A
Good
evening
welcome
to
Athens
City
Council
tonight
is
Monday
December
3rd
2006,
2007
and
City.
Council
tonight
is
meeting
regular
session.
We
do
have
a
quorum
with
67
members
present
under
communications.
I
am
in
receipt
of
a
letter
from
the
department
of
liquor
control
that
I'm
going
to
read
very
quickly
here,
dear
clerk
of
legislative
authority.
The
purpose
of
this
letter
is
to
notify
you
that
all
permits
to
sell
alcoholic
beverages
in
your
political
subdivision
will
expire
on
February
1
2008.
A
In
order
to
maintain
permit
premises,
every
permit
holder
must
file
a
renewal
application,
Ohio
Revised,
Code
4303
point
271
B
provides
the
legislative
authority
with
right
to
object
to
the
renewal
of
a
permit
and
to
request
a
hearing.
The
hearing
may
be
held
in
the
county
seat
of
the
county
in
which
that
our
permit
premises
is
located.
If
that
request
is
made
in
writing.
This
will
be
your
only
opportunity
to
object
to
the
renewal
of
a
liquor
permit
from
the
SIS,
which
might
be
a
problem
in
your
community.
A
That
gives
you
the
gist
of
what
we
are
in
receipt
of.
If
any,
we
it
goes
on
to
tell
the
procedure
that
must
be
followed,
that
if
any
member
of
Council
hears
from
someone
that
they
would
like
to
object
to
one
of
the
permit
holders,
the
letter
will
be
on
file
in
the
clerk's
office
and
we
could
take
it
under
advisement.
Are
there
any
other
communications?
Anyone
wishes
a
sheriff.
B
A
lady
likes
our
traffic
signal
freebies.
Your
notification
was
awarded
$15,000
great
this
past
week.
Well
put
another
15,000
cash
with
that
and
then
we'll
have
employees
time.
That
would
mean
in
all
the
traffic's
37th
traffic
signals
in
town.
We
would
all
be
led
by
the
time
that
project
is
completed.
Wonderful.
A
Great
questions
for
the
mayor
anything
else:
Thank
You,
mayor,
Abel,
well,
director
hunter
annually.
Okay,
I
do
notice
that
we
have
an
executive
session
later
on
in
the
agenda
ordinances
for
third
reading
ordinance,
one
3507,
an
ordinance
approving
the
final
plan
of
the
University
of
State's
residential
single-family
loss
phase.
Two
and
grantee
variances
remember
goals
at.
C
A
In
a
second
to
table
ordinance,
130
507
for
their
discussion
on
tabling
the
ordinance,
all
those
in
favor
of
tabling
ordinance,
135
aye
opposed
the
ordinance
has
been
tabled,
ordinance,
137
and
7
an
ordinance
authorizing
the
mayor
to
submit
an
application
and
enter
into
a
grant
agreement
with
the
Ohio
Bureau
of
workers,
compensation
for
safety
grant
member
sands.
Mr.
D
President,
at
this
time,
on
adoption
of
ordinance
1
3707.
Second,
this
grant
is
available
to
us,
through
the
Bureau
of
workers,
compensation
to
purchase
some
ferg
anomic
equipment
in
this
particular
case
for
cement
for
the
employees
of
the
government
channel.
This
would
be
some
desks
that
would
have
comedy
better
positioning
of
monitors
and
keyboards
etcetera
chairs
to
go
with
those
the
other
options,
such
as
that
further.
A
Discussion,
all
those
in
favor
of
adoption
of
ordinance
137
opposed
the
ordinance
has
been
adopted
onto
ordinances
for
second
reading
ordinance,
130
207,
an
ordinance
amending
the
athens
city
code,
title
5,
water
and
sewer
regulations,
coordinate
130,
807,
an
ordinance
establishing
a
policy
to
allocate
funds
for
public
art,
ordinance,
1
4007,
an
ordinance
granting
a
revocable
license
to
Howard.
Well,
sir
owner
66,
Maplewood
Drive
to
allow
a
fence
to
encroach
into
the
city
right
away
there.
A
A
A
D
President
I
move
adoption
of
ordinance
140
307
thanks.
