From YouTube: City of Boston Licensing Board 2-24-21
Description
The Licensing Board for the City of Boston holds licensed premise inspection hearings on Tuesdays, transactional hearings on Wednesdays and voting hearings on Thursdays weekly pursuant to Governor Charles Baker’s executive order (the “Order”) issued March 22, 2020, temporarily modifying certain requirements of the Open Meeting Law (M.G.L. ch. 30A s. 20) due to the ongoing public health crisis due to Covid-19 (coronavirus).
A
A
Good
afternoon,
this
is
a
hearing
before
the
licensing
board
for
the
city
of
boston.
Today
is
wednesday
february
24th
2021..
Today's
hearing
is
being
conducted
pursuant
to
certain
temporary
amendments
to
the
open
meeting
law.
That
is
what
allows
us
to
meet.
Virtually
today's
hearing
will
be
reported
and
will
be
posted
to
the
single
boston's
website.
Before
we
begin,
I
will
introduce
chairwoman
kathleen
joyce.
A
A
You
will
then
be
be
allowed
to
give
a
brief
presentation,
after
which
the
chairwoman
and
commissioners
will
ask,
after
which
we
will
take
public
testimony.
Public
testimony
will
begin
with
elected
officials
and
their
representatives
and
then
move
to
the
general
public.
Please
ensure
that
your
audio
is
working
so
that
you
can
present
one
called
calling

business

located
at

A
B
Okay
and
a
little
bit
more
information,
how
many
see
how
many
seats
will
there
be
20
seats,
20
seats
and
we
be
open
seven
days
a
week.
B
Okay,
is
there
anything
else,
you'd
like
to
add
about
your
application
or
what
you're
proposing
at
the
site.
B
Okay,
commissioner,
saxon
or
commissioner
carr
do
you
have
any
questions.
A
I
Hi
yes,
good
afternoon,
madam
chair
and
members
of
the
board,
my
name
is
kim
crucioli
from
the
mayor's
office
of
neighborhood
services.
The
applicant
has
support
from
abutters,
as
well
as
no
opposition
from
worcester
square
area,
neighborhood
association,
but
the
mayor's
office
would
like
to
go
on
record
and
ask
that
the
board
holds
on
making
a
decision
until
an
official
abutters
meeting
is
held,
which
will
be
on
march
9th
2021..
Thank
you.
A
Thank
you.
Are
there
any
other
individuals
who
wish
to
testify
regarding
this
application
on
the
board,
we'll
take
this
under
advisement
and
we'll
work
with
the
mayor's
office
of
neighborhood
services
for
an
update
following
the
abutters
meeting?
Thank
you

Yes,
good
good
afternoon,
my

is
mae.
Hua

I
am
on
behalf
I'm
here
on
behalf
of
yongshen
inc,
doing
business.
At
shaking

restaurant
we
are
proposing
a
a
sifu
like
a
seafood
restaurant
to
be
operated
on
1616
dorchester
avenue
in
dorchester.
B
Okay,
thank
you.
Could
you
go
into
a
little
bit
more
detail
about
what
the
seating
capacity
will
be
and
do
you
have
any
idea?
You
know
how
much
takeout
business
you
think
you'll
be
doing
compared
to
what
you'll
be
doing
inside
as
far
as
sit
down.
J
B
And
what
is
that?
What
is
the
proviso.
J
It
is
it's
a
procedure
that
you
have
to
remove
the
grant
of
the
licensor,
so
we
have
to
apply
for
sony
board
appeal
to
allow
us
to
transfer
that
operator
to
our
name.
K
B
All
right
and
you're
not
planning
on
serving
alcohol.
J
No
there's
no
liquor
license.
J
That's
our
max.
I
think
the
dining
portion
of
the
business
can
be
expected
to
be
over
60
percent.
Okay,.
E
Madam
chair
members
of
the
board,
patrick
vandal,
mayor's
office
neighborhood
services,
we'd
like
to
go
on
record
in
support
of
this
application.
The
applicant
has
worked
closely
with
the
greater
ashland
main
streets
organization,
which
facilitates
conversation
around
this
commercial
district,
so
we'd
like
to
go
and
market
in
support
of
this.
A
M
Attorney
upton
is
present,
but
this
is
being
handled
by
flaherty
and
o'hara
from
pittsburgh.
I
think
steve
everett
is
on
the
line.
A
Who
is
president
for
trader
joe's.
M
A
M
M
So
he's
in
so
philip
is
a
mass
resident,
a
u.s
citizen
he's
familiar
with
the
rules
and
regulations
of
the
board
and
the
commonwealth,
and
he
has
considerable
experience
in
the
hotel,
f
b
industry
and
he's
worked
at
the
nine
zero
hotel
for
the
past
couple
of
years.
So
he's
well
qualified
for
this
position
and
there
will
be
no
other
changes
to
the
license
premises.
B
A
You
calling
llc

