Planning work session, commissioner, uh steve west will be joining us in just a minute, but before.

We get into the meet of discussion, let's, as always,.

A

Stand for the pledge of allegiance and take a moment of silence. Thinking of those who.

A

Are on the front lines uh taking care of our community and also those that are uh in harm's way.

A

As well allowing us to do things we do so. With that in mind, please stand and dennis you're on.

I pledge allegiance to the flag of the united states of america and to.

The republic for which it stands, one nation, under god, indivisible with liberty and justice for all.

Possible, but um I need to discuss something with chris for a second, so I'm just waiting for it.

Okay, but um as we're kind of waiting for uh commissioner lance before I hand it over to.

A

Miss eisenberg uh director of planning. I want to share with you that the planning and zoning.

A

Commission over the last couple of months have held a good half dozen of work sessions to go over.

A

The zoning um recommendations uh after they've gone through the planning staff and the uh county.

A

Government uh piece of it it went to the planning and zoning commission for actually.

A

Two two runs of it: the initial and then uh once again, uh going over every one of the properties.

A

I believe there were 29 properties in total, and what you're going to see is some that are going to.

A

Be favorable in recommendations to us as board of commissioners making decisions and then some are.

A

That are going to be recommended. As unfavorable. I recommend to our uh to my colleagues that every.

A

One of the sessions has been videoed and has been held. So if there are some contentious issues that.

A

Will arise, we can always go back and view some of the uh the concerns. I am very proud of.

A

Miss eisenberg and her team, mary and the entire team for capturing the comments as we move forward.

A

From the community- and it was, uh it was a very positive trend in moving forward from the initial.

A

Work session to the final work session, I believe we had last week um last week, a week before.

A

And a positive trend had to do with the details provided uh to the community had to.

A

Do with the expectations of how these work sessions were being handled.

A

And the comments were extremely civil uh and very rewarding to the planning and zoning commission.

A

It was said multiple times by. I believe everyone on the commission.

A

Their appreciation for the community's insight and input and candid thoughts and how they captured it.

A

In value for the planning and zoning commission to make them make their recommendations, the decisions.

A

They made and I would uh as an officio on the planet, zoning commission- I stayed quiet. uh I.

A

Did not vote? It was not my position to vote because, as you know, this is our role now and.

A

Our responsibility as the board to no longer make the recommendations but then to determine.

A

In favor or in unfavorable uh situations for each one of these pieces of property,.

A

um The planning and zoning commission there were some properties uh that we're going to.

A

Get into that were more challenging than others, and some had much more input from the community.

A

Than others um and linda will walk us through the process on why some of these decisions were.

A

Made been favorable unfavorable and I believe that today's session is the initial overview.

A

For the 29 properties, it is not for us to make a decision. It's for us to understand the processes.

A

That took place it's for us to understand the recommendations that have been made, uh whether.

A

It be unfavorable or favorable, and it's for us to begin the the dialogue amongst us. But it is.

A

Not for us to have a final decision uh at this point, we will schedule in a very near future.

A

Follow-On sessions where decisions will then be made so with that said, is there any.

A

Comments from from the board from the other commissioners before we get started.

A

And we'll see if uh commissioner lance can join us, uh he's gone through this before being ex-officio.

A

So I believe he knows uh the beginning processes uh already, but anything um just dennis eric dick.

Okay, well, I I just yeah, please.

D

Okay, my only uh concern is we as we look through these. I think we have to remember.

D

Anything we do is going to be uh focused on our future budget if we are changing any.

D

Designations at this point, if we, if it's something that isn't going to happen in the next.

D

Short period of time, maybe it's not time to do it uh due to the impact this will have on our future.

D

Budget, uh you know uh zoning and basically uh land designation does drive our future budgets. So one.

D

Of the things we have to be conscious of is: do we have the funds we're going to allocate the funds.

D

To get to soil, water infrastructure and things that are needed in some of these.

D

Areas so I think we just have to be conscious throughout all the areas.

D

And think through you know, how does this going to have an economic impact on kell county and how.

D

Is this going to drive our budget in the future, and while I have a moment here, linda uh you and.

D

Your staff did a great presentation, I think, to the farm bureau and they uh last night at their.

D

Meeting did say uh the job you did was tremendous in presenting uh some things to them, so I wanted.

D

To take the opportunity to say thank you, uh they were impressed with the way you presented things.

A

And commissioner weaver, I appreciate it, uh it was a very deliberate process.

A

uh In doing this, looking at the master plan, looking at the different plans.

A

That have been put in place reaching out to the uh different communities, uh whether it be.

A

In district four, with uh mount airy uh or in uh in your district with vince berg and.

A

Some of the properties in mine and five- it really did hit all five of our districts.

A

The other thing I also want to share is that the planning and zoning commission has representation.

A

On all the districts and all the communities that was a very deliberate process from us.

A

To ensure that the planning and zoning commission could represent the best they could for the entire.

A

County and their insight was very valuable uh throughout the process um uh in getting us to.

A

Where we are today typically- and commissioner awareness, I still believe, is not connected, I.

A

Think he is having technical difficulties if we were to be making decisions. At this point, we would.

A

Be holding off on this session because this is an information session and no decisions will be made.

A

But it's to lay it out and to present it best with the we can to each other and then to the community.

A

uh I think it is fair that if commissioner wants cannot join us, we will catch him up at.

A

A later date, with the slides and discussion and that's okay with everybody, we'll move forward.

A

Okay, cool so linda uh again, really good work. um You did a really good job in listening and.

A

Learning uh through the process over the last two months and taking direction from the community.

A

From me from the plan, zoning commission and all others uh to get us to where we are today so.

A

Great job for you and your team and how you capture this and let me hand it off to you.

Well good morning, commissioner, and thank you so much, commissioner roxton for that introduction.