This
is,
as
the
title
says,
some
sewer
work
on
fern
alley.
We,
the
city
not
too
long
ago,
get
some
sewer
work
on
fern
alley
and
we
hope
the
fact
they
addressed
the
problems.
But
we
were
made
aware
by
several
landlords
by
several
property
owners
back
in
the
summer
that
the
problems
had
not
been
addressed,
and
so
we
authorized
the
expenditure
of
about
150,000
dollars.
The
work
is
completed.
D
A
Discussion
on
adoption
of
ordinance
143,
all
those
in
favor
of
adoption,
of
the
ordinance
opposed.
The
ordinance
has
been
adopted.
Honda
ordinances
for
first
reading
organs,
144
and
seven,
an
ordinance
granting
a
variance
from
the
athletes
city,
subdivision
regulations,
dialing
clark
for
property
located
outside
the
corporate
limits,
but
within
the
3-mile
jurisdiction.
C
President,
this
ordinance
came
to
us
simply
because
there
is
a
shared
easement
for
a
driveway
on
the
property.
Otherwise
it
wouldn't
have
come
before
us
at
all.
We
do
have
the
written
recommendation
from
the
Planning
Commission,
so
people
should
have
received
that
in
their
mailboxes
I
think
it's
pretty
straightforward
for.
A
D
President
that
we
consider
ordinance
40507
rules
this
time,
the
suspension
is
due
to
one
portion
of
this
ordinance.
Look
at
the
ordinance.
There
are
four
appropriations
from
the
unappropriated
balance
and
the
last
one
is
for
a
payment
for
the
community
center
debt
fund,
which
is
actually
was
actually
due
on
December
1st.
A
D
President
I
move
adoption
ordinance
one
40507.
Second
again,
this
ordinance
has
several
appropriations
within
it.
The
first
of
all,
you
see
is
twenty
nine
thousand
two
hundred
and
fifty
dollars
to
the
emergency
shelter
grant.
This
is
actually
a
pass
throughs
or
granted.
We
administer
for
the
good
works
shelter
on
Central
Avenue,
and
this
would
be
the
last
portion
of
that.
That
would
be
moved
on
to
two
good
works.
D
D
D
D
D
A
Motion
and
second,
to
adopt
ordinance
140
thousand
seven.
It
was
further
discussion
on
the
ordinance
called
in
some
favor
of
adoption
of
Oregon's
145
hi
Vincent's
been
adopted,
coordinates
146
and
seven,
an
ordinance
amending
the
2007
appropriation
ordinance
and
the
2007
interfund
transfer
organs.
Member
sands.
Mr.
D
D
The
DUI
court
grant
fund,
so
there
are
several
move
portions
to
this.
First,
it
appropriates
35,000
101
dollars
from
the
unappropriated
balance
to
the
drug
court
fund
236
and
then
that
in
the
gold
print
at
the
bottom
and
in
Section,
two
five
section,
two
that
is
then
appropriated
to
the
to
the
general
fund.
D
E
D
H
D
C
A
A
D
D
D
D
A
G
D
Three
to
four
thousand
three
hundred:
seventy
five
dollars
for
the
fourth
quarter
of
2006
administrative
fees.
For
us
to
be
running
this
keeping
track
of
our
payments
billing
to
us,
etc.
We
we
did
receive
this
bill
until
recently,
I
deduce
a
fire,
your
ability
tonight
and
I'm
sorry
the
amount,
the
total
amount
of
four
thousand
three
hundred
seventy
five
dollars.
D
D
F
B
We
get
a
discounted
price
because
they're
doing
in
the
bulk
and
they
purchased
this
from
a
wholesaler
and
it
distributes
all
of
the
diesel
fuel
and
regular
gasoline
fuel
for
all
university
vehicles
in
the
city
of
vehicles
and
they
what
they
do
for
the
administration
is.
Each
vehicle
receives
a
card
which
you
then
put
into
the
pump
just
like
a
credit
card.
It
then
logs
to
that
particular
vehicle.
D
D
F
D
I
E
A
B
B
A
But
always
before
it
had
just
gone
through
this
an
appropriation
type
thing
and
we'd
never
seen
the
administration
of
it
broken
out
like
this,
so
I
yeah
boy,
nobody
likes
to
pay
administrators.
