B
A
Good
morning,
everybody
we're
just
gonna,
give
folks
a
few
seconds
to
clear
the
waiting
room
as
a
reminder
when
you
are
entering
from
the
waiting
room,
please
do
remain
on
mute
unless
or
until
you
are
appearing
or
testifying
before
the
board.
A
Good
morning,
this
is
a
hearing
before
the
licensing
board
for
the
city
of
boston.
Today
is
tuesday
july
12
2022.
Today's
hearing
is
being
held
pursuant
to
temporary
amendments
to
the
open
meeting
off.
That
is
what
allows
us
to
meet.
Virtually
today's
hearing
will
be
recorded
and
posted
to
the
city
of
boston's
website.
Before
I
review
procedural
matters,
I
will
introduce
chairwoman
kathleen
joyce.
C
A
Thank
you
please
ensure
that
your
audio
and
visuals
are
worked
properly.
I
will
call
each
item
in
the
order
it
appears
on
this
morning's
agenda.
I
will
then
ask
who
is
present
on
behalf
of
the
licensee
who
is
present
on
behalf
of
the
boston
police
department
and
whether
there
are
any
other
individuals
with
first-hand
knowledge
of
the
alleged
incident
who
wish
to
testify.
I
will
then
swear
in
all
parties.
After
that,
the
police
report
will
be
read
into
the
record.
A
Again,
all
testimony
will
be
limited
only
to
those
individuals
with
personal
first-hand
knowledge
of
the
alleged
incident

A
A
D
Okay,
thank
you.
Good
morning,
I'm
gonna
enter
into
record
police
report
two
two:
two:
zero
zero,
nine
six
one
eight
this
report
was
written
by
officer
gomes,
not
myself
officer
gomes
is
currently
out
injured,
so
she
won't
be
present
at
this
time
so
about
12
18
a.m.
On
thursday,
2
10
22
officers
gomes
and
michelle,
while
assigned
to
the
kilo
102
alpha
unit,
responded
to
a
radio
call
for
an
investigative
person
at
34,
habitab
brighton
upon
arrival
officers
spoke
with
the
caller.
D
Her
name
is
in
the
report,
but
it's
so
she's
known
to
us
who
stated
she
attempted
to
get
into
the
draft
bar
and
grill
tonight,
but
was
denied
entry,
a
victim
who
stated
a
bartender
named
brad
walshaw,
later
identified
as
brett
walshaw,
who
worked
at
the
draft
bar
and
grill,
has
been
harassing
her
by
calling
her
from
an
unknown
number
in
a
group
chat,
victims
say
the
wall
shaw's
phone
number
would
pop
up
in
the
group
chat
victim,
stated
walsh,
invited
himself
to
the
group
chat
from
another
number
victim
provided
officers
with
wall
shaw's
phone
number,
which
is
in
the
report.
D
I
can
provide
it
later
if
you
need
it
victim
stated.
She
was
at
the
bar
about
four
weeks
in
her
for
about
for
about
four
weeks
and
her
friends
told
her
that
walsh
all
was
a
stalker
officers
observed
victim
to
be
intoxicated.
Victim
was
slurring.
Her
words
was
off
balance
and
tilting
officers
attempted
to
speak
with
wall
shaw,
but
he
he
did
not
want
to
show
any
identification.
It
was
uncooperative.
D
So
that's
the
end
of
that
report
and
then,
on
the
next
day,
this
will
be
a
supplemental
report.
So
it's
going
to
be
the
same
report
number
so
on
211
2022,
around
0
12
40
a.m.
Seven
curving,
which
is
myself
in
the
kilo