Street
holder
of
a
common
bitter

petitioned
for
a
change
in

Llc
manager,
lastly,
is
petitioned
to
change
the
manager
of
the
licensed
business
from
william
monegal
to
robert
heberek
attorney,
matthew,
fogelman.
O
This
is
caroline
o'connell,
I'm
representing
pt
opco,
I'm
clearly
not
matthew
fogelman,
who
was
previous
council,
so
I'm
not
quite
sure
why
he
ended
up
on
this
application.
We're
here
before
you
for
two
changes:
we're
adding
some
officers
to
pt
opco.
We
are
adding
edward
algio
and
randall
sharp.
O
They
are
both
have
been
part
of
the
executive
team
have
been
added
and
we
are
adding
james
zenni,
who
was
became
an
officer
sometime
between
the
boston
licensing,
initial
hearing
and
the
abcc
final
approval,
so
he
is
approved
by
the
abccc,
but
somehow
didn't
end
up
on
the
license
with
boston
licensing
board.
So
we're
correcting
that
omission
at
this
time.
In
addition,
we're
changing
the
manager
to
robert
habereck
robert
is
has
seven
years
of

license,
has
petitioned
to
change
the
license
category
from
retail
package
store
malt
and
wine
to
retail
package
store.
All
alcoholic
beverages
is
the
applicant
present.
N
N
Yes,
due
to
all
of
the
residential
changes
to
the
vfw
parkway
surrounding
our
business,
we
have
gotten
a
lot
of
requests
to
expand
our
offering
to
full
liquor
in
west
roxbury.
N
At
this
point,
you
have
to
actually
go
into
the
center
of
town
and
keeping
people
on
the
parkway
is
is
a
good
thing
for
traffic
and
and
congestion
and
people
are
asking
us
to
to
see.
If
we
can
make
this
change,
and
we
thought
it
was
a
good
time
to
do
it.
B
Okay,
could
you
tell
me
in
the
board,
with
the
closest
all
alcohol
package,
doors
to
your
location,.
B
B
Are
you
located
in
what
other
is
this
in
a
shopping
plaza.
N
No,
no
we're
a
single
standing
location
on
the
vfw
parkway,
which
is
next
to
home
depot.
Okay,
yep.
A
P
Good
afternoon,
madam
chair
members
of
the
board
jack
duggan
mayor's
office
neighborhood
services
just
like
to
go
on
rec
for
support.
The
applicant
went
before
the
west
roche
neighborhood
council
last
night,
received
their
full
support,
there's
also
a
petition
and
support
that
has
30
signatures
on
it.
I
do
want
to
note
that
one
of
the
council
members
last
night
had
some
concerns
about
mips
and
singles,
so
I
just
wanted
to
highlight
that
for
the
board.
Thank
you.
C
Good
afternoon
madam
chair
members
of
the
board
peter
favreto
from
city
councilor,
matt
o'malley's
office,
the
counselor
would
like
to
go
on
record
and
support
as
well.
Q
Hi,
my
name
is
jessica
graf,
I'm
here
on
behalf
of
larry
dekara's
office.
As
some
of
you
might
know,
larry
was
injured
in
a
hit
and
run
he's
recovering
well
and
sends
his
regard,
but
I
am
handling
his
matter
while
he
recuperates.
Q
I
would
just
know
for
the
board
that,
as
mr
duggan
mentioned,
the
west
roxbury
community
did
approve
our
our
application
last
night
and
has
their
support.
They
did
raise
an
issue
regarding
nips
in
the
area.
Mr
mourinho
does
not
sell
those
currently.
So
whatever
the
issue
is
is
a
result
of
somebody
else's
issue,
but
my
client
mentioned
on
that
call,
and
I
would
just
like
to
reiterate
that
he
will
be
very
careful
in
terms
of
trash
and
things
in
those
areas
he
has
been
since
he's
had
the
store
at
that
area.
Q
He's
also
had
the
license
since
2002,
without
incidents
before
the
licensing
board.
He
has
no,
he
has
no
issue
and
we're
just
looking
for
a
simple
change
of
amendment,
especially
during
covid
where
businesses,
smaller
businesses
are
struggling,
we're
looking
to
expand
from
the
barren
wine
that
we've
had
since
2002
to
a
alcoholic
beverages
license,
and
it's
just
an
amendment
change.
B
Okay,
thank
you,
jessica,
and
please
give
my
regards
to
larry.
I
certainly
will
thank
you,
mr
mourinho.
Yes,
you
you
don't
currently
sell,
nips
or
singles
no.
B
Would
you
support
adding
that
to
a
as
a
commission
to
your
license.
Q
I
think
that's
highly
restrictive
and
an
economic
burden
to
place
on
this
client
where
there's
an
existing
issue
and
I'm
sorry
to
interpret
well
where
there's
an
existing
issue
in
the
in
the
neighborhood
of
which
mr
mourinho
has
no
involvement
in.
He
does
not
currently
sell
those.
I
think
that's
an
economic
hardship
on
him.
A
Could
we,
mr
duggan,
from
the
mayor's
office
of
neighborhood
services,
could
you
provide
a
little
more
background
about
what
the
conversation
was
with
the
community.
P
Yeah,
what
so
one
of
the
council
members
last
night
just
mentioned
that
when
you
do
sell
nips
that
you
know
a
lot
of
trash
can
come
with
it
just
in
the
area,
people
just
drinking
them
and
discarding
them.
So
he
he
brought
up
those
concerns.
Obviously
you
know
paul
was
on
the
call,
as
was
jessica,
they
mentioned
that
they
haven't
had
that
issue,
but
I
just
wanted
to
highlight
it
for
you
guys,
since
you
weren't
on
the
call
last
night
that
you
know
if
they
were
to
have
it.
Q
And
I
will
just
add
and
thank
you
jack.
I
will
just
add
to
what
jack
said
that
miss
mourinho
said
on
the
call
and
I'm
sure
we'll
really
reiterate
here
for
the
board.
But
as
his
representative
I
will
say
he
said,
he's
always
been
mindful
of
the
trash
in
the
area
and
we'll,
and
he
told
the
board
last
night
or
the
committee
last
night
that
he
will
continue
to
do
so
going
forward,
which
thereafter
they
voted
in
favor
of
our
application
and
going
forward.
As
mr
duggan
reported
back
to
the
board
just
now,.
B
Okay
jack,
so
the
community
didn't
ask
that
he
had
that
as
a
condition
on
his
license.
A
R
B
Okay,
I
don't
have
any
questions,
commissioner.
Sacks
no
commissioner,
current.