Do.
Thank
you.
There
further
discussion
on
ordinance
for
I
think
we're
up
to
adoption
on
Joseph's
suspension
on
suspending
the
rules
too
pay
a
prior
year
bill
known
as
waters,
one,
forty,
seven
and
seven
all
those
in
favor
suspending
the
rules
posed.
F
A
D
This
I
good
luck,
explaining
that
in
this
ordinance
was
one
that
we
dealt
with
at
the
end
of
last
calendar
year,
where
the
auditor
listed
all
the
funds
that
had
anticipated
receipts
and
they
didn't
come
in
to
fall
down,
and
so
we
backed
those
out
and
then
we
needed
to
put
them
back
into
the
new
budget,
not
correct
time.
So
this
this
ordinance
is
a
an
omnibus
kind
of
ordinance
that
authorizes
the
audit
auditor
to
do
all
that
to
reduce
the
Appropriations
from
the
2007
and
then
the
understood
part
is
that
it
and
to
reauthorize.
C
D
D
D
D
I
H
A
G
C
I
think
part
of
the
issue
was
there,
were
you
know,
bills
coming
in
for
things?
You
know,
expenses
that
we
incurred
during
the
year
and
then
because
we
had
to
unappropriate
this
money.
There
were
bills
that
came
in
and
we
ended
up
having
to
do
things
under
suspension
at
the
beginning
of
the
year.
So
it
just
was
a
different
process,
but
you
know
we'll
just
when
bills
come
in,
we'll
have
to
appropriate
the
money
or
make
sure
that
it's
in
in
the
original
appropriation
just
to
cover
things
that
the
bills
haven't
come
in.
E
While
okay,
so
I
just
say,
this
is
a
very
on
the
bus
situation
here.
So
are
we
going
to
actually
get
a
list
of
numbers
so
eventually
is
that
the
case
I
mean
we
just
spent
time?
Looking
at
you
know,
20
different,
you
know
fees
for
administration
fee
for
gasoline
tanks.
You
know,
and
yet
we've
got
this
one
which
is
zero
out
a
whole
mess
of
stuff,
and
then,
if
we
don't,
we
have
to
pay
a
bill
next
year.
We're
gonna
be
scrambling
again
that.
A
Is
I
see
it
as
probably
the
major
downfall
of
this?
Now
when
we
were
in
council
office
a
little
bit
ago,
I
was
kind
of
shuffling
through
the
latest
auditor's
report
that
we
got
to
see
if
this
was
addressed,
because
last
year
was
a
first
time.
We
went
through
this
accounting
gymnastics
that
everybody
seems
to
have
a
lot
of
trouble
with
the
auditor
I
wish
were
here
tonight.
The
khalsa
says
one
that
we
thought
should
have
been
closed
to
me
and
again
this
year,
but
you
know
state
auditors
being
what
they
are.
D
Mr.
president,
this
ordinance
does
exactly
what
it
says
presents
a
non-union
personnel
salary
as
fringe
benefit
package.
We
talked
earlier
about
package
with
regards
to
the
deductible
or
the
insurance
plan.
Currently,
employees
are
paying
about
20
percent
of
what
we
call
the
fixed
costs,
the
insurance
plan
and
their
monthly
deductible.
Those
fixed
costs
are.
D
Things
like
our
stop-loss
concerns
and
the
administrative
fees
with
her
dark
insurance
in
the
2007
budget.
They
would
be
paying
twenty
four
dollars
and
sixty
nine
cents
a
month
for
single
coverage
$44.50
a
month
for
family
coverage,
so
it's
still
a
very
reasonable
deductible,
but
it
does
increase
it
from
20%
to
30%
of
those
fixed
costs.
That's
the
traditional
plan
where
there
are
certain
deductibles
and
for
service
for
covered
medical
expenses.
D
J
Just
a
clarification,
something
we
haven't
really
talked
about
under
number
17
city
and
county
jointly
fund
the
position
we
had
the
animal
control
officer
there
and
we
were
told
last
week
that
the
police
would
like
to
do
something
different
with
that.
