that
the
initial

sir.
B
Thank
you
very
much.
Detective
I'll
now
ask
Mr
barrows.
Would
you
like
to
address
the
election
incident.
E
Yes,
thank
you
I'd,
just
like
to
state
that
I
was
not
at
the
scene.
That
night
my
manager
was
on
duty
and
I
just
wanted
to
commend
the
officers
for
doing
a
great
job,
preventing
escalation
of
the
incident.
E
The
incident
took
place
that
the
City
parking
lot
Municipal
parking
lot
and
unfortunate
incident
beyond
our
control
and
just
like
to
say
that
we,
we
are
continuing
to
make
sure
when
our
Patriots
patrons
leave
the
restaurant,
that
they
immediately
immediately
get
in
their
vehicles
and
and
leave
the
area.
C
Sorry
I
don't
know
if
it's
for
the
detective
or
for
officer
Moran
or
for
Mr
Barris,
but
who
called
the
police.
F
On
scene
scene
that
night
I
was,
after
my
ship
had
ended,
I
believe,
as
the
offices
stated
in
the
report,
the
boss
police
became
aware
of
a
potential
for
an
altercation
to
occur
at
restaurants.
This
area
and,
as
a
result,
several
units
responded
that
one
of
the
there
was
a
two-man
two
sorry
two
officer
unit
directly
across
the
street
on
Draper,
which
one's
perpendicular
to
Bowden
Street,
which
is
directly
across
from
the
restaurant
okay.
So.
F
Have
been
on
scene
saw
an
altercation
start
to
happen
and
then
proceed
in
the
into
the
municipal
parking
lot
adjacent
into
the
rear
of
the
restaurant.
C
Okay,
so
can
someone
describe
for
me
this,
where
this
Municipal
parking
lot
you're
saying
it's
adjacent
to
the
restaurant.
F
E
No,
you
know
the
back
door
opens
up
to
our
own
parking
lot
and
then,
when
you
go
through
the
restaurant
and
the
the
rare
you
end
up
through
a
gate
there.
You
you
end
up
in
the
municipal
parking
lot
on
the
side
of
the
building.
It's
two
doors
down
from
our
restaurant
there's
another
restaurant
between
ours
and
and
the
parking
lot.
C
C
I
know
you
weren't
there
on
the
night
of
this
incident,
but
your
manager
was.
Did
you
speak
with
him
after
this
incident
occurred.
E
Yes,
we
were
all
they
were
all
at
the
restaurant
inside
the
restaurant
preparing
to
just
close
the
night
as
they
usually
did
they
just
they
were
aware.
Afterwards,
after
they
saw
the
lights
police
lights,
that
there
was
an
incident
taking
place
on
the
parking
lot.
C
You
say
that
you
work
to
make
sure
your
patrons
leave
safely.
Can
you
describe
to
me
what
that
security
plan
is
like
this
time
of
night
out
by
that
door?
That
leads
to
the
parking
lot.
E
We
just
we
have
two
doors:
that
exit
one
on
the
front
to
Baldwin
Street
and
one
that,
if
people
park
in
the
parking
lot,
they
leave
through
the
back.
We
just
make
sure
people
get
in
their
cars
and
don't
hang
out
talking
to
each
other
and
make
sure
they
don't
turn
on
the
music
and
the
cars
to
respect
our
neighbors
and
just
all
right.
C
E
C
And
what
do
they
do
to
make
sure
patrons
leave
safely?
Tell.
E
Them
to
to
please
get
in
their
cars
and
not
hang
out
talking
to
each
other
as
they
you
know,
sometimes
tend
to
do
just
conversing
and
just
prevent
any
anything
from
happening.
C
And
so
you
had
four
four-door
people
working
that
night.
E
C
Okay,
I
may
have
other
questions,
