We want to welcome everyone to our february 22nd meeting with aiken city council, uh we're going to call our meeting to order at this time uh I'll open this with an invocation, and then I've asked chief paranko if he would to uh follow with the pledge. So, if you're inclined, please join me for the invocation father, we're thankful for this day.

We're thankful for this time that you've given us, we ask lord that you would be with each one of us here that you would give us wisdom as we consider the things for the betterment of our city. We ask that you would continue to bless our city protect those folks who who have had coveted may they continue to heal, protect those families. We just ask your blessings, would be them. We we want to lift up our public safety officers, at your protecting hand, would be upon them and all of our employees. Lord.

We just pray that everything that would be said and done in this meeting would be pleasing to you in your name. We ask it amen.

And chief good evening, I I'm gonna, I'm gonna, ask chief if you would lead us in the pledge and we're gonna follow along. I can tell you there's a latency issue and we all want to say it. All right, we moved to old business at this time. Item number one is approval of appointments and discussion of appointees of various city boards, commissions and committees, and with that I'll recognize our city manager uh good evening, mr bean boat.

Good evening, mayor and council, thank you, council has the following appointments for consideration. Tonight. Councilwoman brawl is recommending the appointment of catherine wade to the housing authority to fill the position of beverly cliver for a term that would run through may 28 2024.

She is all councilwoman brawl was also recommending the appointment of ginger hudoc to the senior commission to fulfill or to fill the position of karen papachotta, who resigned for a term that would expire march, 14 2023 and the reappointment of carolyn mcpherson to the general aviation commission, where they turn to expire september. 1St 2022.

Those are the appointments for consideration this evening. Thank.

You, mr fedenbaum, um at this time I did entertain a motion to approve those names to be moved forward for these commissions and boards.

If I might, um after talking with um mr keith wood, who who chairs the economic development commission for us, uh is with their recommendation- and I certainly full-heartedly support them for for the economic development commission, dr katina broadwater she's an executive at ups out at centennial park. um She also has a she started. Her own business in real estate has her own real estate company and um she she has also served us in other capacities when we called upon her and I think she'd be a real asset.

So I'd like for her name to be for consideration at our next meeting as a member to the development commission- and I can get you that information sarah tomorrow.

uh This is um this is a second reading and a public hearing of an ordinance to allow council to hold meetings through remote communication technology by title and ordinance amending chapter 2 of the aitkin city code to allow city council meetings to use remote communication technology is.

You mayor um at a special meeting on january 21st council, adopted an emergency ordinance to temporarily suspend normal operating procedures to allow for city boards commissions and council to meet electronically. At that meeting. Council members, some council members suggested that rather an emergency ordinance that we adopt a regular ordinance to be able to hold meetings using remote communication technology when needed.

The city attorney prepared an ordinance amending chapter 2 of our city code to allow remote communication technology as needed to conduct public meetings and also to allow individual council members to participate in person by using uh remote technology such as via telephone or teleconference, and this ordinance was approved at our first reading on february 8th and it is before you tonight for second and final reading.

Thank you, mr dean bell. I want to thank mr smith for his um work on on this. I think it covers a lot of things. One.

One of the questions we had was that we wanted to see an ordinance that would allow some sort of a hybrid so that, if those of us who felt comfortable coming in, we could run the meeting uh from our chambers, but others could participate, uh whether it be by phone or or zoom or, however, it might accommodate- and I I feel like this- does a good job of capturing that so so. Thank you for your efforts on on putting this together.

We're going to move down to item number 300 old businesses as a second reading and public hearing of an ordinance to amend the community development block grant budget to include revenue and expenditures for cares, act, funds by title and ordinance amending the cdbg budget of the city of aitkin for the fiscal year beginning july, 1, 2020 and ending june 30th 2021 to include cares act. Funds with that is there a motion.

All right, I saw council, I heard councilwoman diggs, who who would someone like to second that counts councilwoman price? Thank you uh comments from staff. Thank.

You, mr mayor, we do have a special allocation through the cares act. uh The federal cares act which was passed in response to the covet pandemic uh for our cdbg uh program, and this special allocation must be used to prevent, prepare for and respond to covet.

We're recommending that also that the our budget be amended for this year to include the revenue and expenditures for these funds to include 232 100, to go into our small business revolving loan program, which council passed in response to the pandemic back in april and 69 743 for our pandemic response and prevention program as intended under the act and we're also recommending that some unspent cdbg funds, after consultation with hud uh in the amount of eighty one thousand eight hundred and fifty five dollars from last year's budget fiscal year, 1920 be carried over to this year, with a budget adjustment to include uh 15 855 for demolition and 66 000 for land acquisition.

And you approve the council approved this first reading and it is before you tonight her second and final reading. Very.

How about the money that we gave out to small businesses has any of it been paid back.

Yes, uh we have had several businesses pay back uh the loans uh and I think tim, mr o'brien is present and he can speak, I think a little more definitively, but I think we we can give you council an update, uh um certainly at our next meeting. uh Whatever tim is unable to uh fulfill right now,.

