and
whether
there

any

Hey
Mr

I
have
have

E

About
1
17
a.m,
on
Sunday
5,
15,
22
officer,
Rooney
and
whistle
in
the
alpha
103
Alpha.
That's
a
two-man
rapid
response
unit
responded
to
a
radio
call
for
the
report
of
an
unconscious
Male
inside
a
legacy
nightclub
located
at
79,
Warrington
Street,
downtown
Boston
upon
arrival
officers
arrived
with
EMS
and
were
alerted
the
victim.
Michael
stem
Lake
was
downstairs,
unconscious
officers
and
EMS
were
unable
to
wake
the
victim.
When
we
located
him
the
victim
was
breathing.
F
B
Thank
you
officer
and
Sergeant
Crossing.
If
you
would
read
the
supplemental
into
the
record.
A
B
Okay
officer
Ernie:
do
you
have
this?
The
supplemental
report
as
well.
F
I
can
try
to
contact
him
and
possibly
locate
it.
I
didn't
have
it
originally.
Just
give
me
one
second,
thank
you.
F
Yeah
he
just
left
I
think
he's
having
connection
issues
I'll
reach
out
to
him
questions.
B
Thank
you,
Lieutenant
Troy.
Do
you
have
the
report.
I
Unfortunately,
I
don't
have
a
copy
of
the
supplemental
report.
I
just
have
the
original
officer
Rooney's
report
I
don't
have
that
a
secondary
report.
Unfortunately
apologize.
A
B
C
I
was
gonna,
say,
I
could
read
them,
but
I
don't
know
if
that's
appropriate,
but
if
he
could
join.
B
B
B
B
That
is
correct
all
right,
so
we
will
move
to
the
licensee
Mr
delpidio
Mr
calabas.
Would
you
like
to
address
the
alleged
incident.
D
Yes
on
this
on
this
particular
9,
our
alternative
night
on
Sunday
nights,
and
we
have
two
managers,
five
door
staff
and-
and
we
got
a
call
on
the
radio
that
someone
was
having
trouble.
So
we
went
over
to
the
person.
We
realized
that
there
was
having
problems.
One
of
his
friends
said
he
was
on
some
kind
of
substance.
We
call
9-1-1
and
9-1-1
came
and-
and
that's
about
all
I
know
about
the
case.
B
That
chairman
Joyce,
do
you
have
any
questions
for
the
licensee
or
for
the
officers.
K
F
Do
have
the
supplemental
report
if,
if
they,
if
you
everyone
would
like
to
hear
it.
F
F
The
alpha
910
conducted
a
code
35
licensed
premise:
inspection
at
Legacy
Nightclub
at
79,
Warren
Warrenton,
Street,
Boston,
Sergeant,
Crossroad
Crossing
issued
license
premise:
inspection
notice,
number,
zero,
two
three:
five:
five
three
to
Linda
Knapp
for
having
a
patron,
become
incapacitated,
slash
unconscious
on
premise,
from
drugs
or
being
over
served
after
an
incident
that
occurred
on
May
15
2022
Ms
Knapp
was
cooperative
with
police
and
accepted
the
notice,
and
that
that
concludes
that
report.
Great.
B
Thank
you
officer,
so,
chairman
Joyce,
if
you
have
any
questions
for
either
the
licensee
or
the
officer.
C
Yes,
the
original
the
original
report
states
that
the
victim
was
breathing,
whoever
he
was
unresponsive
and
it
was
possibly
drug
related.
What
was
that
information
from
was
that
from
interviewing
his
friend
that.
C
Okay,
well,
George!
Okay,
did
he
give
you
any
more
information.
D
C
A
E
German
Joyce,
just
on
behalf
of
the
police
department,
when
we
did
arrive,
he
the
victim
was
already
out
in
the
lobby.
The
security
staff
had
already
cleared.
The
lobby
cleared
a
route
for
EMS.
So
in
regards
to
what
happened
after
the
incapacitation,
I
will
say
that
the
club
did
make
every
effort
to
make
it
easier
for
First
Responders.
C
And
George
you
said
you
had
two
managers
and
five
door
staff
on
that
particular
night.
Do
you
know
how
many
patrons
are
there.
D
C
Okay,
I,
don't
have
any
questions
at
this
time.
Commissioner
Karen.
C
L
B
N
N
B
Yes,
thank
you,
Sergeant
Crossing.
You
could
please
proceed
with
the
police
report.

earlier.

