Description
City of Boston Licensing Board - LPI Hearing - 01/25/2022
A
Make
sure
we
are
recording
great
good
morning.
This
is
a
hearing
before
the
licensing
board
for
the
city
of
boston.
Today
is
tuesday
january
25th
2022.
Today's
hearing
is
being
held
pursuant
to
temporary
amendments
to
the
open
meeting
law.
That
is
what
allows
us
to
meet.
Virtually
today's
hearing
will
be
recorded
and
posted
to
the
city
of
boston
website.
Before
your
procedural
matters,
I
will
introduce
chair
roman
kathleen,
joyce.
B
A
Thank
you
please
ensure
that
your
audio
and
visuals
are
working
properly.
I
will
call
each
item
in
the
order
it
appears
on
the
agenda.
I
will
then
ask
who
is
present
on
behalf
of
the
licensee
who
is
present
on
behalf
of
the
boston
police
department,
whether
there
are
any
other
individuals
with
knowledge
of
the
alleged
incident.
A
Again,
all
testimony
will
be
limited
only
to
individuals
with
personal
knowledge
of
the
alleged
incident,
and
we
will
be
taking
item
number
11
out
of
order
and
beginning
with
that.
So
now
calling
item,
number
11
old,
trafford

Chapter
138,
section
64
and
chapter
265,
section
22.,
who
is
president
on
behalf
of
the
licensee
good
morning.
C
Mr
green
dennis
cruelty
attorney
representing
the
licensee.
I
hope
I
have
someone
here.
I
didn't
realize
there
would
be
called
first
joe.
E
Hi
good
morning
sergeant
mark
irvin
area,
d14,
austin,
brighton,.
A
Sergeant
thank
you
and
are
there
any
other
individuals
with
personal
knowledge
of
the
incident
who
would
like
to
testify
today.
F
A
Okay,
could
all
parties
please
raise
your
right
hand?
E
E
Good,
usually,
I
read
the
police
report,
but
since
this
is
sexual
assault,
it's
classified
so
I'm
just
going
to
give
you
guys
the
cliff
notes,
that's
okay.
E
So
it
came
in
about
10
43
on
tuesday
10
18
20
21
officers
from
area
d14,
which
covers
the
austin
brighton
area
on
the
first
half
tour
of
duty,
which
is
four
to
11.
45
responded
to
the
establishment,
for
it
came
into
sexual
assault
and
progress
and
ended
up
being
an
indecent
assault
and
battery.
So
what
happened
is
mother
in
her
juvenile
son?
I
don't
know
the
exact
age.
E
It's
in
the
report,
maybe
10
11
years
older
at
the
establishment
on
the
second
floor
at
watching
a
concert,
I
believe
they
were
sitting
down
in
the
booth
when
the
subject
came
down,
sat
next
to
her
and
started
groping
her
touching
her
breasts.
E
That's
when
we
all
came
the
subject
was
outside.
We
have
to
get
into
any
of
the
details,
but
the
subject
was
arrested
on
scene
outside.
I
just
want
to
add
that
the
the
staff
was
more
especially
the
mains.
It
was
more
than
cooperative,
very
cooperative
they're,
the
ones
who
call
911
they
brought
the
victim,
and
the
son
into
the
their
private
office
gave
them
water.
They
showed
me
where
the
license
premises
were
where
I
wrote
them
up,
so
I
have
nothing
bad
to
say
about
the
staff
at
that
time.
A
Thank
you
sergeant,
attorney
quilty.
Would
you
like
to
address
the
alleged
incident.
C
E
I
think
the
report
has
first
name
william.
Yes,.
C
Thank
you.
Thank
you.
Sorry.
I
have
no
further
questions
from
the
sergeant.
May
I
just
ask
mr
garrett
testify
yeah.
So
just
scare
you've
been
sworn
in
just
state,
your
name
for
the
record
and
your
position
at
the
establishment.
C
Okay
and
on
the
evening
in
question,
did
you
was
this
incident
brought
to
your
attention.
H
G
We
called
9-1-1
immediately,
as
is
our
procedure,
especially
in
a
sexual
assault
case,
and
then,
and
then
we
just
you
know,
did
our
best
to
to
comfort
the
victim
and
get
her
to
a
safe
place,
and
you
know
just
ask
her
for
information.
She,
we
did
get
a
description
of
the
suspects
and
were
able
to
locate
them
as
they
were,
leaving
the
building.
G
Ahead,
go
ahead;
no,
they
just
they
just
sort
of
walked
off
to
the
side
of
the
building.
It's
a
very
popular
show
and
a
lot
of
fans
were
hanging
around
wanting
to
catch
a
glimpse
of
the
artist
we
assumed
they
were
doing
the
same,
and
so
we
fortunately
did
not
really
have
to
inter
interact
with
them.
At
that
point,
they
just
sort
of
waited
there
and
we
knew
the
police
were
on
their
way.
So
it
worked.
C
Just
a
couple
minutes:
yeah:
did
you
point
these
individuals
out
to
both
the
bu,
please
and
boston?
Please,
yes,
thank
you
and
did
you
have
any
any
further
interaction
with
them,
or
did
you
simply
then
allow
the
police
to
do
their
jobs
yeah.
C
Thank
you,
mr
guerra.
Madam
chair,
just
in
addition,
I
don't
know
whether
mr
meagan
is
with
us
this
morning,
but
as
a
result
of
this
incident,
the
staff
circulated
a
photo
of
this
individual,
