Description
Athens City Council - October 18, 2021
A
Good
evening
and
welcome
to
athens
city
council,
it's
monday
october
18th
at
7
01
pm
we're
in
regular
session
tonight.
Our
first
item
of
business
will
be
to
establish
a
quorum.
We
have
five
of
our
seven
council
members
present
tonight.
Next
item
of
business
is
disposition
of
the
minutes.
For
the
regular
session
held
on
october,
4th
2021..
B
B
A
Opposed,
nay,
the
minutes
have
been
approved.
Next
we
have
communications,
we
do
have
a
notice
from
ohio
division
of
liquor
control,
and
this
is
for
speedway
llc,
and
this
is
for
both
speedway
locations
on
319
estate
street
and
also
419
richland
avenue,
and
what
it
is
is
a
change
in
the
membership
interest
of
the
organization.
So
just
a
change
in
the
in
the
name.
C
Thank
you,
president
nicely
I
had
won.
I
had
a
a
public
comment
presented
to
me
just
today.
That
was
concerning
the
staircase
that
leads
up
to
west
washington
down
from
depot,
and
the
concern
was
that
there
had
been
several
reported
assaults
and
robberies
there
specifically
of
late
night,
female
service
industry
workers
who
were
using
those
stairs
late
at
night,
and
I
just
I
wanted
to
urge
people
to.
C
I
feel
like
it
always
sounds
bad
to
just
say
just
be
aware
of
your
surroundings,
but
please
do
and
those
stairs
definitely
need
to
get
looked
into
and
definitely
need
to
have
some
attention
put
into
the
safety,
the
lighting
and
all
that.
But
until
that's
done,
please
be
very
mindful
of
using
them,
because
if
this
is
happening,
we
don't
want
to
have
people
just
getting
assaulted
there
and
if
you
are,
unfortunately,
a
victim
of
an
assault
or
robbery,
especially
in
any
location.
But
in
that
one
as
well.
C
C
A
Okay,
if
no
other
comment,
communications
from
council
members
will
move
on
to
reports
and
communications
from
other
elected
officials,
law
director,
eliza,
no
okay-
and
I
don't
believe
auditor
hecht-
is
here
at
the
moment
mayor
patterson,
no
reports,
okay,
well,
we'll
move
right
on
to
business.
We
have
ordinances
for
a
third
reading.
B
D
A
B
A
Oppose
nay,
the
motion
carries
and
the
ordinance
is
approved
next
is
ordinance
102
21..
This
is
an
ordinance
amending
ordinance,
80,
20,
athens,
city
code,
title
1,
general
provisions,
chapter
1.03
code
fees,
established
for
solid
waste,
recycling
and
optional
composting
rates
and
declaring
an
emergency,
and
this
is
introduced
by
all
members
of
council.
A
Okay,
we
have
a
motion
in
a
second
and
I'll,
provide
a
little
bit
of
background
information
which
was
presented
last
week
at
the
committee
meeting.
Also,
this
calls
for
a
an
increase
in
the
recycling
fees
that
will
be
going
up
from
350
to
550
and
then
for
an
owner-occupied
unit.
The
amount
of
increase
for
a
single
32
gallon
container
for
trash
will
be
going
up
from
14.50
to
15.23
per
month.
A
There
is
also
an
increase
in
franchises
for
dumpsters
and
other
areas
in
the
city,
and
there
is
also
a
slight
increase
for
extra
bags
when
people
are
having
trash
it's
now
at
five
dollars
per
extra
bag,
it
will
go
up
to
five
dollars
and
twenty
five
cents
and
special
halls
will
go
up
from
fifteen
dollars
to
fifteen
dollars
and
seventy
five
cents.
So
this
information,
the
recommendations
on
the
rate
increases,
have
been
presented
to
council
members
by
administration.
A
A
B
A
B
B
The
third
paragraph
will
be
amended
as
following
as
part
of
the
well
just
read
the
whole
thing:
233
000
to
apr
income
tax
fund,
273
transaction
code,
500
for
paving
and
parking
lot
construction
amended
as
part
of
the
west
state
park,
improvement
project
number
341,
dropping
down
to
section
two
third,
paragraph:
233
thousand
dollars
from
apr
income
tax
fund,
273
transaction
code,
500
for
park
paving
and
parking
lot.
