Athens
City
Council,
it's
Monday
March
16th
at
7:03
p.m.
we
are
having
two
items
tonight,
one
the
first
of
which
is
a
public
hearing
for
our
Community
Development
Block
Grant
programs
and
we'll
be
doing
that
public
hearing,
followed
by
a
regular
business
session.
Our
format
is
slightly
different
tonight
for
both
the
public
hearing
and
the
business
meeting.
We
do
have
some
information
about.
A
Why
we're
in
this
different
format,
number
one?
The
camera
appearance
for
people
who
are
watching
by
TV
will
be
slightly
different
because
we
have
spread
the
council
members
out
around
and
our
Clerk
of
Council
and
the
mayor
throughout
the
council
chambers
so
that
we're
keeping
a
distance.
Likewise,
we
have
some
members
of
the
general
public
who
have
joined
us
and
they've
been
very
gracious
and
distancing
themselves
also,
and
then
we
have
our
other
council
members.
Three
of
our
council
members
are
joining
us
from
home
tonight.

Council
members
grace
Reisner
and
Smedley,
and
we
welcome
their
participation.
I
think
in
light
of
these
circumstances,
for
how
we'll
be
conducting
the
meeting
I'm
going
to
read
a
message
from
our
law
director
so
that
you're,
aware
of
what's
going
to
be
happening
at
least
immediately
after
the
public
hearing
and
for
purposes
of
voting
on
March
13th
attorney
general
Davio's
issued
a
letter
to
local
officials
regarding
the
applicability
of
the
Ohio
Open
Meetings
Act
during
this
time
of
a
cove
at
19
declared
emergency.
A
In
that
letter,
the
Attorney
General
Yoast
stated
in
this
limited
circumstance
where
the
governor
has
declared
a
state
of
emergency,
and
the
director
of
the
Ohio
Department
of
Health
is
limiting
gatherings
so
as
to
prevent
the
spread
of
the
cove
at
19.
But
the
business
of
government
must
continue
it's
reasonable
to
read
the
Ohio
meanness
associations
quote
in
person
in
quote
requirement,
as
permitting
a
member
of
a
public
body
to
appear
at
a
public
meeting
via
teleconference.

This
interpretation
gives
effect
to
both
Revised
Code
121
point
2

and
revised
code,
3
701
point
1
3.
It's
also
consistent
with
the
United
States
Centers
for
Disease
Control
recent
guidance
issued
in
response
to
the
National
kovat
19
epidemic
to
use
video
conferencing
for
meetings
when
possible.
Of
course,
if
a
member
of
a
public
body
chooses
to
appear
via
teleconference
or
telephone,
it's
imperative
that
all
other
requirements
of
the
admissible
Association
be
fulfilled.
A
quorum
must
still
be
present,
whether
in
person
on
the
phone
or
in
some
combination
thereof.
A
In
the
event
that
a
member
apeiron
telephonically
is
cut
off,
the
public
body
should
cease
all
discussions
and
deliberations
until
the
member
can
be
reconnected.
Based
upon
that
letter,
Cydia
counselor
arranged
for
three
members
to
join
tonight's
meeting
by
Xoom
late.
This
afternoon,
law
directors
were
invited
to
join
in
a
telephone
conference
call
with
attorney
general
Yost.
There
was
discussion
as
to
the
validity
of
Attorney
General
u.s.
A
letter
due
to
a
92009
attorney
general
opinion
attorney
general
Yeo
stated
that
he
did
not
believe
there
would
be
a
court
in
the
state
that
would
find
a
violation
under
the
circumstances.
Attorney
General
Yoast
also
stated
the
AG's
office
would
join
in
with
an
amicus
brief.
If
sued,
the
law
directors
asked
attorney
general
Yost
to
petition
the
governor
for
a
governor's
order
to
cover
these
extenuating
circumstances.

Attorney
general
Yost
also
stated
that
there
may
be
a
legislative
fix,
but
the
legislature
is
not
in
session
in
an
abundance
of
caution
and
the
spirit
of
the
Open
Meetings
Act,
the
three
council
members
attending
bazoom
will
not
vote.
There
are
four
members
present
and
a
quorum.
The
rules
may
not
be
suspended
tonight.

So
as
barring
primarily
for
our
business
meeting,
but
also
to
let
the
rest
of
the
public
know
that
our
other
council
members
are
here,
they're
there
attending
via
teleconference,
they
will
appear
on
our
screen
in
the
chambers
if
they
were
to
make
a
comment
during
the
council
meeting.
So
we'll
be
aware
of
that
and
I'll
try
and
identify
who's
who's
speaking.
So
we
know,
what's
going
on
so
we'll
proceed,
then,
with
the
the
public
hearing
for
our
Community
Development
Block
Grant
funds.