because
this
particular
band
was
playing
three
nights
in
a
row
in
the
city.
They
circulated
a
photo
to
the
establishment
where
they
were
performing
the
next
night,
which
is
the
house
of
blues,
and
as
a
result
of
that,
the
individual
was
again
observed
in
the
line
trying
to
get
in.
They
approached
him
told
him.
C
They
would
not
allow
him
in
based
on
what
had
happened
the
night
before,
and
he
was
anyway.
He
had
already
been
arrested
the
night
before
so,
but
they
they
took
extra
precautions
to
make
sure
that
he
did
he
didn't
get
into
the
next
night's
event.
If
you
will
thank
you,
mr
garrett,
the
board
may
have
some
questions
for
you.
B
G
No,
we
we
were
able
to
find
the
couple
entering
the
building
on
our
video
tape
and
it
looked
like
they.
B
Did
they
were
they
served
alcohol.
G
B
G
We
had,
if
I,
if
my
numbers
are
correct,
we
had
about
24
security
guards
on
which
is
larger
than
our
normal
sold
out
staffing.
This
is
a
very
high
profile
show
they
came
with
their
own.
They
had
advanced
with
us
to
put
extra
security
on.
They
also
brought
their
own
security
team,
which
I
think
was
about
four
people,
so.
G
We
normally
do
about
between
18
to
22,
depending
on
the
threat
level
that
we
discussed
prior
to
the
event.
G
Particular
night,
this
one
was
actually
not
considered
a
high
threat
level
show
at
all.
It's
they're
they're,
a
very
you
know:
they're,
not
a
hardcore
band
they're,
not
a
hip-hop
band,
they're
they're,
a
pop
band.
Their
audience
is
very
young,
primarily
female,
but
they
did
ask
us
in
advance.
They
just
said
we,
you
know
we
very
they're,
very
cautious
about
their
fans
and
they
and
the
band
itself.
You
know
very
well
known
band,
so
that
so
they
were
asked
in
advance
to
beef
up
security.
For
this
one.
G
Well,
we
don't
know
where
he
was.
You
know,
prior
to
the
end
of
the
show
he
may
have
been
up
in
the
balcony
area,
the
the
whole
time.
We
don't
know
it's
not
it's
general
admission,
so
it's
you're
allowed
to.
G
Well,
as
I
said,
it's
general
admission
and
there's
no
there's
no
seating,
I
don't
the
one
strange
thing
about
that
account,
because
this
is
the
first
I've
heard
that
he
sat
down
with
her
is
that
we
we
don't
really
have
boots
in
that
area.
There
is
a
banquette
seat
up
there
against
the
wall.
So
that's
I
assume
that's
where
she
must
have
been
sitting,
but
again
it's
not
it's
not
assigned
seating.
G
So
you
know,
even
though
it
was
the
event,
was
ending,
there's
still
a
good
number
of
people
just
starting
to
disperse,
so
he
you
know
it's
certainly
possible
that
he
could
have
sat
down
next
to
her.
At
that
moment,.
B
G
G
We
don't
get
too
firm
with
people
leaving
because
it
was
early.
This
is
a
pretty
early
show
it
was
over
by.
I
think
I
don't
know
exactly
what
time,
but
I
think
it
was
around
10
30
10
45,
so
we
had
plenty
of
time
to
get
people
out.
So
we
don't.
We
don't
try
to
be
too
firm.
Yet
you
know
so
we're
just
sort
of
encouraging
people
to
go,
settle
their
tabs
and
move
toward
the
front
exit.
G
There
are
two
different
ways
down
from
the
balcony,
so
we'll
just
direct
them
to
the
two
staircases
that
they
can
use
to
to
exit
so
it.
But
at
that
point
that's
basically
what
security
was
doing
and
there
was
a
good
number.
As
I
said,
there
were
a
lot
of
people
up
in
the
balcony.
So
you
know
it's
not
it.
Something
like
this
could
potentially
happen
out
of
sight,
and
you
know
we
wouldn't
we
might
not
catch
it
right
away.
G
B
I
J
C
Just
for
the
record,
it's
a
roughly
a
900
seat
facility.
There
are
only
two
levels,
the
main
the
main
floor,
where
the
where
the
stage
is,
and
a
small
balcony
area
above
that
which
includes
the
mixing
area
for
the
the
band.
If
you
will,
and
a
couple
of
small
banquette
kind
of
as
as
bill
described
it
almost
like
a
bench
seating.
But
it's
all.
C
It's
all
standing
room,
the
entire
facility
and
one
can
circulate
pretty
much
wherever
they
want
to
go
and
walk
around
we'd,
initially
heard
that
the
groping,
if
you
will
happened
as
they
were,
exiting
that
he
somehow
you
know,
was
right
next
to
them,
or
something
and
and
groped
the
woman.
But
again
I
mean
it's
a
fairly
small
facility
and
with
24
security
people
on
for
that
many
people
and
I
think
they
they
had
it
cover
pretty
well.
C
But
again,
I
think
this
happened
at
the
moment
where
people
are
all
moving
around
and
we
thought
that's
when
it
happened
that
this
guy
grabbed
her
and
then
he
was
identified.
We
found
him
on
the
video
they
identified
that
the
guy
followed
him
out.
You
know
helped
the
woman.
I
think
they
did
everything
possible,
they
could
in
circumstances.

