City of Boston Licensing Board Transactional Hearing: 6-2-21
A
A
Today's
hearing
is
being
conducted
pursuant
to
certain
temporary
amendments
to
the
open
meeting
law.
That
is
what
allows
us
to
meet
virtually
today's
hearing
is
being
recorded
and
will
be
posted
to
the
city
of
boston's
website.
Before
I
review
trans
before
I
review
administrative
matters,
I
will
introduce
chairwoman
kathleen
joyce.
A
I
believe
she
is
logging
on
okay.
As
a
reminder,
please
make
sure
that
you're
muted,
unless
you're
presenting
to
the
board
or
you
are
testifying-
please
ensure
that
your
audio
and
video
is
working.
If
you
are
being
sworn
in
as
a
proposed
manager
of
record,
you
will
need
to
be
on
camera
for
the
manager
of
record
questions.
We
will
take
each
item
in
the
order
it
appears
on
the
agenda.
A
It
will
be
right
into
the
record
after
which
the
applicant
will
be
given
the
opportunity
to
present
followed
by
questions
from
the
chairwoman
and
commissioners
following
questions.
There
will
be
testimony
beginning
with
elected
officials
or
their
representatives,
followed
by
any
members
of
the
general
public.
Please
note
that
when
you're
providing
testimony,
you
must
limit
that
testimony
to
two
minutes
and
please
also
state
your
full
address
and
your
full
name
for
the
record.
A
Before
we
begin
item
two
california,
pizza
kitchen
inc
is
being
rescheduled
item.
Eight
little
steve's
pizza
ink
is
being
rescheduled
in
item
9,
retail

partners.
South
bay
inc
is
being
continued
and
will
be
heard
on
the
june
23rd
agenda,
calling
candida
damaris
inc
doing
business
at
los
hermanos
restaurant
located
at
604,
blue
hill
avenue,
has
applied
for
a
common

to
be
exercised
from
the

hours
of
operation,
9

to
2

who
is
president
on
behalf
of
the
applicant.
D
C
So
we're
applying
for
a
common
returns
license
to
open
up
our
restaurant.
Our
concept
is
very
home
style,
dominican,
food,
caribbean
food.
We
hope
to
be
a
good
addition
to
the
neighbors.
We
already
spoke
to
a
lot
of
them
through
a
I
think,
the
community
liaison
and
they've
all
they
know
what
we're
doing.
They're,
okay
with
it
they're
happy,
and
they
look
forward
to
it
and.
B
Sure
I
have
a
couple
questions:
how
many?
How
many
seats
will
you
have
in
this
at
this
location.
C
I
believe
we
applied
for
nine.
F
Can
everyone
hear
me
all
right?
Sorry,
I
have
some
background
noise
going
on.
This
is
json
gantt
from
the
mayor's
office
of
neighborhood
services,
we'd
like
to
go
on
record
in
support
of
this
proposal.
They
held
in
the
butters
meeting
may
24th,
where
they
answered
questions
and
concerns
from
the
community.
Members
and
they've
been
working
with
the
project,
wright
airport
association,
and
I
would
just
urge
them
to
continue
working
with
them
for
any
forthcoming
questions
or
concerns
that
the
community
may
have.
A
A
Items
three
and
four
together:
legal
seafoods,
llc
doing
business
as
legal
seafoods
located
at
26
park,
plaza
and
doing
business
as
ltk
bar
kitchen
located
at
225
northern
avenue.
The
aforementioned
licensees
have
petitioned
to
change
the
corporate
name
of
the
licensed
business
from
legal
seafoods
llc
to
lsfw
llc.
Secondly,
has
petitioned
for
a
change
of
llc
manager,
attorney
andrew
upton
attorney
upton.
G
Thank
you
very
much
good
afternoon,
madam
chair
hello,
everyone,
andrew
upton
for
the
applicant.
I
might
suggest
that
number
five
would
be
appropriate
to
consider
in
this
batch
as
well.
G
Two
operators
who
will
then
use
them
so
that
is
basically
all
there
is
this
is
the
assets
are
still
owned
by
the
berkowitz
family.
This
is
just
a
corporate
change
to
get
it
into
a
structure
that
can
be
sold.
B
Okay,
thank
you
attorney
upton.
I
don't
have
any
questions,
commissioner
curran,
do
you.
A
A
for
the
record,
the
board
has
received
significant
correspondence
regarding
this
application.
This
is
not
a
request
for
a
full
liquor
license
to
take
the
place
of
the
existing
wine
and
wall
beverages
license.
This
is
a
change
of
classification
to
allow
for
the
sale
of
cordials,
who
is
president
on
behalf
of
the
applicant.
I
I
I
Obviously
we
all
know
what
happened
on
march
16th
of
last
year.
I
did
reopen
last
summer
and
then,
due
to
the
lack
of
business
and
the
restrictions,
we
went
into
hibernation
in
october
of
last
year
and
then
reopened
approximately
six
weeks
ago.
I
have
had
many
requests
from
my
customers
to
change
and
try
to
serve
full
liquor.
I
I
As
everybody
knows,
many
restaurants
have
clothes
in
kenmore
square,
including
pizzeria,
uno,
eastern
standard,
the
hawthorne
and
island
creek
oysters.
I
do
think
that
this
will
be
a
relatively
low
impact
change.
It's
a
restaurant
that
accommodates
86
patrons
when
there
is
no
outdoor
seating
and
it's
about
115
with
outdoor
seating.
I
I
have
a
30
year
track
record
with
the
licensing
board
in
the
city
of
boston
as
a
licensed
holder,
and
I
I
don't
think
I
take
a
back
seat
to
anyone
for
being
a
responsible
operator
and
being
responsive
to
the
communities
that
I
do
business
with,
and
I
I
just
think
this
will
be
a
added
amenity
for
my
guests
and
give
us
a
little
bit
better
opportunity
to
succeed.
I'm
happy
to
answer
any
questions
or
concerns
you
may
have.
B
Thank
you,
mr
bacon.
As
we
ask
all
applicants
who
are
either
looking
for
a
new
license
or
for
a
change
of
classification,
we
asked
them
to
elaborate
on
the
public
need,
and
I
think
you
described
a
couple
of
restaurants
in
the
general
area
that
are
recently
closed.
How
many
restaurants
have
closed
in
this
area?.
I
So
four
eastern
standard
island
creek
oysters
the
hawthorne
and
pizzeria
uno,
to
my
knowledge,
the
pizzeria
uno.
I
have
no
knowledge
about
whether
it's
going
to
reopen
or
whether
they've
sold
their
liquor
license.
My
understanding
from
reports
in
the
boston
globe
is
the
other.
Three
restaurants
are
going
to
reopen
at
some
point
in
the
next
year,
but
there's
plenty
of
demand
from
my
clientele.
Even
if
those
restaurants
reopen
and
they're
requesting
this
change.
B
A
J
Yes,
good
afternoon,
madam
chair
members
of
the
board
lisa
high
with
the
mayor's
office
of
neighborhood
services.
They
have
done
proper
outreach
and
have
received
a
number
of
support
from
the
abutters,
but
we
do
want
to
point
out
that
they
did
receive
an
opposition
from
the
kenmore
square
business
association.
J
A
K
Yes,
I
would
my
name
is
david
rossi
and
I
own
a
business
in
the
neighborhood
called
copley
clinical
and
a
lot
of
our
staff
like
to
frequent
the
kenmore
and
we'd
like
to
support
the
application,
because
you
know
so
many
restaurants
have
closed
and
it's
good
to
you
know
have
this
establishment
thriving.
So
thank
you
for
this
opportunity.
A
A
Calling

