a

member
in

absence

conflict
of
interest

years

annexed

city

Athens
and
received
a
zoning
designation
at
that
time

go

in
beacon
school,
it's
the
former
location
of
River
Valley
School
is
where
this
is

Williams
came
to
the

It's
been
several
months
ago,
maybe
a
couple
years
ago
and
asked
for
a
similar
permit.

conditional
use
permit
to
establish
a
chiropractic
office
there
and
it
was
reviewed
under
2300.

c7,
which
are
conditionally
permitted
uses
in
the
board,
can
grant
a
conditional
use
permit
for
any
convenience
or
service
establishment,
supplying
commodities
or
performing
services,
primarily
for
residents
of
the
neighborhood.
And
then
there
are
a
couple
restrictions.

appellant,
and
for
that
information,
if
you
have
some
questions,
I
think
it'd
be
best
if
she
answered
those
questions
regarding
the
extent
and
nature
of
the
business,
but
in
its
most
basic
terms,
it's
a
preschool
daycare
and
there's
some
I
think
there's
some
indication
here.
That's
anything
any
child
from
six
weeks
to
12
years
of
age,
so
it's
not
doesn't
technically
meet
the
definition
of
a
school
that
would
even
be
principally
permitted
even
in
our
one
district,
so
I'll.

Board
of
Zoning
Appeals
may
authorize
the
issuance
of
a
conditional
use
permit
in
accordance
with
the
following
provisions.
So
this
is
akin
to
your
findings.
For
a
various,
but
not
quite
exactly
the
same,
the
board
must
find
that
the
use
is
permitted
in
the
zone,
so
yep,
for
example,
establish
that
it's
a
service
business
for
the
neighborhood

each
conditional
each
conditional
use
is
considered
as
an
individual
case.

that's
why
we're
here
tonight
and
that
the
conditional
use
complies
with
all
applicable
city
regulations.

hear
an

there

things
that
I
don't
even
review
as
a
Zoning
Administrator
they
automatically
get
forwarded

one

those
and
it's
called
original
jurisdiction
employed
and,
besides.

heard
a
case
not
simple,
well
kind
of
similar
to
this,
where
the
dance
factory
wanted
to
move
from
factory
Street
to
the
old
church,
on
Ohio
Avenue,
and
because
there
was
a
presentation
that
the
dance
requirements
went
toward
an
educational
requirement
of
the
state
for
home
school
children
to
meet
their
physical
education
requirement.
The
board
said
that
a
permit
was
not
necessary.
It
was
an
effective
school.
It
was
principally
permitted
in
an
r1.
So
this
one's
kind
of
the
same,
but
it's
different.
It's
there's,
no
I,
don't
know
of
any
educate.

getting
to
is:
if
the
board
decides
that
I
misinterpreted
the
code,
just
as
you
determined
in
the
Ohio
Avenue
case,
that's

then

provision
for
children
of
public
education
age
should
be
considered
a
principally
permitted
use
and
not
have

the
board

any
zone.

I
currently
reside
at
10
West
4th
Street
in
the
plains,
and
I
am
the
co-owner
of
stages,
Early
Learning
Center,
which
is
the
child
care
center
that
we
are
proposing
for
tonight,
rented
by
dr.
Williams
at
all-star,
chiropractic
and
the
nature
of
the
business
is
providing
childcare
for
infants
through
school-age
children.
Six
weeks
to
12
years,
12
years
of
age,
we
will
have
an
infant
room,
toddler
room,
a
full-day,
preschool,
half-day
preschool
and
then
an
after-school
program
totaling
around
76
children.

Our
current
hours
of
operation
that
we're
looking
at
is
7:30
a.m.
till
5:30
p.m.
most.
The
time
for
drop-off
in
regards
to
parking
and
egress
from
the
street
would
be
from
7:30
to
9:00.
So
not
all
children
would
be
arriving
at
the
same
time.
Unlike
a
school
setting,
pick-up
and
drop-off
would
be
around
7:30
to
9:00
or
9:30
and
then
again
from
anywhere
from
3:30
to
5:30
in
the
afternoon.
So
there
wouldn't
be
a
total
of
76
cars.
There
I
don't
current
times
parking
in
regards
to
the
facility.
When
dr.
D
Williams
came,
he
talked
about
the
20
improved
parking
spots
that
has
been
completed
and
we're
looking
at
additional
spots
within
the
next
six
months
or
so
so
there's
at
least
40
parking
spots
there.
Currently
it
was
a
previous
school
and
there
used
to
be
a
previous
full-day
preschool
within
that
building
in
the
same
room
that
we're
doing
our
preschool
facility.
The
certificate
of
occupancy
right
now
is
at
a
level

for
a
business,
and
dr.
Williams
is
working
with
the
state
right
now.

that
code
level

which
would
allow
two
and
a
half
year
olds
and
under
to
occupy

space
that
we're
currently
in.
We
would
also
be
applying
for
a
state
license
through
the
Ohio
Department
of
Job
and
Family
Services,

state
inspector
that
would
come
down
and
inspect
our
facility
twice
a
year
and
that's
in
regards
to
permits
other
than
the
food
license
permit
through
the
Athens
City
Health
Department.

we're

early
learning
content
standards
from
the
Ohio
Department
of
Education
and
within
that
curriculum,
there's
different
objectives
that
the
preschool
children
would
be
learning
math,
science,
social
studies,
literacy,

and
we
would
take
themes
based
on
around
that
curriculum
and
provide
them
with
activities
that
they
would
learn
throughout
the
school
year.
So.