his

had
forcefully
removed
a

on

while

Recollection
of
the

closely
matched
those

that
when
the

back
a
second

tried
to
re-enter

punched
in

E
E
Supplemental
about
June
10th
2022
at
127,
Hours
Sergeant
Crossing
myself
responded
to
the
white
Bowl
Tavern
to
conduct
a
code
35
license
premise:
inspection
spoke
to
the
bartender
Stephanie
Metcalf,
who
stated
there
was
no
manager,
Miss
Metcalf
stated
she
would
fill
the
role
as
manager
for
the
purpose
of
the
code.
35.
Ms
Metcalf
stated
that
the
manager
had
left
the
establishment
just
before
the
assault
took
place
as
a
result
of
the
assault.
Such
acroston
issued
a
violation
for
employee
assault
on
Patron,
Patron,
assault
on
employee
and
no
manager
on
scene.
E
Mr
Bart
was
informed
to
secure
footage
for
detectives,
Miss
Metcalf
signed
for
the
violation:
number:
zero,
six,
sorry,
zero,
six,
one
zero,
seven,
eight
and
A1
detectives
to
follow
up
for
other
proceedings
as
necessary,
and
that
concludes
the
supplemental.
N
Yes,
if
I
may,
thank
you
very
much.
Is
it
Sergeant
Crossing.
N
You
Sarge
the
inspection
notice
indicates
that
the
staff
of
the
establishment
made
the
call
to
the
police
Mr
I,
can't
pronounce
it
either
bulafa.
Is
that
correct.
N
N
E
N
N
And
then,
but
and
subsequently
did
not
Mr
Baird
produce
the
video
for
you
on
June
15th.
E
I
believe
I
start
I,
don't
have
it.
I
haven't
seen
the
video
since
and
I'm
not
sure
if
it
was
set
to
detectives
for
subsequent
fall
of
Investigation,
but
I
do
recall,
seeing
it
yeah
again
five
five
six
months
ago.
N
Okay
and
as
to
the
incident
itself,
the
Striking
of
anyone-
you
did
not
make
any
observations
about
that.
Having
come
to
the
scene
after
it
happened,
correct.
N
Already
right
yeah,
so
what
you
were,
what
you
were
told
was
what
you
heard
from
people
on
the
scene,
including
the
staff
and
including
other
people
and.
N
Correct
yes,
and
have
you
now
you
have
not
seen
the
video
recently
I
think
you
just
suggested
it
was
months
ago,
yeah.
E
I
was
within
a
day
or
two
of
the
incident,
whatever
that,
whatever
that
date
that
you
just
referenced
was
all.
N
Right
and
I
I
I
know
we
provided
it
yesterday
when
it
was
provided
to
me
I,
provided
it
to
the
board,
and
my
information
and
belief
is
that
it
shows
the
staff
member
being
basically
sucker
punched
by
an
individual
in
the
video.
N
Are
you
from
do
you?
Are
you
aware
that
happened.
E
If
you
want
to
play
the
video
for
the
for
the
board,
I
think
that'd
be
wonderful.
The.
E
I
I
have
not
seen
the
video
in
the
last
five
months.
It
was
not
provided
to
us.
Obviously
counselor
just
represented
that
he
just
gave
it
to
the
board
yesterday,
which
means
we
weren't,
providing
it.
E
If
it
did,
it
went
to
the
detectives
and
I
personally:
don't
have
it,
it
might
have
gone
to
the
detectives.
I
I
personally,
don't
have
the
video
okay.
N
E
N
E
No
I
I
asked
Miss
Metcalf
I,
asked
I
just
found
a
staff
member
I
said
who's
in
charge
and
they
said
well.
The
manager
just
left
I
said
so.
There's
no.
Is
there
any
manager
here
at
all
I
said
no
I
said
well,
someone
needs
to
sign
for
the
violation
so
says
someone
we
can
call
to
be
a
manager
or
who's
who's
in
charge
and
I
was
responding
back
with
a
note,
not
the
end
of
the
world.
N
Okay,
all
right
and
then
she
did
cooperate,
sign
the
sign.
The
notice
and
oh
yeah
otherwise
cooperate
with
you.
Yes,
yeah.
Okay!
Thank
you,
sir
I
have
no
further
questions.
The
board
May
and
I've
at
some
point
would
like
to
ask
Mr
Baird
a
few
questions
too.
G
Jeffrey
Baird
and
I
am
the
owner
and
manager
on
record.
Okay.
N
G
When
I
leave,
the
usually
the
bartender
working
is,
is
in
charge.
G
N
So
there
was
in
your
belief
there
was
a
manager
on
duty
when
the
Boston
police
arrived
that
night.
Yes,
it
just
wasn't
you
correct,
and
did
you
subsequently
a
see
the
film
the
video
of
this
incident
and
B?
Did
you
subsequently
turn
it
over
to
the
Boston
Police
Department
I.
G
Did
when
I
believe
Sergeant
Crossing
brought
down
the
violation,
I
had
emailed
it
to
him
or
two
I.
Have
it
here,
Zachary
doc,
Crossland
at
PD,
doc,
pdboston.gov,
maybe
I,
don't
know
if
I
got
the
email
right,
but
I
did
email
to
him
as
we
were
having
the
conversation