First
last
week,
committee
meeting
we
did
describe
several
of
the
funds
that
were
possibilities
for
us
to
seek
as
a
city.
One
of
these
is
what's
called
allocation
funds,
and
we
had
several
possibilities
to
be
for
consideration,
one
of
these
being
the
College
Street
accessibility
improvements,
another
one,
the
West
Side's
accessibility
improvements,
and
then
there
had
been
some
other
suggestions
for
sanitary
lining
of
the
sewers
and
water
system.
Improvements
in
Eliot's,
ville
and
in
possible
sidewalk
installation
on
Madison
and
of
these
I
do
believe
that
the
the
one
that's
being
recommended
is
the
this.

Thank

for
clarifying
that.
So
that's
that's
a
one
suggestion
at
this
point
that
we
were
strongly
considering
the
other
grant
the
programs
that
we
talked
about
last
night.
Another
last
week.
Excuse
me
another
one
was
the
residential
public
infrastructure
program
and
of
these
we
were
thinking
the
armitage
well-filled
and
that
we
were
holding
until
2022
to
submit
on
that.
The
question
at
last
week's
council
me
committee
meeting
was
why
are
we
holding
we've
since
received
information
from
Jessica
a
dine
and
robert
heady
that
it
there
several
requirements
that
we
need
to
meet?

One
of
them
would
be
an
Ohio
EPA
permit
we'd
have
to
define
the
project
we'd
have
to
designate
as
design
firm.
We'd
have
to
have
a
survey
of
the
site.
We'd
have
to
inspect
the
well
towers
us
and
the
salt
storage
areas,
and
also
the
riverbank
area,
and
given
all
these
things,
it
wasn't
going
to
be
practical
for
us
to
try
and
get
this
already,
probably
impossible
to
get
it
ready
before
the
deadline.

Let
me
speak
to
that.
Yes,
please,
the
critical
infrastructure
grant.
We
have
found
to
be
very
difficult
one,
it's
a
very
competitive
grant,
but
to
the
amount
that
we're
eligible
for
it's
almost,
not
cost-effective
for
us
to
apply
for
it.
When
you
look
at
the
personnel
hours
that
go
into
the
reporting,
the
tracking-
and
we
also
been
working
with
Capcom-
came
to
the
realization
that
the
water,
the
dewatering,
may
not
even
qualify.
We
have
applied
twice
before,
not
three
times
under
curricula,
the
structure
for
funding
or
the
dewatering
equipment.

were
denied
each
time,
even
though
we
thought
we
were
on
track
to
make
the
change
it's
necessary
to
go
ahead
and
reapply,
but
in
further
exploration
exploration
of
that
with
Glenn
Crippen
at
HAP
cap,
he
has
advised
us
to
not
go
after
that
again
for
the
dewatering,
because
he
didn't
say
it
will
see
a
way
in
which
it
would
fit
under
that
granting
mechanism.

there

other
council

about
these
possibilities
for
funding.
Primarily,
we
had
several
choices
possible
for
the
allocation
funds,
but
West
Washington
is

one
that's
being
most
strongly
recommended,
so
I'd
like
to
get
a
feedback
from
council
members
here
present
also
the
council
members
who
are
joining
us
via
the
teleconference
and
then
we'll
also
invite
public
members
if
they
would
want
to
comment
about
this
council
member
Clodfelter.

difficult
to
anyone

would
just
ask
that
I'm
familiar
with
the
West
Washington
project
if
the
mayor
hasn't
already
elaborated
and
what
that
would
consist
of.
I'd
encourage
him
to
share

I
wouldn't
be
very
much
and
supportive,
seeing
that
project
funded
through
this
program.

look
at
the
allocation
program,
the
crosswalk
improvements
at
Schaefer
in
West
Washington,
which
is
also
one
of
the
items
on
here,
sidewalk
improvements
which
are
really
needed
on
that
that
particular
corridor
we're
currently
going
to
be
working
with
a
splint
to
do
some
significant
shrub
and
tree
trimming
in
that
area,
which
is
another
piece
of
this.
But
for
this
this
particular
mechanism
for
allocation,
sidewalk
improvements
and
lighting
improvements,
and
that
caused
our
evercroft
watt.

the
possibility
for

grant
funding
the

also
offer
to
the
viewing

That
email
is
available

our
city
website

comment

a

Street
Athens
Ohio,

we
will
accept
those
those
comments.

also
be
having
a
second
hearing
in
April
on
April
16th,
and
that
will
be
another
opportunity
by
having
this
public
hearing
tonight.
What
this
offers
is
our
ability
to
move
forward
with
at
least
the
first
reading
that
authorizes
the
city
to
be
able
to
apply
for
these
funds,
and
we
thought
that
that
was
important.
We
don't
want
to
miss
the
opportunity
to
bring
grant
dollars
possibly
into
the
community.
So
that's
why
we're
moving
forward?