We're
not
putting
benefits
in
the
budget
are
we've
mayor,
I
think.
F
A
B
But
let
me
preface
my
remarks
by
saying
that
we're
going
to
discover
clerical
errors
in
the
next
two
weeks.
Just
as
earlier
tonight,
you
authorize
25,000
dollars
extra
in
the
depth
fund
for
the
community
center.
That
was
one
of
those
that
didn't
get
caught
last
year,
because
I
used
the
prior
year's
figure
and
didn't
update
it.
B
So
those
are
the
types
of
things
that
the
auditor's
office
and
myself
and
any
council
members
are
more
than
welcome
to
try
to
pick
up
on
those
talk
wherever,
if
it
does,
it
looks
funny
ask
the
question
if
that
never
hurts,
because
otherwise
we
can't
get
ourselves
into
that
situation
once
again,
where
we're
asking
to
suspend
the
rules,
because
we
have
straightest
own
now,
and
this
is
a
rather
complex
little
file
all
right,
but
having
lots
of
fun
with
it.
The
last
last
few
days,
I'm
going.
B
So
I
wait
to
the
end
and
the
final
cost
allocations
and
I
lose
the
kindest
excited
over
to
the
300.
So
that'll
be
one
of
the
clerical
things
that
I'll
have
to
do
like
this
would
look
a
little
different
than
what
you
are
used
to
it.
This
budget
really
adds
no
positions
anywhere
within
the
city.
It
does
if
you'll
notice
in
the
police
department
right
now-
and
you
will
have
to
probably
adjust
this
because
it
fully
funds
the
five
positions
we're
seeking.
B
We
know
who
you
are
not
going
to
have
those
positions,
January
1,
so
to
a
certain
degree,
do
we
over
budget
for
that,
anticipating
that
might
have
to
call
in
other
officers
on
overtime
to
do
it,
but
to
give
you
somewhat
more
of
a
true
picture
of
what
it
is,
they're
they're
included
in
there
and
you
can
see
when
answer
you
will
see
just
going
down.
Animal
Control
still
has
the
two
and
300-series
lines:
I
have
graphed
all
the
people
out,
I
haven't
got
the
supplies
out.
Do.
I
B
Please
because
I've
been
concentrating
on
the
people
aspect
of
this
first,
because
it's
the
most
complex
level
in
general,
we'll
be
running
about
the
same
budget
around
right.
Now,
it's
at
twenty
nine
million
dollars
of
which
11
million
of
that
is
in
the
general
fund
and
obviously
in
the
general
fund,
six
a
little
over
eighty
percent.
Almost
eighty
one
percent
of
people
cost
because
that's
that's
what
we're
primarily
provide
his
Police
Fire
auditor's
office.
My
office
counsel,
governmental
code
enforcement.
B
J
Bang
we
were
able,
thanks
for
taking
that
money
out.
Animal
control.
I
was
wondering
if
under
fun,
271
community
center
operations.
There
could
be
a
mistake
in
that
because
you've
increased
supplies
and
services
by
forty
thousand
between
two
thousand
six,
two
thousand
seven,
and
while
you
reduce
tenant
capital
outlay,
but
it
don't.
You
think
it
should
be
over
a
million,
maybe
I'm
totally
adding
up
wrong,
but
I
guess
I
can't
argue
with
Excel.
J
J
B
B
E
E
F
E
B
Seeing
a
lot
of
that
is
just
debt
service
because,
okay,
like
for
example,
we
paid
two
million
dollars
on
the
estate
Street
last
year,
so
that
was
a
long.
That's
1.7
million
dollars,
that's
$300,000
different!
We
paid
a
hundred
and
fifty
thousand
dollars
off
on
the
community
center.
What
I've
got
scheduled
this
year
is
to
pay
off
the
park
it's
to
park,
its
parking
garage
rather
debt.
It's
down
to
two
hundred
thousand
dollars
going
into
November
I
think
we
had
over
200,000
unappropriated
cash
balance
in
the
fund.
B
So
let's
try
to
pay
it
off
next
June
but
I
think
by
then
we
would
have
it
in
that
way
that
that's
gone
so
as
you're
paying
down
debt.