but
I'm
going
to
turn
it
over
to
commissioner
Curran
and
then
commissioner
Saxon.
D
Yes,
so,
as
detective
stated
to
the
the
third
line
of
my
report,
so
we
had
Intel
from
inside
the
restaurant
that
something
was
gonna
happen.
So
that's
why
we
staged
our
crews.
Are
there
and
was
just
observing
what
the
patrons
were
doing
and
why
there
was
other
officers
coming
to
that
area.
G
E
That
might
have
been
other
officers
that
might
be
in
the
restaurant
that
might
have
been
at
the
restaurant
that
might
have
alerted
officials,
but
there
was
no
incident
at
all
inside
the
restaurant,
no
altercation,
nothing
at
all
inside
the
restaurant.
That
would
have
indicated
to
us
that
there
was
a.
There
was
a
something
about
to
happen
to
us
that
you
know
we're
not
we're
not
if
there's
no
fight
or
any
altercation
inside
the
restaurant,
we
wouldn't
know
anything
is
about
to
happen
outside.
G
All
right
and
then
officer,
Moran
again
it's
the
way
I'm
reading
it
is
a
large
number
of
patrons
came
out
of
the
back
door.
Is
that
correct,
yeah.
D
So,
where
that
vehicle
was
parked,
where
the
suspect
was
was,
it
was
the
car
that
was
closest
park
to
the
rear
door
of
the
restaurant.
So
we
were
only
about
roughly
20
to
25
feet
from
the
door
of
the
restaurant,
okay,
and
so
the
Patriots
were
all
exiting.
G
D
I
would
believe
so.
Yes,
because
it
was
a
large
group,
began
exiting
and
that's
when
everyone
became
confrontational.
D
G
D
So
we
saw
him
exit
the
restaurant
from
the
front
door
and
that's
when
we
heard
him
screaming
on
the
phone
kind
of
sounded
like
he
was
looking
for
someone,
because
he
was
saying
where
you
at.
Where
are
you
at
that's
when
he
immediately
walked
to
the
left
side
of
the
restaurant
into
the
parking
lot
to
the
rear?
Where
me
and
my
partner
were
just
observing
his
movements
and
just
followed
him.
G
Okay,
I
think
that's
all
I
have
at
the
moment.
Thank
you.
K
Just
to
on
itself,
so
not
the
municipal
one,
but
the
one
that's
actually
adjacent
to
the
restaurant
is
it
well
lit.
Are
there
cameras.
E
E
I'm
not
sure
if
the
officers
retrieved
any
any
data
from
the
camera,
but
it
it
saves
it
for
about
two
and
a
half
weeks.
If
there
was
nothing
retrieved,
I,
don't
believe
we
have
any
images.
E
No,
it
wasn't
removed
by
the
officers
it
wouldn't
have
been
preserved.
G
F
So,
sir,
in
this
case
here
the
gentleman
was
arrested
on
scene
Mr,
Lopes
I
had
in
my
at
least
the
follow-on
stuff
that
I
was
assigned.
I
had
no
reason
to
believe
anything.
There's
nothing
much
watching
the
the
officers
bought
cameras.
F
Etc
captures
everything
that
are
you
starting
on
my
ends
as
far
as
the
criminal
violations,
I
think,
all
the
officers
on
scene,
the
volume
one
cameras
capture
everything
respectively,
so
I
had
no
reason
to
believe
that
anything
took
place
inside
of
the
restaurant
from
the
reports
and
the
following,
along
with
the
the
body.
C
F
Cameras,
that's
that's
kind
of
where
we're
at
I
I
know,
I
didn't
recover
anything
from
inside
the
restaurant
or
the
exterior
cameras
from
the
parking
lot.
Due
to
the
fact
everything
I
needed
was
on
on
the
offices
body,
one
cameras.
Okay,
thank
you.