E

Staff and connection work really hard to get to this point. This is picking up basically, where we.

E

Left off in december, so in december of 2019, we re-zoned properties because we were eliminating.

E

The business neighborhood retail, the business general, the industrial script and the industrial.

E

Generation so we had to move properties to their comparable, c1, c2, c3, i1 and i2 properties. Now what.

E

We're doing is more of the actual implementation of the 2014 master plan and the 2018 freedom plan.

E

Properties who have a venus designation in those plans in order to now bring the zoning.

E

Into alignment with those notifications, we are in the process of resetting, so what we are doing.

E

For this process is by request, we've never undertaken this large of a buy request before.

E

Typically, with past plan implementation, we've had various types of comprehensive rezonings.

E

We felt the buy request was in alignment with what we had done in the past.

E

Will come forward one of the times. I would like to get an agreement with our future laney.

E

From a particular plan and would request a comprehensive rezoning and this.

E

Is the place that we did for several properties over the last several years in the westminster.

E

Environment but that's not achieving the goal of implementation in a more comprehensive fashion,.

E

So that's why we decided to do a more comprehensive, larger scale by at a certain point.

E

In time to really begin to implement our master plan and our freedom plan, so that's where we are.

E

As opposed to having it where we automatically rezoned, that's something that we felt was not.

E

Appropriate because every property, even though their future lanes designation, may be what is.

E

Recommended for a future zoning category, I think the commissioner weaver's point sometimes timing.

E

Isn't right, sometimes infrastructure is not there again. This is a 30 year master plans.

E

That we're implementing over a 10-year planning, so not everything's, ready right now again, this is.

E

Where you would like to end up in the future- but you don't have to end up here today, so that was.

E

A lot of the premise of where we started with reviewing the applications that came forward.

E

Designation for their future van use, um for instance, if a property had a current.

E

Zoning of let's say um residential and their future land use was commercial.

E

They would request to have their zoning in alignment with the future land use, designation.

E

However, some properties may be behaving in a commercial manner as something that is either.

E

A non-conforming use, or that has a conditional use approval- that's currently allowed under the zoning.

E

We're going to see a lot of those come forward. A lot of those properties are requesting a change.

E

In zoning, some were in alignment, even though the romania's designation is not.

E

With future playing goals and objectives, others, however, are none for various reasons.

E

As commissioner rolsteen alluded to, we had unfavorable recommendations.

E

Because again, the end of the day is goal of the goal of this is plan. Implementation.

E

So again, not to reiterate what I've just said, but why are we doing this again? This is implementation.

E

Of our adopted plans and the two most recent ones, as I said, are the carroll county master.

E

Plan and the freedom plan, the foundation of this effort are land use, recommendations again.

E

We just talked a little bit about that. We updated land use definitions, and that was something that.

E

You all worked very diligently on this time last year and our various work sessions for.

E

The text and housing and economic development goals and objectives outlined in the plan.

E

So things to keep in mind as we go through this process um and we, I don't believe this.

E

Board has been a part of any piecemeal rezoning efforts because we've been in a planning process.

E

Since this body took off this, so we have not had any what we call piecemeal or change or mistake.

E

Argument, rezonings and that's important to know this is plan implementation and it's very clearly.

E

Outlined in the land use article of the annotated code of maryland, that requires an action taken.

E

Further not to be contrary to the terms and the plan that addresses policies, timings of.

E

Implementation of the plan, timing of development, timing of rezoning development patterns, land uses.

E

And densities and intensities, so these are again things that, as we move forward to consider.

E

Because when a property is rezoned and eventually developed or redeveloped under that rezoning.

E

One of the duties that we have, especially as plumbing commission, is to make sure.

E

Those recommendations are consistent with the master plans. It's one of the biggest items in.

E

The land use articles making sure we have consistent with our master of plans, so we.

E

Have to go back and establish consistency, so when development review projects come up and they want.

E

To put something on a particular property: if it's not consistent with the plan, then.

E

That's a problem for our planning commission and establishing those consistencies, and what this.

E

Is not, this is not a piecemeal rezoning, meaning that you may hear, especially as we get into the.

E

Listening sessions and the public hearing process from some of the particular properties is making.

E

An argument for there's been such a change in the community that you must be compelled to resound.

E

Or there was a mistake in the zoning saying that the board of county commissioners, who has this.

E

Legislative action should resound, but that's not what we're establishing here. We are establishing.

E

That this is consistent with the plan and that the plan is the overarching goal and objective.

E

Of implementation that we are trying to achieve, it's not to say that there are any mistakes and.

E

You need to rezone and be compelled to do that because of that, and most importantly, is to not.

E

And be careful of not spot rezoning spot rezoning is illegal in maryland, law and spot rezoning.

E

Is when you are rezoning a particular piece of property to benefit one property or one property.

E

Owner in particular, so has really nothing to do with the actual overall plans, goals and objectives.

E

But the outcome will be benefiting a particular party or a particular.

E

Property, so we have to be very careful as you make these decisions, that that is not a spot rezoning.

E

um And the other thing that we're trying not to do here is to convert conditional uses.

E

Or non-conforming uses to primary principal districts, meaning, for instance, we're going to.

E

See a lot of properties as we review this. That may have a legal non-conforming use, because.

E

That use was established well before zoning in the 1960s, but they're still legally operating.

E

The idea is not to legitimize those if they weren't legitimized as part of the master planning.

E

Process and conditional use approvals. They are legally acting, they're allowed to be there.

E

By the bca under conditional use, so the idea is not to grant them necessarily even.

E

More race than what they already had, so I know this is complex and you know, as we go through.

E

If you want to stop me with any questions, please feel free and also, as we come to the.

E

Specific properties, we can go over some of those concerns and issues and if, if the property is.