At

p.m.
On
august
10th,
2021
officer
o'rourke,
while
working
a
paid
detail
at
fenway
park,
responded
to
a
radio
call
for
a
fight
in
grand
stand.
27..
H
I
responded
along
with
multiple
detail
officers
upon
arrival
officer,
o'rourke
met
with
several
fenway
security
staff,
who
had
separated
the
three
individuals
involved
officer
o'rourke
spoke
with
edward
bissonette,
who
was
involved
in
the
altercation
bisonette
stated
that
he
had
been
involved
in
a
fight
with
two
other
patrons
at
the
game.
This
annette
stated
that
he
was
punched
in
the
head
area
multiple
times
during
the
altercation
fenway
medical
staff
evaluated
bissonnette
on
scene,
bissonnette
declined
any
need
for
medical
attention.
Assistance
officer,
o'rourke
spoke
with
sean
mcqueeney
and
kaylee.
H
Sean
mcqueeny
informed
the
officers
that
he
proceeded
to
defend
his
girlfriend
and
punched
bissonnette
several
times
during
the
fight
mcqueen.
He
also
stated
that
he
received
multiple
strikes
from
bissonnette
officers,
observed
scratches
and
bruises
to
both
quinlan
and
mcqueeney.
Both
parties
declined
need
for
medical
attention.
All
parties
were
escorted
out
of
fenway
without
further
assistance.
H
I
retained
a
recording
of
the
incident
from
a
witness
who
showed
the
altercation.
The
officers
observed
on
this
video
bissonnette,
initially
flipped,
quinlan's
hat
off
her
head,
followed
quickly
by
a
closed
fist
or
her
face
officers,
observed
a
fight
ensue
with
all
three
individuals
striking
each
other.
Multiple
times
officers
observed
the
fight
to
be
quickly
separated
by
other
patrons
attending
the
game.
A
C
Thank
you
just
to
inquire
of
the
detectives.
Absolutely
thank
you.
A
detective
were
you
and
officer
o'rourke,
both
on
paid
details
tonight
in
question.
Yes
and
the
the
report
indicates.
Does
it
not
that
when
you
arrived
at
the
site,
fenway
security
were
already
on
on
site
dealing
with
this
matter,
yes,
and
on
the
inspection
notice
you
you
filed
that
or
gave
that
inspection
notice
to
the
red
sox
and
on
that
it
suggests
that
the
police
were
called
by
fenway
and
red
sox
security
right,
that's
correct
and
that
the
management
cooperated
with
you.
C
C
C
And
were
you
on
duty
on
the
night
in
question
I
was
and
can
you
you've
heard
the
report
as
it
was
indicated,
were
your
staff
on
on
site
and
how
quickly
do
you
know
they
were
on
site
when
this
incident
was
reported.
L
C
And
did
your
is
your
staff
as
far
as
you're
concerned,
your
staff
cooperate
with
the
boston
police
department
absolutely
and
then
did
you.
You
received
the
actual
notice
of
the
incident
yourself
and
signed
for
it.
L
C
L
Now
for
our
security
personnel,
we
hire
for
security
of
about
200
people
for
every
game
to
put
out
there.
We
have
about
30
plus
minus
police
officers
for
different
games,
they're,
always
traveling
inside
the
vomitories
and
along
the
concourse,
and
on
the
top
of
the
walkways
to
watch
or
anything
like
this.
L
We
also
have
a
text
tip
line
which,
if
somebody
did
notice
somebody
heckler
heckling,
the
players
they're
informed
that
they
should
text
these
tips,
so
our
security
can
get
right
down
there
right
away
and
separate
them,
and
there's
all
ushers
too
on
just
about
every
walkway
and
every
entrance
within
a
certain
block
to
respond
to
these
issues.
Okay,.
C
And
would
you
just
describe,
I
know
you
have
a
a
camera
system
and
a
main
monitoring
station
in
the
park.
You
just
described
that
for
chairman
joyce.
L
Now
we
have
a
command
center.
That's
set
up
in
the
park
for
every
game
that
utilizes,
maybe
six
people
inside
there
that
receive
radio
calls
tips
and
they
can
connect
with
the
police
department
right
there
to
send
people
out
to
address
these
things,
connect
with
security
to
send
people
out,
there's
hundreds
of
cameras.
There
must
be
350
cameras
all
around
the
park
and
there's
operators
inside
of
a
camera

