Two

observed
the
victim
jacob
loose
outside
of
the
landstone
pub,
with
no
shirt
on
suffering
from
a
laceration
to
the
top
of
his
head
officers
observed
dry
blood
on
lucy's
chest
lou
stated
that
he
was
having
drinks
with
his
friends
at
the
bar
inside
the
lansdowne

when
the

was
also
inside

that
his

were
feeling
uncomfortable
around
william
callahan.
So
they
asked
him
to
leave.

valvey
stated
that
while
he
was
in
the
lansdowne
pub
he
was,
he
asked
callahan
to
walk
away
from
his
group
because
he
was
making
his
female
friends
uncomfortable
bellevue
stated
that
callihan
did
not
listen
and
he
grabbed
loose
by
the
shirt
and
stated
that
and
and
started
a
fight.
Fellaini
stated
that
he
attempted
to
stop
the
fight
between
callahan
and
loose,
but
he
got
punched
in
the
face.
As
a
result,
officers
observed
a
swollen
lip
on
film
officers
called
boston
ems
ambulance,
a9,
attended
to
both
loose
and
falvey.
D
Due
to
the
laceration
on
loose's
head,
he
was
transported
to
beth
israel
hospital.
A
witness
associated
with
luce
and
valvey
clotha
walsh
stated
that
she
was
standing
next
to
falvi
when
he
got
punched
in
the
face.
Wall
stated
that
callahan
was
making
her
feel
uncomfortable
while
they
were
at
the
bar
wall
stated
that
she
asked
callahan
to
walk
away,
but
he
did
not
listen
to
her
and
stated
that,
and
she
stated
that
she
observed
callahan
punched
valvey
in
the
face.
D
D
Detective
started
and
detective
fencer
arrived
to
nine
lansdowne
street
and
took
pictures
of
both
victims
and
sighted,

It
should
be
noted
that
all
parties
were
under
the
influence
of
alcohol.
While
the
incident
had
occurred.
D
As
a
result
of
this
incident,
detective
started
conducted
a
follow-up
investigation.
Detectives
started
spoke
with
both
victims,
as
well
as
witness
florida
walsh
number.
One
news
stated
that
he
originally
had
interaction
with
him,
but
long
that
either
punched
him
with
a
bottle
and
then
ripped.
His
shirt
blue
stated
that
the
assault
by
long
is
what
caused
the
laceration
to
his
head.
D
He
stated
that,
while
having
drinks
at
the
bar
callahan
walked
over
and
stood
uncomfortably
close
to
the
group
continuously
stared
at
the
group,
falbee
stated
that
one
of
his
female
friends
felt
uncomfortable
by
callahan's
actions.
Valvey
attempted
to
quell
the
situation
by
positioning
himself
between
his
female
friend
and
callahan.
At
that
time,
callahan
punched
him
in
the
face
from
behind
and
ripped
his
shirt
off.
D
The
punch
caused
swelling
to
valvey's
face
wall
stated
that
she
was
was
with
a
group
of
friends
at
the
lansdowne
pub
when
the
suspect
callahan
approached
the
group
and
stood
very
close
to
her,
but
did
not
say
anything
whilst
further
stated
that
callahan
stared
at
the
group
and
continued
to
stand
close
to
him.
Callihan's
actions
made
walsh
feel
uncomfortable.
So
she
asked
callihan
to
leave
when
callahan
refused
to
leave
walsh
informed
him
that
she
was
going
to
alert
the
boss
staff
of
his
actions
at
that
time,
callihan
pushed
belby
from
behind
and
then
punched.
D
D
Detective
starter
responded
to
the
lansdowne
pub
and
met
with
bar
employee
steve
regan
regan,
allowed
detective
starter
to
view
the
surveillance
footage
from
the
night
of
the
incident.
The
footage