officers

arrived
at
34,
harvard
ave.
The
draft
bar
signed
a
current
issue.
D
The
draft

a

inspector
notif
notice,
violation,
zero,
six,
zero,
six,
three
one
for
employee
failure
to
cooperate
with
police
refused
to
provide
name
id
to
police
on
soon
on
scene,
and
at
that
time
I
handed
the
violation
to
the
draft
guard.
General
manager
and
those
are
the
two
reports
into
record.
E
Please
so
would
would
it
be
okay
for
me
to
address
the
officer
regarding
it
absolutely
officer.
Did
mr
walshaw
end
up
speaking
with
you
after
this,
after
the
first
conversation,
did
he
come
into
the
station
to
speak
to
you,
after
not.
D
E
Okay-
and
there
is
no,
do
you
know,
is
it
possible
to
ask
you?
Is
there
still
a
case
outstanding
regarding
this.
D
E
Okay
yeah,
so
regarding
the
incident,
apparently,
the
police
came
in
to
speak
to
mr
walsh
and
apparently,
as
far
as
we've
heard
on
the
next
day,
when
we
got
the
violation
he
didn't
give
his
name
and
information.
E
Nobody
on
management
was
was
told
that
that
night,
that
he
wasn't
giving
his
information,
nobody
told
nobody
told
the
manager
there.
Nobody,
nobody
brought
it
up
to
a
manager
that
he
wasn't
cooperating
after
the
incident
took
place
with
the
police
officers.
Well,
when
the
incident
took
place
with
the
police
officers,
the
manager
was
instructed
that
it
was
a
personal
matter
between
mr
walshaw
and
somebody
outside
of
the
establishment,
and
it
didn't
have
anything
to
do
with
the
establishment
it
had
to
do
with
mr
walshaw.
E
E
He
in
turn
told
us
that
he
went
down
to
the
police
station
and
spoke
to
somebody
there
regarding
it
and
everything
had
been
dropped
enough
and
it
was
a
silly
matter
by
a
girl
that
was
had
too
much
to
drink
that
liked
him
and
she
wasn't
allowed
into
the
establishment
because
she
had
too
much
to
drink.
E
You
know
we
we
kind
of
take
it
seriously.
Obviously
we
take
it
seriously
having
people
not
cooperate
with
police,
so
we
immediately
released
mr
walsha
from
working
at
the
establishment.
He
no
longer
works
at
the
establishment
and
we
in
turn
spoke
to
all
the
staff
and
spoke,
and
we
said
everyone's
to
work
with
police,
no
matter
what
first
and
foremost,
cooperation
is
important
with
the
police
officers.
E
So
you
know
I
don't
I
don't
know
what
else
we
could
have
done
better
in
this
situation
and
and
and
I'm
sure,
if
there's
anything
else
that
is
needed
by
us
from
the
police.
We
we
welcome.
We
welcome
the
help.
C
And
during
that
time,
had
you
trained
him
as
far
as
cooperating
with
police.
E
C
E
C
I
don't
have
any
other
questions,
commissioner.
Curran,
do
you.

mrs

at

mrs

stated
that,
while
working
at

on
the
date
above
at
20

her

to

altercation.

noted
that
miss

salvador
that
she
should
clean
up
her
area
while
she
was
where
she
was
situated.
This
resulted
in
a
verbal
exchange
between
the
two
parties.
H
Until
suddenly,
ms
salvador
turned
and
struck
miss
riaz
to
the
face.
Miss
reyes
declined
medical
attention
this
time,
but
acknowledges
that
she
feels
soreness
to
the
left
side
of
her
face.
Miss

H
I
think
that's
essentially
the

there's
a
different
one.
A
Nope,
that's
great.
Thank
you
very
much.
Thank
you,
mr
portillo.
Would
you
like
to
address
the
alleged
incident.
G
Yeah
so,
first
of
all,
I
apologize
that
for
the
insanity
happening,
we've
been
running
the
restaurant
for
a
long
time.
We
really
control.
When
we
sell
liquor,
we
don't
even
sell
a
lot
of
liquor
deal,
we
sell,
we
focus
on
sell
food.
This
was
an
incident
happen
within
between
two
employees.
There's
no
much
we
can
do
was
know
they
could
involve.
Since
the
incident
happened,
the
two
employees
talked
and
they
came
back
to
us
saying
they
want
to
go
back
to
work.
G
We
suspend
them,
for
you
know
a
few
a
few
weeks,
but
then
we
call
them
back,
we'd
sit
down
and
talk
to
them
and
they
apologized,
and
you
know
they
they
went
back
to
work
like
I
said
I
apologize
for
the
incident,
but
we
think
that
you
know
with
no
liquor
involved,
there's
no
much.
We
can
do
because
with
this
happening
between
two
employees,
then
I
can
say
they
apologize
and
now
they're
working
together
again.

This

was
authored
by
police

and
it
reads
as
follows:
about
1
23
a.m.
On
sunday
april,
10,
22
off
sofini
and
sweeney
were
flagged
down
by
hotel
personnel
at
39
dalton
street.
The
sheridan
multiple
of
the
d4
units
arrived
on
scene
to
give
them
a
hand.
J
Officer
spoke
with
the
manager
of
the
hotel,
daniel
sutherland,
who
stated
there
was
a
large
group
of
people,
approximately
200,
plus
that
needed
to
be
dispersed
from
the
lobby.
Bar
officers
observed
there
to
be
a
large
amount
of
guests
in
the
lobby.
Celebrating
a
hockey
event,
officers
observed
a
large
amount
of
alcohol
being
consumed
along
with
guests
carrying
coolers
and
bags
filled
with
alcohol
throughout
the
lobby.
J
Officers
were
also
informed
by
sunderland
that
guests
were
smoking.
Marijuana
in
the
lobby.
I
then
arrived
delta,
910,
sergeant
disease,
checked
the
hotel
permits
and
observed
three
different
permits.
Displaying
three
different
occupancy
limits.
Sergeant
disease
noted
the
highest
occupancy
limit
of
180
guests,
which
was
still
under
the
amount
of
guests
in
the
hotel
lobby.
A
Thank
you
sergeant,
attorney
upton.
Would
you
like
to
address
the
alleged
incident.
J
J
He
had
mentioned
to
me
that
this
was
a
continuation
of
a
rent,
meaning
this
particular
group
rented
the
night
before,
but
because
the
hockey
team
won
another
game
and
was
progressing
through
the
the
championship
they
they
asked
to
stay
again.
J
So
I
think
it
was
an
unplanned
secondary
group.
If
you
will.
J
H
J
J
J
At
first,
the
manager
wanted
the
entire
group
to
be
dispersed,
but,
as
our
conversation
continued,
it
was
realized
that
the
people
who
were
in
the
lobby
and
the
bar
area
were
guests
at
the
hotel.
So
if
we
disperse
them,
they
would
then
go
upstairs
into
the
hotel
and
it
was
determined
that
the
partying
wasn't
going
to
stop.
It
was
going
to
continue
and
now
upset
and
disturb
the
other,
the
other
guests
that
were
upstairs
so
it
was.
I
All
right
all
right.
Thank
you
very
much
appreciate
that.
Thank
you,