that
evening,
but
again,
I'm
not
sure
if
the
email
goes
to
him
or
if
it
goes
to
the
detectives,
but
because.
N
But
in
any
event,
you
provided
it
to
the
Boston
Police
Department,
yes
correct
and
in
in
reviewing
the
film
and
speaking
to
your
employees.
Can
you
tell
the
board
what,
in
your
opinion,
what
occurred
here.
G
It's
pretty
clear
in
the
video
that
the
the
gentleman
came
back
after
about
40
minutes
of
he
was
escorted
out
for
being
unruly
in
45
minutes
later
came
back
in
and
sucker
punched,
my
door
guy
Al
who's
been
sucker
punched
countless
times
over
the
years
he's
been
with
me
about
eight
years
and
it's
pretty
clear
that
they
reacted
in
a
defensive
way
and
the
the
injuries
are
from
the
ground
them
wrestling
on
the
ground,
where
the
victim
actually
still
had
Al
in
a
headlock
on
the
on
the
ground,
while
Zach
was
trying
to
pull
him
off
and
call
91
at
the
same
911.
G
G
It
was
probably
tough
for
the
PD
to
decide
what
happened
as
they
showed
up.
I'm
sure
it
looked
messy
from
you
know
from
their
point
of
view,
so
they
just
wrote
it
up
as
what
they
were
told
not
having
any
video
right
away.
So,
okay,.
N
All
right
at
the
thanks,
Mr
bear
the
the
board
may
have
some
questions
for
you
just
stand
by
please
thank.
C
I
do
thanks
so
Mr
Baird
you're
saying
what
led
up
to
this
was
the
man
being
objected
45
minutes
before?
Yes,.
O
G
The
city
was
clearly
intoxicated
and
he
was
leaving
with
his
his
drink
to
go
out
and
smoke
and
they
he
wouldn't
give
up
the
drink.
And
then
they
finally
just
said
just
leave
and
don't
come
back.
C
Okay
and
as
far
as
the
no
manager
on
duty
and
the
training
of
your
staff,
you
said
you
left
and
you
believe
there
was
a
manager
on
duty.
What's
the
normal
process,
do
you
Noah.
G
Processed
about
when
I'm,
when
I'm,
not
there
or
I,
have
two
other
managers.
When
they're,
not
there,
the
bartender
in
charge,
you
know
that
that's
I
I
don't
leave
a
bartender
alone.
That
does
not
have
significant
seniority.
You
know,
stuff's
been
Bartending
for
10
years,
she's
been
with
me
for
a
few
years.
So
you
know,
leaving
her
in
charge
for
an
hour
at
the
end
of
the
night
is,
is
normal
procedure
I?
She
just
got
nervous,
I,
think
and,
and
that
has
been
corrected
with
the
entire
staff
too.
G
I
N
C
And
what
is
a,
what
is
the
training
procedures
or
what
are
those
the
procedures
for
when
a
patron
becomes
violent?.
G
G
I
I
have
a
yeah
a
few
page
document.
I
believe
I
sent
it
to
last
hearing
last
couple
weeks
ago.
I
could
resend
it
to
you
if
you
like,
yes,.
C
Okay,
I,
don't
believe
the
other
Commissioners
were
on
there,
but
we'll
make
sure
they
got
a
copy
of
it.
I
don't
have
any
questions,
commissioner
Curran.
J
I
have
watched
the
video
and
it
it's
not
clear
that
he
gets
a
punch
in
the
face
on
your
employee.
Is
that
what
you're
telling
has
happened.
J
G
G
G
I
mean
he
could
have
restrained
himself
a
little
bit
better,
but
you
know
when,
when
someone's
swinging
that
you
don't
know
how
many
times
they're
gonna
swing
at
you,
you
know
so
so
it
was
it.
You
know
it's
it's.
You
know
he
they
they
held
him
on
the
ground
and
you
know
I
I'm
glad
to
see
that
they
did
not
swing
anymore.
You
know
my.
My
staff
did
not.
G
It's
clear
that
they
didn't,
they
didn't,
you
know,
retaliate
in
any
any
at
all.
You
know
the
injuries
were
to
me
on.
The
videos
seemed
pretty
clear
that
the
gentleman
did
to
have
Al
on
the
back
of
the
head
and
Al
was
trying
to
get,
you
know,
did
not
throw
and
he
punches
or
anything.
It
was
just
clearly
shoving
and
it
was
a
wrestling
match,
basically
on
the
ground
of
trying
to
get
off
each
other
and
to
me
that's
where
the
injuries
were
from.
G
J
J
G
Yeah
I
know
Al's
been
with
me.
She's
I
inherited
him
at
the
Blackstone
since
2014,
and
he's
been
out
out
there
with
me
quite
a
bit
in
the
a
lot
has
happened
over
that
time
and
he
he's
not
not
an
aggressor.
In
multiple
times.
He's
been
soccer
punched
in
the
face.
Okay,.
L
Like
did
you
do
an
investigation
with
Al
like
does
he
have?
Did
he
write
anything
as
part
of
your
process
of
figuring
out
what
happens,
particularly
because
you
weren't
there
and
he
was
invited
to
testify
today?
This
is
just
not
available.