We're
just

just

one

we'll
move
forward
with
the
agenda.
Is
there
anyone
here
who
wishes

regarding
this

beginning
with

Restaurant

at

the

There
have
been
restaurants
at
that
location
for
well
over
a
hundred
years,
believe
it
or
not
since
1905,
although
in
all
that
time
there
are
only
been
four
restaurants,
so
it's
been
a
very
stable
location.
X
This,
hopefully,
will
be
the

recently
it

the

As

of
nestles

the

of
what
was
la
la
rock
will
be
unchanged,
but
the
concept
and
the
menu
and
execution
will
be
quite
different.
X
It
will
be
the
the
interior
will
be
decorated
in
classic
antiques,
some
wood,
paneling,
upholstered,
seating
and
decor
with
modern
flares,
so
creating
the
ambiance
of
a
private
club
up
on
beacon
hill
menu
will
offer
classic
american
seasonal
fare,
like
steaks
seafood,
pasta,
all
the
side,
dishes
and
desserts
that
you
might
you
know,
expect
also
classic
cocktails
beer
and
wine
list.
X
X
She
is
a
mass
resident.
A
massachusetts
resident
u.s
citizen
has
become
tips
trained
and
and
has
become
familiar
with,
the
rules
and
regulations
of
the
boston
licensing
board.
She
has
been
the
president
and
owner
of
leonard's
antiques
for
almost
25
years.
X
Owning
a
restaurant
and
operating
a
restaurant
has
been
a
dream,
a
lifelong
thought
of
hers.
So
she
wants
to
bring
her
general
skills
as
a
businesswoman
and
personal
resources
to
this
planned
enterprise.
X
She
intends
to
be
on-site,
full-time
hands-on
manager
and
I
have
no
doubt
will
become
the
face
of
the
restaurant,
but
I
I
would
also
say
she
intends
to
staff
up
after
you
know.
Hopefully,
approval
of
this
application
she's
going
to
hire
and
rely
on
an
experienced
restaurant
general
manager,
as
well
as
chef
and
kitchen
and
support
staff.
X
She
also
will
continue
to
have
the
assistance
of
her
life
partner,
who
is
aaron,
sells
an
experienced
restaurateur
who
has
been
serving
and
and
will
continue
to
be,
a
sounding
board
and
source
of
management
and
operational
assistance
while
kristen
obtains
you
know
the
the
direct
hands-on
restaurant
experience.
X
Kristin
appeared
before
the
beacon
hill,
civic
association,
zoning
and
licensing
committee
in
december.
They
just
recently
signed
off
in
a
letter
of
non-opposition.
X
X
Lastly,
I
want
to
note
that
the
application
includes
an
approval
for
a
pledge
of
the
license
to
the
current
licensee,
which
is
b-fam
inc.
They
were
the
operator
of
la
la
roche.
They
have
diligently
searched
for
transferee
this
since
they
closed
one
transfer
got
far
along
but
did
not
materialize
and
then,
of
course,
covet
has
stepped
in
and
further
delayed
it,
but
throughout
bfam
looked
for
an
experienced
right
person
with
the
right
concept.
X
They
feel
confident
in
in
1928
are
a
good
fit
for
this
location
and
and
they've
essentially
agreed
to
sell
or
finance
the
license.
So
they're
going
to
take
back
a
note
and
of
course
the
closing
would
occur
after
full
approval,
so
there's
no
cash
consideration
up
front
for
the
license
there.
There
there
is
some
for
the
remainder
of
the
premises
and
equipment
so
subject
to
any
questions
from
the
board.