Just
to
give
some
background.
The
boston

the

the
hotel.
Occupancy
has
been
strong
this
year
and
the
hotel
has
not
offered
below
market
rates
or
deep
discounts
for
rooms.
I
On
the
night
in
question,
the
hotel
had
a
group
of
guests
from
colorado
who
were
in
town
for
the
national
college
hockey
championships
to
support
the
university
of
denver.
In
fact,
the
denver
fans
with
support
and
coordination
from
the
hotel
held
a
rally
during
the
afternoon
before
the
game
in
the
hotel

There
were
no
incidents
or
problems
of
any
kind
at
the
rally
later.
K
I
I
Based
on
the
rally
when
it
started
to
occur,
staff
and
security
identified,
the
issues
followed,
proper
call
engaged
with
the
guests
and
soon
called
police
when
some
of
the
offenders
were
non-compliant,
both
a
foreseeable
foreseeability
analysis
and
the
record
of
the

actions
suggested
the

He
tried
to
prevent

did
not

B
That
being
said,
the
buck
does
stop
with
me,
so
I
have
taken
the
measures
described
by
our
legal
counsel
and
now
have
hired
a

new

group
with

enhanced

That
should
give
us

responded
to
a
radio
call
from
adult
and
battery
at
five
lansdowne
street
boston.
M
The
victim
advised
she
left
her
boyfriend
briefly
for
the
bathroom
and
as
she
was
exiting
the
bathroom,
the
security
staff
approached
her
and
demanded
money
for
the
bar
cover.
The
victim
stated
that
she
did
not
know
there
was
a
separate
cover
for,
after
the
event,
the
victim
told
officer
cavallari,
as
she
attempted
to
get
money
from
her
boyfriend.
The
security
staff
tackled
her
and
pinned
her
to
the
ground.
M
The
victim's
boyfriend
stated
that
he
witnessed
the
events
occurred,
the
victim
advised
she
recently
had
acl
surgery,
to
which
the
officer
observed
a
knee
brace.
However,
the
victim
declined
the
need
for
blossom
ems.
It
should
be
noted
that,
as
officer
cavallaria
was
speaking
with
the
victim,
a
female
pedestrian
walked
by
and
quickly
stated
that
she
had
witnessed
a
similar
situation
where
a
patron
was
thrown
to
the
ground
for
a
cover
charge.
At
bill's
bar
officer,
capillary
was
unable
to
obtain
the
pedestrian's
information
officer.
M
Jenner
spoke
with
the
security
staff,
slash
suspects
of
bill's
bar
peter
koskowski
and
alex
and
billa
who
stated
the
two
patrons
had
tickets,
which
expired
when
the
comedy
show
had
ended
at
9pm.
The
suspects
both
stated
that
they
did
not
tackle
the
victim
simply
escorted.
The
victim
out
by
guiding
her
with
their
arms
officer.
M
Jenner
spoke
with
another
security
guard
at
bill's
bar
identified
as
nia
richardson,
who
stated
she
attempted
to
move
along
the
crowd
from
the
show
which
included
the
victim
richardson,
advised
that
when
the
staff
was
moving,
the
victim
along
outside
of
the
bathroom
she
tripped
to
the
ground.
Peter
pierre's,
the
property
manager
at
five
lansdowne
street
arrived
on
scene,
but,
however,
did
not
witness
the
events
or
make
any
statements.
Regarding
the
event,
saddam
aziz
and
officer
gately
conducted
a
license
permits
inspection,
which
resulted
in
violation
citation
number
zero.
Two
two
four
five,
five.
L
Yes,
I
may
just
a
question
for
the
officer,
please
thank
you
very
much
officer.
The
inspection
notice
indicates
that
the
management
cooperated
with
the
police.
Is
that
correct.
N
M
L
And
what
was
what
were
any
charges
filed?
You're
aware
of.
L
Okay
and
and
we're
we're
told
the
staff
would
will
tell
you
that
the
this
person
was
was
around
outside
after
they
asked
her
to
leave.
It
was
about
an
hour
after
the
incident
when
she
was
asked
to
leave
that
she
called
the
police.
Do
you
have
any
record
of
that.
L
All
right,
thank
you,
sir
and
madame
brother,
and
as
far
as
you
know,
in
your
interactions
with
the
staff
they
cooperated
with.
You.
M
Kind
of
sorta
there
was
some.
There
was
some,
they
weren't
happy
that
we
were
called
and
that
the
the
citation
was
made.
L
Okay,
all
right
and
perhaps
sergeant
aziz
is
it
perhaps
sergeant
aziz
has
more
information.
J
All
right,
it
was
kind
of
a
chaotic
scene.
There
tried
the
officers
had
to
really
put
some
effort
forth
to
try
and
find
out
who
was
involved
in
the
incident.
But
overall,
once
we
started
trying
to
identify
different
security
staff
who
were
involved
and
who
the
manager
was
that
was
on
scene.
They
were,
they
were
cooperative
with
us
and
provided
us
the
