of
2017,
it's
January
third

council
met
at
6pm
tonight
to
review
some
revised
rules
of
council.
These
are
the
rules
by
which
we
operate
during
the
year
and
we've
made
some
I
think
excellent
suggestions
and
reorganization
of
the
rules
and
we'll
be
passing
them
under
a
motion
for
approval
a
little
bit
later
tonight
in
our
business.

Our
first
item
of
business
tonight
is
establishing
the
quorum
and
we
have
all
members,
but
one
Chris
council,
member
Chris
fall
is
not
able
to
be
with
us
tonight.
Our
first
next
item
of
business
will
be
then
disposition
of
minutes,
and
we
have
them
for
the
regular
session
held
December,
fifth
and
12
a
special
session
and
then
a
regular
session
again
on
December
14
2016.
So
if
we
could
have
a

approve
the
minutes
for
these
three
meetings

member
Congress
wanted
to
mention
that
I
have
received
communications
from
several
citizens
applauding
the
city
for
its
strides
on
the
recycling
receptacles,
both
in
the
uptown
area
and
the
residential
recycling
receptacle
arts,
as
well
as
the
resolution
on
the
single-use
bag
reduction.
So
I'm
going
to
pass
that
along
great

brief
acknowledgment
that
I
know.
In
years,
past
we've
received
communications,
I
have
as
well
as
the
mayor's
office
regarding
Armitage
road
and
the
challenges
in
keeping
that
road
free
of
the
many
potholes
part
of
the
road.
The
Challenger
part
of
the
road
is
maintained
by
the
city
and
then
part
of
its
maintained
by
the
county,
but
I
have
received
past
communications
and
was
recently
on
the
road,
and
I
think
we
we
gave
it
a
new
layer
or
it
was
recently
attended
to,
but
thank
you.

You
this
is
one
of
my
obligations
from
the
ohio
revised
code
to
tell
you
what
I've
been
doing
and
what
our
office
has
been
doing
for
the
last
year
and
first,
you
should
know
that
the
position
of
law
director
is
a
part-time
position
requiring
a
minimum
of
30
hours
a
week
to
be
devoted
to
the
position.
I
oversee
the
law
department.
We
have
three
full-time
city
prosecutor's.
During
the
year
of
2016,
we
had
Tracy
mcjames,
Stanley
and
prosecutor
matt
ward.
Those
three
were
prosecutors,
mr.
Stanley
left,
and
today
we
have
a
new
prosecutor.

Her
name
is
Jessica
branner
and
she
started
today.
We
also
have
two
legal
secretaries:
our
city
prosecutor's
prosecute
cases
in
the
Athens
County
Municipal
Court,
and
this
year
there
were
approximately
11,000
criminal
and
traffic
cases
in
that
court.
Approximately
three-quarters
of
those
cases
wave
court
appearance
they
either
pleaded
arraignment
or
are
prosecuted
by
another
jurisdiction,
and
our
three
full-time
city
prosecutors
have
direct
involvement
with
the
remaining
cases
from
pretrial
conference
to
jury,
trial
I.

Also,
as
law
director
provide
legal
advice
to
city
officials
represent
the
city
and
legal
proceedings,
approve
contracts
and
bonds
involving
the
city.
I
keep
council
apprised
of
the
civil
litigation
where
the
city
is
a
party
and
I
also
have
to
provide
this
annual
report.
This
report
was
provided
to
all
the
City
Council
members
and
I
have
hard
copies.
If
anyone
wishes
to
have
a
copy,
I,
don't
know
if
it
will
be
provided
on
them
will
be
in
the
minutes
for
Council
all
right.

It
also
be
in
the
minutes
for
council
but
I'm
glad
to
answer
any
questions.
Last
year,
I
buzzed
budget
was
650
3730
dollars
and
of
that
the
city
received
40
9303
dollars
from
Athens
County
for
the
prosecution
of
misdemeanor
offenses
in
the
unincorporated
areas
of
the
county.
So
what
happens?
Is
our
office
prosecutes
things
that
happen
in
the
city
of
Athens?

