number

ordinances
before
we
do
that
we
have
several
items
of
business,
the
first
of
which
is
to
establish
a
quorum.
All
members
of
council
are
present
tonight.
Our
clerk
of
council
Debbie
Walker
is
not
with
us
ass
evening,
so
we
will
be
appointing
an
acting
clerk
of
counsel
to
record
some
of
the
disposition
of
our
ordinances
tonight
and
I
know.

two
different
bodies
on
wednesday

7pm
council
members
will
be
having
an
informal
gathering

oh

Trustees
members
just
to
get
to
meet
each
other
personally
share
interests
and
hopes
for
the
city
and
then
on
Friday
at
twelve-thirty
in
Baker

council
members
will
be
meeting
with
Student
Senate.

this

several
times
a
year,
have
done
it
two
or
three
times
to
share
information
about
city
and
pending,
not
pending
legislation,
but
areas
of
legislation
that
we
have
engaged
in
since
council
or
since
these
student
body
came
back
to
the
University.
This
fall
and
I
think
those
are
all
the
communications
that
I
have
at
this
point.

communication
from
a
West
Side
resident
of
the
First
Ward,
who
recently
emailed
me
John
spot
forth,
had
some
suggestions
for
the
municipal
Arts
Commission,
one
of
which
was
to
contact
the
Kresge
Foundation
and
that
they
have
potential
grant
funding
available
for
government
entities.
Likewise,
the
Ohio
Arts
Council
and
the
National
Endowment
for
the
Arts
both
have
awarded
grants
in
the
past.
For
that
level,
he
also
expressed
a
minor
concern
about
some
Park
two
trailers
on
rarden.

just
wanted
to
say,
I've
been
contacted
by
the
audubon
society
and
they
wanted
to
thank
the
city
of
Athens
in
the
county
commissioners
for
allowing
us
to
host
the
sounds
of
so
many
different
birds
that
all
hours
of
the
night
and
they're
sure
that
the
citizens
of
Athens
are
quite
entertained
by
these
cells.
So
I
just
wanted
to
make
council
where
that
were
again
in
the
spotlight.
For
that.

Isaac,
that
is
not
a
city
test
or
trial,
is
going
on
with
those
interesting
bird
sounds
I,
hear
them
daily
as
well.
I
have
a
number
of
things.
I've
received
a
number
of
communications
from
citizens
concerned
citizens
about
the
what
they
saw
with
the
home
home
street
underpass
or
drive
or
connector,
or
whatever
want
to
call
it.

We
had
a
meeting.
I
believe
it
was
last
week
last
monday
at
one
o'clock
here
in
council
chambers,
with
the
Transportation
Committee,
and
we
did
discuss
that
at
length.
I,
don't
know
how
much
the
public
was
aware
of
that.
But
one
of
the
comments
that
was
made
is
that
that
that
concept
is
largely
being
has
been
rethought
and
is
not
likely
to
move
forward
at
all.
So
I
wonder
one
to
know
that
I
appreciate
the
emails
that
I
did
receive
and
put
some
alarmed
residents.
So
that's
something
that
we
have
essentially
put
on
the
shelf.

I
might
read
this-
and
he
was
fine
with
that-
I
have
to
do
with
parking
spaces
and
in
particular
rental
units
in
the
uptown
area,
in
our
high
density
area,
or
what
I
consider
be
one
of
our
higher
density
areas,
but
having
to
do
with
the
economic
impact
that
this
individual
experiences
losing
over
twenty
thousand
dollars
over
a
four-year
period
of
time
for
apartments
in
which
he
has
to
have
parking,
and
he
goes
on
I'm
going
to
quote
this
law
does
not
make
sense
in
Athens.
It
actually
encourages
students
to
bring
their
cars
uptown.

send
this
email
on

counsel,
and
I
will
so
that
you
can
see
this.
This
is
not
the
first
email,
this
type
that
I
have
seen
for
rental
units
that
are
again
in
our
Uptown
area
and
the
last
item
that
I
have

that
I've
been
in
communication
and
even
had
a
meeting
earlier
today
with
Frank
Porter

was
at
the
volunteers
Awards.
If
you
will
up
at
the
athens
county
convention,
Visitors
Bureau,
the
the
main
school
house
and
from
council.

a
beautiful
area
with
native
plantings,
one
of
the
things
that
came
up
at
that
meeting
was
the
possibility
of
council,
possibly
crafting
an
ordinance
that
would
look
at
having
any
part
that
or
any
garden
area.
That's
developed
in
our
city,
parks
or
city
properties
that
we
stick
to
native
plantings
and
by
and
large
perennials.
So
he
and
I've
been
meeting
talking
about
this
and
I'm
sure
that
we'll
be
meeting
with
counsel
or
maybe
in
committee,
in
the
future,
to
look
at
something
like
this
seemed
reasonable
to
me,
so
that
my
communications.

community

sides

people
in
the
community
have
been
active
in
communicating

as
well.

wanted
to
share
that
briefly.

