Starting

my
name
is
David
Melton.
Mr.
mayor,
ladies
and
gentlemen,
the
board
I
have
a
problem.
I
live
outside
the
city
limits
of
Black,
Mountain,
just
west
of
town,
but
there's
a
problem
that
I
think
that
the
town
needs
to
be
aware
of,
because
I'm
I
have
salt
relief
for
years
and
has
just
recently
come
to
light
that
the
problem
is,
with
the
noise
ordinance
the
permitting
option
that
the
town
gives
these
music
venues
outdoor
music
venues.
I
Fisker
brewery
is
one
mile
straight
is
crow
flies
from
me
whenever
they
put
on
a
music
venue.
If
anybody
knows
anything
about
these
subwoofers
that
drive
through
your
community
and
they
thump
and
they'd
bump
I'm,
laying
in
my
bed
at
night
and
it
sounds
like
jaws-
is
getting
ready
just
right
outside
my
walls,
I
can
call
the
town
of
Black
Mountain
call
the
police
department.
The
police
goes,
will
tell
me,
I've
heard
it
many
times
David.
We
can't
do
anything.
They
have
a
permit
to
put
on
an
outdoor
music
venue.
I
It
becomes
a
County
issue,
so
I
called
the
county
and
the
county
has
been
good
to
go
out
there
with
the
town
of
Black
Mountain
law
enforcement
officers
and
to
ask
them
to
turn
their
music
down
I'm,
not
against
outdoor
music
venues,
I
just
like
to
have
my
peace
and
quiet
and
if
I
wanted
to
participate,
I'd
go,
buy
a
ticket
and
pay
and
go
in
there.
The
problem
is
coming
from
the
town
of
Black
Mountain
and
it's
spilling
over
into
the
county.
I
Most
recent
problem
was
the
venue
that
they
had
July
or
June
you
up,
I'm,
sorry,
June,
the
26th
and
I.
Had
the
North
had
the
Buncombe
County
deputy.
That
responded
to
call
me
and
give
me
an
update
of
what
happened.
He
said
that
they
went
out
there
with
met
with
Black
Mountain
police.
They
went
out
there
with
el
officers.
They
issued
five
citations
made
three
arrests
and
he
said
that
there
were
21
complaints
within
the
city
and
the
county
on
the
noise
that
was
emitting
from
there.
The
problem
is
coming
from
the
outdoor
stage.
I
Now
I've
done
a
little
bit.
Research
and
I
found
out
that
the
the
noise
ordinance
that
they're
operating
under
has
not
been
revised
since
january
of
1986,
and
there
are
no
noise
of
limitations
or
decimal
limitations,
and
I
think
that
it
needs
to
be
probably
revised
and
I'm
just
seeking
some
help
and
some
relief
from
this
problem.

Mountain,

envision
that
all
the
church
bells

noon

the
21st

hope
that
we

recognized
as
a
city
of
peace.

like
to
think
that
maybe
that
would
be
a
time
for
the
mayor
to
come

and

tell

people
everything

Black
Mountain
is
done

name

recognized

a
town

are
going
to
put
on
one
heck

o'clock

it
will
be
a
concert
that
nobody
you
want
to
miss
so
I
just
want

thank

the
peaceful
kind
people

this
town
that
lead

to
plan

stated
that
this
was
a
total
project
and

grant
would
go

find

total
project
he
stated
he
would
have
be
glad

through
the
numbers
prior
to
the
budget
meeting

she
had
come
to
him.
My
response
at
that
time
and
I,
like
this
adjustment
made
to
the
minutes,
was
that
I
did
ask
for
that
information
prior
to
that
budget.

are

guys
following

it
said
vice
mayor,
Collins,
state
of
refinancing,
say
four
hundred
thousand
dollars
on
the
interest
rate.
It's
actually
the
interest
accumulated
over
the
life
of
the
purchase
for
the
Town
Square
property
and
my
reply,
which
wasn't
in
there
was
that,
yes,
if
it
hadn't
been
refinanced,
we
would
have
been
paying
four
hundred
thousand
dollars
more
for
that
property.

advised
mrs.
truck,
went
to
stick
with
what
the

2015
2016
budget
deals
with

not
previous

stated
that
the
expenses
for
the
town
square
project

come
up

those
numbers.

were
compiled
and
presented
to

the
Board
of
Aldermen
by
Dean
Looby,

town's
DFO

assistant
town
manager.

stated
that
mr.
DeWitt
IRS
990
filing
his
total
is
185
thousand
for
the
total
project.

of

Mountains
dean's
numbers
were
for

difference
of
two

you

The
historic
preservation
Commission's
purpose
is
to
designate
historic
districts
and
landmarks
within
the
town
of
Black
Mountain.
In
addition,
the
commission
shall
develop
and
recommend
to
the
board
of
aldermen
rules
and
regulations
governing
their
designation
and
maintenance
of
the
historic
properties
in
the
town.