Construction
amended
as
part
of
the
west
state
park.
Improvements,
project,
number
341.
A
Okay
and
councilman
resner,
I
think
I'm
going
to
back
up
a
few
minutes
because
council,
our
clerk
of
counsel,
deborah
walker,
has
some
later
amendments
with
revised
figures
to
that.
So
I
think
what
you
need
to
do
first
is
make
before
the
motion
to
approve.
We
need
to
make
the
motion
to
amend
we'll
get
a
second
on
that
you'll
describe
it
then
we'll
vote
on
the
amendment.
Okay,
thank
you.
B
Good
to
know,
of
course,
you
realize
this
will
drop
it
back
down
to
first
reading
correct
okay,
and
we
cannot.
We.
B
It
is,
it
is
what
it
is
very
well
I'd
like
to
make
a
motion
that
we
amend
zero
one
zero
three
dice
twenty
one.
B
This
safety
director
is
hereby
authorized
to
expand
up
to
six
hundred
forty
six
thousand
dollars
as
follows:.
A
B
A
Opposed
nay
now
the
amendment
passes
and
the
ordinance
has
been
read
for
the
first
time.
Thank
you,
council,
member
eisner
for
accommodating
the
late
changes.
Ordinance.
105
21
is
an
ordinance
amending
ordinance,
93
21
the
2021
appropriation
ordinance
and
authorizing
the
auditor
to
make
an
interfund
transfer
introduced
by
council
member
reisner
on
behalf
of
council
member
crowl.
E
A
B
It
pretty
much
reads,
as
it
is
section
one
of
the
2021
appropriation
ordinance.
140
20
is
hereby
amended
by
appropriating
from
the
unappropriate
balance
of
following
sums:
150
thousand
dollars,
general
fund
transaction
code,
600
for
transfer
for
400
to
general
fund,
treasurer
101.1
transaction
code,
500
for
purchase
of
a
scanner
and
five
thousand
dollars
to
recreation
fund.
B
Two:
seven:
the
transaction
code,
three
hundred
four
thousand
five
hundred
dollars
to
plant
trees
at
the
west
state
park
project
number
three,
forty
one
and
five
hundred
dollars
for
the
pocket
park
lot
in
oakmont
and
increasing
the
total
appropriations
by
said
amount.
A
A
If
not
all
those
in
favor
signify
by
saying
aye,
aye
opposed,
nay,
the
motion
carries
and
the
ordinance
is
approved.
Ordinance.
106
21
is
an
ordinance
granting
a
special
right-of-way
use
permit
to
nathan
wrath
owner
333
e
state
street
to
place
a
sign
on
an
existing
sign
poll.
This
is
introduced
by
council
member
fall.
E
We
we
have
control
over
right-of-ways
so
that
when
somebody
wants
to
put
a
sign
or
such,
they
want
to
come
and
they
get
a
right-of-way
permit.
The
right-of-way
permit
is
good
for
10
years
and
then
it's
an
administrative
reapply
after
that.
A
A
E
Thank
you.
I
ask
that
we
approve
107.21.
Second,
thank
you,
just
as
it
says,
an
awning
over
a
garage
door.
This
will
actually
not
only
approve
improve
the
person's
building
property,
but
also
other
people
in
that
area,
mostly
a
restaurant.
That
will
then
be
able
to
do
extra
things
because
there's
an
awning
there.
Thank
you.
A
A
Great,
that's
good
news.
Okay,
thank
you
and
if
no
other
comments
or
questions
we'll
move
on
to
one
twelve,
twenty
one,
this
is
an
ordinance
providing
for
the
issuance
of
four
hundred
thousand
dollars
of
notes
by
the
city
of
athens,
ohio
in
anticipation
of
the
issuance
of
bonds
for
the
purpose
of
renewing
notes
previously
issued
for
the
purpose
of
paying
part
of
the
costs
of
acquiring
a
new
fire
truck
and
related
equipment
and
declaring
an
emergency
and
is
introduced
by
council
member
crowl.