We
prosecute
for
a
lot
of
different
jurisdictions,
including
the
city
police,
the
high
university
police,
liquor
control,
the
Sheriff's
Department
State
Highway
Patrol,
but
there
are
things
that
happen
outside
the
city
limits
and
those
misdemeanors
by
contract
with
the
county.
We
prosecute
those
offenses
also.
So
as
far
as
the
prosecution's
this
year,
we
prosecuted
about
750
cases
without
attorney
representation.
Those
are
fairly
simple
cases
where
maybe
it's
a
speeding
case
driving
under
suspension.
Something
like
that.
It's
interesting
to
note
that
that
number
is
down
from
the
previous
year.

The
previous
year
was
1100
cases
and
it's
down
because
of
the
diversion
program,
and
this
is
judge.
Grace's
court
has
a
diversion
program
and
those
are
for
the
lower
level
offenses
and
that
took
about
three
hundred
in
some
cases
away
from
us,
and
that
was
only
for
three
quarters
of
the
year.
However,
our
general
caseload
went
up
slightly
because
we
had
more
cases
with
attorney
representation
prior
to
this
beginning,
the
session
beginning
this
evening,
someone
asked
me
on
our
forum.

We
have
the
word
OVI
and
that's
operating
a
vehicle
under
the
influence
and
last
year
we
did
about
251
cases,
which
was
up
from
the
previous
year,
and
we
have
these
pretty
well
broken
down
into
the
number
of
cases
that
we
prosecuted
things
like
speed,
276,
speeding
cases,
251,
Ovi,
163,
thefts,
100
hundred
ninety
underage
consumptions,
and
it
goes
on.
We
do
domestic
violence
aggravated
menacing
violation
of
a
protection
order.

Sometimes
they
might
be
charged
with
multiple
offenses,
but
we
calculated
that
we
did
about
25
hundred
and
fifteen
cases
past
year,
different
cases.
So
that's
three
different
prosecutors
or
three
prosecutors
handling
that
high
volume
of
case
some
additional.

three

services
by
the
prosecutors.

So
many
jury
trials,
but
that's
about
average
statewide.
Now
not
a
lot
of
cases
go
to
a
jury
trial
so,
and
you
can
see
that
there
are
some
other
things
that
we
did
provided
legal
advice.
Now
to
what
I
did
I
administer
the
office
and
supervise
the
prosecutors
I
meet
with
prosecutors,
discuss
resolutions,
I
wrote
for
legal
flomo
legal
opinions,
provide
advice,
ten
council
and
special
sessions,
10
executive
sessions
provide
training
through
the
ordinances
resolutions
negotiated
union
contract
ministered.

Other
contracts
wrote
some
letters
to
collect
money
on
behalf
of
the
city,
attended,
pretrial
conferences
in
common
pleas
court
that
was
outside
counsel,
participate
in
a
mediation
and,
of
course,
I
worked
with
the
clerk
counsel
and
also
with
President
Council
on
these
rules
and
provide
training
council
and,
most
importantly,
at
the
beginning
of
2006
2016.
We
had
four
cases
pending.
These
were
civil
cases.
There
were
two
new
cases
filed
in
2016.
Three
cases
were
completed.
That
leaves
us
with
three
cases
pending
at
the
end
of
2016.

did
just
want
to
praise
your
office
because
I
know
from
experience
that
you
have
prosecutors
of
the
highest
quality
I
respect
each
and
every
one
of
your
prosecutors
I
think
are
very
ethical
and
they're.
Very
professional
I
wanted
to
explain.
Just
very
briefly.
You
had
mentioned
that
there
were
had
only
been
four
jury
trials,
but,
oh
just
in
case,
anyone
in
the
public
is
interested.

Jury
trials
are
rare,
mainly
because
of
the
potential
cost
of
a
jury
with
being
assessed.
Perhaps
it's
nine
hundred
to
a
thousand
dollars
for
the
losing
party.
Your
records
indicate
that
your
prosecutors
had
2340
court
appearances.
A
great
number
of
those
are
in
fact
trials,
but
their
trials
before
the
judge
and
I
did
just
want
to
emphasize
that
that
this
is
not
the
kind
of
jurisdiction
where
cases
do
not
go
to
trial
because
they
go
to
trial.

