the
agenda

related
to
our
cable
franchise
and
it's
on
the
Planning
and
Development
Committee
agenda,
because
there's
a
related
issue
with
right-of-way
that
we're
going
to
end
up
talking
about
in
the
near
future.
You
may
recall
Senate
bill
117,
which
changed
the
rules
for
cable
franchising
in
Ohio.
We
discussed
it
when
that
was
pending
in
the
legislature.

It
was
amended
so
some
of
the
things
that
cities
were
most
concerned
about
I
think
have
been
improved,
but
there
it
is
still
a
pretty
significant
change
where
cable
franchising
is
going
to
be
done
by
the
commerce
department
at
the
state
level.
What
we
have
before
us
that
we
need
to
do
really
soon
is
through
our
existing
franchise
agreement,
where
we're
allowed
to
maintain
that
and
still
get
our
franchise
fee.

we
pass
an
ordinance
saying
that
we
would
still
like
to
get
our
franchise
fee,
and
we
have
to
do
that
before
September
23rd,
which
is
the
effective
date
of
the
law.
So
that's
why
we're
going
to
be?
It
has
an
emergency
clause
attached
to
it
and
we'll
be
asking
for
a
suspension
of
the
rules
on
that
this
evening,
I'm,
not
an
expert
on
this
and
Gary's
here

So

he

outline

some
of
the
the
changes.
The
the
important
ones
as
Debbie
mentioned,
is
the
matter
dealing
with
cable
franchise
fees.
The
Senate
bill
117,
which
is
now
on
I,
revised
code
chapter
13
32,
provides
that
expiring
franchise
fees
can
only
be
maintained
if
the
City
Council
adopts
an
ordinance
saying
they
desire
to
maintain
them
up
to
their
existing
level,
and
we
have
it
in
our
city
code
that
our
franchise
fee
is
5%.
So
it's
not
in
our
franchise
agreement.

The
other
important
thing
to
remember
about
the
the
definition
of
gross
receipts
has
changed
in
the
favor
of
people
operators,
so
we
may
see
some
reduction
in
the
amount
of
fees
that
are
paid
to
the
city
of
Athens
as
a
result
to
change
the
definition
of
gross
revenues,
we
had
a
very
broad
definition
in
our
code:
ordinances
and
they're,
not
going
to
fees
and
taxes
and
etc.
One
important
thing
that
we
can
keep.
That's
in
the
ordinance
tonight
is
advertising
revenues
again.

law
says
you
can
only
keep
that
if
you
so
designated
an
ordinance
that
you
want
to
keep
the
advertising
revenue
so
we've
put
in
the
ordinance.
We
want
to
keep
the
advertising
revenues.
It's
really
kind
of
a
minefield
for
cities.
You
have
to
do
the
ordinance
saying
you
want
to
keep
these
things
and
then,
after
you
get
a
notice
from
the
cable
company
that
they
want
to
be
the
new
service
provider.
Pursuant
to
the
new
state
law,
you
have
10
days
to
notify
them
that
you
have.

fact
it's
an
ordinance
saying
you
want
to
keep
these
fees
since
the
ordinance
or
the
state
law
becomes
effective
on
September
23rd.
We
need
to
be
in
have
this
enacted
tonight
so
that
my
office
can
get

notice

to
receive
notice
from
time
warner.
Probably
on
the
24th
of
september.

can't
outline
for
you
a
couple
other
changes

the

it
is

a

toward
cities,

it's

good
as
it

services

local
programming
to
maintain

obligation
for
tech

peg
channels
anymore,

given
to
the
city
several
years
ago

peg
channels
for
equipment

the

of