holder
of
a
common

seven-day
all-alcoholic

license,
has
petitioned
for
a
change
of
officers,
directors
and
stockholders.
Secondly,
is
petition
for
a
change
of
stock
ownership
interest.
Lastly,
is
petitioned
to
change
the
manager
of
the
licensed
business
from
philip
aviles
to
michael
aveels
attorney,
mark
ivload,
giannis.
L
Good
morning,
members
of
the
board,
madam
chairman,
mark
of
liabi's
for
cuisinarts
inc-
I
have
with
me,
miss
michael
aviles,
essentially
a
number
of
years
ago,
her
husband,
philip
aviles,
who
had
opened
the
restaurant
17
years
ago,
passed
away.
He
committed
suicide,
he
left
without
a
will,
and
the
estate
was
put
into
probate
after
some
time
in
probate
and
taking
care
of
all
the
debtors
that
were
associated
with
the
restaurant.
L
The
norfolk
probate
court,
which
I
provided
paperwork
to
you
allowed
and
approved
mrs
avilas
to
take
over
the
estate
and
issued
the
shares
of
stock
100
percent
shares
of
stock
in
cuisinarts
inc
into
her
name.
So
today
we're
basically
doing
an
administrative
cleanup
of
the
license
in
so
doing
so.
We're
trying
to
get
her
put
on
as
the
owner
of
the
rightful
owner
of
the
shares
and
as
the
manager
of
record
masa
restaurant
has
been
a
neighborhood
bar
for
over
17
years.
L
Unfortunately,
with
covid
hitting
the
the
restaurant
was
closed
and
can
no
longer
operate,
we
just
don't
have
the
staff
with
the
ability
to
continue
down
that
road.
This
is
an
administrative
cleanup
of
the
license
so
that
eventually,
we've
made
an
agreement
with
the
landlord
who
owns
the
building.
He
also
owns
several
other
restaurants
in
boston.
He
will
be
taking
over
the
license
and
taking
over
the
space
and
at
some
point
in
time
in
the
future,
opening
the
restaurant
as
some
other
restaurant.
B
Thank
you
attorney.
I'm
going
to
ask
mrs
avilas
the
four
standard
manager
of
record
questions
and
we
should
be
okay.
Mrs
avilas,
are
you
a
citizen?
I
am.
Are
you
a
resident
of
the
commonwealth?
I'm
sorry
sagan.
Do
you
live
in
massachusetts?
B
I
do
yes.
Do
you
have
experiences?
Okay,
do
you
have
experience
in
the
food
and
beverage
industry?
Yes,
I've
been
in
the
restaurant
for
the
past
15
years.
Okay
and
the
last
question
we
ask
anyone
who's
being
sworn
in
as
manager
of
record
is,
do
you
have
ex
do?
Are
you
familiar
with
the
rules
and
regulations
of
our
board,
the
abcc
and
the
laws
of
the
commonwealth
as
they
pertain
to
the
sale
and
service
of
alcohol?
Yes,
I
do.
Okay,
I
don't
have
any
questions.
Thank
you
for
joining
us.
I'm
sorry
for
your
loss.
Commissioner.