The
historic
Commission
has
been
busy
during
the
year
of
2014
and
beginning
of
2015.
There
were
two
major
accomplishments
of
the
disc
of
the
commission
that
I
want
to
point
out.
The
Commission
has
several
months
that
were
spent
updating
the
historic
district
guidelines.
This
work
included,
removal,
removing
ambiguous
languages,
fixing
it
internal
Corrections
and
clarifying
confusing
statements
and
adding
some
additional
criteria
to
for
the
guidelines.

Commission
undertook
this
project
because
the
guidelines
had
not
been
updated
for
ten
years,
the
guidelines
included
updating
of
photos
and
the
inventory
list
of
all
the
structures
within
the
historic
district,
the
conservation
district,
the
South
Mountain
treat
road
district,
the
Dougherty
heist,
district
and
local
landmarks.
The
updated
draft
will
be
coming
to
the
aldermen
in
the
next
few
months.

The
asari
commission
also
was
awarded
a
grant
through
the
State
Historical
Preservation
Office,
to
host
a
wooden
window,
repair
and
energy
efficiency
workshop.
The
workshop
was
held
on
May
thirtieth
2015
at
Town
Hall,
there,
approximately
29
attendees,
and
they
were
from
both
local
and
also
as
far
away
as
Charlotte.
The
workshop
focused
on
the
window,
preservation
and
repair
weatherizing
and
energy
efficiency
and
the
CLG
training
for
commissioners
and
staff.
Steve
Jordan
from
New
York
was
a
presenter
windows
portion
of
the
workshop
and
historic
preservation
office
staff
provided
the
training
for
the
afternoon
session.

The
commissioners
also
had
a
training
session
with
Jennifer
Cathy
and
andie
mcdowell
from
the
State
Historic
Preservation
Office
in
western
region
topics
included
restoration,
new
construction
materials
and
signage.
The
staff
and
commission
members
attended
training
at
the
western
carolina
facility
in
biltmore
park.
Regarding
quasi
judicial
procedures.
The
workshop
was
led
by
the
state
government.

The
minor
works
saina
jizz
had
eight
sign
permits
to
requests
for
new
color
changes
and
the
removal
of
a
wood
frame
that
was
not
original
to
the
existing
building.
The
Commission
has
a
hearing
set
had
a
theory
sets
certification
at
139
church
streets
for
remodeling
restoration,
the
certificate
of
appropriateness
was
granted
by
the
Commission.

The
Commission
will
welcome
two
new
members,
Nancy
McKay
and
Shonda
Richardson
at
the
July
meeting.
The
commission
would
like
to
thank
Roger
Rio
for
his
time
and
service
on
the
Commission,
as
he
is
rotating
off
now
as
to
our
Commission
meets
on
the
third
Wednesday
of
every
month
at
7pm,
the
Town
Hall.
If
anyone
is
interested
in
attending
the
meeting,
I
apologize

the
fact
that
it's
a
slight
difference
between
this
report
and
the
one
I
read
because
I
got
some
additions
in
late
I'm.

Well,
mr.
mayor
and
aldermen,
we
have
a
happy
report
to
give
tonight
in
that
we
were
able
to,
because
of
the
successful
year
that
we've
had.
We
had
the
happy
problem,
we've
accumulated
too
much
cash
and
we
need
to
get
rid
of
it,
and
so
therefore,
the
board
voted
to
make
a
special
distribution
of
50000
dollars
and
by
state
statute.
Twenty-Five
percent
goes
the
county
and
seventy-five
percent
goes
to
the
town.

we
have
a
check
for

the
town
to
present
and
Randy
reese,
who
is
our
manager
is
here
and
Deborah
luton
who's

board
too,
and
just
want
to
recognize
Randy's
excellent
work.
This
past
year,
fiscal
year
ended
june
thirtieth.
We
topped
two
million
dollars
in
sales
for
the
first
time
and
it's
a
well-run
place
and
I
think
it's
some
of
the
town
should
be
proud
of.
So
who
gets
the

managed
to
say
what
we
need

seven

would
like
to
suggest
ten
minutes
per
person
that
would
have
everybody
had

full

minutes

been

minutes
of
citizen
comments.
Tonight,
I'd
like
to
suggest
that
during
that
ten
minutes
there
will
be
time
allowed
for
question
and
answer
from
the
board
for
others,
but
that
the
first
half
about
five
minutes
somebody
should
get
their
point
across
and
then
the
second
half
of
that
10
minutes
could
be
discussion.