You
president
nicely,
this
is
I
think
a
little
bit
different.
This
is
again
a
year-end
review
that
I
put
together.
There
will
be
the
annual
report
that
comes
out
that
we're
hoping
to
have
a
March
or
sooner
I
do
want
to
kind
of
go
through
this.
I'm
going
to
highlight
some
things.
In
paraphrase
a
little
bit
office
off
of
what
I've
provided
to
all
of
you.

Again,
some
big
city
improvements
in
operations
we're
successful
in
securing
our
bond
rating,
keeping
it
double-a
to
also
successful
in
having
the
income
tax
pass,
which
will
bring
much-needed
revenue
for
infrastructure
improvements
and
safety
services.
The
city
rolled
out
the
64
gallon
blue
bins
to
a
large
number
of
residences
and
to
which
I
believe
has
been
well
received
by
March
and
finally,
the
24
big
belly
recycling
and
trash
compactors
up
on
Court
Street,
which
have
been
very
successful
in
diverting
a
lot
of
the
recycling
from
our
landfill.

A
lot
of
accessibility
improvements
throughout
the
city
to
start
with
the
lift
that
is
in
the
city,
building
the
improvement
to
the
path
that
goes
up
to
cells
park
pond,
as
well
as
the
highland
park
improvements.
A
major
park
convert
in
park,
playground
improvements,
but
also
the
rubberized
surface
that
is
being
or
has
already
been
laid
up.
There.

Arts
parks
and
recreation
still
working
with
MSA
sport,
but
contract
with
ms
a
sport
to
look
at
the
pool
design
in
getting
that
project
going.
The
city
acquired
or
was
donated
camper
tan,
13
acres
under
Arts,
Parks
and
Rec
up
on
Long,
View
Heights,
and
then
the
dr
pepper
snapple
kaboom
grant
was.
I
was
a
great
grant
to
receive
for
the
highland
park
project
and
most
notable
the
highland
park
project
is
that
it
was
a
project
for
theirs
neighborhood
input
that
went
into
that
particular
playground
to
get
that
established.

The
fire
department
a
number
of
different
things
you
guys
can
see
on
here,
but
most
notable
the
fire
department
expanded
their
community
outreach
for
the
first
time
in
20
years
they
had
an
open
house
at
headquarters,
providing
education
food
and
thanks
for
the
community,
support
at
least
acknowledging
the
community
for
all
your
support.
The
fire
department
also
worked
diligently
in
changing
their
own
headquarters
and
possibly
station
2.
I'm
not
sure
if
station
2,
bunks
and
lockers
were
redone
cost
savings
with
the
fact
that
they
built
them
themselves,
making
it
a
more
livable
space
for
them.

They
had
60
year
old
bunk
beds
up
there
that
a
lot
of
them
had
significantly
outgrown
the
police
department.
Hired
five
employees
this
year
with
those
five
employees
to
already
are
already
out
ready
for
duty
3
will
be
entering
into
their
training
going
off
to
the
Academy
community.
Outreach
most
notable
again
is
the
shop
with
a
cop
effort
for
hall
or
for
Christmas
the
joint
place,
Advisory
Council
community
BBQ
and
the
other
popular
dare
program.

The
you
see
the
fest's
again,
we
have
largely
I,
have
been
somewhat
subdued
in
2016
a
lot
of
efforts
in
going
forward
with
trying
to
mitigate
a
lot
of
the
problems
we
see
there,
but
still
it's
a
high-cost
endeavor
when
we're
looking
at
the
total
expense
about
ten
thousand
dollars
per
event.
Code
office
has
hired
a
couple:
people,
a
new
litter,
solid
waste
control,
officer
and
also
administrative
assistant.

Another
notable
on
here
is
the
public
staff.
Are
the
public
stuff
tracking
system
that
we're
using?
Now
you
can
see
from
2015
it's
it's
beyond
exponential.
It's
a
multiplicative
increase.
We
know
we
started
in
2015
with
38
cases
by
2016
it
jumped
up
to
562
cases
that
are
being
recorded
and
having
and
addressed
I
think
a
lot
of
that
is
due
to
people
becoming
more
accustomed
to
using
public
stuff
and
reporting
problems
or
concerns.
They
see
them
lands
and
buildings.