N
We
are
again,
as
was
mentioned,
applying
for
a
package
license
to
sell
beer
and
wine
at
this
grocery
store
just
to
point
out
a
couple
of
notes.
One.
This
is
the
only
grocery
store
in
the
orient
heights
area.
It
is
located
right
within
a
neighborhood
shopping
district
of
east
boston.
In
the
orient
heights
area,
they
are
full
service,
store,
selling,
dry
goods,
all
kinds
of
canned
goods
as
well
as
produce.
N
There
has
become
a
need
from
their
client
base,
as
they
come
off
of
orion
heights
t
station,
walking
to
their
condos
and
they're
buying
dinner
and
food
food
at
this
site
to
have
barren
wine,
and
there
is
a
strong
public
need
for
it.
They
would
be
the
only
grocery
store
in
this
area
and
there
is
no
other
store,
selling
beer
and
wine.
N
Other
than
a
few
of
the
restaurants
in
the
immediate
area,
the
closest
location
would
be
across
a
busy
highway
busy
intersection
on
bennington
street
and
a
little
bit
of
a
walk.
So
this
is
convenient
for
folks
coming
right
out
of
the
t
station,
the
hours
of
operation
of
the
store
are
7
am
to
11
pm
the
size
of
the
stores.
Roughly,
it's
one
story
with
storage
in
the
basement,
1734
square
feet.
N
N
Who's
on
here
has
been
working
and
managing
this
location
during
that
entire
time.
We
believe,
based
on
those
points,
that
there
is
a
strong
need
for
this
application.
Miss
patel
is
a
citizen
of
the
united
states,
she's
a
massachusetts
resident
and
is
familiar
with
rules
and
regulations
for
selling
alcohol.
I
can
pause
now
for
any
questions
that
the
board
may.
I
B
Thank
you
attorney,
drago.
Just
to
clarify
for
the
record,
you
stated
that
the
closest
store
that
sells
beer
and
wine
is
about
how
far
away.
N
So
it's
across
bennington
street,
so
it
would
be
across
the
four
lanes.
I'd
say,
probably
roughly
maybe
600
feet
but
across
the
intersection
and
it's
only
a
liquor
store.
There's
no
other
pros.
B
N
It's
going
to
be
a
section
roughly
like
two
or
three
shelves
that
would
have
you
know
in
coolers
that
would
have
craft
beers
a
wide
selection
of
international
wines
based
on
feedback
that
he
heard
from
consumers,
and
that
would
all
be
with
an
eye
shot
of
the
cash
register
as
well.
B
Okay
in
this,
ms
patel
here
yeah.
B
On
under
yogendra,
okay,
thank
you.
Your
attorney
covered
most
of
the
manager

questions,
but
just
to
get
the
third
one
on
the
record.
Do
you
have
experience
in
the

industry?
Yeah?
Okay,
thank
you
very
much.
I
have
no
other
questions,

Thank
you

you
will

Thank
you
very
much.
It's
nice
to
be
back
before
the
board.
Again,
it's
been
a
long
time
and
it's
an
honor
to
be
so
I'm
here
before
the
board,
with
my
friend
neighbor
and
client
matthew
delisle,
who
is
a
partner
for
the