D

Deemed to be appropriate and it meets the um master plan and it falls in the line.

D

This property now is designated or zoned, at whatever we put it into. Is that an obligate.

D

Us to fund soil and water or whatever, is needed in that area or infrastructure whatsoever. No, it does.

E

Not obligate us to that, under our current county code, um we for roads that will come from property.

E

Development and not all commercial properties or industrial need water and sewer to develop.

E

Many of them are in the water and sewer master plan area, and the developer brings.

E

The infrastructure to those properties and some properties actually have infrastructure on them.

E

That are undeveloped already if the properties are already on the appropriate infrastructure.

E

We're just putting them out into the appropriate zoning category, so this does not obligate to do.

E

Water soup or roads, or anything like that. Okay years ago, we had an issue like this and the.

D

County was sued over it and it cost us quite a few hundred thousand dollars to mitigate that issue.

D

And we had to do it. I was just wondering: does this carry over into anything like that? Roberta? Do you.

D

Have any input into that yeah? I I know to what you allude. Yes, there were two different lawsuits. One.

C

Involving the county and we're involving the city of westminster and um both ultimately made the.

C

Local jurisdiction, um in each case responsible for providing the necessary um infrastructure.

C

But there's a lot of detail like into each decision.

C

We go into it at a different time, probably better, um an explanation, yeah all right. Well, I know we.

D

Just have to be careful, I as we do this, you know it can obligate us or potentially obligate us.

D

Here again, that court of law will decide that, but in those prior cases we have paid dearly for it. So.

C

Correct it's something one should be mindful of. If those services are not there.

C

Then that could be a possibility, possibly wrong.

E

So again, just to reiterate um the history of the process so for these requests once we finished.

E

Up the comprehensive rezonings in december, we submitted, we opened up an application period.

E

And so, during that application period we had actually 3132 properties come forward to apply.

E

For the buy request resign so again, we are not rezoning properties without the property owner.

E

Not only um did are we not doing it for them or, but they are requesting it from us. Then march.

E

Through june, we began our stop analysis and draft reports, and these were very thorough draft reports.

E

So again we looked at the appropriateness of the land use designations during the planning process.

E

And now we're re-evaluating the properties for the zoning process again going back to maybe the.

E

Timing isn't right or maybe there's certain things that are coming out in the zoning process, that.

E

We wanted to bring out in staff reports to make you all aware in your decision-making process.

E

Then july, through august, as commissioner ronstein said, we've had probably seven or eight meetings.

E

From an introductory meeting to two meetings for each property, with detailed reports and discussion.

E

um That we gave initial presentation recommendation then, in september.

E

Through october, we had additional planning commission meetings to break them out so.

E

That way, we could go back and rediscuss the properties that planning commission provided.

E

Provisional recommendations to give you the final recommendation that you all will be seeing today.

E

So public outreach we have done a lot of public outreach as of today.

E

All of the properties, so now there are 29 properties, as part of this process have been.

E

Posted with physical signs, these signs we had custom made for this effort. They carry the logo.

E

And branding of this particular effort, they're colored, a bright turquoise, color they're, the.

E

Same size as all the properties posting signs that we use for bza and for development review, so these.

E

Are you know, bold letters that have information about the property, what the request is and how.

E

To get more information to be able to guide people to call our office or go to the website.

E

We've also mailed over 400 letters to joining properties and other interested parties, so.

E

Not only did we mail them to properties, touching properties that are part of this rezoning process.

E

We also expanded the reach to communities of interest that we knew for specifically properties.

E

That had some more controversial recommendations. We wanted to make sure that we reached out to them.

E

This has also been posted on the county's facebook page we've sent out email blasts since uh february.

E

Of this past year, press releases with updates on meetings and status reports and all of the.

E

Information is on our website carol, rezoning.org, which we're constantly refreshing updating, adding.

E

Information putting more recent information up, so it has current meeting information.

E

Interactive maps that you can zoom in zoom out type in addresses, look at different features.

E

Static maps are basically just a map image that you can zoom in and zoom out of complete.

E

Detailed stack reports for each project links to planning commission's open sessions, a list of.

E

Frequently asked questions that we're continually updating and modifying instructions to sign up.

E

For additional information and a link on how to submit comments, not only do we have that, we also.

E

Actually have the actual comments up there and typically, I know we provide you all with a binder.

E

Of all this information, but given the details of even the pair down stack reports and the amount.

E

We did not want to get seven or 800 pages worth of paper, so I'm going to actually show you all the.

E

Website so you can go there and look at these comments and what we will end up, giving each.

E

Commissioner is a commissioner district report and we think that way you will have information.

E

Just for your district of the properties that are listed and the comments and detailed reports for.

E

Those properties within your district, I will say some, commissioner binders- are going to be heavier.

E

Than others I'm just kind of delaying the land. So um there's no there's not an even distribution of.

E

By requests countywide linda, take a take a breath for a second. If you can go back to that last slide.

Okay: this was a very important piece of the effort over the last few months.

A

um And this is uh really where a lot of attention and uh resources time were put in place.

A

To ensure those that uh had interest, um those that were affected uh were reached out to early on.

A

Those letters went out and there was a bit of frustration that they were received. Only a few.

A

Days prior to the initial meeting, uh you know we we understood that we accepted that, but we kept.

A

Moving forward saying, what else do you want to see in these letters? What else do you want to see on.

A

These signs on facebook or emails. How else do you want to receive that information? Are the websites.

A

Too complicated, is it too much to go through and um again uh working with um with linda with.

A

The entire team- and I applaud them for being both reactive and proactive on saying what else can be.

A

Done and getting the message out, there'll still be somebody out there. That will say I never saw this.

A

Happening, uh that's part of that's part of it. uh We just have to accept it, but you know this effort.