Airbnb.
You
know.
Bed
Marcus's
have
been
around
for
a
long
time
all
over
the
globe
and
Airbnb
is
not
a
completely
new
idea.
It's
a
new
way
of
marketing
bed
and
breakfast
so
I
think
that
when
we
talk
about
bed
and
breakfast
wherever
we're
talking
about
them,
I,
don't
I
think
that
the
code
will
go
to
talk
about
Ben
breakfast
and
not
necessarily
how
their
market
it.

it
used
to
be
that
you
had
books,
and
now
you
have
the
computer
and
I
understand
you
know
all
the
other
things,
but
if
people
had
been
in
bed
and
breakfast
a--'s
in
Britain
for
a
long
time,
they're,
basically
people's
houses
and
they
go
and
they
run
to
room
so
I,
just
like
to
put
that
out
that
it
Airbnb
is
not
like
this
magical
subsection
of
Ben
breakfast
is.
This
ordinance
is
basically
looking
at
our
three
b,

b,
2
and

to
d.

It's
looking
at
making
sure
that
Ben
breakfast
a--'s,
which
I
agree
with
many
people,
are
needed
in
this
city
that
when
they
are
developed
and
marketed,
however,
they
were
marketed,
make
sure
that
one
they
turn
they
collect
transient
guest
tax,
which
is
the
thing
that
every
overnight
transient
guest
facility
collects
meaning
hotels
and
motels
in
the
city,
the
other.
The
other
thing
is
describing
what
a
bed
and
breakfast
is
I've
gone
back
and
forth
with
city
administration
with
planners
with
other
cities
and
I
was
gay
change
it
to
just
a
bed.

But
Ben
breakfast
is
a
well-known
definition
of
what
these
hotels
and
motels
short-term,
more
intimate
facilities
are,
and
so
I
decided
on
recognition
from
the
planner
in
the
city,
not
changing
the
full
definition
not
to
include
breakfast.
So
that
means
a
bed-and-breakfast
can
serve
breakfast,
but
they
are
not
required
to
in
our
three
zones
that
we
have
decided
on
council
after
multiple
meetings
with
people
to
require
that
in
our
three
zones,
the
bed
and
breakfast
has
to
be
owner,
occupied
or
owner-managed.

They
are
in
be
one
there,
a
conditional-use,
meaning
that
you
have
to
make
sure
that
you
go
through
all
the
things
that
are
a
usual
use
and
then
you
have
to
jump
another
hurdle
be

and

It's
a
permitted
use.
So
it's
not
quite
as
regulated,
however,
for
all
the
bed
and
breakfast
in
the
city,
they
will
have
to
get
a
bed
and
breakfast
permit.
So
that's
pretty
much.
We
have
struggled
with
this.

say
that
right
now,

Planning
Commission
is
looking
at

and

suggest

they

committee

all

to
make
it

people
have
their
property
rights
and
people
have

conditions

they
moved

neighborhoods

respected

bed

breakfasts
and

appreciate
the
type
of
time
that
you
have
spent
trying
to
define
it
in
a
way
that
may
work
for
Athens,