has
been

the

a

many

It's
even
where
the

both

her

the
whole
beacon

has
been

we're
elated
to
hear
that
a

Good

I'm

It
is
our
understanding
from
my
client
that
we
are
actually
agreeing
to
defer
the
license
request.
There's
been
an
additional
request
to
have
in
further
meetings
with
the
community,
and
my
client
has
already
begun
majority
of
those
meetings,
but
we
are
in
agreement
or
there's.
We
understand
there
should
be
a
request
for
a
deferral
for
one
week.
B
AA
F
F
F
Fuhrman
is
not
on
the
decision
to
postpone
this
meeting,
it's
just
to
give
them
an
opportunity
to
meet
with
us
on
monday
and
for
the
board
to
defer
on
their
decision
until
from
today.
B
Okay,
so
we'll
hear
the
full
application
and
we'll
just
defer
our
vote
until
next
week.
That
way,
you
don't
have
to
come
back
again
and
present.
So
this
is
a
transfer.
The
same
location
is
that
correct.
F
F
B
A
Believe
so,
if
the
commissioners
have
do
not
have
any
other
questions
and
they're
indicating
they
don't
we'll
take
public
testimony,
is
there
anyone
who
wishes
to
testify
regarding
this
application,
beginning
with
elected
officials
or
their
representatives.

about
holding
this

us

today

with
us.
AC
You
thank
you
bernard.
This
is
a
situation
madam
chair,
where
the
restaurant
has
ceased
operations
in
large
part
due
to
covert
issues
which
we're
all
well
aware
of.
Mr
chu
is
the
owner
of
the
property
in
question:
seeks
to
transfer
the
license
to
the
upland
restaurant
entity
which
he
created
for
that
purpose.
AC
They
would.
This
is
in
a
in
an
effort
to
maintain
this
license
in
the
neighborhood
and
keep
it
viable
for
transfer
to
a
future
tenant
at
this
space,
and
if,
of
course,
that
becomes
impossible
or
unlikely,
it
would
seek
to
transfer
it
out.
This
is
a
request
simply
to
basically
save
this
license
so
that
the
space
can
be
reutilized
in
the
future.
AC
We
have
made
outreach
to
the
mayor's
office
to
the
neighborhood
association
of
the
back
bay
and
to
council
bach,
to
explain
the
nature
of
this
application
and
they
required
no
community
outreach
in
that
regard,
with
the
understanding
that,
of
course,
there
would
be
full
community
outreach
when
a
new
tenant
is
selected
and
an
application
filed
for
transfer
from
this
this
entity
to
a
an
operational
entity.
AC
In
the
meantime,
we
would
ask
and
present
mr
chu
as
the
manager
of
record
he's
the
owner
operator
of
a
couple
of
in-holder

in
other

so
he's
very
familiar
with
the
rules
and
regulations.

is

a

and
we're
certainly
here

If,
if
it
pleases
the
board
and
your
rules
allow
the
following
matter,
number
16
is
the
a
mirror
image.
It's
the
transfer
of
a
license,
the
same
entity
with
the
same
manager,
and
these
are
both
within
the
hotel
commonwealth
in
kenmore
square.
A
I
will
read
item
16
into
the
record
as
well
and
we
will
take
them
together,
calling

quilty
representing
the
and
the
ag
kenmore
llc
seeking
a
transfer
in
both
instances
of
existing
licenses
at
these
locations.
This
is
a
very
similar,
sadly,
a
very
similar
application.
As
the
previous
matter
of
max
brenner,
the
restaurant
operations
have
have
ceased
in
both
both
locations.
These
again
are
at
either
end
of
the
hotel
commonwealth
in
kenmore
square
eastern
standard
at
the
westerly
end
and
island
creek
at
the
easterly
end,
both
extremely
popular
restaurants
for
many
years
in
these
locations.
AC
Again,
you
know
the
business
changed
with
with
with
kovid,
and
the
result
of
that
was
an
agreement
between
both
operators
and
the
landlord
for
this
type
of
a
transaction
so
that
the
license
again
could
be
saved
for
again
transfer
to,
hopefully
future
tenants
in
the
very
near
future
or
as
soon
as
humanly
possible.
Given
the
covered
circumstances
again,
these
are
corporate
transfers.
No
other
changes
requested
or
proposed.
AC
Mr
jammin
is
one
of
the
owners
of
the

his
experience.
He
is
a

and

also

own.

which
is
now
suit
supply,
which
is
a
tenant
of
this
or
that
license,
is
in
a
related
entity,
so
they're
familiar
with
the
rules
and
regs
of
the
board
and
the
necessity
of
operating
licenses.
But
the
hope,
of
course,
is
that
these
licenses
are
maintained.