elected

all
take
a
course

ethics.
Basically,
what
we've
done
here
is

generated
a
code
of
ethics
for
members
of
the
boards
and
commissions,
and
so
what

we
envision

each
board
in
commission
member
would
would
would
read
this
recognize
how
important
it
is
to
the
town
sign
off
on
it
and
return
it
back
and
then
be
held
responsible
to
do
it
here
to
the
to
the
guidelines
and
I'm
sure
you
all
have
have
read
through
them.

they're
really
pretty
basic
they're
they're,
basically
outlining
what
you,
but
what
your
role
and
responsibilities
are
as
a
public
servant
and

how
you
conduct
yourself
as
a
board
and
commission
member
for
the
town,
and
then
there

session
at
the
end,
of
course,
that
if,
if,
if
a
board
member
or
commissioner
were
unable
to
adhere
to
these
guidelines,
there
are
some
sanctions
that
then
would
be
put
in
place.

then
we
would
ask
each
member
to
sign
that
and

adhere
to
that.

who
is
the
subject
of
the
investigation.
Potential
sanctions
include
removal
of
the
member

Board

Alderman's
power
and
I'm
just
curious,
and

I'm
wondering,
if
thought

it
creates,

problematic,

have

means
before
we
take
any
action,

wonder

manager

process
where

has

investigation

we

what

before

amendment

get
rid

the
Housing
Commission,
as
it
reads
in
our
land
use
code
in
our
code
of
ordinances

assign

duties

staff

administration

saw.

is
a
good
time
to
do
this.
I
know
before
I
came
to
work
here.
The
Commission
was
much
larger.
It
was
reduced
in
size,
25
members,
Peter,
Vasquez
being
on
the
planning
board,
as
well
as
Bob,
chill
monic
coming
on
the
planning
board.

So
what's
going
to
happen
is
with,
if
you
decide
to
approve
this
you're,
just
going
to
be
emitting
the
section
in
our
code
of
ordinances
which
created
the
Housing
Commission
and
then
the
section
in
our
land
use
code,
which
kind
of
lays
out
the
duties
of
the
Housing
Commission
and
then
reassigns
those
duties
to
the
plan
board.

mention,
too
that
this
was
something
that
former
mayor
and
aldermen
of
this
attempt
this
town
had
to
had.
The
vision
to
set
up
mayor
will
Kennedy
was
one
that
came
up
with
this
several
years
years
ago,
and
I
think
that
it
was
done
well.
I
think
he
could
have
done
a
lot
more,
as
he
wished
had
done
more,
but
unfortunately
to
affect
the
changes
that
he
wanted,
and
most
of
us
are
on
the
Commission
wanted.

I
think
the
vision,
at
least
as
far
as
staff
sees
it
would
be.
You
know
some
ad
hoc
committees
being
formed
through
the
playing
board
to
look
at
specific
housing
issues
that
may
come
up
or
that
may
need
to
be
studied
more
depth.
I
mean,
if
there's
some
issues
still
that
we're
never
resolved
in
the
house
of
commission
and
we're
going
to
continue
working
on
those
as
we
move
very
good.

bids
have
been
advertised
this
weekend
in
the
Asheville
citizen-times
and
on
our
website,
and
so
prospective
bidders
can
pick
up
bid
packages
move
either
through
the
engineer,
Marty,
cocotte
or
to
town.
There
are
75
dollars
to
pick
up
the
bid
packages,
but
yes,
that
process
has
started,
and
so
I
think
it's
fair
to
say,
Ron,
that
they
have
their
assessments
of
met
the
threshold
for
removing
forward.
So
we're
moving
forward
with
our
portion
of
them
well,
but
with
the
entire
portion
of
the
project,
and
so
the
project
will
be
bit
out.

them

what

the
bid
package
looks
like

They
have
questions
so
that
everybody
hears
all
the
answers,
and
then
they
have
two
more
weeks

weeks
well
ahead

bid's

ten
o'clock

update
them

or
what
do
you
suggest.

have
to
expect
you've
been
through

doctors
still
patching

land
use
code
review
recently

do
have
other
ordinances
on
the
books
that
probably
some
upper
40
years
old
that
you
may
want
to

some
point
address
so.

we
would
do
it
similar

way
that
the
land
use

text
amendments

brought

recommendations,

that

some
different
noise
ordinances
and
see
if
there's

that
kind

Mountain
will

terms
of
that,
one
that
you
know

one's
been
in
place
for
a
while

there's
a
new
technology
that
that
applies
