Description
Athens City Council - June 20, 2023
A
B
B
Our
first
item
of
business
is
to
establish
a
quorum,
and
we
do
have
five
of
our
council
members
present
tonight,
and
so
we
will
be
able
to
do
business
I'm.
Grateful
next
item
of
business
is
disposition
of
the
minutes
for
the
regular
session
of
council
held
on
June
5th
2023.
If
I
could
have
a
motion
to
accept
those
minutes,.
C
B
Those
in
favor
signify
by
saying
aye
aye.
Thank
you.
The
minutes
have
been
approved.
We
now
have
communications,
I
have
two
items
and
I
know
one
council.
Member
has
another
item.
The
first
is
that
council
members
did
receive
from
the
Ohio
Division
of
liquor
control
an
application
for
a
transfer.
This
is
a
transfer
from
the
Ram
Restaurant
known
as
Louis
Louise
to
the
Bel
Ray
restaurant.
B
The
other
communication
that
I
received
is
today
was
from
Ted
Linscott,
who
represents
the
Southeast
Ohio
Central
labor
Council
of
the
AFL-CIO,
and
he
shared
with
me
an
interest
in
the
council
considering
a
resolution
that
would
be
in
opposition
to
the
issue
1
being
presented
for
voting
on
August
8th,
it's
a
very
important
special
election,
this
August
and
it's
a
very,
very
important
issue,
and
so,
if
there
is
consensus
among
council
members,
we
could-
and
they
have
seen
a
draft
ordinance
of
that.
We
could
move.
B
D
Yes,
thank
you,
president
Eisley,
so
under
Communications,
the
proposed
racial
Equity
resolution
that
was
discussed
a
couple
of
weeks
ago
and
tabled
for
two
weeks,
I
want
to
report
that
is
not
ready
to
be
brought
forward.
Yet
the
community
relations
committee
and
other
interested
parties
will
continue
this
discussion
and
submit
a
revised
version
to
Council
in
August.
B
E
I
just
have
one
to
report
this
evening,
president
nicely
and
I
know
that
you
were
in
the
receipt
of
this
as
well
and
it's
worth
reading
into
record
tonight.
As
a
communication,
this
came
to
us
from
the
members
of
the
racial
Equity
Coalition
and
it
reads
as
follows:
the
members
of
the
racial
Equity
Coalition
of
Athens
County
have
been
meeting
regularly
since
2020,
with
mayor
Patterson
to
provide
feedback
on
the
city's
efforts
regarding
racial
equity
and
anti-racism
work
within
the
city
of
Athens.
E
We
commend
the
city's
commitment
to
the
work
to
advance
racial
equity
and
its
Witness
willingness.
Sorry
to
solicit
here
and
use
feedback
from
diverse
individuals
and
groups
today.
We're
writing
in
support
of
the
ongoing
efforts
of
the
city
of
Athens,
to
strongly
urge
the
Athens
County
Fair
board
to
prohibit
the
sale
of
seditious,
slash
hate
paraphernalia
on
the
Athens
County
Fairgrounds.
Specifically,
we
are
writing
to
support
the
inclusion
of
Section
3
of
ordinance,
50
or
58-2-3.
E
We
believe
that
the
city
must
apply
a
racial
equity
and
inclusion
lens
to
all
its
decisions,
not
only
because
it
is
the
right
thing
to
do,
but
also
because
the
city
declared
racism
as
a
Public.
Health
crisis
in
2020
made
a
significant
statement
in
racial
Equity
training
and
further
contemplating
the
reaffirmation
of
its
commitment
to
promote
racial
equity.
E
E
Oh
I,
have
one
I'm.
Sorry
thank
you.
I
have
one
more
a
bit
of
information
for
council
tonight
and
that
is
on
the
30th
of
June
at
the
community
center.
There
will
be
a
basically
a
recognition
and
farewell
to
our
police
chief
Tom
Pyle,
who
you
all
know
is,
is
retiring
and
so
I
would
encourage.
Would
you
recall
the
time
around
noonish,
noonish,
34
years,
34
years
of
service
to
the
city
and
again
taking
the
helm
as
chief
for
almost
a
decade,
I
would
imagine
doing
a
fantastic
job.