appears
to
depict
callahan
in
long
assaulting.
The
two
victims
with
multiple
closed
fist
punches
to
both
victims
face
and
head
area
detectives
saw
that
sought
a
complaint
out
of
roxbury
district
court
for
assault
and
battery
against
callaghan
and
also
started
complaining
at
a
rock
street
court
for
assault
and
battery
serious
wildly
injury
against
law.
A
C
A
You
detective
attorney
quilty.
Would
you
like
to
address
the
alleged
violation.
C
Yes,
if
I
may
attorney
green
may
just
question
the
detective
or
ask
him
a
question,
sir.
F
C
Okay,
the
and
did
the
management
cooperate
with
you.
D
Yes,
the
management
and
the
entire
boss
staff
were
completely
cooperative.
Yes,.
C
D
C
Okay
and-
and
it
indicates
on
the
inspection
notice,
that
the
police
were
called,
is
that
they.
D
C
D
Well,
according
to
the
beginning
of
the
report,
it
it
appears
that
the
officers
who
one
of
them
is
present
at
this
was
flagged
down.
While
they
were
doing
what's
called
the
code
19,
which
would
be
in
the
area
of
lansdowne
street,
it
would
flag
down
at
the
time.
I
I
don't
see
a
911
call
in
the
report.
D
I
I
I
that
may
be,
but
to
the
police,
that's
what
it
states.
I.
C
Understand
I
understand,
thank
you,
sorry
and
you
did
observe
or
were
given
the
the
video
to
review.
C
Sorry
he's
actually
thought
of
us.
Okay!
Thank
you.
Thank
you,
sir.
I
have
no
no
questions
see
other
officer
diaz
have
anything
to
add.
C
C
Mr
hicks
is
the
director
of
operations
for
lansdowne
street,
for
the
lions
group,
miss
corpines
is
the
risk
management,
has
the
records
of
employment,
etc.
C
We
have
in
internal
reports,
which
would
appear
to
indicate
that
our
staff,
interceded
and
assisted
people
and,
in
fact
called
the
police,
but
we
do
not
have
any
witnesses
who
are
still
employed
by
the
company
to
testify
in
this
matter.
We
do
have
a
copy
of
the
video
which
is
corpines,
we'll
make
sure
it
gets
over
to
the
board
today
so
that
you
have
it.
C
It
would
appear
to
show
a
very
quick
interaction
between
these
parties,
and
you
know
the
staff
attempting
to
break
it
up,
but
we
have
no
no
testimony
to
offer,
since
we
don't
have
any
of
the
employees
still
with
us.
C
We
I
I
don't,
I
want
to
be
careful,
we
think
they
did.
The
notice
indicates
the
police
were
called.
It
does
not
indicate
by
whom
that's
blank,
as
the
detective
suggested
they
were
flagged
down.
We
believe
it
was
our
staff
who
flagged
down
the
officers
out
front
that
night.
The
internal
reports
just
indicate
we
have
a
couple
of
employees
who
indicated
that
they
were
present
and
assisted
and
again
from
everything
we
can
figure
internally.
C
B
No
internal
reports
from.
B
You
thank
you.
I
don't
have
any
questions
commissioner
curran
or
commissioner
saxon.
B
F
J
Who
called
the
police?
It
was
the
call
was
received
from
boston
ems
and
then
transferred
to
the
police,
so
the
call
was
originally
called
for
a
20
year
old
male
with
a
hinge
header
head
injury.
It
says
a
good
laceration
that
and
then
it
was
forwarded
to
the
police
from
there.
A
Thank
you.
The
board
will
take
we'll
take
us
back
our
advisement
attorney
quilty.
Please
do
forward
those
internal
reports
and
videos
and
we
will
forward
you
the
additional
reports
as
soon
as
we
receive
them.
Thank
you.

