spoke
to
the

who
stated
that
during
a
verbal
dispute
outside
of

campbell
had
reached
for
his
waistband
as
if
he
had
a

the
victim
stated
that
she
had
turned
away

fled
too
quickly
to
have
seen
what
campbell
reached
for
officers
requested
a
supervisor
and
a

to
respond
to
the

Lieutenant

recorded
them

It
should
be
noted
that
there
was
no
lock
on
the
firearm
at
the
time
of
the
seizure,
but
hollam
supplied
officers
with
the
cable

from
his

D
D
C
Yes,
absolutely
I
apologize
greg
seems
like
he
is
on
the
call,
it's
just
a
matter
of
he's
having
problems
with
his
audio,
so
I
I
I'll
communicate
the
best
that
I
can
so
you
know
I
was
there
on
on
that
night
of
the
event
I
had
left
them,
probably
around
11
30ish
somewhere
around
there
to
kind
of
address
a
family
issue,
and
then
I
got
I
received
the
call
around
2
a.m
in
the
morning
regarding
a
potential
incident
that
had
just
taken
place
right
while
I
was
at
home
all
right,
so
I
you
know
the
next
morning
I
had
given
both
lyndon
who's,
the
head
of
our
security
and
also
greg
joseph
who's,
also,
the
manager
of
the
security
company,
all
right
to
kind
of
figure
out
kind
of
what
it
took
place
and
what
they
had
said
is
somewhere
around
the
hours
of
quarter
past
one
to
around
1
30ish.
C
Two
young,
ladies,
were
in
a
verbal
that
which
turned
you
know
physical
altercation
right,
which
they
were
grappling
each
other
all
right.
The
two
parties
were
separated.
One
of
the
parties
who
were
seen
as
as
the
initiative
the
people
who
initiated
the
issue
were
exited
from
the
building,
so
we
just
to
keep
the
two
parties
away
from
each
other
at
the
time
and
the
hope
was
to
the
next
party
to
kind
of
actually
have
them
exit,
not
too
long
after.
C
But
we
kind
of
didn't
want
it
to
be
an
issue
out
on
on
the
street,
so
one
party
had
exited
and
the
party
let
out
probably
around
well.
The
lights
got
turned
on
around
all
right
somewhere
around
the
time.
When
the
incident,
when
we
had
separated
the
folks
and
then
as
the
party
some
folks
left
and
then
some
folks
stayed
on
on
the
actual
street,
like
from
that
party
that
we
had
had.
F
C
The
the
event
and
apparently
mr
the
gentleman
with
the
green
shirt,
had
showed
up
somewhere
within
10
minutes
of
that
happening.
He
did
not.
He
wasn't
at
the
actual
event
at
all.
For
that
night
he
just
showed
up.
So
apparently
someone
must
have
contacted
him
as
what
we're
hearing
and
we
received
information
from
one
of
our
security
staff
at
the
time
that
he
was
gesturing.
He
was
making
the
same
gestures
that
was
mentioned
by
the
victim
and
at
that
point
in
time
our
security
greg
joseph
he
made.
C
He
made
the
call
to
boston
police
before
this
before
anything
else
kind
of
took
place
before
they
took
over
and-
and
that
was
that,
basically,
as
far
as
that
incident
goes,
you
know
the
police
took
over.
We
gave
them
the
information
as
far
as
the
licenses
that
were
up
here,
I
know
I
had,
and
I
actually
have
it
opened
up
right
now.
I'll
give
you
a
moment.
C
All
right
so
for
the
the
place
of
assembly,
the
boston
fire
department,
pace
of
assembly,
we
had
that
done
back
in
september
of
2021
all
right
and
I
can
send
a
copy
if
you
like
or
email
a
copy,
or
I
even
can
share
it
with
you
as
well.
But
it
says
here
it
expires
on
september,
30th,
2022
and
then
our
certification
of
inspection
was
also
done
earlier,
the
month
prior
prior
back
in
august,
16
2021,
and
that
expires
on
july
31st
2022..
C
But
I'll
I'll
send
them,
they
were
there
and
I'm
not
sure
how
what
what
happened
when
we
came
the
next
morning
to
check
and
see
where
those
that
those
documents
were
they
seemed
like
they
were
wedged
behind
the
old
documents,
but
they
were
there.
I'm
not
I'm
not
sure
how
that
ended
up
happening.
So
I
guess
that's
on
our
end.
Obviously,
but
I'll
I'll,
I
will
send
you
a
copy
of
those
okay.
Could
you
could
you
mind
chatting
me
the
email,
direct
email
that
I
should
be
so.
H
C
I
How
long
was
it
between
the
time
that
the
the
altercation,
the
two
parties
were
split
and
when
the
guy
showed
up
and
with
the
green
sweatshirt.
C
So
the
the
incident
happened
anywhere
between
quarter
past
115
to
somewhere
around
that's
when
the
incident
happened,
115
120
somewhere
around
there's
what
they
had
mentioned,
the
security
staff
I've
mentioned,
and
I
believe
the
young
lady
who
was
in
the
incident.
She
was
exited
out
her
and
folks
who
were
with
who
who,
with
her
all
right,
contributing
to
the
issue.
They
were
exited
out,
probably
around
a
little
bit
before
1
30
somewhere
around
this.
So
as
soon
as
we
saw
it
kind
of
addressed,
it
got
them
separated.
C
J
C
30
somewhere
around
that,
so
it
was
between
130
and
150,
is
where
the
gentleman
with
the
green
jacket
had
showed
up
what
green
sweatshirt
that
showed
up
somewhere
around
there
within
those
20
minutes.
I
And
is
it
part
of
your
protocol
to
to
call
the
police
after
the
altercation.
C
Yes,
yes,
yes,
but
we
were
still
kind
of
addressing
the
actual
issue
separating
the
parties
at
that
point
in
time.
Yes,
absolutely
just
to
call
the
police.