B
We'll
move
on
now
to
ordinances
for
a
third
reading
ordinance
5723
is
an
ordinance
granting
a
special
right-of-way
use
permit
at
one
South
Court
Street
to
the
Athens
County
Board
of
Commissioners
replacement
of
an
election
Ballot
Box
on
the
city
right-of-way
and
is
introduced
by
council
member
Grace
and
council
member
crowl
will
be
speaking
for
her
this
evening.
Thank.
F
A
third
reading
I
do
want
to
read
parts
of
section
two
and
three
section:
two,
the
permit
T
the
Athens
County
Board
of
Commissioners
owner
also
shall
agree
that
the
city
of
Athens
is
maintaining
the
rights
to
install
repair
and
or
replace
its
utility
lines
that
it
determines,
are
located
within
the
permit
area
and
that
the
city
of
Athens,
its
agents
are
assigns
shall
not
be
responsible
for
any
damages
that
might
occur
to
permittee's
property
as
a
result
of
the
installation,
repair
and
or
replacement
of
its
utility
lines
that
are
within
the
permit
area.
F
Section
3
said
permit
shall
be
subject
to
the
following
conditions.
One
this
special
right-of-way
permit
is
personal
in
nature
and
will
be
in
effect
for
a
maximum
of
seven
years
from
the
date
of
issuance
unless
revoked
by
city
council
ordinance
or
there
is
a
change
of
ownership
or
use.
Whichever
comes
first,
two,
the
Athens
County
Board
of
Commissioners
owner
shall
be
responsible
for
the
maintenance
and
upkeep
of
said
right
of
way.
I'd
like
to
make
a
motion
to
approve
5723.
G
B
B
58-23
is
an
ordinance
granting
a
special
right-of-way
use
permit
at
286
West
Union
Street
to
the
Athens
County
Agricultural
Society,
to
place
a
fence
on
the
city
of
right-of-way
and
introduced
by
council
member
Crowell
on
behalf
of
council
member
Grace
and
I
will
share
with
the
public
that
this
afternoon
we
did
receive
from
Treasurer
Ben
AB
fall
the
treasurer
of
the
Agricultural
Society
that
they
have
with
decided
to
withdraw
their
Title
IX
49
application
for
the
special
right-of-way
and
just
a
minute.
I
want
to
defer
to
councilmember
Crowell.
B
F
Second
I
would
like
I'd
like
to
first
thank
the
racial
Equity
Coalition
for
their
support,
but
due
to
the
polling
of
this
permit
from
the
treasurer,
I
would
like
to
table
I'd
like
to
make
a
motion
to
table
5823.
B
F
F
The
special
right-of-way
permit
is
hereby
granted
at
758
West,
Union
Street
to
Seven
Generations
LLC
owner
on
behalf
of
Sunbelt
Rentals,
to
place
a
new
sign
face
on
an
existing
signed
poll
and
a
fence
and
Equipment
parking
10
feet
into
the
right-of-way,
as
indicated
on
the
application
attached
tier
2
and
Incorporated
herein
by
reference.
Thank
you
president
nicely.
B
Nay,
the
motion
carries
and
the
ordinance
is
approved.
6023
is
an
ordinance
authorizing
the
service
safety
director
to
execute
an
expanded,
permanent
easement
and
right-of-way
agreement
with
the
Ohio
power
company,
known
as
AEP
for
installation
of
overhead
electrical
service
at
21,
Kenny
Drive,
introduced
by
council
member
Crowell
on
behalf
of
council
member
Grace.
F
One
Athens
city
council
does
hereby
authorize
the
service
safety
director
to
execute
an
expanded,
permanent,
easement
and
right-of-way
agreement
for
the
total
consideration
of
one
dollar
with
the
Ohio
power
company
and
Ohio
Corporation,
and
a
unit
of
American
Electric
Power
for
installation
of
overhead
electrical
service
to
21
Kenny
drive,
a
copy
of
which
is
attached
here
to
and
Incorporated
herein
by
reference.
Thank
you
president
nicely.
B
A
B
C
You,
madam
president,
I'd
like
to
make
a
motion
that
we
adopt
62-23.