N
A
N
Good
morning
I'll
be
reading
you
from
police
report,
which
I
wrote
on
a
monday
october,
18th
2021,
sorry
detective,
william
gallegon,
detective
eddie
hernandez,
signed
to
the
bpd
license
premise
unit
conducted
licensed
premise:
inspection
of
fenway
park
located
at
fort
jersey
street
detectives
were
walking
through
the
lower
concourse
level
when
they
observed
two
young
looking
patrons
each
holding
a
mixed
alcoholic
beverage,
detective
asked
them
to
produce
identification
to
confirm
their
ages.
Both
patrons
immediately
stated
that
they
were
under
21
years
of
age.
N
N
N
Both
individuals
will
be
summoned
to
quote
for
persons
under
21
percent
of
alcohol.
Mr
chan
will
additionally
be
charged
with
possession
of
identification
and
procuring
alcohol
for
a
person
under
21
years
of
age.
Detectives
brought
this
to
the
attention
of
the
person
in
charge.
Mr
calm
leiden.
As
a
result
of
what
detectives
observed,
detective
gallagher
issued
license
premise:
inspection
notice,
zero,
zero.
C
Sir,
if
I
may
inquire
of
detective
hernandez
detective,
did
the
licensee
cooperate
with
you?
Yes,
sir
fully
and
just
on
the
issue
of
the
identification,
the
the
male
individual
had
a
mass
license
with
his
likeness
on
it,
but
you
checked
it
and
it
ended
up
being
a
fraudulent
correct,
but
it
was
mass
not
out
of
state.
N
C
The
did
they
did,
they
inform
you
whether
or
not
you
know
they
purchased.
These
is
it.
The
allegation
is
in
possession.
C
We
have
no,
no
witness
that
observed
that
he
suggested
to
me
that
he
did.
C
And
again
the
the
staff
and
the
fenway
park
security.
Did
you
inform
them
right
away
and
did
they
observe
to
come
back
and
and
and
work
with
you
yeah?
They
were
extremely
helpful.
Thank
you,
sir.
I
know
further
questions.
I
would
like
to
inquire
of
mr
lyden
and
mr
schwartz.
If
I
may,
and
madam
chair
members,
you
can
imagine
on
a
sold
out
event
at
fenway
park,
you're
talking
about
plus
or
minus
38
or
39
000
people.
C
The
staffing,
as
you
heard
earlier
on
the
security
side,
is
roughly
200,
plus
boston
police
details,
that's
for
every
every
game,
etc.
There
are
additionally
aramark
and
mr
swartz
is
here:
aramark
compliance
personnel
18
of
those
individuals
whose
only
job
is
to
observe
situations
like
this
roving.
The
concourse
is
rubbing
the
seating
areas
with
a
specific
eye
towards
younger
looking
persons
in
possession.
C
Mr
leiden,
mr
sports
can
tell
you
the
numbers
of
checks.
If
you
will
that
they
have
made
on
people
the
number
of
people
that
they
have
stopped
themselves
and
all
the
steps
that
are
taken
by
both
aramark
and
its
team
and
the
red
sox
and
their
team
in
terms
of
keeping
an
eye
out
for
these
circumstances,
they
they
are
extremely
serious
about
this.
C
Okay,
and
were
you
were
you
at
the
park
on
the
night
in
question.
C
And
do
you,
can
you
tell
the
board
what
your
staff
did
in
response
to
this
and
how
you
how
you
were
notified
and
what
your
staff
did
in
response.
L
Normally,
our
staff
is
prepared
to
watch
for
these
things
along
with
aramak.
You
know
we
have
those
security
officers
that
we
have
go
through
team
training,
which
is
total
education
and
alcohol
management,
training
and
effective
alcohol
management.
L
We
have
that
we
have
a
relationship
with
hub
security
that
does
all
the
alcohol
compliance.
They
did.
Approximately
16
000
checks
in
on
age
id
and
another
2100
visual
checks
for
these
fake
ids
that
are
coming
from
all
different
states,
with
half
of
them
out
of
a
thousand
of
them,
half
of
them
in
massachusetts.
L
Yeah
out
of
approximately
a
thousand
ids
that
came
in
half
of
them
would
be
from
massachusetts,
which
is
60
up
from
what
it's
been
over
different
years
now,
they're
getting
better
at
fake
ids.
C
L
We
have,
and
it
got
so
good
it's
that
sometimes
you
have
to
question
the
people
thoroughly
to
find
out
exactly
like.
I
had
two
kids
myself
and
the
id's
looked
great,
but
they
both
were
carrying
voter
registration
forms,
which
no
one
carries
voter
registration
forms
and
that's
part
of
the
package
when
you
buy
fake
ids
that
they'll
give
you
about
a
registration
form
to
send
with
people
as
well.
C
Wow,
amazing,
and
with
regard
to
the
checking
of
individuals
that
your
staff
does,
what
steps
do
you
take.
L
We
will
put
out
a
different,
you
know
when
it
does
happen
and
we're
getting
big
numbers
we
put
out.
I
won't
call
them
strike
teams,
but
I'll
put
out
roven
patrol
that
have
that
do
the
same
thing
that
hub
compliance
hub
security
does
for
compliance,
and
they
work
the
different
areas
of
the
concourses
and
the
biggest
sections
that
we
have
to
try
to
watch
for
people
purchasing
in
line
coming
out
of
lines
or
walking
through
the
concourse
or
passing
off
to
other
individuals
who
will
come
out
of
the
bathroom.
L
C
And
if
you
put
those
those
matters
in
in
play,
if
you
will
for
the
upcoming
season
correct
and
the
board
may
have
some
questions
of
you-
and
I
would
like
to
just
hear
from
mr
schwartz,
if
I
may
is
that
all
right,
so
mr
sports,
again
you've
been
sworn
to
state
your
name
and
your
title
for
the
record,
and
just
madam
chair
and
board
members,
mr
schwartz
will
be
before
you
as
the
new
manager
of
record
applicants.
C
He
will
be
taking
the
place
of
mr
melissie,
who
left
aramark
so
in
the
near
future.
He
will
be
on
as
the
manager
of
record
before
you
thanks
again,
mr
schwartz,
you
state
your
name
and
your
title.
Please
yep.
C
And
does
your
company
hire
the
alcohol
compliance
individuals,
we
do?
Yes,
we
partner.
O
Yeah,
in
a
nutshell,
they
are
are
basically
put
out
on
the
concourse
to
to
manage
our
our
alcohol
program,
making
sure
that
you
know
we're
we're
we're
serving
responsibly
from
an
employee
standpoint
as
well.
As
you
know,
the
guests
that
are
within
the
the
concourse
as
well.
Okay,.
C
And
excuse
me
what
what
training
and
background
do
these
people
have
and
your
and
your
serving
staff
have.
O
So
our
serving
staff
go
through
team
training
as
well
every
every
three
years
they
get
renewed.
It's
part
of
our
alcohol
program
is
part
of
our
onboarding
each
year,
when
our
folks
come
back
to
work
for
the
start
of
the
season.
So
we
review
all
our
alcohol
policy
itself
and
as
well
as
hub
security,.
F
C
And-
and
you
heard
mr
paul,
mr
lyden
refer
to
the
number-
the
number
of
checks
and
and
sightings
made
was
that
by
your
staff
as
well.
O
I
I
don't
know
the
particulars,
but
I
I
can't
say
yes
or
no.
Okay,.
C
O
Did
hear
that,
yes,
as
far
as
the
aramark
staff,
I
mean
again
we're
iding
anybody
under
the
40
years
of
age
at
the
point
of
point
of
sale.
So
we
do
have
a
checks
and
balance
there
as
when
we're
making
the
the
transaction.
B
B
Okay,
detective
hernandez
we're
talking
about
a
16
year
old
and
an
18
year
old.
Would
you
say
they
looked
young.
L
They
are
if,
if
I
can
respond
to
that,
the
ids
are
just
amazing
what
they're
coming
up
with
these
days.
I've
seen
nothing
like
it.
It's
very,
very,
very
professionally
done.
P
N
C
O
K
Did
the
detective
hernandez?
Did
the
young
man
tell
you
when
he
purchased
it.
K
N
It
was
a
juvenile,
so
yes
I
mean
I
can
get
you.
I
did
a
breath
of.
K
Freedom,
so
just
based
on
your
observations
I
mean,
was
he:
was
he
an
older
looking
17
year
old?
Was
he
a
someone
who
looked
basically
exactly
17
year
old
or
someone
who
looked
younger
than
17
years
old?
I
mean.
K
And
so
with,
with
that
in
mind,
how
long
did
you
have
an
opportunity
to
observe
the
two
of
them
like
in
the
concourse?
Should?
Was
it
enough
time
where
someone
in
the
staff
should
have
confronted
them?
Did
they
pass
other
members
of
aramark
security,
or
did
you
notice
anything
to
like
no
one's
confront
them,
we're
going
to
confront
them?
Did
you
have
that
experience
or.
A
N
C
N
C
So
they
this
could
have
been
a
pass
off.
This
could
have
been
somebody
purchasing
for
them.
It
could
have
been
any
number
of
of
matters
if
you
will,
where
they
got
possession
of
this
beverage.

