The Licensing Board for the City of Boston holds licensed premise inspection hearings on Tuesdays, transactional hearings on Wednesdays and voting hearings on Thursdays weekly pursuant to Governor Charles Baker’s executive order (the “Order”) issued March 22, 2020, temporarily modifying certain requirements of the Open Meeting Law (M.G.L. ch. 30A s. 20) due to the ongoing public health crisis due to Covid-19 (coronavirus).

the

When
you
are
called,
I
will
ask
for
the
representatives
on
behalf
of
the
licensee,
the
individuals
from
the
boston
police
department
and
any
other
individuals

knowledge
of
the
alleged
incident
who
wish
to
testify.
Those
individuals
will
be
sworn
in.
After
that
time,
the
boston
police
department
will
read
the
police
notice
into
the
record,
and
then
the
chair
and
the
commissioners
will
have
the
opportunity

ask
questions
of
the
licensee.

standard

inspection

pintaco
located

congress
street,
while
walking
up
to
the
establishment
dessert
detectives
observed
a
portable
chalkboard
on
the
sidewalk
advertising.
Take
on
margaritas
detectives
then
walked
inside
and
observed
a
table
displaying
beers
and
buckets
and
bottles
of
wine.

establishment's
conviction
is
licensed,
restricted,
restricts,
take
out
alcohol
upon
reviewing
the
license
and
permits
of
the
establishment
detectives
observe
that
there
were
13
widescreen
televisions
operating
inside
the
establish

entertainment
license
only
authorized
four
wide
screen
televisions.

had
also

opening

up,

was
some
confusion
as
to
which
states
were
opening
back
up.
They
have
locations
in

which
were
opening
up
mount
massachusetts
was
not.

what
happened,

think
part
of
the
problem
was.
There
was
a
lot
of
confusion
during
that
first
initial
week
of
cobid,
with
a
license
closures
and
openings.

they
have
implemented
a
new
policy
that
no
local
manager
may
take
any
action
without
checking
with
corporate
compliance
first
to
ensure
that
whatever
they
are
doing
is
legal.

to
make
sure
that
an
incident
like
this
would
not
happen
again

local
manager
would

not
authorized

licensed
premise
unit
conducted
a
licensed
premise:
inspection
of
pink
taco
at
374
conga
street
side.
The
premise
detectives
observed
two
young
looking
patrons
sitting
at
a
table
with
mixed
alcohol
drinks
in
front
of
them
thinking.

two
were
underage
detectives
approached
identified
themselves
as
boston
police
and
requested
the
ids,
the
young,
male
and
female
hesitated
at
first
then
informed
detectives
that
they
were
only
18
years
old
when
asked
if
they
were
guarded
by
pink
taco
staff.
They
both
replied
yes
and
provided
detectives
with
the
fraudulent
mass
driver's
license
used
to
order
alcohol
detectives
sought
out
the
manager,
john
boucher
and
informed
him
of
their
findings.
Mr
boucher
informed
detectives
that
he
would
speak
to
staff
and
request
id
scanners
from
corporate.

what
detectives
have
observed

issued
licensed
premise:
inspection
notice,
number,

to
the
pink
taco
for
persons
under
21
possession
of
alcohol.
On
premise
mr
john
boucher

signed
for
and
accept
the
notice
addition
detectives
will
seek
criminal
complaints
against
both
for
minus

possession

alcohol
and
possession
of
fake
ids.

essentially
are
the
facts.

think
the
licensee
wants
to

know
reiterate
that
we
understand
that
a
license
is
a
privilege
and
not
a
right
and
there's,
no
matter
how
it
happens.
There's
really
no
excuse
for
a
minor
to
have
alcoholic
beverages
in
their
possession
on
licensed
premises.

That
being
said,
the
licensee
has
undertaken
a
number
of
steps
to
try
to
prevent
behavior
like
this
from
ever
happening.
Again.
First
of
all,
all
of
the
employees
were
retrained.
Pt
opco
has
two
training
programs,
an
internal
training
program
and
an
external
training
program
just
to
ensure
that
they
have
their
own
internal
programs,
not
accredited,
and
an
external
training
program
to
make
sure
that
employees
are
properly
trained.
They
do
retrain
quarterly
to
make
sure
that
everybody
stays
up
to
date.

happened
after
this
incident
was
everybody
was
immediately
retrained.
In
addition,
new
policies
were
put
in
place
at
the
license
location.
Anyone
who
looks
like
they're
under
30
years
old
is
now
asked
for
a
second
form
of
identification
and
if
a
license
looks
like
it's
questionable,
the
manager
is
called
over
to
inspect
the
license.