A
F
F
Yeah,
yes,
sir,
at
11
17
p.m.
On
sunday
november
21st
2021
officers
responded
to
already
called
for
a
fight
at
295
harp
street
prior
to
arrival.
The
channel
to
this
point
four
officers
that
15
people
were
fighting
the
caller
further
said
people
were
possibly
drunk
from

with
the
assistance
of
other
officers,
officers

a
large
crowd
in

F
It
should
be
noted
that
a
male
unknown
age,
20
30

old
hispanic
man
stopped
officer
duran
with
his
cell

and
was

who
was
cooperative
officer

that
people
had
to
leave
the

immediately.
Due
to
the
officer's
observation
of
a
hundred,
people
were
inside
the
bar,
while
barney's
great
scene
capacity
was
62..
A
F
Yes,
on

detective
james
and
son,
detective

went
to
299

35
on
arrival
officers
saw
that
there
were
six
persons
in
the
bar,
the
manager
darron.
I
don't
know
if
I'm
pronouncing
it
right.
Londono
was
notified
of
the
reason
we
were
there
by
song
detective
blast
and
that
a
citation
was
written
for
violation
that
occurred
on
11
21
2021
at
11.
F
K
Yes,
good
morning,
everybody,
how
are
you
today
going
over
the
incident
that
happened
that
day?
Just
as
far
as
what
had
happened
inside
of
the
business
establishment,
I
do
a
pretty
thorough
job
making
sure
I
try
to
say
you
know
complying
to
the
city's
rules,
laws
and
regulations
as
well
as
the
business,
but
what
had
happened
outside
and
what
occurred
outside
for
me
being
being
inside
and
you
know,
overseeing
the
operations
in
the
back,
though
we
were
a
little
bit
busier
than
normal.
What
occurred
outside.
K
I
don't
know
where
it
stemmed
from
what
the
results
were,
but
when
I
was
notified
of
it,
I
made
sure
to
make
it
a
point
to
go
outside
and
see
what
was
going
on.
There
was
a
lot
of
people
in
the
street
that
day.
It's
also
right
before
thanksgiving
a
lot
of
the
bars
around
here.
You
know
you
have
kelly's
pub.
You
have
other
people
heading
to
the
late
night,
restaurants,
eateries
latino.
You
got
other
places
around
here
that
there's
a
lot
of
people
walking
ahead
into
other
locations.
I
remember
that
day.
K
Wasn't
that
bad
of
weather
outside
either
so
when
I
stepped
outside
and
seen
all
these
people,
you
know
huddled
up
around
and
you
know
the
cops
had
been
called.
I
was
definitely
a
little
at
a
loss
for
words
once
I
realized
I
was
speaking
to
one
of
the.
I
don't
remember
the
officer's
name,
my
apologies,
but
I
was
definitely
compliant
speaking
to
them
about
what
was
going
on.
Some
of
these
patrons
that
I
had
seen
outside.
I
recognized
maybe
just
a
handful
that
had
been
in
here.
K
There
was
other
people
out
there
that
I
have
no
idea
where
they
came
from
how
they
resulted
being
in
front
of
barney's.
K
And
yeah,
so,
as
far
as
that,
you
know
the
officers
did
come
in.
I
guess
there
was
an
observational
account
where
they
said
we
had
more
than
100
patrons.
I,
in
all
honesty
I
don't
recall
having
over
100
people
in
here.
I'm
also
not
saying
we
weren't
even
slightly
over
capacity,
but
as
far
as
being
100
patrons
that's
a
little
bit
far-fetched,
just
in
my
opinion,
with
no
disrespect
to
anybody.
A
B
Thank
you.
Thank
you
detective.
Thank
you,
mr
cardone.
For
joining
us,
the
police
report
indicates
there
might
have
been
a
fight
next
door.
What
is
next
door
to
barney's
grill.
K
So
next
door,
what
we
have!
We
have
a
parking
lot
on
one
side
where
people
do
park
there,
but
unfortunately
we
don't
have
any
signs
posted.
So
we
have
people
that
park
here
to
go
to
some
people
go
to
renzo's.
Some
people
go
to
the
other
little
bars
or
restaurants
around
here,
so
I
do
sometimes
have
to
get
tow
trucks
to
get
over
here.
So
on
one
side,
we
have
a
parking
lot
that
a
lot
of
people
park
at
that
aren't
patrons
and
then
to
the
left
side
of
the
restaurant.
K
K
The
capacity
I
usually
have
well,
one
of
the
supervisors,
could
be
a
dairy
london
who's
there
who
helps
us
out.
We
have
a
counter
at
the
door.
He'll
help
us
out,
I'm
always
inside
at
the
beginning
of
the
bar,
because
I
like
to
help
out
the
bar
staff
as
well
as
checking
ids
at
the
door,
and
then
I
also
have
my
father
who's,
always
here
as
well.
Unfortunately,
in
this
matter
he
was
not.
K
K
B
I
appreciate
that.
Thank
you.
I
don't
have
any
other
questions,
commissioner
curran
or
commissioner
saxon
to
you.
K
K
But
I
do
when
securities
here
anybody,
I'm
always
advised
every
time
we've
hit
every
15
mark
on
the
counter.
So
you
know
15
I
get
notified
30.,
I
get
notified
45,
I
get
notified,
you
know,
60
I
get
notified
and
then
once
it
starts
to
get
to
there,
that's
when
we
start
to
monitor
you
know
who's
coming
in
who's
coming
out,
because
if
you
look
at
our
business
establishment,
when
you
first
walk
into
the
business,
it
is
very
narrow.
K
So
I
understand
where,
as
you
can
walk
in
it's
very
narrow
and
the
bars
directly
to
the
right,
most
people
like
to
stand
in
front
of
the
bar
to
be
able
to
grab
a
drink
a
lot
easier
and
in
the
back
it's
always
a
little
more
wide
open.
It
opens
up
a
lot
more.
We
have
bigger
tables,
but
people
tend
to
just
migrate
towards
the
bar
because
we
have
the
kitchen
here
we
have.
You
know
the
two
bartenders.
K
Yeah
for
my
staff,
I
have
that's
sunday,
it's
one
of
my
other
bartenders.
Her
name
is
cindy
bartender.
Who
is
leset.
We
have
a
bartender
who
is
it's
valeria
also
had
myself
kilda
cardona,
and
I
had
my
uncle
who's.
Actually,
in
the
back
at
the
moment,
helping
us
out,
he
was
doing
office
work
as
well
and
in
the
front
door.
It
was
just
me.
G
K
So
for
me
to
stand
at
the
opening
of
our
bar,
it
puts
me
parallel
to
the
door
where
people
cannot
get
in
unless
they
go
through
me
and
I'm
monitoring
the
bar
and
with
the
help
of
the
employees
that
I
have
there's
people
that
help
us
to
run
up
drinks
run
up
beers
if
we
run
out
bring
ice
as
such
as
that,
so
I
wouldn't
be
running
up
and
down
the
stairs
leaving
the
door.
You
know
unfunded.
K
I
was
inside
when
I
heard
the
reports
that
there
was
something
going
on
outside,
which
is
somebody
that
I
believe
walked
out.
They
said,
hey,
there's
something
going
on
outside.
Can
you
come
outside
and
I
opened
the
door
and
I
proceeded
to
see
the
situation
where
the
cops
were
arriving
and
there
was
some
people
outside
huddled
up
on
the
building
next
door
in
the
front.