A

Was very deliberate and very resource intense um in moving forward. I just want to make sure you.

A

As commissioners and the community recognize that, because it's not perfect, but it was as much as.

A

That could be done in a relatively short amount of time, so I just want to let everyone know that.

A

Thank you uh hands up. um Thank you, commissioner, ruskin for that, and actually uh also to bring you.

Up today, when we sent out the adjoining properties, that was an initial invitation. At that time, we did.

E

Not know wrongly we'd be bringing information to the board of county commissioners, so we said we'd.

E

Be sending a follow-up and right now we're working with pds um planning uh data services. I'm sorry.

E

Printing data services to print out postcards now now outlining the next meetings that are coming up.

E

Where the board of county commissioners involved for the decision making of this.

E

And I will say in the comprehensive plan process, we are not obligated under state law to do any of.

E

This we do not have to post properties under state law or county while for comprehensive rezoning. We.

E

Do not have to mail adjoining letters, we don't have to stand up a website. The only thing that.

E

We are required to do is post an advertisement in a local, a paper of general circulation that the.

E

Local body um would receive so that would be our obligation. um We believe, however, we are going well.

E

Above and beyond that, because it's the right thing to do- we want to make sure that the community.

E

Knows what's happening so again, new letters are going out in the next week of postcards.

E

Letting them know about the process by which the board of county commissioners will be undertaking.

E

So, um and working with roberta windham, we have talked about some good ways to continue to have.

E

This process for the board of county commissioners, and so today, as commissioner osteen said earlier,.

E

We are giving you an overview, it's going to be a very quick overview of each property just to.

E

Familiarize yourself, with the properties that are you're going to be hearing about.

E

um And we've scheduled what we're calling a listening session on october 29th and the idea.

E

Of this listening session is for you to actually hear from the community about each of.

E

The properties so instead of waiting to a public hearing after you've had detailed staff reports.

E

You will be hearing from the community first, those that wish to sign up and speak and continue to.

E

Submit comments for a listening session, then, after the listening session, we have scheduled three work.

E

Sessions in november with the board, so that would be november 3rd november 9th I mean I'm sorry 10th.

E

And november 24th, um so that way you can hear them more in depth after you've already heard.

E

Community input then we'll be hosting another public hearing on december 3rd at 7, 00 pm.

E

And that will be the official public hearing for this effort.

E

Then, after that, we will schedule discussion and deliberations on those properties, since there's.

E

So many properties 29 that may be over, of course, of several meetings, just like planning, commission.

E

Had several meetings to make their final recommendations to you as well.

E

Then, at the end of that would be the adoption of the maps and those again are the same setup.

E

That we had, before with the official zoning maps that you signed back in december of 2019.

E

So does that seem agreeable? Does that seem like a good layout for you all.

Yeah I had a question, though, is all those dates? Are they already on our calendars.

I believe they are good. Okay. Yes, they are.

E

So again, as I said, all of our informations on carol reazoning.org um in that are the.

E

Detailed staff reports the purposes of the zoning district um and that's important so.

E

As you review, if you have a question well what what is this? What are we doing here um again.

E

That's the purposes that are from chapters 158 and chapter 155 for subdivision and then the use table.

E

That was something, as you recall, you all worked very hard on helping to finalize what that use.

E

Table is so it's basically the table of uses for each district. What's allowed, what's not allowed.

E

And what have the conditional approval attached to it and that'll help? You understand what.

E

Each district can do and not do I'm just going to take you really really quickly.

E

To the website, so you can see a little bit about where all of these resources.

Are- and I think my computer might be a little frozen right now.

I think I tried to do too too much at once, and then you get to see my daughter, sorry about that.

Still working on now that we're this next space continuing to put up new information.

At the top is where speakers can sign up to speak for the to listening. The listing.

Session and the public hearings we're already getting that information now then below are the.

Planning, commission dates and the properties that were heard for each planning commission meeting.

And then, underneath that and we're working on organizing this today.

To make it again more user friendly, so probably by the time you have an opportunity to review.

This particular website um this will be skimmed down and cleaned up, because now.

E

We're moving on to the commissioner portion, but we have the location map. We have um the.

E

Summary of recommendations from the planning commission, which are fairly detailed reports.

E

And so it is the district um information that the um so the property information. What the request.

E

Was the planner it was assigned to and then um what the planner recommendation was? The.

E

Planning commission meeting that it was heard on the provisional recommendation from the planning.

E

Commission and what their final recommendation was, the green representative properties.

E

Where the planning commission had a favorable recommendations to you, the red are the properties.

E

That the planning commission had an unfavorable recommendation to you. um I thought that was.

E

An easy word for you to see at a glance what they felt was appropriate and not appropriate.

E

And also comments, so um they have the property booklet itself.

E

And in this property booklet we had to split them because of their size into two booklets. So we did.

E

It since there were 29 properties, we did half and half so the first half of the properties are in.

E

Booklet, one, the second half of the properties, are in booklet two and it's been updated just recently.

E

There's a brief synopsis at the beginning, I'll be going over a little bit of this in continuation of.

E

My presentation um there's a general map of all the properties that same recommendation and then.

E

Staff reports for each property and again I'll be breaking these staff reports.

E

Up by commissioner district, so you have that information for your specific district as well.

E

And then the comment list is underneath of that. So we have in here written.

E

But um oral comments as well and we ordered them by the request number and what the request number.

E

Was is a way for us to track who was coming in and what their requests were and what order they.

E

Came in so that way we could keep it running tally. So that's why you'll see like ec stands.

E

For employment, campus i1 stands for the request to go to i1, etc. um The commissioner district or.

E

The election district is the next number, I'm sorry the year that it was received because.

E

This is going to be a multi-year process and then what number they came in order and then.

E

We have a general property name, someone commented and what a synopsis was a general comment.