J
Thank
you,
Sergeant

the

J
All
right,
that's
all
I
have
for
the
sergeant.
It
is
it's
our
our
position
that
this
was
a
very
quick
and
immediate
situation.
It
was
not
a
foreseeable
event.
We
had
a
very
quick
and
professional
response
with
staff
and
the
call
to
the
police
I
think
the.
J
A
bit
of
testimony
from
the
general
manager
who
was
on
scene,
if
that's
all,
right.
N
J
N
J
J
N
J
She
accept
yeah,
okay,
what
have
you
done
since
this
incident
to
prevent
something
like
this
from
happening
again.
N
So
I've
worked
here
for
like
10
years
and
I've,
never
seen
a
guy
hit
a
girl
for
hitting
on
her
and
turning
her
down.
But
we
talked
to
all
the
bar
staff,
the
security
and
asked
them
to
pay
attention
to
young
women
that
are
on
by
themselves
or
receiving
any
sexual
harassment
or
any
attention
that
they
don't
want.
And
then
we
just
follow
through
with
them
getting
an
Uber's
outside
and
making
sure
that
they're
with
people
that
they
know
all.
J
You
very
much
attorney
green.
That's
all
we
have
I
would
like
to
just
point
out
that,
despite
the
reference
in
the
police
report,
there
were
no
capacity
issues.
There
were
no
allegations
of
service
to
underage
people.
There
were
no
citations
for
any
issues
of
capacity
underage
or
intoxication,
and
it
is
correct
that
they
do
have
a
crowd
of
Irish.
People
come
to
watch
the
football
games,
but
they
are
asked
for
ID
just
like
anyone
else
and
if
they
don't
have
a
mass
driver's
license.