charlestown
known
as
the
gaslight

llc,
and
we
are
seeking
a
restricted
beer
and
wine
license
for
a
new
shop
that
we
hope
to
open
or
my
client
hopes
to
open
at
40
main
street
in
charlestown.
H
H
H
H
Matt
is
my
upstairs
neighbor
and
I
live.
We
both
live
at
50
main
street,
and
this
area
is
absolutely
it
is
void
or
devoid
of
a
lot
of
depth.
That
would
be
brought
if
a
fresh
pasta
and
wine
shop
will
be
allowed
to
to
open
here.
What
we're
asking
the
board
to
do
is
to
grant
this
limited
license
so
that
they
can
begin
to
operate.
H
The
idea
is
that
it
will
be
a
retail
store
where
people
who
are
walking
home
from
downtown
when
the
downtown
area
opens
up
again,
we'll
stop
by
the
shop
and
get
pasta,
bread,
other
retail
items
and
bottle
of
wine
or
six
pack
of
beer.
The
idea
here
is
it's
going
to
be
only
retail,
it's
a
section,
15
license
no
thing
or
no
alcohol
be
served
inside.
There
will
be
no
seating
inside.
H
H
Peter
will
be
making
fresh
pasta
in
the
big
windows
that
are
right
on
main
street.
In
the
gaslight
district
of
charlestown,
it
is
going
to
be
an
open
door
where
people
can
come
in
there's
so
many
families
here
in
charlestown
now
it'll
be
a
great
opportunity
to
shop
for
something
other
than
in
one
food
store
that
services,
the
entire
area,
which
is
whole
foods,
and
it's
got
a
monopoly
on
everything,
but
it
doesn't
provide
what
matt
and
peter
hope
to
do.
I
just
want
to
circle
back
and
say:
these
are
amazing
chefs.
H
This
is
not
going
to
be,
let's
go,
buy
some
pasta
and
try
and
sell
it
to
the
public.
This
is
going
to
be
an
enterprise
where
the
fresh
product
is
going
to
be
the
selling
point,
and
it's
going
to
be
a
destination
point
for
a
lot
of
people
in
charlestown,
hopefully
the
north
end,
and
otherwise,
because
you
rarely
see
an
opportunity
where
chefs
of
this
caliber
are
going
to
be
open
in
a
retail
store
to
try
and
service
a
a
niche
area.
H
H
You
have
to
live
in
charlestown
to
know
that
there's
a
public
need
for
it.
There's
just
really
nothing
here:
ironsides
clothes,
legal,
seafood's,
closed,
there's,
no,
no
idea
when
anything
will
open.
H
Charlestown
in
this
area
has
two
restaurants
that
serve
hamburgers
and
french
fries
and
that's
about
it,
and
so
we're
hoping
that
with
the
opportunity
to
provide
charlestown
will
be
enriched
by
the
efforts
to
open
main
street
pasta
and
wine
and
and
to
do
so
responsibly
and
with
the
duty
that
I
understand
comes
with
the
license.
M
Hi,
how
are
you
yes,
matthew,
delilah
here
for
the
main
street
possible
gaslight
district
and
just
you
know
very
excited
to
bring
something
new
to
charlestown
and
yeah.
I've
been
a
long
time
living
there
for
about
15
16
years
and
the
above
in
the
same
building
without
the
chin
family,
and
you
know
just
happy
to
answer
any
questions
and
excited
to
be
part
of
this.
B
M
B
M
I
would
say
approximately
five
blocks
down
main
street
towards
the
opposite
way,
so
towards
the
whole
foods.
There
is
a
charlestown
liquors,
which
is,
I
would
say,
a
larger,
more
commercial
style
package
store
and
we
will
definitely
be
looking
to
be
more
of
a
niche
kind
of
finer
wines
and
more
interesting
beer.
Wine.
M
H
If
I
may
so,
we
have
notified
all
the
butters
yesterday
peter
magoo,
and
I
canvassed
the
neighborhood
with
the
butters
notice.
There
is
still
a
community
hearing
to
be
held,
which
is
scheduled
for
next
tuesday,
with
mr
romano,
who
god
bless.
Him
is
working
his
butt
off
to
cover
all
the
different
neighborhoods
in
charlestown
and
north
end
and
wherever,
but
we
still
have
one
component.
Yes,
yet
to
do
and
we're
looking
forward
to
it.
We
had
a
great
day
peter,
and
I
yesterday
walking
the
neighborhood
and
passing
out
the
flyers
and
talking
to
people.
H
You
know,
as
I
just
said
earlier,
there's
just
really
nothing
in
charlestown
and
we
need
a
unique
place
like
this
to
open.
A
O
Members
of
the
board-
this
is
john
romano
from
the
mayor's
office
of
neighborhood
services,
as
scott
alluded
to
they
have
their
waters
meeting
next
week.
So
we
just
asked
that
decision
be
deferred
until
such
time
as
the
abutters
have
a
chance
to
weigh
in.
Thank
you.

