Description
Board Of Zoning Appeals May 12, 2020
A
A
A
A
A
Okay,
I'm
going
to
read
the
board
procedure.
The
board
operates
according
to
the
following
procedure.
The
chair
will
name
and
describe
the
case
that
the
Zoning
Administrator
or
the
secretary
will
state
the
basis
of
the
objection
and
any
applicable
facts
or
conditions
pertaining
to
the
case.
The
appellant
or
the
representative
will
give
reason
why
the
appeal
should
be
viewed
favorably
if
he
can't
fix
the
audio
baby
weekend.
A
Anyone
wishing
to
speak
in
favor
of
the
request
will
be
heard.
Anyone
wishing
to
speak
in
general
commentary
will
be
heard,
and,
finally,
anyone
wishing
to
speak
in
opposition
will
be
heard
if
necessary.
The
appellant
or
the
representative
will
offer
concluding
summary
or
rebuttal
remarks
and
testimony
from
the
floor
shall
be
closed
and
the
board
will
deliberate
and
render
a
decision.
A
A
There
are
six
criterias
that
we
will
consider
for
making
our
decisions.
I
am
NOT
going
to
read
them
now,
because
I
will
be
reading
them
again
when
we
go
through
the
findings.
So
with
that
any
person,
resident
or
officer
department
or
appointed
body
of
the
city
of
Adam's
aggrieved
by
a
decision
of
the
board
may
petition
the
Athens
County
Court
of
Common
Pleas.
A
A
A
A
Mr.
Aschenbach,
or
if
the,
if
the
property
that
three
spaces
that
they
are,
let
me
just
read
there.
First
of
all,
the
appellant
appellant
is
requesting
a
variance
from
a
c

tree
requirements
to
allow
a
business
use
with
one
on-site
parking
space
and
three
off-site
least
parking
spaces
within
250
feet
of
the
lot.
A
A
C
The
alley
goes
all
the
way
up
the
right
side
of
the
property
beyond
so
the
only
area
they
have
is
that
garage
which
counts
as
the
one
on-site
space,
and
the
only
other
thing
I
want
to
say
is
that
the
parking
lot
that
they're
talking
about
which
you
would
is
across
Alexandra
and
I,
guess
you'd
call
Tulare
Konrath
Realty
parking
lot
is
under
250
feet,
it's
about
200
feet.
That's
all
I
have
to
say
about
that,
and.
A
We
have
a
letter
from
mr.
Don
lender
in
the
files
is
sending
to
mr.
Justin
Reynolds
and
in
saying
that
he
confirms
that
it
would
be
agreeable
to
least
a
minimum
of
3
parking
spaces,
which
is
at
his
property
at
280
East.
The
status
treat
for
his
use
and
he's
also
saying
that
this
is
not
gonna
change,
anything
for
his
property.
He
has
additional
extra
parking
spaces
that
he
can
share
and
then,
with
that
we're
gonna
call
on
the
appellant
to
state
your
name.
Your
address
for
the
records
and
also
your
case.

Dear

I
am

as

as
their

I
believe
mr.

and

will
be
a
positive
addition
to
the
progressive
commercial

You

J
J
They
were
about
half
full
when
I
was
just
there
earlier
this
evening.
So
I
think
that
that
may
be
an
option
for
occasionally
maybe
at
least
some
folks
to
use
the
street
parking.
There
I
noticed
that
every
house
along
the
street
has
its
own
driveway.
So
it's
not
like
any
of
them.
Don't
have
a
driveway
and
half
the
park
in
the
street,
so
it
seems
as
though
that's
also
an
option.
If
they
have,
you
know
a
busy
day,
there's
also
some
on
street
parking
that
could
be
used.
B

That
we

Whereas
for

A
Obviously,
there
is
some
exceptional
circumstances,
with
the
with
the
topology
of
the
property
I
believe
that
is
not
going
to
be
able
to
add
more
parking
spaces,
so
that
also
will
create
practical
difficulty
and
undue
hardship
because
of
what
we
just
stated:
exceptional
circumstances
or
extraordinary
circumstances
or
conditions
pertaining
to
a
specific
piece
of
property.
The
literal
enforcement
of
these
regulations
will
result
in
practical
difficulty
or
on
the
you
hardship
that
is
unnecessary
to
the
achievement
of
the
public
purposes.
Please
comment
if
you
have
anything
I'm
going
to
add
that's.