receive
one
critical

structure,
grant.
That
was
for
the
Depot
Street
lift
station,
which
you
may
remember
that
was
2014.
As
I
said:
2013
allocation,
the
our
house
on
Richland
Avenue
next
station
fire
station
$75,000
and
then
2012
allocations,
the
Columbus
road,
/,
Lancaster,
Street
rehab,
and
that
was
$85,000
I,
believe
that
was
Oh
maven
sidewalks
$85,000,
though
sidewalks.

we'll

our

that

election,

primary
election
is
tomorrow.

early
voting
up

afternoon.
We
have
also
received
notice
there
that
it's
been
that
it's
been
postponed
to
June
2nd.
So
we
do
have
that
extension.

are
substantial
and
we're
glad
to
have
this
report,
and
so
we
have
a
copy
available
of
that
report

the
council
chambers
that
if
anybody
would
like
to
take
a
look
at
that

thanks

the
fire
chief
thanks

all

fire
persons
who
are
responding
amidst
all
of
this,

other

several
constituents

call
me

time

contact
I'm
concerned
about
evictions
during
this
time
of
coronavirus
and
so
I
think
I
think
that's
a
logical
and
legitimate
place
to
look
at,
especially
with
the
closing
of
the
dorms
and
all
the
other
things
that
are
going
on,
and
the
various
social
distancing
looking
at
making
sure
that
people
aren't
evicted
from
their
homes
before
these
sort
of
things
move
forward.
So
that
was
a
concern
about
it.

mention
that
the
primary
election
has
been
postponed,
and
just
so
everybody's
clear
that
means
polls
will
not
be
open
tomorrow,
you
don't
need
to
go
if
they
don't
beat
you
the
second.
We
just
got
this
information
at

minute,

everyone
else
in
the
state,
and
so
you
know,
we
regret
the
confusion,
but
it
will
not
be
happening
tomorrow.

would
also
like

thank
all
of
our
health
care
workers
and
first
responders,
who
are
being
really
brave
right
now,
and
we
thank
them
for
going
to
work
and
be
willing
to
help
people
who
do
in
fact
get
coronavirus,
but
hopefully
with
so
many
closings
of
events
and
the
sadly
the
restaurants
and
bars
as
well.
Hopefully,
our
community
is
going
to
stay
safe
and
I
really
appreciate
everyone.

just
going
to
be
a
lot
of
unemployed
people
right
now
and
the
competition
to
get
other
jobs.
It's
going
to
be
fierce,
so
I
don't
know
if
any
of
them
would
actually
want
to
do
that.
But
it's
just
a
thought,
because
I
think
we
may
need
to
find
ways
to
help
some
of
those
people
and
I'm
delighted
that
the
city
is
not
going
to
be
shutting
down
their
water
accounts
or
their
electricity
counts
and
preventing
evictions.
I
think
that's
very,
very
kind
and
good
and.

other
thing
I
want
to
let
business
owners
know,
is
to
look
to
the
state
right
now.
The
rules
on
unemployment
claiming
unemployment
has
changed,
and
so
we
want
to
look
to
that
because
some
of
the
some
of
the
parameters
have
been
dropped
in
order
to
to
claim
unemployment
and
then
for
the
business
owners
themselves.
There
are
also
small
business
loans
at
low
interest
rates
to
kind
of
help
lessen
some
of
the
impacts
that
all
of
them
are
going
to
experience
here.

we

the

I've
heard
a
comment
too

What

can
share
with
you
is
that
councilmember
fall
and
I
saw
mayor
Paterson
nodding
his
head
and
agreement
that
we
that
utility
bills
people
are
people
are
not
going
to
be
shut
off
with
from
their
utilities.

that's
number

two:
the
community
center
effective
9
p.m.
tonight,
which
is
the
end
of
business.
The
community
center
will
be
closed.
Last
week
we
closed
down
the
the
preschool,
as
well
as
the
after-school
care,
and
that
was
to
get
separation
between
the
Senior
Center,
which
is
also
in
the
community
center.
The
Senior
Center
effective
today
it
too
was
closed
down.
I
spoke
with
them
and
said
in
the
best
interest
of
our
seniors
health,
given
the
pandemic
that
were
under
and
that
we're
experiencing
and
not
to
scare
anybody
it's
here.

are
no
positive
confirmed
cases,
but
it
certainly
takes
time
for
these.
You
know
once
testing
is
done
to
confirm
cases,
but
we
all
need
to
be
hyper
vigilant
of
several
different
things.
Now,
washing
your
hands,
washing
your

frequently,
the
other
thing
is
social,
distancing
or
physical
distancing.