The

on

approximately
400

E
Yes,
good
afternoon,
members
of
the
board
and
miss
hawkins
monte
cristo.
This
was
a
restaurant
that
was
in
operation
previously
under
a
different
name,
but
served
the
same
menu
in
cuisine
it
operated
with
10
years.
It
did
have
a
beer
and
malt
liquor
license
at
the
time
of
the
sale
of
the
restaurant,
we
had
hoped
to
transfer
the
license
to
my
clients.
E
However,
that
was
not
possible,
so
we
had
to
apply
from
scratch
and
we
are
in
the
process
right
now,
as
you
can
see,
of
trying
to
obtain
the
wine
and
malt
liquor
license-
and
this
is
a
citizen
of
the
united
states
and
he,
I
believe,
is
a
resident
of
the
city
of
boston.
E
Again,
the
seating
capacity
is
18..
This
restaurant
primarily
is
take
out,
but
there
is
a
seating
capacity
for
18
people,
so
there
are
times
when
the
restaurant
would
be
better
served
if
they
did
continue
on
with
the
beer
and
malt
liquor
that
was
allowed.
E
When
the
last
owners
were
granted
the
license,
we
did
send
out
all
the
notifications.
I
haven't
received
any
negatives
and
I
do
have
end
this
on
the
line.
If
you
have
any
questions
as
far
as
he's
concerned,.
P
B
Yep.
Thank
you,
mr
ventura.
Your
attorney
already
answered
the
first
two
manager
of
record
questions:
you're,
a
citizen
and
a
resident
of
the
commonwealth.
P
P
P
B
Okay,
just
going
back
to
the
presentation,
there's
18
seats,
it's
primarily
take
out
what
does
it
primarily
mean
like
what
percentage
of
your
sales
would
you
say
your
dine
in
verse,
takeout.
P
A
J
Yes,
madam
chair
members
of
the

lisa
hi
with
the
mayor's

of

my

shanice
pimental,

in
a
butters
meeting
on
march,
2nd
2021.
The
mayor's
office
would
like
to
go
on
record
to
support.
We
do
not
have
any
concerns
at
this
time
as
they
are
located
in
the
main
streets
and
there
are
similar
bear
and
wine
licenses
in
the
area,
but
do
ask
that
they
continue
to
work
with
the
neighborhood.
Thank
you.

The

is
located
on
the

and
food

In
the
large
basement
area,
the
restaurant
is
approximately
1
500
square
feet.
H
Thank
you.
This
is.
This
is
one
if
you'll
give
me
a
little
more
time.
I'd
appreciate
it.
This
one
is
particularly
near
and
dear
to
my
heart.
Fernando
has
opened
a
picture
there.
H
It's
somebody
I've
known
and
look
at
as
a
little
brother
in
ways,
and
he
he
has
opened
a
business
having
come
from
el
salvador
struggled
to
get
here,
made
it
here
with
his
sister
and
was
able
to
work
mostly
two
jobs
a
day
in
order
to
feed
his
family
and
feed
himself
and
to
have
housing,
and
I
met
him
10
years
ago
at
the
oceanaire,
where
he
was
a
bartender
and
he
was
just
the
best.
H
He
treated
us.
Well,
I'm
sorry
I
get
choked
up,
but
this
is
a
guy
rooted
for
he
has
opened
this
restaurant
and
yesterday
I
sent
two
little
snippets.
I
hopefully
the
board
got
to
see,
one
of
which
was
a
chronicle
piece
on
this
restaurant
and
the
other
was
a
northeastern
article
and
it's
just
a
unique
place
run
by
new
unique
people.
H
It
is
basically
a
bakery
when
you
walk
in
and
then
in
the
back.
There's
seating
with
a
tv
and
now
in
the
summer
he's
got
some
outdoor
seating.
You
know
I've
known
him
forever
and
this
covert
year
was
brutal.
H
Nobody
was
coming
in
and
they
were
still
baking.
They
start
at
four
o'clock
in
the
morning
and
they're
open
till
10
at
night,
and
I
would
go
visit
and
there
were
some
days.
I
was
the
only
person
in
the
store
and
I'm
a
diabetic,
so
I
shouldn't
even
be
doing
that,
but
it's
a
unique
place
and
run
by
a
man
who
has
got
14
years
of
restaurant
experience.
H
H
H
There
is
a
public
need
because
every
other
place
is
a
bar
that
serves
food,
and
this
is
a
restaurant
that
wants
to
serve
beer
and
wine
to
its
customers
and
help
make
ends
meet
fernando
hasn't
gotten
a
paycheck
until
last
month
and
has
lived
with
his
wife
doing
most
of
the
work
and
to
pay
for
their
family
they've
endured
a
lot
and
I'm
hopeful
that
the
board
will
consider
not
only
the
neighborhood,
not
only
the
responsibility
that
I've
talked
to
him
about,
and
he
understands,
but
that
this
is.
H
There
is
a
couple
of
wrinkles
due
to
covid
his
chance
to
get
citizenship
was
not
advanced
he's.
Everything
in
he's
got
a
green
card
when
I
applied
for
the
application
and
maria
spoke
to
me
about
this,
god
bless
her.
H
His
wife,
who
is
here
sitting
next
to
him,
aaron
sheila
young,
is,
is
willing
to
be
the
manager
of
record.
He
is
in
the
path
and
she
will
be
there
because
she
works
at
northeastern,
so
she
can
work
in
the
summer
and
he
can
watch
the
kids
and
vice
versa,
but
she
will
be
there
throughout
the
summer
and
we
are
hoping
to
advance
his
application
for
full
citizenship
along
so
that
he
can.
Then
we
can
make
the
switch
back
to
fernando.
I
call
fernando
it's
manuel
fernando
roses.
H
B
Interrupt
here
before
we
go
any
further,
there's
a
there's,
a
defect
in
the
application.
If
he's
not
a
citizen,
I'm
going
to
have
to
turn
it
to
leslie,
it's
a
very
moving
story
and
I
sympathize,
but
you
applied
for
manuel
to
be
the
manager
of
record.
We
want
to
be
helpful
to
you.
We
can't
just
swap
it
out
the
day
of
the
hearing.
No.
A
I
think
my
suggestion
attorney
homes,
because
you've
done
the
the
legal
notices
and
because
a
manager
of
record
does
not
require
a
publication,
but
it
means
there's
a
defect
under
the
open
meeting
law
with
our
our
posted
notice.
My
suggestion
would
be
that
we
defer
the
entire,
because
we
can't
vote
on
on
the
application,
because
the
manager
of
record
is
not
a
us
citizen,
so
we
legally
under
chapter
138.
We
don't
have
that
ability,
but
what
we
can
do
so
that
you
don't
have
to
again
pay
for
the
legal
notice
and
the
butter
notifications
is.
A
My
suggestion
would
be
that
you
continue
this
matter
until
the
june
23rd
hearing
will
work
with
maria
to
ensure
that
this
is
properly
posted
for
the
manager
of
record
note,
that's
a
continuance
for
the
manager
record
corrected
portion
to
be
heard
at
that
hearing.
But
legally
the
board
cannot
vote
on
this
matter
because
there
is
a
defect
in
the
application.
A