I

N
E
I'm
going
to
read
the
police
report.
This
is
not
my
police
report.
This
was
the
patrol
officer
at
the
time
about
23
30
hours
on
10

officers.

On
arrival
officer
spoke
with
the
owner,
george
carotis.
E
If
I
spelled
his
name
wrong,
I
apologize,
I
said
his
name
wrong.
He
stated
that
one
of
his
patrons
was
unruly
and
she's
been
asked
to
leave.
He
stated
that
there's
a
capacity
downstairs
and
they
were
at
their
limit.
He
stated
that
the
victim's
friends
were
downstairs
and
she
wanted
to
join
them.
E
He
stated
that
the
staff
refused
her
request
and
she
started
causing
a
disturbance
and
stated
and
quote
my
father's
a
judge
and
you'll
shut
this
place
down
now.
Let
me
downstairs,
after
a
few
minutes
of
this,
they
stated
to
her
that
she
had
to
leave
the
premise
and
walked
her
out.
He
also
stated
that
once
outside
she
would
not
leave
the
front
of
the
restaurant
stating
it's
a
free
country
and
I
can
stand
on
the
sidewalk.
He
also
stated
that
they
have
cameras
inside
and
everything
is
recorded,
but
they
don't
have
volume.
E
I
spoke
to
the
victim
and
asked
her
and
her
witness.
She
said
that
she
tried
to
go
downstairs
after
numerous
attempts.
She
was
asked
to
leave
the
premise.
She
stated
that
mr
froedt
has
physically
grabbed
her
by
the
arm
and
escorted
her
outside
both
the
victim
and
witness
both
pointed
out
mr
crotis
to
myself
as
the
one
who
grabbed
her
by
the
arm.
I
can
definitely
conduct
it
at
code.
35
violation,
zero,
six,
zero,
six,
two
seven,
mr
kurodis,
was
advised
to
hold
our
recordings
for
this
hearing.
E
Let
me
just
say
the
number
one
caller
that's
the
end
of
the
report.
The
number
one
caller
was
in
florida
and
it
stated
his
daughter
is
calling
him
saying
that
she's
in
circle
pizza
and
they
have
locked
her
and
her
friends
in
the
basement,
there's
a
large
group
and
they
won't
let
them
out
of
the
basement.
E
E
I
also
add
that
the
owner
and
the
staff
that
were
cooperative
with
the
police
with
this
they
handed
me
his
id
or
that
the
license
premise.
So
I
don't
have
issues
with
the
staff
right
this
time.
I
don't
know
if
detectives
took
charges
out
or
any
of
that.
I
that
I
don't
know.
A
Thank
you
sergeant,
attorney
miller.
Would
you
like
to
address
the
alleged
incident.
R
Just
a
couple
of
quick
questions
for
the
the
sergeant
sergeant.
As
you
stated,
the
staff
was
was
cooperative
and
also
there
was
a
bogus
call
from
florida
concerning
a
kidnapping,
correct.
E
R
And
and
this
julia
singal
her
address
is
coconut
creek
florida.
R
Did
you
observe
any
marks,
or
or
bruises
or
whatever,
on
miss
single
nope?
R
Phantom
you
members
with
me
it
is
george
kariotis
and
also
the
doorman
that
was
involved.
You
can
see
them
on
video
for
the
circle.
The
mr
harris.
Could
you
just
identify
yourself
for
the
board.
R
And
you
were
working
on
the
evening.
The
incident,
the
police
sergeant
just
read
the
report
on
yes,
sir,
in
in
on
that
night,
you
have
a
set
capacity
for
the
upstairs
and
the
downstairs
is
that
correct,
that's
correct
and
so
you're
controlling,
and
there
was
another
doorman
with
you
between
the
two
of
you.
You
were
controlling
to
make
sure
that
the
upstairs
and
the
downstairs
do
not
exceed
capacity.
Is
that
correct.
H
R
And
this
particular
julia
single
wanted
to
go
downstairs
and
you
told
us
she
had
to
wait
until
there
was
appropriate
capacity.
R
Is
that
correct
and
she
can't
yes,
sir,
and
she
kept
giving
you
a
hard
time
saying
she
didn't
care
she
wanted
to
go
downstairs
now.
Yes,
sir,
and
at
that
point
you
heard
what
was
in
the
report.
She
said
that
her
father
is
a
judge
and
let
her
go
downstairs
or
are
they
gonna
her
father's
gonna
shut
the
place
down,
that's
correct,
sir,
and
so
she
kept
she
kept
causing
a
disturbance
at
that
point.
R
And
so
you
asked
her
to
leave
correct.
R
D
R
I
don't
think
I
have
anything
further
at
that
point
her
or
her
she
refused
to
leave
the
out,
I'm
sorry.
She
stayed
outside
and
refused
to
leave
the
area.
M
R
You
and
mr
cariota
spoke
with
the
police
about
this
incident.
When
the
police
arrived.
R
R
A
A
A
F
Okay,
this
report
is
not
my
report
read
from
the
incident
at
about
12
30
a.m.
On
sunday
october
10
2021
officers
received
a
9-1-1
radio
call