H
Thank
you,
I
was
on
scene
when
I
got
the
radio
call
and
like,
like
everything,
the
detective
said
is
correct.
We
did
couldn't
find
your
ID
or
anything,
but
we
did
I
find
that
we
did
find
her
phone.
H
We
don't
know
what
happened
to
her
idea.
You
know
nobody
gets
into
the
club
without
an
ID
and-
and
you
know,
I
made
sure
that
they're,
you
know
they're
21
their
date
of
birth
is
we
found
out
later
it
was
12
796..
Her
stuff
was
some
of
her
stuff
was
found
at
the
club
when
the
cleaning
crew
came
in
that
night
and
we
were
able
to
get
get
that
back
to
her
first
thing
we
did
was
called
9-1-1.
H
Obviously,
and
you
know,
we
were
concerned
that
she
might
have
taken
something
we
we
had
no
idea
and,
like
you
said,
when
the
officers
arrived,
pupils
were
dilated
and
we
you
know
we
had
the
EMS,
take
it
to
Tufts
Medical
Center.
B
C
I
C
Okay,
thank
you.
Can
someone
from
the
licensed
seat
tell
us,
or
do
you
know
how
long
she
was
in
the
license
premise
or
how
many
drinks
she
may
have
had
that
night.
H
H
We,
we
don't
have
a
you
know
like
a
credit
card
statement
or
or
Bill
or
anything
like
that,
but
this
happened
suddenly,
because
I
have
security,
I
mean
we've
got
about
18
people
doing
security,
you
know
between
outside
and
inside,
and
we
were
constantly
you
know
roaming,
the
club,
you
know
making
sure
everybody's
safe.
So
this
this
is
something
that
you
know
happened.
H
C
H
Well,
no,
our
cameras
are
mainly
around
the
bars
okay.
C
H
H
No
geez
I'm,
sorry
I
I,
I,
I
I
didn't
even
I
I
I.
At
the
time,
I
was
in
the
middle
of
trying
to
worrying
about
her
and
I.
Didn't
think
about
that.
D
But
I
think
that's
a
great
question,
Madam,
chairman
and
and
I
think
we
will
take
that
under
advisement
and
and
and
put
that
into
work
for
us
so
that
next
time
something
like
this
happens,
we
can
give
you
a
better
answer.
Okay,.
J
Just
a
second
that
we
do
on
these
matters,
we're
seeing
more
of
them.
We
just
we
need
better
follow-up
coming
into
these
hearings
from
you
guys,
so
we
can
maybe
have
a
chance
and
get
into
the
bottom
and
then
thank
you
totally.