does

Hey
man,
I
know
mr
holiam
wants
to
speak
as
well.
It's
just
a
lot
to
digest
here.
First
officer
murray,
you
have
no
personal
knowledge
of
the
the
violation
notice
or
whatever.
What
may
have
happened
to
this
person
earlier
in
the
evening.
You
just
saw
him
and
helped
him
when
he
was
coming
out
of
the
water
or
you
picked
him
up
on
the
street.
Correct.
E
Okay,
thank
you
very
much,
sir.
Madam
detective
gallagher,
the
yes,
you
two
have
no
personal
knowledge
of
and
of
the
event
that
happened
on
the
night
before
this
gentleman
was
found.
Having
come
out
of
the
harbor,
you.
E
Were
cooperative?
I'm
sorry,
yes,
sir,
they
were
flawed.
Okay
and
at
some
point,
did
you
discover
that
they
indeed
had
called
the
police
that
evening?
E
No,
you
did
not
no
all
right,
and
you
did
read
in
the
report
that
the
as
to
this
question
of
someone
being
roofy,
this
person
had
no
had
a
negative
toxicology.
J
E
E
Okay-
and
you
have
personal
knowledge
of
this
particular
incident,.
F
Well,
I
was
not
there
the
night
of,
but
the
night,
the
day
after
when
I
became
aware
of
it,
I
spoke
to
the
victim.
I
spoke
to
the
victim's
mother.
I
went
and
met
with
the
victim's
father,
who
had
had
subsequent
conversations
with
a
number
of
the
victim's
friends.
F
So,
through
those
conversations
I
got
a
clearer
picture
of
you
know
what
they
believe
happened
the
night
of.
So
I
can
tell
you
what
they
told
me
but,
and
then
also
I
talked
to
artie
lucas
who's
on
the
call
here
right
now,
who's
the
general
manager
was
present
that
night.
So
he
was
there
yeah,
our
our.
We
had
a
five-year
high
school
reunion
party
I
forget
which
high
school
it
was,
but
five
year
high
school
year
and
party
that
we
contracted
with
that
went
from
7
p.m,
till
9
30
p.m.
F
We
had
a
list
of
everyone
who
attended,
so
it
was
a.
It
was
a
listed
list.
Everyone's
names
who
were
attending
this
individual
was
attending.
He
came
with
his
high
school
friends,
some
of
his
very
close
personal
friends
and
talking
to
his
father,
you
know
at
some
point
during
the
night.
He
said
the
night
was
going
along
fine,
it
calls
the
night
very
well
and
he
said
around
9
30.
F
He
recalled
the
announcement
going
over
the
system
that
the
we're
opening
the
business
up
to
the
public,
the
private
event,
was
no
longer
open
anymore,
so
he
recalls
9
30.
at
some
point.
After
9
30
he
says
his
memory
went,
went
blank.
He
feels
he
said.
He
only
had
two
drinks,
maybe
three,
but
that's
it
he's.
He
said
strenuously
to
me
number
of
times
that
he
did
not.
This
was
not
a
result
of
over
drinking.
His
father
told
me
he
is
not
a
big
drinker.
He
doesn't
drink.
F
His
friends
told
me
he's
not
a
big
drink,
he
doesn't
drink
a
lot.
He
feels
he
was.
He
was
roofied.
I
asked
him
or
something
was