A
B
Thank
you,
madam
president.
Unfortunately
some
of
this
will
will
have
to
be
read,
even
though
it
has
been
discussed
in
committee
section,
one,
the
following
sections
of
athens
city
code,
title
7
traffic
code,
chapter
7.01
parking
regulations
are
here
by
a
minute
as
follows:
section
7.0.
B
4.40
section
e
paragraph
1,
processions
and
parades
permits
required
to
read
as
follows:.
B
B
B
up
from
20
per
year
for
one
motorcycle
and
60
per
year
for
two
motorcycles
owned
by
one
individual
or
their
spouse
stickers
for
any
number
of
motorcycles
owned
by
one
individual
or
spouse
other
than
the
two
herein
provided
for
shall
cost
30.
Each
valid
certificates
of
title
for
each
motorcycle,
owned
by
the
one
individual
or
spouse,
must
be
presented
at
the
time
of
purchase
in
order
to
receive
the
discounted
rate
of
sixty
dollars.
B
B
B
D
In
section
d,
a
nice
switch
from
some
gendered
language
that
has
slashed
her
to
there
and
I'd
like
to
thank
our
law
director
eliason
for
a
conversation
that
affirmed,
I
think,
our
interest
in
seeing
more
inclusive
language
and
as
these
sort
of
ordinances
come
come
up,
seeing
those
changes
made,
and
I
was
going
to
just
ask
for
clarification
about
the
process
for
doing
that,
because
it's
my
understanding
that
it's
a
lot
of
work-
and
I
was
hoping
our
law
director-
could
comment
on
that
effort.
D
A
Great
thanks
for
the
comments.
Okay,
any
other
comments
or
questions
all
right,
we'll
move
on
to
ordnance
114
21.
This
is
an
ordinance
amending
athens
city
code,
title
11,
business
regulations,
chapter
11.04,
vending
peddling
and
soliciting
section
11.04.03
regulation
of
vendors,
peddlers
and
solicitors
penalties.
This
is
introduced
by
councilmember
reisner.
B
And
section
one:
an
ordinance
amending
athens
city
code,
title
11,
business
regulations,
chapter
11.04,
vending
peddling
and
soliciting
section
11.04
regulation
of
vendors,
peddlers
solicitors.
To
read
as
follows:
paragraph
a
all
vendors,
peddlers
and
solicitors
must
be
duly
licensed
by
the
city
of
athens
unless
otherwise
exempt
pursuant
to
and
to
section
11.04.20.
B
B
Paragraph
c
has
been
amended
as
follows:
the
first
sentence
has
been
struck
out
and
replaced
by
in
case
any
person
refuses
to
comply
with
an
order
issued
pursuant
to
the
above
provisions.
In
addition
to
the
penalties
provided
by
this
code,
the
city
of
athens
may
institute
civil
proceedings
to
enforce
compliance
with
the
order.
B
A
E
E
One
is
where
all
our
fees
and
and
for
services
are
housed,
and
so
what
we're
doing
with
these
particular
these
next
this
and
a
couple
other
ordinances
is
putting
the
language
in
so
that
the
fees
in
title
1
are
established
in
the
master
ordinance
that
they
would
have
so,
for
example,
and
this
one
is,
it
says,
established
by
separate
ordinance,
a
set
forth
in
title
one,
and
so
all
the
language
about
fines
and
offenses
have
come
out,
and
they
are
now
in
title.
One.
A
Thank
you.
Thank
you
any
comments
or
questions
from
council
members,
elected
officials
or
the
public.
Okay,
if
not
we'll
move
on
to
116
21
much
the
same
kind
of
changes
to
this.
An
ordinance
amending
athens
city
code,
title
13,
general
offenses,
chapter
13.07,
miscellaneous
offenses,
section
13.07.07,
citation
introduced
by
councilmember
fall.
E
A
E
A
This
is
an
ordinance
of
mending
athens
city
code,
title
1,
general
provisions,
chapter
1.03
code
fees,
established
section,
5.0,
4.08
sewer
rates
and
declaring
an
emergency,
and
the
detailed
of
the
rate
increases
for
the
sewer
rates
has
been
set
and
is
available,
the
details
of
it
in
the
ordinance
very
basically,
it's
a
residential
fee.
