We would.

Like to take this opportunity, mayor council to present our side of the story,.
C
From start to finish of events that took place at our house on our property and.
C
On that note, we will begin on october 5th.
I was doing laundry and notice that.
C
The toilet was gurgling in the bowl had drained.
We called the plumber to come.
C
And have a look as we were concerned, there was a block in the line and didn't.
C
Want to have anything start backing up on us.
C
On sunday october 8th the plumber came and snaked the line he got about a.
C
Hundred feet and couldn't get the line out any further, he pulled it out and it.
C
Came back with mud and gravel, his assessment was that we likely had a.
C
Break in the line and suggested, as far out as he got with his equipment that we.
C
Called the city and get a camera down there to see what's going on, in whose.
C
Property, the issue is on my husband, placed a call to the city and talked to.
C
The on-call worker and arranged a time for them to come tuesday, the 10th in the.
C
Morning the city came that morning and put the camera down the pike.
It was.
C
Determined that there was a low spot where solids were collecting and that.
C
Was affecting the flow through the pipes and what was causing our issue?
It was.
C
Also determined that it was on city property, he said to me that it wasn't a.
C
Top priority, but he wasn't happy with the situation we were in and that he.
C
Would recommend that the city does not sit on this too long as it is a family.
C
Home and if it was left for a long period of time, it's only going to get.
C
Worse, we were told we could carry on with our normal routines and to notify.
C
The city, if anything, changed, I was informed that we would receive.
C
Notification when they would be able to fix it or if the city had a free day, the.
C
Crew might just show up on october 18th the chute, the sewer crew showed up to.
C
Fix the repair, there is a tree on city property in the front of 13 acadia.
That.
C
Needed to be removed before they could start the job, so they left the and the.
C
Parks department showed up to remove the tree.
This was a day where there were 90.
C
Kilometer per hour winds and, in our opinion, not ideal conditions to be.
C
Cutting down a tree, my husband received a call about the sewer.
C
Had showed up but because the tree needed to be removed, they could not.
C
Start the work, so when we got home there would be no tree left in the front and.
C
They would return at a later date to do their work.
My husband phoned me at.
C
Around 3 p.m.
to let me know that had happened and approximately 3 thani.
I.

Received a call from my neighbor that the tree had been removed.
But in the.
C
Process, hydraulic oil had been sprayed all over our homes and property and.
C
There was a note left on the door with a number to call.
I left work and went home.
C
To call the number, but no one had answered so I left a message and took.
C
Photos of the damage on the morning of thursday, the 19th, the risk management.
C
Department cory from jd s, adjusters and the equipment operators from the day.
C
Before were at the house, my neighbor messaged me that everyone was there, so I.
C
Might want to come home to talk and find out what the next steps were to getting.
C
Us all cleaned up, I was, it was recommended that I submit my claim to.
C
The risk management apartment as well as get in touch with my home insurance to.
C
Get a claim going with them, tyler pearson, who said he was the one.
C
Operating the equipment also came up to mike my neighbor and myself and.
C
Personally apologized, he told us insurance issues aside.
He just wanted to.
C
Apologize for what had happened, he wanted went on to explain that that.
C
There are couplings on the front of the equipment when they went to clamp down.
C
On the branches, the wind blew the hydraulic hose into the clamp severing.
C
The hose in their minds, the equipment was no longer functional and they needed.
C
To get the branches out when they open the equipment, the hydraulic oil started.
C
To spray everywhere, due to the release and pressure and combination of the wind.
C
And at that point there was nothing they could do to stop it.
I called my husband.
C
To let him know what happened and return to work.
That afternoon I got in contact.
C
With my insurance company to open a claim and informed them, what had.
C
Happened: they strongly recommended that we contact the city and not go through.
C
Our hosts insurance as the city is a hundred percent at fault, and it would.
C
Have a negative effect on our policy.
I also emailed the risk management.
C
Department a list of what damage we could see to get a claim going with the.
C
City as well, our insurance company had an adjuster named mike.
C
Come up with the following day on the 20th to have a look at things.
They also.
C
Suggested some restoration companies to get in contact with to get a quote for.
C
Fixing the damage and getting things cleaned up on the morning of the 20th.