Thank

Sergeant
with

to
address
the
alleged
incident.
A
Here
we
go,
hi
I
was
the
bartender
on
duty.
My
name
is
Nancy
pazani.
A
We
were
unaware
of
anything
that
went
on
in
the
parking
lot
until
a
customer
had
called
me
and
told
me,
there
was
a
scuffle
going
on
in
the
parking
lot
I
exited
the
bar
through
the
rear
door
and
went
over
to
the
gentleman
standing
in
between
the
vehicles
over
there,
and
one
of
them
was
on
the
phone
with
the
police.
I
took
his
phone
to
talk
to
the
police
and
tell
them
the
correct
address
of
where
we
were
located
at
because
he
didn't
know
where
we
were
located
at.
A
They
had
been
in
the
bar
prior
to
it,
but
they
only
had
the
one
drinks
that
they
left
on
the
table
and
I
thought
they
had
gone
outside
to
smoke.
A
cigarette,
so
I
didn't
think
nothing
of
to
watch
them
on
the
camera
and
I
knew
nothing
until
I
watched
the
camera
system
myself
about
what
went
on
in
the
parking
lot.
A
Okay,
they
do
have.
You
do
have
a
video
camera
system.
A
B
H
Yes,
I
just
kind
of
understand
how
I
could
go
somewhere
for
the
first
time
and
end
up
in
the
hospital.
On
the
day
of
my
wedding
that
that,
like
amazes
me,.
H
I
only
had
one
drink
at
that
bar
I.
Never
that
was
my
first
time
did
I,
never
finished
the
whole
drink
and
when
I
walked
out
of
that
place,
someone
just
walked
up
on
me,
so
I
turned
around.
They
just
stabbed
me
and
then
it's
Perfection
right
now,
I
haven't
been
back
to
work
since
that
day
and
any
day
now
I'm
going
in
for
another
operation.
Because
of
this
incident.
B
Thank
you,
Mr
Bush,
we're
very
sorry
to
hear
that
anything
else,
you'd
like
to
add
for
the
board,
or
can
we
move
to
questions.
C
I
have
a
few
questions
in
the
police
report.
Mr
Bush
says
that
you
or
a
friend
of
the
other
victim.
H
H
J
H
Why
not
we
ended
up
at
this
bar?
One
of
my
friends
was
playing
pool
man.
My
other
friend
was
sitting
at
the
table.
I
had
one
drink
and
a
Corona
beer
I
did
not
even
finish
and
I
realized.
One
of
my
friends
was
intoxicated.
I
was
like
listen,
I'm
ready
to
go
because
he
was
driving,
I
wasn't
driving
at
the
time
and
that's
when
we
left
once
we
got
to
the
parking
lot.
C
C
Okay,
all
right.
So
my
question
is
for
Miss
pasani.
So
what
happened?
You
said
nothing
happened
inside
when
you,
when
you
reviewed
the
camera
footage,
tell
us
what
happened.
A
So,
as
I
watched,
the
camera
I
noticed
that
they
were
sitting
up
against
the
wall,
that
on
a
small
table
next
to
the
pool
table,
one
of
their
friends
was
playing
pool,
no
arguments
involved
in
the
bar.
Nobody
was
fighting
with
each
other,
they
were
actually
talking
with
other
customers
and
then
they
left
and
went
outside
and
their
drinks
were
still
on
the
table.
So
I
didn't
touch
their
drinks.
A
I
just
left
them
there,
because
they
had
gone
to
the
parking
lot
and
I
thought
they
went
to
go
smoke,
but
they
were
out
in
the
parking
lot
for
quite
some
time
in
the
back
of
the
parking
lot
way
in
the
corner
next
to
their
truck
in
somebody
else's
car,
don't
know
what
they
were
doing
over
there,
but
they
were
over
there
for
quite
some
time
and
the
next
thing
everybody
was
having
a
nice
time
in
the
bar.
A
The
next
thing
another
customer
had
called
me
on
the
buy
phone
and
said
to
me:
Nancy
go
outside
in
the
parking
lot.
There's
a
scuffle
going
on
in
the
parking
lot
I
proceeded
outside
and
that's
when
I
noticed
they
were
very
far
in
the
back
part
of
the
parking
lot.
Like
the
camera
system
kind
of
goes
over
there.
You
can
kind
of
see
a
little
bit
of
it,
but
it's
really
dark
over
there.
A
C
Thank
you,
commissioner.
Current
have
any
questions.
A
A
G
H
A
You
have
to
go
out
the
front
door,
take
a
right
and
then
the
parking
lot
is
right.
There
is
it
kind
of
like
across
the
street.
No,
it's
it's
like
directly
right.
Next
to
the
bar,
like
you
have
to
go
like
there's,
eight
there's
the
bar,
then
there's
a
street
which
is
a
small
little
Street,
and
then
the
parking
lot
is
connected
right
there,
it's
across
the
a
street
right.
P
G
G
G
Have
the
police
tracked
him
down?
Sorry.
P
Sorry,
it's
just
starting
to
sell
them
again.
I,
don't
believe
we
tracked
him
down
I
I.
This
has
been
the
signs
of
detective
I
kind
of
only
have
information
on
my
initial
response.
Yeah.
That's
all
the
information
I
have
at
this
time.
Sir
detective
Deborah
might
have
some
follow-up
information.
I
know
he
interviewed
both
the
victims
so,
but
as
far
as
as
my
end
of
it,
I
just
risk
wanted
that
knife
of
the
person
stabbed.
So
they
didn't.
No
one
was
identified
on
scene
as
the
person
who
did
it.
P
H
No,
no,
where
we
we
just
left,
we
left
the
ball.
We
wasn't
in
the
parking
lot
for
five
minutes.
We
was
actually
going
straight
to
their
car.
When
this
person
came
up,
it
wasn't
one
minute
later
it
was
like.
The
person
must
have
came
right
out
after
us
and
that's
when
the
incident
happened
and
he
was
belligerent
started.
Talking
about
somebody's
gonna,
get
murdered
and
I
turned
around
and
I
got
poked.
B
Thank
you.