males,
trespassing
in

security.
F
As
the
two
males
were
still
roaming
around
the
park,
they
managed
to
comply
with
the
officers
at
gate
a
I
believe
it
was
a
d
officers
identif.
I
id'd
the
two
suspects
one
lionel
bean
with
the
date
of
birth
of
616
2000,
which
puts
them
at
21
years
old
and
a
michael
bernard
date
of
birth.
510
2001
would
put
him
at
a
date
of
birth
of
20..
F
We
then
issued
them
a
trespass
from
fenway
park,
and
I
went
to
game
on
to
conduct
a
code
35
on
the
premise
I
met
with.
I'm
not
sure
the
manager
on
in
charge
very
cooperative
with
us,
provided
us
with
the
permits
that
they
had
posted
as
well
as
showed
us
how
these
patrons
were
able
to
enter
fenway
park
from
their
bar.
F
C
To
address
it,
thank
you
on
the
screen.
If
I
may
sergeant,
the
staff
did
cooperate
with
you.
C
And
do
you
re,
mr
chile
is
with
us
here
this
morning
as
management?
Did
you
inquire
of
him
if
he
was
able
to
make
any
observations
of
these
people
on
their
camera
system?.
F
C
The
allegation
here
is
that
these
two
individuals
were
actually
inside
fenway
park.
Right,
yes,
is
that
correct?
Yes,
and
it
was
according
to
the
inspection
notice,
the
call
to
the
police
was
made.
It
just
says
by
fenway
park.
F
After
we
interviewed
the
two
subjects
in
fenway
park,
we,
yes,
I
went
to
game
on
based
on
their
statements
that
they
got
into
the
park
through
game
on
and
that
one
of
them
was
20
years
old.
C
C
And
I
may
just
no
that's
not
let
me
I'm
fine,
sir.
Thank
you
sergeant
appreciate
it.
I
may,
madam
chairman,
inquired
mr
chuga.
Thank
you,
sir.
Would
you
you've
been
sworn
to
state
your
name
and
your
position
for
the
record,
my
name
is
anthony
and
I'm
a
manager
for
game
on
okay,
and
are
you
familiar
with
this
incident.
D
Yeah,
I
am,
I
was
there
that
night,
I
was
the
one
who
directed
the
officers
over
to
all
of
our
licenses
that
are
posted.
C
And
did
you
make
observation
of
of
your
security
system
as
to
whether
or
not
you
could
find
these
individuals.
C
Them,
okay
and
you
have
any
idea
whether
or
not
these
people
were
in
your
establishment.
C
C
And
then
it
would
follow
that
you
of
course,
have
no
knowledge
of
anyone
serving
these
individuals
correct,
okay,
thank
you,
sir.
This
board
may
have
some
questions
for,
if
I
may,
madam
chair,
just
so,
there's
an
explanation
here
this
when,
when
the
establishment
was
first
licensed
many
years
ago,
there
is
a
an
access
to
a
batting
cage
which
is
straddles
between
the
fenway
property
line
and
this
property
line,
and
so
the
only
purpose
for
that
doorway
system
was
for
access.