ability
to
view
their
their
their
licenses
to
inspect
those
and
and
whatnot.
L
Okay,
and
and
do
you
recall
whether
it
was
your
the
report
indicates
that
you
or
the
other
officer
spoke
to
mr
guskowski
who's
with
us
this
morning?
Would
you
do
you
recognize
him
as
the
person
you
spoke
to
he's.
J
I
don't
I
don't
recognize
the
the
person
that
they
spoke
with,
the
officers
were
handling
the
the
situation
and
had
spoken
to
several
several
of
the
staff
from
bill's
bar
prior
to
my
arrival.
By
the
time
I
got
there
and
and
heard
what
had
happened.
That's
when
I
began
my
my
inspection
went
inside
okay.
L
And
and
nobody
was
cited
arrested
or
any
other
action
was
taken,
was
there
that
night.
J
Bill's
bar
was,
it
was
cited,
but
no
arrests
or
anything
like
that.
All.
L
Right.
Thank
you,
sir.
If
I
may
madam
chair
question
mr
gaskowski
peter,
would
you
just
raise
your
hand
you're
just
showing
up
his
iphone,
okay
and
hear
you
and
and
having
been
sworn
just
state,
your
your
name
for
the
record.
Please.
L
O
O
The
comedy
show
got
over,
the
patrons
boyfriend
was
already
outside
and
was
not
being
let
back
in
due
to
just
our
staff
didn't
feel
comfortable
letting
him
in
because
he
was
on
slur
in
his
words,
there's
still
substance
on
his
shirt.
He
just
looked
really
inebriated,
so
we
didn't
feel
comfortable,
so
she
starts
walking
up
and
we
let
her.
We
gave
her
the
benefit
of
the
doubt
because,
like
she
had
a
knee
brace
on
so
we
let
her
use
the
bathroom
and
it
took
forever
for
her
in
the
bathroom.
O
O
He
said
you
guys
can't
come
in.
They
didn't
want
to
pay
the
cover
charge
for
the
new,
because
once
the
comedy
show
got
over
for
the
like
second
half
of
the
night,
it's
like
a
new
cover
charge.
So
she
didn't
like
that
very
much.
She
tried
to
storm
the
door
and
like
and
his
friends
I
could
run
into
like
to
run
over
our
female
unit
and
she
fell
to
the
ground
and
we
helped
her
up
and
then
she
was
fine
and
everything
was
fine
yeah.
Since
she
forgot
our
sweater,
we
were
very
cooperative.
O
We
looked
for
a
sweater,
we
looked
everywhere,
couldn't
find
it
so
probably
for
like
an
hour
and
20
minutes.
They
sat
outside
our
door
and
just
heckled
in
all
our
staff.
Everything.
I
told
all
my
guys,
my
security
staff
not
to
talk
to
her
just
ignore
them
and
just
go
about
your
business
and
just
do
your
job
and
sure
enough.
Like
an
hour,
20
minutes
later
the
police
come.
I
address
the
police
right
away
and
that's
pretty
much
what
happened.
L
Did
did
your
staff
eventually
recover
and
return
this
sweater
to
her.
O
L
O
He
had
fun,
he
had
fun,
but
he
yeah
he
just
he.
I
don't
know
what
exactly
happened
with
him,
but
he
was
not
allowed
back
into
the
bar,
because
our
staff
didn't
feel
comfortable.
Let
him
back
in
okay
and
she
when
she
was
walking
up
the
ramp.
She
couldn't
tell
because
she
had
the
knee
brace.
I
didn't
want
to
judge
her
because
she
had
the
knee
brace.
Maybe
it
was
an
injury,
but
she
was
wobbly
on
her
feet
and
all
that
stuff.
O
Then,
after
the
bathroom
I
got
close
to
look
and
there
was
spilled
substance
on
her
shirt.
She
was
having
a
hard
time,
make
complete
sentences
so
right
away,
I
kind
of
knew
okay.
Maybe
she
had
a
little
too
much
to
drink
that
night
and
her
she
went
outside
she
left.
Her
boyfriend
wasn't
allowed
back
in.
So
she
wasn't.
She
lost
her
sweater,
so
we
went
to
go,
get
her
sweater
and
we
just
didn't
feel
comfortable
letting
both
of
them
back
into
our
bar,
because
how
they
were.
L
Okay
and
did
did
you,
did
you
strike
this
person?
No
did.
O
L
All
right,
thank
you,
mr
gaskow
see
the
the
board
may
have
some
questions
for
you.
Okay,.
J
I
actually
asked
that
that
day
and
they
said
that
there
was
no
video
inside
in
that
general
area.
Where
the
the
victim
said.
The
incident
happened
outside
the
bathroom.
C
O
The
protocol
during
during
the
comedy
show
it's
just
like.
I
think
it's
from
like.
I
think
I
want
to
say
it's
from
like
five
to
like
seven
or
something
just
a
comedy
show
people
come
in,
you
have
to
go
online
and
get
tickets
to
that
show
privately
and
then
once
that
gets
over
the
whole
place
most
of
the
people
leave,
and
then
you
start
for
like
it's
like
night.
It's
like
the
night,
the
night
order.
So
it's
like
kind
of
like
the
band
comes
in
our
dj
comes
in
and
we
have.
A
Thank
you.
Thank
you.
The