The
base
rate
on
that
is
going
up
from
5.55
to
5.72
cents,
commercial
rate
from
628
to
6.47
an
industrial
rate
from
6.92
to
7.13.
A
These
are
the
flat
monthly
fees
and
then
probably
most
pertinent
to
most
residential
customers.
A
The
monthly
charge
for
zero
to
15,
000
gallons
of
sewer,
has
been
increased
from
28
and
40
cents
a
month
to
29.25
cents
a
month,
and
so
this
is
approximately
a
three
percent
increase
and
once
again
it's
one
of
these
proprietary
funds
where
we
are
it's
not
part
of
the
general
fund,
but
is
a
a
separate
fund
where
the
money
coming
in
the
revenues
coming
in
need
to
be
sufficient
to
equal
our
to
meet
our
expenses.
In
that
account
any
questions
or
comments.
E
Thank
you.
This
is
all
the
the
previous
sections
that
we
have
removed
from
all
the
different
29.,
29.0307
and
5.0603,
and
now
it's
in
the
infamous
code,
title
1..
Thank
you.
Okay.
Thank
you.
A
B
Thank
you,
madam
president.
Ordinance
120
21
reads
as
follows,
and
it's
short
thank
god
section,
one.
A
A
B
Yes,
I
believe
everyone
on
council
received
an
email
from.
A
I
have
other
council
members
receive
them,
you
did
receive
them
and
you
did
review
them
okay.
So
there
are
some
changes
in
updating
the
agreements.
Also,
the
recognition
of
the
union
changing
it
to
mirror
language.
I
don't
think
we
need
to
read
through
every
single
one
holidays,
that's
adding
juneteenth
and
the
language
for
that,
and
then
the
wages
are
updated
and
they
include
increases
for
2.5
percent
for
2022.
E
A
A
A
Any
questions
or
comments
from
council
members
elected
officials,
members
of
the
public,
okay,
we
will
move
on
to
the
next
ordinance.
This
is
123.2
123.21,
an
ordinance
providing
compensation
of
greater
than
25
percent
through
the
assigned
pay
grade,
pursuant
to
ordinance
3521
for
the
assistant
director
of
epw
and
authorizing
the
hourly
rate
to
be
paid
retroactively
to
the
employee's
subsequent
rehire
date
and
introduced
by
council
member
risen
on
behalf
of
councilmember
crowl.
B
and
71
cents
per
hour.
I
think
we
all
know
that
the
reasoning
behind
this
is
the
person
was
hired
at
one
rate
and
then
there's
some
error
or
other.
We
have
to
make
a
correction
here
to
bring
it
back
up,
so
I
think
we
need
to
get
this
through
for
as
quickly
as
possible.
A
All
right,
so
this
sets
the
rate
at
his
first
higher
rate.
Yes,
corrects
it:
okay,
any
questions
or
comments
from
council
members,
elected
officials,
public
okay,
if
not,
then
we'll
move
on
to
ordinance
124
21.
This
is
an
ordinance
amending
the
2021
staffing
levels
authorized
by
ordinance
14120
and
is
introduced
by
council
member
eisner
for
councilmember
crowl.
B
Thank
you.
Madam
president,
section
one
will
read
as
follows:
staffing
levels
authorized
by
ordinance
141-20
are
hereby
amended
to
read
as
follows:
fund
270.940
recreation
program,
specialist
arts,
the
full-time
equivalent,
is
change
from
0.25
to
1.
A
Thank
you
any
questions
or
comments
all
right,
if
not
we'll
move
on
to
announcements
on
other
business,
we
have
three
items,
one
of
which
is
a
motion
to
accept
the
september
21
2021
credit
card
transactions
that
have
been
submitted
to
council
members
and
reviewed.
We
could
have
a
motion
for
their
approval.
B
E
A
Okay
and
that's
for
a
period
of
three
years,
all
those
in
favor
signify
by
saying
I
I
oppose
nay,
the
motion
carries
and
that
reappointment
has
been
confirmed.