smashed
her

As

Q
They
were

we
all

as

there
turned

the

kind
of
came

he

he

Mr

lehman

Mr

stated
that
one

broke
it.
The

was

they

I
Thank
you
attorney
green,
firstly,
I'd
I'd
like
to
mention
to
the
members
of
the
board
that
I
dropped
off.
A
thumb
drive
yesterday
to
attorney
green.
It
contains
two
videos
and
which-
and
I
will
address
those
videos
after
after
we
have
dealt
with
a
testimony
here
today.
There
are
two
videos,
one
taken
from
inside
the
bar:
that's
about
30
minutes
in
duration
and
a
cell
phone
video
taken
from
outside
the
bar.
If
I
could
briefly
ask
lieutenant
to
detect
detective
troy,
some
questions.
I
Lieutenant
detective
troy
you
you
you,
you
read
the
report
of
officer
murray
in
this
in
this
case
correct.
Yes,
sir.
Obviously,
you
have
no
you've,
no
independent
verification
that
mr
mike
lehmann
who's
identified
as
a
victim.
In
the
report,
he
stated
that
the
bouncer
pushed
punched
him
repeatedly
in
the
face
and
threw
him
out
and
threw
him
out
of
the
bar
you've,
no
independent
verification
of
that
allegation.
I
And
you
also
noted
that.
I
Officer
murray
wrote
that
mr
demora,
the
the
bouncer,
who
was
about
to
testify
here,
stated
that
lehman
the
alleged
victim
in
the
case
kicked
the
front
door
to
the
bar
and
kicked
levi,
namely
mr
tamora
in
the
stomach,
and
that
officer
murray
did
observe
a
footprint.
D
I
And
further
and
finally,
mr
demora
also
stated
that
one
of
lehman's
friends
an
unknown
female
ripped
his
earpiece
out
of
his
ear
and
broke
it.
Yes,
sir
right,
I
have
no
further
questions
of
lieutenant
detective,
troy.
I
And
I
I
would
madam
chairwoman
and
and
members
of
the
board
after
the
evidence
after
the
evidence
has
concluded
here,
I
would
like
to
make
a
brief
statement
along
the
lines
of
a
closing
argument
are
the
case,
but
I
would
like
to
call
levi
damora
guiames.
B
I
J
Your
name
yeah,
my
name,
is
lee
heigh-marais.
I
work
at

jones.
I
All
right
and
and
fenway
johnny's
is
is
a
is
a
premises,
is
a
bar
that
has
two
floors.
Isn't
that
correct?
Yes,
two
floors,
there's
a
down,
there's
the
there's
the
floor
on
the
street
level
and
then
there's
a
downstairs
bar
correct,
yes,
and
at
the
stairway
heading
to
the
downstairs
bar
there's,
also
an
exit
door.
Isn't
that
correct?
Yes,
though?
Yes
so
there
and
there
are
two
doors
on
the
street
to
get
into
fenway,
johnny's,
correct,
correct.
I
So
on
on
sunday
october,
the
17th
2021,
you
were
working
that
morning
at
fenway,
johnny's,
correct,
correct,
okay,
and
you
heard
the
you
heard
the
lieutenant
detective
troy
read
the
police
report
of
officer
murray
a
few
moments
ago.
Correct!
Yes,
do
you
have
a
memory
of
that
evening?.
J
Oh
yes,
the
situation
started
the
at
the
stairways
for
downstairs
and
the
guy
and
the
girl
was
creating
problems
because
we
we
can't
stack
the
they
stabbing
in
cause
of
fire
or
anything.
We
can't.
We
can't
stop
in
there
and
the
security
that
walks
in
there
asking
him
so
many
times
to
to
go
down
or
to
get
out
and
he
did
not
attend
and
he
started
to
say
so
for
that
guy
and
he
put
him
outside
and
he
got
so.
Let.
I
J
Kid
looked
like
he's
like
he
looks,
skinny
and
white
and
and
blonde
blonde
hair.
Yes,
blonde
hair.
J
J
I
J
I
I
And
madam
chair
woman
and
and
members
of
the
board,
as
I
stated
earlier,
I
I
have
submitted
at
two
video
tapes
for
your
consideration
in
this
matter
and,
if
I'll
be
very
brief
in
the
first
video
tape,
you
will
see
the
individual
who's
identified,
as
as
mr
lehmann
in
the
police
report
and
a
female
companion
of
his
standing
at
the
top
of
the
stairs
heading
to
the
downstairs
bar
and
they
were
uncooperative
and
they
were
asked
to
leave
it's
it's
obvious
from
the
video.
I
What
you
will
also
see
is
the
male
mike
lehmann
spitting
in
the
face
of
one
of
the
security
staff
that
I
submit
is
an
assault
and
battery
under
our
law
and
in
the
era
of
covet
to
spit
into
somebody's
face
is
certainly
egregious
at
best.
You
will
then
see
mr
lehmann
very
respectfully.
I
will
submit
being
escorted
outside
the
escorted
outside
by
the
by
the
staff
member
in
fenway
johnny's.
I
You
will
then
see
him
out
on
the
street
kicking
the
front
door,
and
you
will
then
see
him
pick,
mr
or
levi,
mr
damora,
on
the
street.
That's
what
you'll
see
in
that
video.
The
second
video
is
a
cell
phone
video
taken
from
a
disinterested
party
on
the
other
side
of
the
street.
It's
about
30
seconds
long
and
you
will
see
the
same
activity
from
a
different
angle
and
you
will
hear
people
on
that
video
going,
oh,
my
god,
the
girl
she's,
you
know
she's
hitting
them
in
the
face.
I
H
K
Okay,
just
for
our
do
you
have
any,
is
it
all
full
of
the
action
or
are
there
time
stamps
you
want
to
direct
us
to?
If
you
have
any
notes.
I
Yeah,
it's
it's
about
30
minutes
long.
You
really
only
need
to
see
when
you
get
about
seven
minutes
into
it.
You'll
start
you'll
start
seeing
the
action
when
the
it's
a
blonde
female
is
standing
at
the
top
of
the
stairs
and
then
that
will
continue
for
about
another
four
minutes.
That's
that's
where
the
action
takes
place.
Thank
you.
There
is
a