A
lot
has
been
done
to
the
city
building,
most
of
it
being
the
building
envelope,
but
also
some
HVAC
upgrades
that
we're
seeing
within
the
building
itself
the
parking
garage
as
everyone's
aware
that
2.2
million
dollar
renovation
that's
taken
place
with
that,
but
replacing
both
elevator
cars
as
well
as
a
lot
of
structural
and
driving
surface
repairs
done
some
progress
in
the
armory
asbestos
abatement
in
the
armory.
We
also
had
the
clothes
out
of
the
the
Athens
armory
market
study,
which
took
place,
which
was
funded
by
the.
H
Funded
by
the
State
Historic
Preservation
Office
through
Ohio
history
connection
and
where
they
landed
on
that
with
this
market
study
was
the
Armory's
best
use
or
more
most
useful
use
would
be
a
mixed
design
of
a
cultural
center,
/
business
/
retail
space
for
the
armory,
as
if
we
move
forward
and
as
we
move
forward
and
then.
Finally,
a
lot
of
engineering
public
works
projects,
as
you
all
are
very
familiar
with
going
forward.
Notable
the
franklin
street
improvements
have
taken
place:
major
water
and
wine
replacements
on
grand
park.

The
north
court
street
storm
tunnel,
which
was
a
major
major
project
that
had
had
to
take
place.
Diplo's
depot
street
lift
station.
The
richland
avenue
between
the
bridges
project
in
between
on
richland
avenue,
between
Schaeffer
and
Oxbow
bridge
was
completed,
and
that
was
in
collaboration
with
Ohio
University,
significant
bridge
replacement
on
dairy
lane,
as
well
as
repair
to
the
bridge,
the
superstructure
and
the
abutments.
Then.
Finally,
under
engineering
and
Public
Works,
the
much
anticipated
opening
of
the
new
bike
path.
Bike
paths,
/,
the
Columbus
road
bike
paths
were
with
its
bridge
and
roadway.

briefly

appreciation

the
mayor
for
reviewing
and
sharing

it's
a
it's

lot
to
accomplish
and
it
takes
a
group
effort
from
legislative
branch
and
executive
branch
and
I
appreciate
your
leadership
on
a
lot
of
these
endeavors
and
I
also
appreciate
the
attention
to
detail
on
a
number
of
these
projects,
too
many
of
which
happen
you
know
to
list
or
single
out.

have
received
positive
feedback
from

community
on
a
number
of
these
projects
and
it's
important
to
hear
it's
easy
to
be
a
critic.

reading

Many
of

know
that
President
mcdavis
has
served
the
University
in
the
community
since
2004.
We
thought
we'd
have
him
here
in
Athens
until
june
30,
but
learn
just
a
few
weeks
ago
that
he
will
be
accepting
a
new
position
on
and
so
his
last
day
will
be
februari
17th
at
Ohio,
University
and
acknowledging
that
council
members
have
created
a
resolution
of
appreciation
for
president
mcdavis
and
I
believe
councilmember
Butler
has
the
text
of
that
to
move
the
motion
forward.

mcdavis,

ohio
university
in
2004,
fostered
the
open
flow
of
information
and
mutual
aid
through
regular
meetings
between
the
city
and
the
university
leadership.

whereas
president
mcdavis
worked
with
the
city
to
provide
university
support
for
nestle
municipal
fire
equipment
and
whereas
president
mcdavis
partnered,
with
former
marawa,
to
create
a
Memorandum
of
Understanding
between
the
city
and
university.

working
relationships
between
the
two
entities
and
whereas
President
mcdavis
actively
engaged
University
staff
to
work
with
City
Council
members
to
address
specific
topics,
community
events
and
affordable
housing.

mcdavis
has

Appalachian
scholars
and
the
urban
scholars
program,
which
in
turn,
benefits
the
long-term
success
of
the
community

by

council,
the

for
his
years
of
service

university