The
next
one
is
the
confirmation
of
the
mayor's
reappointment
of
joe
krause
to
the
zoning
board
of
appeals,
and
I
believe,
council
member
mc
ziff
has
that.
C
Thank
you,
president
isaac.
I
would
like
to
move
that.
We
confirm
the
mayor's
mayor's
reappointment
of
jim
krause
to
the
board
of
zoning
appeals.
A
A
Next
item
of
business
is
an
opportunity
for
citizens
to
speak
on
agenda
items
that
were
not
on
our
agenda
tonight.
Is
there
anyone
in
the
audience
that
is
wanting
to
speak?
Yes,
mr
crane,
if
you
could
come
up
and
your
name
and
address
and
we'll
set
the
timer
for
three
minutes,
and
you
might
notice
tonight
that
the
light's
been
moved
so
that
it's
now
on
the
podium
and
the
green,
green,
yellow
and
red
easily
seen.
Thank
you.
F
Damon
crane,
hudson
avenue
sunshine,
they
say-
is
the
best
disinfectant
we've
had
an
unusually
sunny
week
here
in
athens,
but
unfortunately,
a
few
folks
are
still
hiding
in
the
shadows.
When
mayor
patterson
met
with
republicans
last
week
to
lie
about
progressive
candidates
and
inflame
the
same
far-right
paranoia
responsible
for
the
january
6
capital
riot.
He
was
acting
in
support
of
all
of
you
when
the
mayor
sucked
up
the
far-right
provocateur
jay
edwards.
F
He
was
acting
on
your
behalf
and
when
the
mayor
joined
with
republicans,
in
belittling
iris
vergie,
a
young
woman
of
color
with
a
degree
in
city
planning
and
a
history
of
community
organizing
work
as
merely
a
girl
and
a
bartender
whose
name
the
mayor
said
he
couldn't
even
remember,
and
they
all
had
a
great
laugh
about
it.
The
mayor
was
working
to
get
three
of
you
elected.
F
F
In
an
attempt
to
save
face,
the
city
democratic
central
committee
broke
with
decades
of
past
practice
and
appointed
ziff
and
mccary,
both
of
them
renters
in
their
30s
won
a
gay
black
man
and
what's
more
ben
and
micah,
you
guys
seem
to
be
on
the
same
page
as
iris
and
me
on
most
issues,
certainly
on
tenants,
rights,
rental,
housing
regulation
and
parking
and
you're
also
closer
to
us
on
racial
equity
and
policing
than
you
are
at
anybody
else.
In
the
running.
F
After
all,
that's
why
the
mayor's
republican
pals
denounced
both
of
you
before
they
even
got
around
to
me
and
iris,
but,
while
you
say
you're
on
the
same
page
as
us,
you're
literally
on
the
same
yard,
sign
as
sarah
grace
the
mayor's
steadfast
ally,
who
opposes
all
four
of
us
on
all
of
these
issues.
So
when
it
comes
to
the
issues
you
literally
are
campaigning
for
your
opponents
and
against
your
allies.
F
F
F
Do
you
think
he
bothered
to
remember
your
name
if
it
couldn't
be
slapped
on
a
sign
next
to
sarah's
and
micah
suppose
you
also
were
running
as
an
independent.
If
the
mayor
is
willing
to
join
with
republicans
and
belittling
iris
as
merely
a
girl,
what
do
you
think
he'd
have
to
say
about
you
behind
closed
doors?
So,
what's
it
going
to
be?
Are
you
guys
going
to
continue
to
allow
yourselves
to
be
tokenized
and
weaponized
against
the
very
communities
you
claim
to
represent?
F
Are
you
going
to
throw
our
people
under
the
bus
in
exchange
for
your
own
seat
at
the
table,
or
are
you
going
to
join
iris
and
me
in
opposing
a
city
establishment
that
is
undeniably
hostile
to
all
of
us?
I
hope
you'll
make
the
right
decision,
but
regardless
the
people
of
athens
deserve
to
know
where
you
stand.
So
please
stop
hiding.