Before

I
will
note
the

is
in
receipt
from
both
the
applicant
and
from
counselor
box
office
of
the
good
neighbor
agreement
that
was
entered
into
between
the
applicant
and
the
community.
That
is
a
private
agreement
between
parties
and
would
not
be
incorporated
into
the
license
in
any
way
should
the
transfer
be
granted,
but
just
wanted
to
know
that
we
are
in
receipt
of
that
agreement
for
the
record
attorney
quilty.
AC
Yes,
ma'am.
Thank
you
very
much
again,
madam
chair
members
of
the
board
attorney
delaney
hawkins.
I
I
hope
with
us
is
andrew
flynn,
the
principal
of
minot,
as
well
as
michael
janaco,
who
is
the
proposed
manager
of
record.
We
have
spent
an
extensive
period
of
time,
speaking
with
talking
to
and
attending
meetings
with,
various
neighbors
and
abutters,
which
have
successfully
led
to
the
agreement
which
attorney
delaney
hawkins
mentioned
a
good
neighbor
agreement.
AC
We
would
like
to
make
it
clear
that
understanding
that
the
board
doesn't
generally
provide
such
agreements
as
a
part
of
the
license
attachment
mr
flynn
and
his
business
partners
intend
to
operate
within
the
parameters
that
they
agreed
to
with
those
neighbors
and
as
well
within
the
parameters
of
the,
I
believe
at
least
six
conditions
that
are
already
on
the
face
of
the
license.
AC
You
know
as
we
seek
to
transfer
other
than
that
there
are
no
changes
proposed
to
the
operation
or
the
style
of
operation
or
the
hours
etc.
This
is
a
corporate
court
transfer,
no
change
of
location,
no
other
changes
being
considered
again.
AC
We
have
spent
hours
talking
to
and
dealing
with
the
butters
and
neighbors
are
very,
very
keenly
aware
of
the
concerns
of
of
local
folks,
we'd
like
to
thank
councillor
bach
for
personally
interceding
and
assisting
in
regard
to
finalizing
that
good
neighbor
agreement
we'd
like
to
thank
the
beacon
hill,
civic
association
with
whom
we
met
probably
a
year
ago
in
in
terms
of
this,
and
they
supported
our
transfer
application.
AC
So
again,
we
propose
no
other
operational
changes
and
proposed
to
live
within
both
the
conditions
on
the
license
and
the
good
neighbor
agreement
and
mr
gimanco
is
present
and
again
he
is
a
u.s
citizen.
He
is
a
mass
resident
and
he
is
familiar
with
the
rules
and
regs
and
operations
of
of
that
he
must
to
operate
this
license.
Mr
jamalco,
are
you
with
us?
Yes?
Yes,
I
see.
B
Him
thank
you
attorney

thank
you
for
covering
the
manager
of
record
questions
and
explaining
this
to
the
board.
I'm
not
going
to
get
into
the
good
neighbor
agreement.
We
have
received
it.
Commissioner
curran
commissioner,
commissioner

do
you
have
any
questions?
B
Z
Yeah
kennedy
april,
with
counselor
box
office,
councillor
bach,
is
still
at
the
weekly
city
council
meeting,
but
she's
asked
me
to
read
these
comments
into
the
record
madam
chair
and
members
of
the
licensing
board.
I
am
here
through
my
representative
today
to
support
this
license
transfer
at
25
charles
street,
on
the
basis
of
a
good
neighbor
agreement
that
andrew
flynn
has
signed
on
behalf
of
the
minot
hospitality
group,
with
the
abutting
neighbors
and
the
beacon
hill
civic
association.
Z
Z
In
particular,
there
have
been
issues
in
the
past
with
the
roof
deck
in
this
regard,
which
is
why
the
existing
license
includes
conditions
that
the
roof
deck
be
stacked
at
all
times
and
closed
by
10
pm.
The
good
neighbor
agreement
with
minot
hospitality
group
adds
stipulations
that
there
will
be
no
music
or
smoking
on
the
roof
deck.
Its
noise
level
will
be
kept
below
60
decibels
and
the
proponent
will
explore
further
sound
proofing.
Z
It
will
see
a
maximum
of
12
patrons
from
the
hotel
and
bistro
only
with
no
fixed
bar,
except
for
up
to
8,
scheduled
and
pre-noticed
events
a
year
for
up
to
30
people.
These
will
conclude
by
9
pm
and
last
no
longer
than
3
hours.
I
have
forwarded
a
copy
of
this
good
neighbor
agreement
to
the
licensing
board
for
your
records.
Z
I'm
grateful
for
mr
flynn's
recognition
of
neighbors
concerns
and
the
crafting
of
this
agreement
and
his
firm
commitment
to
abide
by
it
and
be
held
accountable
to
it
by
the
abutters,
the
beacon
hill,
civic
association
and
the
district
8
council
office.
It
is
on
this
basis
that
I
support
the
license

you
today.