Ohio
Department
job
Family
Services
we're
not
required
to
have
licensed
teachers
to
do
that.
Obviously
it
would
be
great
if
we
could
hire
them.
They
just
have
to
have
a
high
school
diploma
and
have
experience
working
with
school-age
children,
but
any
of
our
teachers
that
would
be
working.
Our
facility
are
required
by
the
state
to
have
15
in-service
hours
per
year
and
child
development.

before
we
get
approval
from
from
the
state
based
on
our
square
footage,
because
it's
35
square
feet
per
child,
the
full-day
preschool
we
will
have
24
children
and
the
half

preschool
will

children.

full-day
preschool

half-day
preschool
will
run
the
same
curriculum
up
until
lunchtime.
So
that's
the
early
learning
content
standard
so
we'll
have
36
children
enrolled
in
the
preschool
program.

for
those

a

occupation,
and
so

board
never
did
hear
that
case.

area

designed
to
cause

interference
with
traffic

seemed
when

out

that
that
was
so

don't

anybody

chance

so
it's
been,

been
filling
all
of
these
requirements

asking

review

a
previous
case
in

1995
that
originally
Gantt
granted
a
use
variance
for
a
snug,
and
there
have
been
some
complaints
and
he
wants
a
review
of
the
case.
And
could
you
come
up
Steve
and
give
us
a
little
little
bit
of
background.

I
can
gather
from
reading
the
record?
It
was
considered
to
be
possibly
a
manufacturing
use
and
that
zoning
out
there
is
b3
general
business
so
before
a
use,
permit
variance
can
be
granted.
The
Planning
Commission
has
to
weigh
in
and
and
send
something
to
the
board
design
appeals
I
mean
that
resolution.
It
mentioned
several
things
that
they
had
concern
about,
including
the
potential
need
for
filtering
systems
on
range
hoods
to
control,
odor
and
emissions.

So
that's
the
memo
that
went
then
to
the
floor.
Design
appeals
also
in
the
packet,
then,
is
a
resolution
of
the
board
dated
March
xx
1995
and
it
talks
quite
a
bit
about
the
size
of
the
area
in
grants.

flood
special
flood
hazard
area,
development,
variance
for
construction
below
the
required
protection
level,
but
there's
no
there's
no
statement
about
for
a
comment
on
odor
control
included
in
the
board's
resolution.

was
very
early
on
in
my
employment
with
the
city
and
my
recollection
of
the
Zoning
Board
meeting
was
there
was
a
presentation
by
the
architect
for
the
project
who
described
in
quite
a
bit
of
detail
the
filtering
system
that
would

address
the
concerns
expressed
at
the
Planning
Commission
about
odor
and
different
noxious
emissions.

he

also
have
a

letter
that
I
wrote

net
related

same
complaint.

barely
regularly
has

go
out
and
address
a
complaint
regarding
odor
I
didn't
know
quite
sure
how
to
address
this.

I
worked
with
the
law
director's
office
to
see
how
could
this
be
brought
back
to

board

just
seems
to
be
a
reoccurring
problem,
so
you
may
receive
some
testimony
tonight
about
how
recurring
it
is
from
an
adjoining
property
owner
to
make
a.

I,
am
one
of
a
three
member
management.
Team.
I
probably
have
the
most
longevity
with
ace
net
in
that
I've
been
involved
with
the
development
of
the
food
ventures
Center
since
1992,
so
I
actually
was
in
person
for
some
of
those
other
variances
when
we
needed
to
get
the
floodplain
variance
back
in
1995.

So
that
was
the
one
meeting
that
I
think
Steve
referenced
early
on.
What
I've
tried
to
do
and
I'm
sure
some
people
are
familiar
with
the
food
ventures
Center,
which
is
the
property
located
at
98
North
Columbus
Road,
the
first
two
business
incubators
facilities
on
the
athens
ace
net
campus
were
opened
in
1991
in
1995
we
finalized
the
purchase
of
a
property
adjacent
at
98,
Columbus
Road,
and
that
has
been
the
property
that
we
have
developed
the
commercial
kitchen
in
or
as
we
refer
to
it,
the
food
venture
Center.

In
1995
we
developed
the
facility,
it
was
approximately
9,000
square
feet
and
there
was
a
central
kitchen.
So
when
our
architect
appeared
at
the
Zoning
Board
of
Appeals
to
discuss
the
floodplain,
when
the
issue
of
a
filtering
system
came
up
in
discussion,
we
identified
all
the
regulations
or
compliance
that
we
met
at
that
point
in
time.
In
our
central
kitchen
in
1999,
we
developed
an
expansion
project
for
this
facility.
So
if
you
look
at
the
initial
photograph,
our
original
footprint
was
approximately
9,000
square
feet.