Also called the risk management department to follow up with what happens once our claim is submitted.
She said she had received our claim and.
C
It had been sent off to quarry at jd s and she provided me with his contact.
C
Info and said he would be able to answer my questions or let me know who to get.
C
In touch with, I called and was informed that he was out on claims and left a.
C
Message on monday, the 23rd I went into his office to talk to him about what his.
C
Thoughts of the assessment he did was, he said he was there on behalf of the city.
C
For it mental environmental reasons and not to assess the damage, he also.
C
Suggests it to get in touch with our insurance company and that there was no.
C
One from the city that we could talk to you, they wouldn't deal with us directly.
C
And that everything would have to go through insurance companies on both.
C
Sides we contacted cory from ken cade.
C
Restoration and on monday the 23rd he came to look in the morning at the.
C
Damages that afternoon a county employee came to clean a small area as a test to.
C
See if the oil could be removed within 24 hours, the spa started to show back.
C
Through on thursday of the 26, I contacted cory to see where things.
C
Were at and he told me he was working on a quote and would be getting it off to.
C
Me and the insurance company shortly as it stands, we currently have a quote from.
C
Ken cade for three thousand dollars to clean, repaint and reseal everything this.
C
Situation has cost us time away from work and hours spent working on.
C
Insurance claims and documentation.
We are a young family with a two-year-old.
C
And a second child due in august, the fact of the matter is this: was a city.
C
Issue being fixed on city property, with city equipment by city, employees is.
C
Extremely frustrating to think that we should have any money come out of our.
C
Pockets and to have to spend more time fighting to get this cleaned up.
It's not.
C
Like we're asking you to take care of a mess, we made we're asking you to take.

Care of a mess made well is very well done.

Said before in our formal meeting, we need to hear both sides of the story and now you've heard the other side of the story.
Where you've probably heard some.

Things that we didn't hear in our informal meeting- and I think they were important for council to know here's a young couple- that's like most young.
D
Couples of the un-- family trying to make ends meet, and this was an accident.
D
It's nobody's fault: we're not trying to look for blame, we're not trying to hang anybody.
It was an accident and the difference between is what I'm.
D
Trying to understand is the difference between liability and responsibility seems to be a very fine line, because this was never intended to happen, but it.
D
Was our responsibility that it did happen right from the equipment to the.
D
Actions of the operators to the damage that was done was all the responsibility.
D
The city, but because there was no malice, because there was no intent, were deemed.
D
To be not at fault- and I don't totally agree with that, because I think morally.
D
We'd have to seek some responsibility in this matter in that and maybe help out.
D
This couple through you know this: financially, I mean a thousand dollar.
D
Deductible is pretty steep: most people don't have a thousand on a doctor in the house.
So right off the top.
That's pretty pretty steep for a young couple.
They'll.

Probably lose their claims free percentage on their coverage, which ylim.
D
Out, probably to another, over the years time anywhere from 800 to a thousand.
D
Dollars as well so again for something that wasn't their fault at all and.
D
You're going to probably hear from another neighbor tonight right off the.
D
Hop they're, probably looking at $2,000 out of their pocket over the course of time for an accident that williams responsibility of of city crews.

Again, it was an accident, but where does the responsibility line?

Through you to councillor patterson during the 2018 budget deliberations,.

City council allocated additional funding for resources to address this.

Growing issue in our community brandon police service received additional.

Funding for officers to focus on restricting illegal drugs from entering.

Our community, as the police chief indicated during his presentation, vps.

Officers are also adding additional resources targeted at curtailing human.
G
Exploitation, especially with respect to young people in our community, along with.
G
This initiative, the brown police service, continues to support our community.
G
Mobilization hub, whose goal is to reach individuals or families at acutely.
G
Elevated risk in our community and connect them to supports and services.
G
Before the situation escalates or a tragedy occurs currently sitting at the.

Community mobilization table following agencies- brandon police.

Service royal, canadian mounted police, brandon, school division, child and family.

Services of western manitoba, dakota, ojibwe, child and family service, curry.

Mountain health, probation services, brandon correctional center west man.

Family services and the brandon fringe friendship center city council also.

Included $25,000 in the teen budget for the mayor's proposed initiative related.