you

it's
it's

P
Yes,
if
I
may
begin
I'm
sure
of
the
board,
thank
you
for
having
us.
This
was
a
fairly
routine
incident
in
the
sense
that
we
followed
protocol
of
how
we
handle
incidents
similar
to
this.
Luckily,
we
don't
have
many
incidents
like
this,
but
certainly
all
protocols
were
followed.
P
Kevin
mabry,
our
general
manager
and
manager
of
record
will
certainly
go
through
the
details
of
what
occurred
that
day.
Our
bar
manager
called
9-1-1
to
report
the
incident
escalating
and
this
employee
was
actually
an
ex-employee
and
again
mr
mabry
will
will
read
the
incident
report
that
we
internally
fill
out
immediately
when
an
incident
like
this
happens
kevin.
If
you
would.
S
Yes,
absolutely,
madam
chairman,
members
of
the
board,
thanks
for
having
us
today,
I'm
going
to
read
from
the

written
by
scott
miles
himself,
the
victim
in
this
case
it
goes
as
follows:
ex-employee
manny
pena
shows
up
intoxicated
and
sits
on
the
patio
outs
with
outside
alcohol.
I
go
to
tell
him.
This
is
not
allowed.
He
becomes
agitated
and
walks
into
the
restaurant.
At
this
point
I
follow
him
and
tell
him
again
he's
not
allowed
to
be
in
here.
S
He
starts
to
become
very
confrontational,
so
I
ask
him
to
leave
and
escort
him
outside,
while
he's
yelling
in
front
of
guests
and
causing
a
disturbance.
He
follows
me
outside
verbally
then
physically
assaulting
me.
He
tackles
me
to
the
ground
for
a
moment
and
then
walked
away,
at
which
point
we
called
the
police
officers.
A
Great,
thank
you,
chairman
joyce.
Any
questions.
B
I
just
have
a
comment:
thank
you
for
calling
the
police
for
such
an
incident.
These
are
the
things
that
we
were
trying
to
emphasize
and
encourage
all
licensees
to
do
when
there
is
an
employee.
Employee,
escalated
incident,
in
this
case
a
former
employee,
but
this
is
exactly
what
we
want
you
guys
to
do.
We
will
not
penalize
you
for
calling
the
police
or
something
like
this
like.

N
Again
good
morning,
I'll
be
reading
from

Sorry

detective

signed
to
the

and
conducted
a
licensed
premise.
Inspection
of
loretta's
last
call
at
one
lansdowne
street.
The
the
inspection
took
place
during
the
red
sox
astros
american
league
championship
game,
as
detectives
walked
through
the
premise
they
observed
the
tables
to
be
on.
I
N
Tables
to
be
all
occupied
with
patrons
standing
at
the
bar
detector
hernandez
conducted
a
mechanical
account
of
the
premise
which
resulted
in
172
patrons
being
found.
The
house
count
detectives
were
given
by
the
doorman
135
patrons
the
premises
license
lists
two
different
types
of
setups,
which
also
have
different
capacities.
The
premise
was
currently
set
up
as
a
restaurant,
with
tables
and
chairs.
On
the
main
floor,
the
the
listed
capacity
under
setup
number
two
was
134.
N
C
Thank
you
screen
detective
hernandez.
Your
inspection
notice
indicates
that
management
cooperated
with
you
fully.
N
C
And
was
it
was
mr
kopko
was
with
us
this
morning?
Yes,
okay!
Thank
you
just
one
of
the
questions.
This
is
a
somewhat
unusual
circumstance
with
two
different
sets
of
capacities.
Is
that
correct.
N
C
C
Okay,
and
were
you
the
president
on
the
night
in
question
and
are
you
the
person
who
interfaced
with
detective
hernandez?
C
I
was
I'm
sorry,
I
didn't
hear
you,
I
was
okay,
and
can
you
tell
them,
can
you
tell
the
the
board
what
you
had
done
with
regard
to
the
floor
plan
on
the
night
in
question.
M
I
so
before
the
day
even
started,
we
took
out
more
than
half
of
the
bar
stools,
as
well
as
three
to
four
of
the
tables
that
were
in
the
establishment
before
the
before
the
pregame
rush.
C
And
you
you,
this
being
a
a
championship
game,
you
expected
a
big
crowd
right.
C
I
didn't
hear
you
correct.
Okay,
thank
you.
So,
in
your
opinion,
was
the
premise
operating
not
as
a
restaurant
in
the
night
in
question
and
therefore
entitled
to
the
larger
capacity.
Is
that
what
you
had
done.
A
M
C
So
could
you
explain
just
explain
what
you
do
in
the
circumstance
when
you're
trying
to
you
know
remove
if
you
all
the
restaurant
functions
of
the
room
so
that
you
get
the
greater
capacity.
M
Sure
the
tables
usually
get
sat
first
and
as
we
get
busier
and
busier
furniture
continuously
comes
out
throughout
the
day,
so
that
we
can
hit
a
larger
capacity.
C
M
C
B
Just
to
be
just
to
be
clear
as
a
restaurant,
the
capacity
is
allowed
to
be
one.
I'm
sorry,
I
just
closed
my
screen.
B
K
Sorry,
the
setup
is
the
larger
capacity
setup
has
only
24
persons
at
tables
right.
K
M
K
M
K
K
And
one
last
question:
can
you
account
for
the
discrepancy
between
the
account
that
was
given
to
the
inspectors
and
the
account
that
was
actually
in
the
restaurant.
A
Okay,
any
further
questions
from
the
board.
Okay,
thank
you.
The
board
will
take
this
matter
under
advisement.
Thank
you.
Thank
you.
Thank
you.
Item
number.
10
has
also
been
continued
due
to
a
request
from
licensees
council.
It
will
be
heard
on
february
1st
and
those
are
all
of
the
matters
before
the
board
today.
Thank
you,
everybody.