On

read
as
follows:
the

states
there's
a

who
tried
to

her.
They
question
whether
this
is
happening
inside
or

The

arrived

detained,
the
above

suspect,
was
in
position
of
two
large

inside

an

located.
Nine
lansdowne
street
officers
were
able
to
speak
to
the
victim
and
multiple
witnesses
who
observed
the
incident
unfold.
P
P
In
his
position
as
a
bar
back
victim
further
stated,
the
suspect
is
actively
watching
her
count.
The
tip

to
make
sure
the
other
bartenders
in
her
are
not
skimming
tip
money
which
eventually
reduces
his
portion
of
the
tip
during
the
tip
count.
The
victim's
boyfriend,
adam
kenea,
was
seated
right.
Next
to
her
victims
stated
she
took
a
20
bill
from
the
tipple
and
gave
it
to
her
boyfriend
since
he
helped
out
with
work
earlier
in
the
evening.
It
should
be
noted
that
the
boyfriend
adam
does
not
work
at
the
bar.
P
It
was
at
this
time
the
suspect
got
angry
and
started
confronting
the
victim
and
her
boyfriend.
Verbal
altercation
ensued,
the
suspect,
left
the
barrier
and
came
back
with
two
large
kitchen
knives
and
yelled
out.
Give
me
my
bread
or
I'll
run
your
pockets
while
holding
two
knives
against
his
forearm
officers.
Also
spoke
to
heather
simpson,
one
of
the
witnesses
who
was
working
as
a
bartender.
At
this
time
she
stated
that
she
saw
and
heard
the
original
verbal
argument
and
observed
the
suspect
walked
down
to
the
kitchen
right
after
the
verbal
altercation.
P
She
then
observed
the
suspect
come
out
of
the
kitchen
with
two
large
knives
and
approached
the
barry
area
where
the
victim
and
her
boyfriend
were
seated.
Ms
simpson
alerted
her
co-workers
and
called
9-1-1.
She
noticed
simpsons,
you
heard
the
suspect
yell
give
me
my
bread
or
I'll
run
your
pockets.
She
further
stated
that
the
suspect
had
worked
at
the
bar
for
about
a
week.
P
Officers
then
spoke
to
william
hangian
who's,
the
bartender
and
jacob
gibson,
the
manager.
They
were
at
the
barrier
at
the
request
of
the
witness
and
they
saw
the
suspect
with
two
knives
as
well.
They
stated
they
observed
the
suspect,
pulling
two
knives
and
demanding
his
money.
P
Should
we
know
that,
while
conducting
sergeants
into
lawful
arrests
officers
removed
a
large
amount
of
cash
from
his
pockets
fields,
you
guys
are

suspect

retreating,
two

and
returning
to

the

are

to

Mr

he's
placed
an

and
charged

L
Yes,
thank
you
attorney.
Green
may
just
start
with
the
sergeant.
Please
thank
you
sergeant
you,
you
signed
the
license
premise.
Inspection
notice
is
that
correct.
P
L
L
Okay,
okay
and
you
quickly
determined
that
there
was
some
money
argument
between
these
two
people
and
this
guy
went
in
the
kitchen
and
grabbed
a
couple
of
knives
came
back
out
and
demanded.
Money.
Is
that
about
what
occurred.
L
Thank
you,
sir.
I
don't
have
any
questions.
Thank
you
very
much
for
your
testimony,
madam
chair,
may
I
just
inquire
mr
ninitz
go
ahead.
Okay,
mr
name.
It's
just
having
been
sworn
state,
your
name
for
the
record.
Please.
L
Okay,
and
can
you
describe
the
incident,
do
you
know
which
staff
member
called
the
police.
Q
I
am
unsure
which
one
called
the
police.
I
was
just
told
that
a
staff
member
called
the
police
because.
L
Q
L
Okay,
thank
you,
sir
and
madam
chair.
There
there
is
video
that
we
can
provide
to
you
of
the
incident
that
pretty
much
shows
exactly
what
you've
just
heard
in
the
testimony.
L
L
Yeah
other
than
I
I
think
this
is
certainly
an
unusual
situation.
A
little
a
beef
over
money
between
these
two
employees,
which
was
quickly
stopped
police,
recalled
management,
cooperated
I
mean
we
certainly
couldn't
have
foreseen
that
somebody
would
react
like
this
to.
You
know
somebody
an
allegation
that
they
would
hold
more
tip
money,
but
having
seen
everything
they
did
stop
the
issue
call
the
police
and
again,
thankfully,
there
were
no
patrons
or
members
of
the
public
involved.
L
R
I,
my
apologies.
My
camera
is
not
working.
I
do
not
have
any
knowledge
of
how
long
mr
mason,
I
can
reach
out
to
payroll
and
find
out
this
date
of
hire
and
date
of
I'm.
I
mean
his
date
of
termination
was
obviously
this
day
here,
but
I
can
find
out
when
exactly
his
higher
date
was.
C
Yeah
I'm
curious,
and
I
would
like
to
know
how
these
workers
are
trained.
It
just
seems
troubling
to
me.
R
I
mean
for
my
understanding,
they're
it's
on
the
job
training,
so
there's
a
an.
R
They
fill
out
an
application,
there's
an
interview
process,
references
are
checked
and
once
they're
hired,
they
go
through
a
on-the-job
training,
so
they're
shadowing
other
bar
backs
to
learn
exactly
what
they
need
to
do.
That's
my
understanding
of
how
it
works.
C
Okay,
if
you
could
forward
that
information
to
the
board,
so
you
could
take
a
look
at
it.
I
would
appreciate
it.
I.
L
Can
do
that
you
can't
forward
that
along
with
the
video?
Yes
thank
you
yes,
but
it
does
there.
I
can't

