Description
Athens City Council - February 20, 2023
B
And
welcome
to
Athens
city
council,
it's
7
P.M
on
February
20th
2023..
We
are
in
a
business
meeting
tonight
before
we
begin
the
business
we
will
be
having
a
public
hearing
and
this
particular
one
is
coming
forward
to
US,
based
on
recommendations
from
the
Athens
City
Planning
Commission,
to
amend
our
Athens
City
Zoning
code
sections
on
buildings
on
public
streets
and
then
also
accessory
structures.
C
Member
Grace,
thank
you
president
nicely.
So
this
public
hearing
is
is
part
of
the
process
by
which
our
city,
the
zoning
rules,
can
be
changed
and,
as
part
of
this
process,
the
recommendations
from
the
Athens
City,
Planning
Commission,
are
sent
to
members
of
city
council,
and
we
discussed
those
in
in
committee
and
and
then
make
a
decision
on
whether
or
not
to
bring
forward
an
ordinance
and
but
another
part
of
the
process
is
that
there
is,
in
addition
to
the
opportunities
for
public
comment
in
our
normal
City
Council
meetings.
C
There
is
a
specific
requirement
for
public
hearing,
and
that
is
what
we
are
holding
this
evening
and
the
recommendations
involve
a
few
different
changes
to
our
zoning
laws.
One
is
specifically
to
allow
accessory
structures
that
are
accessory,
Energy
Systems,
and
these
can
be
structures
that
are
either
roof
or
ground
mounted,
to
facilitate
a
most
often
solar
energy
generation,
and
these
this
changes.
The
mechanism
through
which
a
homeowner
could
receive
a
permit
and
the
rules
around
that
process
for
being
able
to
have
especially
a
ground
mounted
solar,
Energy
System
in
in
their
on
their
lot.
C
That
is
separate
from
the
primary
dwelling.
We
also
have
changes
to
Neighborhood
business
zones,
and
my
computer
is
telling
me
I'm
not
signed
in
so
I
may
lose
my.
C
C
All
businesses
to
be
taking
place
within
the
confines
of
a
structure
and
language
to
allow
for
outdoor
dining
has
been
added
to
to
that
section
of
our
city,
ordinance
or
city
code
through
the
ordinance
process,
and
the
final
change
is
a
change
to
the
rules
regarding
the
low
permitted
locations
for
a
drive-in
and
Dr
or
drive
through
at
an
eating
establishment,
and
currently
there
is
a
requirement
that
the
drive-through
must
be
at
least
200
feet
from
any
R1
or
R2
Zone,
and
the
ordinance
under
consideration
at
the
recommendation
of
of
the
Planning
Commission
is
to
change
that
to
a
distance
of
100
feet.
C
E
Name
and
address
Greg
Lavelle
16
Avon
place
I'm,
asking
Council
to
please
a
vote.
No
on
the
planning
on
changing
the
zoning
code
from
100
feet
or
200
feet
to
100
feet.
E
I
live
in
a
place
where
there's
a
drive-through
Drive-In,
that's
currently
200
feet
from
an
R1
and
to
make
it
100
feet
from
an
R1
and
establish
that
as
the
as
the
law
in
the
code,
I
think
would
drive
a
lot
of
R1
residents
that
live
right
next
to
those
businesses
out
of
the
neighborhood
like
they
already
have
in
our
neighborhood.
So
I
would
highly
recommend
that
you
keep
it
at
200
feet
and
not
100
feet
the
solar
panel
thing
in
in
one's
backyard
or
whatever.
E
C
C
Back
within
very
specific,
specifically
defined.
E
E
C
Wind
powered
AES
shall
be
designed
in
such
a
manner
as
to
have
minimal
impact
to
Residents
public
areas,
including
city
parks,
streams,
creeks
and
rivers.
Wind
powered
AES
shall
not
be
placed
in
any
legal,
easement
or
right-of-way
location
or
placed
in
any
stormwater
conveyance
system
that
would
in
any
manner
impede
storm
water,
runoff,
appropriate
safety.