staying
having
six
foot
distance
around
you
radius
from
where
you
are
that's
social,
distancing
and

finally,

you're
not
feeling
well

cough

call
your
primary

provider

your

care
provider.
They
may
request
that
you
come
in

be
tested

go

those
are
the
main
things

the
Athens
City
County
Health
Department,
is
encouraging
people
to
do
as
we
move
forward.

will
likely
in
the
near
future,
if
not
tomorrow,
start
to
close
down
some
of
the
functions
to
the
public
for
operations.
On
the
first
floor
of
the
city,
building
that
being
the
utility
billing
office,
people
are
still
encouraged
to
pay
your
bills
online.
That's
easy
to
do,
but
we
do
need
to
to
do
the
best
that
we
can
to
protect
everybody
as
we
move
forward.
It's
it's
difficult
and
I
get
that
were
in
a
whole
new
era
in
time
when
it
comes
to
the
pandemics
I'm
glad
that
these
census
2020
was
spoken
to
census.

2020
has
made
several
pivots
in
terms
of
delaying
things.
Let
me
be
very
brief.
With
some
of
these,
they
have
delayed
the
start
of
their
mobile
questionnaire
assistance
program.
It
was
set
to
begin
on
March
30th.
It
will
be
starting
instead
on
April
13th
they're,
also
delaying
their
early
non-response
follow-up
operation
that
was
set
to
deploy
April
9th.
That
will
be
that'll
begin
April
23rd.

Instead,

share
with
you
earlier
this
evening
my
wife
and
I
with
my
daughter's,
because
they
wanted
to
be
involved
and
see
how
the
census
works.
We
did
ours
on
line
for
a
family
of
four.
It
took
us
all
of
15
minutes
to
do

become
enumerated
online
again.
I
encourage
everybody
to
use
that
mode
of
enumeration.

other
thing
I
want
to
share-

this
is
new-
this
just
was
just
released
today,
and
that
is
that
you
know
over
the
weekend
the
governor
ordered
the
closure
of
bars
and
restaurants,
except
for
carryout,
allowing
for
carryout
in
either
of
those.
Today
they
have
included
movie
theaters,
as
well
as
bowling
alleys
or
being
asked
to
close
down.

other
big
change
is
that
we've
gone
from
gatherings,
non-permissible
being
gatherings
of
a
hundred
people
or
more
in
one
space
that
has
since
changed
under
the
Ohio
Department
of
Health
Director
Amy
Acton,
it
is
now
50.
People
are
hearing
from
the
CDC
that
there
is
a
recommendation
and
that's
important.
They
are
recommending
no
gatherings
greater
than
10,
but
that's
not
a
mandate.
That's
a
recommendation
from
the
CDC.

city
of
Athens

County
Department,
an
Ohio
University,
have
become
aware
of
an
effort
to
organize
a
fest
event
this
weekend,
any
such
gathering
would
be
in
direct
violation
of
the
state
health
Directors
order,
prohibiting
public
assemblies
of
5000
or
more,
which
specifically
includes
festivals
as
such,
the
city
of
Athens
will
not
permit
these
events
to
take
place
as
long
as
the
Health
Director
order
remains.
In
effect,
any
attempt
to
assemble
is
a
violation
of
the
health
Directors
order.

presentation

who

Columbus
community

her

group
of

areas

transportation,
housing,

the

assessment

implementation
plan

cases

cases

because
you
know
the
the
the
amount
of
social
resources
that
we
are
spending
to
focus
on.

is
nowhere
near
enough

adequate
response

live

a
society

little
bit
of
pressure
from
a
public
health
crisis,
our
stock
market.

thing
that

it's

pinnacle

healthy
economy

supposed

look

crashing

federal
government

able
to
fork
over
1.5
trillion
dollars

save

stock
market

feel
like
if
we're
able
to
mobilize
that
amount
of
resources
to
save
some
wealthy
billionaires
on
Wall
Street.
Maybe
our

we
could
have
a
system
where
we
actually
try
to
support
everyday
working
class
people.
So
basically,
the
system
is
not
equipped
to
deal
with
this
crisis.

using
xenophobia
and
racism

shift
blame
away
from

actual,

economic
reasons,
that
we
are
not
able
to
deal
with

crisis
and
blame.

immigrants
and
say
if
people
are
saying
we
should
build,

continue
to
build
the
wall

deporting
immigrants
at
hospitals
right
now.
This
is
so,
if
there's
ever
a
time
for
a
city
council
to
say
like
we
will
not
cooperate
with
ice
now
is
the
time
to
do
that
when
literally
immigrants
are
being
deported
at
hospitals.

support