I
I

I
just
just
if
you

if

I
just
would
like
to
know
if
someone
could

For
me,
the

who

would
have

before
they
were
put
in
this

them

Both

immediately
stated
that
they
were
over
21

provided
them

both

the

which
confirmed
that
the
driver's

were
indeed
fraudulent.
The
fraudulent
connecticut

were
confiscated
by
detectives.
S
It
should
be
noted
that
both
patrons
stated
that
no
staff
member
asked
them
for
identification.
The
manager
raymond
young
was
able
to
confirm
that
the
way
it
did
not
ask
the
patients
for
any
form
of

Both
individuals
will
be
submitted
to
quarter

S
Detectives
brought
this
to

Mr

good

Yes,

communities
wondering
if
I
could
find
out
more
about
the
two
that
have
produced
those
fraudulent
ids.
What
has
happened
to
them.
K
Our
business
is
really
focused
really
on
the
symphony
hall
business
and
so
that
night,
that
that
that
evening,
these
two
individuals
had
come
in
and
with
intention
clearly
to
fraud.
The
establishment
should
they
be
asked
for
for
identification,
but
regardless
the
it
was
a,
it
was
an
unexpected
busy
night
and
the
manager
was
helping
the
bartender
and
they're
both
helping
each
other
running.
K
I
think
running
around
being
a
little
short
staffed
because
of
the
unexpected
rush
regardless,
when
this
happened,
commander
did
eventually
verify
with
the
server
that
he
had
not
id'd.
There
was
definitely
a
breakdown
in
communication
between
between
the
manager
and
the
server,
as
this
rush
had
just
died
down.
When
the
two
detectives
came
in.
K
There
is
a
house
policy,
this
gen,
this
server,
it
had
been
with
us
for
about
eight
months
and
they
all
get
training
with
regards
to
our
house
policy
of
finding
iding
all
parts
of
patrons
under
the
age
of
40.,
and
so
upon
further
discussion
with
the
two
individuals,
the
manager
on
duty,
as
well
as
the
server
there
was
indeed
a
breakdown
of
communication
in
the
midst
of
this,
and
the
server
has
been
suspended
for
a
week.

Oh
yes,
by
the
way
this
was
the

last
shift,
but
when
he
did
come
for
his
last

mr
devlin,
the

asked
him
about
this
violation
and
he
said
that
he
had
in
fact
asked
for
identification
and
was
given
the
fraudulent
id,
as
the
board
knows
from
looking
at
the
record.
This
business
has
been
in
out
bright,
brighton
center
for
well
over
20
years
and
has
never
been
a
problem.
It
is
basically
a
neighborhood
restaurant.
T
Its
clientele
is
more
mature
than
the
average.
That
would
think
that
of
a
bar
so
close
to
to
the
college
area,
but
we
have
taken
it
seriously
and
what
we're
doing
is
we're
re,
educating
all
of
our
employees
with
respect
to
ids
and
to
be
extra
vigilant
in
making
sure
that
we're
not
serving
anybody
under
age.
T
I
believe
I
was
laughing
to
myself
this
morning.
I
think
the
last
time
we
had
a
violation,
joe
mulligan,
was
sitting
on
the
board.
That's
how
long
ago
it
was
so.
As
I
said,
we
we
do
take
it
seriously
and
we
are
re-educating
each
one
of
our
employees.
C
C
U
It
was
late,
it
was.
C
T
Well,
the
licensees
policy
is
pretty
standard
that
anybody
looks
like
they're
under
the
age
of
30
that
they
will
be
asked
for
identification
and
normally,
as
I
said,
we
don't
have.
We
don't
have
a
problem.
We
don't
cater
to
younger
people,
but
we
are
reiterating
that
to
to
make
sure
that
each
one
of
our
employees,
not
only
the
bartenders
but
the
waiters
and
the
waitresses
and
everybody
who
is
serving
knows
that
they
have
to
take
part
or
do
their
part
to
make
sure
that
there
are
no.
C
Okay,
thank
you.
I
don't
have
any
further
questions.
A
V
A
A
Great,
thank
you
and
mr