you.

At
code,
35
licensed
premise:
inspection
was
completed,
At
the
quiet
few
located
at
331,
Sumner,
Street,
East
Boston
present
during
this
protection
or
certain
detective
Blas
and
tactospino.
At
the
time
of
inspection,
the
person
in
charge
of
the
establishment
establishment
was
Josh
Weinstein
at
the
conclusion
of
the
inspection
Weinstein
signed
and
accepted
for
licensed
premise
notice:
zero,
two
two
six,
eight
two,
the
violation
noted
The
Following
over
capacity,
the
capacity
was
49
and
the
actual
count
was
63..
Q
Q
You
very
much
this
particular
establishment.
Madam
chair
members
of
the
board,
has
a
capacity
of
49.
this
evening
was
game,
six
of
the
NBA
Finals
according
to
Josh,
and
he
can
certainly
reiterate
it
was
a
busy
night
full
inside
plus
the
outdoor
patio
was
in
operation
with
approximately
25
to
30
people
and
nine
staff
members,
including
Josh
himself,
plus
three
back
of
three
employees
in
the
back
of
the
house,
two
bartenders,
a
bar
back
one
patio
server
and
a
doorman
by
way
of
background
and
just
for
informational
purposes.
Q
The
business
does
utilize
a
doorman
Thursday
through
Sunday
nights
and
on
tis
and
anticipated
busier
evenings
such
as
this.
This
particular
doorman
has
been
in
the
business
for
two
and
a
half
years
and
certainly
understands
the
importance
of
keeping
track
of
capacity
for
public
safety
reasons,
as
does
ownership
and
does
not
allow
for
entry
beyond
their
posted
limit.
Q
I
know
and
Josh
can
can
speak
to
this.
He
had
a
conversation
with
police
when
they
visited
that
evening
regarding
whether
staff
comes
towards
overall
capacity,
which
he
was
under
the
impression
they
were
not
which
again,
he
had
nine
staff
on
including
himself
that
night
and
because
of
the
existing
staff
exit
through
the
kitchen
and
the
rear
of
the
premises
again.
Outdoor
patio
is
quite
full
as
well.
Q
We
aren't
sure
if
some
of
those
patrons
were
also
counted
by
police
by
mistake
and
some
may
have
been
permitted
to
come
in
to
use
the
restroom,
but
given
the
licensees,
understanding
previous
understanding
or
confusion
regarding
whether
staff
counts
toward
the
overall
capacity.
Even
given
this
the
count
of
63
the
benefit
of
the
doubt,
the
infraction
would
be
de
minimis
minus
the
staff
on
duty.
That
evening
this
particular
license
premises
has
been
in
operation
since
April
2019,
and
since
that
time
the
record
speaks
for
themselves.
Q
They've
been
an
excellent
operator,
no
violations
to
speak
of
even
when
they
have
them
visited
on
similar
busy
nights,
never
any
violations
at
this
time.
Josh.
If
there's
anything,
you
would
like
to
add.
Please
feel
free
to
do
so.
Otherwise,
we're
both
happy
to
answer
any
questions.
The
board
might
have.
M
Yeah
I
just
want
to
add
that
the
time
of
the
violation
1005
is
right
when
the
patio
was
closing,
so
it
it
is
a
bit
at
10
o'clock,
everybody's
off
the
patio,
so
I'm
not
sure
what
the
what
time
the
officers
arrived,
but
it
was
a
busy
night.
So
I'm
not
sure
it
was
a
busy
patio
night
I'm,
just
not
sure,
to
how
much
commotion
there
was
with
people
taking
off
going
to
the
bathroom
before
they
take
off
closing
tabs
whatever
it
might
be.
B
B
You,
chairman
Joyce,
do
you
have
any
questions.
G
How
many
seats
on
the
interior
on
the?
How
is
it
set
up
that.
M
Evening
I'm
sorry
I
haven't
seen
under
that.
M
G
So
40
46
40
stools
is
all
you're
seated.
M
No
there's,
as
far
as
sorry.
M
M
There
is
standing
room,
there's
a
area
at
the
front
of
the
bar
where
I
mentioned,
there's
a
rail.
We
have
four
stools
there,
but
usually
that's
a
area
that
people
stand
at.
Q
Commissioner
Karen
and
Josh,
if
I
can
jump
in
I
think
that's
what
I
was
trying
to
explain
in
the
beginning.
There's
definitely
some
confusion
based
on
some
prior
professionals,
when
Josh
first
opened
the
premises
as
to
whether
or
not
staff
were
included
in
the
total
count
for
the
overall
capacity
Josh
was
under
the
impression
they
were
not.
Q
He
has
since
learned
that
they
are,
but
he
was
operating
under
the
the
fact
that
night,
that,
because
of
the
exit
in
the
back
because
of
the
availability
of
that
that
the
back
of
the
house,
any
back
of
the
house
staff
did
not
count
towards
overall
capacity
so
that
there
was
just
some
point
of
confusion
there
with
that
number
of
people.
Okay,.
G
G
G
Maybe
there's
some
confusion
about
the
four,
but
it
doesn't
sound
like
you
were
even
running
it.
You
were
even
even
if
I
were
to
Discount
the
four
kitchen
staff
in
the
back.
It
sounds
like
you're
running
over,
especially
at
that
time,
where
you're
closing
the
patio
and
people
might
be
coming
into
the
interior.
So
well.
Q
I
think
there's
also
a
discrepancy,
though,
as
well
of
what
the
staff
believes
they
had
on
their
counter,
which
wouldn't
have
been
over
49.
So
we
again,
we
don't
know
where
the
police
were
counting
the
additional
people,
because,
frankly
they
don't,
they
don't
operate
over
capacity,
but
for
I
guess
the
staff
confusion
issue
on
whether
or
not
they
count
towards
that.
G
Yeah,
but
even
then
he
said
that
they
would
have
nine
people
over
the
40..
Just
he
just
said
it
now,
and
he
wouldn't
have
nine
people
over
the
40..
You
would
have
like
two
over
the
40
with
if
you're,
counting
the
front
of
house
staff.
G
B
Thank
you
very
much
without
the
board
we'll
take
this
matter
under
advisement.
Thank
you.
Thank
you.
Thank
you.
B