Slash
warning
signage
concerning
voltage
shall
be
placed
at
Ground
mounted
devices,
equipment
and
structures.
All
electrical.
D
C
The
permit
for
wind
power
to
AES
shall
include
as
a
minimum
standard
manufacturers,
drawings
and
Engineering
specifications
of
the
turbine
structure,
Tower
base
and
footings
a
statement
that
the
system
shall
comply
with
all
state
permits
and
regulations,
and
a
plot
plan
showing
the
wind
powered
AES
relative
to
all
property
lines.
On-Site
structures
off-site
structures
within
one
and
a
half
times
the
height
of
the
proposed
wind
powered,
AES,
overhead
utility
locations
parks
and
public
spaces.
C
So
this
is
all
of
that
information
has
to
be
included
in
their
application,
their
permit
application
to
receive
a
permit
for
building
or
erecting
one.
Okay.
F
Part
about
the
one
and
a
half
I'm
trying
to
do
the
math
here
in
my
head
and
I.
Couldn't
do
it
quick
enough,
but
let's
say
that
my
lot
is
55
feet
wide
by
110
feet,
deep,
which
is
fairly
common
lot
in
the
city
based
on
that
last
part
about
one
and
a
half
to
Mr
lavelle's
Question.
How
tall
could
that
turbine
be.
G
Thank
you.
Member
slank
I've
always
been
advised
against
public
math.
G
I
didn't
make
a
calculator
either.
So
there's
not
a
restriction
on
height,
but
the
plot
plan
shows
must
show
all
off-site
structures
within
1.5
times
the
height
of
the
proposed
wind
powered
AES.
So,
for
instance,
if
your
lot
is
55
feet
wide,
you
put
it
in
the
middle
of
the
back
of
the
lot
and
it
is
100
feet
tall.
You
would
have
to
show
on
the
plot
submission
that
you
submit
every
structure
within
155
feet
of
that
I'm.
Sorry
150
feet
of
the
of
the
thing.
F
G
F
G
Right
for
the
structure,
so
you
know
to
be
able
to
extend
beyond
the
edge
of
that.
I
also
think
our
height
restrictions
would
apply
in
this
particular
instance
as
well,
which
I
think
are
Max
height
five
feet
so
I
mean
you
know.
If
there
is
concern
that
there's
going
to
be
a
300
foot
structure
in
the
backyard
of
someone
on
the
far
East
Side,
that's
going
to
endanger
the
property
next
door,
that's
just
not
going
to
happen
under
the
existing
code
with
a
with
a
accessory
structure,
a
principal
energy
use.
G
There
are
certain
zones
that
that
could
be
permitted
in
I.
Don't
know
that
the
wind
in
Southeast
Ohio
would
support
it,
but
that's
probably
something
we'd
want
to
get
into
the
principal
Renewable,
Energy
System
and
that's
the
next
section
of
code.
That's
related
here
and
I.
Can
I
can
jump
into
that?
If
we
need
to,
if
you
give
me
a
few
minutes,
we
can,
we
can
look
at
it
and
get
you
an
answer.
G
Of
note,
while
I'm
talking
someone
asked
a
question:
I'm,
not
sure
if
it
was,
you
remember,
Swank
or
somebody
else
in
one
of
the
previous
iterations
on
this
code,
change
related
to
the
historic
overlay
Zone
and
whether
or
not
a
ground-mounted
solar
system
could
be
permitted
in
the
historic,
overly
Zone.
But
the
answer
to
that
question
I
said
I'd
go
back
and
find
that
is,
it
could
be
if
the
historic
preservation
commission
voted
to
approve
a
certificate
of
appropriateness,
which
functionally
is
like
a
a
variance
from
the
bza.
G
H
I
Mary
Abel
48
Strathmore.
Would
someone
just
clarify
for
me
in
that
language?
It
says
drive
in
drive
through,
but
it's
talking
about
permitting
outdoor
dining.
Now
that
Drive-In
drive
through?
Does
that
mean
a
drive-in
drive-through
place
that
has
dining
inside
as
or
can
it
mean
any
kind
of
drive
through
facility.