I

B
A
A
Mr.
Aschenbach
were
I
recall:
there
was
a
business
out
there,
maybe
last
year,
so
I
believe
he
used
to
call
mother
earth
and
they
had
the
same
issue.
They
had
the
same
hardship
and
they
would
every
day
they
put
a
sign
right
by
where
this
sign
is
proposed
and
they
had
to
take
it
in
every
night.
I
don't
know
if
he
granted
them
a
permission
or
they
were
doing
it
on
their
own,
but
I,
that's
I.
Remember:
there's
been
a
hardship
for
that
piece
of
property
for
not
having
a
sign
or
be
visible.
C
A
H
Okay,
hello,
Kelly,
Sauber
I
live
at
84
second
Street
here
on
the
west
side,
Paul.
Basically,
you
just
said
it
quite
stutely
we
built
well.
We
took
over
the
old
Athens
electric
motors
this
building
we
are
at
237
West,
8th,
Street
addressed
our
only
access
is
from
Schaefer
Street
directly
between
Cavallino
and
Oh.
You
comment.
H
We.
We
have
an
easement
for
ingress
and
egress
on
Schaffer
Street.
We
also
acquired
an
easement
from
oh.
You
comment
who
quite
graciously
granted
us
an
easement
to
allow
us
to
put
a
sign
I'm
right
at
the
intersection
of
our
property
in
Schaefer
Street,
since
we
have
no
other
access
from
any
other
Road.
So
that's
pretty
much
where
we're
at
okay.
A
H
A
A
A
J
H
F
H
A
K
A
As
the
exceptional
circumstances,
I
think
this
would
be
an
example.
A
good
example
of
what's
exceptional
circumstances
means
because
this
property
is
not
really
visible
from
the
main
two
roads,
and
you
really
need
a
sign
and
I'm
not
suggesting
anything.
But
if
it
was
me,
I
would
have
put
an
arrow
also
in
there
to
show
that
what
the
business
is
going.
A
And
that
also
has
will
create
tall
difficulty
in
order
to
get
people's
attention
to
the
business
of
those
preservation
of
equal
property
rights.
I
believe
I,
that
there
is
a
similar
sign
at
the
other
side
on
the
corner,
and
so
others
are
having
signs
in
that
neighborhood
and
then
so.
We
are
not
violating
any
equal
rights
in
here
do
be.

A
Also
have
three
letters
that
mr.
Gary
Rothwell
sent
to
three
neighbors
and
requesting
that
if
this
project
was
okay
with
them
and
then
they
agreed,
they
signed
the

A
misdirection,

I
can
read
the
names.
If
you
could
police
read
those
three
names,
one
was
the
Demetrius

that
one
I
could
read
the
other
ones,
I'm,
not
sure.
So,
if
you
have
a
more,
if
somebody
else
has
it
handy,
they
can
read
the
names
yo.
C