Some
people
probably
remember
it
as
Mitch
ndex,
mattress
warehouse,
and
it
was
just
an
open
building
that
had
retail
in
the
front
and
warehousing
in
the
back.
So
we
did
substantial
renovations
to
the
property
before
we
opened
in
1996.
The
rear
two-thirds
of
the
building
were
the
commercial
kitchen
area.
The
front
third
of
the
building
was
retail
area,
a
conference
room
and
ten
offices
that
part
of
the
building
remains
the
same
in
2007.

Initially,
all
the
processing
happened
in
the
rear
third
of
the
building,
and
that's
where
the
central
kitchen
is
where
the
central
kitchen
still
is.
Today
in
1999,
we
added
a
3,200
square
foot
warehouse.
Initially,
we
had
two
docks
on
the
side
of
the
building
and
you
can
see
still
one
small
original
dot
on
that
side.
When
we
added
the
warehouse,
we
added
two
additional
docks
that
certainly
accommodated
some
of
the
larger
delivery,
the
semis
that
we
have
actually
bringing
product
or
delivering
product
from
our
tenant
firms.

The
thermal
processing
room
at
that
point
in
time
was
created,
and
this
is
a
dedicated
thermal
processing
room
different
from
the
central
kitchen
and
I
think
our
neighbor
is
most
concerned,
probably
with
some
of
the
aromas
coming
from
that
processing
area.
The
central
kitchen
again
is
more
in
the
back
part
of
the
building
I
relish
you
to
breath
blueprints
and
the
thermal
processing
room
and
the
packaging
room
are
now
in
the
middle
third
of
the
building.

So
if
you
look
at
this
small
dock
door
behind
that
door,
there's
an
open
space,
then
there's
interior
double
doors
and
that's
where
our
dedicated
thermal
processing
room
is
in
that
was
retrofitted
in
1999.
We've
added
a
central
exhaust
system.
At
that
point,
when
we
open
that
room
for
business
approximately
in
late
99,
early
2000
and
then
in
response
to
some
of
the
concerns,
we've
added
additional
exhaust
and
what
we
would
hope
outer
control.

if
you
continue
to
flip,
you

see
in
the
thermal
processing
room,
here's
the
exhaust
system,
we
added
in
99
and
2000.
There's
a
vent
system.
We
added
an
ozone
Zener
generator.
That
is
a
piece
of
equipment
that
looks
like
that
and
what
that
does.
Is
it
hopefully
conditions
the
air
so
that
when
the
air
is
filtered
through
the
exhaust
system,
it
neutralizes
any
of
the
odors
that
are
produced
in
the
thermal
processing
room,
and
that
is
on
at
all
times
whether
the
room
is
in
operation
or
no.

weekdays
and

mornings
are
a

problematic

disturb

neighbors.

doctor,

doors

the
thermal
processing
room,
the

doors

closed

times

So
that
was,
we
thought
our
airlock.

we

additional
airlock
outside
the
thermal
processing
room,
the
hallway
and
again
I
don't
have
the
the
footprint
might
might
have
to
be
reconfigured
a
little
bit

we're
in
terms
of
some
of
the
other
state.

we're
regulated
by
the
FDA,
the
Ohio
Department

Agriculture,

County
Health

think

to
get
some
expert
opinions
in
terms
of
what
we,
what
would
be
doable
well.

would
still
want
to
meet
with
the
third
local
fire
department
as
well,
and
have
a
meeting

minds
between
our
architectural,
firm

exactly
across
from
a
snap

I
guess
I'm
here

tell
you
guys
what
we
have
to
go

they're

not
like
just
dicing

few
little
onions
and
putting

hot
dogs.

it's
a
real,
stringent
smell
and
it'll
burn
your
eyes.

complaints
from
the
customers,
I

complaints
from
all
the
employees

What
are

gonna
do
about
that?
Well,
here,
I
am
tonight.
The
thing
with
ace
net
is
that
equipment
over
there
is
not
up
to
standard
a
little
magic
door
thing,
that's
that
they
just
don't
have
enough
equipment
to
handle.
You
know
six
to
eight
hundred
pounds
of
onions,
cooking
it'll,
bring
tears
to
your
eyes,
and
the
wind,
of
course,
is
always
blowing
our
way.
You
know
for
some
reason:
I
guess
we're
just
lucky,
but
you
know
it's
bad
for
our
customers.

can
actually
feel
it
burning
your
skin.
Even
we've
even
had
people
from
the
code
office
come
down
and
say
hey.
We
know
what
you're
talking
about,
because
you
know
tears
are
rolling
out

eyes

not

just
the
door
being
open
over
there.
That
equipment
is
just
not
it
just
can't
handle
what
they're
doing
there
is
this
indefinably
monthly.