To youth addiction prevention, the mayor is engaging with the school and I don't.

Municipal development and service agreement with gambler first nation to.

Set out the terms and conditions for the first nations purchase of municipal.

Services from the city to service land at 1725, 18th street, north and 1655 clair.

Avenue whereby the terms and conditions shall include- and I think it will read.

Through these feel, like that's right, it'll take a minute that the city will.
H
Provide services to the first station to the same extent and standards as such.
H
Services provided to similar lands within the city to that the agreement.
H
Begins as soon as the lands are set apart as reserve 3 that the agreement.

Reflect the city's desire to enjoy a long term relationship with the first.
H
Nation that can only be terminated by mutual agreement or as a conclusion of a.
H
Comprehensive dispute resolution process for that the first nation in the city.
H
Will respect each other's laws within its boundaries, 5 that the use of the.
H
First, nations land will respect the city, zoning bylaw and north.
H
A secondary plan, six that all activities, persons and things on the first nations.
H
Lands must conform to all city requirements, seven that non-compliance.
H
With city requirements would result in a dispute resolution and without.
H
Resolution: withdrawal of city services except emergency services, eight, the.
H
Development with land is subject to the city's development review process and.
H
Development charge in 2018: that's a dollar, 95 or 93 square foot for the.
H
Commercial 2000 under 19 per resident 2094 residents that subject to annual.
H
Increases annually to the construction price index 9 at the city will construct.
H
Clear avenue, at a time that aligns with the first nations project, phasing 10.
H
That the first nation undertake all construction on the land in accordance.
H
With the regular building permit process 11 that the standards of city services.

To the first nations, land are to the same.
Standard of services is similar to.

City taxpayers!
Well that the first nations will pay a general service fee.

To the city, the equivalent of property taxes, less the amount of services that.

The first nation is unable to purchase example, government governance, finance, hr.

At section 13 that the first nations will pay specific service fees to the.

City, the same as other users of city fee-based services, 14 that a thorough.

Communication and consultation and dispute resolution process is set forth.

In the agreement that supports the relationship.

The city and the first nations are having the second around that place.

