The Licensing Board for the City of Boston holds licensed premise inspection hearings on Tuesdays, transactional hearings on Wednesdays and voting hearings on Thursdays weekly pursuant to Governor Charles Baker’s executive order (the “Order”) issued March 22, 2020, temporarily modifying certain requirements of the Open Meeting Law (M.G.L. ch. 30A s. 20) due to the ongoing public health crisis due to Covid-19 (coronavirus).

licensing
board
for
the
city
of
boston.
Today
is
monday
february,
22nd
2021..
Today's
hearing
is
being
conducted
pursuant
to
certain
temporary
amendments
to
the
open
meeting
law.
That
is
what
allows
us
to
meet
virtually
this
hearing
is
being
reported
and
will
be
posted
to
the
city
of
boston's
website.
Before
I
review
the
some
procedural
matters
I'll
introduce
chairwoman
kathleen.

I'm
chair
of
the
boston
licensing
board.
Today,
I'm
joined
by
commissioner
keanu
saxon
and
commissioner
liam
curran.
I
just
want
to
take
the
opportunity
to
remind
everyone
that
these
are
emergency
hearings,
they're
unprecedented
for
the
licensing
board,
and
they
are
in
response
to
the
coven
19
guidelines
set
by
the
state
in
the
city.
It
is
our
job
to
regulate
and
to
enforce
these
guidelines.

there
are
any

the
alleged
incident.
Each
party

assigned

licensed
premise
unit
conducted
a
licensed
premise.
Inspection
of
robbie
is
at
73
salem
street.
This
inspection
came
about
because
it
called
received
on
the
mayor's
hotline
complaining
that
the
premise
was
not
adhering
to
the
governor's
covet
19
guidelines.

detectives
entered
the
premise
they
observed
the
premise
to
have
most
of
its
tables
occupied
detective
hernandez
conducted.

mechanical

of
the
premise
which
resulted
in
31
patrons
under
the
current
phase
for
reopening
premises
must
adhere
to
a
40
percent
capacity.
Robbie's
reduced
capacity
would
be
25
patrons.

given

manager

who
stated
that
she
would
bring
the
premise
into
compliance.
As
a
result
of
what
detectives
had
observed.
Serge
detective
gallagher
issued
a
license
premise:
inspection
notice,
number,
zero,

four,

three
zero
to
robbie's;
failure
to
adhere
to
the
governor
and
boston
licensing
board
guidelines
on
covert
19
premise,
not
adhering
to
the
40
capacity.
Ms
fontaine
signed
phone
accepted
the
notice
addition
detectives
gave
a
notice
to
appear
for
today's
hearing
those,
essentially
all
the
facts.

done
everything
she's
there,
every
single
night
and
day
working
as

manager
on
record.
This
may
have
been
one
incident
honestly
that
got
away
from
her.
I
spoke
with
her
over
the
weekend
after
she
received
this
notice.
She
adamantly
denies

valentine's
day
incident
that
the
place
was
packed.
She
she
said
she,
you
know
she
does
her
best.
She
makes
sure
that
the
reservations
are
staggered.

have
come
in
and
checked

has
her
own
policy.

makes
sure
that
people
wait
outside

there

meets
that
requirement
and
doesn't
exceed
it

be
in
violation.
This
may
have
been
one

these
incidents
that
should
may
have
been
just
an
oversight.

spoke
with
her.
She
said
that
some
people
were
coming
in
and
checking
in
she
she
is
on
top
of
it.

she's
been

manager
at

comply

protocols,
especially
since
our

conversations

she's
there
every
single
night
making
sure
that
the
protocols
are
fall

apologize.

be
one
incident
where
maybe
people
may
have
been
getting
up
and
leaving
checking
in,

she

keeps
her

keep
a
better
watch
on
it.

job

the
summer

fall

adhering
to
the

guidelines.

believe
we've
had

overnight
the

in
the
guidelines
that
have
been
set
forth

over

the
sergeant
detective

there

some
patrons
that
were
on
the
upstairs
level
waiting
to
be
seated.

I
think

with
chris
over
the
weekend

night

I

he
understands
that
people,
even
though
it's
cold
out
people
need
to
wait
outside
and
it's
unfortunate
under
the
circumstances.
They

have
to
wait,
so
they
can
be
in
compliance,
as
the
sergeant
detective
indicates
downstairs
was
in
compliance.
They've
done
a
very
good
job
staff
with
all
the
other
protocols.
I
think
it
they've
done
a
good
job.

the
one
of
the
owners
last
night
and
chris
about
the
reservations
and
all
these
daggers
the
reservations

patrons
need
to
leave
within
certain
times
so
they've

everything
they
can

sure

the

protocols

think
in
this
one
here.
Unfortunately,
I
think
the
numbers
just
kind

wrapped
up
on
them,
like
I
said
they
were

compliance

downstairs.

more

have
had

upstairs,

I
think
chris
totally
understands
that
he
he's
there
on
regularly
monitoring
the

number

patrons
and
the
staff
has
done
a
great
job
with
no
violations
throughout
the
last
year.

hopefully
you
take
that
into
consideration
making
your
decision.

enforce

guidelines,

we
have
it

week

prioritize
covet
and
capacity
violations
more
than
even
underage
drinking.

noticed
that
the
establishment
appeared
to
be
over
capacity.
The
check
of
the
premises
convictions
license
revealed
that
the
restaurant's
normal
capacity
is
99
patrons
under
the
governor's
and
boston
license
aboard
temporary
covert
restrictions.
The
premise
must
operate
at
a
reduced
capacity
of
40
percent,
of
its
normal
capacity.
That
would
my
figure
would
be
40.

mr
miguel
cajus,
mr
hayes
stated
that
he
would
bring
the
assessment
into
capacity

compliance
as
a
result
of
what
the
detectives
observed.

was

failure
to
hear
the
governor's
covert
guidelines
in
the
boston

licenses

on
the
prohibition

the

establishment,
mr
gay
assigned
for
an
accepted
notice.

that
night,
the

weren't
prepared
for
that
night
because
it
was
supposed
to
be
a
snow
day
and
we
called
off
a
lot
of
our
staff.
So
we
didn't
expect
it
to
get
busy
and
the
snowstorm
never
came,
and
when
the
restaurant
got
full,
I
wasn't
able
to
control
the
crowd,
as
as
I
would
have
liked,
because
we
were
just
running
around
trying
to
handle
what
we
could.

we're

intentionally
trying

break
the
law.
It
was
an
off
night
for
us
and
as
far
as
noise
complaints,
it's
been
the
same
neighbor
who
moved
in
two
years
ago

honestly

we
had
no
prior
complaints
from
the
neighbors
and
we're
not
over
here
trying
to
be
above
the
law.
It's
unfortunate.
What
happened
that
night,
but
we're
super
strict.
We
usually
have
one
security
guard
moving
the
crowd
in
front
of
the
restaurant.

that
the

checked

the

license

that
the
restaurant's

is

seated
patrons
under
the
governor's