Alcoholic

are
6
30

to
2

from

to

that
would

R
Medicare

marcie
cosley,
mcdermott,
kelty

miller
on
behalf
of
the
applicant.
As
said
the
proposed
licensee
is
asking
for
an
on-premise
all-alcoholic
beverages
license.
It
is
currently
the
holder
of
a
stevie
license
that
has
been
operating
in
the
south
end
for
10
years.
They
actually
just
celebrated
their
10-year
anniversary.
R
At
that
location.
The
license
will
continue
to
offer
expertly
made
espresso
bread,
espresso
beverages,
daily
coffee
selections,
breakfast
sandwiches
and
bagels
served
all
day
with
sandwiches
and
salad
made
fresh
to
order
and
a
variety
of
pastries
and
desserts.
R
So
the
concept
is
not
meant
to
change
at
all.
It's
going
to
be
the
same.
Neighborhood
cafe
that
everybody
in
south
end
has
grown
to
enjoy.
The
addition
of
the
alcoholic
beverages
will
just
be
to
give
some
give
the
customers,
you
know
a
place.
They
want
to
go
two
times
a
day
instead
of
one.
You
can
start
your
day
off
there
in
the
morning
and
you
can
end
it
there
at
night.
It
won't
be
a
bar,
a
nightclub,
anything
like
that.
R
It's
meant
to
be
a
calm
place
where
you
can
go
and
enjoy
yourself
in
terms
of
the
proposed
hours
of
operation.
We
are
requesting
the
maximum
2
a.m
closing
hour.
However,
the
hours
of
operation
are
likely
to
be
6
30
a.m,
until
11
p.m,
sunday,
through
thursday
and
6
30
a.m
until
midnight
on
friday
and
saturday.
Of
course,
anil
is
aware:
he
can't
serve
alcohol
that
early
in
the
morning,
so
the
eight
o'clock
in
the
morning
alcohol
service
time
monday
through
saturday
and
then
at
10
a.m.
R
On
sundays,
he's
aware
that
that's
when
he
can
start
service,
however,
he
is
primarily
a
coffee
and
breakfast
pastries
establishments,
so
those
early
morning
hours
are
important.
The
2
am
closing
hours,
also
in
line
with
his
other
locations.
R
Just
for
that
flexibility
of
that
later
hour,
however,
as
I
mentioned
during
the
week,
he
does
plan
on
actually
having
a
closing
hour
of
11
during
the
week
and
midnight
on
the
weekends.

