually
help
mitigate
potential
issues
and
discourage
vagrancy.

Anecdotally,
the
south
bay
center
is
an
area
that
has
demonstrated
public
need
for
an
alcohol
license
in
the
past
in
2017,
the
legislature
granted
15
additional
on-premise
licenses
for
south
bay
development
that
would
not
pull
from
our
own
quota,
anticipating
the
need
in
the
area.
The
state
and
city
have
agreed
that
there
is
a
need
in
this.

the

but
the
response
was
persuasive.

store
is
the
size
of
the
store

the
security

the

hampton
street
area.

know
we
all
call
it
mass
and
cats,
but
I
did
have
a
lot
of
reservations
because
it's
really
southampton
street
and
stretching
back
towards
south
bay.

successes