Miss

on

detective
Gallagher
observed
an

Inspectional

have
expired
back
in
January
of
2021,
no
posted
city
of
Boston
entertainment
license
or
outdoor
dining
approval
form.
These
issues
were
brought
to
the
attention
of
Miss
sukenic
Mr
kennick
was
unable
to
produce
the
current
licenses
for
those
issues,
but
stated
she
would
Rectify
them
as
soon
as
possible.
T
As
a
result
of
what
was
observed,
trying
to
detective
Gallagher
issue,
the
licensed
Parish
inspection
known
as
zero
five,
eight
nine
three
two
to
formage
for
no
outdoor
dining
approval,
no
posts
and
entertainment
license
or
current
ISD
certificate
is
Tatiana.
Sukenik
signed
for
an
accepted
the
notice
as
well.
S
Yeah
so
when
the
officer
arrived,
yes,
I
was
working
in
a
kitchen
and
unfortunately,
I
was
caught
our
guard
and
so
ICD
certificate.
I
did
have
I.
Just
couldn't
find
it
so
next
day
when
he
showed
up
again
I
think
it
was
an
Excel
following
day
and
I
showed
it
to
him.
2022
July
date
of
July,
but
it
was
just
a
few
days
expired.
So
I
was
working
on
a
new
one
and
I
updated
that
so
every
license
is
updated.
S
Every
certificate
is
updated
by
now,
even
our
door,
dining,
and
at
that
time
I
was
open
just
a
few
days
a
week,
because
my
mother
passed
away
in
Ukraine
and
my
friend
passed
away,
and
it
was
a
war
in
Ukraine
and
the
most
important
one
of
the
most
important
employee
issues
so
and
unfortunately,
I
apologize,
I
was
so
disorganized
and
it
was
not
displayed
like
license
were
not
displayed
on
the
on
a
wall.
S
I
think
I
had
too
much
in
my
hand,
but
now
everything
is
organized.
I
have
all
licenses,
everything
is
updated,
yeah
our
door
license,
I
got
entertainment,
license
and
inspectional
certificate
is
updated
and
already
there
I
apologize
for
that.
I.
S
S
And
I'm
sorry
I
didn't
show
up
for
that
meeting
because
when
I
talked
to
Christopher,
Rockwell
I
believe-
and
he
said,
don't
what,
because
the
reason
is
I
did
send
an
application.
I
think
it
was
May
15th
if
I'm
not
mistaken,
and
then
I
showed
this
to
officer
when
he
arrived
the
he
followed
up
the
second
day
or
third
day
I,
don't
remember,
and
when
I
talked
to
Christopher
he
said:
I
can't
find
it,
but
later
they
did
found
it.
It
was
some
kind
of
loss.
S
I
have
no
idea,
and
he
said
you
need
to
update
some
more
information
because
there's
new
regulation-
and
so
that's
what
I
did
and
I
was
kind
of
like
trying
to
tell
him.
Yes,
I
did
send
it
on
a
May.
15Th
I
did
send
it
I
I,
have
it
I
I,
unfortunately,
I
couldn't
find
it
I'm.
Sorry,
I'm
really
really
sorry.

My
last

does
have
a
picture
that
detective
Hernandez
did
take.
This
is
from
the
outside
on
the

looking
to
the
inside
and
shows
a
serving
car
that
was
blocking
the
the
egress
from
the
inside
and
also
the
table.
We
just
set
up,
we've
been
back
accents
and,
and
the
situation
has
been
rectified.
O
I
I
just
want
to
apologize
for
what
had
happened.
The
card
usually
is
not
in
that
spot.
I
think
they
had
moved
the
tables
around
to
accommodate
any
bigger
party
outside
and
they
did
not
move
the
cart
back
and
that's
usually
the
spot
that
it's
currently
in
is
the
permanent
spot
for
it
and
then,
as
far
as
the
inside
tables,
we
did
move
it
to
a
different
area
so
that
there
is
a
nice
passageway
and
just
apologize
for
the
inconvenience.
B
Thank
you