a

Mr

Mr
claus
was
instructed
to
preserve
and
he
surveilled
footage
from
that
knight
original
incident,
which
they
did
supply.
I
The
the
the
big
incident
with
the
miner
it
began
on
cinco
de
mayo,
which
is
one
of
the
busiest
nights
of
the
year
for
us.
Unfortunately,
due
to
coved
that
we
had
a
couple
of
employees
call
out
last
minute,
we
were
a
little
understaffed
at
around
11
30,
the
female
on
the
report
walks
in
we
noticed
she
went
to
the
bar
to
talk
to
a
friend
of
hers
who
bought
her
a
drink.
I
We
were
busy
at
the
time
she
showed
an
id
which,
because
it
was
so
busy,
the
bartender
was
unable
to
thoroughly
inspect
it
and
I
believe,
that's
what
caused
it.
Throughout
the
night
she
only
had
about
three
drinks
in
a
two-hour
span
and
at
1
15.
We
turned
on
the
lights
to
do
last
call
and
our
security
began
to
remove
anybody
just
hanging
around
just
to
get
everybody
to
go
without
incident
and
she
got
upset,
but
she
ended
up
leaving
outside.
I
She
just
stood
out
there
calmly
and
then
out
of
nowhere
began
to
throw
her
purse
multiple
times
and
at
which
point
she
ripped
off
her
shirt
and
I
walked
out
tried
to
calm
her
down
and
she
just
charged
across
the
street
to
the
walgreens
mentioned
to
a
group
of
girls.
She
had
no
prior
contact
with
at
that
point.
I
tried
to
hand
her
clothes
and
calm
her
down
and
the
officer's
backup
was
called.
I
guess
and
that's
when
the
officers
told
me
to
go
back
inside
and
they
were
going
to
handle
the
situation.
I
B
What's
your,
what
are
your
procedures
for
identifying
for
iding
people.
M
For
idean,
usually
we
have
a
security
guard
at
the
door
actually
seven
days
a
week
and
they
start
id
and
all
customers
after
midnight,
because
usually
we
do.
We
do
still
have
the
kitchen
open
until
12
45,
but
we
prefer
not
to
have
anyone.
That's
that
could
be
potentially
underage
or
could
potentially
buy
alcohol
without
us
having
a
security
guard
who
was
certified.
I
I
B
Okay
and
what's
your
procedures
for
accepting
whatever
kind
of
and
not
an
out-of-state
id
or
this
whatever,
this
is.
P
M
M
And
but
so
after
that
we
just
started,
we
got
everyone
tip
certified.
We
did
have
a
lot
of
new
stuff
and.
M
And
now
we're
only
accepting
passports
and
state
ids
from
any
state
in
the
united
states,
so
no
more
the
employment
cards
or
any
ids
from
other
countries.
A
Item
number
five
can
concerns
the
same
licensee,
so
we
will

a

that
as
well.
A

six
seven
and
eight
item
well:
first,
let's
see
is
this
licensee
with
us
today?
Is
there
anyone
present
on
behalf
of
sam's
spot?
I
can
see
that
we
are
getting
pretty
small
in
numbers
here.

the
truth.