It
does
open
up
because
I
have
not
added
into
here.
You
had
the
sewer
fund
debt.
Yeah
I've
got
the
sheets
from
the
auditors,
but
I've
gotta
figure
out
how
much
reality
is
there
and
it's
not
in
there.
Yet.
Okay,
okay.
C
C
Have
a
quick
question
in
looking
at
the
version
you
gave
us
last
week
and
the
version
we're
looking
at
tonight:
you've
taken
out
the
salary
for
the
animal
control
officer,
but
we're
still
spending
more
overall
in
salaries
and
I
just
wondered
are
those
additional
part-time
positions.
It
looks
like
in
several
different
departments.
They're,
you
know,
set
a
couple
thousand
dollars
more.
You
know
from
this
week's
version
then.
Last
week.
B
I
mean
is
just
taking
a
look.
You
know
I
asked
last
week
how
much
do
I
do
for
the
non-union
employees
you
said
raise
pool
three
percent
while
went
in
the
budget?
Okay.
So
if
you
do
like
three
percent
wage
pool
and
start
plugging
that
into
everybody,
that's
in
everybody
in
the
general
funds
now
and
pers
increases
and
all
the
other
stuff
that
goes
along
with
wage
increase.
You
know,
okay,
so.
J
B
J
B
It's
like
a
number
of
different
things
that
I
had
to
go
in.
There
is
like,
for
example,
I
made
an
assumption
on
the
open
positions
of
the
Service
Safety
Director
in
the
city,
planner
that
the
administration
has
the
ability
to
pay
up
to
the
bottom
rate
plus
25%.
So
that's
what
I
budgeted,
because
they
could
potentially
do
that
anything.
Above
and
beyond
that
they
have
to
come
to
Council
for
so
I
to
me
it
was
the
area
to
budget,
for
they
might
not
hire
them
in
that
high.
B
B
D
F
J
Them
question
I
have
I,
guess
that
maybe
on
now
I
understand
why
they
100
series
is
up
in
water,
sewer
funds
which
I'm
looking
at
but
I,
don't
notice
any
changes
in
the
in
the
areas
where
we've
had
some
discussion
earlier
supplies
and
services.
You
know,
for
example,
the
cost
of
electricity
and
and
natural
gas
that
both
of
the
plants
will
be
substantial.
Won't
it
be
increases
yes,.
K
B
All
I'm
saying
this
is
that
between
the
discussion
we
had
a
week
ago,
all
I've
had
free
time
to
do
is
most
of
the
payroll
I
haven't.
I
did
do
some
things
in
parks
and
recreation
because
I've
been
down
there,
a
lot
in
the
last
six
months
and
I
knew
and
we
had
built
some
budget
models
there.
I
haven't
touched
a
lot
of
those
other
areas
yet
so.
J
B
But
there's
also
it
which
gets
tricky
like
asking
employees
that
are
going
through
the
steps
you
have
to
go
in
individually
and
check
each
one
to
make
sure
where
it's
slaughtering,
where
it's
in
there.
No
that's,
that's
part
of
it.
The
police
are
the
fire,
the
easy
ones.
We
don't
have
a
policeman
or
a
fire
where
that
isn't
the
top
of
the
pay
scale.
So
you
just
changed
the
pay
scale.
It's
all
done.
B
J
A
B
Only
section
in
that
that
I
actually
work
much
harder
was
the
Xzibit
V
of
that
work.
We
really
had
recognized
that
the
middle
of
state
minimum
wage
is
going
up
to
$7.
We
tried
to
classify
and
part
of
the
recreation
and
you'll
see
sometimes
people
who
a
position
in
both
the
$7
7
750,
because
you're
recognized
as
they've
been
there
longer
they.
You
know
if
they're
there,
two
years
they're
gonna
get
paid
more
than
the
beginning
wage
rate.
B
B
Never
the
Walker
later
too
late
this
afternoon
was
the
reclassification
of
those
that
are
eligible
for
overtime
and
not
eligible
for
overtime.
So
now,
with
that,
I
will
have
to
go
into
their
individuals,
agent,
I,
budgeted
in
overtime
for
this
person.
That's
now
eligible.