as
follows:
on

the

the

unable

I

the

of

Thank.
H
Yeah,
this
was
actually
brought
to
my
attention
when
my
security
at
the
door
said
that
there
was
an
officer
up
the
street
at
the
bus.
Stop
so
I
came
down
and
that's
what
I
found
out
that
they
were
actually
in
the
club.
H
As
far
as
we
know,
they
walked
out
of
the
club
and
went
down
the
street
and
went
to
the
bus,
stop.
They
were
inside
the
little
bus
stop
area
trying
to
get
an
Uber
and
I
mean
we
once
they
left
the
club
I.
You
know
they
were
they
were.
They
were
75
yards
down
the
street
at
that
point,
I
don't
have
anybody
saying
that
they
saw
anybody
stumbling
out
of
the
club
I
asked
some
security
at
the
door.
H
H
No
I
mean
we
would
never
allow
somebody
in
a
condition
like
that
to
leave
the
club
week.
We've
I've
we've
put
this
way.
We've
been
in
front
of
you
many
times,
because
we
stopped
people
from
coming
in
from
leaving
the
club
in
that
kind
of
a
condition.
B
Thank
you,
chairman
Drake.
You
have
any
questions.
C
H
H
Not
right
at
the
front
door,
but
there's
there's
one
at
the
bottom
of
the
stairs
when
you
before
you
leave
where
the
path
down
is
and
there's
one
at
this
at
our
mezzanine
level,
where
people
come
in
and
leave
to
to
pay
did.
H
No
I
I
did
not,
and
and
by
the
time
this
was
brought
to
my
attention-
the
camera
life
Delete,
the
the
camera
tapes,
whatever
they
they
delete
themselves.
You
know,
after
about
two
or
three
weeks,
depending
on
how
busy
we
are
so
I
I
could
not
go
back
again
and
and
look
at
that.
D
I
will
I
will
say
that
at
the
end
of
the
night,
I
stand
outside
I'll,
say
good
night
to
everybody
and
I
one
of
the
main
things
I'm
doing
when
I'm
saying
good
night
to
people
is
to
see
if
anybody
needs
any
help.
So
if
anybody
needs
any
help,
I
take
over
right
from
that
point,.

You
have
no
personal

of
this

Is
that
correct.
N
And
with,
in
that
regard,
the
inspection
notice
indicates
that
the
management
cooperated
with
the
police.
Is
that
correct.
I
N
Right:
okay,
thank
you
very
much.
We
responded
called
the

Have
no,

somebody

We

You
guys
can
hear
me:
okay,
yes,
yes,
yeah,
so
just
so
everyone's
Claire.
There
were
two
gentlemen.
You

talking

you

the

is
Jeffrey

and
then
the

that
they're
talking
about
so
our

the

the

ran

broke.
M
It
up
immediately,
kicked
that
gentleman
out
and
called
the
police
and
then
in
the
meantime
they
were
talking
to
the
victim
Jeffrey.
If
he
wanted
any
medical
attention
or
anything,
he
did
not.
The
police
showed
up,
we
cooperated,
and
that
was
pretty
much
it.
The