that
you'll
be
serving?
What
will
you
be
serving
the
beer
and
wine
with
or
they
all
like?
It's
not
an
egg
sandwich.
I
don't
imagine.
S
Right,
no,
I
mean
like
marcy
mentioned,
it's,
the
concept
isn't
changing
at
night
we
find
most
people
coming
in
for
desserts,
for
example,
after
having
dinner
somewhere
and
they
you
know
they
get
like
a
coffee
based
cocktail.
S
We
do
our
like
sandwiches
all
day.
We
do
some
like
charcuterie
cheese,
platters
yeah,
just
like
small
snacks
and
desserts.
B
Okay
and
you
how
many
other
locations
do
you
have
in
the
city.
B
Okay
and
where
in
this
neighborhood
is
the,
are
there
any
other
restaurants
that
sir
sit
down?
Restaurants
that
serve
alcohol
in
this
general
vicinity?
Could
you
let
the
board
know.
R
There
are
madam
chairs
kind
of
diagonally
across
the
street,
is
toro
and
then
on
the
same
side
of
the
street
is
equator.
They
both
do
hold
alcohol
licenses.
However,
the
concept
of
both
of
those
restaurants
is
very
different.
They
are
much
more
of
a
sit-down
dinner
establishments,
whereas
yahoo
is
very
much
more
of
a
cafe
concept
coming
in
the
morning
coming
in
the
afternoon,
it's
open
all
day,
really
just
a
community
based
space.
R
B
R
Madam
chair
public
need
is
that
there
really
is
nothing
with
this
concept
in
the
neighborhood
and
neil
has
found
through
his
other
locations
in
the
back
bay
and
in
the
downtown
neighborhood
that
his
clientele
really
enjoy,
having
the
opportunity
to
have
a
place
in
the
neighborhood
where
they
can
relax,
enjoy
a
snack,
a
dessert,
something
and
something
to
drink
at
the
end
of
their
day,
the
middle
of
their
day
or
even
in
the
morning.
Who
knows
if
it's
an
exciting
saturday
for
some
reason
and
you'd
like
a
drink
in
the
morning.
R
T
Hi
yes,
good
afternoon,
madam
chair
and
members
of
the
board,
my
name
is
kim
crucioli
from
mayor's
office
of
neighborhood
services.
The
mayor's
office
would
like
to
go
on
record
in
support
of
this
proposal,
and
a
butters
meeting
was
held
on
may
20th,
where
support
was
shown
by
butters.
I've
received
eight
letters
of
support
for
this
proposal.
T
They
also
have
the
full
support
of
the
blackstone
franklin
square,
neighborhood
association
and
support
from
the
worcester
square
area,
neighborhood
association,
under
the
circumstances
that
they
stopped
serving
outdoors
at
10
pm
during
the
week
and
11
pm
on
the
weekends
and
have
all
patrons
out
at
12
30..
The
mayor's
office
feels
that
this
proposal
matches
other
restaurants
in
the
area
like
bar
lion,
toro
and
equator,
and
with
that
we
get
full
support.
Thank
you.
A
T
But
that
was
the
support
from
the
worcester
square,
the
mayor's
office,
giving
false
part
of
the
proposal.