I just want her voting on it to know how it's gone.

uh Yes, we've been uh through information and updates. We've uh done a couple of updates, we'll get another one from security federal we've had, I believe, uh five uh businesses that have paid the loans back in their entirety um and they are collecting pretty well. They do have two or three uh that were in arrears, but I can get an updated report based on uh current collections as of uh this month.

We're going to move to new business on our agenda item number one. This is the first ring of an ordinance amending the city code to adopt the 2020 2022 revised model business license ordinance by title, an ordinance amending chapter 12, article 2 of the aitkin city code to adopt the 2022 revised model business license ordinance of the city of aitkin, and with that I would look to counsel for a motion.

Councilwoman roll! Thank you. Is there a second high? Second, thank you. Councilwoman diggs comments from staff, mr beanbow.

Mayor we do have uh um you know we impose a business license tax based on gross receipts, that a business operates within the city limits uh the state last september. Well, the governor signed a bill that went through the general assembly last last year. He signed it in september that uh calls for a statewide due date.

F

uh Prior to this municipalities and counties had the option of selecting their own due date, and we selected our due date as being june 30th with a pay-by-date without penalty uh through july 31st, um but the law which goes into effect it can be. It goes into effect, whether we like it or not. Next year, 2022 will require a due date of april 30th and then penalties begin accruing.

F

May the first also it's required that uh the city, each jurisdiction, uh aligned with the state uh business, the the business portal, uh so a an entity only has to fill out an application. One time they don't if they do business in jurisdictions are not having multiple applications. So we need to comply with that uh we're in compliance with all the other primary elements, next codes uh and so forth. But um what we're recommending is because we have the ability this year uh to do.

This is to make continue to have a pay-by-date without penalty to be this year through july 31st, as has been for the past number of years, but new go ahead and move the due date to april the 30th, so businesses can get acclimated to the fact that there is a due date, that's earlier, because in 2022 we are going to have to adopt that that due date is going to be in effect and late fees begin accruing on may the 1st 2022.

So I think as part of education and communicating with our business owners by going ahead and making the due date april, 30th or for 2021, but still allowing folks uh business owners to pay without penalty through july 31st. Again we can help get the word out, give them sort of a years. uh One year's notice that this is coming again.

This was something that the general assembly passed and the governor's um governor signed so again, we'll be going into effect, 2022 regardless, but we have the option of putting it in effect uh a year early again what it would be due date april 30th, but you pay without penalty uh through july 31st, which is the current pay without penalty date.

F

um So this is before you tonight for first reading, we did work very closely with the municipal association. I guess we're one of their test uh municipalities to uh put to to work to to be one of the first ones um on board, uh so um we're glad to entertain any comments or questions uh about this. uh This act and uh this uh date change.

Thank you, mr bean boat. uh One thing I want to say is this: is um you know it didn't come just from general assembly or the municipal association, but uh this was actually something that was a an issue that was brought up by the state chamber of commerce.

A

It was one of it was one of their main objectives through the session to try to consolidate these uh due dates, because every municipality was setting a different date, and so, if you were a multi-jurisdiction business, where you were doing businesses in multiple municipalities, it got a bit confusing.

A

uh Now with the portal that's in place and the date being being all on those on the same schedule, a business can come in, they can check the businesses or check the municipalities where they do business at write, one check and be done with it, and they don't get a reminder two months later and have to pay a late fee somewhere that they, it was on different cycles.

A

So this was this was a situation where we worked with the board for the state chamber of commerce and, I think, came up with something that was very positive for business and and helped the cities out. So we're happy to be a part of that. Obviously, so with that, mr bland, are there any comments from from our public at public comment at city of aikensc.gov.

uh Nothing changed on this other than the due date for our ordinance, correct.

Right, it doesn't and it changes without any penalty on this first year. What what right we're doing as a city is, is actually giving our businesses um two years to adapt to the new date. That's going to be the uniform date, as opposed to just waiting till next year and putting it all on one so that they can. They can ease in and there's no penalty uh taken in within this this year.

A

So so I think it actually gives two years to prepare for that. We thought it would be the fairest way to do it. uh Being one of one of the municipalities is moving our date by a few months.

It was, it was very good to have the uh two um ordinances one with the corrected and one the clean so that we could see what the difference was and see that there was no change in classifications or anything like that. So I think that was beneficial.

And we will be again educating. I should counsel this. We will begin education uh or or informing uh business owners uh after right after first reading, uh just to let them know that the date has changed, but the pay without penalty day this year only is still july 31st.

But the state law will mandate that the due date is april 30th to pay without penalty. In beginning 2022, late charges will uh late through again state requirement.

I just like to say every time I see one of these. I keep thinking we're getting people annexing in the city. I think it's something we need to look hard at decide a better way for people to do it, making it easier making it easier for them to come in the city, hook up the sewer and do stuff.

um I don't know if that's a planning commission thing or what, but we need to get that process started.