went
looking

him,
but
he
was
long
gone

R
O
Sorry
about
that
we
have
an
ID
science
scanner
that
we
scan
all
licenses
through
and
according
to
you
know,
gives
us
if
it
gives
us
a
green
check,
mark
we're
good
to
go,
and
if
it
gives
us
a
red,
big
x,
it's
doesn't
and
that's
what
we
did
that
night
she
came
in.
We
ran
our
ID,
our
Colorado
ID,
and
it
came
back
a
green
check
mark
and
that's
why
we
sold
to
her.
K
If
I
may,
for
the
record,
we
I
forwarded
to
the
board
a
copy
of
the
ID
scan
that
we
did
on
this
license,
that
we
were
able
to
get
from
our
scanner
and
you
have
it,
and
it
shows
that
the
ID
passed
our
our
ID
scanner.
Now,
if
I
could
have
Mr
hazena,
please
get
into
the
camera
so
that
he
can
tell
the
board
what
happened.
That
night.
O
K
This
morning,
can
you
please
State
your
full
name,
sir,
and
were
you
working
on
the
night
of
this
alleged
incident?
I.
Q
Q
K
How
long
have
you
been
employed
by
Quality
Mart,
almost
20
years,.
Q
K
Now,
can
you
tell
the
board
what
happened
that
night
and
how
you
were
informed
that
there
was
a
sale
to
a
an
underage
person
me.
Q
Q
We
ran
it
through
the
ID
science
scanner.
It
gave
us
a
pass
her
friend's
ID.
We
did
not
take
because
she
was
not
the
person
the
person
making
the
purchase.
So
we
ran
her
ID
and
passed
so
we
sold
to
her.
K
Okay,
and
how
do
you
know
how?
How
are
we
able
to
determine
that
the
picture
of
the
ID
scan
that
we
submitted
to
the
board
today
is,
in
fact,
the
woman
that
is
alleged
to
have
been
served.
Q
Because
it's
also
the
idea
that
Sergeant
Gallagher
has
and
I
forwarded
an
email
a
couple
days
later,
when
I
was
able
to
get
in
touch
with
ID
science,
I
sent
an
email
to
detective
Gallagher
or
Sergeant
Kentucky
Galler
telling
him
like.
Listen,
sir
I
just
want
you
to
know,
you
know
we're
not
a
bunch
of
scumbags
and
we
actually
did
scan
the
ID,
and
this
is
what
we
got
back,
and
this
is
why
it
was
sold
to
her.
It
wasn't
a
situation
of
where
we
just
decided
that
we
looked
at
the
idea
and
just
sold.
Q
K
So,
okay,
so
you
believe
that
I
that
night,
that
the
policies
of
Quality
Mart
were
being
followed
to
the
letters
is
that.
K
Okay,
thank
you
so
to
the
members
of
the
board.
We
do
have
this
policy,
this
ID
scanner.
Obviously
this
is
not
what
we
expected
to
happen
when
we
we've
made
this
major
purchase
we're
going
back
to
ID
scanner.
We
are
right
now
in
touch
with
them,
asking
them
how
you
know.
K
How
did
this
happen,
and
you
know
why
we
shouldn't
switch,
but
we
have
in
good
faith,
then
scanning
every
every
license
that
comes
in
there,
so
where
we,
we
believe
that
we
took
due
care
and
we
were
we're
going
to
sharpen
and
do
whatever
we
need
to
do
to
make
sure
that
this
doesn't
happen
again.
B
Thank
you,
yep,
chairman
Joyce.
Do
you
have
any
questions.
C
First
is
my
comment:
you
can't
rely
on
an
ID
scanner,
there's,
no
presumption
that
that's
correct.
Have
you
ever
considered
asking
for
backup
ID
out
of
state
IDs.
C
A
K
Is
one
of
the
things
we've
discussed
to
look
into
and
we
we
appreciate
the
board's
taking
the
time
to
give
us
a
suggestion,
because
we
do
need
we
need
to
be
more.
You
know
we
need.
C
Not
enough
to
rely
on
it's
not
enough
to
rely
on
an
ID,
that's
the
abcc
recommended
to
you.
The
software
could
not
be
up
to
date.
I
don't
know
enough
about
when
it
was
last
updated.
It
doesn't
matter
it's
scanned
as
fake.
It
was
fake
and
do
alcohol
was
sold
to
an
underage
person.
So
I
don't
have
any
other
questions.
Commissioner
Karina,
commissioner
Saxon.
J
R
We
we
did
scan
both
those
IDs
outside.
Actually
one
did
not
give
an
ID
fourth
commonly
we
had
to
kind
of
pry
it
out
of
her,
but
the
ID,
the
Colorado
license
that
we
were
given
did
not
pass
our
scanner.
I
went
back
inside
with
Detective
Hernandez.
We
approached
the
manager.
There
was
a
young
woman
working
a
counter.
R
It
might
have
been
for
a
stay
or
something,
but
we
we
then
watched
them
scan
the
ID,
and
it
came
back
negative
that
it
was
no
good
how
much
we
weren't
there
for
their
first
scan,
but
we
scared
them
multiple
times
after
that
and
each
time
we
scanned
it
on
their
scanner.
They
came
back
as
not
a
ballot.
Id
I
talked
to
the
manager
that
night
and
I
said.
Listen.
R
If
there's
a
problem
with
the
scanner,
you're
gonna
need
to
provide
some
type
of
documentation
that
the
scanner
is
not
functioning
properly
and
I
would
call
the
company
who
got
this
from
and
tell
them
there's
a
problem,
because
if
they
can
rely
on
this
wholeheartedly,
it's
not
doing
a
good
job.
I
mean
they're,
surrounded
by
students.
They're
going
to
get
beat
all
the
time.
J
Sergeant
detective,
the
the
ID
that
you
scan
that
you
were
presented
with.
Did
it
have
the
actual
this,
the
name
of
the
person
who
gave
it
to
you
on
it?
Yes,.
Q
Did
ask
the
girl
for
for
her
school
ID
as
well
to
match
up
the
name.
J
You
you've,
given
us
proof
of
a
scan
that
came
back
past,
but
it
doesn't
have.
It
doesn't
match
a
name.
That's
on
the
police
report.
K
Well,
this
is
what
we
went
back
and
we
looked
at
everything
we
had
scanner
ID
to
give
us
what
exactly
what
was
scanned
so
that.
J
K
We'll
go
back
and
check
the
records.
We
will
ask
scanner,
we
will
ask
our
ID
people
to
do
it
because
they
they're
the
people
that
we're
dealing
with
right
now
to
find
out
what
is
basically
if
there
is
a
problem,
what
it
is
and
I'm,
maybe
just
change
them
as
a
vendor.
J
Okay,
but
do
you
do
you
understand,
what's
happening
like
most
of
these
young
people
with
the
fake
IDs?
They
have
their
real
name
on
it
and
they
just
switch
up
the
other
information.
So
it
would
be
unusual
to
have
a
different
name,
but
this
this
name
on
the
the
scan
that
you
sent
us
does
not
match.
The
two
individuals
that
were
approached
by
the
officers
by
the
detectives
is.
Q
That
is
the
idea
that
was
scanned,
and
that
was
the
idea
that
was
scanned
by
the
detectives
yeah,
but
these
that
was
that
that
was
the
exact
idea.
I.
Have
it
here
that
the
detective
sent
me
that
night
I
have
it
right
here
sent
by
by
the
detective
brought
it
back
in
I?
Had
my
employee
take
a
picture
of
it
here?
It
is.
This.
Is
the
ID
itself
simanova
martinova?
This
is
the
ID
detective
Gallagher
brought
back
in,
and
this
is
the
name
that
is
on
the
skin.
I
provided
okay.
This
is
the
idea.
Q
R
J
They
say
Carla's
and
or
Lucas.
S
Q
She
did
not
provide
an
ID
either,
but
the
ID
that
was
brought
back
by
detective
Gallagher
is
right
here
on
seminova
martinova,
and
this
is
the
ID.
I
gave
the
name
to
the
ID
science
people
and
they
went
back
and
pulled
it
out,
and
it
also
shows
it
failing
after
when
detective
Gallagher
brought
it
back
in
to
rescan
that
same
ID
passed
the
initial
scan
and
then
failed
when
Sergeant
detective
Gallagher
brought
it
back
in.
Q
B
L
I
mean
I,
all
I
would
say
is
just
like
before
you
just
kind
of
throw
away
the
machine
and
get
another
one.
Just
kind
of
check
yourself
for
human
error
and
in
process
and
in
handling
the
machine
itself.
A
B
You
thank
you.
Thank
you.
Thank
you.