I
don't
know,
roofies
something.
I
asked
him
to
explain
how
he
thought
it
happened
and
he
just
simply
said
that
he
felt
that
maybe
he
got
a
hold
of
someone's
drink.
He
didn't
expect
he
would
be
roofied
and
there
were
some
young
women
in
this
group.
F
He
did
recall
a
woman
giving
him
a
drink,
so
he
wasn't
sure
if
maybe
her
drink
had
been
roofied
and
she
gave
it
to
him
unknowingly.
It
was
unclear
so
at
some
point
during
the
evening.
I
think
it
was
later
than
11.
Even
the
report
says
at
some
point.
Even
our
staff
noticed
that
he
was
showing
signs
of
what
we
would
be
intoxication.
You
know
come
to
find
out
that
maybe
it
was
more
reflective
of
being
drugged
and
they
asked
him
to
leave
the
premises
and
move
him
outside.
F
He
went
outside
up
on
high
street
asked
for
his
jacket
because
he
didn't
have
a
jacket
with
his
jacket
was
the
co-check,
and
while
we
were
waiting
for
his
jacket
to
get
his
jacket,
it
took
a
little
bit
of
time
because
we
were
busy
at
the
time,
as
some
of
his
other
friends
had
come
out
to
the
street
on
the
outside
of
the
street
and
as
detective
gallagher
testified,
there
was
a
you
know.
This
individual
was
talking
to
people
and
lying
and
chirping
different
people,
and
there
was
a
little
bit
of
a
fight.
F
Wasn't
much.
As
the
report
stated,
there
was
a
quick
up
and
down,
and
it
was
over
with
very
quickly
and
the
individuals
have
all
left
the
area,
and
so
we
went
back
back
about
our
business.
That
was
the
last
week.
We,
our
staff,
remembers
this
individual.
It
was
until
the
next
day
when
we
got
a
call
from
boston
police
department
that
he
had
been
found
in
the
harbor
or
got
gotten
out
of
the
harbor
that
we
were
made
aware
that
this
had
happened.
F
No,
I
I
don't
want
to
speak
to
the
boston
police
report,
because
there
is
a
detective
that
did
a
lot
of.
I
forget
his
name
that
did
a
lot
of
investigating
on
this
matter
and
they
didn't
get
video
surveillance
of
this
individual
walking
around
down
by
the
boston,
harbor
hotel
and,
I
think,
voluntarily,
based
on
the
video
jumping
into
the
harbor
and
not
not
falling
but
voluntarily
jumping
into
the
harbor.
F
But
I
again,
I
that's
in
a
re-
that's
a
plus,
a
police
detective
that
that
I
forget,
whose
name
what
his
name
is,
but
reference
that
to
me
so
the
over-serving
violation.
Quite
candidly,
I
don't
know
where
there
would
be
evidence
of
that.
I
mean
we
did
have
an
open
bar
party,
as
detective
gallagher
mentioned,
but
it
was
contracted
for
and
there
was
a
list
of
attendees
and
it
went
from
7
to
9
30,
and
this
incident
happened
well
well
past
that
so
that's
our
that's.
What
I
know
of
the
incident.
E
And
I
know
mr
mr
lucas
was
present
on
the
night
in
question.
I
just
questioned
him.
I
can't
see
you
now,
mr
lucas,