it

Of

It
involves
a

I
think
it's
over
133
states
that
were
owned
by
the
debtor.
It
was
bought
by
the
biggest
creditors
in
the

which
are
the

Their

out
of
out

needed
to
get
the

that.
V
There
are
absolutely
no
changes
in

the

the

largely
the

not
only
at
the

he's
been

for
seven

doesn't
know
much

he
is

AE
Peterborough

a

and
this

is
located
approximately
two
blocks
from
boylston

and
two
blocks
from
the

It's
a

and
mostly

but
they
desire
with

they
also

AE
AE
The
total
square
footage
is
1875
square
feet.
They
are
looking
for
a
maximum
capacity
of
29
people.
They,
the
seating,
is
the
seating
capacity
is
a
little
funny
and
that
the
cv
license
says
that
the
capacity
is
25,
but
the
certificate
of
inspection
has
it
as
19
and
just
so
the
board
knows.
The
applicant
currently
has
applications
pending
before
the
zoning
board
and
the
with
regard
to
the
patio
we
pl.
AE
We
through
this
process
realized
that
sushi
capo
did
not
have
a
use
of
premises
permit,
so
they
applied
for
one
and
then
we're
told
that
they
needed
zoning
relief
and
to
go
before
the
plumbing
board.
So
we
have
a
hearing
next
week
before
the
plumbing
board
with
regard
to
the
patio,
because
it
increases
the
capacity
and
there's
only
one
restroom.
AE
We
have
the
support
of
the
fenway
civic
association
and
I
just
received
a
message
from
karen
wolfe
who
was
on
the
call,
and
it
looks
as
though
she
had
to
step
away,
and
I
don't
know
if
she's
still
on
so,
hopefully
you
get
a
chance
to
hear
from
her.
But
her
message
says
that
she
had
to
leave
for
answers
unforeseen
circumstances.
AE
Please
let
the
board
and
stephania
know
that
the
fenway
civic
association
supports
the
application,
and
she
had
told
me
previously
that
she
was
going
to
submit
a
letter,
and
hopefully
the
board
has
that,
in
terms
of
just
as
an
aside
with
regard
to
the
fenway
civic
association,
they
had
requested
that
there
be
a
condition
that
food
be
served
with
alcoholic
beverages
and
ms
ladder
and
mr
garcia
have
accepted
that
as
a
condition
and
would
be
willing
to
have
that
put
on.
They
have
no
problem
with
serving
food
with
alcoholic
beverages.
AE
AE
They
also
would
have
a
written
policy
for
their
employees
regarding
the
sale
and
service
of
alcoholic
beverages
and,
like
I
said
they
would
also,
they
would
also
be
willing
to
have
a
condition
that
food
be
served
with
alcoholic
beverages
and
I'd
just
like
to
address
public
need
quickly.
If
the
board
would
consider
that,
so
the
the
applicants
have
had
repeated
requests
from
customers
as
to
the
service
of
alcohol
and
especially
sake,
it's
a
sushi,
restaurant
and
customers
would
like
to
have
some
sake
or
an
alcoholic
beverage
with
their
with
their
food.
AE
I'd
like
to
point
out
that
the
board
previously
found
public
need
at
this
very
particular
location
on
the
name
of
that
applicant
or
that
licensee
was
ss
jh
inc
doing
business
as
swish
shabu.
It
was
licensed
october,
6
2011,
but
was
transferred
in
2017
and
that's
the
year
that
the
applicants
took
over
the
the
premises.
AE
They
were
not
approached
about
the
transfer
of
that
license
at
that
time.
I
think
they
came
on
after
the
current
after
the
prior
tenants
left
the
premises
and
the
license
number
for
that
for
your
reference
is
01960-rs011
like
I
said
this
is
a
quiet,
neighborhood
street,
it's
almost
entirely
residential
except
there's
a
small
strip
of
very
small
restaurants,
restaurants
right
next
to
each
other.
One
of
those
restaurants
has
a
liquor,
license:
that's
thornton's,
fenway
grill,
but
other
than
that
restaurant.
None
of
the
other
restaurants,
have
a
liquor
license.
AE
AE
AE
I've
also
I'd
also
like
to
point
out
as
a
as
an
aside
that
there
are
three
churches
in
one
school
within
500
feet
of
sushi
capo,
we
did
provide
them
the
required
notices.
I
am
not
aware
that
anyone
has
objected-
or
is
here
today
with
regard
to
that
issue,
but
we
also
request
that
the
board
find
that
the
premises
are
not
detrimental
to
the
educational
and
spiritual
activities
of
the
school
and
churches.
AE
B
Thank
you.
I
just
need
some
clarification.
You're
seeking
the
cfi
is
for
19
people,
how
many
what's
the
capacity
that
you're
seeking
for
the
patio?
Yes.
AE
Thank
you
so
with
this.
If
this
application
is
approved
and
there
is
a
license,
we
would
like
to
put
16
patrons
a
maximum
of
16
patrons
inside
the
restaurant,
with
three
so
seating
for
16,
plus
three
employees,
so
a
total
of
19
inside
and
then
10
seats
on
the
patio
outside.
So
that
would
increase
the
occupancy
to
29
people,
which
is
triggers
the
plumbing
code
issue,
because
if
you
have
more
than
20,
you
need
to
get
a
variance.
B
Okay,
mr
garcia
you're
going
to
be
the
manager
of
record
here.
B
You
a
resident
of
the
commonwealth,
yep
and
you're
familiar
with
our
rules
and
regulations.
B
AE
It
is
this
is
in
the
fenway
area,
it's
like,
I
said
kind
of
sandwiched
in
between
boylston
street
and
the
back
bay
fenn's
waterway.
So
it's
like
two
blocks
from
each
the
quiet,
one-way
street,
with
almost
it's
almost
entirely
residences
like
condos
and
apartments.
So
on.
B
AE
The
only
one
that
has
one
is
thorton's
fenway
grill
at
100
peterborough
street.
Okay,
I
believe
that's
a
full
liquor
license,
but
I
don't
know
for
sure
I
can
tell
you
the
license
number
if
you'd
like
well
liquor
yeah
and
they
have
it's
a
it's
a
larger
restaurant
than
sushi
capo.
It
has
a
small
bar.
Is
that
right,
jose.
AE