the

D
D
We
have
been
here
just
shy
of
18
years.
We
opened
our
business
in
this
area
when
most
of
these
surrounding
businesses
were
boarded
up.
We
do
now
have
come
to
three
that
are
that
are
have
been
closed
for
a
number
of
years.
D
People
are
spending
ridiculous
amounts
of
money
to
live
here
and
we
just
feel
like
we
need
to
change
with
the
times
we
have
done
well
with
this
coffee
shop.
We
would
like
to
add
this
liquor
license
to
the
shop
so
that
it
will
enable
us
to
open
up
at
night
years
ago.
We,
we
were
open
till
11
pm
here
and
we
were
serving
coffee
and
ice
cream
over
the
last
three
years,
because
there
has
been
such
a
change
in
our
neighborhood.
A
lot
of
the
families
have
been
priced
out.
D
We
haven't
done
so
well
with
the
ice
cream,
so
we've
decided
to
let
that
go.
We
would
like
to
open
this
business.
It's
a
very
large
store
front.
You
know
big
glass
windows
on
a
corner
and
it
is
dark
up
here
at
night
and
we've
had
two
other
businesses
across
the
street
from
us.
That
also
did
follow
suit
and
closed
at
night.
Shortly
after
we
did,
we
are
looking
now
to
bring
some
life
back
into
this.
D
This
area
get
the
lights
back
on
at
night
and,
as
I
said
a
few
minutes
ago
changed
with
the
times.
We
are
often
having
people
come
in
and
asking
us
if
they
can
sit
and
have
you
know
their
breakfast
and
maybe
a
drink,
and
now
we're
watching
them
get
into
cabs
and
go
over
to
south
boston
or
down
the
other
end
of
dawn
ave
to
the
lower
mill
section
I
live
in
this
neighborhood.
D
My
family
owns
this
building.
I'm
raising
my
four
children
here,
two
of
them
on
property.
My
oldest,
is
just
married
with
her
first
child
we're
not
going
anywhere.
My
reputation
is
on
the
line
up
here,
so
I
do
plan
on
keeping
this.
D
You
know
just
the
way
it
has
been
a
respectable
place,
a
place
that
our
community
has
come
to
for
many
many
years
and
it's
it's
been
kind
of
a
gathering
area
in
this
section
of
the
city.
I
the
plan
is
right
now
to
open
up
at
night.
I
think
you
know,
between
five
and
ten,
maybe
continue
to
offer
our
coffee
drinks
and
some
of
our
sandwiches,
but
mostly
we're
gonna
start
adding
our
high-end
desserts
at
night.
People
can
come
in.
Have
their
dessert
have
a
cocktail.
D
It
gives
our
little
area
a
chance
to
come
again
stay
in
our
neighborhood.
You
don't
have
to
get
into
a
car
or
you,
but
to
go
to
a
different
section
of
the
neighborhood
and
just
bring
that
life
back
back
here.
They
can
have
a
drink.
It's
not
going
to
be
as
loud
as
some
of
the
other
bars
there's
a
lot
of
us
that
you
know
a
lot
of
these
bars
are
really
servicing
the
younger
crowd.
D
So
I
feel
like
we.
We
could
definitely.
I
feel
confident
enough
that
this
would
work.
I
do
know
that
there
is
a
need
for
this
here.
As
I
said
earlier,
I've
been
here
long
enough.
I've
seen
it
changed.
I've
survived
the
changes.
We've
you
know
made
it
through
covid.
D
It's
just
now
time
to
change
with
the
times,
and
I
would
rather
have
it
continue
to
be
me
than
have
to
turn
around
and
hand
it
over
to
some
stranger.
B
Mrs
baker,
I
just
have
a
couple
of
questions
for
you
for
the
record.
We
have
to
ask
the
manager
of
record
questions
of
every
applicant
who
is
seeking
an
alcohol
license.
Are
you
a
citizen?
Yes,
are
you
a
resident
of
the
commonwealth?
B
D
B
Okay,
so
just
a
couple
questions
you're
going
to
be
opened
in
the
morning
and
then
close
for
a
couple
hours
and
reopen
at
night
the
application
states
that
they'll
be
seating
for
19..
Now
I'm
familiar
with
this
location,
the
19
seats
are
right
when
you
first
walk
in,
but
then
you
have
the
room
in
the
back.
Is
that
is
that
going
to
be
part
of
your
ultimate.
D
B
D
Will
be
appearing
before
the
licensing
board?
Again,
I'm
going
to
work
with
isd,
because
I
do
have
a
quite
large
room
in
the
back
that
we
haven't
utilized,
but
I
do
plan
to
add
some
seating
back
there.
It's
just
it
didn't
make
sense
for
me
to
go
through
that
process.
If
I
didn't
know
you
know
if,
before
I
started
the
process
of
the
liquor
license.
B
Okay-
and
my
other
question
is
where
would
you
say
the
closest
liquor
license
is
to
your
location.
D
So
that
would
be
two
to
four.
It's
probably
point
two
of
a
mile
where
the
polish
triangle
is
about
51
acres.
I
believe-
and
we
have
one
sit-down
restaurant-
that
has
a
liquor
license
and
the
difference.
You
know
it's.
D
If
you
look
at
the
city,
there's
a
lot
of
different
places
where
you
can
just
walk
and
have
something
to
eat
or
have
a
drink,
and
this
this
area
just
doesn't
have
that
the
difference
is
that
again,
I
would
be
a
store,
basically
in
the
center
of
it
all
that
that
is
going
to
be
open
in
the
morning
and
also
at
night.
I
definitely
don't
want
to
give
up
that
morning,
business,
and
nor
does
this
community.
B
No,
I
understand
that
I
don't
have
any
other
questions.
Commissioner
carr,
do
you.
A
U
Good
afternoon
manager,
chairman
of
the
board,
patrick
fandale,
mayor's
office,
neighborhood
services,
we'd
like
to
find
record
in
full
support
of
this
proposal.
The
applicant
has
met
with
the
macquarie
civic
association,
with
no
concerns
raised
there,
we'd
just
like
to
go
on
the
record
in
support
we're
very
excited
about
seeing
this
application
move
forward
in
this
commercial
area.
Thank
you.
A
V
V
Councilwoman
george
would
like
to
go
on
reckon
full
support
of
this
and
echo
the
sentiments
of
the
mayor.
Thank
you
very
much.
A
Right
seeing
none,
we
will
take
this
matter
under
advisement.
Before
we
finish,
I
did
note
that
an
email
came
in
from
attorney
silverman.
I
believe
you
would
also
requested
that
the
a
temporary
cv
be
approved
for
monte
cristo,
regardless
of
any
action
on
the
liquor
license.