I think we would start with the planning department- and I know, there's a procedure for sta in state code, for how property is annexed. So we would need to make sure that we're compliant with the annexation processes uh in state code. But, yes, um I I think it would start with the planning department.

um We can look that he and I can begin that conversation this week to see what we could do to streamline and pick that up.

um A couple things this is andrea. um I know at one point I had asked about properties in the city that are that we can pinpoint that are already near or at the connection points, um because I think to councilman wolte's point. You know those would be properties that we can easily or somehow get them annexed into the city without a huge expense. One and two I'm not mistaken ryan. Wasn't this a topic in the last or the previous planning commission meeting to look at these new potential annexation properties.

Yes, mr mayor, so at the past I want to say probably four or so planning commission work sessions, um particularly following the the city council planning, commission action agenda meeting last fall. We have been updating the commission and going through in some detail the current annexation policies, as well as costs to connect cities, charges for and fees for connection, um just kind of some of the logistical issues where, where water and sewer are located, so we have been going through um some of those things to get.

The commission, familiarized and they've asked staff to work to come up with some recommendations for them to potentially consider as a result of some of those conversations. So I think we will be moving that forward to them, so they can make a recommendation to you at some point in the near future.

That sounds terrific, mr bland.

I think I think we used to have that. We guarantee three years, you'd be net neutral on your taxes and for some reason we stopped that.

That stopped about uh 20 years ago, I believe I've.

Been around a long time.

And you know those are in effect they run with the property. uh I think in most cases in continuity, because occasionally we'll get an annexation and we'll have to uh we'll have to send a check to the new owner. It could be. You know three owners that.

And then some was held back until it came into the city.

Thank you good comments. I think I think there's an interest from this council. That's to maybe revisit some of those uh I'd say incentives, but also just business practices that that make it more open and friendly to coming to the city.

uh Moving down to item number four under new business. This is a first ring of an ordinance amending the fy 2021 budget for purchase of a compactor for the downtown by title and ordinance amending the budget of the city of aitkin or for the fiscal year, beginning july, 1, 2020 and ending june 30th 2021 for purchase of compactor for the downtown.

uh With that, I would look the council for a motion promotion for our provost mayor. Thank you, uh councilman price! Is there a second hi? Second, all right, councilwoman, councilwoman brawler, it's all over the house. I know uh council on parole um second and comments from staff. Mr biedenbaum.

Thank you so much um we have provided uh there is garbage uh for downtown, uh primarily this area, that the alley is sort of the hub point for, um and it's uh almost exclusively used by the restaurants uh in the downtown and the location.

F

Will no longer be available to us in the very near future. This came up suddenly, um as property is being transferred uh middle of next month and they are working with us to ease that transition. But, however, the dumpsters that are located behind the building that houses uh several contractors on uh a sushi place and the ada etc.

F

Because of that sales transfer, we need to find a new location. uh There are not a lot of locations dumpsters in the downtown, so we're recommending a compactor that would be located on property. The city currently owns it's. It was prepped for a compactor sometime back, but then we delayed that due to some other issues, we were addressing with that property.

F

So now that this is before us, um our public services director who's in charge of solid waste, alex kirkland price uh kind of the best approach here and, and he uh between.

Installation and purchase is recommending a 47 000 expense that will require a budget adjustment um in our hospitality tax fund to install a compactor. There is a four to six week. uh Excuse me, a minimum four weeks perhaps longer lead time on it, so we did want to move quickly based on comments and um uh and direction from council.

Recently we're bringing this to you for consideration.

We'll move down to petitions and requests I'm number one: this is approval of capital project sales, tax, three funds for valve and hydra replacement, um I'm going to recognize staff first before I take the motion so that he can talk. So mr b can tell us a little bit about this project. First.

You we do have money uh a little bit of money left in capital project sales tax. Three, it's cash on hand for this uh staff will be performing upgrade valves and doing some hydrant replacement, along with water line replacements in several areas, abbeville avenue from sumter to marion burgundy, road between dibble and comedy and looping, a water line from ligon to perrin and allison street to hampton avenue, along with a valve replacement on pipeline road price. These jobs and estimate the cost to be 143 593, which is a good granular to the dollar estimate.

And we, since it is cp capital project sales, tax funding, needs to come to council and the cash is on hand. We just need uh we request council's consideration and approval of this.

Only again, we will be sending an email out after at the conclusion of our work session uh just uh 45 minutes ago, I've uh brought up the availability of uh some amdc chairman and others to participate in our next round of new horizons.

So we're going to send out in writing, which I believe is march, the 3rd 5 o'clock, uh to have the the next session of new horizons. uh We there's a there's a chance. We may have to have an executive session about a time, sensitive issue. uh I will know more about that later this um later this week, uh but we will go ahead and get the agenda out for you by wednesday. So you'll have a good week to review everything again, but otherwise I have no other items at this time. Mr mayor.

Very good, very good. Well, thank you. um You know, I want to say a special thank you to our staff. I know these uh doing. Meetings that I uh zoom and over the internet sometimes create uh some unexpected difficulties.

I think uh they did a great job of pulling it together today, and I really appreciate their efforts and uh and in keeping council as well as staff, all put together for a coherent meeting where we were able to take care of the business of our people who we represent, so thank a special, especially a special thanks to uh gary meadows and the staff, who did a great job of getting it together for us yeah. So, with with that, I would look for a motion to adjourn.