C
The
change
as
far
as
for
the
drive-in
drive
through
is
only
for
an
eating
and
drinking
establishment
and
that
it
says
eating
and
drinking
establishments
provided
that
restaurants
with
Drive-In
drive-throughs
have
the
drive-in
drive
through
at
least
100
feet
or
200
feet
from
the
R1
R2
zone.
So
that
is
to
it's
under
the
heading
of
principal
permitted
uses
in
the
general
business
Zone,
but
only
in
eating
and
drinking
establishments.
I
G
39
allows
us
to
to
regulate
the
source,
water
protection
area
and
the
Wellhead
protection
team
is
a
is
a
group
of
individuals
that
we
select
through
the
administration
there's
nowhere
in
the
code
that
says
who's
on
the
team,
but
basically
it's
it's.
The
people
that
you
know
we
within
the
administration
have
selected
to
help
enforce
title
39.
right
now.
G
The
high
Protection
Team
includes
the
service
agency,
director
of
the
Deputy
service
safety,
director
engineering,
Public
Works,
director,
a
representative
from
the
Athens
City
County,
Health
Department,
the
water
lab
technician,
the
water
plant
manager
and
then
the
source
water
protection
area
is
a
delineated
area.
That's
a
zoning
overlay
that
title
39
regulates
the
activities
inside
that.
J
Yeah,
this
is
from
the
public,
so
I
I
got
an
email
from
now
his
name
John
Lefferts
levels.
Is
that
how
response?
Okay?
Sorry
anyway,
you
sent
me
an
email
regarding
the
outdoor,
dining
situation,
zoning
change
and
his.
He
would
like
us
to
consider
defining
what
dining
means
does
that
include
breakfast
and
lunch,
or
is
that
exclusive
to
one
meal
or
another?
J
And
then
he
said
he'd
like
to
see
a
provision
to
require
litter
control
by
that
dining
establishment.
So
you
know
if
people
mess
up,
they
also
responsible
for
cleaning
up
whatever
their
customers
leave
behind
and
that
outdoor
seating
not
exceed
a
percentage
of
the
indoor
seating
to
help
reduce
parking
strain.
And
the
fourth
item
is
that
no
outdoor
dining
facility
should
operate
between
10
pm
and
7
A.M
each
day
Sunday
evening
through
Friday
morning
or
between
the
hours
of
12
a.m
and
7
A.M,
Saturday
and
Sunday
morning,
matching
the
noise
ordinance
hours.
J
E
C
E
C
Yes,
I
believe,
if
calls
are
are
made
and
then
yes,
it
is
certainly
enforceable.
Thank
you.
F
I
have
one
going
back
to
Barbara's
comments
and
the
type
of
business.
F
Drawing
a
blank
I
drank
this
coffee
every
morning
at
home,
Dunkin
Donuts.
If
we
were
to
take
not
Dunkin
Donuts,
what's
the
what's
the
Tim.
F
Next
to
Napa
Auto
Parts
on
East
State
Street
there
at
Strathmore
very
vacant,
very
valuable,
high
visibility.
Lot
move
that
Tim
Hortons
over
there
and
it's
it's
a
problem
in
the
neighborhood
200
feet
probably
is
about
100
feet.
It
really
is
and
if
you've
ever
been
down
there
during
the
day
they
line
up
15
16
17
cars.
Deep
and
it's
continuous,
it's
a
great
business.
F
It
really
is
I
wish
I
had
stock
in
it,
but
I
think
we
might
want
to
when
we
come
up
for
next
reading
and
take
a
look
at
the
100
versus
200,
which
seem
to
have
worked
pretty
well
for
many
many
years.
B
Thank
you.
Thanks
for
being
here,
we're
going
to
move
on
to
our
regular
business
meeting
and
establishing
a
quorum
is
the
first
item
of
business
with
all
council
members
present
tonight.
Next
item
of
business
is
disposition
of
the
minutes
for
the
regular
session
of
council
held
on
February
6
2023.