In
addition,
when
persons
are
carded-
and
they
do
not
have
the
secondary
form
of
identification
or
their
license,
looks
questionable,
they're
not
allowed
to
stay
in
the
premises
and
order
food
without
alcoholic
beverages,
they're
asked
to
leave
the
premises.
The
licensee
was
uncomfortable
if
somebody's
turning
in
a
fraudulent
id
or
a
questionable
id
is
uncomfortable
that
that
person
may
try
to
get
an
alcoholic
beverage
from
a
different
portion
of
the
licensed
premises.
So
they
are
just
asked
to
leave
to
avoid
any
type
of
issues
granted.
That's
it.

lose
some
revenue
over
that,
but
it's
more
important
that
no
minor
have
access
to
alcoholic
beverages
over
the
revenue.
The
third
step
that
they
have
taken
is
when
the
license
premise
is
busy.
The
hosts
in
the
hostess
stand
have
been
moved
outside
from
the
doorway
further
out
towards
the
street.
The
licensee
has
found
that
that
way,
it's
easier
to
streamline
the
patrons
coming
in
and
when
there's
there's
no
possibility
of
an
incident
where
a
crowd
comes
in
and
a
person
is
missed
and
not
carded.

kids

they
should
have

picked
it
up,

once

scan

best
way

form
of

one

ids

not

the
person's
name,
but
that
being
said,
we
were
more
than
happy
to
get
scanners
that
the
thinking
behind
that
is,
we,
the
licensee
trains
their
employees
to
to
look
at
touch
and
feel

license,
and
they
want
to
make
sure
that
their
employees
stay
in
the
habit
of
doing
that
and
don't
just
run
it
through
a
scanner.
But
if
for
any
questionable
license,
if
we
feel
that
an
additional
scan,
additional
scanner
would
help
prevent
issues
we're
more
than
happy
to
do
that.

and

from

to

was
a
party
going
on
what
happened
with

this
property.

that
it's
a
mixed-use
building,
it's
commercial
and
it's
residential,
so
the
tenants
that
live
above
the
restaurant
they
have
access
to
the
backyard.

So
I
explained
to
sergeant
gallagher
that
I
would
take
care
of
it
and
I
would
not
allow
that
happen.
Also,
I
explained
to
the
tenants
that
which
I
don't
own,
the
building
that
they
can't
come
in
in
the
property
and
if
they're
gonna
play
the
music,
they
will
have
to
play
the
music
with
the
door
closed
and
they
actually
comply.

I
receive
a
few
visits
from
detectives
since
then,
and
they
can
testify
that
there
has
not
been
any
hookah
and
there
has
not
been
any
music
playing
and
the
several
visits
they
have
issues.

So
I
apologize
for
the
incident.

it

happen

and
since
then

has

taken
care

police
in
boston
as
detectives,
walked
to
the
outside
patio.
They
observed
three
females,
drinking
beers
and
mixed
alcoholic
beverages.
Detectives
noticed
these
patrons
appeared
young.
The
detectives
asked
them
to
produce
identification
to
confirm
their
ages.
One
patriot
immediately
stated
that
she
was
under
21
years
of
age.

other
two
preachers
stated
that
they

over
21
years
of
age
and
produced
valid
massachusetts
driving
license,
stating
they
were
over
21
years
of
age.
Upon
further
investigation,
it
was
determined
that
well
one
female
did
have
in
her
possession
of
mass
driver's
license
belonging
to
her
sister,
which
used
to
purchase
alcohol.
Detectives,
then
determined
that
the
female
did
have
it
in
her
possession
a
mass
vowel
driverless
belonging
to
her
cousin,
which
she
used
to
purchase
alcohol.

driver's
license
of
the
family
members
presented
to
detectives
by
the
two
patrons
were
confiscated.
It
should
be
noted
that
all
three
patrons
stated
that
they
used
the
restaurant
app

their
phone
to
order
the

the

arrived,

were
never
asked
for
identification
by