fake
IDs
or
what's
are
the
telltale
signs
and
when
to
get
a
manager
involved,
we've
been
doing
verbal
training
for
roughly
about
a
week
and
then
the
secondary
week
we're
more
quizzing
asking
questions
to
the
staff
and
having
them
recite
information
to
us.
U
We
do
and
what
qualifies
as
a
second
form
of
identification,
as
well
as
asking
their
address
date
of
birth
Etc.
That's
the
same
on
the
cards
since.
T
This
incident
have
you
had
to
decline
on
the
individuals.
U
We've
had
two
separate
instances
where
we
have
declined.
Service
one
was
a
60th
birthday
party
that
was
held
on
the
same
floor
as
this
particular
event.
There
was
an
individual
that
produced
an
ID
at
the
bar.
It
was
a
55
person
event.
Bartender
did
not
feel
comfortable
with
the
form
of
identification.
It
wasn't
out
of
state
New
York
license,
we
did
refuse
service
and
we
did.
We
did
have
bracelets
in
place.
U
At
that
point,
it
was
like
I
said
a
60th
birthday,
so
we
put
marker
X
on
her
hand
to
identify
that
she
was
not
able
to
be
served.
Alcohol.
The
second
incident
was
on
the
first
floor.
Shojo
restaurant.
It
was
three
individuals,
one
seemed
young
to
us
with
the
Philadelphia
license.
U
We
did
go
through
the
proper
produce,
proper
steps.
You
know
she
was
able
to
recite
all
the
information
on
the
ID
card,
however,
was
not
able
to
produce
a
second
form
of
ID,
and
we
just
did
not
feel
comfortable,
and
we
turned
down
that
one
group
of
three.
T
Thanks
Brian
Madam,
chair
and
members
of
the
board,
if
I
may,
just
in
summary,
in
addition
to
Brian's
testimony
I
know,
the
board
has
been
presented
with
this
before,
but
obviously
increased
sophistication
of
fake
IDs
that
utilize,
essentially
all
the
information
of
a
patron
but
for
a
birth
year
and
what
appears
to
be
proper
watermarks
on
IDs
has
has
again
become
increasingly
sophisticated
and
something
that
all
licensed
primacies
have
been
battling
against
for
some
time.
These
are
a
few
unfortunate
incidents
and
IDs
and
patrons
that
did
get
by
the
staff
on
this
evening.
T
Since
that
time,
the
licensee
has
taken
several
steps
to
hopefully
ensure
that
this
doesn't
happen
again.
This
is
a
licensee-
that's
been
here
and
licensed
for
decades
with
no
history
of
persons
under
21
in
possession
violations
on
their
record.
As
you
heard,
they
did
update
their
training
policies,
manuals
and
procedures.
One
to
get
managers
involved.
Ask
for
backup
now
instituting
training
at
every
pre-meal
meeting
and
quizzing
staff
to
hammer
it
home
consistently
with
staff
what's
unacceptable
or
versus
acceptable
for
forms
of
identification.
T
They
have
also
purchased,
as
you
heard,
an
ID
scanner
to
utilize,
with
for
both
events
and
in
the
restaurant
again
to
prevent
anything
further
from
happening
again.
Of
course,
we
are
both
happy
to
answer
any
questions
that
the
board
might
have
beyond
that.
B
Thank
you
very
much
chairman
Joyce.
Do
you
have
any
questions.
C
What's
the
question
for
detector,
Hernandez
or
Sergeant
Gallagher,
the
police
report
says
that
when
you
enter
there
were
many
looking
individuals
that
appeared
underage.
C
The
three
people
that
you
id'd
were
those
just
that
were
to
do
were
those
the
only
three
people
that
you
decided
to
ID
that
night
or
I'm
just
wondering,
because
the
statement
saying
that
there's
many
young
looking
individuals
and
then
there's
testimony
that
you
know
this
was
a
unfortunate
incident
but
I'm
trying
to
get
a
picture
of
the
room
to
appear
that
there
were
many
others
as
well.
R
It
starts
downstairs
we
can
kind
of
get
tipped
about
this
place,
that
there
was
something
going
on
this
evening
and
as
we
waited
outside
to
go
in
I
noticed
cars
up
front
with
appeared
to
be
like
parents
suede
in
cars,
for
people
to
come
out,
which
kind
of
tipped
us
off
that
this
might
be
even
younger
than
we
anticipated.
But
those
three
people
were
the
first
three
people
we
stopped,
and
you
know
we
we're
not
going
to
we're
not
into
piling
on
Three's
enough.
A
lot
of
the
crowd
looked
very
young.
S
B
Thank
you,
commissioner.
Any
questions.
D
S
Good
morning
I'll
be
reading
from
a
pollution
portraits
which
I
wrote
on
Saturday
October
22nd
2022
shine,
detective
William,
Gallen,
detective
honey,
Hernandez
assigned
to
the
BPD
licensed
premise
unit
conducted
a
license
premise:
inspection
of
SoJO
located
in
nine
Tyler
Street
in
Boston
detectives
also
wanted
to
speak
to
Stafford
Garden,
a
rave
type
party
occurring
at
the
address
the
prior
night,
while
inside
the
establishment,
detectives
observed
a
table
of
three
patents
with
alcoholic
beverages
in
front
of
them.
Detectives
notice
that
these
patrons
appeared
young
detective
absence
of
the
produced
identification
to
confirm
their
ages.
S
The
patrons
initially
stated
they
were
all
over
21
years
of
age
and
two
patrons
provided
detectives
with
driver's
licenses,
stating
they
were
over
21
years
of
age.
Detectives
use
a
license.
Verification
program,
which
confirmed
the
true
driver's
license,
were
indeed
fraudulent.
The
frauds
on
driver's
licenses
contained
the
individual's
correct
name
but
display
the
date
of
birth
made
appear,
so
they
were
over
21
years
of
age.
The
two
frauds
and
driver's
licenses
were
confiscated
by
detectives.
His
third
Patron
initially
stated.
S
He
had
no
identification
and
no
identification,
but
eventually
provided
his
valid
Texas
driver's
license
confirming
he
was
under
21
years
old.
Upon
further
investigation.
The
patrons
are
positive
positively
identified
as
Spencer
Young
Samar
neighbor,
with
fraudulent