If
I
can
have
a
motion
for
accepting
these
minutes
still.
D
A
B
K
I
have
a
couple
items
for
council
tonight.
Last
week,
I
attended
the
Ohio
mayor's
Alliance
meeting
up
in
Columbus
and
had
the
opportunity
to
spend
some
time
with
not
only
Governor
dewine
but
Senate
President
Huffman
discussing
the
budget
and
discussing
other
things.
There
was
a
really
interesting
presentation,
though,
from
the
Ohio
opiate
education
Alliance,
and
would
encourage
all
of
council
to
go
online
and
look
at
beatthestigma.org
I'm.
Taking
that
challenge
and
as
I
move
forward
I'm
in
probably
well,
you
may
be
seeing
the
future.
K
A
pledge
for
us
to
honor
beat
the
stigma
when
it
comes
to
people
who
are
struggling
with
addictions
of
different
types
as
well
as
individuals
with
mental
health
issues.
It's
I
again
I'm
just
going
to
encourage
Council
to
to
take
a
look
at
that.
The
other
thing
I
want
to
share
with
council
tonight
is
that
last
week
we
requested
the
flavored
tobacco
ordinance
from
Columbus
and
are
in
receipt
of
that
ordinance.
K
At
the
health
department,
he
said
he
and
Dr
dick
Gaskell
both
agreed
that
they
would
support
something
if
the
city
were
to
choose
to
take
up
something
similar
to
what
Columbus
has
been
able
to
accomplish
when
it
comes
to
selling
flavored
tobacco
products,
which
I
would
hope
that
we
all
recognize
is
something
that
is
certainly
attractive
to
younger
individuals
and
I
believe
poses
a
significant
Health
concern
when
it
comes
to
our
youth
and
adults,
but
again
just
want
to
share
with
Council
that
that
council
member
Grace
has
been
in
receipt
of
that
order.
L
Thank
you,
as
discussed
at
committee
and
at
first
and
second
readings.
This
ordinance
authorizes
the
service
safety
director
to
sell
items
at
internet
auction.
Thank.
B
If
not
all
those
in
favor
signify
by
saying
aye,
aye
opposed,
nay,
the
motion
carries
and
the
ordinance
is
approved.
Ordinance
423
is
an
ordinance
amending
ordinance,
156-22,
reallocating
revenues
from
the
city,
income
tax
and
declaring
an
emergency,
and
this
is
introduced
by
council
member
Crowell.
Thank.
L
You
president
Eisley
I'd
like
to
make
a
motion
to
approve
zero
four
twenty
three.
Second,
thank
you
I'm
going
to
go
ahead
and
read
section
one
here.
This
is
changing
our
city
income
tax
mix,
section
one
effective,
January,
1st
2023
section
one
of
ordinance.
L
This
is
new
language,
as
required
under
tax
levy
shall
be
allocated
directly
to
the
funds
as
follows,
and
then
we
list
the
five
funds:
72.5
percent
to
the
general
fund,
17.5
percent
to
the
street
fund,
six
percent
to
the
recreation
fund,
three
percent
to
the
Capital
Improvements
fund
and
one
percent
to
the
transportation
assistance
fund
and
this
tax
income
tax
mix
changes
were
necessary
with
our
fire
Levy
for
the
new
fire
station
on
Stimson
Avenue.
Thank
you.
President
Leslie.
B
B
M
So
with
the
0523
section,
1
States,
the
service
safety
director
hereby
authorized
to
close
streets
in
the
Uptown
area
for
special
events
during
the
2023
calendar
year
to
change,
requested
dates
or
cancel
events
and
implement
the
following
closed
as
an
Industries
to
vehicular
traffic
in
the
city
of
Athens,
no
earlier
than
6
a.m,
and
no
later
than
midnight
and
maintain
cross
traffic
wherever
practicable
and
for
the
following
events,
which
then
lists
several
events
and
then
ends
up
with
section.
B
banned
parking
on
designated
streets
beginning
no
earlier
than
3
A.M
later
than
1
a.m.