E

So these are all of the comments that we received written and then the detailed written comments are.

E

In the book, but it's some, then we also had calling comments. So someone called in we.

E

Gave the property name the person commenting and again a general synopsis of their comment.

E

And then we added in all of the detailed comments that were submitted.

E

So again, these are hundreds upon hundreds of pages um actually having this digital lease a good way.

E

To search through this is just to do a control, find control, f,.

E

And you can type in a keyword and if you are looking for something specific it'll take you.

E

To it it's about it's a little bit easier to also peruse, but they also go in number order.

E

So I'm going to go back to the powerpoint presentation and hopefully this opens up quickly.

So again, that's just a quick overview of the website and feel free to reach out to me.

Or to mary, if you have any questions, if there's something you can't find on the website that.

You're looking for in particular and we'll make sure we get that data and information to you.

So here's a county line map of all the properties, as you can see, it's not all evenly.

E

Distributed throughout the county, uh most of the properties that are being requested are south.

E

Of westminster and to the east, so the freedom area has a lot of properties for consideration.

E

As well as parts of westminster and commissioner weber's district, the.

E

Kingsburg area as well, and then there's just maybe one or two in commissioner.

E

Lance's district and then there's several in commissioner um boucher's district.

E

So again, 29 applications are what you'll be considering. Originally, we had 31 requests, but.

E

Several properties throughout the process decided that they did not want to go through. After all,.

E

The comprehensive rezoning process, so we pulled them out of the application, so you will not be.

E

Seeing those and 615 acres countywide are being requested to move to these commercial industrial.

E

And planning campus district, so the breakdown is two c1 properties, 15 c2 properties, one c3 property.

Two i1 properties, five i2 properties and four employment, campus properties and here's the.

You know general acreage breakdown with employment campus being the largest.

Acreage and that's because there are larger parcels that meet that employment, campus criteria.

So now I'm going to go into an overview of each of the.

E

Properties are there any questions before I move on to this portion.

E

Okay, so the first property is ec142021, the application location is in the eldersburg area.

E

The applicant is avar partnership and this is the actual legacy school. The request is from ag it's.

E

Current zoning to employment campus, the applicable plan is the freedom plan and in the freedom plan I.

E

Had a future land use, designation of employment, campus and staff and planning commission gave.

E

This property a favorable recommendation: this property is part of a larger group of properties.

E

From the freedom plan that were designated for employment, campus and the other properties are.

E

The known as the delaney properties um that were earned that are owned by carroll county.

E

um The next is i214 2023 um i2 that second property was removed prior to going to planning.

E

Commission this is in the woodbine area off in 97. The applicant is michael wedikin.

E

The request is from ag to i2, and this was in the carroll county master plan.

E

In that planet had a future lane use designation as industrial heavy and the staff recommendation.

E

And planning commission recommendation are favorable for this change, so this is um old.

E

Washington road or maryland 97- and this is part of that overall, south carol industrial park.

E

Area where this is um zoned industrial- and this was one remaining piece of ag- that is.

E

Joining another parcel that was subdivided from the vatican property that was still left in ag.

E

That was identified in the master plan to move to i2.

E

On the next property's request for commercial 2, c214 2024- and this is along 20, maryland 26th.

E

In the sykesville area, the owner is deborah stockdale and the request is from r20000 to c2.

E

And again, this was in the 2018 freedom plan with the future land use of commercial medium.

E

And favorable recommendation from staff and planning commission so this to orient you.

E

Is maryland 26. to the north of this particular property is st john properties, liberty, exchange.

E

And this is a clustering of commercial properties on the south side of maryland's 26.

E

The next is c207 2025, the location is in the westminster area, the applicant is hail and.

E

Helen stern super and the request is c2 from r20 000 and it's in the westminster environments plan.

E

The future lane uses suburban residential, so this is one of the ones that did not have a land use.

E

Designation, consistent um with the request for c2, however, staff and planning commission.

E

Gave it a favorable recommendation and part of the discussion was that its location along main.

E

Street near the intersection of maryland 97 and the surrounding area being so heavily commercial.

E

Actually, planning commission was a little surprised. It wasn't already so commercial to begin.

E

With and there's a lot of that in the westminster environs area and that's a plan that we will be.

E

Undertaking in the future, because there's a lot of properties, there are a lot of properties that are.

E

Acting commercial that still have future lane use designations solidly residential. So that's.

E

Something I've planned that we will be working on in the city of westminster with to work on what.

E

This environs area means and what their future plans are for annexation of the westminster area.

E

um The next is c214 2026. This is in the woodbine area. The applicant is sarah evler.

E

Request is c1 to c2 it's in the 2014 plan and it's in a rural village and the future land use.

E

Is village commercial industrial staff gave it a favorable recommendation, but planning commission.

E

Gave it an unfavorable recommendation, here's the parcel here p137. um They were originally a bnr.

E

Property and in the first rezoning of c1 c2 and c3, they were put into a c1 classification.

E

However, they wanted to have um expand their enterprise to allow auto service, and so that.

E

Was their request for c2? You cannot do body work in a c1 property and that's something they wanted.

E

To expand their business um to incorporate the planning commission um thought that, given the size.

E

Of the property um and the surrounding community that that might be too intense for this area.

E

The next is c104 2027. um This is in the westminster area, playtime corporation, which is a.

E

Daycare child care center request is from ag to c1, and this is a permitted use.

E

Conditional in the ag, so the applicable plan is the master plan, the future land use and that plan.

E

Was agriculture staff gave this an unfavorable recommendation and planning commission gave.

E

This an unfavorable recommendation- and we did have a few comments regarding this property.

E

From the surrounding community- and so here is um baltimore maryland 140 and here's old.

E

Westminster pike, the property does not have access to maryland 140 directly.