Q
Yes,
good
morning
on
4

20

at
2,
30
p.m.
Lieutenant
detective
adrian
troy
sergeant,
checked
william
gallagher,
detective
eddie,
hernandez
assigned
to
the
licensed
premise
unit
conducted
a
license
from
its
inspection
of
the
cask
and
flagging
at
62
brookline
avenue
during
the
red
sox
home
opener,
as
detectives
made
their
way
through
the
patio
section
of
the
cask
detectives
observed
two
patrons
sitting
at
a
table
with
two
full
pictures
of
draft
beer.
Q
Sergeant
detective
gallagher
spoke
to
the
female
server
and
asked
how
many
beers
were
contained
in
each
picture.
The
server
applied
for
serge
detective
gallagher
informed
the
server
that
mass
law
prohibits
a
service
more
than
two
drinks
to
a
person.
At
any
time,
detectives
sought
out
the
manager
jimmy
relgado
informed
him
of
their
observations.
Mr
rogaldo
stated
that
he
would
speak
to
the
staff.
Q
As
a
result,
the
detectives
had
observed
sergeant
gallagher
issued
a
licensed
premise:
inspection
notice,
number
zero,
four,
two
three
one,
four
to
the
cast
and
flagging
for
service
of
more
than
two
drinks
to
one
person
at
a
time
which
is
mass,
prohibitive
practice.
204
cmi,
mr
jimmy,
regardless
signed
for
an
acceptable
notice.
Those
essentially
the
facts
of
that
evening,
sorry
afternoon.
C
Thank
you,
sir.
We
have
no
further
questions
of
the
officers
mr
van
fleet
is
with
us
he's
a
hands-on
owner
operator
well
known
to
the
board.
This
is
totally
against
every
policy
that
he
has
put
in
place
over
many
years.
This
individual
server
was
terminated
immediately.
Staff
was
immediately
retrained.
C
R
Course,
good
morning,
we
at
the
caskian
flag
and
take
alcohol
service
very
seriously
in
any
violations
are
a
big
deal
to
us.
We
have
a
zero
tolerance,
tolerance
policy.
We
have
a
very
stringent
training
program,
so
all
servers
and
all
employees
are
well
aware
of
the
laws
and
regulations
pertaining
to
the
service
of
alcohol
and
as
a
result
of
our
zero
tolerance
policy,
we
did
immediately
terminate
that
server
of
that
day
for
an
obvious
violation
that
we
do
not
deny.
R
She
did
for
whatever
reason
served
the
two
gentlemen,
two
pitches
of
beer,
and
we
took
the
appropriate
action
based
on
our
policy.
We
also
took
advantage
of
the
situation
and
used
it
as
an
example
for
the
rest
of
the
staff
to
show
them
that
we
do
take
these
situations
very
seriously
and
in
fact
our
zero
tolerance
policy
will
be
adhered
to
at
all
times.
R
So
it's
an
unfortunate
incident
that
we
hope
would
never
happen,
but
it
did
and
we're
using
it
to
make
sure
that
it
doesn't
happen
in
the
future
and
the
rest
of
our
staff
fully
understands
the
seriousness
of
what
our
server
I
did
that
day.
R
We
do
we
we're
constantly
coaching
our
staff.
As
everybody
knows
these
days,
staffing
is
very
difficult.
There's
a
lot
of
coming
and
going
of
employees
so
management
on
a
daily
basis.
We
have
meetings
before
every
shift.
R
We
discuss
certain
topics
and
obviously
one
of
the
most
important
topics
is
the
importance
of
the
service
of
alcohol
and
that
we
adhere
to
all
laws
and
regulations
in
terms
of
minors
in
terms
of
over
serving
in
terms
of
all
the
little
details,
even
two
drinks
per
person
at
one
time.
So
it's
a
it's
a
daily
practice
these
days
and
we'll
continue
that
practice
to
make
sure
that
something
like
this
does
not
happen
again.
C
A
P
A
O
P
Good
morning
I'll
be
reading
a
little
police
report,
which
I
wrote
on
monday
april,
18
2022
lieutenant
detective
during
tourists
trying
to
take
a
little
gallery
and
victory
eddie
hernandez
assigned
to
the
bp
licensed
premise
unit
conducted
a
license
from
inspection
of
the
art
house
located
126
proton
lab
in
boston
as
detectives
walked
inside
the
establishment.
Detectives
asked
the
front
door
staff
how
many
patrons
they
had
the
staff
members
say
to
the
hearing
out
of
account
of
patrons
or
reviewing
the
license
and
parameter
establishments.
P
O
Yes,
thank
you.
First,
just
a
couple
questions
for
the
detective,
if
I
may
detective,
was
staff
and