you
there
you
are.
It
is
at
some
point
when
the
individual
was
asked
to
leave.
Did
you
or
staff
call
the
police
at
that
time?.
N
No
not
at
that
time
from
what
I
recall
when
the
incident
started
happening
outside,
we
made
a
call
because
you're
supposed
to
call
when
there's
a
we
thought
it
was
going
to
escalate
larger
than
it
was,
and
I
think
it
ended
sooner
than
the
police
when
they
arrived
and
that
was
already
dissipated.
Okay,.
N
Yeah
I
mean
and
then
like
I
said
it
was
a.
It
was
a
pretty
you
know,
steady
night,
so
we
just
went
on
for
the
rest
of
the
night,
never
thought
anything
of
it
and
I
got
the
phone
call
the
next
morning,
early
from
his
family
members
and
the
boston
police,
and
that's
when
I
brought
mr
holly
in
and
we
started
working
with
the
police
department
and
the
family
to
try
to
come
to
an
answer.
What
would
happen?
Okay,.
N
I
personally
didn't
talk
to
any
of
the
family
members.
Paul
did
all
of
that,
so
he
could
speak
to
that.
E
Mr
holland,
can
you
answer
that?
Did
the
family
understand
that
you
had
been
cooperative
and
tried
to
assist
in
this
process.
F
Yeah
I
mean
I
talked
to
his
mom.
I
talked
to
him
the
day
of
the
next
day
and
I
went
to
his
father's
place
of
business
and
walpole
met
with
his
father
personally
and
sat
down
with
the
dad
personally
to
go
through
everything,
because
you
know
I'm
a
father
myself
and
it's
a
concerning
thing,
particularly
everything.
We
hear
about
these
young
men
going
into
the
harbor.
It's
a
it's
a
scary
thing,
so
I've
met
with
a
dad
for
probably
about
an
hour.
F
It's
an
unfortunate
situation
that
it
happened,
but
thankfully
he's
the
individual's
fine
he's.
Okay,.
B
I
do
I
just
want
to
make
sure
I
have
a
clear
he,
the
victim,
testified
or
stated
that
he
only
had
two
drinks
the
entire
evening.
Is
that
correct?
Well,.
F
B
And
just
for
clarity
for
me,
I
know
you
stated
that
you
cooperated
with
the
police.
Did
that
cooperation
include
reviewing
video
of
the
victim
there
and
in
the
video
did
it
indicate
that
he
had
two
or
three
drinks.
F
Well,
I
mean
the
the
video
we
have
of
him
entering
the
establishment
with
his
one
of
his
friends
and
we
have
video.
I
believe
we
provide
the
video
to
the
police
department
of
him
exiting
the
establishment,
I
believe,
but
while
in
the
establishment,
you
know
it's
a,
we
have
six
cameras
within
the
establishment,
but
it's
very
difficult
to
track
people
inside
the
actual
footprint
of
the
of
the
business.
So
I
couldn't.
I
F
N
B
L
He
had
one
beer
primed
prior
to
going
to
how,
at
the
moment,
two
beers,
two
rum
and
cokes
prior
to
this
female,
hitting
them
a
red
bull
back.
Okay,.
B
That's
helpful
all
right.
Thank
you.
I
don't
have
any
other
questions,
commissioner,
karen
commissioner
saxon.
I