E

So the entrance to this site is old, westminster pike, and this is residential in front of it.

E

The next series of properties are ones that are kennel resource recovery, llc or kmp resources.

E

Recovery llc, there's four of them um that are clustered together.

E

The request is ag to conserve I'm sorry again conservation to i1 again. This was in the master.

E

Plan the future land use was resource conservation and light. Industrial scott gave this a favorable.

E

Recommendation because of its consistency with the master plan, however, planning commission.

E

Felt it was unfavorable and the property was not ready at this time to move forward.

E

So if you can see the purple here is.

E

The current county, landfill and off the map to the south will be the other properties.

E

Of this grouping that we'll be talking about this series of properties, um properties, 8, 9,.

E

12 and 13. are particularly controversial. The community is not happy to see this zoning.

E

Change for these properties. Complaining commission heard these properties for the master plan process.

E

There wasn't a lot of feedback, but now with, as we've moved into the zoning portion of this we've.

E

Heard a lot from the community planning commission felt because this property was situated to the.

E

Back of the landfill, nothing was happening here with the landfill just yet they felt it was not.

E

Appropriate at this time again because of timing and infrastructure to move this request forward.

E

So I'm grouping these together and you'll see them go out of numeric order. The next one is again in.

E

The westminster area, it's the same property owner. The request is added to employment campus, and this.

E

Was in the city of westminster, comprehensive plan, the future land use for this is employment. Campus.

E

And staff and planning commission gave this property a favorable recommendation.

E

So this again is the landfill, and this is just.

E

To the north, or actually to the direct west, I'm sorry north of 140, of the landfill.

E

I'm jumping a little out of order is um c204 20 2010. This is in the westminster area. This is.

E

Owned by smo incorporated, the request is r40 to c2. This is under the master plan. This does not have a.

E

Future land use designation as commercial after the plan was adopted in 2014, the property owner.

E

Came back and subdivided the property in various different ways had to do with the sale of the.

E

Overall property: this is the jiffy mart properties um and the billboard along maryland 140.. So this.

E

Was part of a re-subdivision um I think a year or two ago so created sub-par parcels for residential.

E

And now the idea is to put this is the jiffy mart at suffolk and maryland? 140 is to put it in.

E

um To be consistent with the property that it's a joint and part of now that the ownership has.

E

Changed next is d204 20 2011.. um This is the parcel to the north of that one that's owned by.

E

Ted, this real estate has a billboard on it again when it was subdivided from the initial properties.

E

That were in the r40 district to see, choose the request and they created a subpar parcel. um So.

E

Again, that's why they felt it was more appropriate and we do not have that in the master plan. I mean.

E

Staff and planning commission gave both properties, 10 and 11 favorable recommendations for c2.

E

And here's the brand new snap, so all of this then would become c2.

E

If the zoning request moves forward.

E

Going back to the kmp resource recovery properties as part of that cluster, I was just speaking about.

E

Several slides ago, the next request is from add commercial. Three. um This was in the 2014 plan.

E

Again, with the future land use recommendation, commercial, high and favorable recommendation.

E

From staff and from the planning commission again there's a lot of public comment on these.

E

Properties in the public comments that are on the website that we've posted we've lumped all of the.

E

Properties for 8, 9, 12 and 13 together, because many of them talked about them individually,.

E

And together it was really hard to separate out because of that which we're talking about which.

E

Property, so they're all lumped in together as comments for the grouping of properties.

E

So these are, um this is again for orientation. The northern landfill.

E

Reefs road- and this is a stretch that the request is for commercial high along baltimore boulevard.

E

This was that property playtime corporation across the street that was requesting.

E

um It's not yet determined if state highway will get access.

E

Off of maryland 140 that would happen at a site plan, um one site when the site.

E

Plan is submitted if the zoning moves forward. That's a state highway decision.

E

And the last in this cluster of properties is i204 202013 ag to industrial, high i2 planning.

E

Commission and staff gave this both a favorable recommendation, so the properties before that.

E

Are the commercial in the front? This was for recommending the heavy industrial to the back now.

E

um In the carroll county master plan, one of the decisions in making these properties commercial.

E

And industrial was at the time westminster did not have its restrictive water policy in place um and.

E

The property owner at that time was had some preliminary discussions with westminster about.

E

Extending water and sewer to these particular properties, westminster um controls, the water.

E

And sewer for this area and going back to what commissioner weaver was stating earlier.

E

um Carroll county only controls, water and sewer for the freedom area, and we only control sewer.

E

For the hampstead area, the rest of the water and sewer is really determined by the municipalities.

E

And, except for westminster, you have to be annexed in to utilize their utilities.

E

Property 14 c209 2014, is in the winfield area. It's mad property enterprises. The request is added to.

E

C2 on the future land use is agriculture. Staff gave it an unfavorable recommendation. The planning.

E

Commission gave it a favorable recommendation, so these properties are just west of the.

E

Winfield rural village, so if you see the slash pattern here, that is the windfield world village.

E

So this is just slightly um west of that and it's two properties near skidmore and actually it's off.

E

Of old liberties, so access would not be right off of maryland, 26 would be off of old liberty.

E

The next is c206 20 2015. This is in the lime bro area. The applicant is mary, jane graf. The request.

E

Is added to c2? It is in the rural village of lyme borough and has a future language designation of.

E

The residential staff and planning commission gave this property a favorable recommendation.

E

So the hatched pattern is the rural village of lime verto. This is a large piece of property.

E

Right off of maryland, 86 lymborough road, that's already developed um with.

E

A daycare center in the front portion of the property and as you move to the back.

E

um It's contractor equipment storage. They had some service bays there. A pole, barn.

E

And some other industry happening there, so the request, because it was already developed site.

E

Made sense to me from um village residential because it's in the rural village and does.