security
cooperative
when
you
made
your
inspection
and
had
your
discussions
with
them.
O
Thank
you,
and,
and
is
it,
is
it
accurate
to
say
there
are
several
different
dining
and
patio
and
bar
areas
in
this
establishment,
and
it
was
only
this
one
patio
section
that
was
over
capacity.
O
O
This
incident
occurred
on
marathon
monday
yard
house
employs
contract
security.
We
usually
guard
the
door
and
count
the
patrons
because
it
was
the
marathon
contract.
Security
was
late
and
patrons
filtered
into
the
patio,
because
the
back
door
was
not
being
counted.
O
O
We
did
fail
to
count
the
patio
guests
in
a
timely
fashion,
but
the
patio
has
garage
doors
that
were
open,
giving
direct
access
to
the
front
dining
rooms,
so
there's
plenty
of
room
to
move,
it
didn't
appear,
crowded
and
egress
was
never
blocked
or
impeded.
I've
submitted
photos
of
both
of
those
areas.
O
All
that
being
said,
this
is
a
busy
professionally
run
place
and
management
has
taken
this
incident
as
an
opportunity
to
review
staffing
and
crowd
management
and
I'd
like
to
have
wilson
figueroa.
The
manager
of
record
say
a
few
words
about
that.
S
Good
morning,
everyone,
my
name,
is
wilson
figueroa
and
I'm
the
general
manager
at
the
yard
house
on
brooklyn
avenue,
been
working
for
yard
house
now
coming
on
11
years
now,
I
have
eight
assistant
managers
at
work
with
me
and
a
staff
about
131.
Currently
right
now,
I
do
want
to
apologize
for
the
incident.
You
know
at
the
end
of
the
day,
I'm
I'm
responsible
for
the
establishment
and
accountable
for
any
of
the
opportunities
or
problems
that
may
arise
in
the
building.
The
day
of
the
incident
was
marathon
monday.
S
Unfortunately,
that
was
also
opening
day
weekend
with
baseball
season
being
pushed
back,
and
it
was
a
new
security
company
and
they
were
one
of
the
two
guys
was
there.
Who
was
at
the
front
door,
checking
all
ids.
We
do
lock
the
back
door
so
that
all
ids
get
funneled
through
the
front,
and
so
there's
nobody
at
the
back
door.
Unfortunately,
I
reached
out
to
the
security
company.
S
They
got
somebody
out
there
as
quickly
as
they
could
and
given
that
situation
we
obviously
didn't
do
a
very
good
job
in
tracking
the
crowd
capacity.
At
that
point,
you
know
the
staff
was
out
there
and
they
obviously
will
monitor
you
know
underage
drinking
or
intoxication
harassment.
Things
like
that
you
know,
but
obviously
you
know
we
went
over
and,
like
the
attorney
said,
we
weren't
working
under
over
capacity
anywhere
else,
but
since
that
situation
did
occur,
we
took
some
steps
to.
S
You
know
make
sure
that
this
issue
doesn't
happen
moving
forward.
You
know,
first
and
foremost,
I
got
all
the
managers
clickers,
so
they
all
have
their
own
individual
one
that
way
as
they're
going
through
the
crowds
they
can.
Just
you
know,
do
a
quick
count
and
make
sure
that
something
like
this
doesn't
happen,
especially
that
we're
just
not
solely
dependent
on
that
security
company.
S
The
second
thing
was,
we
did
end
up
moving
forward
with
another
security
company,
obviously
with
them
being
not
on
time
being
late,
not
being
able
to
man
the
door,
it
wasn't
something
that
we
could
continue
to
risk
and
allow
to
continue
to
happen.
So
we
did
end
up
determining
it
was
minuteman
security,
and
now
we
utilize
narrow
security.
S
To
do
that,
you
know
we
continue
to
talk
to
the
team.
We
also
have
all
the
managers
on
walkie
talkies.
So
that
way
we
can
communicate
to
one
one
another
throughout
the
floor
on
both
ends
of
the
building,
make
sure
that
we're
constantly
looking
at
it
and
controlling
it.
So
if
a
manager
for
some
reason
has
to
be
back
there
and
stashing
off
the
area
and
now
and
go
one
for
one
of
the
patios,
we
know
that
that's
what's
going
on.
S
O
A
G
How,
how
is
this
premises
broken
down
as
far
as
capacity
on
your
license?
I
don't
have
it
in
front
of
me
right
now.
So
do
you
recall.
O
We
have
a
tote
total
of
672
dining
area,
one
is
309,
patio,
dining
is
80
with
30
standing
dining
area,
2
is
36
and
seasonal
outdoor