is
going.
Are
you
going

or
no
do
you

the

truth
and
nothing
but
the
truth.
U
A
I
do
thank
you

You
may
proceed
with
the

U
U

U
A

you
like

V
Yes
morning
sergeant
did
the

manager
the
employee
cooperate
with
you
yesterday.
Did
he
have
any
comments
or
issues
when
you
told
them,
his
scanner
wasn't
working
properly.
V
And
any
any
issues
when
you've
been
back.
U
We
we
have
caught
two
others,
so
actually
we
caught
one
that
night
waiting
in
line
and
we
caught
one
shortly
thereafter,
I
think,
was
a
separate
occasion,
a
handoff
out
front.
So
there
has
been
other
occurrences,
but
as
of
late
they've
been
good.
V
Okay,
thank
you.
The
the
when
you
say
detectives
were
alerted
that
the
premises
were
selling
alcohol
to
underage
persons.
Was
that
from
people
in
the
community
are
you
aware
of
who
it
came
from
or
yes.
U
D
U
Beverage
commission
for
the
commonwealth
of
massachusetts
informed
us
and
told
us
that
they
had
they've
written
them
up
twice
in
the
last
week.
For
the
same
thing,.
U
Yeah,
the
the
state,
alcohol
beverage
commission
informed
us
and
okay.
V
Thank
you.
I
I
have
no
further
questions
sergeant.
Thank
you.
Good
luck.
So,
madam
chair
commissioner
curran,
I
think,
as
you
probably
recall,
from
this
location
had
kind
of
a
rough
start
with
what
they
inherited
from
figueroa's
market
at
this
location.
V
They
did
work
hard
to
clean
this
location
up
and
have
since
late
2018
operated
without
incident,
since
this
certainly
has
been
a
an
aberration
from
the
operation,
but
it
gave
him
a
total
wake-up
call.
So
what
they've
done
since
these
incidents
everybody's
been
recertified
and
tips?
Trained
they've
now
updated
the
pro
protocol.
Where
not
only
is
everybody
scanned
all
everything
every
license
scan,
but
every
person's
id
is
checked,
there's
no
under
30
or
under
40
or
whatever
they've
updated.
V
The
protocol
there's
been
obviously
some
pushback,
but
at
the
same
time
they
can't
operate
with
further
incidents.
V
They
did
replace
the
scanner
with
an
updated,
state-of-the-art
scanner
which
hopefully
will
give
them
some
protection
against
the
fraudulent
licenses,
but
I
think,
as
this
board
knows
as
soon
as
the
software
is
updated,
the
people
that
are
selling
these
license
seem
to
come
up
with
further
ways
to
beat
it.
V
And
lastly,
the
employee
that
was
involved
in
these
incidents
is
no
longer
working
in
the
store,
so
the
manager
sushila
patel
who's
on
you
know,
along
with
her
husband
who
assists
her
and
mrs
patel
mrs
drew
patel
as
part
of
the
ownership,
have
taken
an
act
of
more
active
participation
in
employee
training
and
updating
protocols
to
make
sure
that
this
is,
as
I
said,
an
aberration
and
not
part
of
their
ongoing
operation.
V
Miss
patel
is
mrs
patel
is
here.
If
you
have
any
questions
for
her.
C
B
N
C
V
V
Yeah
once
again,
they
are
aware
that
they're
not
supposed
to
sell
singles
and
that's
amongst
you
know
that
alone
is
a
reason
why
this
employee
is
no
longer
along
with
other
things
that
have
occurred,
that
the
reason
why
this
employee
is
no
longer
at
the
store
he's
fully
they're,
fully
aware
that
they
are
not
supposed
to
sell
singles
and
that
they
have
been
before
the
board.
For
that
reason,.
C
Yeah,
I'm
going
to
ask
that
they
re
familiarize
themselves
with
the
rules
and
regulations
of
this
board.
I
don't
think
one
employee
is
responsible
for
the
sale
of
two
singles
to
me.
That
sounds
more
like
a
breakdown
in
management
to
allow
those
things
to
be
sold
unless
you're
telling
me
that
they're
only
sold
by
that
employee
either
way.
C
I
think
the
management
needs
to
understand
their
their
responsibilities
a
little
bit
more
that
come
with
this
license.
I
want
to
ask
commissioner
current
if
he
has
any
questions.
F
You
do
prior
to
this
incident.
Was
there
any
reason
to
believe
that
the
scanner
that
you're
using
at
the
time
was
unreliable.
V
They
did
not
have
any
notice
or
any
idea
that
the
scanner
was
unreliable,
but
they
didn't
invest
in
a
new
state-of-the-art
scanner,
and
you
know
fortunately
sergeant
gallagher
did
come
back
and
show
them
exactly
the
fact
that
the
the
scanner
they
had
was
totally
unreliable.
V
The
the
one
they
have
now
is
is
updated
constantly
for
the
with
the
latest
software
to
make
sure
that
as
fast
as
they
come
up
with
new
ways
to
beat
the
scanners
this,
hopefully
this
id
science
software
will
attack
it.
V
The
the
scanner,
the
1abc
one
of
the
abcc
incidents,
the
scanner,
the
new
scanner,
the
software
was
not
totally
installed
at
the
time,
so
it
scanned
that
license
as
as
accurate.
But
since
then
it's
all
been
brought
up
today.
V
They
they
have
not,
they
just
put
the
scanner
in
the
back
room,
they
haven't
done
anything
they
had
it
for
some
time,
but
clearly
clearly,
you
know
based.
Fortunately,
sergeant
gallagher
gave
him
the
heads
up
that
the
scanner
was
not
working
so
there
they
just
put
it
in
the
back
room.
It
was
well
outside
of
any
warranty
or
anything
they
could
do
with
the
with
the
company
and
they
just
had
to
invest
in
a
new
scanner.
A
Thank
you,
commissioner.
Karen