L
B
Aye
opposed,
nay
motion
carries
and
the
ordinance
is
approved.
623
is
an
ordinance
suspending
the
enforcement
of
Athens
city
code,
title
13,
General,
offenses,
chapter
13.04,
offenses
against
public
peace,
sections,
13.04.1,
unnecessary
noise
and
designated
event
areas
introduced
by
council
member
Reisner.
M
Thank
you,
madam
president.
The
title
that
you
just
read
pretty
much
sums
up
everything:
that's
in
the
ordinance
other
than
the
exact
events
that
are
listed
and
there's
five
or
six.
So
I
would
like
to
make
a
motion
that
we
adopt
zero,
six
dash
23
seconds.
B
B
Nay,
the
motion
carries
and
motion
is
passed
and
the
ordinance
that
goes
into
effect.
Thank
you.
723
is
an
ordinance
suspending
the
enforcement
of
Athens
city
code,
chapter
11.04,
vending
peddling
and
soliciting
to
allow
vending
and
designated
event
areas
and
is
introduced
by
council
member
Reisner.
M
Thank
you,
madam
president,
I'd
like
to
make
a
motion
that
we
adopt
07-23.
Second
I'll,
read
section
one:
the
enforcement
of
Athens
city
code,
chapter
11.04,
vending
peddling
and
soliciting
is
hereby
suspended
from
8
A.M
to
11
P.M
to
allow
Vending
in
the
designated
street
closure
areas
authorized
by
ordinance
05-23
at
such
times
in
areas
determined
appropriate
by
the
administration
for
the
following
events,
and
we
have
a
list
of
six
or
seven
different
events,
and
we
end
up
with
vending
shall
be
subject
to
the
following.
B
Really
never
well
I
didn't
mark
it
down.
Okay,
all
right,
any
any
questions
or
comments
if
none
from
Council
Members
or
elected
officials
or
our
audience
all
those
in
favor
signify
by
saying
aye.
A
L
M
Allow
me
to
read
section
one:
the
service
safety
director
is
hereby
authorized
to
suspend
the
fee
for
parking
in
the
municipal
parking
garage,
excluding
two-hour
meter
spaces
on
one
upper
as
follows,
and
then
we
have
a
list
of
the
dates
and
times
the
suspensions
all
the
way
through
December
23rd
of
this
year.
D
M
Thank
you.
The
title
actually
sums
up
the
entire
ordinance.
There's
no
need
to
repeat
it
just
urge
that
everyone
vote
in
favor
of
it.
Okay,.
B
B
N
You
president
nisley
I,
would
like
to
make
a
motion
that
we
approve
ordinance
10-23.
Second,
thank
you
very
much.
Al
Reed
from
section
two.
The
service
safety
director
is
hereby
authorized
to
expend
up
to
168
thousand
dollars
from
waterfund
plant
740.637
transaction
class.
300
for
set
purchase
of
water
softening
and
I
would
recommend
we
go
ahead
and
improve
this.
F
Just
a
real
quick
question
from
director
Stone
we're
two
months
into
the
calendar
year.
Are
you
starting
to
see
a
softening
of
inflationary
pressures
on
items
that
we
normally
buy,
such
as
salt
compared
to
previous
years
and
and
other
things.
G
Thank
you,
member
Swank,
I
I
am
just
barely
water.
Softening
salt
tends
to
be
very
stable
from
year
to
year,
because
the
the
quantities
don't
increase
and
decrease
significantly
across
the
spectrum
of
treatment
plants
that
use
that
particular
grade
of
salt.
Road
salt,
on
the
other
hand,
does
go
up
and
down
significantly
based
on
supply
and
demand,
in
most
cases,
driven
by
demand
from
the
previous
years,
either
severeness
or
lack
of
severeness
of
the
of
the
winter.
G
As
far
as
overall
inflationary
pressures
we're
starting
to
see
a
little
bit
of
tapering
off
of
things,
I'm
very
excited
about
the
next
ordinance,
which
is
about
the
fire
station
bidding
and
I'm,
hoping
that,
because
we
are
a
couple
months
later
than
when
inflation
was
really
roaring,
that
we'll
see
some
some
good
some
good
bids
as
some
of
the
construction
costs
and
supply
chain
issues
that
we've
seen
across
the
across
the
board
have
started
to
subside.