5
is
39.
O
No
ju
wilson
correct
me
if
I'm
wrong,
but
that's
just
the
outdoor
patio
in
the
photos
I
submitted,
you
can
see
sort
of
a
triangular
shape
with
a
big
garage
door.
That's
open!
So
that's
the
patio
backing
up
onto
the
dining
room.
S
So
seats
you
could
see
with
the
new
tables
that
we
just
purchased.
I
believe
it
was
a
total
of
30
guests
could
be
sat
and
then
that
would
leave
an
old
standing
room
of
about
20.
Yes
on
each
patio.
R
S
Yeah
we
have
two
two
patios
two
outdoor
patios
one
closest
to
fenway,
one
closest
to
wall
burgers
and
both
wolves.
There's
a
total
of
50.
D
C

Yeah
the

Those
essentially
the
backs
of
that
incident.
A
Thank
you
very
much
sergeant
gallagher.
Ms
anson,
would
you
like
to
address
the
alleged
incident.
H
Yes,
so
yes,
that
even
obviously
did
occur.
I
allowed
one
of
my
employees
to
have
a
birthday
party.
My
cv
license
did
expire,
which
I
then
renewed,
which
I
wasn't
aware
of
at
the
time,
and
I
they
kind
of
just
like
left
after
they
were
told.
I
wish
I'm
fully
aware
of
that.
That
was
incorrect
to
have
the
to
allow
them
to
do
that
after
the
moment,
but
we
no
longer
allowed
that
to
happen.
I
mean
there
were
two
instances
after
but
as
of
now,
that's
no
longer
an
issue.
H
B
H
H
B
So
what
you're
waiting
on
the
city
or
is
there
something
you
need
to
do.
H
B
And
your
cv
license
lists
you
as
85
owner
and
a
kerwin
cornelius
as
15
owner.
We
need
to
have
an
emergency
contact.
We've
had
a
lot
of
difficulty
getting
in
touch
with
people.
This
board
requires
an
emergency
contact
in
case,
something
like
this
happens.
We
know
how
to
get
in
touch
with
the
owner
and
the
responsible
person
immediately.
This
has
been
a
strain
on
my
resources,
my
staff
resources
and
the
police
resources.
B
B
H
So
it
was
more
so
like
additional
space
for
my
catering,
because
I
have
a
catering
company
as
well,
so
it
was
like
additional
seating
like
for
private
events
more
so
just
so,
when
clients
book
it
they
want
to
have
like
a
sit-down
dinner
type.
Then
they
kind
of
have
that
option.
B
H
G
B
Do
you
understand
that
your
license
needs
to
be
renewed
every
year?
Yes,
okay,
right
now,
your
license
is
for
takeout
only
so
you
cannot
have
four
seats
unless
you
amend
your
license.
H
B
And
your
mailing
address
is
this
methuen
address
correct
and
the
phone
number
is
your
phone
number?
Does
it
end
in
6325,
or
does
it
end
in
what
is
listed
in
the
police
report.
B
And
the
employee
that
you
allowed
to
have
the
birthday
party
there
with
a
bar
set
up
and
a
dj,
do
they
still
work
for
you?
No
okay.
I
don't
have
any
questions.
Commissioner
caron,

it's
no
fault
of
their
own,
I
mean
I
gave
them
a
key,
so
that's
kind
of
and
it's
pretty
much
the
same
people
just
kind
of
routinely
just
coming
after
work
and
meeting
at
this
spot-
and
I
mean
I've
talked
to
them
about
it
and
obviously
we're
here.
So
I
mean
that's
no
longer
anything
going
on.
B
Ms
anson
did
you
receive
any
calls
or
communication
after
the
last
incident
on
march
20th,
when
your
staff
were
right
now
you
did
actually.
H
B
H
H
B
H
H
I
terminated
it,
I
mean
on
different
instances
the
bartender
I
terminated
her.
I
would
say
two
months
ago.
B
What's
the
bartender
do
for
your
catering
company
you're
not
supposed
to
have
alcohol.
H
She
was
a
server,
she
was
a
cashier,
well
training
for
cashier
position,
but
primarily
she
was
a
server.
B
And
who
is
miss
singleton.
B
H
B
Just
to
because
we
have
you
with
us
today,
I'm
trying
to
pull
up
your
cv
license,
because
I
don't
believe
anyone
can
be
on
the
premise
at
3am.
Just
because.
H
H
Yeah
so
I
actually
got
it
in
2020
and
then
I
renewed
it
and
then
it
expired
in
to
the
early
2022.
J
So
was
it,
did
you
have
a
takeout
in
operation
for
those
two
years.

this

No

could
be
located.
L
It
should
be
noted
that,
prior
to
the
short
spotter
activation
officers,
gushard
and
mahongos
had
observed
numerous
people
coming
and
going
from
1478
dorchester

1478
dorchester

is
a

of
an

which
has
been
the

of
numerous

L
Oh
yes,
the
harry

two
lieutenant
smith
processed
the

took
photographs
and
collected
the
ballistic
evidence.
The
ballistic

was
logged
into
firearms

forty,
four,
that's
the
end.