this

I

science

detective

hernandez
assigned
to
the

Inspection
of
the
greatest
bar
located
at
262

in
boston
upon
entering
the
establishment
detectives,
asked
the
front
door
staff
with
the
counter
patrons
inside
the
establishment.
Was
the
staff
members
say
that
they
had
a
count
of
374
patrons
once
inside.
The
establishment
detectives
noticed
that
the
second
floor
level
appeared
to
be
overcrowded.
O
while
reviewing
the
licenses
and
permits
the
establishment
detectives
learned
the
capacity
on
the
premises
set
at
100
percent
on
the
second
level.
Second
floor
level.
Detectives
brought
this
to
the
attention
of
the
person
in
charge.
Mr
jack
b,
mr
bean
stated
he
would
bring
the
commerce
into
compliance
resolved.
The
detectives
observed
trying
to
typically
issue
the
license:
purchase
inspection,
number,
zero,
zero,
five,
three
one,
seven
for
overcrowding
on
the
second
level
of
the
establishments
to
being
signed
for
an
accepted
notice.
M
Detective
hernandez,
just
briefly,
the
staff
was
cooperative
and
helpful
with
you
that
night
in
your
investigation,.
O
M
Thank
you.
Let
me
just
address
jack
bean
is
here
to
answer
questions,
but
this
is
a
on
this
particular
night.
We
have
the
three
and
a
half
floors,
four
floors,
actually,
first
floor,
mezzanine
and
second
and
third
floor.
There
was
a.
We
did
have
a
new
individual
that
was
on
that
night.
We
had
a
little
miscommunication
with
him
in
terms
of
numbers.
M
The
first
and
third
floor
capacity
is
140
and
the
second
floor
is
a
capacity
of
100..
We
had
sufficient
staff
on
that
night.
We
have
staff
at
the
front
door
to
deal
with
the
overall
count
in
the
building,
and
we
have
staff
on
each
of
the
three
are
the
four
levels
to
make
sure
that
we
have
proper
numbers
for
each
one.
M
All
of
our
security
staff,
when
they're
hired,
has
to
take
a
crowd
manager,
video
test,
along
with
the
other
testing
and
the
other
training
that
we
give
them.
We
did
have
a
miscommunication
that
particular
night
with
the
changing
of
the
guard
and
the
person
that
ended
up
on
the
second
floor
in
terms
of
the
count
and
that's
how
that
count
that
particular
night
get
out
of
a
little
bit
out
of
whack.
We
do
have
weekly
meetings
with
the
managers
and
monthly
meetings
with
the
staff,
so
we
can
address
these
issues.
M
We've
used
this
obviously
as
a
teaching
teaching
lesson
for
the
new
people
that
we
have
hired.
We
are
up
to
full
speed
with
in
terms
of
the
number
of
security
staff
we
have,
so
we
can
ensure
that
this
does
not
happen
again.
I
do
have
jack
being
here.