Thank
you.
A
B
Opposed,
nay,
the
motion
carries
in
the
ordinance
is
approved
now
move
on
to
our
last
third
reading
ordinance.
This
is
11
23..
This
is
an
ordinance
authorizing
the
service
safety
director
to
enter
into
a
contract
for
construction
of
the
new
Fire
headquarters,
project
number
346
and
declaring
an
emergency
and
council
member
McCary
I
do
believe.
We
need
to
table
this
tonight.
Okay,.
N
Okay,
I
will
go
ahead
and
ask
our
City
Safety
Services
director
if
there
is
an
update
on
the
contract,
since
that
was
the
remaining
question
from
our
last
committee
discussion
wanting
to
make
sure
that
that
was
completely
finalized
before
we
entered
the
agreement.
G
All
right,
thank
you.
Member
Carrie,
the
Ohio
controlling
board
has
to
approve
the
purchase
contract
on
the
and
the
controlling
board
meets
on
the
28th.
So
in
order
to
delay
this
appropriation
and
authorization
until
after
we
truly
have
that
contract
Inked
and
the
controlling
board
has
approved
it,
I
would
ask
that
you
go
ahead
and
table
it,
and
then
we
pick
it
back
up
sometime
after
they
meet
and
because
the
emergency
Clause
is
on
here,
that'll
allow
us
to
go
ahead
and
proceed.
Awarding
a
bid
bids
hit
the
street
tomorrow.
G
So
we're
very
excited
about
that.
I've
been
on
the
phone
with
the
Architecture
Firm
here
on
a
host
of
things
over
the
last
couple
weeks,
trying
to
get
it
all
all
nailed
down
and
and
surely
there'll
be
a
couple
addendums
that
will
go
out
during
the
period
of
time.
That's
bidding
with
the
goal
of
opening
bids.
There
I
think
on
the
16th
of
March
is
our
bit
opening
day.
That's
a
validate
that
exact
date,
but
the
goal
would
be
that
you
pass
this
ordinance
sometime
before
the
16th
of
March.
G
So
we
anticipate
the
controlling
board
approving
on
the
28th
and
then
we'll
be
able
to
bring
this
off
the
table
and
have
it
come
back
to
you
for.
N
B
B
And
we
will
proceed
with
a
several
ordinances
for
a
second
reading
and
on
these
particular
ordinances.
I
read
the
title
as
required
by
law,
and
unless
there
are
comments
or
questions,
then
we
move
on
and
read
the
title
of
the
next
ordinance.
So
I
will
pause
briefly
after
the
reading
of
each
ordinance
to
see
if
there
are
any
questions
or
comments.
B
Ordinance
1323
is
an
ordinance
amending
the
2023
appropriation
ordinance,
155-22
and
amending
ordinance
126-22
authorizing
an
increased
expenditure
and
construction
and
construction
engineering
for
the
water
treatment,
plant,
salt
storage,
roof
slab
and
beam
replacement
project.
This
is
Project
number
354
introduced
by
council
member
McCary
and
any
questions
or
comments.
B
If
none
will
move
on
to
1423.
This
is
an
ordinance
amending
the
2023
appropriation
ordinance,
155-22
and
amending
ordinance
89-22
authorizing
an
increased
expenditure
for
the
West
Washington
Street
sidewalk
and
safety
improvements.
Project
number
335..
This
is
introduced
by
council
member
Reisner.
Are
there
any
comments
or
questions?
B
If
not
ordinance?
1523
is
an
ordinance
amending
the
2023
appropriation
ordinance
and
authorizing
the
auditor
to
make
interfund
transfers.