A
L
L
Most
well,
the
only
one
that's
lived.
There
was
my
son
and
then
he
moved
out.
We
currently
rent
up
to
two
people.
Then
only
one
of
them
has
a
car
and
it's
there
is
off
street
parking
there,
but
it's
it's
not
always
a
very
place
to
park,
because
I
don't
like
parking
there,
but
the
parking
spot
that
we've
been
provided
is
actually
just
borders,
our
property,
because
the
property
line
has
a
five-foot.
L
A
Okay,
I
just
want
to
clarify
something
that
what
we
are
hearing
tonight
is
that
you're
gonna
have
two
oxide
parking
and
one
off-site,
but
when
I
was
reading
your
statement,
it
sounded
to
me
and
I
could
be
mistaken-
that
it
says
that
you
are.
You
have
two
on-site
parking
and
you
would
be
able
to
provide
a
third
one
if
so
needed.
A
A
L
I
I've
been
in
conversation
with
Dwayne
we're
friends
and
we
help
each
other
out
with
their
properties,
and
he
has
an
extra
space
available
he's
in
the
process
of
renovating
one
of
his
now,
which
my
son
has
done
a
lot
of
work
on
that,
but
he
put
in
extra
spaces
there
I
don't
know
he.
He
has
two
different
houses
and
there
is
an
extra
space
can
see.
Lucy
I
believe
it
was
Brian
to
Luke
I,
believe
that
was
his
name
told
he
looked
at
it
and
he
had
some
extra
space
he's
agreed
to.
L
A
C
L
We
wasn't
really
exchanging
money
for
this
space.
It's
just
I
can
get
a
letter,
verifying
that
that
spaces
is
for
me
and
I
have
no
problem
providing
if
something
if
he
would
sell
down
the
road
and
the
another
owner
would
say.
Well,
we
can't
do
that
and
when
I
could
lease
us
I
don't
have
a
problem
lease
in
this
place.
One
of
the
other
two
options.
A
A
C
B
J
C
I,
you
know
it's
I,
in
my
opinion,
it's
enough
of
a
difference
in
the
variance
requests
that
it
would
have
to
be
re
advertised.
I
think
we
have
to
give
people
the
right.
People
might
have
a
differing
opinion.
They
might
not
mind
him
having
a
third
off-site
space,
but
they
might
be
against
him
not
having
to
provide
a
third
space
at
all
I
think
we
would
have
to
advertise
it
again.
You
know,
and
here's
the
case
again
based
on
that
request.
Okay,
understood.
J
You
know
I'm
not
a
big
fan
of
parking
requirements,
they
jack
up
the
prices
of
the
cost
of
rental
properties,
especially
when
there's
so
many
students
that
don't
have
cars.
It's
really
not
a
necessary
requirement
for
many
renters
in
the
city
and
so
I
think
it's
an
onerous
requirement,
and
in
this
case
there
are
many
parking
spaces
on
the
street
right
in
front
of
the
house.
If
those
aren't
for
somebody
to
park
there,
what
are
they
for
so
I
think
the
requirement
is
really
not
that
important
here,
but.
L
I
didn't
know
that
was
an
option
so,
but
I
don't
have
a
problem
like
what
it's
a
it's
a
very
nice
not
to
punch
my
own
ticket
here,
but
we
we
did
extensively
completely.
We
did
this
and
it's
exceptionally
nice
house
and
if
sometime
in
the
future,
is
Sun
button,
why
I
really
don't
want
to
rent
to
three
different
people
right,
I'm,
not
I'm,
more
concerned
with
keeping
the
place
decent
instead
of
and
I've
been
very
fortunate.
I've
got
a
girl
or
boyfriend
in
there
right
now
and
it's
it's.
L
L
B
A
G
A
A
I
Property
today
with
my
son,
that
house
is
beautiful.
Compare
that
now
compared
to
the
neighbors
I,
think
you
really
did
a
great
job
on
it
and
that
third
parking
spot
is
literally
it
almost
on
his
property.
So
I
think
it's
the
perfect
situation
for
them,
and
it's
nice
to
see
houses
like
that
go
up
in
the
roads.
Okay,.
A
Is
that
John
yeah
yeah,
okay,
okay,
okay,
very
good!
A
D
A
F
I,
don't
know
I,
think
I'm,
just
thinking
in
terms
of
minimum
variance
that
this
seems
like
a
reasonable
requirement
on
his
part
and
I
think
yeah.
As
far
as
I'm
concerned.
It
would
cause
practical
difficulties
if
we
weren't
to
grant
the
variance
given
that
he's
able
to
accommodate
a
third
tenant
so
easily.
A
K
A
L
L
A
We
have
just
one
minor
thing
to
this:
take
care
of
a
disposition
of
the
minutes
from
March
10,
2009
teen.
That
was
a
long
time
ago.
I
didn't
see
anything
at
the
time
and
I
don't
recall
if
there
was
a
words
or
something
that
I
say
to
you,
mr.
Barker,
or
maybe
that
was
the
one
before
that.
But
I
was
good
with
it.
Anybody
else.
A
F
A
Aaron
second
and
I'm,
just
gonna
call
everybody
am
I
gonna
mention
name,
sir.
All
those
who
approve
the
minutes
off,
March,
10,
2020,
say
aye
all
opposed.
Oh,
you
didn't
hear
anyone.
So
the
motion
carries
I,
don't
know.
I
I
only
had
a
hammer
or
so
okay
folks,
this
was
fun
and
then
maybe
we'll
do
it
again.
So
maybe
next
time.