This

walked
away
into
the

and
appeared
to
bring
the
drinks
to
a
table
while
walking
inside
the
establishment.
S
Detectives
observed
a
table
of
four
patrons
drinking
alcoholic
beverages.
Detectives
noticed
that
these
patrons
looked
young
and
asked
them
to
produce
identification
to
confirm
their
ages.
Three
out
of
the
four
individuals
stated
they
were
over
21
years
of
age
and
produced
various
forms
of
identification,
saying
they
were

years
of
age.
S
Detectives
were
able
to
confirm
that
the
patrons
had
valid
passports
and
were
of
age.
The
fourth
patron
later
identified
as
matilde

stated
that
she
was
not
21

old
and
provided
detectives

confirmed

N
Would
so
the
bartender
we
questioned
them?
They
said
that
the
table
that
was
served.
Five
drinks
was
when
I
shot
of
them.
They
knew
the
table
had
people
there.
We've
since
addressed
that
with
our
team
gone
through
tip
serving
again
with
everyone,
so
they
understand
that
they
are
not
able
to
do
that.
What
they
are
able
to
do
would
be
a
beer
and
a
a
drink
or
shot.
N
Rather,
if
that
was
one
person,
if
they
had
to
have
more
people,
they
have
to
come
up
to
the
bar
honestly,
that's
just
something
that
we
will
take
we'll
take
the
training
and
try
and
get
better
from
that.
N
Additionally,
with
the
underage
guests,
we've
had
several,
it's
been
getting
very
rowdy
in
downtown
crossing
again,
not
just
in
the
days
of
the
weekends,
but
also
days
of
the
week.
So
we
have
hired
a
full-time
person
at
the
front
door
who
will
also
make
sure
people
don't.
N
Intoxicated
be
iding
everyone
once
again
in
addition
to
when
they
come
and
sit
at
a
table
at
that
time
of
the
evening,
so
that
will
provide
some
additional
checking
of
ids
as
well.
I
know
that
we've
talked
several
times
about
scanners.
We
did
not
scan
anyone's
here,
we're
still
working
as
a
company
to
try
and
find
a
program
that
works
financially
for
us,
fortunately,
have
not
gone
anywhere
with
that
yet,
but
we
do
not
have
a
history
of
underage
drinking
here.
C
Mr
miller
tesla,
the
last
time
you
appeared
before
us
for
a
different
license
premise.
You
said
you
were
researching
the
cost
of
the
scanners
too.
Could
you
submit
something
in
writing
to
the
board?
What
your
research
has
shown?
You
you've
repeatedly
said
it's
cost
prohibitive
I'd
like
to
see
what
those
costs
are.
N
I'll
submit
the
cover
counts
that
will
show
us
just
what
we
have
for
per
week
at
the
table.
I
can't
tell
us
how
many
people
we
have
through
the
door,
but
I
can
make
an
estimate
of
that
as
well
and
what
the
investment
would
be
for.
C
N
C
To
see
that
in
writing,
because
we've
heard
that
we've
we're
collecting
information,
other
places
are
doing
similar
research
and
you're,
testifying
today
under
oath
that
it's
too
expensive
or
that
this
particular
one
is
too
expensive.
So
we're
trying
to
be
helpful,
collect
information
and
share
resources.
N
Okay,
great,
I
will
put
that
together
for
you
for
sure.
I
C
C
N
Yeah
I
mean
we
generally,
we
don't
have
people
anywhere
near
that
age
here,
but,
like
I
said,
we
will
have
a
someone
assisting
us
with
just
kind
of
the
traffic
of
the
restaurant
and
they'll
be
checking
ids
for
people
who
are
over
over
21.
After,
like
nine
o'clock
per
our
usual.
A
Thank
you,
there's
no
further
questions
on
the
board.
The
board
will
take
this
matter
under
advisement
as
well.
Mr
maltesta,
please
do
provide
anything
in
writing
that
you
have
to
let
the
board
know
about
the
price
and
feasibility
of
obtaining
a
scanner.
At
your
license
premise,
you
can
send
it
to
licensing
board
at
boston.gov.