Second,
thank
you.
Member
Carl.
We
discussed
this
in
committee
and
it's
been
read
twice.
The
city
has
been
awarded
a
an
ODOT
safety
program
funds
for
the
construction
of
a
single
Lane
roundabout.
This
ordinance
is
for,
as
it
says,
Engineering
Services
prior
to
the
construction.
B
B
C
You,
madam
president,
I'd
like
to
make
a
motion
that
we
adopt
63-23
as
we've
discussed
in
committee
and
it's
been
read,
the
city's
been
awarded
a
a
program
funds
for
the
rehabilitation
of
Simpson
Avenue
Bridge
of
over
three
million
dollars,
and
this
would
well
if
anyone's
driven
on
the
Simpson
Avenue
Bridge.
They
know
it
definitely
needs
to
be
rehabilitated.
A
G
Yeah
just
a
quick
question
from
Mr
Stone
on
this.
If
I
remember
in
conversation,
there
was
some
reference
that
perhaps
this
bridge
would
have
some
of
the
same
design
or
similar
design
characteristics
as
the
Richland
Avenue
Bridge.
To
get
a
sense
of
you
know,
consistency
within
the
city
in
doing
that,
is
there
a
way
and
I
don't
mean
to
get
in
the
weeds
here.
Is
there
a
way
to
finish
the
bridge
so
that
we
don't
end
up
with
the
type
of
paint
and
peeling
paint
that
is
so
prevalent?
H
G
When
you
come
across
the
Richland
Avenue
Bridge
across
the
Hocking
River
on
either
side,
we
have
cement
or
whatever,
and
you
often
see
this
all
over
the
place
where,
in
a
matter
of
a
year
or
two,
it's
just
like
a
pitted
mess
and
I.
Don't
know
you
know
why
we
can
not
well
see,
we
all
mean
the
city,
but
why
we
continue
to
build
Bridges
and
paint
them
like
that
when
a
short
period
of
time-
and
they
just
look
horrible.
H
H
Maybe
it
was
a
good
idea,
then
for
both
Aesthetics
as
well
as
preservation
of
the
concrete,
because
that
specifically
was
the
paint
on
the
concrete
or
the
coating
on
the
concrete
for
that
bridge,
and
it
turns
out
that
you
know
the
the
way
it
was
applied
was
not
either
wasn't
correct
or
you
know
the
moisture
content
after
the
the
curing
of
the
concrete
wasn't
exactly
right,
and
it
resulted
in
that
that
outcome,
which
is
not
something
we
were
particularly
happy
with,
but
by
the
time
it
started
to
come
off,
the
warranty
period
was
done,
which
seems
to
be
the
way
that
things
like
that
work.
H
What
we'll
do,
as
we
do,
the
design
with
this,
this
Simpson
bridge
is
Will
point
to
that
specific
problem
and-
and
you
know
have
these
experts,
who
are
the
designers,
basically
specify
a
coating
if
we're
going
to
do
that.
That
won't
have
that
outcome,
so
that'll
that'll
be
a
good,
a
goal
of
ours.
On
on
this
one
great,
thank
you.
A
E
A
C
Okay,
thank
you,
madam
president,
I'd
like
to
make
a
motion
that
we
adopt
64-23.
Second,
thank
you,
member
Swank.
This
is
I,
consider
just
basically
a
a
housekeeping
ordinance.
We
discussed
it
there's
a
lot
of
these
yellow
extra
garbage
bag
tags
that
are
still
floating
around
I
I,
certainly
know
in
my
neighborhood.
They
are.
C
B
F
Thank
you,
member
McCary.
This
appropriation
ordinance
has
three
Appropriations
twelve
thousand
five
hundred
dollars
for
vehicle
leasing,
one
thousand
dollars
for
recreation
fund
refunds
over
the
summer
or
at
any
time,
but
Recreation
fund
refunds,
215
000
to
Capital
Improvements
for
our
city
hall,
150th
anniversary
renovation
and
I'll
just
say
that
while
I
was
at
the
Juneteenth
Festival
this
weekend,
I
was
discussing
with
Brian
koshko
out
in
front
of
the
courthouse
and
looking
forward
to
her
return
to
this
building.