Mexico
driver's
license
and
a
frozen
Texas
driver's
license
respectively.
S
Also,
while
inside
the
establishment
detectives
proceeded
to
review
the
licenses
and
permits
of
the
establishment,
detectives
learned
the
capacity
of
the
premise
to
set
the
47
patrons
detector
Hernandez
performed
the
mechanical
count
of
the
establishment
discovered
the
actual
number
patrons
located
inside.
The
premise
was
59..
The
Texas
brought
this
to
the
attention
of
the
person
in
charge,
Mr
Jin
Tran.
T
Please
detective
Hernandez
the
patrons
produced
fraudulent
driver's
licenses
to
you
and
Detective.
S
T
Did
it
also
include
an
accurate
or
what
you
deem
to
be
an
accurate
picture
of
the
individuals
as
well?
Yes,
and
the
patrons
in
the
first
instance,
initially
lied
to
to
you
and
Sergeant
Dr
Gallagher
as
well
about
their
ages.
Correct.
T
The
patrons
when
you
were
interviewing
them
initially
lied
to
you
about
their
ages,
correct
and
their
identification.
Yes,
so
is
it
possible,
then,
that
they
lied
to
you
about
not
being
asked
for
identification
by
staff
as
well.
No.
T
T
T
No
further
questions
at
this
time,
I
appreciate
that
detector
Fernandez
Madam
chair
members
of
the
board
in
the
first
there's
an
initial
matter
regarding
the
capacity
count
we
they
did
have
12
staff
on
duty
that
evening
it
was
the
licensed
premises,
belief
that
their
the
staff
didn't
count
towards
overall
capacity.
They
are
very
well
aware
of
that.
T
At
this
point
now
it
was
exactly
12
staff
on
that
evening
and
they're
currently
working
with
an
architect
who
will
subsequently
work
with
the
building
department
to
increase
their
capacity
as
well
as
far
as
the
count
against
them
for
persons
under
21
in
possession
of
alcohol.
T
We
joined
interview
staff
and,
if
the
board
deems
warranted,
we
can
provide
after
signed
affidavits
by
them
as
well,
including
the
manager
that
was
on
duty,
Jim
Tran,
who
has
identified
in
the
report
as
the
person
in
charge.
Although
staff,
the
staff
member
member,
who
allegedly
confirmed
they
did
not
ask
her
patrons,
isn't
identified
in
the
report,
both
Jim
and
the
server
stated
that
they
did
indeed
ask
for
identification
from
these
staff
members.
T
This
is
obviously
again
similar
to
the
the
violation
that
you
heard
a
moment
ago
for
the
related
license
premises
upstairs
something
that
was
unfortunate
and
definitely
an
oversight,
and
since
that
time,
that
particular
staff
member
who
had
only
been
on
duty
with
them
for
about
two
or
three
months,
was
issued.
A
verbal
warning
and
all
staff
have
undergone
updating
training,
including
an
updated
training
manual,
tip
certification
requirements.
T
The
license
premises
is
also
again
purchased
for
the
record
and
ID
scanner
for
use
at
both
events
upstairs
at
China
Pearl
and
downstairs
the
restaurant
with
Shojo,
with
any
questions
that
relate
to
whether
or
not
IDs
are
accurate,
they're
told
and
instructed
to
involve
a
manager,
and
if
there's
any
question
whatsoever
for
that
Patron
not
to
be
served,
we
would
we
would
resubmit
for
the
record
all
the
the
mitigation
steps
that
this
same
licensee
has
taken
that
you
heard
just
a
moment
ago
in
the
last
violation
for
the
record,
but
of
course,
happy
to
answer
any
questions
that
the
board
might
have
regarding
this
incident
as
well.
B
Thank
you.
The
board
we'll
take
this
matter
under
advisement
as
well.
Thank
you
and
we
will
take
a
second
call
for
those
that
were
not
present
when
they
were
initially
called.
Is
anyone
present
on
behalf
of
Belarus
Colombia.
B
P
I
got
a
question:
My
Lou
is
not
present
and
we
was
trying
to
request
if
you
can
give
us
a
further
day,
because
we
asked
for
the
video
footage
of
the
of
the
cameras
body
cameras
and
they
were
going
to
provide
it
to
us.
So
he's
not
ready.
So
he
was
trying
to
see
if
we
can
push
it
push
a
further
date
because
he
can
be
a
president.
B
B
Thank
you,
Mr
Frontiers
is
that
for
items
six
and
seven
you
are
requesting
a
deferral.
B
B
R
R
B
C
You,
madam
chair,
excuse
me
I,
think
I
think
we'll
I
don't
believe
this
is
the
same
confusion
as
the
one
before
I
think
we
can
read
this
one
into
the
record
and
proceed.
B
B
B
Thank
you.
You've
both
been
sworn
in
Sergeant
gentle
Gallagher.
You
may
please
proceed
with
the
report.
R
Yes,
good
morning
on
9
3
2022
at
1208,
A.M
William,
Gallagher
who's
checked
with
Eddie
Hernandez,
signed
the
license
premise
unit,
we're
dropping
off
a
hearing
notice
to
Red
Line
Pizza
580
Dorchester
Avenue
on
the
Absurd
Patron
is
sitting
inside
the
establishment
waiting
for
pizza
as
well
as
patrons
entering
and
exiting
with
their
orders.
Objective:
Snow
Red
Lion
Pete's
to
have
an
11
30
PM
license,
but
the
only
deliveries
after
that
people
to
check
the
conservative
side
would
not
delivery
drivers
for
the
medical
patients.
R
This
again
was
brought
the
attention
to
the
manager
Mr
enault
mikos.
As
a
result
of
the
check
that
said,
observed,
Sergeant
check
the
Gallagher
issued
license
from
his
inspection
notice,
number
zero,
four
three
three
seven:
four:
it's
a
Red
Line
Pizza,
patrons
on
premise:
at
1208
a.m.
After
post,
at
11,
30
PM,
closing
Mr
mikos
assigned
poll
and
accepted
the
notice,
those
essentially
other
facts
of
that
money.
B
B
Thank
you
and
chairman
Joyce
is
your
intention
to
vote
on
this
matter
on
Thursday.
B
Thank
you
for
stating
that,
for
the
record,
the
board
will
take
this
matter
under
advisement
as
well,
and
those
are
all
the
items
before
the
board
today
that
will
conclude
this
morning's
hearing.
Thank
you.
Everybody
thank.
