C
A
Motion
in
a
second
any
further
discussion,
all
in
favor,
please
say:
aye
aye
any
opposed.
We
will
reconvene
from
the
closed
session
and
we
may
take
action
following
the
closed
session
green
closed
session.
All
right.
We
need
a
motion
to
return
to
open
session
so
moved.
Second,
all
in
favor,
please
say
aye
aye,
any
opposed
all
right.
We
are
back
in
open
session
and
I
would
like
to
call
on
mr.
A
C
Mr.
chairman,
just
so,
everyone
can
recall
we
Institute
a
lawsuit
on
behalf
the
county
against
Wanda
green
Michael,
Green,
seeking
recovery
for
funds
that
were
misused
or
miss
appropriate
are
appropriated
and
included
in
those
claims,
as
a
claim
for
two
million
three
hundred
and
ten
thousand
dollars
that
was
used
to
purchase
whole
life
insurance
policies
on
behalf
of
certain
county
employees,
including
miss
gray,
her
son
of
that
approximately
two
million
three
hundred
and
ten
thousand
dollars.
C
The
other
county
employees,
all
to
their
credit,
assign
those
policies
back
to
the
county
and
I've
been
in
negotiation,
with
the
attorney
for
the
insurance
carrier
and
the
broker
that
was
involved,
and
one
of
the
reasons
we
haven't
been
perhaps
as
forthcoming
is.
There
were
negotiations
that
were
sensitive
in
nature
and
could
have
been
jeopardized.
C
Had
this
been
publicized
to
the
public
at
the
time
of
the
negotiations
was
ongoing,
but
as
a
Friday
afternoon
and
I
received
an
offer
of
settlement
that
the
insurance
company
out
of
the
two
million
three
hundred
ten
thousand
will
pay
to
us,
two
million
eighty-one
thousand
six
hundred
eighty
six
dollars
and
thirty
seven
cents
now
Commission
is
aware,
and
it
has
been
alleged
in
our
complaint.
Ms
green
had
had
paid
four
hundred
fifty
eight
thousand
for
her
policies,
which
she
had
cashed
in
those
policies
no
longer
exist.
C
So
in
return
for
this
settlement,
we
accept
this
number.
They
are
going
to
go
ahead
and
pay
us
for
the
policies
that
were
issued
on
the
life
of
Michael
green
and
if
we
do
receive
those
either
by
assignment
or
some
other
mechanism,
we
would
have
to
surrender
those
the
insurance
company
with
no
further
payment,
but
I
can
tell
the
Commission
I
wholeheartedly
endorse
this,
because
it
is
a
good
settlement
than
the
net
difference.
Being
two
hundred
twenty
eight
thousand
three
thirteen
sixty
three,
it's
less
than
what
ms
green
paid
for
her
own
policy.
C
It's
about,
half
so
I
think
the
insurance
company
and
its
broker
have
done
the
right
thing.
It's
been
a
little
bit
of
a
long
process,
but
things
of
this
nature
generally
are.
If
we
do
accept
this,
this
does
not
release
any
claims
against
MS,
green
or
her
son,
which
we
are
still
vigorously
pursuing
on
behalf
of
the
county
for
the
other
funds
that
were
appropriated,
including
the
difference
that
we
have
not
recovered
by
the
resolution
with
the
insurance
company
and
its
broker.
Should
the
board
decide
to
accept
that
resolution?
C
In
exchange
these
monies,
we
would
be
required
to
execute
a
general
release
against
the
insurance
company.
Its
broker
or
brokers
and
any
of
their
employees,
for
he
claims
that
might
arise
under
any
of
the
policies
that
were
issued
by
the
insurance
carrier
as
a
result
of
the
transfer.
That's
two
million
three
hundred
ten
thousand
dollars,
but
I
recommend
we
accept
this
and
get
the
money
back
into
the
County
coffers
as
quickly
as
possible.
A
A
All
right
I
would
entertain
a
motion
to
approve
a
partial
settlement
in
the
amount
of
two
million
$81,000
six
hundred
and
eighty
six
and
thirty
seven
cents
from
the
insurance
company
in
its
broker.
This
is
a
complete
release
of
the
insurance
company
and
its
brokers.
The
motion
authorizes.
The
motion
would
authorize
the
chair
of
the
board
to
execute
the
settlement
agreement
so.
A
All
right,
we
have
a
motion
and
a
second
to
support
this,
this
settlement
with
the
insurance
company
in
its
agents
further
discussion,
all
in
favor,
please
say:
aye
aye,
any
opposed
all
right.
The
motion
is
accepted
all
right.
Thank
you
very
much.
Mr.
Payne,
we
greatly
appreciate
your
work
on
this
important
matter
and,
as
you
noted
the
issue,
although
the
issue
with
the
insurance
company
would
be
completely
resolved
by
this
acceptance
of
the
settlement,
the
county's
civil
suit
against
one
and
Michael
Green
will
be
going
forward.
A
So
the
work
is
not
completely
done,
but
this
is
an
important
step
forward
and
recouping
the
large
majority
of
the
county
funds
that
were
wrongfully
appropriated
on
this
on
this
matter.
So
thank
you
for
your
great
work
and
we
look
forward
to
further
updates
on
this
commission.
Any
other
questions
or
I'll
entertain
a
motion
to
adjourn
so
move
all
in
favor.
Please
say
aye
any
opposed,
aye
we're
adjourned.