Thank
you.
F
B
C
F
You,
member
Eisner,
this
is
a
little
bit
of
bookkeeping,
making
sure
that
the
funds
are
coming
from
the
correct
the
dollars
are
coming
from
the
correct
funds.
Thank
you,
president.
Eisley.
B
A
B
Opposed,
nay,
the
motion
carries
and
the
ordinance
is
approved.
69
23
is
an
ordinance
approving
a
then
and
now
certificate
for
payment.
Today,
I'm
Schroeder
roofing
for
replacement
of
the
community
center
roof
project
number
353
and
declaring
an
emergency.
This
is
introduced
by
council
member
Crowe.
B
Okay,
thank
you
and
this
then,
and
now
certificate.
This
is
a
new
requirement
that
the
Auditors
are
helping
us
to
make
sure
that
we
try
and
process
things
within
30
days
and
it's
requirement
or
hoped
for
that.
We
can
meet
these
requirements
and
this
has
been
implemented
by
the
state
auditor's
office.
B
A
B
B
7123
is
an
ordinance
authorizing
construction
and
construction
engineering
of
the
Stimson
Avenue
water
line,
extension
project,
number
364
and
is
introduced
by
council
member
McCary,
and
if
no
comments
or
questions,
then
we
will
move
on
to
ordinance
7223.
This
is
an
ordinance
authorizing
Engineering
Services
for
design
of
the
Columbus
Road
lift
station.
This
is
Project
number
359
introduced
by
council
member
McCary,
no
comments
or
questions.
B
Then
we
will
move
on
to
7323
an
ordinance
authorizing
the
service
safety
director
to
advertise
and
accept
bids
for
construction
and
construction,
engineering
of
the
city,
sewer
system,
improvements,
project,
number
330
and
declaring
an
emergency,
and
if
no
comments
or
questions,
then
we
will
move
on
to
74-23.
This
is
an
ordinance
authorizing
the
mayor
to
submit
an
application
to
participate
in
the
state,
capital,
Improvement
and
or
Local
transportation,
Improvement
programs
for
issue
One
funds
and
execute
contracts
as
required.
This
is
introduced
by
council
member
Reisner.
B
If
no
comments
or
questions
on
this
one,
we
will
move
on
to
our
last
one
for
second
reading.
This
is
7623
an
ordinance
amending
the
2023
Staffing
levels
authorized
by
ordinance,
14722,
part-time
and
seasonal,
auxiliary,
Patrol
officers
and
introduced
by
council
member
Crowell,
and
that
ends
our
readings
of
for
second
or
ordinances.
For
second
readings.
B
We
move
on
to
the
Motions
to
accept
various
reports
and
appointments
to
commissions.
I
would
like
to
make
an
announcement
that
council,
members
and
I
know
City
Administration
will
be
together
tomorrow
at
9
30
at
the
fire
for
the
fire
station
groundbreaking
and
just
so
Council
all
our
other
council
members
are
aware
of
that
event.
If
you
can
join
us,
that
would
be
wonderful.
A
B
C
C
Make
a
motion
that
we
accept
the
mayor's
nominee
Kate
betterhoff.
Second
great
okay,
I
had
the
pleasure
of
meeting
the
the
appointee
last
week
at
our
Athens
Municipal
Arts,
Commission,
meeting
and
I.
Believe
you
have
someone
in
the
audience
representing
the
organization
who
would
like
to
speak
about
the
nominee
foreign.
I
My
name
is
Devin
sudman
I
am
the
secretary
for
the
Athens
Municipal
Arts
commission
I'm,
here
to
speak
on
behalf
of
Cape
Federal.
She
comes
to
Athens
with
a
lifetime
commitment
to
the
Arts
and
as
an
art
therapist.
She
brings
an
excruciating
or
an
increase
impeccable
duty
to
the
commission
as
we
navigate
some
important
tasks
ahead
of
us
for
the
city.
She
looks
forward
to
being
with
us
and
we
look
forward
to
having
her.
Thank
you.
Thank.
C
B
D
B
E
B
G
I
would
move
that
Richard,
better
and
John
ballantor
be
appointed
and
reappointed
to
the
historian
preservation.
Commission.