a
long
time.
Popular
pizza,
restaurant
and
the
neighborhood
was
pleased
to
see
it
remain
as
such
when
joe
first
opened
up
in
2018
to
keep
it
a
local
operator
in
the
storefront.
AF
The
business
initially
created
eight
jobs
pre-covered
but
they're
down
to
two
now
and
of
course,
would
like
to
be
able
to
bring
people
back
in
it's
again
imperative
to
keep
local
business
in
this
neighborhood
and
along
this
particular
corridor
of
washington
street,
which
is
have
a
heavy
retail
area.
We've
obviously
seen
devastation
across
the
country
and
boston
is
no
different
with
local
operators
trying
to
stay
alive.
AF
So
the
neighborhood
really
has
a
vested
interest
in
keeping
local
business
in
the
neighborhood
along
this
portion
of
washington
street,
because
they've
already
lost
several,
unfortunately
to
its
detriment.
As
far
as
hours
of
operation
are
concerned,
prior
to
covid,
they
were
operating
seven
days
a
week
from
11
a.m,
to
10
p.m,
but
right
now,
they're
operating
tuesday
through
saturday
from
3
p.m,
to
8
p.m.
I
know
they've
done
their
own
extensive
outreach
with
city
councilors
as
well,
who
have
been
supportive
for
this
endeavor
since
they
began
it
in
2019.
B
AF
That
would
be,
they
haven't
gone
through
that
process
yet,
but
if
they
were
able
to
get
a
license,
it's
something
that
they
would
like
to
explore
and
they
think,
with
preliminary
plans,
they've
drawn
up
and
done
the
measurements
that
they
could
probably
have
ten
tables
with
four
seats.
Apiece.
B
Okay,
I'm
just
making
a
recommendation
to
clients;
they
could
still
apply
for
the
temporary
extension,
even
without
the
liquor
license.
It
helps
us
with
planning
purposes
for
the
entire
season,
as
opposed
to
going
back
and
then
trying
to
make
an
application
fit
into
a
neighborhood.
Okay,
I
haven't
proved
any
of
them
yet,
but
it's
a
simple
online
application
that
you
might
want
to
take
a
look
at
okay
and
it's
there's
no
fee
associated
with
it,
so
it
might
be
something
worth
exploring.

