cases

happened

two
years
ago
this
February
my
neighbor,
contacted
me
and
she
indicated
that
she
was
having
some
financial
difficulties
and
wanted
to
know
if
I

interested

buying
the
majority
of
her
land,
which
accounted
for
about
three
point.

nine

acres
of
four
acres
adjoining
land
and
I
was
interested
in
doing
that,
and
so
we
we
agreed
upon
a
price.

drew
up
a
contract,

paid
her.

approached
the
health
department
and
when
they
next
got
back
to
me,
which
was
the
middle
of
April
of
2006,
and
the
administrator
at
the
health
department
indicated
that
the
lot
split
would
not
be
approved
because
for
two
reasons,
number
one:
the
sale,
the
land
had
left
the
seller
in
sufficient
land
for
a
future
leach
field
expansion.
If
that
was
going
to
be
necessitated
at
some
point
in
time
and
then
secondarily
the
soil,
it
was
his
opinion
based
on
a
study
that
he
supposedly
did
that
the
soil
wouldn't
support
a
future
leach
field,
expanding
expansion.

So
the
only
way
he
would
approve
the
lot
split
was
if
I
gave
her
back
three
quarters
of
an
acre
of
the
land
that
I
bought
from
her
I.
Wasn't
really
happy
with
that
conclusion,
because
I
was
fairly
confident.
My
neighbor,
who
I
had
never
known
to
work,
had
probably
spent
that
money
and
so
was
going
to
mean
that
I
would
probably
have
to
give
her
back
three
quarters
of
an
acre
of
land.

we
went
round
and
round
on
that
for
a
bit
I
attended
some
health
department
meetings
board
meetings
and
suggested
that
there
were
alternative
ways
in
which
she
could
adjust
her
leach
field
if
it
ever
did
fail
insulation
of
a
narrator,
a
mound
system.
There
are
various
ways
in
which
we
can
produce
the
leach
field
footprint
and
the
Health
Department
administrator,
nor
the
board
would
buy
any
of
that.

then
argued
that
the
the
chances
of
her
leach
field
failing
were
remote
because
her
system
had
been
installed
just
seven
years
earlier,
when
it
was
discovered
by
myself
and
then
the
Health
Department
that
my
neighbor,
the
one
that
I
was
purchasing
the
land
from
was
openly
discharging
her
sewage
to
within
about
15
feet
of
my
water
source.
So
at
that
time,
in
the
spring
of
2000,
she
was
required
to
install
a
septic
system
and
it
was
permitted
by
the
Health
Department.
So
my
question
was:
how
can
a
a
system
you
know
sonu,
be?

for

upgrade
or
expansion
etc.
I
was
then
said
that
if
I
wasn't
satisfied
with
the
health
department's
findings,
that
I
could
bring
in
a
soil
scientist
to
evaluate
the
situation
and
I
was
provided
three
names
by
the
Health
Department
of
certified
soil
scientists
who
could
conduct
such
a
study
in
and
perhaps
shed
some
further
light
on
the
situation.

So
in
December
of
2006,
a
gentleman
in
Jos
tiger,
who
is
a
retired
sanitarian
from
Fairfield
County
and
also
a
certified
soil
scientist
and
was
on
the
list
of
Health
Department
recommended
people
that
could
do.
Such
a
study
came
to
the
juncture.
This
lot
split
with
the
blessing
of
the
the
seller
and
he
conducted
a
study
and
the
day
that
he
came.
I
finally
received
a
report
from
the
health
department
outlining
in
a
more
concrete
way
why
they
couldn't
allow
the
lot
split.

A
week
later,
I
got
the
report
from
the
soil
scientist,
and
that
was
the
13th
I
believe
in
December
of
2006
and
in
his
report.
He
not
only
identified
that
there
was
sufficient
area,
but
the
soil
was
of
a
quality
that
would
support
a
future
leach
field
expansion
and
he
included
in
his
9
page
report,
a
map
that
showed
two
possible
future
leaching
areas
contained
within
the
cellars
remaining
land.
That
would
allow
her
leach
field
to
be
expanded.

Our
Planning
Commission
meeting
here
recently
not
aware
that
this
was
within
the
city
limits
trying
to
outline
that
the
typical
citizen
in
Athens
is
using
about
a
thousand
gallons
of
water
a
day
and
consequently
discharging
an
equal
amount.
Probably-
and
so
this
this
number
that
they're
throwing
at
us
a
480
gallons
of
discharge
of
days,
is
excessive
and
then
to
conclude
here
in
2000
when
it
was
discovered,
February
2000,
when
I
discovered
that
my
neighbor
was
openly
discharging
her
sewage
to
within
15
feet
of
my
water
source.

I
discovered
that
the
fella
that
was
living
next
to
my
barn
and
across
the
road
he
was
also
doing
the
same.
He
was
openly
discharging,
but
he
was
discharging
onto
the
park.
It
took
two
years
for
the
Athens
City
County
Health
Department,
to
have
him
rectify
the
fact
that
he
was
discharging
openly
and
without
any
system,
and
since
he
was
living
on
my
land
and
had
what
was
referred
to
as
a
life
estate,
the
prospects
of
him
putting
in
a
septic
system
were
slim
to
none
and
so
their
solution.

thousand
gallons
of
the
discharge
is
normal,
because
that's
what
he
had
this
fellow
who
had
no
system
in
2000
and
eventually
made
him
rectify
that
in
2002
and
on
the
other
hand
there
they're
saying
well,
we
need
to
comply
with
this
480
gallons
daily
of
discharge,
which
again
is
an
awful
lot
of
water
usage
for
any
family
and
then
finally,
going
back
to
2000.
At
the
time
the
health
department
told
my
neighbor,
she
had
to
install
a
septic
system.

They
also
cited
her
for
a
large
dump
that
is
at
the
back
of
her
land,
has
changed
hands
now,
but
is
essentially
in
contact
with
the
southern
boundary
of
the
property
that
I've
purchased
from
her.
That
dump
has
not
changed
a
bit,
and
it
is
a
large
dump
I'm
going
to
say
that
it
probably
accounts
for
a
good
half
acre
of
land
and
unfortunately,
I
have
with
me
a
PowerPoint
presentation
that
doesn't
look
like
I'll
get
a
chance
to
share
it
with
you,
but
it
shows
quite
a
bit
of
footage
of
this
dump.

some

it

so
the
Health
Department
has
been
saying
in
their
letters
that
they're
concerned
about
the
public's
health
and
I
understand
that.
But
what
they've
been
doing
out
on
Brown
Road
does
not
really
live
up
to

so
we

to
a
place
now
where
we've
got
a
very
small
lot.

interest

building

that

been

of
inconsistencies

department's