Q
Further
reports
officers
had
been
observing
people
coming
and
going
from
1478
dorchester
avenue
during
their
shift
that
evening
officers
proceeded
to
enter
1478
where
they
attempted
to
gain
entrance,
but
they
found
the
tour
locked
after
knocking
for
several
minutes
with
no
one
answering
officers
left
the
scene
after
pro
assessing
the
evidence.
Lieutenant
smith
reports
that
the
premise
has
been
a
constant
problem
during
the
overnight
shift
with
after
hours
parties,
as
was
the
case
on
this
state
inspection
notice,
was
mailed
to
the
manager
of
record
samantha
anson
and
those
essentially
artifacts.
H
I
would
so
I
actually
have
no
knowledge
of
the
shooting
at
1489,
because
I'm
1478.,
and
there
also
are
other
events
that
happen
along
the
strip
of
14.
well
along
dorchester,
rav,
there's
an
event
right
along
like
three
doors
down
for
me:
there's
a
building
that
has
parties
all
all
night
long,
so
I
mean
I.
H
I
can't
fully
take
responsibility
for
other
events
that
happen
around
my
location
and
just
so
happen
to
be
like
next
door
to
me,
or
so
when
we're
known
to
have
had
previous
parties
and
then
it
just
kind
of
like
automatically
goes
to
us
and
there's
been
other
instances,
I'm
not
looking
to
shift
blame
or
put
it
anywhere
else,
but
in
that
instance,
I
have
no
knowledge
of
that.
I
had
no
staff
there
if
they
knocked
on
the
door.
H
We
always
answer
if
it's
obviously,
if
there's
something
going
on
they're
gonna
answer,
because
they
feel
like
it's
somebody
coming
to
the
party
if
it
was
the
police,
we
answer
automatically.
So
that
part
I
don't
I
can't
really
attest
to-
and
I
also
am
not
sure
where
there
was
no
fight.
H
A
Thank
you,
ms
hansen,
chairman
joyce.
Do
you
have
any
questions.
B
Yes,
for
officer
butler
in
your
police
report,
it
stays
it
states.
In
the
fourth
paragraph,
it
should
be
noted
that,
prior
to
the
shot,
spotter
activation
offices
guichard-
and
I
can't
pronounce
the
names
mihangos
had
observed-
and
numerous
people
coming
and
going
from
1478
dorchester
ave-
is
that
what
your
testimony
is
tonight
today?
H
Okay,
so
in
that
instance,
I
mean
I
would
just
assume
that
they
would
maybe
ask
them
if
they
had
any
knowledge
of
what
was
going
on,
because
I
mean
like
I
said
I
wasn't
there,
but
if
there
were
people,
I
would
just
assume
that
maybe
please
just
ask
them
if
they
know
versus
just
assuming,
because
I
don't
know
what
they
were
doing
going
in
and
out.
But
it's
just
the
fact
that,
like
I
have
no
connection
to
the
shooting
going
on
at
1489.,
okay,
you.
H
H
B
Report
you
were
written
up
for
the
premise
operating
after
11
p.m
and
officer
butler
said
that
his
colleagues
spotted
saw
people
with
their
own
eyes
coming
out
and
then
also
written
up
for
not
allowing
the
detectives
in
when
they
went
to
inspect
afterwards.
So.
H
So
are
they
positive?
There
was
somebody
in
there
after
them
coming
and
going
out.
Like
I
mean
because,
like
I
said,
I've
I've
been
in
my
location
at
four
in
the
morning
at
two
in
the
morning
doing
work.
I've
done
things
at
different
times.
It
could
have
been
staff,
it
could
have
been
if
there
was
no
wow
music
or
there
was
no
like
you
know,
I'm
sure
if
they
banged
on
the
door,
somebody
would
have
opened
it
if
there
was
somebody
in
there
if
they're.
B
H
H
H
M
B
So
that's
why
it's
sort
of
I
have
to
defer
to
the
police,
officer's
observations
being
familiar
with
this
location
and
assume
that
people
were
there
when
they
should
not
have
been
so
right.
Any
questions,
commissioner
curran
or
commissioner
saxon.
H
Like
I've
stayed
later
in
the
night,
to
kind
of
like
either
do
work
upstairs,
we
have
like
I
said
it's
an
additional
space,
so
we've
painted
at
like
two
in
the
morning.
We've
done
like
floor
work
at
three
in
the
morning
like
it
all
depends
on
when
I'm
able
to
have
people
come
help
me
like.
If
I
have
staff
it's
not
always
like
the
same
consistent
staff
because,
like
I
said
it's
well,
people
mentioned
it's
very
hard
to
get
staff.
H
H
H
H
If
he's
there,
whatever
time
he's
there,
so
I
could
say
that
that
was
definitely
somebody
who
was
paid
on
that
day,
whether
he
sub
paid
people
to
be
there
or
not.
What
was
he
doing?
H
I
mean
he
does
a
lot
he
does
on
this
date.
I
can't
tell
you
specifically,
if
I
call
them
and
ask
them
maybe
and
recall.
G
G
B
I'm
just
going
to
repeat
that
these
are
these
are
taken
very
seriously
by
the
board
and
as
the
owner
the
85
owner,
I
would
behoove
you
to
find
out
who
was
working
there
and
why-
and
I
mean
you're,
putting
your
license
at
risk.
B
It's
already
at
risk
and
usually
people
come
very
prepared
to
defend
what
happened,
and
I
think
what
commissioner
current
is
saying
that
you
we
would
expect
you
to
find
out
if
you're
testifying,
that
cornelius
was
coming
and
going,
and
he
salaried
what
work
he
was
doing
there
on
that
night.
Okay,
we
vote
on
thursday,
so
if
you
could
get
in
touch
with
him
absolutely.
A
Thank
you.
The
board
will
take
this
under
advisement,
ms
hanson.
If
there
is
any
further
information,
you
would
like
to
provide
the
board.
As
chairman
joyce
stated,
we
do
vote
on
thursday
morning,
so
the
record
will
stay
open
until
the
end
of
the
day.
Tomorrow,
okay,.
