The Licensing Board for the City of Boston holds licensed premise inspection hearings on Tuesdays, transactional hearings on Wednesdays and voting hearings on Thursdays weekly pursuant to Governor Charles Baker’s executive order (the “Order”) issued March 22, 2020, temporarily modifying certain requirements of the Open Meeting Law (M.G.L. ch. 30A s. 20) due to the ongoing public health crisis due to Covid-19 (coronavirus).

district

on
the
south
end
of
boston
and
I'll

reading
the
police
report
around
1
40
on
tuesday
january
14
2020,
while
assigned
to
the
front
desk
at
district
district
4.
cadet
smith,
took
a
walk
and
assault
report
from
stuart
sinclair.
The
incident
occurred
at
the
mandarin
hotel
at
776
boylston
street.
The
victim
stated
that
on
112
2020
at
around
8pm,
he
was
at
the
bar
at
the
mandarin
hotel
when
he
was
getting
ready
to
leave.
He
was
attacked
unprovoked
by
a
male
suspect.

victim
stated
he
was
putting
a
chokehold
thrown
to
the
ground
and
punched
repeatedly
until
the
host
hotel
staff
pulled
the
suspect
off
of
them.
It
should
be
noted
the
victim
stated.
The
police
were
not
called
to
the
incident.
The
victim
stated.
He
went
to
south
shore
hospital
the
following
day
and
he
sustained
a
concussion,
and
he
also
stated
that
he
did
not
get
a
good
look
at
the
suspect,
but
the
suspect
was
636
for
white
male
with
facial
hair
and
that
there
was
video
available.

and

did
meet
with
greg
o'neill.
He
was
very
cooperative
and
I
did
obtain
video
of
the
incident

show
this
alleged
assault
and
a
license.

just
important
to
note
to
the
board

this

this
incident
occurred.

They
have
been
closed
for
several
months
now.
The
mandarin
oriental
is
obviously
still
open,
but
the
the
restaurant
itself
has
been
closed
and,
as
a
result,
a
majority
of
the
staff
are
no
longer
employed
there.

So

know,
I
don't
believe
that
the
hotel
or
their
staff
had
any
reason
to
believe
that
an
incident
would
occur.
It
sounded
like
it
happened
very
quickly,
but
one
of
the
security
offices
did
intervene.

Rather,
you
know
almost
immediately
when
he
saw
that
there
was
a
physical
altercation
and
he
separated
the
the
individuals-
and
I
believe
mr
o'neill
will
testify
to
this
as
well,
that
he
removed
the
aggressor
from
the
property
in
his
party
and
also
had
a
chance
to
speak
to
the
victim.
Shortly
thereafter
asked
if
he
required
any
assistance
or
aid
and
the
victim
declined
any
help
at
that
time
and
surely
left
the
premises.

o'neill,
in
addition
to
his
position
as
a
manager
of
record,
is
also
the
director
of
security
at
the
hotel
and
he's
held
that
position
for
many
years,
and
I
know
he
takes
this
very
seriously
in
his
staff
in
terms
of
trying
to
de-escalate
any
type
of
situation
and
handle
it
as
appropriately
as
they
can
given
the
fact
that
it
seemed
like
it
was
unprovoked
in
a
very
quick
event.

incident

occurred,

but
basically
what

you
just
stated
is
quite
accurate.

happened
very
quickly
and
a
very
quiet
night
in
the
bar
very
unexpected
two
parties,
seated

believe
one
said
something
that

other
took
offense
to
and
escalated
physically
very
quickly.

staff
was
very
close
by
security
officer
intervened,
de-escalated,
the
situation
got
both
parties
separated
and
they
both
partied
left

quickly
at
the
conclusion
of
the
of
the
incident
once
it
was
resolved.

it
was,

something
that
was
not
foreseen
but
did
happen
very
quickly
and
I
thought
was
handled
quite
well.

the

but
my
concern
is
that
the
police
were
not
called
and

assailant

very
irate,

imagine

resulted
in
the
physical

focus
and

to
keep
the
party
separated
and,
as
I
said
as
they
got
everyone
out
and
outside
of
the
bar,
they
left
very
quickly
in
separate
vehicles.

assigned

licensed
premise
unit
conducted
licensed
premise:
inspection
of
miha
cantina,
located
at
one
faneuil
hall
marketplace
in
boston,
as
detectives
walked
through
the
outside
patio.
They
observed
three
patrons
later
identified
as
carol
fletcher
sailor
tyson
and
sydney
runcher
drinking
mixed
alcoholic
strengths,
detectives
notice
that
these
patrons
appeared
younger
detectives
asked
them
to
produce
identification
to
confirm
their
ages,
patrons
immediately
stated
they
were
under
21
years
of
age.