If
they
worked
before
or
no
longer
eligible
did
I
do
it
and
I
got
a
cross-check.
A
D
E
D
Have
had
a
contract
with
a
company
called
AIG
life
insurance
for
several
years,
our
personnel
director,
Beverly
Henderson,
has
been
talking
to
her
nervous,
panting
administrators
and
companies
that
that
handle
our
insurance
and
they
have
recommended
a
new
company
called
VP
incorporated.
The
bottom
line
is
basically
AI.
G's
costs
are
about
eleven
dollars
from
employees
VIGS
or
ten
dollars,
and
seventy
cents
an
employee,
but
in
an
annual
budget
that's
several
thousand
dollars.
Different
AIG
is
three
hundred
and
five
thousand
EPS
288,000.
D
A
J
A
J
L
You,
mr.
president,
council,
this
is,
we
proved
engineering
on
this.
Of
course,
a
while
ago,
you
might
remember
it
I'm,
just
the
extension,
and
now
we
need
to
approve
the
funds
for
construction.
I
will
note
that
80%
of
its
can
be
carved
by
grant
and
they
were
getting
another
100,000
from
the
clean
ohio
trail
fund.
So
we're
just
kidding
need
to
get
this
past
three,
so
we
can
accept
the
bids
or
bid
just
you.
A
A
Another
business
next
Sunday
of
six
o'clock
I
am
having
a
get-together
at
my
home
that
the
attendees
will
include-
or
at
least
the
numbers
of
council
will
be
invited
which
I
believe
legally
would
constitute
a
meeting
of
council,
and
although
there
is
going
to
be
no
addenda,
I
would
like
to
make
that
announcement
and
any
citizen
or
a
member
of
the
press
that
would
like
to
come
and
be
there
to
make
sure
we
don't
discuss
anything.
We
shouldn't
otherwise
or
not
more
than
welcome
to
attend.
A
I
I
F
I
K
Gregory
brought
hers,
14,
gravel,
Avenue
and
natural
resource
professional
and
I
would
like
to
weigh
in
on
this,
especially
in
regards
to
appointment
to
people
to
a
committee
before
in
the
time
of
appointment,
has
even
arrived,
abject
and
as
far
as
the
previous
year,
I
don't
believe
there
you
have
to
ask
the
law
director
I,
don't
believe,
there's
a
precedent
where
someone
can
be
approved
in
we
caught
this
and
name
for
it
legally.
In
Reverse
and
I
would
like
to
see
that
see,
council
would
look
to
see
the
require.
K
A
A
F
A
F
A
D
F
A
F
L
A
Seeing
none.
We
have
a
number
9
on
our
agenda
tonight,
it's
an
executive
session.
It's
my
understanding.
The
council
may
wish
to
come
back
into
session
afterwards
and
when
I
record-
and
we
may
take
council
action
afterwards.
Normally
we
adjourn
the
night
may
be
different
if
members
of
the
press
or
anyone
would
like
to
wait
in
council
chambers,
we
will
let
you
know
when
we
are
finished.
As
far
as
I
know,
we
will
be
going
back
on
the
air
as
soon
as
the
session
is
over
with
so
citizens
of
Athens.
A
G
E
A
A
E
F
A
G
Like
to
indicate
to
the
public
that
the
city
has
received
a
request
from
its
litigation
couple,
it
again
canceled
on
the
lead
base
case
base
case
to
paint
case
to
voluntarily
dismiss
the
case
without
prejudice,
because
the
attorney
general's
office
has
filed
suit
against
the
lead-based
paint.
Manufacturers
and
I've
been
informed
that
all
other
major
cities
that
have
filed
suit
against
the
big
manufacturers
on
lead-based
paint
issue
have
dismissed
without
prejudice.
G
If
we
dismissed
the
case
but
I'm
requesting
that
counsel
do
tonight
is
to
adopt
a
motion
authorizing
my
office
to
dismiss
the
lead-based
paint
case
upon
receipt
of
assurances
to
my
satisfaction
that
the
public
documents
requests
have
been
withdrawn
and
that
all
defendants
will
not
see
quantum
merit
against
the
city
of
Athens
in
their
litigation
counsel
will
not
see
c'mon.
There.