Pleased to make some remarks about the process at the end, if you wish, so I just.
I
Want to quickly run through how we got to here tonight.
There are not many.
I
Slides so this won't take long.
My first point is just to explain what a.
I
Municipal development and service agreement is, it is the agreement that we.
I
Are required to enter into between a first nation and a municipality, and it's.
I
When the first nation wishes to purchase services from the municipality, it's a.
I
Requirement of their process through the federal government that we do this, the.
I
Picture that I put up, there is just an example of an early 2016 agreement that.
I
Was executed between the mayor of warner, headingley and the chief of rolling.
I
River, sorry mayor tell you he will not be sure all did I missed his name.
What.
I
This process actually started with for us in 2016 and several of council and.
I
The staff we all participate in in some training on doing business with first.
I
Nations, and as a result of of that after that training, what your worship yourself.
I
And chief ledoux actually entered into an agreement.
I
Memorandum of understanding that set forth a protocol about how we would.
I
Negotiate what we would negotiate about, so it was actually late last year that.
I
We really started.
Everyone came together in the the the ted snur room at our ar.
I
Mcdermott building and we really got to the end of that negotiation.
We just.
I
Began, putting the the different ideas together so the rest of this just really.
I
Marches through those, what the chief and the mayor had determined that we wanted.
I
To we were directed to negotiate on and tells you how we agreed to to the.
I
Different principles, so one of the most fundamental pieces of the agreement is a.
I
Principle that the the first nation gambler first nation insisted in in.
I
Always they wanted to not be treated any more any less than anyone else.
They.
I
Really wanted their their community as it would as it may arise, and on these.
I
Lands that are now within the city of brand and to be the same as everybody.
I
Else so that was a print that that principle underlies everything else.
So.
I
If you wanted to sort of, I think that's one of the most important things the.
I
Agreement term and termination was something that we had to agree upon.
I
Everyone agreed that the the most important thing is that what this was to.
I
Be a long-term relationship, it will begin when the land is set apart, as.
I
Reserve and there there are certain ways built in that it can be terminated by.
I
Mutual agreement or at the conclusion of a dispute resolution process, but even.
I
Then that would just require another agreement if they were to still the.
I
First, nation still wishes to use musical services, so the the thinking behind this.
I
That is set forth in the agreement.
Is that it's very long term relationship.
I
Jurisdiction was a really big part of the agreement, too, and and and the basic.
I
Point of it is we really have to respect that each of.
I
The each of us has a different jurisdiction as city of brandon we're.
I
Simply a municipality and we get our authority from the province of manitoba.
I
The gambler first nation, of course, is subject to gets their authority from the.
I
Government of canada, so very different governments and very different sets of.
I
Authority and there's a lot of work to understand the differences in how we're.
I
Going to work together with those use of the land was important to talk about and.
I
Right upfront, gambler first nation is absolutely pleased with the zoning as it.
I
Is on the land which is commercial arterial zoning, so they are happy to.
I
Develop their land with all of the uses that are listed in that zoning and they.
I
Are also pleased to be part of the north gateway neighbourhood and there is a.
I
Secondary plan on that neighbourhood that describes how how the land should.
I
Be developed going forward, so everyone agrees that that is how the development.
I
Philosophically will proceed into the future an important premise in the.
I
Agreement is this idea of city requirements.
It's used throughout the.
I
Entire agreement, and what it is, is that the gambler first nation agrees to meet.
I
All city requirements and city requirements are all of our bylaws all.
I
Of our policies, all of the way so that we do business so they actually want to.
I
Completely sort of have a seamless community here with their nation as well.
I
As the city of brandon and one of the ways is, they would like our city.
I
Requirements to apply on their land so the activities on the land, then they the.
I
Gambler first nation, as well as complying with all the city requirements.
I
We had to talk about what, if there is non-compliance, what do we do and.
I
Therefore, there's dispute resolution processes and then what and what happens.
I
At the time when the first nation actually brings their own laws onto the.
I
Land and when they do that, there would be subject to additional consultation.
I
Between the first nation and the city to make sure everything is compatible, we.
I
Talked about development, how the land will be developed, and so this is.
I
Actually, an image that shows where the land is on the northeast corner of 18th.
I
Street north and clair avenue and gambler is pleased to meet exactly the.
I
Same requirements as as as a developer in branding would do developers and brad.
I
Didn't have to meet an extensive list of development, submission requirements to.
I
Make sure that we have all the information to process through engineering and public works, etc to make sure everything works and so gambler.
I
Will have to has agreed to also provide us the information required in that.
I
Document is actually a tack attached.
It would be attached to the agreement.
I
Itself, the land would be subject to the development charge, as it has been.
I
Drafted right now so right now we haven't adopted it yet at the city, but.
I
They have agreed that they would pay that amount, which is a dollar ninety.
I
Three per square foot of commercial and or two thousand one hundred ninety.
I
Dollars per residents- and I the agreement, goes further to say that it's.
I
Such time in the future, as we may have an actual development charge by law, they.
I
Would then comply with that, but for the purpose of this agreement, we're using.
I
Those they've agreed that those numbers are the fair contribution.
Part of that.
I
Also is that they will pay an offset contribution toward infrastructure in.
I
The north gateway area and say the city then, would construct claire and that we.
I
Would construct out aligning with their project phasing and if they want to go.
I
Soon or they could construct claire sooner, which is the same as would.
I
Happen with other developments in the city, construction on the land when they.
I
Actually begin to construct, they will they have.
They have asked for and.
I
Purchased our inspection and building processes from the city of branded so.
I
They will go through a regular billet building and development permitting.
I
Processes they will meet, they have to, in any case, meet all building plumbing fire.
I
Code in all city bylaws, with respect to construction and standards of service- and this can be anything from the.
I
Frequency of us snow plowing to the you know, different animal control, bylaws.
I
Anything that we have in that's do we offer a service, our standards to gambler.
I
Are the same standards as we are to similar tax payers, so in this case.
I
Largely a commercial property in that kind of location.
I
The services will be no different and if there's any change to the service, what.
I
They want or what we can deliver it simply pops into a consultation and.
I
Review so then I just put a slide here just to do that.
Try to explain simply.
I
How gambler gambler would never, of course, pay taxes to brown and they will.
I
Have their own tax laws of their own taxation, but they will pay a fee for all.
I
Of these services that they're purchasing from the city of brandon and.
I
So their fee and total adds up to two parts.
When we're calling a general.
I
Service, the other one is a specific service charge, and so, if you just think.
I
About the general service charge is kind of like the taxes we would each pay as a.
I
Taxpayer of brandon and the specific church service charge is, are the user.
I
Fees that we would otherwise pay, whether or that was to you know to the to the.
I
Music to the sports, plaques or tipping fee at the landfill, not sort of thing so.
I
Just to clarify one more time the general service charge we use exactly.
I
The same numbers that we use for everyone else in calculating what that.
I
Charge would be, it will represent sort of the tax part of what we, as taxpayers,.
I
Pay we use, we share with gambler a calculation to come up with our.
I
Assessment value we actually use the province of manitoba's portioned value.
I
In the formula and then the city's mill rate would be applied and the first.
I
Nation will actually pay for all of the services delivered the same as.
I
They're city taxpayers: they don't get as many services as other city taxpayers, so.
I
There-There was a consideration of that, but that's the calculation, how the.
I
Calculation for the general service charge is made in the agreement and the.
I
Specific service charge, as I mentioned before, is just very specific.
It's the.
I
Same as everyone else, they'll get water bills, permit fees, tipping fees.
I
Recreation fees, if we do have local improvements on the land or special.
I
Service levies that would all be the same as if it was any other land so.
I
Those two added together equal the full charge that that we would be billing to.
I
Gambler first nation, on an annual basis, the just to remind everyone.
I talked.
I
About the dispute resolution or communication, the agreement, the draft.
I
Agreement that we have the term that we have in there now includes this.
I
Comprehensive communication program so there's pieces that involve ongoing.
I
Communication, how we're going to appoint representatives from each we're going to.
I
Have regular meetings, regular communications as we have had and have.
I
Something more formal annually to talk about our plans and aspirations, and that.
I
Sort of thing we also, which that's the annual review and planning, which is the.
I
Second step: we also have a consul and rotation review.
So if there's ever.
I
Anything that we're changing what how were impacting each other there's a.
I
Consultation review process and that's really notifying each other getting.
I
Together talking about the issue and when we're trying to make sure that we're all on the same page, if I mean if we go through all of that, and we don't.
I
Agree there is a dispute resolution process and which may go through.
I
Mediation if necessary, and then ultimately there is a very small handful.
I
Of items that may go to arbitration if we just can't agree so that's that's.
I
Built into the to the agreement as it stands, the last point would be the.
I
Agreement of course, had to deal with liability, so just letting you know that.
I
Liability in the agreement, just simple says that our liability is exactly the.
I
Same as the fullest extent that we can possibly have liability under our.
I
Legislation so we've nothing different than it is for anyone else or any other.
I
Property owner- and I think that should summarize everything if there's any.
I

