I now call to order the regular scheduled meeting of the board of zoning appeals notice to the public the time the date the place and the agenda for this meeting was published as a legal notice on july 5th 2020 in the aitkin standard.

2021 2021, as a legal notice, are in the aiken standard, contiguous property owners were notified and signs were posted on the properties on or before the 20th of june july. 2021.

For anyone giving testimony to this board knowingly providing false information, now, that's! According to section 22-9 of the aitkin municipal code, it states each infraction is a separate offense, with a penalty of up to 30 days in jail and are a fine of 1097. and 50 cents.

These I'm sorry. If I heard you correctly, the um the planning department received a request from um downstairs to uh make a few changes uh to those orders, so they have already been. They had already been signed by the board, but this just uh corrected version. That's uh before you to be resigned.

Hey mr chair, before I start I'd like to reintroduce myself uh greg zionic I've been uh with the board uh providing staff support a number of times in the past. I'm here one more time, but I'd also like to introduce to you max plankey, who is a new member of the planning staff here at the city.

With that application, I call your attention to application 2-1.

9306: that's a request for a variance to the zoning ordinance to permit an approximately six and a half foot setback to the south property line to be constructed as an attached garage and a home edition, and that's on property zone, residential single family 15 and is located at 619 azalea place. Southeast.

We were the planning department received two written responses to the mail out to adjoining property owners. Those responses are included in exhibit f of your agenda packet, otherwise we receive no other communications or requests for information. Thank.

819 azalea place southeast is located uh just south of knox avenue on the south side of the city, the request is for variance from the side yard requirements contained in section 4.2.1 of the city's zoning ordinances. The request is to reduce the the south side yard from 10 feet to 6.5 feet.

The purpose of the request is to allow the applicants brooke thomas and mike sakara to replace an existing two-car carport with a two-car garage and several rooms as part of an addition to the house on south side of the existing house.

Information detailing the proposed expansion of the house contained in exhibit c of the agenda packet.

The subject property is a single family, single story house built in the late 1950s.

F

It sits more or less in the middle of a 0.45 acre lot. The.

House is approximately 30 feet from either side property line and about 75 73 feet from the rear property line.

Adjoining the subject property to the south at 831 azalea place southeast is another single family residence which is about 25 feet from the common property line, meaning that the two structures currently are about 55 feet.

Well, I want everybody that I wasn't good at the technology adjoining the property to the north at 807 azalea place southeast there's another single family structure in this photograph. You can see it as a kind of a taupe colored uh structure.

It is approximately seven or eight feet from its property line. The combined distance between the two existing structures, therefore, is about 37 38 feet.

As we said, the purpose of the request is to remove an existing two car carport, that's shown in the photograph we have up now. The carport will be replaced with a two-car garage with additional rooms behind the garage the carport has.

I think it may be visible in this picture here at the lower left-hand corner of this photograph. You can see a bit of survey flagging. It is uh when it reaches the ground. It's at the corner, pin for the property you can see by the distance of that pin from the driveway that it appears that the the driveway is within the 10 foot setback, which is no problem.

But if you look further back into the photograph you see, the existing carport may also uh be within the existing uh 10-foot setback. This is not uncommon in this part of the city. It appears that the subdivisions that were built in and around azealia place we're using a seven and a half foot setback when these houses were built, given that they were built in the 50s and 60s that obviously predates the current zoning ordinance.

This is the side yard to the north. It looks nice and broad, but it is only about 30 feet, which is the same distance on the south side. What is worth noting is that just behind the trees and shrubs to the right of this photograph is a house. That's only about seven or eight feet from the property line.

This is a survey plant that was drawn showing the existing conditions. You see the rectangular lot, the house placed more or less center on the lot location of the driveway and the carport.

As I said, the purpose of the request is to allow the addition to be within the existing 10 foot setback.

The staff's evaluation of the request, as uh as well as the applicant's response to the six criteria for compliance with a variance request, begin on page two of your agenda packet.

Within those six, I uh six uh criteria. uh You can see that there are other factors such as the um excuse me, uh such as those that I just mentioned are explained in a bit more detail. If you've got any questions about any of the staff's response to these six criteria, please let me know point out that in the exhibits to the agenda.

I have up now of the site plan. That's in exhibit c following it in the agenda. Packet are several pages of plans and elevations that describe the proposed construction of the addition to the house in detail.

There's also a plan for the existing footprint of the building, in exhibit c exhibit d, provides additional map aerial maps showing a wider view of the location of the property, the zoning of the vicinity and vicinity and a couple other details regarding the description of the general area, exhibit these several photographs, in addition to the ones that I have shown on your screens, the show a bit more detail about various aspects of the area and, as I said earlier, exhibit f, contains the comments of received from two adjoining property owners.

The owners of 818 azalea placed southeast and 830 azalea placed southeast. Both of the comments received, supported the applications request I'll, be happy to answer any questions.

In the package there's a photograph of two telephone poles and I couldn't determine what the um traffic light was. I take it it lines up with the older telephone pole and and the flag.

Of that photograph was uh to show that the flag that you just mentioned, you remember uh the uh the telephone pole on the right in that photograph has flagging. It goes down to the corner, pin that was shown in.

This this photograph that I have up now right, the photograph with the two poles with the flag in the background, shows the direction that the property line takes from that corner. Pin. Okay,.

For all intents and purposes, let's call the edge of the driveway there to the edge of the carport. How far is that off the property line right.

um So, as far as I understand it, then you're going to take down the carport as it is right now and build over to the concrete, a completed two-car garage.

Yes and then the addition behind it: yes yeah, we don't.

It's gonna be quite the project.

How far is the addition off the back property line.

That I don't know um it's it's going to actually be flush with the the back room that now protrudes a little bit. um It it'll be equal to that, so it won't get any farther than the farthest part of the back.

Okay, now it said your neighbors did not object, it was it just the one next door and across the street is that what it was or did have? You talked to all the neighbors.

I I actually went and talked to all my neighbors, and I did ask for them to send in emails or write letters. um Not all of them did some of them.

But uh well I commend you on your addition. The the existing driveway has got a little kink to it, but it looks like if I project that line. I think the question has been answered, but just for my clarification, the if you project the line of the edge of your existing concrete, paved driveway.

If you extend that on back, that will be pretty much the limit. There's.

Actually, when you look in that picture, there's a little paint can with a little pink flag, which is pretty much the straight line of the driveway, which that is where the addition is going to go to. So it is pretty much going to be the width of that driveway.

That's what that was for just to indicate where that.