E

Support the rural village uh to be and a commercial medium designation.

E

The next is, I 105, 20 2016.. This is in the sykesville area. um The applicant is fogle.

E

Properties, the request is conservation to i1. This was in the freedom plan with the future land use.

E

Of conservation and staff and planning commission both gave this an unfavorable recommendation.

E

The properties are situated off of obrecht road. It's just outside of the corporate limits.

E

Of sykesville um spill and an nearby property owner go through it and uh comment in opposition.

E

Psych spill does not feel it's appropriate to change the zerning of this property. The white.

E

Area is the growth area for the town of sykesville. um You can see this little blue stretch right.

E

After the word use in future, land use, that's actually where the dam is for the pioneer run.

E

Reservoir so part of this swap bag. Here is the inundation area for the piney run dam. If anything,.

E

Should ever happen to the dam, this property was put in conservation. We did a zoning history.

E

Back in the 70s um as part of the overall 77 freedom mini plant area,.

E

The next is c307 20 2017. This is in the westminster area. This is 844 professional.

E

Center condominiums request is r 1000 to c2 or c3. This is in the westminster environs plan.

E

And again, this is the future land use suburban residential. However, both of this part of this.

E

Property developed as a medical office, complex and planning, commission and staff both gave.

E

It a favorable recommendation for c2 there's a whole series of properties along washington, road.

E

That are being used very differently from their future land use recommendations.

E

Our future land uses in any plan and their current zoning because of conditional uses.

E

This would be an area that, when we are embarking on an updated plan for the westminster environs.

E

Area we need to get particular attention to because there's a lot of changes that.

E

Have happened over the years that need to be acknowledged and reviewed and put into.

E

An appropriate category with how they've developed, because this is a complete medical office, complex.

E

The next is i209 20 2018.. This is in westminster area near salem, bottom road.

E

The applicant is melvin laney, the request is ag and conservation 2 i2 industrial. This was.

E

In the 2018 master plan on the future, land use is resource conservation and stock and.

E

Planning commission get but gave this unfavorable recommendation, so um this is salem bottom road.

E

The surrounding area is conservation, there is significant flood plain near and around this.

E

Property, this property is outlined in blue again they are legally operating with the conditional.

E

Use for a contractor equipment storage yard by giving them the i2 designation, does not change.

E

What they're doing on the property? They can continue indefinitely with this particular use.

E

The next is c 2020 19.. This is in the finksburg area. The applicant is.

E

Gems investment, the request is conservation to c2, and this is in the 2013 ginsburg corridor plan.

E

It has a future land use of conservation staff, gave it an unfavorable recommendation, but.

E

Planning commission gave it a favorable recommendation with revised boundaries.

E

So the entire parcel request was this green sliver, that is, between old westminster pike and baltimore.

E

Boulevard, just after you come over, the bridge from baltimore county moving west is on that south side.

E

The applicant then revise the request to just be the blue portion of this property. We did hear from.

E

A property owner from the nearby residential um in opposition to the change in this request.

E

This property is heavily constrained by environmental features, with streams.

E

Forest and some wetland area, the blue here- is actually reservoir property owned by the city.

E

Of baltimore, the actual reservoir itself is off the map, but it is in the reservoir watershed area.

E

And is one of the last adjoining properties before we get to the reservoir buffer area.

E

Next is c203 2020 002. This is on little's town pike, just outside of westminster.

E

um This is 97 crab, pass, llc or better known as the maryland mallet request is added to c2. It was in.

E

The master plan, as agriculture and staff gave it an unfavorable recommendation, but planning.

E

Commission gave it a favorable recommendation for c2, so this is littlest town pike, maryland 97.

E

And the property is accessed right off of 97 in its maryland ballot.

E

One property owner do call in in opposition to the request.

E

And we received several written comments on that site.

E

Connects to c207 2020 0022, this is in westminster. um This is book llc. The request is added to c2.

E

um Staff and planning commission gave this property an unfavorable recommendation, so the.

E

Map is 97 north of westminster and byron's area. The corporate limits are the.

E

Hatched pattern: this is right outside the corporate limits of westminster.

E

This property was formerly the north carol community school and formerly a church, both.

E

The school and the church are principal permitted uses in the ag district.

E

And the request was to go to commercial medium for that site. The next is i211 2020 23.. This is.

E

um In the westminster area off of maryland 31., the applicant is finch services. Request is ag to i2.

E

This falls under the carroll county master plan with the future lanes designation of ag.

E

Staff and planning commission gave us an unfavorable recommendation.

E

We had several comments, written and oral from the community regarding this property.

E

The entire parcel is the blue outline and where the number 206 is, this is on the north side of.

E

Maryland 31 heading toward new windsor um in the that industrial corridor of maryland 31.. However,.

E

The front part of this property, which is about half the acreage of the overall site, is currently.

E

Zone i2, the request was to add the additional back half to go to i2 the concern from the community.

E

Was access to the property, um especially coming up medford road? There's a lot of concern about.

E

That and there's a lot of concern about from the surrounding property owners and farmers in the.

E

Area with the compatibility of heavy industrial back onto medford and old, new windsor road.

E

However, um economic development did give it a favorable recommendation and sent a letter.

E

In regarding that property, the next is c207 2020 24. This is in westminster at the intersection of.

E

Maryland 32 and 97 the applicant is dana kiker. The request is added commercial, medium c2, both.

E

Staff and planning commission gave this a favorable recommendation, even though.

E

The future range designation is agricultural, so this is old, walk new washington, road, maryland 97.

E

This is sykesville road, maryland 32. This is where the two intersect to the north of this property.

E

Is the ymca, then the community college, so a lot of the properties going up maryland 32 are not like. I.

E

Said before and either the zoning or the landing schedule, you would think they were being given.