I
have
submitted
a
letter
of
support
to
you
via
email.
G
We
urge
you
to
pass
this
application
for
a
full
alcohol
license.
This
location
had
been
a
bar
restaurant
with
the
patio
with
the
same
hours
until
very
recently
august
2020
and
mr

an
excellent

the

having
operated
his
first

G
the
issues
where
the

and
noise
in
this

is
a
much
different
neighborhood
than
norfolk

and
he's
agreed
to
have
signs
asking
patrons
to
respect

and
leave
quietly
he's
agreed
to
not
throw
out
bottles
into
the

and
he
also
said
he'd
keep
strict

he's

to
keep
strict

on
all
the

G
So
we
urge
you
to
to
pass
this
license
with
the
proviso
he
has
agreed
and
you
may
not
need
to
do
it
on
the
license,
but
he's
agreed
to
have
a

with

six

after
getting
the

an

seven-day

this

This
is

of
the

AC
If
you
will,
on
the
rutherford

of
charlestown
and
the

went
through
a
lengthy
process,
or
rather
I'm
sorry,
the

went
through
a

in
the

process,
referencing
the
application
that
there
would
be
an
application
for
a
restaurant
at
this
site.
As
a
result
on
our
our
community
outreach,
we
were
only
obliged
to
hold
a
mayor's
office
of
butters
meeting,
which
we
held
virtually
I'm
sure.
AC
Ons
is
present
to
to
discuss
that.
We
had
no
opposition
at
that
time.
This
application
is
a
companion
if
you
will
of
a
restaurant,
that
the
board
is
licensed
in
the
downtown
the
tradesmen
down
along
the
greenway
in
the
downtown
area,
mr
durocovic
and
his
business
partner,
mr
greslack
own,
and
operate
a
number
of
establishments.
The

the

on
battery

the
tradesmen
downtown
they
proposed
to
operate
a
an
american
style.
AC
You
know
bistro
restaurant
at
this
site.
They
have
a
great
history
and
background
in
this
regard.
Mr
durocovic
is,
I
believe,
is
a
manager
of
record
already
approved
by
you.
He
is
a
us
citizen
and
mass
resident
and
is
familiar
with
the
rules
and
regs
and
all
operational
matters
concerning
the
application
of
this
nature
as
to
public
need.
AC
What
we
have
here,
I
think,
is
almost
a
new
neighborhood
being
created
by
the
development
of
the
farmer,
hood
properties
in
what
was
a
very
if
you
will
manufacturing
back
of
the
house
operations
area,
which
is
going
to
be
converted
into
much
more
of
a
lively
residential
office.
Restaurant
part
of
the
neighborhood,
but
it's
this
would
be
the
start
and
the
first
and
we
think
it's
necessary
to
provide
amenity
for
the
residents
and
office
workers
and
and
folks
who
we
hope
will
be
living
and
working
here
at
this
site.
AC
So
it's
we
think
the
public
need
is
is
met
in
that
you
will
be
providing
a
great
service
to
this
new
section
of
the
charlestown
neighborhood
and
we
hope
there'll
be
more
places
to
come
in
the
future.
And
again
mr
drakovich
is
present.
If
you
do
have
any
questions,
we're
happy
to
be
here
and
answer
and
the
capacity
again
just
in
case
it's
a
very
large
space.
So
it's
136
inside
and
30
on
a
an
outdoor
patio
on
private
property.
AC
B
You
thank
you
quilty.
I
I
think
you
covered
my
questions
adequately
adequately,
describing
the
public
need
and
the
capacity,
but
just
anecdotally,
mr
dorakovich,
your
other
restaurants,
you
said,
there's
three
others
or
two
others.
I
know
it's
the
other
tradesmen
in
the
hotel
right.
Yes,.
D
Thank
you
very
much
for
having
us
today.
I
appreciate
your
time.
I
am
a
manager
on
a
record
on
a
in
a
fin
point.
That's
in
the
hilton
broad.
S
D
I'm
a
manager
of
record
tradesman,
also,
that
is
in
the
hilton
on
89
broad
street.
The
tree's
been
located
very
much,
I'm
a
manager
of
lilies
on
the
very
march,
the
lilies
bar
and
patio.
We
recently
bought
it
and
used
to
be
that
berry
park,
so
we
renovated
the
modern
american
bar
and
also
we
did
apply
for
amber
road.
That's
in
a
hundred
federal
street
restaurant,
I'm
managing
a
record
there,
but
that's
for
right.
D
Now
it's
a
little
bit
on
hold
because
of
everything
that's
happening
with
the
covet,
so
we
are
planning
to
take
this
concept
trace
man,
that
is
a
coffee,
lounge
and
a
bar
restaurant,
and
bring
to
charleston
in
this
absolutely
new
developing
area.
There's
pretty
much
nothing
there
in
you
know
good
development
and
we
were
going
to
be
the
first
first
wrestler
in
that
neighborhood.
D
A
landlord
expressed
good
good
feelings
about
the
tradesmen,
because
the
successor
that
we
had
in
a
downtown
with
a
coffee
and
a
food
and
quick
lunches
and
all
that
stuff.
So
we
are
ready
to
do
this
and
make
this
place
special.
I