This
is
introduced
by
council
member
Krell
and
if
no
questions
or
comments,
then
I
will
move
on
to
the
next
one,
which
is
1623
an
ordinance
amending
Athens
City
Zoning
code,
titled,
23,
chapter
23.03,
General
regulations
and
permitted
modifications,
sections,
23.03.1,
23.03.11
and
adding
section
23.03.12
introduced
by
council
member
Grace.
B
Personal
comments
or
questions:
this
is
the
particular
ordinance
that
we
were
having
the
public
hearing
for
earlier
this
evening.
Then
we'll
move
on
now
to
ordinance
1723.
This
is
an
ordinance
amending
certain
sections
of
the
Athens
City
Zoning
code,
title
23,
chapter
23.04,
remitted
uses
section,
23.04.04,
A1,
B1,
neighborhood,
business,
Zone
and
23.04.07
1
and
3.
B
B
B
L
You
president
nicely
as
discussed
at
committee,
these
Appropriations

in

to
the
2023
approach.

will

L
B
M
You,
madam
president,
this
is
rather
short
section
one
at
the
city
council
hereby
declares
the
following:
equipment
and
vehicles
no
longer
needed
for
a
municipal
purpose,
and
it
lists

B
Yeah,
that's
it!
Thank
you
any
questions
or
comments
all
right,
if
not
we'll
move
on
to
22
23..
This
is
an

B
2323
is
an
ordinance
authorizing
the
mayor
to
submit
an
application,
an
injure
into
agreements
with
the
Ohio
Department
of
Transportation
for
a
transportation,
Alternatives
program
Grant
and
a
curb
ramp
improvements
grant
for
Columbus
Road
improvements,
phase
one
and
declaring
an
emergency.
This
is
introduced
by
council
member
Reisner.
Thank.
D
B
M
M
Me
read
the
part
in
a
section
section
one.
The
mayor
is
hereby
authorized
to
submit
applications
to
the
Ohio
Department
of
Transportation
ODOT
for
Grant
funds
through
the
transportation
alternative
program
and
a
curb
ramp,
Improvement
grant
for
Columbus
Road
improvements,
phase
one
and
then
so
on
so
forth.
F
K
Be
the
flat
portion,
it
will
not
be
the
hill
going
up
towards
Lancaster
that'll
be
phase
one
and
it's
gonna
be
sidewalks
on
Columbus
Road.
B
D
B
This
follows
a
ordinance
that
we
had
last
year
that
was
for
estate
settlement.
This
is
a
national
one,
and
this
is
part
of
an
opt-in
program.
We
must
opt
in
to
participate,
you
don't
automatically
become
part
of
it
and
what
this
particular
ordinance
is
doing
is
ratifying
the
mayor's
signature
on
the
agreement.
He
is
the
signer
for
this,
and
so
this
is
introduced
by
all
members
of
council.
B
D
B
B
D
D
B
Aye,
okay,
thank
you
opposed,
nay,
they
have
been
accepted
and
they
have
been
reviewed.
The
motion
to
next
motion
is
to
accept
the
January
2023
Financial
reports.
If
we
could
have
a
motion
for
their
approval.
B
Okay,
all
those
in
favor
signify
by
saying
aye.
B
D
You
president
Eisley
yeah.
This
would
just
be
to
confirm
the
mayor's
appointments
of
both
Deborah
Daniels
and
Michael
Lincoln
to
the
shade
tree
commission.
Both
of
them
are
Master
Gardeners
here
in
town,
I
personally
have
known
Michael
Lincoln
for
a
great
many
years.
He
was
one
of
my
professors
when
I
was
at
OU,
so
I
think
it
would
be
really
really
nice
to
have
our
our
Shades
recommission,
nice
and
staffed
up,
which
this
will
help
do
yeah.
D
B
B
Nay,
this
motion
is
approved
and
they're
welcome
to
the
shade
tree.
Commission
last
item
before
we
adjourn,
is
an
opportunity
for
citizens
to
speak
on
legislative
items
and
city
services
that
have
not
been
covered
on
the
agenda
and
any
member
from
the
audience
who
wishes
to
do
so
if
they
have
something
related
to
these
city
services
may
speak
for
three
minutes.
