B) Application CERD23- 001003: Applicant John Outten with Aiken Properties, LLC
requests approval for the construction of a new dwelling on Lot # 2 on Charleston St.
SE ( TMP 121- 11- 12- 011).
C) Application CERD23- 001004: Applicant John Outten with Aiken Properties, LLC
requests approval for the construction of a new dwelling on Lot # 3 on Charleston St.
SE ( TMP 121- 11- 12- 012).
D) Executive Session: purpose is to receive legal advice relating to a pending,
threatened, or potential claim or litigation or other matters covered by the attorney -
client privilege from DRB Attorneys. ( Must be authorized by a motion and vote of the
Board.)

speak
in
favor
or
against
applications
after
after
the
applicant
speaks,
and
we
have
a
five-minute
limit.
I
believe
on
each
one
of
those
we'll
have
the

speaking

giving

name
and
address
if
you,

come
to
speak
publicly,
if
you
wish
to
ask
questions
of
the
applicant,
that
would

the
time
for
you
to
do

demolition

the

future
plans
for
that
corner.

don't
see
anyone
speaking
either
way.
Anyone

to
speak
in
opposition
to
demolition
of
this.

Here

I
would
like
to
at
least
address
some
issues
about
procedure,
because
we've
tried
to
talk
about
procedure
with
this
board
in
the
past
and
we've
more
or
less
been
shut
down,
which
I
don't
think
serves
the
board
or
serves
the
citizens.
Well,
so
I'd
like
to
without
belaboring
it
put
that
on
the
agenda
for
some
time,
which
I
thought
we
had
an
agreement
that
we
were
going
to
get
it
on
the
agenda
at
some
point,
so
we
don't
have
to
bore
everybody
else
with
it.
People
can
come
to
that.

There's
no
way
a
citizen
would
know
from
the
yellow
agenda
that
this
project
was
going
to
be
discussed
in
the
work
session
and
that
violates
foia
laws,
because
you
are
making
a
consideration
of
an
application
and
a
work
session
without
disclosing
it.
So
there's
things
like
that,
I'm
not
trying
to
make
an
issue
of
it
here
at
all
things
like
that
that
I
think
one
would
benefit
from
dialogue
on
these
issues
and
it
would
make
it
clearer
for
citizens
when
they
want
to
come
to
a
meeting
to
see.

What's
going
on
when
they
don't
want
to
come
to
a
meeting,
the
whole
issue
of
pre-application
conferences
is
also
confusing.
The
ordinance
says:
pre-act
pre-application
conferences
are
for
procedures
and
regulations,
reviewing
what
you
need
to
do
in
the
process,
and
it
seems
in
the
past.
Pre-Application
conferences
have
been
used
to
review
projects
which
those
two
things
aren't
consistent.
Would
you.

this
case,
I
think
the
applications
were
presented,
but
they
weren't
listed
in
the
agenda.
So
it
looks
like,
for
example,
these
projects
that
the
current
one
is
part
of
a
formal
application,
but
there's
no
disclosure
in
the
yellow
agenda
that
that
project
is
going
to
be
discussed
in
that
work
session.
So
it's
just
confusing
for
people
to
follow,
and
then,
when
we
get
into
contentious
issues,
there's
nothing
intentions
about
this
one.
So
there's
no
reason.
There's
no
reason
to
make
an
issue
of
it.
It's
more
about.

trying
to
be
brief,
having
a
discussion
about
procedures
so
that
we
can
at
least
agree
if
we
have
good
procedures,
we'll
have
better
outcomes,
and
you
won't
have
people
angry
at
you
in
the
process,

I
think
it's
also
fairer
for
the
citizens,
because
they
know
when
they
come
here.
What
the
procedures
are
that
they
will
be
followed
and
that
people
who
want
to
comment
will
know
exactly
what's
going
on
at
these
meetings
and
then
we
can
look
at
it.

commend
the
board
for

training
session
that
you
had
recently.

went
to
it.
It
was
very
educational
for
me,
I
seems,
like
you've
got
a
good
resource
there.
That
I
think,
would
be
very
helpful
to
the
board

conducting
this
business

forward

especially
in
following
procedures.

commend

board
today.

suggestions
that
were
made
in
that
meeting-
and
you
know
from

point
of
view
of
citizens-
citizens
looking
at
it-
I'm
sure
you're,
tired
of
hearing
me
and
there's
nothing.

be
able
to
stay
home
and
have
a
drink
instead
of
having
to
come
to
these
meetings,
you
don't
have
to
come.

know
I
do
have
to
come.

great

mainly

we
need

do

cohesive

get
back

more
civil
discussion

concrete

prospect

but
disappointed
in
the
procedure,
because
I
think
the
issue
that
was
raised
as
an
example
should
be
decided
by
the
guidelines.
We
either
have
guidelines
that
the
sighting
should
be
conforming
on
three
sides
or
on
four
sides
or
in
some
fashion,
or
we
don't,
and
it's
according
to
the
ins,
the
training
that
was
provided
on
the
in
the
recent
meeting.

point
is
not
to
exercise
the
board's
preference
on
the
property
rights
of
the
citizens,
but
it's
to
determine
whether
what
the
citizen
is
proposing
follows
the
guidelines
which
the
citizen
has
available
and
can
look
at
and
then
see.

fair
with

because
the
issue
they
raised
was

failed
to
follow
a
guideline
that
I
should
have

The
citizens
voted
for
those
guidelines

for

people
who
put
together

like

change

board's
duty

follow

those
guidelines
not
based

personal

look
at

precedents
that
review
boards
use
the
review
boards

authorized
by.
You

ordinances

say
what
review
boards
can
and
shouldn't
do.
But

one
thing
that's
clear
is
the
ordinances
and
the
proper
practice
say.
The
review
board
should
follow
guidelines
because
it
is
the
reward
is
not
there
to
impose
its
preferences.

can
speak
to
their
preferences.
The
review
board
is
there
to
determine
whether
what
the
citizen
has
proposed
follows
guidelines
or
not,
and
I
think
that
would
make
everybody
more
comfortable
with
this
process,
because
I
think
it's
better
for

then
they
can't
contest
it.
They
can't
argue
that
you
treated
them
unfairly
and
it's
better
for
the
citizens
who
are
sitting
in
the
audience,
because
we
then
see.

I
stood
up
in

other
building

support

application

mcgee,
who
happens,
coincidentally,

not
because
he's
here
that
I'm
saying
this,

a
very
similar
house,
similar
size,
similar
location.
There
was,
you
know,
a
significant
discussion
about
putting
a
chimney
back
on
the
house
that
didn't
have
a
chimney.
There's
no
discussion
of
that
here.

people
aren't
treated
with
consistency,
they
might
feel
like
they're
being
unfairly
treated
by
the
board,
whereas
if
the
board-
and
I'm
not
saying
I'm
perfect
or
that
the
board
is
always
going
to
be
perfect,
we're
all
human
and
we
do
what
we
can.
So
I
respect
that,
but
it
illustrates
how
consistency
is
important.
Here's
a
person
sitting
watching
a
building
get
approved
with
no
discussion
about
putting
a
chimney
when
there's
no
chimney
in
the
house
and
he's
building
a
building
that
he
was
sort
of
bedeviled
about
the
chimneys
and
what
he
had
to
do.

there
was
