The Licensing Board for the City of Boston holds licensed premise inspection hearings on Tuesdays, transactional hearings on Wednesdays and voting hearings on Thursdays weekly pursuant to Governor Charles Baker’s executive order (the “Order”) issued March 22, 2020, temporarily modifying certain requirements of the Open Meeting Law (M.G.L. ch. 30A s. 20) due to the ongoing public health crisis due to Covid-19 (coronavirus).

Today

Today's
hearing
is
being
held
pursuant
to
temporary
amendments
to
the
open
meeting
law.
That
is

allows
us

meet.
Virtually
today's
hearing
will
be
recorded
and
posted

Before

review
procedural
matters,
I
will
introduce

of

the
victim
carnivale
stated
that
the
incident
began
following
a
minor
verbal
argument
inside
the
bar
between
him
and
another
male
patron
of
sullivan's
tap.

numerous
threats
to
shoot
him.
Although
a
firearm
was
never
seen
nor
displayed
the
victim's
girlfriend
maloney
provided
an
eyewitness
account
to
the
incident
made
statements
that
corroborated
his
account
of
the
events
that
transpired
prior
to
officer's
arrival
officers
requested
ems,
the
scene
for
an
evaluation
of
the
victim's
injuries,
which
he
reported
were
very
serious,
stating
numerous
times
that
he
was
not
okay.

boston
ems,
ambulance,
three
emt's
galuchi
kennedy
and
murphy
arrived
on
scene.
However,
the
victim
refused
treatment
outright,
stating
that
he
is
a
firefighter
slash,
paramedic
and
did
not
want
to
be
treated
for
his
injuries.
The
victim
was
advised
to
re-contact
9-1-1
in
the
case
that
he
wishes
to
seek
later
medical
treatment.

not
know
when
they
would
be
coming
back
at
this
time,
officer
asked

weeks
for
their
identification
to
document
that
they
had
witnessed
the
event
and
all
parties

hesitant
to
provide
the
information
as
if
they
hadn't
seen
anything
officer.
Elvin
sent
some
minor
hesitation
to
cooperate
with
her
investigation
requested
that
the
patrol
supervisor
sergeant
holden
myself,
respond
to
the
scene
to
assist
officer.

explained
that
the
aforementioned
individuals
to
the
to
the
aforementioned
individuals
that
pro-licensing
agreements
with
the
city
of
boston
management
is
required
to
provide
a
list
of
all
employees
working
at
a
licensed
premise,
establishment
at
all
times.
So
if
they
refuse
to
do
so,
the
information
would
be
obtained
directly
through
management
at
a
later
date.

at
this
time,
cheeks
became
increasingly
confrontational
and
refused
to
do
so
weeks
and
sevilla
stated
they
didn't
know
who
he
or
she
was
or
how
to
contact
them
shortly.
Thereafter,
the
aforementioned
bouncers
presence
stated
numerous
times
that
no
manager
was
on
the
premise,
but
they
do,
but
that
they
were
on
the
way
back
and
we'll
be
back
in
about
10
minutes
officer,
alvin
and
sage
holden
waited
on
scene
for
some
time.

sergeant,
holden
and
officer
elvin
returned
to
sullivan's
tap
to
issue
a
license
premise
violation
only
at
this
time.
The
fourth
time
responded
to
this
location,
where
members
of
management
identified
the
co-owners
of
sullivan's
top
were
present
on
scene
at
this
time
or
identified
as
dana
rosenblatt
date
of
birth,
126,

and
julius
sawcall
date
of
birth.

is
absolutely
false
that

bouncers

not
know
their
names
and
have
their

managers

noon,
and
it
was
on
camera,
despite
being
apparently
absent
at
the
time
of
officer
ellen's.

know

manager's
name
and
didn't
see
anything.

captured
on
officer,
elvin's

camera

and
I
then
made
their
way
to
the
other
end
of
the
bar
in
an
attempt
to
find
a
different
employee
who
might
be
able
to
provide
the
name
of
the
manager
during
our
movement
from
the
front
of
the
to
the
back
of
the
crowded
box.
It
appears
that
an
unknown
individual
inadvertently
bumps
out
to
elvin's
body
camera,
causing
it
to
shut
off.

helpful
with
rosenblatt,
suggesting
that
I
was
intimidating
his
staff
and
causing
problems
on
purpose
and
being
unfair
after
having
so-called

violation
and
providing
him
with

lying
on

ground

apparently
been
hit.

that

not
feel
well,

attempted

call
9-1-1.

call
did
not
go
through

that
point.

brought
mr
carmali
inside
and
I
saw
a
two
officers
directly
outside
in
the
cruiser,
and
I
grabbed
mr
carmali
and
told
him
to
go,
make
the
report
to
them.

radio
call
for
assault

battery

beverly
street
boston
to
heaven
on
the
square
channel
2
dispatch
notified
two
opposit
notified
officers.
Two
males
were
fighting
inside
the
restaurant,
leaving
one
male
with
a
broken
jaw
and
a
large
amount
of
blood
dispatch
stated
the
suspect
was
a
white
male
about
28
30
years
old,
blonde
hair
wearing
a
green
celtics
jersey
fled
the
scene
in
an
unknown
direction.

responding
was
officers,
grady,
murray
genius,
samus
and
sergeant
crossing
on
arrival
officers
observed
the
victim,
william
barrington,
sitting
on
the
front
patio
with
a
large
amount
of
blood.
Next
to
his
feet,
it
was
apparent
that
officers
barrington
suffered
a
severe
injury
to
his
mouth
and
jaw.
He
immediately
stated
he
broke
his
jaw
and
officers
observed
multiple
napkins
scattered
about
a
pool
of
blood
underneath
his
feet.
Barrington
stated
he
was
standing
in
the
bar
inside
tavern
on
the
square
when
an
unknown
male
approached
him
and
punched
him
in
the
face.

only
description
barrington
could
provide
his
officers
was
a
blonde
redheaded
male
struck
him
in
the
face
with
a
closed
fist
then
fled
the
scene
immediately
after
barrington
believed
the
suspect
fled
the
area
in
an
uber
one
of
the
females
barrington
was
with
stated.
There
was
an
altercation
between
the
two
men
at
the
bar,
which
they
were
swapping
a
margarita
to
one
of
the
females
which
the
female
did
not
want.
She
then
signaled
two
hands
together,
signaling
a
fight
ensued
officers
went
unable
to
obtain
the
female's
biological
information
as
they
fled
the
scene.

Soon
after
ems
arrived
on
scene
officer,
marion
grady
then
spoke
with
a
witness
owen
mcguire,
who
stated
barrington
and
another
male
went
into
a
restroom
earlier
in
the
night
and
attempted
to
fight
multiple
people
in
the
restaurant
owen,
stated
barrington
made
his
way
over
to
the
corner
of
the
bar
and
got
into
a
verbal
altercation
with
two
other
males.
At
that
point,
barrington
took
his
hat
off
and
the
suspect
from
the
suspect
and
the
suspect
stuck
struck
barrington
with
a
close
fist
to
his
jaw.
Owen
stated:
both
men
fled
the
scene
in
an
unknown

stated
that

inappropriate

and

group
of

banging

on

they
were
denied
entry
by
security

to

reaching

when

the

their
ages.

seven
individuals
stated
that
they

years
of
age

only