the

O
E
E
Thank
you
very
much.
I
know
mr
fonseca
would
like
to
address
the
board.
This
is
a
situation
where
we
we
just
had
a
rogue
employee.
Unfortunately,
we
think
this
person
was
just
trying
to
be
a
big
shot
with
these
women
at
the
bar
and
there's
not
a
lot
that
other
than
dealing
with
it
as
a
disciplinary
matter
immediately.
E
P
Sorry,
it
was
working
fine
in
my
prior
meeting
I
apologize,
but
I'm
leo
fonsick,
I'm
the
chief
operating
officer
of
kings,
county
entertainment.
We
operate
the
kings
of
the
seaport,
obviously,
and
as
attorney
quilty
said,
this
is
not
behavior
that
we
condone.
We
take
the
service
of
alcohol
very
seriously.
P
We
have
a
very
in-depth
training
program
for
all
members
of
our
staff
that
serve
alcohol
and
in
this
case
we
just
had
a
rogue
employee
that,
as
dennis
quilty
as
courtney,
culture
said,
I
think,
was
just
trying
to
impress
these
girls
and
act
like
a
big
shot.
As
soon
as
the
we
were
made
aware
of
the
incident.
The
bartender
was
terminated
that
evening,
and
you
know
we
use
this
as
an
opportunity
to
retrain
all
of
our
staff
to
make
sure
they
understand
that
we
are
not.
P
You
know,
going
to
accept
this
type
of
behavior,
certainly
in
the
service
of
alcohol
or
the
smoking
of
the
vape,
and
it's
against
our
rules,
and
we
and-
and
we
dealt
with
it
immediately-
that
evening.
B
E
A
full
restaurant,
of
course-
and
you
know
people
were
there.
Dining
was
new
year's
eve
actually,
but
you
know
people
are
dining
in
different
locations
around
the
establishment.
So
you
know
it's
obviously
up
to
us
to
check
those
ids
and
again.
We
think
we
had
a
rogue
employee
here
who
simply
didn't.
P
Yes,
we
are,
we
are
all
ages
until
a
certain
hour
of
the
evening
at
the
time.
This
incident,
I
believe
it
was
10
o'clock
for
this
location
at
10
o'clock.
We
go
21
and
over
you
know
it's
a
it's
a
it's
a
full
entertainment
facility
with
boeing
and
arcade
games
and
it's
sort
of
meant
for
all
ages.
But
of
course
we
we're
supposed
to
be
carting
all
those
individuals
before
we
serve
them
alcohol-
and
in
this
case
that
just
didn't
happen.
P
We
we
do
not
we're
supposed
to
be
carting
people
every
time
they
come
to
the
bar.
You
know.
Obviously,
this
incident
has
given
us
an
opportunity
to
sort
of
re-look
at
some
of
those
policies.
But
again
we
have
been
extremely
stringent
on
on
checking
ids
and-
and
we
will
continue
to
do
that.

Big

staff
who
stated
that
they
wanted
a
police
report
for
an
incident
that
happened
inside
the
establishment.
The
officer
spoke
to
patron
hannah
keaney,
who,
who
stated
a
female
later
identified
as
giza
madrigal
pushed
her,
because
keaney
was
hanging
on
out
at
her
table.
O
Keaney
then
started
a
fight
stated
that
a
fight
ensued,
but
she
did
not
wish
to
file
criminal
charges.
The
officer
observed
a
large
lump

minor

kinney
stated
that
she
was

that
he
was

when
he

by

unknown
males.
O
Q
So
thank
you
for
that
on
this
particular
evening
and
and
as
the
board,
if
you
haven't
had
a
chance
to
review
the
video,
yet
you
will,
as
it's
been
sent
over
to
the
board,
but
there
were
no
issues
prior
to
this
incident
occurring
with
either
of
these
patrons
or
any
patients
for
that
matter
that
evening
or
any
point
prior
in
that
evening,
as
you'll
see
from
the
video
at
about
1
45
in
the
morning,
it
appears
there's
a
couple
of
females
and
they're
observed
attempting
to
take
a
photo
and.
Q
Q
On
the
back
of
his
shirt
to
immediately
separate
the
parties,
other
staff
obviously
immediately
become
involved,
bring
them
to
different
parts
of
the
venue
and
call
9-1-1
for
the
police
to
respond
to
the
incident,
as
is
the
protocol
for
any
incidences
occurring
with
patrons
on
the
premises.
So,
obviously,
while
the
incident
occurred,
it
happened
quickly
and
without
warning
and
staff
responded
appropriately
and
immediately.
In
this
instance.