I know it's been a long and.

Very involved process, so there's certainly a lot to cover there any.

We contract with the vast.

Majority of municipalities, cities and some first nations in all of the.

Province outside of the perimeter of winnipeg to provide a e-911 services so.

The proposal that's before you tonight is for software, which, which essentially.

Allows us to perform the enhanced or the e-911 function.
So if you can imagine way.

Back when and when a caller called in to 9-1-1, there was no location services.

Didn't even get a number you didn't know where they were calling from.
Basically.

What this software does is, it provides caller information.
It provides us with.

The number, if it's from a landline it gives us the address of where the caller.

Is calling from if the caller is calling from a cell phone?
It gives us location.

Services, so that's very handy, if you can imagine someone from out of province.

Traveling down the trans-canada highway to have an accident, they may not.

Necessarily know where they are, but when they call 9-1-1, we know where they are.

And also another important function with this software is, it allows us to do call.

Our ring back so someone phones, 9-1-1, there's been an incident even if no one.

Speaks once again, we know where they are.
We have the ability to call back to the.

Phone that they call it from so in our operation.
This software is very.

Important we've done a what I believe is very fair and open tendering process for.

This proposal, and, in this case solocom who's, a canadian company, was the.

Successful proponent, they had the best overall proposal and, coincidentally, the.