it
is
pretty
closely
to
what

would
think
of
as
a
traditional
bed
and
breakfast
I'm
glad
that
you're
going
to
collect
the
tax
I'm
glad
that
you're
going
to
require
parking.
I
am
glad
that
you
are
going
to
I
think
limit
the
number
of
beds
available.
I
Excuse
me,
I,
had
assumed
when
I
read
this,
that
we
were
going
to
require
owner
occupancy,
so
I'm
a
little
bit
concerned
about
the
fact
that
this
may
simply
be
owner-managed,
which
means
that
the
owner
may
be
at
a
very
far
distance
and
have
very
little
day-to-day
control
and
certainly
will
not
necessarily
be
on
site
to
control
what
goes
on,
but
nevertheless,
I'm
glad
to
have
you
consider
this
pre
carefully.
My
second
comment
is
an
objection
which
doesn't
really
surprise.
I
You
expect
I
want
to
say
that
over
time,
a
long
time,
our
districts
have
been
considered
whether
sacrosanct
businesses
have
traditionally
in
Athens
and
in
most
other
places,
not
been
welcoming
businesses.
We
have
zoning
for
purpose.
It's
two
separate
different
uses,
a
business
use
in
an
hour
district,
even
if
you
consider
it
twins
additional,
which
I
don't
necessarily
do
because
I
live
in
an
r1
zone,
data
button
or
three
zone
which
is
still
residential
and
I.
Think
people
who
live
there
would
be
concerned
to
think
that
they
would
have
a
business
next
door.
I
So,
let's
see
what
else
I
wanted
to
say
about
that
I
guess
I
just
want
to
say
that
I
think
it's
still
true
that
businesses
don't
belong
in
residential
districts,
I'm
glad
that
you
are
proposing
some
restrictions.
That
I
think
are
very
important,
but
nevertheless
this
is
a
business's
of
imposing,
even
though
it's
or
three
thank
you.

in
November,

trees

them

hire

butchers

many
trees
in

now

think

they're
requiring

subcontractors

better
job

we've
done
it
one
year
at

time
we've
been
able
to

address
some
of
the
issues
as
they
come
up
instead
of

five
year
or
three
year
program.

acknowledge
that
we're
fortunate
in
our
community
that
we
are
a
tree
city,
USA
and
that's
a
nice
title
to
have,
and
many
of

the
community
are
thankful
and
welcome
the
presence
of
so
many
trees
and
diversity
within
within
our
tree
canopy.
So
it
is.
It
is
a
big
issue
and
I
think
this
yearly
contract
helps
with
holding
some
accountability
within
that
realm.

is.
There
are
multiple
agreements
that,
when
I
was
on
counselors
agreements
to
include
not
just
the
tree
trimming,
but
also
the
treatment
of
poles
that
are
in
our
wellhead
protection
area,
to
her
being
able
to
negotiate
to
where
they're
not
treated
poles
with
creosote
and
other
nasty
things
that
can
be
put
on
them,
it
led
to
the
five-year
leach
or
the
one-year
leach
for
that
matter.

that's
a

was
fine
with
doing
that,
knowing
that
maintenance
was
going
to
have
to
be
enhanced
with
possible
replacement
of
poles,
but
they
they
felt
that,
given
that
it
was
our
wellhead,
it
was
not

difficult
negotiation
to
have
with

good
negotiations
going
on

that
they're
open
to
what
we
suggest
or
what
we
demand.

Origin
is
from
the
municipal
court
of
the
city,
which
is

second
floor
right
below
our
feet.
Recently
they
upgraded
their
computer
system
software
to
do
bigger
better
more
things.
Unfortunately,
their
actual
computer
equipment
is
very
antiquated
and
just
hardly
keep
them
able
to
keep
up
with
the
the
new
software
and
sighs
and
so
on.
So
this
appropriation
ordinance
will
address
that,
and
I
will
read
the
ordinance
now.

is
the
first
reading
for
this
ordinance.
Basically,
this
is
a
improvement
project
for
safe,
a
DA,
accessible
playground
equipment
at
Highland
Park
part
of
we
have
in
this
ordinance
to
authorize
to
expend
up
to
90,000
from
the
recreation
fund
270
by
the
service
safety
director.
We
do
have
a
grant
that
will
pay
for
parts
part
of
the
equipment.
We
know
that
can't
won't
cover
all
of
the
equipment.
So
it's
our
first
reading
tonight
and
I
for
one
am
really
pleased
that
we
were
able
to
put
this
together.

together
to
develop
this
series

routes
that
go
cross
across
the
state
of
ohio,
and
it
just
so
happens
that
one
of
them
bicycle
route,
20,
state
bicycle
route,
20
will
cross
through

city

Athens.

has
asked
us
for
this
passing
of
this
resolution
in
support
of
this
of
this
route,
and
there
is
a
map
up
and
basically
to
give
you
give
you
the
the
key
here.

the
bike
path,
the
bikeway
coming
in
from
nelsonville
so
and
then
the
only
time
that
we
actually
exit
onto
a
street
is
on
the
far
east
side
of
town
on

drive.

to

know
that
the
traffic
count
there
the
last
time

I

was
aware
of

was
about

cars,

cyclists
or
motorists.