E

The heavy development actually of that maryland 32 corridor. um We have the school, we have the.

E

Community college, we have the service beer, we have the career and tech we have westminster. I mean.

E

There's a lot of heavy development that are not characteristic of or conservation um in this area.

E

Next is ec 24 2020 25, and this is the sykesville area. These are the delaney properties.

E

Request is from add to an employment campus. These were designated in the freedom plan as.

E

Employment campus and the staff and planning commission gave them favorable recommendations.

E

So this is seasonal road. This is 26., um the blue striped is lit in our clinton springs elementary.

E

School and um century high school so then to the north or the beginning of the delaney properties.

E

That are in the red and white straight, so this is the legacy property that we just.

E

Talked about a bar partnership, so this will be contiguous employment, campus.

E

There are still three properties that are designated employment campus that did not.

E

Submit an application and we've not heard anything from the community regarding these properties.

E

Coming down the final stretch, just a few more properties to review the next is c103 2020 27.

E

This is in the westminster area. This is the new location of the north carol community school.

E

The request is added to c1 and the future lanes. Designation is agriculture in the 2014 master plan.

E

And staff and planning commission both gave it an unfavorable recommendation again. This is a.

E

Primary principal use for the school to be allowed in the ag district, so by moving it to c2, does not.

E

Brands at more rights than it currently already has and they're, acting appropriately with no.

E

um Limits as what they can do for the school portion of this site, so this is old stone, road.

E

And littlest town pike and then this is the area of the current carol north carol, community school.

E

The next property is c205 2020 28. This is in the eldersburg area. The applicant.

E

Is longmeadow farm or the baby property? We are currently zoned. I want industrial.

E

Light with a request to go to c2 commercial medium, this is under the 2018 freedom plan.

E

The future lane's designation in the freedom plan was commercial high.

E

And staff and planning commission both gave it a favorable recommendation for commercial, medium, c2.

E

This request was modified from the land use, designation and the freedom plan, so in the.

E

Freedom plan, the c3 district was approximately 40 acres and encompassed the burgundy portion here.

E

The request now is to pair that site back to 30 acres and now be the blue outline and the.

E

Request is to go to c2 commercial medium. Instead of c3 commercial high, we've received a lot of.

E

Oral and written comment regarding this properties rezoning- this property is also heavily discussed.

E

During the freedom planning process and there's a lot of comments about this particular site.

E

Next is i204 2020 29.. This is at old westminster pike in the westminster area,.

E

This is roy poole property, known as tumbleweed express. The request is from ag to i2. This is in.

E

The carroll county master plan, as agriculture and staff m planning commission gave this property an.

E

Unfavorable recommendation there's been a lot of concern from community because.

E

Of the nature of this business, they do have a bza conditional use approval for this particular site.

E

To run the trucking business that they have on the site, um but the community surrounding it.

E

Has been very vocal in their opposition about the expansion um of the allowable use.

E

Through the board of vending appeals, especially in 2018 when they expanded the property, even.

E

Further so um staff and planning commission, I gave this particular piece: an unfavorable.

E

Recommendation there's a lot of public comment before I'm written. As I said regarding this site.

E

The next is ec13202003. This is in the mount airy area off of ridge, road.

E

It's known as the colburn-holberg bay property, the request is conservation to employment, campus.

E

And this was identified in the 2014 master plan as employment campus, but the staff recommendation.

E

Is favorable and the planning commission recommendation is unfavorable this property.

E

Is particularly controversial because it's been swept up into the future annexation, which we.

E

Have not received the request yet of the harrison and my sheer property to the south, which has an.

E

Office park, employment campus designation, they are currently trying to work through the annexation.

E

Process now and the community um is not happy with the potential annexation of that property.

E

This property is the stripped property to the north. Of that we've gotten a lot of comment.

E

Not only from the community but also from the mayor of mount airy and the planning commission.

E

In opposition because they'd like to see the property to the south move forward into.

E

The annexation process first and our planning commission gave an unfavorable recommendation.

E

um Looking and giving a lot of consideration to the town of mount aries wishes with regard.

E

To that and that it's not quite ready yet to move forward, let's have one move forward now that will.

E

Be buying into the town um and maybe perhaps wait for a future date from the properties to the north.

E

So our last two properties are along maryland, 26 in the freedom eldersburg area. This is c205.

E

2020 31.: this is buckman and associates. The request is r 10 000 to commercial medium.

E

And this was both favorable from the staff and planning commission. um So this is uh the princess.

E

Shopping center, where shoppers food warehouse used to be located and there's a panera.

E

Then there's a small commercial property here, which um was a medical building, and this was.

E

A real estate office that now wants to move to its appropriate commercial, medium, designation.

E

And that's the same with the next two three properties that are together, which is c205.

E

2020.0032, these are owner frios, seminole trustees and requested to go from r10.

E

000 to c2 and planning staff and commission both give it a favorable recommendation. There's a.

E

Series of three properties separated by margin way- and these are the owner freo properties, which are.

E

Next to the hair salon that they own.

E

And that is a very brief run through of all of the properties and, as I said,.

E

More detailed reports for your commissioner district are forthcoming. um Are there any.

Questions that you have with regard to all of the information I showed you today in record fashion,.

Okay, linda up front again, I I do appreciate all the work you and the planning commission have done.

To get us to this point right now, um a lot, a lot of effort, a lot of sessions, a lot of listening, a.

Lot of uh you know, understanding, anxiety and angst in some of the comments and capturing them.

And then packaging it for us and just for the group again, as you saw there are some decisions.

That were unfavorable, there were some decisions, never favorable. There were some that were uh not.

In line with what the um planning directorate came up with, because the planning commission.

Listened to the community and the property owners in many cases and made a different recommendation.

We've come a long ways, and so I do appreciate it. I see commissioner lance is back on or is on so.