The
patrons
then
produced
fraudulent
massachusetts
drivers
license
that
could
contain
the
individual's
correct
name
but
display
the
date
of
birth,
which
made
it
appear
as
though
they
were
over
21
years
of
age.
Detectives
used
a
license.
Verification
program
which
confirmed
that
the
driver's
licenses
were
indeed
fraudulent.
Fraudulent
drivers
licenses
were
confiscated
by
detectives.
I
All
three
parties
will
be
submitted
to
court
for
a
person's
under
21
possession
of
alcohol
and
possession
of
fraudulent
identification.
Detectives
brought
this
matter
to
the
attention
of
the
person
in
charge.
Mr

result
of
what
detectives
observed,

issued
a
license
premise:
inspection
notice,
zero,

for
persons
under
21
percent
of
alcohol.

in
my
possession
the
three
fraudulent
driver's
licenses.

fake

getting

scanner
which
we
did

been
doing.

was
prior
to
we've,
been
doing
it
prior
to
covid
or
post
coven

manager

didn't
understand
how
there
were
three
people
at
a
table
when
we
have
a
check
id
scanner
that
we've
been
using
regularly
and
it
turned
out
that
our
server
knew
the
individuals
they
were
friends
of
hers.

them

drink,
knowing
that
they
were
underage,
we
fired
her
because
of
it,
and

that
we
should
not
have

doing

should
not
have
happened.

responsibility

had

man,

been
getting
ids
actually
as
slow

hall

This
summer
we
have
confiscated
numerous
ids
and
it's
not
something
that
you
know
we
want
to
portray
or
be
a
part
of,
and
we
apologize.

the
seating
is
outside
this
happened,
so
they
came
to

patio
to
the
host
stand.
All
of
our
staff.
Has
we

a
corporate
check
id
scanner
on
on
a
few
phones,

we

everybody

check
id
scanner.
The
managers
and
the
managers
also
go
around
and
check
on
top
of
that,
but
this
server,
who
is
supposed
to
be
using
that
scanner
as
well
said
she
used
it,
but
apparently
did
not
use
it,
and
she

spoke
to
the
to
that
server.

observed
three
patrons

Drinking

mixed
drinks
detectives
noticed
that
these
patrons
appeared
young
detectives
attempt
to
produce
identification
to
confirm
their
ages.
Patriots
immediately
said
that
they
were
under
21
years
of
age.

Patrons
then
produced
fraudulent
massachusetts
driver's
licenses
and
that
contained
the
individual's
correct
name
but
displayed
at
date
of
birth,
which
made
it
appear.
So
they
were
over
21
years
of
age,
detectives
used
a
license
identification
program
which
confirmed
that
driver's
licenses
were
indeed
fraudulent.
Fraudulent
drivers,
voices
were
confiscated
by
detectives,
altering
patrons
will
be
summoned
into
court
for
persons
on
the
21
physical,
alcohol
and
possession
of
fraudulent
identification.

to
the

person
in
charge.

a
result
of
what
detectives
observed
on
gallagher
issue,
license
from
suspect,

notice
zero
two
three,
nine
two,
six,

person

the
twenty
one
position
of
alcohol.
On
premise
mr
foreign's
assigned
for
an
accepted
notice
and
again
we
have
three
more
fraudulent
messages.

wanted
to
state
for
the
record
that
we've
been
in
business
in
south
bay
over
a
decade
and
have
had
no
issues
similar
to
this
whatsoever.

good.
Fakes
is
my
understanding
from
the
detectives
communicating
to
both
paul
and
billy
after
the
incident,
apparently
their
their
own
personal
information
that
they
send
in
with
hundreds
of
dollars,
and
it
was
suggested
that
the
best
line
of
defense
was
to
get
the
intellicheck
app
that
the
detectives
do
use
several
days
after
we
did
purchase
that
as
well
as
the
technology
to
make
that
the
scanner
stays
in-house.

we
can
therefore
scan
every
single
id
that
comes
in
and
make
sure
that
this
doesn't
happen
in
the
future.
As
far
as
the
server
training,
we
have
an
in-house
training
sabre
which
stands
for
serving
alcohol
beverages
responsibly,
that
every
every
team
member
goes
through
upon
hiring.
We
also
revisit
that
and
do
the
complete
annually.

a
two-hour
course
with
testing
at
the
end,
to
make
sure
that
we
have
a
training
to
prevent
these
types
of
things.
Server

on
that
night
did
follow
his
training.
He
did
take
the
ids
to
his
knowledge
and
ability

training
was
not
able
to
pick
up
that
they
were
fraudulent.

don't

it's
my
understanding
that
they
said
that
they're
very
difficult
to
determine
unless
you're
in
the
business
of
you
know
and
analyzing
fraudulent
ids,
so
upon
their
advice,
we
did
get
the
app
immediately
and
since
then
it's
been
great
that
we're
scanning
every
id.
We
do
have
a
couple
that
you
know
that
come
across
and
immediately
we
deny
service,
that's
a
great
safeguard.
So
again
we
certainly
apologize

this
happened.

patrons

alcoholic
beverages
sitting
on
the
patio
of
luca
at

hanover
street.

be
underage,

detective
asked
the
server
if
he
carded
the
individuals
before
serving
alcohol
to
them.

server
replied.

approached
the
group

himself

identification
from
the
five
patrons
the

appeared.
